Request For Bids Timetable

The following schedule has been established for the Request for Bids (RFB) for the sale of food frompushcarts and mobile trucks at various locations citywide and T-shirts from a cart in FlushingMeadows Corona Park, Queens.. This schedule is subject to change as circumstances warrant.

Request For Bids

NYC Parks & Recreation requests bids for the sale of food from pushcarts and mobile trucks atlocations citywide and the sale of T-shirts from a cart in Flushing Meadows Corona Park, Queens. A three (3) season term is offered (unless otherwise noted) beginning with the effective datethrough December 31, 2003 (unless otherwise noted).

Note: If you are a successful bidder, you will be notified that you have thirty (30) days in whichto obtain insurance coverage, post a security deposit, and sign your permit with NYC Parks& Recreation, and pay any outstanding balances owed from any current or past permits. Ifyou do not respond accordingly within this thirty (30) day period, your bid deposit of $600.00will be seized, and Parks may award the concession to the next-highest bidder or readvertisethe location, if it feels that it would be in the best interest of the city to do so. Your failure toenter into an agreement with Parks may be considered in the evaluation of future bids.

Approved Menu and Maximum Prices

Unless otherwise indicated, all pushcart locations are for the sale of the items listed below, at pricesno greater than the prices below. Under no circumstances may any mobile food concession exceedthese maximum prices for the items listed below. Please note that processing/cooking grills will notbe allowed at any pushcart locations except those listed in this RFB as processing cart locations. Mobile truck concessionaires may, with Parks' approval, sell items other than the items listed below. If you would like to sell items other than those listed below at a mobile truck location, please be sureto include a proposed menu with a price list in your bid submission. Pushcart locations designatedas ethnic food cart, specialty cart, and breakfast cart are for the sale of specific food items whichmust be approved by Parks. Ethnic food carts may sell items other than those listed below, includingdishes native to other parts of the world, but they will not be permitted to sell the items on the menusbelow, with the possible exception of beverages and chips. Specialty carts may sell a variety offoods not included on the following menus, including potato skins with fillings, crepes, soups,popcorn, cotton candy and other items, as well as unique soft drinks, such as egg creams, and fruitjuices. Breakfast carts are for the sale of breakfast foods. If you are bidding on any such locations,please be sure to include a proposed menu with a price list in your bid submission. NOTE: Unlessotherwise noted, if you operate a pushcart location that also contains a 3’ x 3’ ice cream cart,in cold weather you may substitute the ice cream cart with a 3’ x 3’ nut cart.

The following menu lists the items which may be sold at pushcart locations and the highest priceswhich may be charged for these items.

All nuts anddried fruit will be sold in 8 oz. bags. Following are the items that may be sold at these locations:

Bid Submission Instructions

All bids must comply with all items in the ΑBid Submission Requirements≅ section below, and shouldcomply with all items in the ΑBid Submission Guidelines≅ section below. A completed bid form (attachedto the back of this RFB), a bid deposit, and any additional information must be submitted in a sealedenvelope with the following information written on the outside of the envelope:

Additional information submitted should be printed or typed on 82≅ x 11" paper. No bids should besubmitted in plastic sleeves or spiral binders. Telegraphic or facsimile bids will not be accepted.

Bid Submission Requirements

Each bid submitted must meet the following requirements. Bids that do not comply with theserequirements will be automatically disqualified from further consideration. NYC Parks &Recreation cannot consider bids which do not comply with these requirements.

Fee Offer:

Each bid should contain a fee offer to the city expressed as a guaranteed annual payment for eachseason/year of operation. The seasons/years offered are defined as follows:

Season/Year 1: Start date (usually about one month after date available) through December 31, 2001Season/Year 2: January 1, 2002 through December 31, 2002Season/Year 3: January 1, 2003 through December 31, 2003

You must submit a separate fee offer for each location that you are bidding on, even if the locations arein the same park. Parks expects an increase of at least 5% in the annual fee for each successive season ofthe license. You must specify the amount you offer for each season/year.

Minimum Bid:

Parks has established a minimum bid of $600.00 for each year/season of operation. Parks will notaccept any bids lower than $600.00 for each year/season of operation.

In the event that several bids are comparable, i.e., close, Parks will use a Net Present Value (NPV) analysisto determine which bid is highest.

Bid Deposit:

Each bid must be accompanied by a bid deposit in the form of a certified check or money order in theamount of six hundred dollars ($600.00) per location. Personal checks will not be accepted. Thecertified check/s or money order/s must be payable to NYC Parks & Recreation. Parks requires a $600.00

bid deposit for each site on which you are bidding. Bidders should clearly indicate their name and addresson the face of the certified check or money order. A certified bid deposit of $600.00 is required for eachlocation. In the event that the highest bidder for a given location fails to enter into a contract with Parks,his or her bid deposit will be seized. All other bid deposits will be returned after contracts are signed withsuccessful bidders.

Example: If you are bidding on ten (10) locations, you may submit one certified check/money order in theamount of $6,000.00, although Parks would prefer 10 separate certified checks/money orders in the amountof $600.00 each, one for each location. In this example, if you submit one certified check/money order for$6,000.00 and you win five of the ten locations on which you bid, you would be entitled to a refund of$3,000.00. However, because of city administrative procedures, it would be approximately four to sixweeks before you would receive your refund. On the other hand, if you submit ten separate certifiedchecks/money orders for $600.00 each, Parks can return your $3,000.00 in bid deposits promptly.

Each bid must clearly indicate the location on which you are bidding. A separate bid/fee offer should bemade for each location. You may use a copy of the form enclosed with the RFB for each location.

Bid Deadline:

All bids must be received in the office of the Assistant Commissioner, Revenue Division, New York CityParks & Recreation, The Arsenal, 830 Fifth Avenue, Room 407, New York, NY 10021 no later thanWednesday, May 23, 2001 @ 11am. Hand delivery to Room 407 before the deadline is recommendedto ensure consideration of your bid. All bids must be submitted in sealed envelopes. Bids receivedafter the time and date listed above will be returned to the bidder unopened and will not beconsidered for award.

Bid Submission Guidelines

Each bid is expected to include the following information:

1. Please include a clear photo or rendering of the pushcart or mobile truck that you will use.

2. Please include a description of the hours of operation, as well as a maintenance schedule forcleaning the area within 50 (fifty) feet of the vending unit.

3. Please submit both a wholesale and retail price list of items to be sold.

4 Please include a resume or description of your professional experience.

5. Please include a financial statement and completed business and personal questionnaires.

6. Please contact the project manager to obtain these questionnaires. If updated financial statementsand questionnaires are on file, you need not resubmit them, but please mention this in your bidsubmission.

Requirements During The Term of The License

A non-renewable term of three (3) seasons is offered. All permits for the locations offered in this RFB willexpire on December 31, 2003 (12/31/03). A longer term will not be considered.

1. If you win a location, you will be required to present picture identification (such as a driverslicense or a passport) and proof of address (such as a utility bill) in order to sign your permit. Inaddition, you will be required to provide us with at least two telephone numbers (see bid form, atend of document) at which we will be able to reach you. If there are any changes in your addressor phone number/s, you must inform the Parks Revenue office immediately.

2. Concessionaires will be required to purchase or otherwise obtain use of pushcarts or mobile trucks.You will be required to present your pushcart or mobile truck to NYC Parks & Recreation forinspection before you can sign a permit.

1. Pushcarts, mobile trucks, umbrellas, canopies and other equipment attached to pushcarts or mobiletrucks shall be of a design and color approved by Parks. In addition, the concessionaire shall repairor replace the above if deemed necessary by Parks. Advertising of product brands will not beallowed without Parks= approval. All umbrellas/awnings must be green and white. NOTE: THESALE OF BEVERAGES IN GLASS BOTTLES IS PROHIBITED.

4. In addition to a Parks permit, vendors must obtain a Department of Health License for their truckor cart, and a vendor ID card for each operator. If you are a new vendor with the city please beaware that this process takes between six and eight weeks. You will not be allowed to apply foryour Health Department permits until you have obtained your Parks permit. If you win a location,contact the New York City Licensing Department, 42 Broadway, 5th floor, Monday through Friday8.30am to 5pm, or by phone at 212-487-4436.

Note: If you are operating without all necessary permits, you may be subject to fines and/orconfiscation of your merchandise and vending unit.

5. Vending units must have garbage receptacles present at all times. Operators will be responsible forcleaning the area within 50 feet of their concession.

6. Concessionaires must cooperate with Parks if directed to move for special events or otherunanticipated eventualities.

7. Concessionaires will be required to maintain insurance for the duration of their license term.The required coverage is $500,000 in personal/general liability insurance and $50,000 in propertydamage liability insurance. Insurance certificates must name NYC Parks & Recreation as anAdditional Insured. The certificate must also specify the name of the park and the location of theconcession. A separate certificate of insurance is required for each location.

8. Parks must approve all menu items and their prices. A price list, approved by Parks, must beprominently displayed at your vending unit at all times. Parks requires that at least two items sellfor 75 cents ($0.75) or less. You should indicate what they are in your menu.

9. For every permit, the city requires a minimum security deposit of at least 25% of the highest

year's fee. This security deposit will be held by the city for the duration of the license term.

10. Concessionaires will be required to submit monthly statements of gross receipts in a formatprovided by Parks.

11. Concessionaires are expected to comply with all terms of their permits. Inspectors from Parks willvisit the concession site unannounced to inspect your operations and determine whether or not youare complying with the terms of your permit. If inspectors find violations, you may be fined foreach violation. If you do not pay such fines, they will be deducted from the security deposit heldby Parks.

12. Concessionaires will receive a permit sticker upon signing their permit. A new sticker will be

issued for each season of operation, provided you comply with the Requirements During the Termof License. If you lose a sticker, you will be charged a fee of $50.00 for each replacement sticker.

13. If you do not comply with the terms of your permit, your permit may be terminated. Any warningsor terminations may be considered in making future bidder responsibility determinations.

Pushcart and Mobile Truck Maintenance and Requirements

It is necessary to keep pushcarts and mobile trucks in good condition. This involves ensuring thatpushcarts or mobile trucks do not leak any type of fluid, including water, onto the ground. It is alsonecessary to keep pushcarts and mobile trucks clean and free of graffiti. The umbrella that is used mustbe an official NYC Parks & Recreation green and white umbrella. Pushcarts and mobile trucks must alsobe free of any and all advertising, including advertising for hot dog, beverage, and pretzel companies. Pushcarts and mobile trucks must not be damaged or dented.

In addition to keeping pushcarts and mobile trucks clean and in good condition, a NYC Parks & Recreationpermit must be displayed at all times in a visible location. A menu and a price list must also be displayedat all times for all items that are sold at the pushcart or mobile truck, including ice cream and ices.

Pushcarts and mobile trucks must remain in the specified location on your permit at all times. Pushcartsand mobile trucks may not extend vending space beyond the confines of the pushcart or the truck.

No food products or beverages may be stored on the ground or on any surface in the park other than in oron the pushcart or in a separate gray or black garbage can. Each pushcart is permitted to retain one extragray or black garbage can in which extra beverages and ice can be placed.

If any of the above stipulations is violated, the concessionaire may be fined for each and every offense. Thefine schedule is as follows:

Procedure for Appeals of Assessments For Concession License Violations

If a fine is received for one of the above violations, there is a process by which the fines may be appealedif the concessionaire feels that the fine has been assessed in error. The procedure is outlined below:

1. Filing an Appeal

A. If the concessionaire wishes to appeal the assessment, a notice of appeal must be delivered to Parkswithin ten (10) days along with a statement of reasons why he or she believes the assessment waserroneous. The statement of reasons must be notarized. Any evidence supporting the concessionaire=sappeal (such as photographs, documents, witness statements) should also be included.

B. If no appeal is received within 10 days of the date the assessment is mailed, the assessment shallbe considered final and charged to the concessionaire=s account.

2. Adjudication of Appeal

A. The appeal shall be sent to the Assistant to the First Deputy Commissioner, whose office is locatedat the Arsenal, 830 Fifth Avenue, New York, NY 10021. The Commissioner has designated the Assistantto the First Deputy Commissioner to decide on the merits of these appeals. The decision of the Assistantto the First Deputy Commissioner shall constitute the final decision of NYC Parks & Recreation.

B. The Assistant to the First Deputy Commissioner is authorized to investigate the merits of theappeal, but is not required either to hold a hearing or to speak to the concessionaire in person.

Bid Evaluation

In evaluating bids, NYC Parks & Recreation will select the highest fee offer to the city from aresponsible and responsive bidder. Failure to respond substantially to the requirements of the RFBwill result in the rejection of the bids.

The city is not required to accept any bid. Acceptance of a bid does not imply that every element of thatbid has been accepted.

NYC Parks & Recreation reserves the right to postpone or cancel this RFB or reject all bids for any or alllocations, if in its judgement it is in the best interest of the City of New York to do so.

All Request for Bids submission materials become the property of the City of New York Parks &Recreation, and will generally be made available for inspection and copying by interested parties upon

written request, except when exempted from disclosure by the Freedom of Information Law. Proposersmay mark as confidential those portions of a proposal which they believe are not required to be disclosedunder New York State Freedom of Information Law.

NYC Parks & Recreation is subject to the New York Sate Freedom of Information Law, which governsthe process for the public disclosure of certain records maintained by Parks. (See Public Officers Law,Sections 87 and 89.) Individuals or firms that submit proposals to Parks may request that Parks except allor part of such proposal from public disclosure, pursuant to Section 87(2)(d) of the Public Officers Law,on the grounds that the proposal contains trade secrets, proprietary information, or that the information,if disclosed, would cause substantial injury to the competitive position of the individual or firm submittingthe information. Such exception may extend to information contained in the request itself, if publicdisclosure would defeat the purpose for which the exception is sought. The request for such an exceptionmust be in writing and state, in detail, the specific reasons for the requested exception. It must also specifythe proposal or portions thereof for which the exception is requested. If Parks grants the request forexception from disclosure, Parks shall keep such proposal or portion thereof in secure facilities.

NYC Parks & Recreation will not be liable for any costs incurred by bidders in the preparation of bids orfor any work performed in connection therein.

A bidder may submit a modified bid to replace all or any portion of a bid submitted up until the bidsubmission deadline. The project manager will only consider the latest version of the bid. Late bids andlate modifications will not be considered. Bidders may withdraw their bid from consideration at any timebefore the bid submission deadline. To withdraw a bid, the bidder must provide Parks with writtennotification.

Technical addenda issued by NYC Parks & Recreation will be the only authorized method forcommunicating clarificatory information to all potential vendors. Bidders should contact the agency priorto bid submission to verify that any addenda issued have been received. Bidders should acknowledge thereceipt of all addenda as part of their bid submissions.

The Office of the Comptroller of the City of New York is charged with the audit of concession agreements.Any person or entity who believes that there has been unfairness, favoritism, or impropriety in the bidprocess should inform the Comptroller=s Office of Contract Administration, located at 1 Centre Street,Room 835, New York, NY 10007. The left column provides the following information: the name of the park, whether the location isapproved for a pushcart or a mobile truck, and when the location will become available. The middlecolumn indicates the location of the vending site within the park. The right column indicates thelocation's property number, which should appear on the outside of the envelope in which you submit yourbid. Parks retains the right to relocate or restrict a pushcart or mobile truck, if necessary. The term of these permits may be extended, contingent on theconstruction in the area, pending Parks approval.
