Disclosure of Pecuniary Interests at meetings

– Item from Bluett Local Government Handbook

[14.125] A Councillor or a Council Committee member who has a pecuniary interest in any matter with which the council is concerned, and who is present at a meeting of the council or committee at which the matter is being considered, must disclose the nature of the interest to the meeting as soon as practicable. The person must not be present at, or in the sight of, the meeting either at any time during which the matter is being considered or discussed or at any time during which a vote is being taken on any question relating to the matter (s 451). A Councillor who has declared a pecuniary interest in a matter before the council but has withdrawn from the meeting because of that declaration is not counted in considering whether the meeting is quorate for that matter.

Disclosure of Political Donations and Gifts

The Environmental Planning and Assessment Act 1979 places obligations on Councillors, staff, applicants and any person who makes a public submission, to disclose information relating to political donations and gifts during the environmental plan making or development assessment process.

Furthermore, for each planning decision made at a Council or Committee Meeting, the names of Councillors who supported the decision and those that oppose the decision must be recorded.

The fact that political donations or gifts have been made by applicants / proponents of a planning application should not affect whether an application is approved or refused. Political donations or gifts should not be relevant in making a determination. The matter should be determined on its merits. Nor do they provide grounds for challenging the determination of any applications.

Public Recording of Meetings prohibited without Council authority

A person may use any recording device, including audio and visual recording and any device capable of recording speech, to record the proceedings of a meeting of a council or a committee of a council only by the resolution of the council or committee.

A person may, be expelled from a meeting of a council or a committee of a council or using or having used a tape recorder without consent.

Photography

Flash photography is not permitted at a meeting of the Council or a Committee of the council without the consent of the General Manager.

Public Forum (extract from the Code of Meeting Practice)

a) All prospective public forum speakers must advise the General Manager of their wish to address Council by the Monday prior to a Council meeting. They must also provide a verbal or written précis of the subject matter at that time. b) The public forum section shall only operate for a period of thirty (30) minutes immediately after apologies have been formally received. c) Preference shall be given to addressees who wish to speak to any item before Council at that particular meeting. d) The maximum time allowed for each speaker will be 5 minutes. e) Not more than two members of a group may speak. f) All persons addressing the meeting shall speak to the Chair. g) The Chairperson may curtail the public participation where the information being presented is considered repetitive or irrelevant. h) Councillors may ask questions of the person/s addressing Council only if so approved by the Chair. i) Councillors will not enter into general debate with the speakers. j) The Mayor is to approve of variations to this procedure in urgent / compelling circumstances. k) All people / organisations who wish to address Council be made aware of the above condition.

Item 5.1 RECRUITMENT OF GENERAL MANAGER

Recommendation: That a recruitment process for the General Manager of Snowy Valleys Council commence during August 2017, with the newly elected Council to determine the selection and appointment process at its first meeting to be held in September 2017.

Report: On 7th November, Kay Whitehead was appointed as Acting Interim General Manager for Snowy Valleys Council for a period of up to twelve months pending advice from the Office of Local Government about the appointment of a permanent General Manager. Council is required to publicly advertise the permanent position of General Manager, and appoint in accordance with the Act and under the Office of Local Government Standard Contract of Employment for General Managers of Local Councils in New South Wales. The Administrator has taken the view that the newly elected Council should appoint the permanent General Manager of Snowy Valleys Council following elections to be held on 9 September 2017. It is therefore proposed to commence the recruitment process by advertising the position during August 2017, with applications closing shortly after the middle of September, and with Council to determine the selection and appointment process at its first meeting.

Item 5.2 TERMINATION OF APPOINTMENT OF ACTING INTERIM GENERAL MANAGER KAY WHITEHEAD

Recommendation:

1. That Kay Whitehead’s temporary appointment as the Acting Interim General Manager is to cease upon the appointment of a replacement Acting General Manager effective from a date to be determined by the Administrator, but no later than 8 September 2017.

2. In light of Ms Whitehead’s permanent position as Deputy General Manager being made redundant following the recent organisational restructure, Ms Whitehead will cease her employment with Council effective from her final day as Acting Interim General Manager.

3. Ms Whitehead will receive a termination payment in reliance upon clauses 10.3.5 and 11.3 of the Standard Contract of Employment to be calculated from her final day of employment.

4. The Administrator is to publish a press release recognising the significant long term service of Ms Whitehead to Tumbarumba Shire and, more recently, Snowy Valleys Council.

Purpose of Report: The 4th quarter budget review is currently being prepared for 2016/2017. Tabled in this report are a list of projects that have been identified as not completed in 2016/2017 and funds have been requested to be carried over to 2017/2018 for expenditure.

Recommendation:

1. That Council note the list of projects transferred to reserve.

2. That the transfers to Uncompleted Reserve, Capital Works Reserve, Plant Replacement Reserve, Water and Sewer reserves totalling $6,818,015 be carried forward and endorsed for expenditure in 2017/2018.

Report: The 4th quarter budget review in conjunction with preparing year end statements is currently being prepared for 2016/2017. A review was carried out by staff and the following list of projects have been identified as being not completed or started by June 30. It should be noted that projects Council has endorsed in 2016/2017 that have already started or had costs committed against them but are not completed by year end, do not require approval for expenditure per s211 of the Local Government (General) Regulation 2005. These projects have only been included in the following tables for Council information. It is requested that Council review these transfers and endorse the recommendation that projects listed in the following tables be endorsed for expenditure in 2017/2018. The total transferred to reserves is $6,818,015 of which $3,221,462 had already been committed by 30 June 2017. Totals and projects transferred to reserves comprise the following.

7.1 REQUEST FOR SPONSORSHIP

Purpose of Report: Snowy Valleys Council has received a request from Upper Murray Challenge event organisers to sponsor the 2017 event.

Recommendation:

That Council approve the request from Upper Murray Challenge event organisers for $1,200 cash sponsorship and in-kind support for the 2017 event.

Report: During July 2017, Council received a request from Upper Murray Challenge event organisers for sponsorship and in-kind support for the 2017 event. Upper Murray Challenge typically receives funding from Council through the annual Small Community Grants program, however due to a changeover in event organisers they were not aware of the program this year and missed the application deadline. Event organisers are seeking $1,200 cash, plus in-kind support as per previous years. In 2014, Tumbarumba Shire Council awarded Upper Murray Challenge $2,500 cash, in addition to their in-kind support. Upper Murray Challenge will be held on Saturday 4 November 2017. Commencing in Khancoban, the challenge is a very successful multisport event for the region.

Options Council can choose to accept the request of sponsorship.

Budget Implications: Funding of $1,200 be awarded in addition to the allocation for the annual grants program

7.2 PROPOSED CROWN ROAD CLOSURE

Purpose of Report: To consider a request by the Department of Lands to close part of a Crown Road.

Recommendation:

That Council not support the closure of public roads outlined in Cluster 583976.

Report: Council has received an application from the Department of Lands for the closure of the Crown Road as indicated on the attached map. Roads are not always constructed on these corridors and the Lands Department is proposing to sell these portions of land. Council has 28 days to reply to the request. CL583976 is located on the southern side of the Khancoban Pondage spillway. Practical access for many of the residents on the southern side of the spillway is over the spillway itself. This is not a road corridor, gazetted road or legal access and is owned by Snowy Hydro Limited. Snowy Hydro Limited may choose to close this access at any stage as the dam wall is their responsibility and asset. Snowy Hydro has specifically stated on many occasions that they cannot guarantee access via the spillway. The legal access for these properties is via the Crown Lands owned road corridors which are shown on CL583976. If these were to be closed and the access via the Khancoban Pondage wall was limited, no legal access would be available. It is therefore recommended that the public roads in this cluster not be closed.

Recommendation:

That the Minutes of the Building Committee meeting held on 22 June 2017 be received and the following recommendations contained therein be adopted:

4.1 Depot Upgrade

RECOMMENDATION:

That Council endorse the additional funding of $75,000 for the Depot upgrade to enable the project to be finalised.

4.2 Khancoban Rose Garden

RECOMMENDATION:

That the following amendments be made to the Landscape Specification document and then proceed to Tender:

1.7 Access to Site and Storage - SVC is to advise where on site stock piling can occur.

2.2.4 Relocation of Existing Roses – the Director Engineering Services to ascertain if there are any ashes located within the rose garden memorial site.

5.5 Signage – to be the responsibility of SVC. Should contain history, species. Signage will not be part of the Tender.

4.3 Khancoban Swimming Pool Upgrade

RECOMMENDATION:

That an additional $20,000 be allocated from the general fund towards upgrading of the toddlers pool at Khancoban at a total estimated cost of $85,000 with the remainder ($65,000) to be funded from savings in the redevelopment of the main pool and from funds held in Khancoban community reserves.

4.5 Tumbarumba Creek Caravan Park Upgrade

RECOMMENDATION:

1. That the workers accommodation be located on the northern side of the Tumbarumba Creek on the existing mod football field, subject the mod field being included in the redevelopment of the showground oval.

2. That the Director Environmental Services provide a detailed budget report for consideration to the next Building Committee meeting.

3. That the Hyne Community Trust be flagged as a possible source for additional funding.

RESOLVED:

That the Minutes of the Building Committee Meeting held on 4 April 2017 be noted.

3 BUSINESS ARISING Item 4.1.3 – Director Engineering Services enquired into the status of the free camping in Union Lane. 4. AGENDA ITEMS 4.1 DEPOT UPGRADE

RECOMMENDATION:

That Council endorse the additional funding of $75,000 for the Depot upgrade to enable the project to be finalised.

4.2 KHANCOBAN ROSE GARDEN

RECOMMENDATION:

That the following amendments be made to the Landscape Specification document and then proceed to Tender:

1.7 Access to Site and Storage - SVC is to advise where on site stock piling

2.2.4 Relocation of Existing Roses – the Director Engineering Services to ascertain if there are any ashes located within the rose garden memorial site.

4.3 KHANCOBAN SWIMMING POOL UPGRADE

RECOMMENDATION:

That an additional $20,000 be allocated from the general fund towards upgrading of the toddlers pool at Khancoban at a total estimated cost of $85,000 with the remainder ($65,000) to be funded from savings in the redevelopment of the main pool and from funds held in Khancoban community reserves.

4.4 TUMBARUMBA LIBRARY FENCE

RESOLVED: That Council not proceed with the erection of a fence at the Library as it would interfere with the open space around the Library.

4.5 TUMBARUMBA CREEK CARAVAN PARK UPGRADE

RECOMMENDATION:

1. That the workers accommodation be located on the northern side of the Tumbarumba Creek on the existing mod football field, subject the mod field being included in the redevelopment of the showground oval.

2. That the Director Environmental Services provide a detailed budget report for consideration to the next Building Committee meeting.

3. That the Hyne Community Trust be flagged as a possible source for additional funding.

5 GENERAL BUSINESS

Khancoban – Council to make contact with Snowy Hydro to have general discussion on the rose garden, possible land purchase (Scammel Street/ Alpine Way) and the walking track.

Wheel Stops - discussion was held in relation to the wheel stops in The Parade. A copy of a recent newspaper article will be forwarded to Council’s insurance company for advice.

6 NEXT MEETING There was no date set for a future meeting of the Building Committee. There being no further business to discuss, the meeting closed at 11.35am

9. COMMITTEE OF THE WHOLE

The Local Government Act provides that Council may close to the public that part of the meeting that deals with matters of a confidential nature. Section 10(2) lists such matters.

The grounds on which a meeting is closed to the public must be specified in the decision to close the meeting and recorded in the minutes of the meeting.

Recommendation:

That Council move into Committee of the Whole to consider the matters listed in the confidential section of the agenda (Committee of the Whole) in accordance with Section 10(2) of the Local Government Act 1993 for the reasons specified.

9.1 STRONGER COMMUNITIES FUNDING Item 9.1 is confidential under the Local Government Act 1993 Section 10A 2 (c) as it relates to information that would, if disclosed, confer a commercial advantage on a person with whom the Council is conducting (or proposes to conduct) business and Council considers that discussion of the matter in an open meeting would be, on balance, contrary to the public interest.

9.2 COMMUNITY INFRASTRUCTURE GRANT FUNDING OPPORTUNITIES Item 9.2 is confidential under the Local Government Act 1993 Section 10A 2 (c) as it relates to information that would, if disclosed, confer a commercial advantage on a person with whom the Council is conducting (or proposes to conduct) business and Council considers that discussion of the matter in an open meeting would be, on balance, contrary to the public interest.
