The GT’s front and rear-hinged back doors open slightly upward to ensure easy ingress and egress, and the spacious cabin provides comfortable seating for four, assisted by the concept’s unusually long wheel-base of 112.6 inches and overall length of 184.6 inches. Despite

its low stance, an overall height of 54.3 inches allows for plenty of headroom.

The GT is not all looks, however, packing plenty of heat under the hood. Coupled with an eight-speed automatic transmission is a 3.3-liter turbocharged Lambda V6 Gasoline Direct Injection (GDI) engine, allowing the rear-wheel-

In a case involving a car battery that exploded in a consumer’s hands, a fed-eral court in New Jersey has reaffirmed the longstanding notion that retailers can be found strictly liable when they sell defective products. The Nov. 2 deci-sion by U.S. District Court Judge Peter G. Sheridan potentially places a heavy burden on a gamut of retailers consid-ered to be “experts” in their industries, including the likes of auto parts sellers, hardware stores, toy and other specialty retailers, noted LeClairRyan shareholder Thomas C. Regan. He added that super-markets, discount department stores and other mass merchants could also be impacted.

“The implications of this ruling could be far-reaching,” said the veteran product liability litigator, who is based in the national law firm’s Newark office. “For example, it puts the onus on retail-ers to be thoroughly familiar with the products they sell and the packaging in which those products are delivered. Further, it is likely this opinion will be cited in other product liability actions, including failure-to-warn cases in which plaintiffs sue retailers because they were not told about product defects. It is imperative that retailers deal with these issues proactively in order to protect their consumers and themselves from

In the case (DeGennaro v. Rally Manufacturing, 09-cv-443), the plain-tiff claimed injury after a lead-acid bat-tery he had just bought at an Ocean Township Pep Boys exploded in his hand and against his body. He sued both the manufacturer and the retailer. Based upon the evidence, the judge ruled that Pep Boys’ management “knew or should have known” that the battery had the propensity to explode because of the heat sealed packaging. Pep Boys was therefore not allowed to take advantage of certain safe harbor provisions that can protect sellers from product liability, noted Regan, who was not involved in the case.

“The plaintiff’s bar successful-ly argued that the use of heat-sealed packaging was inappropriate because it failed to properly ventilate the bat-teries,” he explained. “Pep Boys filed a motion for summary judgment on the product liability claims, seeking to take advantage of the safe harbor provisions of the New Jersey Products Liability Act, but the court wouldn’t hear of it.”

The safe harbor provisions only protect product sellers under certain circumstances. “They have to be able to identify a manufacturer against whom relief may be obtained, and they cannot

have created the defect in the product in the first place,” Regan explained. “If they knew or should have known of the prod-uct defect, they cannot seek safe harbor. Likewise, they cannot have controlled the product’s design, manufacture, pack-aging or labeling.”

In order to reduce their risk of being found liable in such cases, retailers should redouble their efforts to become thoroughly aware of any defects associ-ated with the products they sell. But this is only the first step--they should also work with their legal counsel to deter-mine the appropriate course of action once those defects or potential defects are uncovered, Regan advised. “When a conversation about potential defects in products being sold occurs, for instance, it is essential that the retailer ‘close the loop’ on such discussions,” he said. “This might include discussing the issue with outside counsel familiar with product liability issues.”

In DeGennaro, there was some evi-dence that Pep Boys knew of the pro-pensity for explosion of the lead-acid batteries in question and yet continued to sell them anyway. “The message for retailers is clear--you are responsible for the products leaving your store, and it is therefore your legal responsibility to make sure they are safe,” Regan said. n

Red-light safety cameras are con-tinuing to save lives and increase road safety throughout Florida. Recent results from the City of Pembroke Pines and the City of Miami Gardens police depart-ments show considerable decreases in crashes at intersections with safety cam-eras.

Since the inception of the red-light safety camera program, Miami Gardens crashes have been reduced by 83% per-cent at the 12 monitored intersections. Crash data from 2008 through October 2011 was closely examined and the city has achieved a steady reduction in col-lisions creating safer roads for the com-munity.

“These cameras are helping modi-fy driver behavior dramatically,” said City

of Miami Gardens Police Chief Matthew Boyd. “I believe that many people are now more cautious on the road and think twice before running a red-light.”

Another Florida city, Pembroke Pines, has also seen great success at the S.W. 129th Avenue/Pines Boulevard intersection. Based on that city’s recent findings, activation of the red-light safe-ty camera suggest a 46 percent decrease in the average annual number of traffic crashes at this intersection.

“This is a large reduction in average traffic collisions,” said Pembroke Pines Police Chief Dan Giustino. “A reduction in crashes translates into saving lives. This program is working.”

Currently, more than 70 communi-ties in Florida, and more than 500 nation-

wide, use technology to create safer roads and safer driving habits. According to the Federal Highway Administration, most communities with camera programs will experience a reduction in red-light run-ning violations ranging from 20-87 per-cent, within about an eighteen month time frame of when an intersection safe-ty camera program is implemented.

“About one year ago, someone carelessly ran a red light and my mother lost her life while riding her bike home from work,” said Genevieve Almodovar and Selena Glass, daughters of Diane Vega, a red-light crash victim. “However, safety cameras make people think before they proceed through a red light. They help save lives of innocent drivers, pedestrians and bicyclists.”n

When the new Porsche Cars North America (PCNA) headquarters opens in late 2013, it will send a clear visual mes-sage that whether man-made structure or automobile, the presence of Porsche DNA means uncompromising quality, performance and style. To ensure that every square inch of the brand new facil-ity is infused with these Porsche brand and product values, Porsche has select-ed HOK, a leading global architectural firm, as its design partner.

“Our vision for our new U.S. corpo-rate home is to create a bold and energiz-ing environment where the physical ele-ments are as memorable and moving as the Porsche driving and ownership expe-rience,” said Detlev von Platen, President and CEO of Porsche Cars North America. “The design must allow employees and visitors to see, hear, feel and experi-ence both the emotional and practical benefits of the Porsche brand, from the moment they first see the building.”

One Porsche Drive, the future address of PCNA, will be home for up to 400 U.S. Porsche employees, and is also designed as a must-see destination for Porsche owners, dealers, enthusiasts and visitors from around the world. It is a unique concept within the auto-motive industry, combining modern offices, technical service and training and the world-class Porsche Customer Experience Center - one of only four such facilities around the globe.

New Porsche U.S. Headquarters Design Mirrors the Bold Energy, Performance and Passion of the Porsche Brand

The “Aerotropolis Atlanta” devel-opment site, near the brand new International Terminal at Hartsfield-Jackson Atlanta International Airport, connects Porsche with millions of con-sumers. By 2015, airport data forecasts over 100 million visitors annually, and one of the first impressions for every traveler will be a bird’s-eye view of the 26.44-acre Porsche facility.

While the exterior structure of the building pays homage to the lines of the iconic Porsche badge, the sights and sounds of Porsche won’t just be thrill-ing visitors on the outside. An equally important part of the design criteria was to bring the Porsche brand and product experience inside to office and meeting environments, hospitality areas, training facilities, even the parking structure. In a first for any North American automo-tive headquarters, the One Porsche Drive site design integrates the track with the building, bringing a whole new defini-tion to “rush hour” - namely that of the adrenaline kind.

“We have designed a building with the same high-energy feel and perfor-mance as Porsche automobiles,” said Todd Bertsch, HOK Atlanta Vice President and Director of Design. “Everything about this space is designed to encourage peo-ple to fall in love with the Porsche brand and automobiles.”

To allow employees and visitors to share that passion, the new head-

quarters office layout will steer clear of “cubicle culture” and instead offer open, light-filled individual and shared work spaces, ideal for collaboration and cre-ative spark.

Discussion and idea exchange between team members is reinforced at every turn, from transparent stairwells to a central “Main Street” atrium and court-yard, where a static display of Porsche automobiles is complemented by close-up views of track action.

Like Porsche cars, technology also plays an important role in the facility design, especially in the achievement of sustainability goals. HOK will consider principles of biomimicry, the study of how plants and animals adapt over time to thrive in specific geographies. From landscaping that acts as a natural shade producer in the summer and lets in more sun during the winter to rooftop rainwa-ter collection and filtration, One Porsche Drive will strive for a high level of LEED certification.

“HOK’s design solution boldly and progressively captured our Porsche vision and aesthetic,” said von Platen. “We are now looking forward to shifting from planning to breaking ground - and laying the foundation for strong and ongoing growth in the U.S. market.”

Porsche expects to dedicate the new U.S. headquarters location with an official ground breaking ceremony in early 2012.n

The Genesis 3.8-liter Lambda engine will receive direct injection (GDI) technology, boost-ing its output 15 percent from 290 to 333 horsepower, an impressive gain of 43 horsepower with no increase in dis-placement. In addition, peak torque rises from 264 lb.-ft. to 291 lb.-ft., a generous

increase of 27 lb.-ft. from the same 3.8 liters. Compression ratio increases from 10.4:1 to 11.5:1 for greater thermal effi-ciency. This new direct-injected Lambda V6 produces a higher specific output (87.6 hp/liter) than its normally-aspirated premium luxury competitors.

All 3.8-liter engines will be cou-pled to an in-house-developed eight-speed transmission with SHIFTRONIC and pre-cisely calibrated gear ratios for an overall transmission efficien-cy gain of six percent.

Toyota team members recently celebrated the opening of Toyota Motor Manufacturing, Mississippi (TMMMS), the company’s new $800 million plant outside of Tupelo that assembles the Corolla, the world’s best-selling car of all time. Joining the celebration were Toyota Motor Corporation President Akio Toyoda and Mississippi Governor Haley Barbour.

TMMMS is Toyota’s fourteenth North American plant, further advancing the company’s efforts to design, develop and build vehicles where they are sold. The plant has the annual capacity to pro-duce 150,000 vehicles and will employ nearly 2,000.

Speaking at the ceremony, Toyoda said, “Building vehicles where we sell them helps us be even closer to our cus-tomers. The U.S. market remains a key

When Toyota announced the Blue Springs project, they also announced a partnership with the CREATE Foundation and a donation of $50 million - $5 million a year for 10 years - was also announced toward an innovative addition to the public school system in the Pontotoc, Union, and Lee counties. The Center for Professional Futures will be an education facility that will expose students in the eight school districts in the PUL Alliance counties in to professional careers through high performance teaching and a modern learning environment.n

Providence TrinityKids Care, the only children’s hospice program serv-ing Los Angeles and Orange counties, recently received a Toyota Sienna mini-van, courtesy of Toyota’s 100 Cars for Good program, which awarded 100 vehicles over the course of 100 days to 100 deserving non-profit organizations. The Sienna minivan for Providence is one of 16 donated vehicles that have been specially built by Toyota to better assist those who are mobility-impaired, whether due to illness, age or disabil-ity. The delivery took place at Toyota’s Torrance campus.

Providence TrinityKids Care is a pediatric hospice service for critically ill children and their families, whose team of medical experts provide their expertise to help keep children com-fortable at home. The organization is the only dedicated in-home children’s hospice and palliative care program in Los Angeles and Orange counties. The organization plans to use its Toyota Sienna to develop its Transportation Program, which will help families get to and from medical appointments.

“Passing the hat” is a time-hon-ored tradition of collecting donations for a worthwhile cause. At the 2011 SEMA Show, which took place November 1-4, 2011 at the Las Vegas Convention Hall, the Society of Collision Repair Specialists (SCRS) put its own unique spin on the tradition by “passing the helmet” for Operation Comfort’s Automotivation

SCRS and Collision Industry Raise over $3,200 for Operation Comfort’s Automotivation Program

initiative; the overall fundraising effort resulted in the collection of over $3200 for the non-profit organization.

Operation Comfort, located in San Antonio, Texas, provides support to U.S. service members who have been wounded in Afghanistan or Iraq and are receiving treatment at the Brooke Army Medical Center (BAMC). As a form

of occupational therapy and career replacement, Operation Comfort runs a program entitled Automotivation where wounded service members rehabilitate through automotive-related activities such as rebuilding and restoring cars, trucks, and motorcycles on a ranch outside of San Antonio. Two vehicles the soldiers worked on as part of the

Automotivation program, a 1957 Dodge Power Wagon used by the Army as a weapons carrier and a 1966 Cobra kit car, were on display at the SEMA Show.

“Operation Comfort pro-vides a great place to work with lots of space and tools I wouldn’t otherwise have access to, like a lift, power tools and a compres-sor,” said Sergeant Robert Dickey, an Automotivation participant who was at the SEMA Show. “It’s an opportunity to get out and do something I enjoyed doing before I got injured, plus it gives me the opportunity to consider doing something that I love for a living. I’m very thankful for that.”

In an exclusive interview conducted by CollisionHub with SCRS Executive Director Aaron Schulenburg at the SCRS booth, Operation Comfort Executive Director Janis Roznowski expressed her gratitude for the industry’s efforts on behalf of the program. “A lot of our guys are gear heads, and Automotivation gives them a chance to leave the hospital and the barracks to do something they love,” Roznowski explained. “In the process, they may find a new career path open-ing up in front of them. We thank SCRS and the collision industry for their generosity. The money collected at this show is going to go to our next project, the resto-ration of a 1934 Ford Cabriolet.”

The Gear Up FloridaCoalition, com-prised of Florida residents, law enforce-ment agencies and business associa-tions, is dedicated to protecting Florida’s insurance consumers from soaring costs resulting from the criminal abuse of Florida’s no-fault law.

“We want to end automobile accident fraud and the organized sys-tems that support it,” said Associated Industries of Florida General Counsel Tammy Perdue. “Legislative action in 2012 is essential to protect Florida’s businesses and insur-ance consumers from what government officials have called, ‘a nearly $1 billion fraud tax on Florida Consumers.’”

As a result of accident fraud, Florida insurance con-sumers pay 56 percent more than consumers in other states for automobile insurance pre-miums - an average of $736 in Florida versus $471 country-wide. Staged accidents, ram-pant litigation, and unscru-pulous medical clinics that provide services to Personal Injury Protection claimants have created a perfect storm of skyrocketing costs for hon-est Florida consumers.

Florida leads the nation in staged automobile acci-dents and questionable insur-ance claims. Four of the top 10 U.S. hotspots with the high-est rate of questionable auto claims are in Florida: Tampa, Miami, Orlando and Hialeah. If the underlying problems that allow for the abuse of Florida’s no-fault law are not addressed in 2012, Florida’s consumers will continue to pay the price.

Worse, the Florida Office of Insurance Regulation warns that the current trend in fraud-ulent claims is unsustainable and may lead to an automo-bile liability insurance avail-ability crisis.

“Undercover investiga-tions have revealed that many participants in staged acci-

The Automotive Service Association (ASA) Board of Directors met recently and discussed changes to the ASA policy on replacement crash parts. The board voted unanimously to approve a new policy for crash parts.

With reference to the new pol-icy, Dan Stander, AAM, ASA Collision Division director and co-owner of Jerry Stander's Collision Works, Littleton, Colo., said:

"ASA's replacement crash parts position statement is in response to today's parts usage and market condi-tions. With an increasing number of part types with various levels of qual-ity, and an increase in the number of processes used to validate - or not validate - these various lines of quality, it is confusing at best to most repairers. "ASA's position better defines its goal to provide the highest level of repair by requiring full disclosure of all part types by all parties, and having the standard for replacement crash parts that are

ASA Recognizes Value of Certification and Verification for Parts Quality certified and verified to be the equiva-lent of the OEM part."

The new crash parts policy reads: ASA supports requiring insurers

and auto collision facilities to provide disclosure of part type, description and warranty information to the consumer for all part types including, but not limited to, original equipment manu-facturer, aftermarket, recycled, reman-ufactured, reconditioned and rebuilt crash parts.

ASA supports quality parts, cer-tified and verified in which the qual-ity is determined based on empirical and measurable evidence equal to the standard of OEM parts. ASA recom-mends quality verification and testing related to metallurgy, fit, functionality and responsiveness.

ASA believes a competitive parts marketplace, of tested and verified quality parts, is in the best interest of the motoring public. ASA continues to oppose parts policies that focus solely

on cost efficiency without regard to cer-tification, verifiable quality and safety.

Roy Schnepper, AAM, ASA Government Affairs Committee chair-man and owner of Butler's Collision Inc. in Roseville, Mich., said:

"We are seeing a changing mar-ket in the collision industry, especial-ly in reference to the growing use of aftermarket crash parts, which we, as shop owners, are being asked to use in repairing vehicles.

"ASA believes collision repairers should have confidence that replace-ment crash parts will respond equally as well in a secondary collision as the parts originally placed on the vehicle. Collision repairers, insurers, parts dis-tributors and manufacturers must work together to ensure the testing and veri-fication procedures are the best pos-sible to protect consumers and repair-ers. Mazda Motor Corporation has developed the world's first passenger vehicle regenerative braking system that uses a capacitor. The groundbreak-ing system, which Mazda calls 'i-ELOOP', will begin to appear in Mazda's vehicles in 2012. In real-world driving condi-tions with frequent accelera-tion and braking, 'i-ELOOP' improves fuel economy by approximately 10 percent.

M a z d a ' s r e g e n e r a -tive brak-ing system is unique b e c a u s e it uses a c a p a c i t o r, which is an e l e c t r i c a l c o m p o n e n t that temporar-ily stores large volumes of electric-ity. Compared to bat-teries, capacitors can be charged and discharged rapidly and are resistant to deteriora-tion through prolonged use. 'i-ELOOP' efficiently converts the vehicle's kinetic energy into electricity as it decel-erates, and uses the electricity to power the climate control, audio system and numerous other electrical components.

Regenerative braking systems are growing in popularity as a fuel saving technology. They use an electric motor or alternator to generate electricity as the vehicle decelerates, thereby recov-ering a portion of the vehicle's kinetic energy. Regenerative braking systems in hybrid vehicles generally use a large electric motor and dedicated battery.

Mazda examined automobile accelerating and decelerating mecha-nisms, and developed a highly efficient regenerative braking system that rap-idly recovers a large amount of electric-ity every time the vehicle decelerates. Unlike hybrids, Mazda's system also avoids the need for a dedicated electric motor and battery.

'i-ELOOP' features a new 12-25V variable voltage alternator, a low-resis-tance electric double layer capaci-tor and a DC/DC converter. 'i-ELOOP' starts to recover kinetic energy the

moment the driver lifts off the accel-erator pedal and the vehicle begins to decelerate. The variable voltage alterna-tor generates electricity at up to 25V for maximum efficiency before sending it to the Electric Double Layer Capacitor

(EDLC) for storage. The capacitor, which has been specially devel-

oped for use in a vehicle, can be fully charged

in seconds. The DC/DC converter

steps down the electric-

ity from 25V to 12V before it is distr ibut-ed directly to the v e h i c l e ' s

e l e c t r i c a l components.

The system also charges the vehi-

cle battery as neces-sary. 'i-ELOOP' operates

whenever the vehicle decel-erates, reducing the need for the engine to burn extra fuel to gen-erate electricity. As a result, in

"stop-and-go" driving conditions, fuel economy improves by approximately 10 percent.

The U.S. Senate Committee on Environment and Public Works held a full committee markup titled "Highway Construction Programs Reauthorization to consider Senate Bill 1813, 'Moving Ahead for Progress in the 21st Century' (MAP-21)." During the markup, the com-mittee unanimously approved S. 1813, a bill to reauthorize the nation's transpor-tation programs for two years.

MAP-21 builds on the success of HSIP and sub-stantially increases the amount of fund-ing for this program because of the strong results it has achieved in reduc-ing fatalities. Under HSIP, states must develop and implement a safety plan that identifies highway safety programs and a strategy to address them.

The Automotive Service Association is pleased to announce the Secure Data Release Model (SDRM) will now be managed by ASA. The SDRM is a secure method to support immo-bilizer reset and key code distribution through traditional aftermarket sup-port channels. It helps ensure that only registered security professionals can gain access to vehicle key codes.

Previously managed by the Associated Locksmiths of America (ALOA), the SDRM moves to ASA per the organization’s charter now that ALOA has relinquished its management responsibility. ASA has contracted David Lowell, former executive direc-tor of ALOA, to manage the project. Lowell will continue to run the SDRM on a day-to-day basis working closely with ASA staff at its new headquarters in Colleyille, Texas.

Task Force (NASTF) SDRM has been a great benefit to all stakeholders includ-ing the OEMs, aftermarket repair facili-ties, locksmiths and consumers. I look forward to working with ASA and the opportunity to continue to be directly involved in providing this valuable ser-vice. As we look to the future, there are many opportunities for expanding the use of the SDRM including theft-related parts, tools and other vehicle security-related items,” said Lowell.

The Secure Data Release Model, developed by the NASTF Vehicle Security Committee, continues to be the indus-try solution to what was previously a service information gap. Development of the SDRM began in 2003 and was fully implemented in January 2008, bringing multiple components together including the automaker interfaces and

the National Insurance Crime Bureau interface. Since its launch, ALOA and ASA have held joint responsibility for overseeing the SDRM. ALOA took the lead in developing the SDRM registry interface, and managing the registry and registration process.

“As the SDRM takes on new responsibilities – including vehicle module initialization and theft-related parts programs – ASA is ready and eager to play a larger role in the growth of the SDRM,” said Ron Pyle, ASA presi-dent and NASTF chairman.

Since the 2002 ASA-Automaker Service Information Agreement, ASA has worked with automakers and other industry groups to ensure that inde-pendent repairers have access to the same service and tool information, and training, as franchised new car dealers.n

Rulemaking (NPRM)While challenging, Volkswagen is

encouraged that the proposed stan-dards set a single, national fuel econo-my program for the foreseeable future. However, Volkswagen would like to see the same flexibilities and alternative compliance paths afforded the heavi-est trucks be available to the smallest, already fuel-efficient passenger cars. Furthermore, the proposal is not tech-nology neutral and does not encourage the benefits of technologies, like clean diesel, that are available now, affordable

to mainstream consumers, and provide immediate fuel economy improvements and CO2 reduction benefits, enhancing our energy security and protecting the environment.

A lot of good work has been done, but there is room and a need for some improvements to keep a level playing field for all automakers to attain the chal-lenging new goals. Volkswagen looks forward to expressing these concerns and continuing negotiations with the Administration.n

The Automotive Service Association (ASA), AASP, SCRS and the Assured Performance Network recently joined together as a unified voice regarding repair standards. Representing collision repair businesses and technicians across the United States, ASA joined with the other industry groups in recommending that the published repair procedures pro-vided by automotive original equipment manufacturers (OEMs) be the official industry-recognized "repair standards" for collision repair. The joint statement also recommended that these standards, where they exist, be the basis for the establishment of training, testing, repair practices and documentations.

ASA Signs Joint Position Statement Addressing Collision Repair StandardsThe signing parties also recom-

mended that in situations where OEM repair procedures are incomplete in com-parison to the full scope of vehicles and repair operations that exist in the market-place, the OEM published repair proce-dures shall serve as the baseline for indus-try repair standards, with the recognition that further development of procedures would be necessary in areas not covered by published procedures.

ASA joins with the other groups to officially ask the Inter-Industry Conference on Auto Collision Repair (I-CAR) board of directors to establish within its over-all organizational structure an industry council to identify gaps in existing OEM

procedures and develop processes to close gaps, vet industry proposed alter-natives, modifications, and additions to OEM repair procedures. The council will include volunteer representatives serv-ing several groups, including ASA, SCRS, AASP and I-CAR.

Ron Pyle, ASA president and chief staff executive, said, "ASA supports a dec-laration that OEM repair practices, docu-mentation, training and testing serve as the foundation for repair standards. ASA also supports working with I-CAR and others in closing any gaps in repair pro-cedures as we, as an industry, continue to elevate the quality and craftsmanship of automobile service and repair."n

Nearly all drivers (96 percent) feel drowsy driving is an unacceptable behav-ior, yet almost a third (32 percent) admit-ted driving when they were so tired that they had difficulty keeping their eyes open in the past month, according to the AAA Foundation for Traffic Safety’s 2011 safety culture survey. A study released last year by the AAA Foundation found that one of every six deadly crashes and one in eight crashes causing serious injury involved a drowsy driver. This is substan-tially higher than previous estimates, con-firming the suspicions of researchers that the impact of drowsy driving on motor vehicle crashes, injuries, and deaths has been greatly underestimated.

“Although the vast majority of driv-ers recognize the serious threat of drowsy driving, a ‘Do as I Say, Not as I Do’ attitude

Recent AAA Foundation research on drowsy driving found that two out of every five drivers (41 percent) admit to having fallen asleep at the wheel at some point, with one in 10 saying they

had done so in the past year. “What’s so alarming is that over half of these driv-ers reported having fallen asleep while driving on high?speed roads,” said AAA’s Director of Traffic Safety Advocacy and Research Jake Nelson. “These data under-score the importance of educating driv-ers about the dangers of drowsy driving.”

For more than two decades, the National Sleep Foundation has worked to raise drowsy driving awareness and related education.

Since our business is comprised of multiple locations, I’m looking forward to utilizing the training in all three of my stores, to bring everyone up to speed on some of the process adjustments we are going to make; plus, it’s an honor to know the money is supporting such a great cause like Operation Comfort. I got to meet some of the soldiers in the program while at the SEMA Show, and it is great to know there is a program like that to help.”

Dr. Winslow Sargeant has been confirmed as the chief counsel for advo-cacy by the U.S. Senate, being the sixth presidentially appointed and Senate-confirmed chief counsel for the Office of Advocacy.

Sargeant had been serving as chief counsel since August 2010 under

Senate Confirms Small Business Chief Counsel for Advocacya recess appointment. During his time as chief counsel, the Office of Advocacy has held more than 40 small-business round-tables to hear from small businesses on their issues and concerns. The Office of Advocacy has also filed 56 public com-ment letters with federal agencies trying to mitigate the impact of proposed regu-

lations on small businesses.Sargeant made the following

comments regarding his position: "It is inspiring to witness the country's entre-preneurial spirit and it is an honor to represent small businesses every day ... I would like to thank President Obama, the Senate, and the small-business orga-nizations and entrepreneurs who have supported my nomination."

Sargeant's previous work includes being the managing director for Venture Investors LLC in Madison, Wis. He received a Ph.D. in electrical engineer-ing from the University of Wisconsin, Madison, and co-founded Aanetcom, a semiconductor integrated circuit design company. He had the following to say regarding his past experiences and how they helped prepare him for his latest job: "My background gives me the unique perspective to understand the challenges that our entrepreneurs face day in and day out. As chief coun-sel I am dedicated to working on their behalf and fighting for their interests in Washington."

As chief counsel for the U.S. Small Business Administration's Office of Advocacy, Sargeant's position will involve directing Advocacy's operations, including conducting research on the U.S. small-business sector, advocating for small business within the federal government's agencies and rulemaking processes, reaching out to regional and state small-business advocates and poli-cymakers, and fostering public aware-ness of small-business contributions and concerns.n

As congressional support for the bipartisan-sponsored Motor Vehicle Owners’ Right to Repair Act (HR 1449) continues to climb, Massachusetts motor-ists have come together on the state level to help ensure that Right to Repair will appear on the 2012 ballot in their state, according to Kathleen Schmatz, president and CEO of the Automotive Aftermarket Industry Association (AAIA).

“We are very pleased with the growing support for Right to Repair on both the federal and state levels. The momentum building in Congress, cou-pled with the groundswell of support from voters in Massachusetts, demon-strates how important Right to Repair is to consumers, especially in a tough econ-omy,” said Schmatz. “Right to Repair will help alleviate motorists’ financial bur-den by ensuring a competitive vehicle repair marketplace, allowing car owners to patronize the repair facility of their choice.”

Right to Repair levels the competi-tive playing field for motoring consum-ers and between new car dealerships and independent repair shops by requir-ing that car companies provide full, fair access at a reasonable cost to all non-proprietary service information, tools, fault codes and safety-related bulletins needed to repair motor vehicles. “ B o t h parties are talk-ing about jobs and the econ-omy. Right to Repair is a jobs and affordabil-ity bill during this economic downturn,” said Sandy Bass-Cors, executive director of the Coalition for Auto Repair Equality (CARE). “The automo-tive aftermarket employs nearly five million peo-ple nationwide and, unless the Right to Repair Act passes,

many of those jobs could be downsized. And, as more Americans choose to keep their vehicles longer for financial reasons, Right to Repair is even more of a fiscal necessity for them.”n

The Federal Trade Commission (FTC) conducted its third and final Motor Vehicle Dealer Roundtable on Thursday, Nov. 17 in Washington, D.C. The roundtable focused on the follow-ing areas:

1. Alleged misrepresentations and other misconduct in consumer leasing transactions;

2. Consumer and business educa-tion;

3. Alleged abuses by automobile dealers that significantly harm consum-ers; and

4. Widespread dealer conduct that currently is lawful but may nevertheless

ics to determine what, if any, actions it should initiate to further protect consumers. The actions it may pursue include rulemaking, enforcement, and consumer and business education.

As with the two prior FTC round-tables in Detroit and San Antonio, NADA representatives provided a vig-orous defense of the dealer-assisted financing model and provided exten-sive information to correct and rebut a series of misstatements made about various dealer practices.

NADA also underscored that, despite repeated requests for empirical

information from the FTC, the consumer group allegations of dealer misconduct were anecdotal and unsupported by current and reliable data demonstrating that they are widespread.

NADA will remain actively engaged in this matter and will continue to work with the FTC to promote a better under-standing of the extraordinary value and benefits that dealer-assisted financing provides to millions of consumers each year.

NADA will also continue to stress to its members the need to keep current with the full range of federal and state legal requirements governing their operations.n

“America’s auto dealers support continuous improvement in the fuel economy of the fleet of vehicles that drive on the nation’s roads. To this end, we are concerned that adding about $3,000 to the average cost of a car will price millions of Americans out of the market, which could reduce fleet turn-over and delay environmental gains.

“This regulation gambles that mil-lions of consumers will be able to afford

This policy is contrary to what most consumers are actually buying today, despite the wide availabil-ity of more fuel efficient models. The number one question that must be asked is: How many people will no longer be able to afford a new vehicle if the government raises the price of a new car by about $3,000? We will ana-
