IMPORTICO CORPORATIONTRANSFER STATION/MATERIALS RECOVERY FACILITY AND

CLASS A RECYCLING CENTERBAEKELAND AVENUE, MIDDLESEX BOROUGH, MIDDLESEX COUNTY, NEW JERSEY

FACILITY REGISTRATION NO. 1211000503

This Solid Waste Facility Permit, which includes the Certificate ofApproved Registration and Engineering Design Approval (hereinafter"Permit"), is conditioned upon compliance with all applicablestatutes, rules, regulations and ordinances, and the implementationof the following:

1. Permitted Waste Types

The following materials may be accepted for processing andtransfer at this facility:

3. Recyclables

Recyclable materials designated in a respectiveCounty/District Recycling Plan to be source separated in themunicipality of origin, pursuant to N.J.S.A. 13:1E-99.13.b.(2), shall only be accepted at this facility, as perCondition Number 10 (Waste and Class A Recyclables MaterialsAcceptance and Processing Capacity) and as noted below.

Any recyclable materials, unless specifically exempted inCondition Number 12 (Materials Recovery Operations) orexempted in accordance with N.J.S.A. 13:1E-99.16d, that aredetected in a load of waste accepted at the facility, shall behandled by the Permittee pursuant to the recyclablesinspection plan listed at Condition Number 21 of this Permit.

The Permittee shall maintain documented exemptions for clientsof Importico Corporation; secured pursuant to N.J.S.A. 13:1E-99.16d. Importico Corporation shall not accept any load froma commercial and/or institutional account that is notaccompanied by documentation from that account which providesindividual exemption status from the source separationrequirements by the respective municipality having soleauthority to grant this exemption pursuant to N.J.S.A. 13:1E-99.16d. Additionally, the Permittee shall furnish respectivemunicipalities of origin with annual, or as required, reportslisting the identity of the commercial and/or institutionalgenerators, the quantity (in tonnage) of the designatedmaterials delivered to Importico Corporation for separation,and the amount actually recycled.

4. Referenced Engineering Plans and Documents

The construction and operation of this facility shall be inaccordance with the provisions of N.J.A.C. 7:26-1 et seq., theconditions of this Permit, and the submissions specified asfollows:

a. The Middlesex County Solid Waste Management DistrictPlan Amendment # 1995-3, dated October 5, 1995(Inclusion of Importico, Inc. Class A recycling center,adding a new parcel Block 352, Lot 1A to the existingBlock 352, Lot 2, designation from "transfer station" to"transfer station/material recovery facility", increaseof the permitted capacity and weekly averaging oftonnage).

b. Certification dated December 26, 1995 of the Amendment #1995-3 of the Middlesex County District Solid WasteManagement Plan by the Department of EnvironmentalProtection.

c. Memorandum dated January 19, 1996 from Ray Worob,Supervising Planner, Bureau of Recycling and Planning,to Sukhdev Bhalla, Chief, Bureau of Resource Recovery &Transfer Facilities. This letter clarified MiddlesexCounty Plan Amendment # 1995-3 and its Certificationdated December 26, 1995 by the Department.

d. "Traffic Impact Report" dated March 15, 1995 forImportico Transfer Station/MRF/Class A Recycling Center,prepared by Simoff Engineering Associates. This reportwas submitted on March 20, 1995 with the Amended SWFPermit Renewal Application dated March 17, 1995 by AlmanManagement Group, Inc. of Westfield, New Jersey.

e. "Amended SWF Permit Renewal Application" for ImporticoCorporation, prepared by Alman Management Group, Inc. ofWestfield, New Jersey, dated October 4, 1995 andsubmitted on October 6, 1995 in response to the Noticeof Deficiency dated July 27, 1995. The informationsubmitted was superseded by the submittals of December6, 1995 and February 6, 1996, except the followingdocument:

(i) A Preliminary Operations and Maintenance (O&M)Manual dated August, 1995, for ImporticoCorporation's Solid Waste TransferStation/Materials Recovery Facility/Class ARecycling Center.

f. "Supplemental Information" for Importico Corporation,

prepared by Alman Management Group, Inc. of Westfield,New Jersey, dated November 29, 1995 and submitted onDecember 6, 1995 in response to the Notice of Deficiencydated July 27, 1995, which included the following:

(i) "Standard Application Form (CP#1)" and "Solid WasteSupplement to Standard Application Form CP#1" datedAugust 18, 1995. This registration statementsuperseded the registration statement submitted onOctober 6, 1995.

(ii) The Deed of Record between Vera Importico andWilliam J. Importico for the facility property,Block No. 352, Lots 1A and 2.

(iii) Equipment Specifications

(iv) "Traffic Impact Report" dated November 21, 1995 forImportico Transfer Station/MRF/Class A RecyclingCenter, prepared by Simoff Engineering Associates. The document is a revision of the "Traffic ImpactReport" dated March 15, 1995 (refer to item 4.d),in response to the traffic issues raised by theNotice of Deficiency dated July 27, 1995.

g. "Response Document" dated February 5, 1996 and submittedon February 6, 1996, which included the following:

(i) Amended Engineering Design dated February, 1996.

(ii) Amended Environmental and Health Impact Statementdated February, 1996.

(iii) Revised engineering drawings by Simoff EngineeringAssociates, Inc. Refer to item 4.h of this Permit.

h. The following engineering drawings, prepared and signedand sealed by Hal Simoff, Registered Prof. Engineer,P.P., of Simoff Engineering Associates, Inc. of Chatham,New Jersey, and submitted on February 6, 1996, with thelatest revisions as follows:(i) "Key Map", Sheet No. 1 of 9, dated November 20,

1994, Rev. 1.(ii) "Existing Conditions Plan", Sheet No. 2 of 9, dated

September 25, 1995, Rev. 2. (iii) "Site Plan", Sheet No. 3 of 9, dated January 24,

1996, Rev. 3.(iv) "Utility Plan", Sheet No. 4 of 9, dated January 24,

1996, Rev. 3.

(v) "Ingress Traffic Circulation Plan", Sheet No. 5 of9, dated January 24, 1996, Rev. 1.

(vi) "Egress Traffic Circulation Plan", Sheet No. 6 of9, dated January 24, 1996, Rev. 2.

(vii) "Building Floor Plan and Elevations", Sheet No. 7of 9, dated January 23, 1996, Rev. 3.

(viii) "Vicinity Map", Sheet No. 8 of 9, datedNovember 13, 1992.

(ix) "Details Sheet", Sheet No. 9 of 9, datedSeptember 25, 1995, Rev. 2.

In case of conflict, the most recent revisions and supplementinformation approved by the Department shall prevail overprior submittals and designs, and the conditions of thisPermit shall supersede those of the engineering design andenvironmental and health impact statement referenced above.

5. Construction Requirements

a. Thirty (30) days after the issuance of the SWF Permit,the Permittee shall submit a construction schedule tothe Bureau of Resource Recovery & Transfer Facilitiesfor the proposed building and all equipment.

b. Thirty (30) days prior to installation of the scale, thePermittee shall submit the information pertaining to theproposed scale to be installed at the facility such asmanufacturer, type of scale (concrete or steel), andcapacity (in tons) to the Bureau of Resource Recovery &Transfer Facilities. Further, the installation of thescale shall be in accordance with N.J.A.C. 7:26-17.

c. During the facility construction phase, the Permitteeshall implement the following procedures in order tominimize vehicles and equipment noise, dust generationand construction vehicles traffic impacts:

1. Exhaust silencers shall be maintained on all heavyconstruction equipment. Unnecessary idling ofconstruction equipment shall be prohibited.

2. Only noise attenuated air compressors shall beutilized.

3. All major noise producing construction activitiesand all construction activities occurring near thefacility perimeter shall be confined to theworking hours of 7:00 AM to 5:00 PM.

4. All soil stockpiles and open storage areas

containing fine or unbound material shall becovered or watered to minimize dust generation.

5. Vehicles transporting loose or fine-aggregatematerials shall be securely covered to preventfugitive dust. Loading and unloading operationsshall be controlled to minimize dust generation.

6. Silt barrier fences, if required, shall beinstalled and maintained in accordance with anapproved Soil Erosion and Sediment Control Plan.

7. The tracking or other means of transportingdirt/dust onto paved public roads shall beminimized and the Permittee shall be responsiblefor prompt cleanup of any accumulation.

8. All waste materials generated by site preparationactivities and by facility construction shall behandled, stored and disposed of in accordance withthe Department's rules and regulations, those ofthe local Board of Health and in conformity withthe approved Middlesex County District Solid WasteManagement Plan.

9. Access and egress to the transfer station/materialrecovery facility site by construction vehiclesshall be via routes approved for use by refusevehicles, and not through residential areas. On-site roadways shall be maintained.

10. Any subsurface investigation reports (soil boringstests results) shall be submitted to theDepartment, when available.

11. In the event ground water is encountered duringconstruction activities, all related excavationactivities shall cease and the Department shall benotified immediately. Should it be deemednecessary to perform dewatering activities on-site,the Permittee shall submit a plan for sampling,analysis and disposal to the Department forapproval.

12. All fuels for construction equipment shall bedelivered on an as-needed basis and dispenseddirectly from the delivery truck to the equipmentwithout storage of the fuels on-site.

13. The maximum size containers for other fluids and

chemicals stored on-site during construction of thefacility shall be fifty-five (55) gallon drums. Alocalized containment field shall be installed inaccordance with State and local codes.

6. Certification of Construction

The Permittee shall retain the services of a licensedprofessional engineer registered in the State of New Jersey tosupervise the construction of the facility and who shallcertify, in writing to the Department, subsequent tocompletion of the facility construction phase that he/she haspersonally examined each major phase of the facilityconstruction and that the facility has been constructed inaccordance with this Permit, the documents, statements,designs and plans submitted in whole or as a part of theapplication as approved by the Department.

All certifications shall bear the raised seal of the licensedprofessional engineer, his/her signature and the date ofcertification. The certification shall include the followingstatement: "I certify, under penalty of law, that I havepersonally examined and am familiar with the informationsubmitted in this document and all attachments and that Ibelieve the submitted information is true, accurate andcomplete. I am aware that there are significant penalties forsubmitting false information, including the possibility offine and imprisonment."

The Certificate of Construction shall be submitted to theDivision of Solid and Hazardous Waste, Bureau of ResourceRecovery & Transfer Facilities within thirty (30) days aftercompletion of all construction activities at the facility,along with any revised "As Built" construction andarchitectural drawings approved by all State and localagencies.

7. Certificate of Occupancy (for Proposed Addition)

A Certificate of Occupancy shall be obtained from the Boroughof Middlesex, which serves notice that the proposed buildingand equipment has been constructed/installed in accordancewith the New Jersey Uniform Construction Code, N.J.A.C. 5:23and is approved for use and/or occupancy.

8. Pre-Operational Requirements

The Permittee shall not begin operations within the proposedbuilding prior to meeting these requirements:

a. Subsurface investigation report (soil boring testresults) as required by Permit Condition Number 5.c.10.

b. Certificate of Construction as required by PermitCondition Number 6.

c. Certificate of Occupancy as required by Permit ConditionNumber 7.

d. Connection of oil/water separator to the public sanitarysewer as required by Permit Condition Number 14.

e. Storm water discharge permit and NJPDES-DGW Permit asrequired by Permit Condition Number 14.

f. Connection of the site storm water drainage system tothe public storm water collection system and itsapproval from Middlesex Borough as required by PermitCondition Number 14.

g. Air Pollution Control Permit as required by PermitCondition Number 15.

9. Operations and Maintenance Manual

A Final Operations and Maintenance (O & M) Manual shall besubmitted to the Department for approval no later than sixty(60) days before the start up of facility operations withinthe proposed building.

The O & M Manual shall be prepared as a separate and fullyself-contained document which includes all relevantnarratives, listings, schedules, sample forms, etc. which isnot dependent upon other documents for completeness, and whichis adequate for use alone for training and reference. Itshall be maintained and available for use at the facility atall times. Subsequent changes to the approved O & M Manualproposed by the Permittee shall not be implemented untilapproved by the Department.

The Final O & M Manual shall include the following sections:

a. A description of the facility operation, including:

(1) A statement of the days and hours for receivingwaste, for processing waste and recoveringrecyclable materials, and for transporting(transferring) recovered materials and waste

residues from the facility.

(2) A listing and brief description of equipment itemsof the following types: materials handling,processing, monitoring and control, safety,emergency, security and structural. As applicable,a description shall include the item's common name,manufacturer's or trade name (if different),manufacturer, model number, capacity, statement offunction and brief description of how the item isoperated.

(3) A summary narrative that describes the following:

(a) The overall operations of the facility.

(b) All monitoring and control functions which arepart of the facility operations.

(c) All security functions (including alarms andcommunications) which are part of the facilityoperations.

(d) Measures for controlling on-site litter anddebris and preventing wind-blown dust andother materials from leaving the site.

(e) Measures for preventing and detecting fires,and equipment and procedures for extinguishingfires.

(f) Measures for controlling arthropods androdents.

(g) Measures for controlling noise generation.

(h) Procedures for inspecting incoming loads ofsolid waste and preventing the receipt ofprohibited waste types.

(i) Procedures for removing small quantities ofprohibited waste types from an incoming loadand storing them temporarily in a secure areapending Department instructions for disposal,or for storing entire loads of prohibitedwaste types.

(j) Measures to handle unusual peak loading which

may exceed the facility's design capacity.

(k) Measures to handle incoming waste flow duringperiods of emergencies, equipment breakdown orfacility shutdown.

(l) Measures to control on-site traffic.

b. An inspection plan and a maintenance plan to bedeveloped in accordance with the Permit Condition Number19 to ensure continued operation of the facility.

c. A facility staffing plan developed in accordance withCondition Number 22 of this Permit and which shallinclude the job title for each position at the facilityand a written job description for each position,including duties and performance standards. Thedescription shall include the requisite skills,education and other qualifications of employees assignedto each position.

d. A staff training plan developed in accordance withCondition Number 23 of this Permit and which defines thetype and amount of both the initial and follow-uptraining to be provided to facility personnel.

e. A facility safety plan developed in accordance withCondition Number 28 of this Permit and which describesthe operating procedures to be followed to protectfacility personnel and other persons from injury. Theplan shall demonstrate compliance with the occupationalsafety and health administration standards for generalindustry, 29 CFR 1900 to 1910. The plan shall alsoimplement industrial safety standards such as the latestamendments of ASME B20.1-1990 for conveyors and ANSIZ244.1-1982 regarding electrical lockout.

f. An emergency contingency plan developed in accordancewith Condition Number 29 of this Permit and whichdelineates procedures for responding to emergencies suchas fires, explosions or hazardous substance discharges.The contingency plan shall contain a description of theactions facility personnel shall take in the event ofvarious emergency situations, a description ofarrangements made with the Department and local policeand fire departments which allow their immediate entryinto the facility by their authorized representativesshould the need arise, such as in the case of personnelresponding to an emergency situation; and a list ofnames, addresses and telephone numbers (office and home)of all person(s) qualified to act as emergency

coordinator for the facility. The list shall be kept upto date.

Copies of the contingency plan shall be submitted to thelocal police and fire departments, and the local andcounty health department.

g. A recyclables inspection plan developed in accordancewith Condition Numbers 3 and 21 of this Permit.

10. Waste (including Class A Recyclable Materials) Acceptance andProcessing Capacity

Importico Corporation may receive a maximum of 250 tons perday (but shall not exceed 900 tons per week) of solid waste(and/or source separated recyclable materials pursuant toN.J.A.C. 7:26-2.11(b)15) inclusive of source separated Class Arecyclable materials accepted at the facility in accordancewith the documents referenced at Condition Number 4 of thisPermit. Class A recyclables include only mixed office paper,corrugated cardboard, newspaper, glass, aluminum containers,metal (ferrous and non-ferrous) and plastic.

Deposition of waste is allowed in only those areas within thebuilding specifically identified in the design drawings forsuch purposes. Under no circumstances shall waste bedeposited beyond the confines of the building. The facilityshall process the amount of solid waste that is delivered toit on any given operating day.

11. Waste (including Class A Recyclables Materials) Acceptance andProcessing Hours

Waste (including delivery of Class A recyclable materials toImportico Corporation) shall be accepted for processing at thefacility only in accordance with the following schedule:

7:00 a.m. to 5:00 p.m., Monday through Saturday

Waste deliveries, including the delivery of Class A materials,to the facility shall be scheduled in such a manner as tominimize truck queuing on the facility property. Under nocircumstances shall delivery trucks, transfer trailersaccessing or exiting the facility be allowed to park or queueonto public roads (Baekeland Avenue).

Waste (including Class A materials delivered to ImporticoCorporation) shall be processed at the facility according tothe following schedule:

7:00 a.m. to 7:00 p.m., Monday through SaturdayThe facility shall obtain all necessary local approvals tooperate during the above stated hours.

The Department reserves the right to revise the above scheduleshould the operation of this facility, under anycircumstances, result in violations of the noise levelstandards as established in the Noise Control Condition(Condition Number 18) of this Permit.

12. Materials Recovery Operations

The materials recovery operation at the facility shall meetthe following criteria:

a. In accordance with the Solid Waste Facility Permitrenewal application as listed at Condition Number 4herein, the Permittee is hereby authorized to extractfrom daily solid waste receipts and store at thefacility, as appropriate, the following materials: roofing shingles, ferrous and non-ferrous metal, wood,concrete, asphalt, brick, and tires. All recyclablematerials removed from the incoming solid waste shall bestored separately and loaded into outgoing recyclingtrailers when appropriate.

b. (1) A movable concrete barrier or equivalent type ofbarricade shall be in place when both the materialrecovery facility (MRF) and Class A recyclingcenter are in operation, to physically separate thesolid waste tipping, processing and storage areas. The MRF tipping floor can be expanded into the"flexible zone" using the movable barrier toaccommodate increased solid waste loadings, onlyafter removal of Class A recyclable materials fromthis flexible zone.

(2) Any source separated Class B recyclables loadstipped on the tipping floor shall be kept separatefrom Class A recyclables and solid waste.

c. The Permittee may store the recyclable materials at thefacility for later transport to end markets,manufacturers or recycling centers pursuant to thefollowing:

(1) Recyclable materials may be transported only to theabove noted destinations pursuant to therequirements of N.J.A.C. 7:26A et seq.

(2) End markets, manufacturers and recycling centers

shall mean the same as the definitions found atN.J.A.C. 7:26A-1.3.

(3) All recovered Class B recyclable materialstransported to an in-state recycling center forfurther processing shall be transported only tothose recycling centers approved by the Departmentpursuant to N.J.A.C. 7:26A et seq.

(4) Recyclable materials stored outside the enclosedbuilding shall be stored only in the roll-offcontainers/bins. These containers shall be coveredat night and during rain.

d. The Permittee shall maintain contracts or letters ofagreement with end markets, manufacturers and approvedrecycling centers for the disposition of recoveredmaterials. The Department shall be notified by thePermittee within one week of the change in the status ofexisting contracts or letters or of the addition of anynew contracts or letters for the disposition ofrecoverable materials. Such notice shall includedocumentation of the changed status or a copy of the newcontract or letter of agreement.

e. Unauthorized or hazardous waste detected and removedfrom the solid waste stream shall be handled inaccordance with Condition Number 20 of this Permit.

f. All processing and storage of solid waste and all otherrelated waste processing activities shall be performedwithin the confines of the facility as depicted on theapproved engineering design drawings and as explained inthe documents submitted in support of this Permitreferenced in Condition Number 4.

g. The Department reserves the right to amend this Permitto further restrict operations, impose monitoringrequirements, prohibit specific waste types or imposeadditional time limitations on the storage of waste orrecovered materials.

13. Waste Retention Time

No solid waste shall be allowed to remain on the tipping floorovernight.

14. Wastewater and Stormwater Collection and Disposal

A. Wastewater Collection and Disposal:

i. Existing Operation:

Wastewater resulting from the existing operationsshall be collected into the existing sump pit whichis drained via the grit collection tank into theoil/water separator. The resultant wastewatershall be pumped out by a septic contractor, whenaccumulated, and properly transported in accordancewith N.J.A.C. 7:26-3 et seq., to an approvedtreatment plant for disposal.

ii. Proposed Operation:

The concrete tipping floor of the proposed buildingshall be graded to ensure properdirectionalization, containment and disposal ofwastewater into the existing sump pit.

Wastewater resulting within loading ramp/loadingarea shall be drained into the existing sump pit.

Resultant wastewater shall be directed via theoil/water separator to the public sanitary sewer. Necessary approval from the Borough of Middlesexshall be obtained for the disposal of wastewater.

B. Stormwater Collection and Disposal

i. Existing Operations:

Stormwater from garage roof and paved areas shallbe directed to the Baekeland Avenue storm line viathe underground detention box and 12" slot drain.

Stormwater generated within the existing materialrecovery operation area shall be directed to theexisting sump pit.

ii. Proposed Operations:

Stormwater from roof and paved area shall bedirected to the Baekeland Avenue storm line via theunderground detention box, 12" slot drain andproposed trench drain as depicted on the UtilityPlan (Engineering Dwg. Sheet 4 of 9). Necessaryapproval from the Borough of Middlesex shall beobtained for the disposal of stormwater.

C. NJDEP Permits:

i. Importico Corporation must apply for and obtain aNJPDES-DGW Permit for the stormwater detentionsystems on-site from the Bureau of OperationalGround Water Permits, Division of Water Quality.

ii. Importico Corporation must apply for and obtain aStormwater Discharge Permit from the Bureau ofStormwater Permitting, Office of Land and WaterPlanning.

15. Odor and Dust Control

Importico Corporation shall apply immediately for an AirPollution Control Permit from the Bureau of New Source Review,Air Quality Permitting. Upon issuance, the Permittee shallcomply with the conditions of the Air Pollution ControlPermit.

All air pollution control equipment must be installed prior tothe commencement of material recovery facility operation inthe proposed building.

The operation of this facility shall not result in odorsassociated with solid waste being detected off-site in anyarea of human use or occupancy at any time.

The operation of this facility shall not result in theproduction of potentially unhealthy levels of dust. ThePermittee shall implement, as necessary, the use of sprayedwater when unloading and processing of waste I.D. #13C(Construction and Demolition Waste) takes place. Dust shallbe controlled by the use of an air filtration system.

16. Housekeeping

Routine housekeeping and maintenance procedures shall beimplemented within the facility interior to prevent theaccumulation of dust and debris, and to maintain generalcleanliness in the working environment. All areas where solidwaste has come in contact shall be cleaned on a daily basis. Facility exterior grounds shall be maintained in a manner freeof litter and debris. All paved areas on-site shall be swepton a routine basis and the entrance area shall be policed

regularly to prevent the accumulation of dirt and debris onthe public roads.

All facility roof drains, slot drain, trench drain, inlets anddry wells shall be maintained free of obstruction tofacilitate drainage.

17. Vermin Control

The Permittee shall institute and maintain an effective vermincontrol program at the facility, directed by a qualifiedapplicator of pesticides as set forth in the New JerseyPesticide Control Code N.J.A.C. 7:30-1 et seq.

18. Noise Control

Noise control shall be implemented so that sound levelsgenerated by the facility operation including on-site vehiclemovement shall not exceed the standards set forth at the NewJersey Noise Control Code at N.J.A.C. 7:29 et seq.

The Permittee is required to conduct a sound level surveythirty (30) days after the commencement of facility operationsinside the proposed MRF building in order to demonstratecompliance with the noise code referenced at N.J.A.C. 7:29 etseq. The sound level survey shall be conducted during periodswhich are representative of overall facility operations andshall be managed by a firm qualified to conduct sound levelsurveys. A detailed report outlining the survey methods,procedures, equipment utilized, and the results obtained shallbe submitted to the Department within thirty (30) days ofcompletion of the survey.

The Permittee shall limit the facility processing operationsto inside the material recovery facility building in orderthat sound levels generated by the facility operation,including on-site vehicle movement, do not exceed those limitsset forth at the New Jersey Noise Control Code N.J.A.C. 7:29.

The Permittee shall prevent the continued entry to thefacility of any vehicle not equipped with proper operatingmuffler systems or those vehicles which create excessivenoise.

The Department reserves the right to require the Permittee toperform additional noise surveys to ensure continuedcompliance with N.J.A.C. 7:29.

19. Inspection, Maintenance and Repair

Through an effective inspection, planned maintenance, repairand parts replacement program, the facility systems andrelated appurtenances shall at all times be kept in properoperating order.

An inspection plan shall include schedules for inspecting allaspects of the facility operations necessary to ensure maximumfacility availability and compliance with the conditions ofthis Permit and the regulations of the Division of Solid andHazardous Waste. The frequency of inspection shall be basedon the rate of potential equipment deterioration ormalfunction and the probability of an adverse incidentoccurring if the deterioration or malfunction goes undetected. The inspection plan shall include schedules for inspectingmonitoring, safety and emergency equipment, security devices,and processing and structural equipment. The plan shallidentify the types of problems which are to be looked forduring the inspection and the frequency of inspections.

The results of all inspections shall be recorded in a boundinspection log. These records shall include the date and timeof the inspection, the name of the inspector, a notation ofobservations, recommendations and the date and nature of anyrepairs or other remedial action taken. These records shallbe made available for inspection by the appropriaterepresentatives of the Department upon request.

A maintenance plan shall include an analysis of spare partsinventory needs, schedule for anticipated repairs or majorequipment replacement and maintenance contracts with equipmentdealers to supply standby or emergency equipment.

20. Unauthorized Waste

The Permittee shall implement the procedures established todetect and remove unauthorized waste from the waste streamentering the facility as described in the O & M Manual. Theprocedures shall include the following:

a. Continuous visual monitoring of the delivered waste bythe facility personnel. Any suspected unauthorizedwaste shall be removed from the processing stream; and

b. Provisions to ensure that any suspected hazardous waste,

waste-containing drums or liquids that may be found in aload accepted at the facility are not returned to thegenerator. Such material shall be segregated and storedin a manner in an area within the building as depictedon the engineering drawing (Sheet 3 of 9) as referencedin Condition Number 4 of this Permit, and its discoveryshall immediately be brought to the attention of theNJDEP Environmental Action Line at (609) 292-7172(available 24 hours per day including weekends andholidays). Such waste shall be handled as hazardouswaste for storage and disposal purposes unless otherwisedirected by the Department. The Permittee shall obtainan EPA ID Number as a hazardous waste generator in orderto facilitate disposal of this type of waste.

Any negligent or known processing of any hazardous wasteor other unauthorized waste shall be cause of revocationof the Permit.

21. Recyclables Inspection Plan

The Permittee shall implement the recyclables inspection plandescribed in the Operation & Maintenance Manual. As provided,the facility shall only accept recyclable materials designatedby the respective County/District Recycling Plans as sourceseparated, as per Permit Condition Number 10 (Waste and ClassA Recyclable Materials Acceptance and Processing Capacity) andpursuant to the exemptions as noted at Condition Number 3(Recyclables, in delivered waste loads).

Importico Corporation shall consult with the respectivecounty recycling coordinator on a quarter basis to reviewthose recyclables that are designated as source separatedpursuant to N.J.S.A. 13:1E-99.13.b(2). Should these materialsbe detected in delivered waste loads, the respective countyrecycling coordinator shall be notified in writing. Wheneverpossible, the generator failing to source separate theserecyclables shall be identified and reported to the respectivecounty.The Division of Solid and Hazardous Waste reserves the rightto revise, as necessary, the above stated recyclablesinspection plan.

22. Facility Staffing

The facility shall maintain sufficient staff to ensure proper,orderly and safe operation of materials handling, processing,monitoring, control, safety, emergency and security equipmentitems. Concurrently, the level of staffing shall provide thecapability to handle all routine facility maintenancerequirements and also to respond to all emergency situations.

A fully trained and qualified foreman or supervisor, who isdesignated and authorized by the Permittee to direct andimplement all operational decision, shall be present at thefacility during all operating hours.

23. Facility Personnel Training

All personnel who are directly involved in facility wastemanagement activities or who operate, service or monitor anyfacility equipment, machinery or system shall successfullycomplete an initial program of classroom instruction or on-the-job training. This program shall include instruction inthe operation, inspection, maintenance and repair of thefacility equipment, machinery and monitoring systems,instruction in the use of safety equipment which teaches thepersonnel to perform their duties in a manner that ensures thefacility's compliance with the requirements of N.J.A.C. 7:26-1et seq., and the conditions of all Departmental permits issuedto the facility.

The training program shall ensure that facility personnel areable to respond effectively to any equipment malfunction oremergency situation such as fires, explosions, etc. which mayarise. The training program shall provide procedures to befollowed during planned or unplanned shutdown of operations.

The training program shall include continuous inspection ofincoming loads and identification and proper handling ofsuspected unauthorized wastes.

The training program shall also include fire trainingspecifically applicable to this type of facility andinstructions on noise monitoring to be provided to appropriateemployees.

24. Waste Delivery Haul Routes

The traffic flow routes described in the engineering reportshall be posted at the facility and the Permittee shallprovide photocopies to the users of the facility to ensurethat all trucks adhere to those routes described. Deliveryvehicles not using the assigned routes shall not be permittedto deposit solid waste at the facility.

25. On-Site and Off-Site Traffic Control

On-site traffic control measures shall be implemented toprovide for orderly vehicle movement on the facility grounds. The measures implemented shall include the use of lane

delineation, signals and signs. All on-site roads and loadingramps subject to truck traffic shall be paved and maintainedto withstand heavy traffic usage.

Facility related vehicles shall not be backed, parked orqueued on public streets or roads (Baekeland Avenue). Queuingand staging of collection, transfer and recycling vehiclesshall occur only in the respective areas designated for thatpurpose, in the documents that are listed in Condition Number4 of this Permit.

If the traffic generated by the operation of this facilityresults in congestion of surrounding roads, correctivemeasures shall be promptly developed, submitted to theDepartment for approval and subsequently implemented toalleviate any respective traffic related problems.

26. Fire Protection and Emergency Response

The fire protection and detection system shall be maintainedin operable condition at all times and firefighting equipmentshall be readily available on-site. In the proposed building,wall mounted fire extinguishers as shown on site plan drawingshall be installed and maintained. Further, fireextinguishers shall be installed and maintained in theexisting masonry garage and near the existing diesel tank.

Also, in the proposed building, fire suppression system(sprinkler system), designed per applicable fire code shall beinstalled and maintained.

Fire-fighting procedures and emergency procedures shall beposted prominently in work area and shall include thetelephone numbers of local fire, police, ambulance andhospital facilities.

27. Security

Access to the site shall be restricted to authorized vehicles,facility personnel and authorized visitors only. Securityprocedures shall be implemented that provide for an effective means of controlling entry and exit at all times. Guards,attendants, visual monitors or locked gates shall be utilizedat site entrances and exit points. Security fencing and wallstructures with gate controls shall be maintained around theentire facility.

28. Safety Procedures

The Permittee shall follow the Occupational Safety and Health

Administration (OSHA) standards in the construction andoperation of this facility, for the safety of employees andfor other persons entering the premises. A copy of therelated safety procedures shall be posted prominently in thework area. Additionally, facility staff shall be trained toeffectively respond to any equipment malfunction or emergencysituation that may arise during facility operation. Thisinstruction shall include, where applicable, but not belimited to:

a. The use of personal safety equipment;

b. The use of communications and alarm systems; and

c. The procedures to be followed in response to fires,explosions or other emergencies.

d. Bilingual signage shall be incorporated, as appropriate,for safe operation of equipment.

29. Emergency Situations

An emergency situation is defined as the occurrences of afire, explosion or uncontrolled pollutant discharge oremission to the environment. If an emergency situationoccurs, the emergency coordinator identified in thecontingency plan as described in the O & M Manual shallimplement the following actions:

a. Immediately identify the character, source, amount andextent of any discharge and notify appropriate State orlocal agencies with designated response roles ifassistance is needed.

b. Concurrently, assess possible hazards to public healthor the environment that may result and, as applicable:

(1) Notify appropriate local authorities if anassessment indicates that evacuation of local areasmay be advisable.

(2) Notify the Environmental Action Hot Line at (609)292-7172, reporting the type of substance and theestimated quantity discharged, if known, thelocation of the discharge, actions the personreporting the discharge is currently taking orproposing to take in order to mitigate thedischarge, and any other information concerning the

incident which the Department may request at thetime of notification.

The emergency coordinator shall take all reasonablemeasures to ensure that an emergency situation does notspread to other areas of the facility. Such measuresmay include the cessation of process operations and thecollection and containment of released pollutants.

Immediately after an emergency situation, the emergencycoordinator shall provide for the appropriate treating,storing or disposing of waste contaminated soil orwater, or any other material contaminated as a result ofthe event in accordance with all applicable rules andregulations.

The emergency coordinator shall ensure that no waste isprocessed in the affected unit or area until cleanupprocedures are completed and all equipment is again fitfor its intended use.

The emergency coordinator shall notify the Departmentand appropriate local authorities when operations havereturned to normal.

Within fifteen days after the incident, the emergencycoordinator shall submit a written report on theincident to the Department. The report shall include,but not be limited to, the name, address and telephonenumber of the facility; the date, time and descriptionof the incident; the extent of injuries, if applicable,with names and job responsibilities indicated; anassessment of actual damage to the environment, ifapplicable; an assessment of the scope and magnitude ofthe incident; a description of the immediate actionsthat have been initiated to

clean up the affected area and prevent a recurrence of asimilar incident; and an implementation schedule forundertaking longer term measures to effect cleanup andavoid recurrences of the incident, if applicable.

Nothing in this Condition shall be deemed to supersedeany notification required pursuant to the SpillCompensation and Control Act, N.J.S.A. 58:10.23 et seq.,Hazardous Substance Discharges: Reports and Notices,N.J.A.C. 7:1-7, or the air pollution notificationrequired pursuant to N.J.S.A. 26:2C-19 or any otherindependent statutory or regulatory notice requirements.

30. Emergency Provisions for Equipment Breakdown or Power Failure

In the event of a facility outage or other significantmalfunction which would result in the facility's inability toprocess waste at a rate equal to or exceeding the rate ofincoming waste, the operator shall immediately report suchsituation or event to the Division of Solid and HazardousWaste at (609) 984-6650. At no time shall the capacity of thedelineated tipping area be exceeded nor shall vehicles bepermitted to queue in areas other than those designated in thedocuments that are listed in Condition Number 4 of thisPermit.

31. Operation Records

Records of the facility's operations shall be maintained on adaily basis by the Permittee. Monthly summaries of therecords shall be submitted by the Permittee to the Division ofSolid and Hazardous Waste, Bureau of Recycling and Planning,before the 20th of each month for which the information wasrecorded. The information shall include the following:

a. The weight of solid waste delivered to the facility foreach waste type permitted;

b. The number of collection vehicles delivering waste tothe facility;

c. The volume and tonnage of waste flow, reported by type,from each solid waste district and the respectivemunicipality from which the waste was received;

d. The volume and tonnage of each waste type removed fordisposal and the facility receiving the waste;

e. The number of vehicles removing waste for disposal fromthe facility or recyclables for reuse or furtherprocessing, from the facility;

f. Tonnage records of recyclables recovered shall be keptfor each separate material recovered.

g. For all source separated recyclables received at thefacility, tonnage reporting requirements, pursuant toN.J.A.C. 7:26A-4.4, shall be implemented.

Where applicable, the information required to be recorded inthe daily record shall be supplied by the collector/hauler tothe facility operator on the waste origin/waste disposal (O&D)forms (or duplicates of the same). The O&D forms shall bekept by the Permittee for a minimum of three years and shall

be made available for inspection by the appropriaterepresentative of the Department and shall be submitted to theDepartment upon request.

The information provided on the daily records, O&D forms andmonthly summary shall denote compliance with the adoptedamendments to N.J.A.C. 7:26-2.13, 2B.9 and 2B.10 (mixed loadsrule).

32. Vehicle Registration

The Permittee shall allow only collection and transfervehicles properly registered with the Department, inaccordance with N.J.A.C. 7:26-3, to transport solid waste toand from the facility.

All solid waste collection vehicles utilizing the facilityshall satisfy specific design limitations and be loaded andoperated in such a manner as to ensure compliance with N.J.S.A39:3-20 and N.J.S.A. 39:3-84.

33. Final Disposal

Pursuant to this Permit, the requirements of the Solid WasteManagement Act and its implementing regulations at N.J.A.C.7:26-6.1 et seq., the point of generation of all wastereceived, handled and/or processed at the facility shall bethe physical source and the county solid waste managementdistrict from which the waste entering the facilityoriginates. The Permittee shall not be considered thegenerator of any of the solid waste which, after processing,is to be disposed. All solid waste processed at this facilityother than those materials collected for transportation to arecycling center or final market destination, shall bedelivered to permitted solid waste disposal facilities withinthe appropriate solid waste district of origin as designatedin the particular District Solid Waste Management Plan and inaccordance with N.J.A.C. 7:26-2B.9 and 2B.10. The facilityshall maintain records as per Condition Number 31 of thisPermit in order to document compliance with this requirement.

34. Plans On-Site

One complete set of the approved engineering plans, theengineering report, the environmental impact statement, the O& M Manual, the operation's records and this Permit, asconditioned herein, shall be kept on file at the facility andshall be available for inspection by Department personnel orthe Department's designated representatives.

35. Right of Entry

The Permittee hereby agrees and authorizes Departmentpersonnel or the Department's designated representatives tomake whatever inspections and examinations of all premisesoccupied by the facility which may be impacted by theactivities authorized by this Permit whenever theserepresentatives, in their discretion, consider such aninspection or examination necessary to determine the extent ofcompliance with any and all conditions of the Permit. Anyrefusal to allow entry to the Department's representativesshall constitute grounds for either suspension or revocationof this Permit.

36. Duration of Permit

This Solid Waste Facility Permit is valid for a maximum periodof five (5) years from the effective date of this Permit. This Permit may be renewed, upon proper application pursuantto N.J.A.C. 7:26-2.7, provided that the operation will meetall Departmental requirements that may exist when the renewalapplication is made.

37. Conformance with the Solid Waste Management Plan

This Permit is conditioned upon conformance with allrequirements of the Middlesex County District Solid WasteManagement Plan and State Solid Waste Management Plans asadopted and promulgated, pursuant to N.J.S.A. 13:1E-1 et seq.,(as amended), and all other District Solid Waste ManagementPlans, modifications and waste flow requirements specified atN.J.A.C. 7:26-6.5.

Failure to comply with any or all limitations heretofore mentionedmay result in the Department seeking relief under N.J.S.A. 13:1E-1et seq., the Solid Waste Management Act. Specifically, each day offailure to comply shall constitute a separate violation on thebasis of which a fine may be assessed and may result in loss ofoperating authority, pursuant to N.J.S.A. 13:1E-12.

The issuance of this Permit and the conditions of operationidentified herein shall not be interpreted as relieving theapplicant of his/her responsibility to secure, maintain and complywith all other applicable Federal, State and local permits orsimilar forms of authorization relating to the construction andoperation of this facility.
