1. Introduction

1.1. Project Background and Description

1. The Asian Development Bank (ADB) is supporting ‘Assam Power Sector Enhancement

Investment Program’ (APSEIP) through a multi-tranche financing facility (MFF) to support

continued investment in the state power sector, which is necessary to support economic

growth and poverty reduction. The investments under the program are intended to (i)

facilitate increased power transfers to accommodate increased demand and economic

growth; (ii) improve supply-side energy efficiency by system de-bottlenecking and reducing

technical losses; (iii) reduce the intensity of greenhouse gas (GHG) and other emissions via

improved system efficiency; (iv) support expanded private sector participation in

distribution system operations and other energy services; and (v) facilitate poverty

reduction via improved electricity services and economic growth.

2. The impact of the investment program will be a sustainable state power sector with

increased T&D capacity to support inclusive economic growth. The outcome will be

enhanced quality and expanded service delivery of electricity through improved technical,

commercial, and financial performance and capability of power utilities.

3. The Government of India and Government of Assam have requested ADB to provide

US$ 200 million loan funding under “Assam Power Sector Enhancement Investment

Program” via a Multi-Tranche Financing Facility (MFF) to support continued investment in

the state power sector, which is necessary to support economic growth and poverty

reduction. The proposed investments are necessary to:

i. Facilitate increased power transfers to accommodate increased demand and

economic growth;

ii. Improve supply-side energy efficiency by system de-bottlenecking and reducing

technical losses;

iii. Reduce the intensity of greenhouse gas (GHG) and other emissions via improved

system efficiency;

iv. Support expanded private sector participation in distribution system operations and

other energy services; and

v. Facilitate poverty reduction via improved electricity services and economic growth.

4. GOA and APDCL are the Executing Agencies (EA). The field units of APDCL are the

Implementing Agency (IA) for the ongoing MFF.

5. In Tranche-3, a total of 29 new sub-stations will be constructed for which 620.3km of

33kV and 307 km of 11kV new distribution line is being laid. The sub-projects (Tranche 3)

have been bundled into six contract packages i.e. Part-A, Part-B, Part-C, Part-D, Part-E &

Part-F. These sub-projects are spread in different districts of the Assam state. The details of

sub-projects identified under Tranche-3 are in Annexure 1. The Tranche-3, APSEIP is

hereinafter and throughout this Report, referred to as the ‘Project’.

1.2. Purpose of the Report

6. The report capture overall social safeguards implementation progress in compliance

to project’s Resettlement Framework and regulatory requirements. The various social

safeguard related issues addressed during the reporting period has also been covered, with

reference to the progress achieved and current status of reporting period

7. The current report covers the implementation progress of social safeguard during the

1st and 2nd quarters of 2017.

1.3. Social Safeguard Categorisation

8. As per the Resettlement Plan prepared for the T3 project, Tranche-3 components is

categorized as ‘B’ for Involuntary Resettlement (IR) according to ADB’s Safeguard Policy

Statement, 2009 (SPS).

9. As per RP prepared for T3, there will be no impact on Indigenous peoples except one

scheduled tribe and four scheduled caste household losing small portion of land for

proposed 33/11kV substation. Construction activities will not have any impact on

Indigenous Peoples or Scheduled Tribes of that area. Therefore, Tranche-3 is categorized as

'B’ for Indigenous Peoples.

2. Project Implementation Status

1.1. Overview of Social Impacts

10. The Resettlement Plan (RP) prepared (June, 2011) for the project has identified

social impacts due to acquisition of land, damages to crop, and other losses, due to sub-

station construction and stringing of transmission line. The RP has indicated that sub-

stations were proposed on 17 government land and 13 on private land (including 4 on tea

estate).

11. The implementation status of various RP measures was gathered from the

implementing agency and has been compared with those recorded in the original RP (Table

2.0). During implementation stage, changes of sub-project sites and land area required for

sub-stations were minimized, which resulted to reducing impact on land area. Hence, the

number of affected persons has decreased.

12. In Tranche – III, almost 90% of sub-station are commissioned till December 2016

(Table 2.1). Civil works at three sub-stations and testing of 1 sub-station is in progress. The

installation of pole and stringing of 620.3kms for 33/11kV of distribution line is complete

and 307kms of 11kV Distribution lines are completed till June 2017. Final distribution line

details have been sent from the EA and has been updated and final stringing for both 33kV

and 11kV line is calculated to be 927.3kms.

13. The acquisition of private land for 9 substations is through Direct Negotiations and is

completed. The tea estates have been gifted or have given consents for the construction of

4 sub-stations i.e. Harchurra, Dibrugharh II, Daflagarh, and Nowboicha.(Refer to Annexure-

4)

14. In case of Distribution line, no impacts have been reported within the right of way till

this reporting period.

1.2. Affected Persons

15. The acquisition of private land for 9 sub-stations and four tea estates has affected 17

entities, which include 13 individual private owners. No Non-title holders are affected due

to acquisition of land. The details of affected persons are in Table No. 2.2.

16. No persons has been affected due to stringing of 927.3km length of distribution lines

(33kV & 11kV), till this reporting period. In case of any incidence for loss of

trees/crops/bamboos/tea plants etc. if identified within the right-of-way of distribution

lines, measures suggested in the Resettlement Framework will be adopted.

1.3. Impacts on Land

The construction of 29 sub-stations has impacted an aggregate area of 8.02ha, which

includes private agriculture (1.97ha), tea estates (1.72ha), community (0.08ha) and

government (4.25ha) land.

17. In case of 33kV & 11kV distribution line, the concrete pole foundation does not involve

heavy designed and area of 0.487m2 (0.75m x 0.65m) is required for each concrete pole.

Hence, the damage to land is insignificant.

1.4. Impacts on Structure

18. All sub-stations site identified are vacant land and do not impact any structure. In case

of distribution lines, no impacts on any kind of structure identified till this reporting period.

1.5. Crop Damage

19. The sub-stations sites are all vacant land and do not impact any standing crop. In case

of distribution line, the stringing is done post harvesting and has avoided damage to

standing crop. However, few incidences of damaging standing crop reported and details are

being sought from the implementing agency.

1.6. Impacts on Tree

20. No trees are affected due to the sub-station and stringing of distribution line.

1.7. Impacts on Livelihood

21. A total of 12 households have been affected due to acquisition of land for construction

of 8 substations on private land. As per the socio economic census survey 50% of the

affected households are economically displaced, and while remaining 50% are neither

economically nor physically displaced. However, impact on land has been reduced due to

design modification in sub-station design layout. Consequently, impact on livelihood has

also been minimised (Table 2.0).

1.8. Impacts on Common Property Resources

22. The sub-stations site identified do not impact any CPR’s. In case of distribution line

also no such impact has been identified till December 2016.

2. Compensation

2.1. Land Compensation

23. The land for 13 sub-stations is identified at tea estate and individual private land. All

the four tea estates have given their consent/NOC for sub-station construction. Base on

status provided by Implementing Agency, an amount of Rs. 73,61,386.50/- has been

disbursed to private land acquisition for nine substations.

3. Consultation and Disclosures

3.1. Consultation

27. The implementation of R&R activities is a multifaceted task demanding constant

monitoring during various stages of implementation. Engagement of stakeholders during

various stages of project is necessary due to dynamics at different stakeholder level that

might create more challenges for the program implementation. A continuous engagement

with affected persons is necessary to ensure their participation, identify problems, creates

ownership on program and for smooth sailing of the project.

28. Consultations were conducted at

Bijoy Nagar (Dharapur) and Kahilipara

(Nehru Stadium) substation on 27th

February 2017 for preparation of due

diligence report. During consultation no

concerns of significance were raised on

environmental aspects of the project. The

community welcomed the initiative taken by

APDCL and perceived certain benefits from

the proposed investment program, such as

improved electricity, good power supply,

better irrigation and better living condition

etc (Annexure-2). Due diligence report for the above visit was submitted to The Director,

PMU (APDCL) on 8th June 2017 for final submission to ADB.

3.2. Disclosures

29. To ensure transparency in planning and active involvement of APs and other

stakeholders, the project information, Resettlement Plan report is uploaded in the official

website of the EA (http://www.apdcl.gov.in) and ADB. The official of IA will continue

interacting with affected persons and information dissemination through consultation will

continue throughout Investment Program implementation.

4. Grievance Redress Mechanism

30. The Grievance Redress Committee cell has been formed at circles level to (i) provide

support to AP’s on problems arising from the use of their land/property; (ii) record

grievances of the AP’s and resolve them; and (iii) review grievances involving resettlements

benefits like compensations and assistance to AP’s. A directive in this regard from Director

(PMU), ASEB has been issued to AEGCL and APDCL, who are the implementing agencies of

the MFF. The GRC constitutes representatives of

32. The GRC provide the platform to affected persons (Aps) to first bring their grievances

to the attention of the Project head of the PIU. Grievances not redressed by the PIU will be

brought to the Grievance Redress Committee (GRC) set up at circle level to monitor

subproject Implementation for each subproject affected area. The GRC will determine the

merit of each grievance, and resolve grievances within an outer time limit of three months

of receiving the complaint. The AP has the right to refer the grievances to appropriate

courts of law if not satisfied with the redress at any stage of the process. The set up GRC has

the system of records keeping, contact details of complainant, date of the complaint

received, nature of grievance etc. if any for the ongoing project and taking the necessary

action against the complaint.

33. The general query of AP’s is related to valuation of resettlement benefits,

compensation, relocation, replacement cost and other eligible assistance. During this

reporting period, no formal complaint or grievances from affected people have been

registered.

5. Institutional Arrangements

34. The implementation of the Resettlement Plan requires the involvement of various

institutions at different stages of the project. The primary institutions involved in the project

are:

• Assam Power Distribution Company Limited (EA and IA)

• Project Management Unit (PMU)

• Environment and Social Management Unit (ESMU) at PMU Level

35. The Assam Power Distribution Company Limited (APDCL) is the executing agency

(EA) for the Tranche-3. The APDCL also function as the implementing agency (IA) for the

project with a dedicated Project Management Unit (PMU). The PMU in APDCL has been set

up with overall responsibilities for planning, coordinating, implementing and financing all

resettlement activities. The PMU is assisted by an Environment and Social Management Unit

(ESMU) to deal with the environmental and social safeguards issues.

36. The Environment and Social Management Unit (ESMU) has been set up within the

PMU/APDCL, along with other engineering units, to address all environmental and social

issues of Tranche-3. The ESMU is headed by an Assistant Manager, who works closely with

other staff of the PMU and assists the PMU in getting all necessary clearances and in the

implementation of the resettlement activities prior to the start of any civil works. The ESMU

coordinates safeguard activities both at headquarter and PIU level. All safeguards activities

are managed and supervised by the Assistant General Manager based at the Head Office.

37. At field level, field units of IA are responsible for independent implementation of

sub-project that includes all social safeguards related requirements and RP implementation.

The field units maintain all databases, works closely with Aps and other stakeholders and

monitors day-to-day resettlement activities.

38. To support the ESMU in the PMU has appointed a Social Safeguard Consultant with

responsibility to review and update RPs, based on the Resettlement Framework (RF) agreed

for this MFF and in compliant to relevant ADB policies. In addition, the Consultant’s

responsibilities also include advising and assisting the EA/IA in mitigating Social and

Environmental issues and administration and Implementation of measures in RP, as

required. During the reporting period, Social Safeguard Consultant has provided services on

intermittent basis.

6. Monitoring and Evaluation

39. Monitoring of RP implementation is the responsibility of APDCL through its

PMU/ESMU. APDCL is required to implement safeguard measures and relevant safeguard

plans, as provided in the legal agreements, and to submit periodic monitoring reports on

their implementation performance. APDCL and PMU is required to:

� establish and maintain procedures to monitor the progress of implementation of

safeguard plans,

� verify the compliance with safeguard measures and their progress toward intended

outcomes,

� document and disclose monitoring results and identify necessary corrective and

preventive actions in the periodic monitoring reports,

� follow up on these actions to ensure progress toward the desired outcomes,

� submit periodic monitoring reports (bi-annual) on safeguard measures as agreed

with ADB,

40. RP implementation is monitored through internal monitoring arrangements, to

assess resettlement progress and identify potential difficulties and problems. Internal

monitoring is undertaken by the PMU/ESMU with assistance from the PIU.

41. Monitoring and evaluation reports documenting progress on Resettlement Plan

implementation will be provided bi-annually by the PMU to ADB for review.

7. Conclusion

42. The acquisition of 9 private lands is completed and consent from 4 tea estate has

been obtained for construction of 13 sub-stations. The requisite compensation amount has

been disbursed to affected persons. Various activities are in progress for 3 sub-stations

under package no. ADB/UAZ/02 i.e. 33/11 kV, 2x10 MVA Tinsukia – II (Panitola), 33/11 kV,

2x10 MVA Na Pukhuri / Sreepuria and 33/11 kV, 2x5 MVA Pengeri. Stringing work for 87

distribution line (33kV and 11kV) is almost over except ADB/UAZ/02. The project has

minimal social impact, by minimising land area and proposing sub-station on government

land. No impact is reported at distribution line sub-projects.

43. Executing Agency is closely monitoring and coordinating with respective

departments to expedite in resolving of any social issues and, to complete all social

safeguard activities by loan closing date i.e. June 30, 2017.

Resettlement plan for the 9 private and 4 tea estate substations has been clubbed in one RP

report and has been prepared for final submission end of 2nd quarter of 2017.

Again the Manager Harchura T.E. hi;>s submitted one No Objection certificate to the UIS for construction of the s/s as per schedule below:-

1 An area of land measuring 1 (one) big ha under Dag No. 51; F.S. Grant No.22/24, Of the village Harchura T.E. Dist. Sonitpur, (Assam), which is bounded by (copy Encl)

Further, the Circle Officer, Chariduar Revenue Circle has given go ahead certificate, copy of which is also enclosed herewith.

As the required fund is available with APDCL, under ADB funded project, I request you kindly to arrange for urgent acquirement of this undisputed land from your end for APDCL, to construct the s/s funded by ADB which will definitely improve power supply in the surrounding areas and saturated load will be released from Balipara sub-station.

. The seller demands a cost of Rs. 5.00 Lakh per bigha and after repeated negotiation the amount is fixed at Rs.4.30 Lakh per bigha.

For this purpose v,e will purchase a plot of Myadi Patta land measuring 1 Bigha (excluding approach road) from Sri Dharmeswar Sonowal of village Gagaldubigaon vidc Dag No-269, Patta No-79 .

. The seller demands a cost of Rs. 5.00 Lakh per bigha and after repeated negotiation the amount is fixed at Rs.4.30 Lakh per bigha.

Under the circumstances, I would request you to please allow us to buy the said plot of land for greater interest of the public.

After physical verification of above land and several round of discussions with the land O\vner in respect of fixation of rate, the land owner submitted an offer for sale of land @ Rs. 5 00 Lakh/Bigha But the committee has arrived at a mutually agreed rate of Rs. 4.30 Lakh/Bigha (Rupees four lakh thirty thousand) only with the land owner The owner agreed to provide approach road from NH-52 to the plot free of cost measuring 15 feet wide. I haYe the honour to inform you that a plot of myadi patta land measuring 1 Bigha is propsed to be. purchased at Baginadi for construction of 33/11 KV, 2 x 5 MV A Sub-Station under ADB scheme The member invitee of the committee (Circle officer, Kadam Revenue Ct rcle) refused to sign the negotiated value as it is higher than the government value. The matter was discussed with the DC, Lakhimpur on 23/8/2012 and the DC has advised to negotiate the rnlue amongst APDCL officials with the seller. Accordingly the rate is negotiated and a minutes is prepared which is signed by all APDCL officials.

I am enclosing herewith the minutes of meeting and a passed bill amounting to Rs. 4.30 Lakh for purchase of l Bigha myadi patta land at Uttarkulabali (Baginadi). It may be noted that the approach road of 15 feet wide from NH-52 to the plot will be provided by the land owner free of cost

2. The Committee Members after discussion opined that the offered rate of Rs. 8,00,000.00 (Rupees Eight Lacs only) per Katha was on the higher side compared to Government approved rate. However, considering the difficulty in finding available land suitable for the purpose of constructing the Sub-Station and considering the technical feasibility of the offered land, it was resolved to request the la.q.downer to offer a reduced rate.

On enquiry it appears that porgona Barak.par Mouza-Ambicapur pt-Vill covered by 2"d

R.S. Patta No.102 Dag No.157/881 measuring an area 03 (three) Katha of land and 2nd RS.

Patta No.101 Dag No.256/883 measuring an area 03 (three) Katha 06 (six) Chatak 12 (twelve)

Gonda ofland only. The total measuring an area of both pattas and Dags are 06 (six) Katha 06

(six) Chatak 12 (twelve) Gonda ofland only vide Regel, deed No.4456 dt. 28/12/2006.

The same Mouza covered by 2"d R.S. Patta No.IOI Dag No.258/875 measuring an area

02 (two) Bigha 03 (three) Katha of land only vide Regd, deed No.1106 dt. 11/6/1992. But it is

mentioned here that out of total land applicant obtain permission only 01 (one) Bigha 03

(three) Katha 13 (thirteen) Chatak 08 (eight) Gonda of land only.

Total measuring an area of both deeds are 01 (one) Bigha 10 (ten) Kathas only. The

average value of the said land is assesseJto be approximately Rs.33,55,999,50 ( Rupees thirty

three laks fifty five thousand nine hundred ninty nine and fifty paisa )only at the rate of

Rs.22,37,333,00 ( Rupees twenty two laks thirty seven thousand three hundred thirty three )

only on average per bigha.It is mentioned here that Classes of land may be changetl due to 3ro

Re-Settlement operation.

The above valuation has been arrived after comparing 03 (three) years and 03 (threeO

Nos of Sale Deeds in the Sub-Register Office, Sil char.

It is also mentioned here that Regd. Deed for the year 2011 not available in the Sub­

Register Office Silchar. So the valuation report has been prepared on the basis of Regd. Deed

2010. Sale statement, trace Map alongwith connected papers are enclosed herewith for favour

of your kind information and necessary action.

During fixation of the sale amoWlt, the position of the land as per actual and as per

trace map must be tak~ consideration and must not be below the notified Zonal valuation.

schedule be paid by a single cheque in favour of his own brother Vendor No-1 Sri Prantosh Bhowmik. Accordingly purchase on the basis of said Affidavit

dated 07-05-2012 sworn by Vendor No-2 Santosh Bhowmik the full consideration money Amounting to Rs.33, 55,999.00(Rupees thirty three lakh fifty five thousand nine hundred ninety nine) is paid vide Cheque No-065742 dated 09-05-2012 of the State Bank of India of New Silchar Banch, as full and final consideration money in respect of the land described in the schedule of

Minutes of meeting held on 12/01/2012 for settlement of rate for purchase of a plot of private land

belonging to Shri Kashi Ram Das,Paichara, Ghagrapar for construction of one new 33/11 kv Substation

under ADB financed Scheme of APDCL vide No. ASEB/PP & D/ Tech-B(Land)/2010/593 dtd 18-08-2011.

A meeting is held today on 12/01/2012 comprising of members as above for discussion

and final settlement of rate for purchase of a plot of land measuring 28 3K 9L vide Dag No: 292

Patta No: 37 owned by Shri Kashi ram das Paichara Ghagrapar for construction of a new 33/11

kv 5/5 at Ghagrapar i'll_ready proposed and approved by APDCL.

After several correspondences and discussion with the land owner in respect of fixation of a rate

for final disposal of the land owned by shri Kashi Ram Das to APDCL authority, a mutually agreed

rate of Rs. 3,00,000/-(Three Lacs) Only per bighals fixed. The Circle Officer ,Ghagrapar revenue

Circle has also justified the rate as agreed by both the party and has considered for approval of

the rate @ Rs. 3,00,000/-(Three Lacs) only per Bigha.
