1. INTRODUCTION

1. The Regional Roads Development Project (RRDP) is being implemented in four provinces of Indonesia, namely West and North Kalimantan; Central and East Java, envisaged to address important national or strategic road corridors in northern Kalimantan and southern Java to encourage economic growth in the less developed and poorer areas of Indonesia. The rehabilitation, capacity expansion and new construction of roads will improve connectivity and access to services. Specifically, improved road infrastructure in southern Java is necessary for increased economic growth to improve access to markets and to attract investment in that area. Road network development in Kalimantan will ensure that economic development will occur in less developed and remote areas.

2. The Project is a four-year undertaking by the Director General of Highways (DGH or Ditjen Bina Marga) of the Ministry of Public Works and Public Housing (MPWPH) purposely to rehabilitate, improve or newly construct about 476 km of roads and bridges where of the 485 km sub project roads, about 679 m of bridges will involve rehabilitation or replacement and 40 km will be construction of new roads in agricultural areas with existing earthen tracks in some sections.

3. Project financing is with the Asian Development Bank (ADB) and the Islamic Development Bank (IDB) as approved on 24 November 2011 by the ADB Board. The Government of Indonesia and ADB signed the loan agreement on 07 May 2012. The ADB- financed component covers 408 km of road (459 m of which are bridges) while the IDB- financed component includes 77 km of road (220 m of which are bridges).

1.1 Background

4. RRDP comprises of eleven (11) construction packages. Land Acquisition and Resettlement Plans (LARP) were prepared in October 2011 and uploaded on to the ADB website (Table 1).

5. As stipulated in the Loan Agreement:

Schedule 5, Para 5: The Borrower shall, and shall cause the Project Executing Agency to ensure that any involuntary resettlement and / or activities impacting ethnic minorities be carried out in accordance with the agreed LARAPs, ADB Safeguard Policy Statement (SPS), and the Borrower’s relevant laws. In case of differences between Borrower’s laws and regulations and the SPS, the SPS shall prevail. In case of such involuntary resettlement, the Borrower shall ensure (a) the Project Executing Agency shall be responsible for internal monitoring of resettlement activities, including engagement of an external monitoring agency 1 month before commencement of the resettlement activities. The internal and external monitoring reports shall be submitted to ADB every quarter and uploaded on

DGH's website within 2 weeks of their submission; and such monitoring and reporting activities shall be carried out until resettlement has been completed; and (b) the timely provision of counterpart funds for resettlement in order to satisfy the requirements and objectives of resettlement.

Schedule 5, Para 8: The Borrower shall, and shall cause the Project Executing Agency to ensure that ADB’s SPS requirements are applied and implemented for all Project components regardless of financing source.

6. As such, internal monitoring reports are prepared to determine the extent the LARP documents have been implemented in the field and identify constraints and problems encountered during the implementation process. Specifically, this report intends to cover the following concerns:

Compensation and/or other entitlements are provided as per Final LARP, with no discrimination according to gender, vulnerability, or any other factor;

Livelihood restoration measures are designed and implemented including modifications in the programs and provision of additional cash and in-kind assistance to the participating affected households as and when necessary;

Public information, public consultation and grievance redress procedures are followed as described in the Final LARP;

Capacity of AP to re-store/re-establish livelihoods and living standards. Special attention is given to severely affected and vulnerable households.

Affected public facilities and infrastructure are restored promptly; and

The transition between relocation or site clearing and commencement of civil works is smooth and that sites are not handed over for civil works until affected households have been satisfactorily compensated, assisted and relocated.

1.2 Timelines

7. Key time lines (Table 2) are pertinent to note under social safeguards as Project management transitions to more relevant and comprehensive documentation of forthcoming monitoring periods.

1.3 Number of AHs and Budget during Plan and Implementation

Table 3 provides a summary of affected households eligible for compensation/ assistance and total replacement cost and assistance identified during plan and implementation, and source of funds for LARP implementation and the associated cost. In both Kalimantan and Java provinces, timely release of funds was a constraint despite assurances from local governments. Number of AHs and cost during implementation was usually much higher than the plan, and it was because of time span between both planning and implementation is usually long, thus there may be additional affected assets and increased unit price.

Malang District stopped process of land acquisition for replacement of forest land because according to the new government regulation (Peraturan Pemerintah No. 105/2015) replacing acquired forestry land will be provided in the form of riverbank rehabilitation within the forest for commercial and non-commercial purposes only. The rehabilitation has been completed in 2015

2. GENERAL PROGRESS IN LARP IMPLEMENTATION

2.1 Compensation Payment

2.1.1. West Kalimantan

9. Field assessment in order to monitor of LARP implementation of road packages in West Kalimantan was conducted on November 2017 during ADB Mission. Following are monitoring results for each package.

10. Sosok-Tayan; Tanjung – Batas Kota Sanggau. As reported in the previous monitoring report, payment of compensation to the affected households (AHs) has been implemented by the Government of Sanggau on 2013 and 2014, including top up for depreciation have been delivered, so it complies with the project policy. Compensastion paid by the LG is based on preliminary design using a corridor of impact (COI) of 14 meters.

11. However when CTC visited the site in August 2017, the team got information from the Contractor and validated by Head of Sebarra Village about some outstanding issues related to compensation payment. It was reported that there are 11 affected people in STA 21-27 who claim to have land certificate in the road Right-of-Way. It was also noted that besides the eleven AHs above, there are three other AHs in Sebarra Village who claim that their affected trees (oil palm and Gaharu) and secondary structure have not been compensated. Detailed name of those AHs have been reported in the previous monitoring report. According to the Contractor, issues have caused delays in construction. DGH sent letter to Balai Besar Pelaksanaan Jalan Nasional XI Banjarmasin requesting them to address issues in coordination and collaboration with Provincial and District Government.

12. No update is available on follow up actions, thus this is still an outstanding issue until November 2017 when the ADB mission was conducted. More data related with this issue was received by CTC during the mission i.e. (i) There are ROW poles on the left and right side alongside the Sp. Tanjung-Batas Sanggau road section that clarified about the ROW on that location is about 30 m as stated in the LARP document; (ii) The ROW poles also found inside the plantation area which was claimed by those 11 AHs; and (iii) Sample of the certificate was given by the head of village, and on the six samples of certificate, the border of the private land are up to the edge of existing pavement

13. Others issues related with unsettled compensation payment arose during road construction and founded/identified during ADB mission are mentioned in the Table 4 below.

Construction of intersection was hampered by the insuficient ROW. ROW acquired by LG was 15 m, while for development of the intersections need 16 to 23.75 m of ROW.

Shortage of land for the intersection belonged to one household (namely : Agus/Arti) who has lives there since 1998

When the team consult with him during the mission, he have no objection if the land will acquired for the project . Only small part of his land was affected (only about 2% of total of land)

Sta 25 + 525- Batang Tarang Village, Balai Subdistrict

Land needed for outlet of the cross drain (+ 1,5 m x 15 m ) is not acquired yet.

Sta 15 + 540 (R) –Senyabang Village

Stairs access to house located in the shoulder/ drainage.

The said AH (namely Lumbe) rejected his stairs access to his house to be demolished by project since he rejected amount of compensation offered by the LG.

This issue have been settled when the AH consulted during that mission and he agreed to receive compensation in the form of rebuilding that access by the contractor

There are about 11 AHs in Sebarra Village claimed they have certificate land on the existing ROW .

On the six sample of certificate, the border of the private land are up to the edge of existing pavement

Two AHs that their affected trees (oil palm and Gaharu) and one secondary structure belong to one AH have not been compensated

Detailed name of AHs who claimed compensation of their land and who have not compensated are shown in Appendix 5.

14. Tebas-Singkawang - Sambas Bypass: Galing-Tanjung Harapan; Aruk (Bts. Serawak)-Sp. Tanjung. Compensation payment was provided by the Sambas District Government in 2011 for the loss of building and trees/plants. According to verification carried out by CTC in 2015, the project corridor impact (COI) has been in the existing ROW and there is no private land affected by project. Therefore compensation payment for CW-06 is acceptable.

15. Tanjung Harapan - Sambas (Missing Link). As reported in the previous monitoring report, payment of compensation paid for two villages in December 2016 was much lower than the amount indicated in the approved RP. To ensure that the remaining payment will be paid in accordance to the RP, several coordination meeting and communication have been conducted with Sambas LG during June-August 2017. As per coordination meeting held in August 2017, Sambas LG expressed their commitment to implement compensation as per approved RP within this year, including payment of the gap compensation of structure and implementation IRP.

16. In order to get update on this commitment, further coordination meeting was conducted among DGH, BBPJN XI Banjarmasin,CTC, ADB Mission and relevant institution of Sambas LG. During that meeting there were some agreements concluded as follows: (i) Outstanding gap compensation for affected structure will be given in cash and will be delivered completely in first week of December (4 December 2017); (ii) All back up/receipts of those compensation will be delivered to DGH on 10 December 2017; (iii) Income restoration program (IRP) for vulnerable and severely AHs in the form of training, assistance, and distribution of agriculture facilities are ongoing, and if the identified vulnerable AH have not been included in the program for 2017 FY, the IRP will be continued in 2018; and (iv) Budget for replacement of affected plants owned by LG has been allocated and the plants will be planted after the completion of road construction. The agreement of the meeting was signed by all parties and attached in Appendix 1.

17. During November 2017 mission, it was also recorded that three households from Tambatan Village claimed their lands were affected by the bridge (at Sta 6+900) and therefore, the construction work has been stopped for three weeks. Inventory of affected land and consultation have been conducted between projects and the AHs facilitated by head of villages. They have reached an agreement on the amount of compensation and Sambas LG committed to pay compensation in the mid-December 2017. This commitment was also stated in the coordination meeting with the ADB mission.

18. Simpang Tanjung - Aruk. Due to the change of the land status from 2014 into protected forest and the difficulties in paying compensation for such land status, the DGH decided to return to the original engineering design with 2 lanes and the construction will be done in the existing 14 meters of the ROW. It was reported that there are several assets belonging to local people found in the ROW of the said segment. The Resettlement and Customary Community Development Plan (RCCDP) for this section was approved by ADB in August 2017. Compensation payment for the affected assets has been completely paid in September 2017. There are two affected structure identified during the RCCDP preparation that have been cancelled due to the changes of the engineering design. This cancellation has been informed and acceptable to the AHs. Even though the terrace of shop belonging to one AH (Kimpengs) was cancelled due to the changes of the engineering design, loss of income allowance was given to him since his shop was affected during construction of drainage and re-installment of portable gasoline kiosk. The total amount of assistance for income loss given is IDR 300,000 or equal to three days of his income from the shop.

19. IRP for three vulnerable AHs in the form of training of cultivation of pepper and distribution of seeds have been delivered in September 2017. Detailed information about implementation of RCCDP will be reported in the Short RCCDP Implementation Report which is under preparation by CTC.

2.1.2. North Kalimantan

20. Bulungan. There is no compensation provided for the loss of land since the road project are located in the existing ROW, forest areas and state land used by peoples for farming without any legal evidence. It was reported in the previous monitoring report all compensation of affected assets and all complaints related to resettlement have been settled for road sections in Bulungan District. But according to the review of sample receipts of compensation received from Bulungan LG (74 of 121 AHs) in March 2017, it appears that there is gap payment in the compensation for structures for 35 out of 74 AHs, and it is likely that there might be additional AHs with gap payment in the remaining 47 out of 121, for which we have not received compensation data. Summary of the gap payment is shown in Table 5 below. The gap was because the LG applied depreciation on the compensation which did not comply with the project safeguards principles and entitlements. This issues will be discussed with Bulungan LG during the mission in early December 2017.

21. Nunukan. For Nunukan District, the compensation payment to affected trees was provided in the form of access road to the plantation and houses built by the Contractor. Report which demonstrated that the assistance provided by the Contractor for the access have been equivalent with the compensation rate has been described in the previous monitoring reports. As per interview by safeguard team to several AHs, they also expressed their satisfaction and have no more complaint about that.

2.1.3. East Java

22. As reported in previous monitoring reports, land acquisition for the land replacement of the forestry land used for the project only achieved 63.6% (31.8 of 50 Ha) Malang District stopped the process of land acquisition for replacement land because according to the new government regulation (Peraturan Pemerintah No. 105/2015), replacing acquired forestry land will be provided in the form of riverbank rehabilitation within the forest for commercial and non-commercial purposes only. The rehabilitation was completed in 2015 and now the Malang LG still propose to get of land use permit (Ijin Pinjam Pakai Kawasan Hutan-IPPKH) from Ministry of Environment And Forestry (Kementerian Lingkungan Hidup Dan Kehutanan).

2.1.4. Central Java

23. Lot 1: CW-01 Tambakmulyo - Wawar – During 4 -7 September 2017, CTC conducted field assessment to address several outstanding issues related to compensation information for the additional AHs brought about by improvements on a separate road connecting to Tambakmulyo-Wawar to enhance access and to see if the implementation is in accordance with the LARP. Following were agenda during that field assessment:

a. Consultation with Bappeda Kabupaten Kebumen in order to: (i) get more information related with their economic empowerment program applied to the villages along the road section during 2012 to 2016 FY; and (ii) informing about there will be additional vulnerable/ severely AHs due to review design on the Sta

0+00 and requested the LG to include them in the benefecieries of LG economic empowerment program 2017 or 2018 FY as per entitlement in the LARP 2011. During the consultation meeting, Bappeda committed to send more data on the existing economic empowerment program to DGH/CTC.

b. Consultation with the Land Acquisition and Implementation Team (LAIT) of Kebumen District in order to get clarity on some issues related with land acquisition process among others are: (i) how was determination of compensation for the affected assets (land and non land); (ii) consultation, participation and disclosure; (iii) any grievance and complaint and the mechanism; and (iv) update information related with renewal land ownership status of affected land. Aside that CTC also informed about the plan to conduct socio economic survey (SES) to AHs at Sta 0+00 and asked their assistance.

c. Key informant interview to Head of Villages of Tegalretno and Tambakmulyo to clarify information related with the renewal land ownership status from the LAIT.

d. Carried out SES to AHs along Sta 0+00 (Tambakmulyo Village, Puring Subdistrict) in order to identify their vulnerability and severity supported by Kebumen District LAIT.

e. Carried out interviews to several AHs in order to validate compensation amount/basis and recorded any grievances/complaints and its solution, if any.

24. Based on these field assessments, following paragraphs describe the summary of results.

a. Compensation for affected assets (land and non-land) complies with the Kebumen LARP 2011 principle, please see detailed analysis in the Table 6.

- Compensation for affected trees/plants comply with the Kebumen LARP 2011 principle

b. Socialization and Consultation. Since this land acquisition of Sta 0+00 is a continuation of previous land acquisition conducted for Tambak-Mulyo road section purposes, then the process of socialization and negotiation went smoothly and quickly. First socialization was conducted on 25 October 2016, and agreement on the compensation amount was reached after two negotiations (22 and 25 December 2016). Payment of compensation was paid on 29 December 2016. All AHs confirmed that they got information already about the project from the LAIT and LG during socialization and from the project staff. Socialization and negotiation was invited all of the AHs. Minutes of meeting of this socialization and negotiation are attached in the Appendix 2.

c. Perceptions and suggestion. The SES obtained APs perceptions regarding the project. On the positive side of the proposed project, 13 AH heads welcome an improved and smooth road, 7 AHs happy received compensation of their affected asset, 5 others believe that the improvement of the road will boost the local economy, while one AH believe their land price will increase due to road improvement. On the negative side, 21 AH heads pointed reduction of their land while 5 AH head mentioned air pollution and increasing noise during construction. Suggestions also mentioned by the AHs to the project, 26 AHs suggested installation of road sign and lamp after construction finished, 18 AHs expect the

project to do watering of the road regularly to reduce increasing of dust, while four AHs expect to get work in the project and planted trees alongside the road after construction finished. Summary is presented in Table 7.

d. Compensation payment. When the CTC conducted SES, the team also validated scope of resettlement impacts as mentioned in the due dilligence report and payment of compensation. Compensation payments have been delivered

completely to all of AHs on 29 December 2017; except for compensation for affected land belong to the village. Receipts of those compensation payment have been attached in the due diligence report submitted to ADB in February 2017.

The transfer process of land assets belonging to the village (government assets) should follow the procedure set up in the Ministry of Home Affairs Regulation No. 1/2016, which states that to release the assets have to get approval from the Governor. To obtain the approval of the Governor, the Village Head must file a letter to the Bupati who will then forward it to the Governor. When the field visit was held in early September 2017, the Village Head of Tambakmulyo Wawar has not made the letter, so that LAIT Kebumen has not been able to make any compensation payments even though the budget has been allocated. However informally communications related to the release of this asset has been done between LAIT / Kebumen LG with the Provincial Government and has been pre-approved.

e. Vulnerability. The vulnerable households have been identified as: (i) households headed by women, (ii) household heads with disabilities; (iii) households falling under the regional poverty line (the district poverty threshold is IDR 313,881.00 per person/month or IDR. 1,318,300.00 per household-average household size among AHs were 4.2); and (iv) elderly household heads.2. Based on the SES (Table 8 below), there are 8 AHs classified as vulnerable: two are women headed households, three elderly headed households, one poor household, one woman headed-poor household, and one elderly and poor household.

f. Severely APs/AHs refer to affected/displaced persons who will (i) lose 10% or more of their total productive assets; (ii) have to relocate, and/or (iii) lose 10% or more of their total income sources due to the project. According to IOL and SES, 11 AHs were categorized as severely because their structure was completely affected, while other 3 AHs lose 10% or more of their total income sources due to the project (their shop was entirely affected) .As per principle in the LARAP, vulnerable and severely AHs are entitled to participate in the livelihood restoration program and priority for employment of a household member on a project related job. This entitlement have been communicated to the Kebumen LG and PPK staff during that field visit.

g. Entirely affected households. As mentioned above there are 11 AHs affected their entirely structure. Seven out of 11 AHs affected their entirely houses, while the remaining 4 AHs affected their houses and shops. All of 11 relocated AHs have moved their houses to nearby existing location/in the same village. Four of eleven relocated just moved back in their remaining land and two of eleven relocated moved across the road. According information from LAIT, the relocated AHs have enough time to build their new house before their affected house was demolished. This information was validated by three relocated AHs who were interviewed by the team which stated they have sufficient time (6-8 months) before project demolished their affected structure.

h. Business AHs. There are seven shop owners who had their shop affected by the project, six shops were entirely affected while another shop only affected partially. All of six entirely affected shop just moved back in their remaining land. For those seven shop owners, LAIT gave sufficient time to build their new shop or repair the affected part before demolished, there was no loss income due to the project or loss of income can be minimized. This information was validated by AHs when interviewed by the team, in average they need 6 months to build/repair their new shop.

i. Land ownership update. To monitor land ownership update, the CTC safeguards team met member of Kebumen District Land Acquisition Committee (Heri Suharyanto and Badrudin), Head and Scretary of Tegalretno Village (Supriyanto and Teguh Priyatno), Head of Tambakmulyo Village (Arief Dwidarto) and interviewed several AHs from Tambakmulyo Village. Following are the result according to series of discussion and interviews:

i) The update land certificate belong to three AHs from Tegalretno Village (namely Zaenal, Surtijan and Saodah) have been completed in 2011 (sample of the update certificate belong to Surtijan are shown in Appendix 3). The update land certificate was administered by LAC and no fees were charged to the AHs.

ii) The remaining land ownership of affected lands was Surat Pembayaran Pajak Terutang (SPPT) or letter of payable tax payment. The update status of SPPT was adiministered by village official through BPKAD (Badan Pengelolaan Keuangan dan Aset Daerah) in the District Office. Refering to the Bupati Regulation, no fee was charged for updating of SPPT ownership due to public interest. Updated of SPPT ownership in Tegalretno Village have been finished in 2013, while updated of SPPT ownership in Tambakmulyo Village have been finished completely in 2015.This information was validated by several AHs in Tambakmulyo Village interviewed by CTC Safeguard Team.

25. Lot 2: CW-02 Giriwoyo – Duwet. As of this monitoring, the 7 households which refused the land compensation are still unresolved, the compensation funds were already

put in the Court. Those seven aggrieved AHs requesting recalculation of compensation value, and they would file the complaint to the higher court if the LG didn’t meet their request. But since the DGH had decided to use the existing alignment, and thus will not require having seven properties cleared and will not delay the implementation schedule.

26. To get update on land acquisition of aditional land needed for realigned segment of about 4.8 km at STA 13.050, CTC Team met PPK Staff (Ersy Perdhana) on 6 September 2017. According to his information considering the dirsbursement procedure of compensation budget and limitation of construction time, the design at Sta 13+050 and 13+200 was adjusted /optimized using the existing ROW. No additional land is required. This revision has been included in the Contract Variation Order No. 1 (August 2016). Please see revision of design and typical road section on that station in Appendix 4. Due to limitations in Sta ROW 13 + 000 will not be built drainage, slope of the road will be arranged so that water can flow and does not stagnate.

27. Lot 3: CW-03 Congot – Wawar. All affected households (estimated 2,663 households) have been completely paid from 2005-2007, and no more complaint related to the resettlement was raised by AHs up to November 2017.

2.2 Income Restoration Program (IRP)

2.2.1. West Kalimantan

28. Sosok-Tayan; Tanjung – Batas Kota Sanggau. The Sanggau LG have implemented income restoration program to residents living along the project road including the affected households. Target under RRDP is 94 AHs to be included for LRP, and these are all vulnerable AHs. To get clear picture of participation of the affected persons in the program during montoring in the site, CTC team was traced the information through consultation with several relevant stakeholders in the site level (Head of village or staff, Sub district staff, Agriculture Agency Official in Subdistrict level and UPK PNPM Program official). Based on that series of consultations and data collection, it can be seen that some of affected households are part of the beneficiaries of one of more programs implemented by the LG. A total of 35 LRPs were implemented by Sanggau local government amounting to IDR 410,745,350.00 covering a total of 4,918 beneficiaries since 2013 as shown in the following Table 9.

29. To get more data on the perception on the LARP implementation, including IRP, CTC Community Development Team conducted FGDs (Focus Group Discussions) in several villages affected by this road sections in November 2017. Detailed information of the LRPs implementation and AHs perception can be seen in the LARP Implementation Report which is being prepared by CTC.

30. Tebas-Singkawang - Sambas Bypass: Galing-Tanjung Harapan; Aruk (Bts. Serawak)-Sp. Tanjung. There was provision of LRP, though documentation of LRP still has to be completed by CTC. Focus group discussions were conducted by CTC in November 2017 in 3 Sambas villages: Sungai Palah, Senipahan, and Tanjung attended by 13 participants amongst AHs and project beneficiaries to get their perception on the LARP implementation, including IRP. Detailed information of the LRPs implementation and AHs perception can be seen in the LARP Implementation Report which is under preparation by CTC.

31. Tanjung Harapan - Sambas (Missing Link). Nine LRP packages were implemented by the Sambas local government mostly in 2017 and these are presented in Table 10. The list from the local government covers villages under RRDP. There are 52 RRDP AHs in need of livelihood restoration. Even though list of program and participants have been obtained from the LG, but since the participants of IRP can be wife or children other than AHs head, further coordination with related institutions within Sambas LG need to be done by CTC to get exact name and number of AHs participated in IRP. The LG guarantee if there are any vulnerable AHs which were not included as beneficiaries of the IRP program in 2017 FY, they will be included in the IRP program 2018 FY. This statement was included in the minute of coordination meeting with ADB Mission on 23 November 2017.

32. 33. Sp. Tanjung – Aruk: The 3 AHs deemed vulnerable availed of training on pepper production and were also provided with pepper seeds this 2017 by the Contractor through the Contractor’s corporate social responsibility program. A focus group discussion was

conducted by CTC in November 2017 at Kaliau Village to get their perceptions on the LARP Implementation and IRP road. Detailed result will be reported in the LARP Implementation Report by CTC.

2.2.3. North Kalimantan

34. Bulungan. Beside compensation for affected asset, the Bulungan District will provide financial aid to make certificate to all AHs, but as reported in the previous monitoring report, the Secretary of Bappeda Bulungan District confirmed there is no budget allocated for that purpose. The CTC safeguard team need to closely coordinate with Bulungan LG or Project (PPK and/or contractor) to formulate other possible local government agency to implement the program the LRP.

2.2.4. East Java

35. There are 54 AHs enlisted for LRP assistance by Malang local government and all program have been completed in 2015. Table 11 shows that all 54 AHs availed of LRP programs twice.

2.2.4. Central Java

36. Lot 1: CW-01 Tambakmulyo - Wawar As mentioned above during consultation with Bappeda Kebumen in early September 2017, Bappeda commited to send more data on the existing economic empowerment program. And according to some data was received by CTC in October 2017 shows that a total of 3 LRP packages were implemented by the Kebumen Local Government as shown in Table 12. The list as provided by the Local Government covers villages under RRDP for the 45 AHs under the 2011 LARP, while IRP for the total number of 11 AHs additional in 2016 have to be verified.

37. As of this period some outstanding issues for road sections in West Kalimantan have been settled/solved as described in some paras above, however, new resettlement issues have emerged. 4. OTHER CONCERNS AND NOTATIONS

4.1 Internal and External Monitoring

41. With respect to internal monitoring, it is currently being addressed by DGH and reports from 2016 being completed, and this report being the fourth of the quarter of 2017.

42. External monitoring on the other hand will have to commence soonest as only one has been conducted to date, when it should be a semi-annual undertaking. DGH has to coordinate the different units tasked with this undertaking. Due to delays in engagement of the EMA in timely fashion, DGH proposed that, the services of the EMA will be engaged through the CTC Consultancy Contract whereby, an external consultant or an NGO will be procured by CTC. The CTC will only act as the conduit for procurement and administration, whereas the tasks and the scope of work of EMA will be completely independent from CTC. CTC had prepared the TOR of EMA and approval on the TOR from ADB have been issued on 2 August 2017. Bidding process have been started on 16 October 2017.

4.2 Grievance Redress Mechanism

43. There are two grievance recorded during the ADB Mission. First grievance are raised by AH in Senyabang Village (Sta 15+540) of CW-05 Sosok-Tayan, Sp Tanjung-Bts Kota Sangau road section.The said AH (namely Lumbe) rejected his stairs access to his house to be demolished by project since he rejected amount of compensation offered by the LG. This issue have been settled when the AH consulted during that mission and he agreed to receive compensation in the form of rebuilding that access by the contractor.

44. As already mentioned above there are three households from Tambatan Village claimed their lands were affected by the bridge (at Sta 6+900) and therefore, the construction work has been stopped for three weeks. The complainants allowed the project to continue the construction after there was agreement on amount of compensation and guarantee from the LG to paid the compensation.

45. There are no grievances were documented by CTC or even through DSC for other road sections.
