IN 203034 relates to a ·speech encoding method and encoder which is efficient even at low bit rates as it first determines optimum gains of a plurality of consecutive sub-frames followed by vector quantization of said optimum gain parameters. Further, the internal encoder states are updated using the said vector quantized gains. The claimed method and encoding apparatus thus, reduce the number of bits required to encode a frame while maintaining the synchronization between internal sates of the encoder and the decoder.

Also, IN 203034 is essential for 3rd Generation Partnership Project (3GPP) standards including ETSI TS 126 090 V4.0.0 (2001-03) which incorporates technical spec::ifications 'I of 3GPP TS 26.090: Universal Mobile Telecommunication System (UMTS): Mandatory Speech Codec speech processing functions; Adaptive Multi-Rate (AMR) speech codec; Transcoding functions (Release 4). - perform necessary operations.

Also, IN 240471 is essential for 3rd Generation Partnership Project (3GPP) standards including ETSI TS 125 ~31 V3.21.0 (2004-12) .which incorporates technical specifications of 3GPP TS 25.331: Universal Mobile Telecommunications System (UMTS); Radio Resource Control (RRC) protocol specification (Release 1999). Thus, Ericsson in .view of its commitment towards making its standard essential patents available through licensing on fa.lr, reasonable and non-discriminatory (FRAND) terms (subject to reciprocity) has licensed its patents (including IN 240471 to a large number of global entities1 who are selling their products.( either after importing the same or after locally manufacturing) in India. ·.

In case the subject matter or any of the information is held by or related to another public authority, you are requested to transfer the application or such pmt of it as may be appropriate to that other public authority with an intimation to the undersigned as per Section 6(3) of the RTI Act.

Consider th~;following as an application under Section 6 of the Right to Information Act, 2005 (RTI Act) and accordingly provide the information sought hereunder.

The information pertains to statement of accounts and sales submitted by NATCO Pharma in relation to Patent No. 215758.

It is reminded that the order of Controller of Patents dated March 09, 2012 [in C.L.A No. 1 of 2011] granted compulsory license to NATCO Pharma in relation to Patent No. 215758. As per Section 146(2) read with Rule 131 of the Patents Act, 1970, it is mandatory upon licensees to submit Form~27 containing information on commercial working of the patented invention. Furthermore, Paragraph 15(b) of the abovementioned order imposes an obligation on NATCO Pharma to report accounts of sales to the Controller on a quarterly basis. For sake of convenience, relevant portion is.reproduced below:

(b) The licensee shall maintain accounts of sale etc. in a proper manner and shall report the details of sales to the Controller as well as the Licensor on a quarterly basis, on or before fifteenth day of the succeeding month.

In light of the above, kindly provide the following info_rmation:

1. Has NA TCO Pharma fully complied witli conditions imposed in Paragraph 15(b)?

2. If answer to Query No. 1 is yes, please provide true copies of all the statements/accounts submitted to the Patent Office.

3. If answer to Query No. 1 is no, please provide details of any communication made.or action initiated against NATCO Pharma seeking compliance in this regard.
