Santa Clara County's Electronic voting system gives visually-impaired voters the ability to cast a secret ballot without assistance. The voting system is equipped with an audio voting component that allows voters to listen to the ballot and make their choices using the keypad provided. The keypad includes a "sip and puff" feature as well.

Electronic Ballot Voting Instructions

Activate the voting machine by inserting the Voter Card into the yellow slot on the lower left-hand side of the voting machine.

Choose the language in which you wish to vote.

Make your selection by touching the circle to the right of the candidate or measure response of your choice. A green checkmark will appear in the circle.

To change your selection, touch the checkmark again. The checkmark will disappear and you may make a new selection.

To vote for a qualified write-in candidate, touch the circle to the right of the word "WRITE-IN". When the keyboard screen appears, touch the letters of the candidate’s name, then touch the "OK" button in the lower right-hand corner of your screen to continue.

To enlarge the type size, touch the "ABC" button.

When you are done with your selections, touch the "Next" arrow in the lower right corner of the screen.

To review your selections at any time prior to casting your ballot, touch "Review" at the bottom center of the screen. The Review screen will provide you with a summary of your selections. If you have not made a selection, or all "vote for possibilities" in a contest, this contest could appear in red. Touch the red contest to return to it.

Press "Touch here to review the required paper record of your ballot." Your record will be displayed behind the glass to the left of the screen. Please review the paper record to verify your vote.

If you want to make a change press "Make Changes" on the left. Some ballots may print more than one review page. Touch "Continue Printing" until there are no more ballot pages for you to review. Conditional Voter Registration

Effective January 1, 2017, Conditional Voter Registration is available to eligible voters in California pursuant to Election Codes 2170 through 2173.

Conditional Voter Registration (CVR) extends the existing 15-day registration deadline to eligible voters, allowing them to register and vote 14 days prior to an election through Election Day. An eligible voter would need to register directly in the office of the Santa Clara County Registrar of Voters, located at 1555 Berger Drive in San Jose, CA, 95112 to conditionally register to vote and vote a provisional ballot. Voters may register online at www.sccvote.org, however, CVR ballots will only be issued at the Office of the Registrar of Voters or at a designated satellite location and not at the poll sites.

In order to conditionally register, the voter must first complete an affidavit of registration (also known as a Voter Registration Card). Once the registration is submitted, the Registrar of Voters will issue a CVR provisional ballot to vote.

The affidavit will be processed and once the eligibility is determined and validated, the registration will become permanent and once the CVR provisional ballot is validated, it will be counted.

Conditional Voter Registrations are treated and processed in the same manner as other registrations; CVR provisional ballots are treated and processed the same as other provisional ballots.

CVR was enacted in 2012, to be operative on the January 1st after the certification of a statewide voter registration database. VoteCal, California’s statewide voter registration database, was certified on September 26, 2016; CVR became operative as of January 1, 2017.

MEASURE B

COUNTY COUNSEL'S IMPARTIAL ANALYSIS OF MEASURE B

Measure B was placed on the ballot by the Board of Trustees (Board) for the Mountain View Whisman School District (District). The Board proposes a tax on parcels of real property at a rate of $191 per parcel per year that will be collected beginning on July 1, 2017. The proposed tax will expire, and collection will end, eight years later. The proposed tax will replace an existing parcel tax of between $127 and $1,016 per parcel per year, which will expire on June 30, 2017.

For the District to impose the proposed tax, Measure B must be approved by at least two-thirds of those voting on it.

There are exemptions from the proposed tax. Certain parcels that are currently exempt from the expiring tax will be automatically exempt from the proposed tax. An exemption from the proposed tax will be made available, upon application, to any owners of a parcel used solely for owner-occupied single-family residential purposes who: (1) are receiving Social Security Income for a disability regardless of age; (2) are 65 years of age prior to July 1 of the tax year; or (3) are receiving Social Security Disability Insurance benefits, regardless of age, and whose yearly income does not exceed 250 percent of the 2012 federal poverty guidelines issued by the United States. Parcels that would otherwise be exempt from property tax will also be exempt from the proposed tax.

State law requires the District to state the specific purposes for which the tax proceeds will be used and to only spend the proceeds of the tax for these purposes. The stated purposes of the proposed tax are to: (1) continue local school funding; (2) support struggling students; (3) offer competitive compensation to attract and retain the best teachers; (4) maintain small class sizes; (5) enhance hands-on science, technology, math and engineering programs; (6) maintain outstanding music and art education; and, (7) support core academics.

The District is also required to provide additional accountability measures for the proceeds. These measures include: (1) depositing the proceeds into a fund that is separate from other District funds; and (2) providing an annual written report to the Board stating the amount of funds collected and expended, and the status of any project authorized to be funded from the tax proceeds. The Board will also appoint or designate an independent advisory committee to provide oversight of expenditures of the tax proceeds.

Under state law, the District has an appropriations limit. The Board will adjust the District's appropriations limit as necessary to permit the proceeds of the proposed tax to be spent. The Board will reduce this tax if it has the effect of decreasing or offsetting local, state or federal government funding that would otherwise be available to the District.

A "yes" vote is a vote to approve a parcel tax of $191 per parcel for eight years.

A "no" vote is a vote to not approve the proposed parcel tax.

• Sustain high academic achievement and ensure studentsuccess as academic needs evolve by maintaining schoollibraries, small class sizes, outdoor education, music and artsprograms, student leadership classes, after-school programsand by supporting English language learners;

• Expand class size reduction, offset reduced State funding forK-3 class size reduction, and lower class size for grades 4-8;

• Increase instructional time by providing interventionprofessionals at each school site, programming during schoolbreaks, and enrichment programming and staff development;

• Increase instructional time by providing after-school intervention professionals at each school site, programming during schoolbreaks, and enrichment programming and staff development;

• Attract and retain highly qualified teachers by recruitingteachers with high demand skills and credentials;

• Provide program support for extra curricular/co-curricularactivities;

• Protect the taxpayers' investment in education and ensureDistrict accountability by providing for taxpayer oversight andindependent financial audits of revenues and expenditures.

A. Amount and Basis of Tax

The qualified special tax shall be $191 per year, per Parcel of Taxable Real Property beginning on July 1, 2017 and continuing for a period of eight (8) years. The District shall provide the Santa Clara County Tax Collector ("County Tax Collector") a report indicating the parcel number and amount of tax for each Parcel of Taxable Real Property.

This qualified special tax is estimated to raise $2.8 million in annual local funding for District schools. The amount of annual local funding raised by this qualified special tax will vary from year-to-year due to changes in the number of parcels exempt from the levy.

To the extent allowed by law "Parcel of Taxable Real Property" shall be defined as:

1) Any unit of real property which lies wholly or partially within theboundaries of the District and that receives a separate tax billfor ad valorem property taxes from the County Tax Collector'sOffice.

2) All property that is otherwise exempt from or upon which arelevied no ad valorem property taxes in any year shall not beconsidered a Parcel of Taxable Real Property for purposes ofthe special tax in such year.

If any portion of this definition is deemed contrary to law, the Board declares and the voters by approving the Measure concur, that every other section and part of this definition has independent value, and the Board and voters would have adopted each other section and part hereof regardless of every other section or part hereof. If all sections or parts of this definition are deemed contrary to law, "Parcel of Taxable Real Property" shall be defined as any real property in the District assigned an assessor's parcel number.

B. Exemptions

Under procedures adopted by the District, upon application, an exemption from payment of the qualified special tax will be made available to any owners of a parcel used solely for owner-occupied, single-family residential purposes who:

1) Are receiving Supplemental Security Income for a disabilityregardless of age; or,

2) Will attain 65 years of age prior to July 1 of the tax year; or,

3) Are receiving Social Security Disability Insurance benefits,regardless of age, and whose yearly income does not exceed250 percent of the 2012 federal poverty guidelines issued bythe United States Department of Health and Human Services.

Any one application from a qualified applicant will provide an exemption for the parcel for the remaining term of the qualified special tax, so long as such applicant continues to qualify for the exemption. Exemptions granted under the current qualified special tax levied by the District will not require re-approval and will provide an exemption for the parcel for the term of the qualified special tax levied pursuant to this Measure so long as such applicant remains eligible for the exemption.

C. Claim/Exemption Procedures

With respect to all general property tax matters within its jurisdiction, the County Tax Collector or other appropriate County tax official shall make all final determinations of tax exemption or relief for any reason, and that decision shall be final and binding. With respect to matters specific to the levy of the special tax, including the exemptions, the application of the definition of "Parcel of Taxable Real Property" to any parcel(s) or any other disputed matter specific to the application of the special tax, the decisions of the District shall be final and binding.

The procedures described herein, and any additional procedures established by the Board shall be the exclusive claims procedure for claimants seeking an exemption, refund, reduction, or re-computation of the special tax. Whether any particular claim is to be resolved by the

District or by the County shall be determined by the District, in coordination with the County as necessary.

D. Appropriations Limit

Pursuant to California Constitution and applicable laws, the appropriations limit for the District will be adjusted periodically by the aggregate sum collected by levy of this special tax.

E. Accountability Measures

1. Specific Purposes. The proceeds of the special tax shall beapplied only to the specific purposes identified above.

2. Annual Reports. The proceeds of the special tax shall bedeposited into a fund, which shall be kept separate and apartfrom other funds of the District, pursuant to the GovernmentCode. No later than December 31 of each year while the taxis in effect, the District shall prepare and file with the Board areport detailing the amount of funds collected and expended,and the status of any project authorized to be funded by thismeasure. The report may relate to the calendar year, fiscalyear, or other appropriate annual period, as said officer shalldetermine, and may be incorporated into or filed with the annual budget, audit, or other appropriate routine report to the Board.

3. Independent Oversight Committee. A committee shall beappointed or designated by the Board to ensure that thespecial tax proceeds are spent for their authorized purposes,and to report annually to the Board and the public regardingthe expenditure of such funds. The Board shall provide for thecomposition, duties, funding, and other necessary informationregarding the committee's formation and operation, and maydesignate an existing committee to oversee this measure'srevenues.

F. Protection of Funding

Current law forbids any decrease in State or federal funding to the District resulting from the adoption of an education parcel tax. However, if any such funding is reduced or affected because of the adoption of this local funding measure, then the Board may reduce the amount of the special taxes levied as necessary in order to restore such State or federal funding and/or maximize the District's fiscal position for the benefit of the educational program. As a result, whether directly or indirectly, no funding from this measure may be taken away by the State or federal governments.

G. Severability

The Board hereby declares, and the voters by approving this measure concur, that every section and part of this measure has independent value, and the Board and the voters would have adopted each provision hereof regardless of every other provision hereof. Upon approval of this measure by the voters, should any part of the measure or taxing formula be found by a court of competent jurisdiction to be invalid for any reason, all remaining parts of the measure or taxing formula hereof shall remain in full force and effect to the fullest extent allowed by law.

For over a decade, voter-approved funding has supported core academics and retained highly-qualified teachers in local elementary and middle schools.

Now this funding is set to expire and, without it, teachers could be laid off, class sizes could increase and school libraries could close.

Measure B preserves current levels of funding for our schools so local students can continue to succeed.

All children deserve the same outstanding education, regardless of where they attend school. Measure B ensures Mountain View students are just as prepared for high school, college and great careers as students in Los Altos and other surrounding communities.

REBUTTAL TO ARGUMENT IN FAVOR OF MEASURE B

Former School Trustee Steve Nelson makes some good points in his opening argument against this flat parcel tax measure. I have some other points.

At a time when thousands of new housing units are being added locally and school enrollment is bound to increase greatly, this District has school sites rented out to get more money for salaries and benefits.

The District just extended a lease at Slater School on North Whisman Road after having voted to re-open Slater as a public school! Now the District would need to add hugely expensive new buildings to share the site. It seems rather crazy.

More than a year ago, I raised the issue of increasing the safety of the schools from potential intruders-including terrorists-by adding some cameras with a few dollars of school bond money.

I suggested that cameras are like car alarms; bad guys are more likely to skip cars with alarms and schools with some cameras. District officials evidently failed to even discuss the idea.

Frankly, if (or when) there is a terrorist attack on a school anywhere in America, centralized schooling may become a thing of the past. Students will need to learn at home, online or in smaller settings.

How about contingency planning? Burying one's head in the sand will not help.

This District needs something other than a little more money from a parcel tax. It needs leadership focused on the best interests of students.

ARGUMENT AGAINST MEASURE B

• Measure is a regressive tax: large wealthy landowners pay lessthan before.

• The Administration is again not restricted from shifting funding.• There is not a fiscal crisis: projections are 23% Reserves, 17% is

suggested.• District Leadership planned this poorly and is now in a rush.

Local voters have never supported a regressive tax to fund local education. This unfair tax proposal reduces the amount that large commercial property owners pay and increases the tax on individual homeowners to completely make up the difference! In contrast Alameda, Emeryville and Berkeley have recent per-square-foot taxes where larger properties pay more taxes. These are legal and have been easily defended. MVWSD could have had such a Fair Tax, which might have been fully discussed by the Board and outside experts-but President Wheeler "left any discussion on the parcel tax measure off the agenda until...December." Administrators can freely move around programs and money. Measure C spending like "custodians" and "warehouse/operations" has gotten With Concerns votes from Oversight Committee members since 2013. The spending language is again very ambiguous rather than being focused by "percentage" on EXACTLY what voters want to support and PROTECT.

Let it be clear, there is no MVWSD fiscal crisis: the Budget and Reserves projections have shown 23% 2019 Reserves even with the Parcel Tax expiring in June 2017. A better, fair, progressive tax can be discussed and passed after the voters make this unfair Measure disappear.

By rushing this with quick meetings since only December 8 through approval January 28, by delaying this to the last possible interval before the previous tax expires–the district Leadership has again shown poor planning. Good Public Policy and a Fair Tax should not fall before poor Administration planning.

REBUTTAL TO ARGUMENT AGAINST MEASURE B

The lone opponent has his facts wrong. Here's the truth:

FACT: For 13 years Mountain View schools have relied on locally controlled parcel tax funding. Without Measure B, this funding expires in June and cuts will follow, such as teacher layoffs, class size increases and school library closures.

FACT: Measure B isn't rushed. The issue was discussed at public school board meetings at least 10 times over two years. Mr. Nelson attended most of those meetings as a board member. Measure B is the result of a thorough process, including input from parents, teachers, experts and the community.

FACT: By law, Measure B funds may only be used for programs listed in the measure. An independent oversight committee must review the use of funds and issue reports. Oversight reports have consistently confirmed proper spending.

FACT: Measure B is structured just like measures in neighboring districts. The opponent's approach is both uncommon and risky, and has led to costly lawsuits. Measure B draws on what works so Mountain View students are just as prepared as Los Altos students when they reach high school, because every student deserves a quality education.

FACT: We can't rely on Sacramento or Washington. The Governor's budget projects reduced education funding. Measure B funds stay local—the state and federal governments can't take one penny.

Let's not play politics with the futures of our children. Measure B supports students struggling with the basics and bolsters 21st-century instruction like science and engineering, ensuring that every student has a chance to succeed.

Vote Yes on B: protect Mountain View schools.
