Complete set of tender documents can be ob tained by down loading f rom Bank’s

website www.sbi.co. in under the head ‘Procurement News’ or obtained f rom the

Consultants, M/s. Architecture Incorporated f rom their off ice at VRA A -8, Women’s

col lege lane, Vazhuthacaud, Thiruvananthapuram, between 10.00 to 15.00 hrs on any

day except hol idays on payment of Rs.600/- in cash.

SPECIFIC CONDITIONS TO BE ADHERED TO BY THE CONTRACTOR

The tenderer should have valid PAN, GST registration etc for Kerala state as applicable.

A competent Engineer and Supervisor who is fully conversant and fluent in the local language (for reading, writing

and speaking), should be available at the work site at all times to receive instructions from the Bank/ Architects. All

instructions will be communicated in the local language only. A qualified Resident Supervisor shall be appointed as Site

– In - Charge having diploma and minimum five years’ experience in similar works.

Overnight stay/ washing of clothes/ bathing etc. by the labors are not permitted in the premises. Entry pass will be issued by the Bank strictly for execution of work only.

Existing passenger lifts and staircases in the building should not be used for transportation of materials/ debris. Separate Goods lift should be installed for transportation of materials.

Dismantling of flooring and similar works should be done only during night or during holidays

without affecting the functioning of the office.

The work is to be done in the SBI CPPC Ground and Third floor of the building in which several

offices are functioning. The work will have to be done without affecting the functioning of the other

offices.

Please read the ‘ INSTRUCTIONS TO TENDERERS’ t horoughly before submit t ing

the Tenders. Also note to ver i fy the Bank web -site under ‘Tender Not ices’ before

the last date and conf irm that ‘CORRIGENDA’ to the Tender Not ices issued ( i f

any) has been read and / or complied wi th.

TENDER NOTICE

1. Sealed Tenders for the above work wi l l be received by the Assistant General

Manager, (P & E), State Bank of India, Premises Department, Local Head Off ice,

P.B No.2704, Poojapura, Thiruvananthapuram up to 3.00 p.m on 27.12.2017. The

tenders wi l l be opened on the same day at 3.30 p.m. In the presence of the

tenderer or their representat ives, who are expected to be present at the t ime of

opening of the tenders.

a. The tenders must be submit ted in sealed covers and should be addressed to the

Assistant General Manager (P & E), State Bank of India, Premises Depart ment,

Local Head Off ice, P.B No.2704, Poojapura, Thiruvananthapuram in or ig inal and

dupl icate. The name of the tenderer and the name of the work being noted on

the cover.

b. I f the tender is made by an individual, i t shal l be signed with his ful l name and

his address shal l be g iven, i f i t is made by a member of the f i rm who shal l also

sign his name, and the name and address of each member of the f i rm shal l be

signed by a duly author ised Off icer, who shal l produce with his tender,

sat isfactory evidence of his author isat ion. Such tender ing f i rm may be required

before the agreement is executed to furnish evidence of i ts corporate existence.

c Every tenderer is expected, before quot ing his rates to inspect the si te of the

proposed work, to ascertain avai labi l i ty of space for stor ing mater ials, water,

power and other faci l i t ies. The rate quoted shal l be f i rm t i l l the complet ion of

the ent ire work.

3. Bidders have to at tend the pre -bid meet ing in which images of sample work

stat ions wi l l be displayed for due obser vat ions of certain specif icat ions in BOQ.

a. Every tenderer must enclose with his tender, earnest money deposit by a

crossed draft for a sum of Rs.58,000/ - (Rupees Fifty Eight thousand only)

made out in favour of State Bank of India, Thiruvananthapuram. Tenders not

accompanying EMD, wi l l be rejected. The Earnest Money Deposit wi l l be

refunded to the unsuccessful tenderer after int imat ion is sent on reject ion of the

tender or at the expiry of Six months f rom the date of tender whichever is

ear l ier. The earnest money wi l l not carry any interest .

b. The Earnest Money Deposit wi l l be retained in the case of successful tenderer

and wil l not carry any interest and wil l be dealt with as provided in the

condit ions of contract . In case the L1 tenderer backs out, the ir EMD wil l be

foref i t ted.

c. The tenderer whose tender is accepted shal l execute an agreement in the

standard format acceptable to the bank with Assistant General Manager (P & E) ,

5. The tenderer shal l peruse careful ly the tender not ice, condit ions of contract , bi l ls

of quant i t ies, relat ive drawings, out l ine specif icat ions and general condit ions etc. ,

before pr ic ing in the quant i t ies. Al l these documents shal l be returned with the

tender duly s igned in every page in token of acceptance of the condit ions.

6. The State Bank of India does not bind i tself to accept the lowest or any tender

and reserves the r ight to re ject any tender or al l the tenders at any stage i f

required. Condit ional tenders wi l l be rejected.

7. The state Bank of India, reserves the r ight of al ter ing and/or amending the

drawings and scope of work by addit ions or al terat ions or omissions without

assigning any reason therefore.

8. The Contractor shal l g ive a l ist of his relat ives work ing with the bank along with

their designat ions and addresses.

9. No Employee of the bank is al lowed to work as a contractor for a per iod of two

years of his ret irement f rom bank service, without the previous permission of the

bank. This contract is l iab le to be cancel led i f ei ther the contractor or any of his

employees is found at any t ime to be such a person who had not obtained the

permission of the bank as aforesa id before submission of the tender or engagement

in the contractor 's service.

other conditions if any) and other cover for technical bid & price bid-BOQ)(in original and duplicate)

14. The rates quoted by the contractor must be inclusive of all taxes (including GST)

1. I /We, the undersigned do hereby tender and undertake to perform, provide,

execute and do a l l the works, mater ials, matters and things descr ibed or

ment ioned in the Tender Not ice, Condit ions of Contract , Bi l l of Quant i t ies and

drawings (hereinaf ter cal led tender documents) which have been produced to and

careful ly examined by me/us in str ict accordance with and under and subject to the

terms provis ions and condit ions set for th or ment i oned in the said Tender

Documents at the rates g iven and as stated in the Bi l l of Quant i t ies.

2. I /We, also undertake to do al l extra or var ied works which may be ordered as part

of this contract upon the terms provided for in the condit ions of tender and

agreement.

sign the tender documents with in f if teen days af ter the acceptance of my/our

tender and that in the event of my/our fai lure to execute the agreement within

f if teen days, this tender shal l be considered as having been rejected, EMD wil l be

forfei ted or abandoned and you may, thereupon at such t ime or t imes, in such

CONDITIONS OF CONTRACT

1. The Contractors are required to examine careful ly al l the Drawings for th e above

work, condit ions of contract . Form of Agreement and Specif icat ions before pr ic ing

in the bi l l of quant i t ies set out below:

2. The rates quoted by the Contractors in the fol lowing Bi l l of Quant i t ies shal l include

for sett ing out the works, for supply ing al l mater ials including GST and any other

taxes as appl icable and labour and equipment necessary for complet ing the work in

the best workmanlike manner, for maintaining the same, al l in accordance with the

provisions of the specif icat ions and condit ion s of contract , for the erect ion and

removal on complet ion of the work, al l unnecessary scaffolding, shed, water tanks,

c lerk of works off ice, with f i t t ings, latr ines for the workman etc. , for al l the fencing

required to enclose the si te to prevent work peo ple t respassing boards, mats,

c lothes, etc. , to exc lude d ir t and dust , for cart ing away a l l debr is and rubbish, by

removing paint stains, c leaning f loors, windows, etc. , for leaving the premises in a

clean and sat isfactory state on complet ion and for work i ng in conjunct ion with the

general bui ld ing contract .

3. While the works are in course of construct ion and unt i l the Employer take over

same, the works and al l mater ials or plants used or to be used in construct ing the

same, remain at the Contractors r isk and shal l not be ent i t led to any compensat ion

for injury to or loss or destruct ion of such works or mater ials ar is ing f rom any

cause whatsoever.

The successful tenderer should take adequate cover under Workman's

Compensat ion Act and also take Insurance cover age against third party injury, Fire,

Riot , Civi l Commotion etc.

4. Other agencies may be work ing in the bui ld ing dur ing the progress of the work and

contractors must al low th is contractor to carry out this works without any

hindrance. No addit ion to the complet ion t ime wi l l be al lowed on this account

unless special delays caused by other agencies can be proved.

5. The quant i t ies set out in the bi l ls of quant i t ies are approximate and indicat ive only

and al l work wi l l be paid for on actual measurements taken du r ing the progress of

work and paid for at the accepted tender rates.

6. Al l works shal l be measured net as f inished and the rates quoted by the

Contractors shal l include for al l cut t ings, waste, breakages, etc. Tenderer must

include in their rates, GST, Labour Welfare Fund and any other taxes and dut ies

levied by the Central Government or any State Government or Local Author i ty, i f

appl icable. The rates quoted shal l be f i rm t i l l the complet ion of the ent ire work and

no var iat ion of rates wi l l be entertained .

The var ious statutory tax deduct ions implemented by the state and central

government f rom t ime to t ime shal l also be affected in the respect ive running bi l ls.

7. No al lowances shal l be made to the Contractors on account of any cla im, which is

based on the circumstances that the work may be, descr ibed in the condit ions of

the contract or specif icat ions on which apparent ly there is no corresponding i tems

given in the bi l ls of quant i t ies.

8. Errors in the bills of quantities shall be dealt with in the following manner:

IF on check there are differences between the rates given by the contractor in words and

figures or in the amount worked out by him, the following procedure shall be followed:

a. When there is a difference between the rates in figures and in words, the rates which

correspond to the amounts worked out by the contractor, shall be taken as correct.

b. When the contractor does not work out the amount of an item or it does not correspond

with the rate written either in figures or in words, then the rate quoted by the contractors

in words shall be taken as correct.

c. When the rate quoted by the contractor in figures and in words tallies but the amount is

not worked out correctly, the rate quoted by the contractor shall be taken as correct and

not the amount.

d. The bills of quantities have been marked "Original" and "Duplicate". If there is any

discrepancy in the rates, units and amounts between the 'original' and 'duplicate' the

'original' will be liable to be taken as correct and the 'duplicate' corrected accordingly.

a. Al l provis ional sums, provis ional i tems and cont ingencies included in the

fol lowing bi l ls of quant i t ies shal l be deducted in whole or in part , i f not expanded

under orders in wr i t ing f rom the Architects.

b. The tenderer should deposit along with the tender a sum of Rs. 58,000/ - as

Earnest Money Deposit . The Earnest Money Deposit wi l l be made a part of

secur i ty deposit , i f the tenderer is L1 and work order has been issued to them.

The Earnest Money Deposit wi l l not carry any interest .

c. The successfu l tenderer to whom the contract is awarded wi l l have to deposit as

ini t ia l secur i ty deposit a fur ther sum to make up 2% of the value of the accepted

tender including the Earnest Money Deposit . The ini t ia l Secur i ty Deposit wi l l

have to be made within 14 da ys of int imat ion to him of the acceptance of his

tender, fai l ing which the Employer at his discret ion may revoke the let ter of

acceptance and forfei t the Earnest Money Deposit furnished along with the

tender.

Apart f rom the ini t ia l deposit made as above , retent ion money shal l be deducted

f rom progressive running bi l ls at 10% of the gross value of each running bi l l

provided the total secur i ty deposit ie. The ISD plus retention money shal l both

together does not exceed 5% of the contract value.

The 50% of the Total Secur i ty Deposi t is refunded to the contractor without

interest on complet ion, subject to the following:

I . Issue of Vir tual complet ion cert i f icate by the Architect / Premises Engineer

I I . Contractor 's removal of his mater ials, equipment, labour force , temporary

sheds/stones, etc. f rom the si te (except ing for a small presence required) i f

any for the defect l iabi l i ty per iod and approved by the Bank.

The remaining 50% of the amount wi l l be refunded to the contractor without

interest with in f if teen days af ter the end of defects l iabi l i ty per iod, provided he

has sat isfactor i ly carr ied out al l the works and attended to al l defects in

accordance with the condit ions of the contract , including si te clearance.

The retent ion money wi l l bear no interest whatsoeve r, unti l the date of their

release.

10. Qual i ty of al l mater ials and workmanship and shal l be f i rst c lass, and shal l conform

to the latest Indian Standard code of pract ice, Local PWD and Latest CPWD

specif icat ions with up-to-date correct ion sl ips as the case may be and the ISS in

addit ion to the Archi tect specif icat ion.

11. The Contractor is to provide for al l the mater ials, labour t ransport etc. , required for

complet ing the work as scheduled.

12. Tenderer are required to make a careful note of the required t ime o f complet ion for

al l the works in this contract to the sat isfact ion of the employer and/or the

Architects.

13. The Contractor should comply to the provisions of any legal enactment relat ing to

the works and to the regulat ions any bye - laws of any local author i ty and or any

water or l ight ing companies with whose system the structure is proposed to be

connected and shal l before making any var iat ion f rom the drawings or

specif icat ions that they may be necessi tated by conforming, g ive to the Architects

wr i t ten not ice specifying the var iat ion proposed to be made and the reason for

making i t and apply for instruct ions thereon. In case the Contractor shal l not in

due course revise such instruct ions, he shal l proceed with the work conforming to

the provis ions, regulat ions or byelaws in quest ion and any var iat ion so

necessitated shal l be dealt with according to the agreement. The Contractor shal l

g ive al l not ices required by the said acts, regulat ions or bye – laws to be g iven to

any local author i ty and pay al l fees payable to any such author i ty or to any publ ic

off icer in respect of the work. The Employer shal l however reimburse the amount

paid as fees to any such author i ty by the Contractor who shal l make his own

arrangements for payment of the Octroi and the amount w i l l not be reimbursed.

The Contractor shal l also pay sales tax on al l mater ials and other dut ies, which wi l l

not be reimbursed either.

14. Any var iat ion f rom the contract drawings or bi l ls of quant i t ies wi l l be submit ted in

wr i t ing to the Architects and no work shal l be started or mater ials ordered before

wr i t ten approval is obtained f rom the Bank.

15. The Contractor shal l keep constant ly on the works a competent and qual i f ied

resident engineer and any direct ion or explanat ion g iven by the Architects or their

representat ives to such Resident Engineer shal l be held to have been g iven to the

Contractor.

16. Every work wi l l be inspected by the Employer and the Architects before i t is

covered up and the employer and the Architects reserve the r ight to uncover any

work at the Contractor 's expenses, i f found necessary.

17. The Contractor shall maintain complete records of labour hours and any overt ime

hours of al l work people engaged by them in connect ion with the work for the

inspect ion of the employer.

18. The employer wi l l endeavour to make avai lable water and power to the contractors.

The cost of extending water and power supply f rom the point where supply is made

avai lable, making connect ion with the exist ing supply, f ixing meters, etc. is to be

borne by the Tenderer. Charges for water and power consumed by the Contractor

wi l l be payable by the Contractor. The Tenderer shal l inform the employer at the

t ime of tender ing, the requirement of water and power for construct ion purposes. I f

so directed water and power shal l be h ad f rom the sources avai lable with the

general bui ld ing, contractor and the charges for consumpt ion paid to the general

bui lding contractor.

19. Time is the essence of the Contract . The employer reserves the r ight to terminate

the contract , if the work fal l s behind schedule by four weeks at any t ime. Al l the

works shal l be completed within 60 days f rom the date of work order. The

contractor shal l furnish along with the tender, a programme chart for the complet ion

of the work along one week from the date of issue of work order and shal l st r ict ly

adhere to i t .

20. A penalty of 0.5% of the contract amount wi l l be levied for every week of non -

complet ion beyond the schedule of complet ion, subject to a maximum of 5% of the

accepted contract value.

21. The Contractor shal l take adequate cover under workmen's compensat ion act and

also take insurance cover against third party injury, f i re, r iot , c ivi l commotion etc.

The copy of the pol icy (Al l r isk pol icy and cover under Workmen Compensat ion Act

should be submit ted to the Employer) .

22. The employer wi l l have the r ight to order the omission of any i tem or i tems included

in the Bi l ls of Quanti t ies and the contractor shal l not be ent i t led to payment of any

k ind on account of such i tem or i tems. I f the employer considers i t des irable, the

contractor shal l have the i tems or i tems as omit ted executed by other f i rm or f i rms.

23. The tenderer shal l furnish with his tender, a l ist of sub -contractors who wi l l be

responsib le to the main contractor for special ised jobs including supply of mater ials

and services.

24. Site Meet ings wi l l be cal led at regular intervals and the contractor or his senior

representat ive wi l l be required to be present at such meet ings to discuss progress

of the work and other matters including any deviat ion f rom the dr awings or

specif icat ions.

25. I f the Contractor suspends or sublets the work or neglects or fai ls to proceed with

due di l igence in the performance on his part of the contract as laid down in

schedule of rate progress or does not abide by any one of the condit ion of contract ,

the Assistant General Manager (P & E), State Bank of India, Premises Department,

Local Head Off ice, P,B No.2704,Poojapura, Thiruvananthapuram wil l be at l iberty to

terminate his contract and the work arranged otherwise at the r isk and cost of the

contractor .

26. The Tenderer should also include in his rate charges for cart ing away of al l surplus

excavated earth/spoi l , away f rom the si te as may be directed by the Employer

without c la im to any extra.

27. The tenderer should take al l precaut ions ne cessary by way of screening and

provision of chutes etc. to prevent dust nuisance to adjacent bui ldings and to

ensure that no damages occurs due to fal l of construct ion mater ials.

28. The works are to be carr ied out without disturbing the day -to-day funct ioning of the

Branch. The contractor has to take due care on the secur i ty of Bank propert ies.

Some t ime he may need to carry out the works dur ing the night hours and hence

the contractor has to take care whi le quot ing the rate in the tender consider ing

these facts. The contractor wi l l c la im nothing extra in this regard.

WHEREAS the Employer desirous to instal l Inter ior furnishing work for SBI CPPC at

Ground and Third f loor of Chembikalam Bui ld ing, Vazhuthacaud Thiruvananthapuram and has caused drawings and specif icat ions and schedule of quant i t ies descr ibing the work to be done to be prepared by M/s. Architecture Incorporated, VRA A -8, VISWAKARMA, Women’s col lege lane, Vazhuthacaud , Thiruvananthapuram, Kerala their Architects (hereinaf ter referred to ARCHITECTS).

AND W HEREAS the said drawings and specif icat ions and pr iced schedule of

quant i t ies have been signed by or on behalf of the part ies hereto. AND W HEREAS the Contractor has agreed to execute upon and subject to the

condit ions set for the herein (hereinafter referred to as the said condit ions) the work shown upon the said drawings and descr ibed in the said specif icat ions and the pr iced schedule of quant i t ies at the respect ive rates ment ioned in the pr iced schedule of quant i t ies at tached herewith.

NOW IT IS HEREBY AGREED AS FOLLOWS:

1. In considerat ion of the payments to be made to the Contractor as hereinaf ter provide, he shal l upon and subject to t he said condit ions execute and complete the works shown upon the said drawings and such further detai ls drawings, as may be furnished to him, by the said Architects and descr ibed in the said specif icat ions and the said pr iced schedule of quant i t ies.

2. The Employer shal l pay the Contractor such sums as shal l become payable

hereunder at the t imes and in the manner specif ied in the said condit ions. 3. The Term 'Architects ' in the said condit ions shal l mean the said M/s. Architecture

Incorporated, VRA A-8, VISWAKARMA, Women’s col lege lane, Vazhuthacaud , Thiruvananthapuram, Kerala. Or in the event of their ceasing to be Architects for the purpose of this contract , such other person as shal l be nominated for that purpose by the Employer, not being a person to who m the contractor shal l object for reasons considered to be suff ic ient by the Arbit rator ment ioned in the said condit ions provided always that no person subsequent ly appointed to be Architects under the contract shal l be ent i t led to disregard or over -rule any decision or approval or direct ion g iven or expressed by the Architects for the t ime being.

4. The Contractors agree and undertake to duly perform and execute and complete

the said work set for th in the Work Order No. issued by the Architects on behal f of the Employer and the subsequent amendments, if any, issued from t ime to t ime thereto in the manner author ised by and under the General Condit ions of Contract . The said work shal l throughout the st ipulated per iod of the contract be proceed with al l due di l igence, promptness, care and accuracy and in a workman l ike

manner to the sat isfact ion of the Architects and would be completed in accordance with the said specif icat ions, designs, drawings bi l l of quant i t ies and instruct ions on or before due date ment ioned in the said work order, t ime being the essence of the contract on part of the contractors. Acquiescence of NO OBJECTION of the State Bank of India, to the complet ion of any port ion of the work beyond the st ipulated due t ime shal l be without prejudice to the r ights of the State Bank of India, to enforce i ts r ights and remedies avai lable under this Agreement and the Condit ions of Contract regarding forfei ture, damages, penalty or otherwise and shal l not const i tute a waiver of the Corporat ion's r ights in th at behalf .

5. Without prejudice to the r ights and remedies of the State Bank of India, against the

contractors under any of the provision of this agreement and General Condit ions of Contract of the said work order or otherwise in law, i f the contractors comm it any default or breach of terms and condit ions of this Agreement and/or the General Condit ions of the contract and/or the work order or foi l in the due performance thereof within the t ime f ixed by the contract (which is the essence of the Contract) and do not complete the ent ire work on the st ipulated due date, the State Bank of India, shal l be ent i t led to recover f rom the contractors and the contractors hereby agree to be bound to pay the State Bank of India, as by way of compensat ion or l iquidated damages an amount calculated at the rate of 1/2% of contract amount per week subject to a maximum of 5% of the contract amount . The delay beyond the st ipulated date in respect of the i tem which is not completed or f in ished and del ivered completely to the State Bank of India on the st ipulated date as ment ioned in the Contract work order and declare that the amount of compensat ion or l iquidated damages f ixed as above represent the genuine, fair and reasonable pre -est imate thereof consider ing al l the facts and circ umstances as the loss and damages that would be l ikely suffered by the State Bank of India on account thereof. I t is fur ther hereby agreed and conf irmed that the sum payable by the contractor under this provis ion shal l be considered as reasonable compensa t ion ir respect ive of whether actual loss or damage has or has not been sustained and the State Bank of India, would not be required to render any proof in support thereof. I t is specif ical ly agreed and declared that in the event of the contractors not complet ing the work af ter the st ipulated date, the aforesaid provisions shal l not be deemed to prevent or stop the State Bank of India, f rom exercis ing any other r ights or remedies avai lable to the State Bank of India, against the Contractors including the complet ion of the work departmental ly or through any other contractor or agency or otherwise whomsoever at the r isk and account of contractors and the State Bank of India, shal l be ent i t led to recover and the contractors shal l be bound to pay al l such losses and damages which the State Bank of India, may suffer on account thereof . This is a lso without prejudice to al l the r ights and remedies avai lable to the State Bank of India, under the General Condit ions of Contract .

6. The Contractors shal l keep constant ly at the work si te a competent supervisor or

such other competent technical person as may be required to set the work and any direct ion or explanat ion g iven by the State Bank of India/Architects author ised representat ive to such person in wr i t ing shal l be h eld to have been g iven to the Contractors.

7. The Plans, Agreements and Documents above ment ioned shal l form the basis of

this contract and the decis ion of the said Architects for the t ime being, as ment ioned in the condit ions of contract , taken with the app roval of the Employer, in reference to al l the matters of dispute as to the mater ial , workmanship or account and as to the intended interpretat ion of the Clauses of this agreement or any other document at tached shal l be f inal and b inding on both the part ie s and may be Rule of Court .

8. The said contract comprises the bui ldings above ment ioned and al l subsid iary

works connected therewith the same site as may be ordered to be done from t ime to t ime by the said Architects for the t ime being with the approved of the Employer even though such works may not be shown in the drawings of descr ibed in the said specif icat ions or the pr iced schedule of quant i t ies.

9. The Employer through the Architects, reserve to himself the r ights of al ter ing, the

drawings and nature of work and of adding to or omit t ing any i tem of work or of having port ions of the same carr ied out departmental ly or otherwise and such alterat ions or var iat ions shal l be carr ied out without prejudice to this contract.

Provided that the Contractor shal l not be ent i t led to claim any compensat ion other than the admissib le rates provided for in the contract or otherwise mutual ly agreed upon for such addit ions, al terat ions, not i f icat ion, var iat ions, omissions etc.

10. The said condit ions shal l be read and construed as forming part of this agreement

and the part ies wi l l respect ive ly abide by and submit themselves to the condit ions and st ipulat ions and perform the agreements on their parts respect ively in such condit ions contained.

11. Al l d isputes ar is ing out or in any way connected with this agreement shal l be

deemed to have ar isen in Thiruvananthapuram and only the Courts in Thiruvananthapuram shal l have jur isdict ion to determine the same.

12. The several parts of this contract have been read to us and ful ly understood by us.

GENERAL CONDITIONS OF CONTRACT

Except where provided for in the descr ipt ion of the individual i tems in the schedule

of quant i t ies and in the specif icat ions and condit ions laid down hereinaf ter and in the

Drawings, the work shal l be carr ied out as per standard specif icat ions and under the

direct ion of the Employer/Architect /Engineer - in-Charge and Site Engineer.

1. INTRODUCTION

In construing these condit ions, the specif icat ions, the schedule of quant i t ies,

tender and agreement, the fol lowing words shal l have the meaning herein assigned

to them except where the subject or context otherwise requires:

a. Employer :

The term Employer shal l denote State Bank of India, and any of i ts employees or

representat ives, author ised on their behalf .

b. Architects :

The term Architects shal l mean M/s. Architecture Incorporated, VRA A-8,

VISWAKARMA, Women’s col lege lane, Vazhuthacaud , Thiruvananthapuram,

Kerala or in the event of his/ their ceasing to be the Architects for the purpose of

this Contract such other person/s as the Employer shal l nominate for the

purpose.

c. Contractor :

The term, Contractor shal l mean (Name and address of the Contractor) and

his/ their heirs, legal representat ives, assigns and successors.

d. Site: Ground and Third Floor, Chembikalam Bui lding, Vazhuthacaud,

Thiruvananthapuram.

e. Drawings :

The work is to be carr ied out in accordance with drawings, specif icat ions, the

schedule of quant i t ies and any fur ther drawings, which may be suppl ied, or any

other instruct ion, which may be g iven by the Employer dur ing the execut ion of

the work.

Al l drawings relat ing to work g iven to the Contractor together with a copy of

schedule of quant i t ies are to be kept at s i te and the Employer/Architects shal l be

g iven access to such drawings or schedule of quant i t ies whenever necessary.

In case any detai led Drawings are necessar y contractor shal l prepare such

detai led drawings and/or dimensional sketches therefore and have i t conf irmed

by the Employer/Architects pr ior to tak ing up such work.

The contractor shal l ask in wr i t ing for al l c lar i f icat ion on matters occurr ing

anywhere in drawings, specif icat ions and schedule of quant i t ies or to addit ional

instruct ions at least 10 days ahead f rom the t ime when i t is required for

implementat ion so that the Employer may be able to g ive decision thereon.

f . "The Works" shal l mean the work or works to be executed or done under this

contract .

g . "Act of Insolvency" shal l mean any act as such as def ined by the presidency

Towns Insolvency Act or in Provincial Insolvency Act or any amending statutes.

h. "The Schedule of Quant i t ies" shal l mean the schedu le of quant i t ies as specif ied

and forming part of this contract .

i . "Pr iced Schedule of Quant i t ies" shal l mean the schedule of quant i t ies duly

pr iced with the accepted quoted rates of the contractor.

2. SCOPE

The work consists of Construct ion of Employer 's pro posed Internal Part i t ions,

Furnishing and False cei l ing etc, in accordance with the "drawings" and "Schedule

of Quant i t ies". The Inter ior decorat ion, furniture works etc. are within the scope of

this tender. I t includes furnishing al l mater ials, labour, tools and equipment and

management necessary for and incidental to the construct ion and complet ion of the

work. Al l work dur ing i ts progress and upon complet ion, shal l conform to the l ines,

elevat ions and grades as shown on the drawings furnished by the

Employer/Architects. Should any detai l essent ial for eff ic ient complet ion of the

work be omit ted f rom the drawings and specif icat ions i t shal l be the responsib i l i ty

of the contractor to inform the Employer/Architects and to furnish and instal l such

detai l with Employer 's/Architect ' concurrence, so that upon complet ion of the

proposed work the same wi l l be acceptable and ready for use.

Employer/Architects may in their absolute discret ion issue fur ther drawings and/or

wr i t ten instruct ions, detai ls, direct ion s and explanat ions, which are, hereafter

col lect ively referred to as "The Employer 's/Architect 's instruct ions" in regard to : -

a. The var iat ion or modif icat ion of the design qual i ty or quant i ty of works or the

addit ion or omission or subst i tut ion of any work .

b. Any discrepancy in the drawings or between the schedule of quant i t ies and/or

drawings and/or specif icat ions.

c. The removal f rom the si te of any defect ive mater ial brought thereon by the

contractor and the subst i tut ion of any other mater ial thereof .

d. The demoli t ion removal and/or re -execut ion of any work executed by the

contractor/s.

e. The dismissal f rom the work of any persons employed thereupon.

f . The opening up for inspect ion of any work covered up.

g. The rect if icat ion and making good of any defects under clause s hereinaf ter

ment ioned and those ar is ing dur ing the maintenance per iod (retent ion per iod).

The contractor shal l forthwith comply wi th and duly execute any work comprised in

such Employer 's/Architect 's instruct ions, provided always that verbal instruct ion s,

direct ions and explanat ions g iven to the contractor 's or his representat ive upon the

works by the Employer/Architects shal l in involving a var iat ion be conf irmed in

wr i t ing to the contractor/s with in seven days. No works, for which rates are not

specif ical ly ment ioned in the pr iced schedule of quant i t ies, shal l be taken up

without wr i t ten permission of the Employer/Architects. The employer in

consultat ion with the Architects as provided in Clause "var iat ion" shal l f ix rates of

i tems not ment ioned in the pr iced schedule of quant i t ies.

The contractor shal l set up a f ield laboratory with necessary equipments for day to

day test ing of materials l ike grading of coarse and f ine aggregates, s i l t content and

bulk age of sand etc.

Regarding al l factory made products for which ISI marked products are avai lable,

only products bear ing ISI mark ing shal l be used in the work.

3. TENDERER SHALL VISIT THE SITE.

Intending tenderer shal l vis i t the si te and make himself thoroughly acquainted with

the local s i te condit ion, nature and requirements of the works, faci l i t ies of t ransport

condit ion, effect ive labour and mater ials, access and storage for mater ials and

removal of rubbish. The tenderer shal l provide in their tender for cost of carr iage,

f reight and other charges as also for any special di f f icult ies and including pol ice

restr ict ion for transport etc., for proper execut ion of work as indicated in the

drawings. The successful tenderer wi l l not be ent i t led to any claim of

compensat ion for di ff icult ies faced or losses in curred on account of any si te

condit ion which existed before the commencement of the work or which in the

opin ion of the Employer/Architects might be deemed to have reasonably been

inferred to be so exist ing before commencement of work.

4. TENDERS

The ent ire set of tender paper including drawings issued to the tenderer should be

submit ted ful ly pr iced and also signed on the last page together with ini t ia ls on

every page. Ini t ia l /s ignature wi l l ind icate the acceptance of the tender papers by

the tenderer. (A lso see para 15 of General Rules and Instruct ions for guidance of

tenderer.)

The schedule of quant i t ies shal l be f i l led in as fol lows: -

a. The "Rate" column to be legibly f i l led in ink in both Engl ish f igures and Engl ish

words.

b. Amount column to be f i l led in for each i tem and the amount for each sub head

as detai led in the "Schedule of Quant i t ies"

c. Al l correct ions are to be ini t iated.

d. The "Rate Column" for al ternat ive i tems shal l be f i l led up.

e. The "Amount" column for al ternat ive i tems of which the quant i t ies are not

ment ioned shal l not be f i l led up.

No modif icat ions, wr i t ings or correct ions can be made in the tender papers by the

tenderer, but may at his opt ion offer his comments or modif icat ions in a separate

sheet of paper attached to the tender papers.

The Employer reserves the r ight to reject the lowest or any tender and also to

discharge any or al l of the tenders for each sect ion or to spl i t up and distr ibute any

i tem of work without assigning any reason at any stage.

The tenderer should note that the tender is str ict ly on the i tem rate basis and their

at tent ion is drawn to the fact that the rates for each and every i tem should be

correct , workable and self -support ing. I f cal led upon by the Employer/Architects

detai led analys is of any or al l the rates shal l be submit ted. The

Employer/Architects shal l not be bound to recognise the contractor 's analysis.

The works wi l l be paid for as "measured work" on the basis of actual work done and

not as " lump sum" contract .

Al l i tems of work decided in the schedu le of quant i t ies are to be deemed and paid

as complete works in al l respects and detai ls including preparatory and f inish ing

works involved, direct ly, related to and reasonably detectable f rom the drawings,

specif icat ions and schedule of quant i t ies and no fur ther extra charges wi l l be

al lowed in this connect ion. In the case of lump sum charges in the tender in

respect of any i tem of works, the payment of such i tems of work wi l l be made for

the actual work done on the basis of lump sum charges as wi l l be as sessed to be

payable by the Employer/Architects.

The Employer has power to add/to omit any work as shown in drawings or

descr ibed in specif icat ions or included in schedule of quant i t ies and int imate the

same in wr i t ing but no addit ion, omission or var iat i on shal l be made by the

contractor without author isat ion f rom the Employer. No var iat ion shal l v i t iate the

contract .

The tenderer shal l note that his tender shal l remain open for considerat ion for a

per iod of 6 months f rom the date of opening of the tend er.

5. AGREEMENT

The successful contractor may be required to sign agreement as may be drawn up

to suit local condit ions and shal l pay for al l stamps and legal expenses, incidental

thereto.

6. GOVERNMENT AND LOCAL RULES

The contractor shal l conform to the prov is ions of al l local Bye- laws and Acts

relat ing to the work and to the Regulat ions etc. of the Government and Local

Author i t ies and of any company with whose system the structure is proposed to be

connected. The contractor shal l g ive al l not ices required b y said Act . Rules,

Regulat ions, and Bye- laws etc. and pay al l fees payable to such

author i ty/author i t ies for execut ion of the work involved. The cost , i f any, shal l be

deemed to have been included in his quoted rates, tak ing into account al l l iab i l i t ies

for l icenses, fees for footpath encroachment and restorat ions etc. and shal l

indemnify the Employer against such l iabi l i t ies and shal l defend al l act ions ar is ing

f rom such claims or l iab i l i t ies.

7. TAXES AND DUTIES/FIRM RATES

The rate quoted should include all taxes in vogue like GST, Income tax, or any other tax (if any), etc.

And Bank shall not consider any claim whatsoever in this regard. Income tax and labour welfare fund

etc at the prevailing rates will be deducted from the contractor’s bill.

The rates quoted shal l be f i rm t i l l complet ion of work and no escalat ion shal l be

considered.

8. PROVISIONAL SUMS (P.S.)

Al l provisional sums descr ibed in the schedule of quanti t ies as P.S. shal l be

exc lusively al lot ted to the purchase of mater ials and not fo r any handl ing and f ixing

to be done by the Contractor. Such costs of handl ing and f ixing with prof i t

( including t ransport charges if required) shal l be separately included in the contract

pr ice as descr ibed in the schedule of quant i t ies. The disposal of the amounts

covered under this head wil l be absolutely at the discret ion of the Employer.

Contractor is to make payments for these mater ials to the suppl iers on cert i f icate

or order issued by the Employer/Architects and real ise them through his bi l ls f ro m

the Employer.

9. QUANTITY OF WORK TO BE EXECUTED

The quant i t ies shown in the schedule of quant i t ies are intended to cover the entire

new structure indicated in the drawings but the Employer reserves the r ight to

execute only a part or the whole or any exce ss thereof without assigning any

reason therefore.

10. OTHER PERSONS ENGAGED BY THE EMPLOYER

The employer reserves the r ight to execute any part of the work included in this

contract or any work, which is not included in this contract , or any work, which is

not included in this contract by other Agency or persons and contractor, shal l al low

al l reasonable faci l i t ies and use of his scaffolding for the execut ion of such work.

11. EARNEST MONEY AND SECURITY DEPOSITE/RETENTION AMOUNT

EARNEST MONEY DEPOSIT:

Earnest Money Deposit is calculated at the rate of 1% of the estimated cost of work .The EMD is

accepted in demand draft only and not in the form of Bank Guarantee. No interest is payable on

Earnest Money Deposit.

INTIAL SECURITY DEPOSIT:

The amount of Initial Security Deposit shall be 2% of the accepted value of the tender including the

Earnest Money Deposit.

The initial security deposit is to be paid by the contractor to the bank within 14 (fourteen) days of

intimation to him of the acceptance of his tender and no interest is payable on the above Security

Deposit by means of Demand Draft or Pay Order.

RETENTION MONEY:

The retention percentage (i.e., deduction from interim bill) shall be 10% of the gross value of

each interim bill sanctioned for payment by the Employer.

The maximum amount of retention money shall be the balance amount of the Total Security

Deposit. i.e the ISD plus retention money shall both together does not exceed 5 % of the

contract value.

The 50% of the retent ion amount is refunded to the co ntractor without interest on

complet ion, subject to the fol lowing:

I . Issue of Vir tual complet ion cert i f icate by the Architect /Premises Engineer

I I . Contractor 's removal of his mater ials, equipment, labour force, temporary

sheds/stones, etc. f rom the si te (excep t ing for a small presence required) i f

any for the defect l iabi l i ty per iod and approved by the Bank.

The remaining 50% of the amount wi l l be refunded to the contractor without interest

within f i f teen days af ter the end of defects l iabi l i ty per iod, provide d he has

sat isfactor i ly carr ied out al l the works and at tended to al l defects in accordance

with the condit ions of the contract , including si te clearance. The retent ion money

wil l bear no interest whatsoever, unt i l the date of their release.

12. CONTRACTOR TO PROVIDE EVERYTHING NECESSARY

The contractor shal l provide everyth ing necessary for the proper execut ion of the

work according to the intent and meaning of the drawings, schedule of quant i t ies

and specif icat ions taken together whether the same may or may n ot be part icular ly

shown or descr ibed therein provided that the same can reasonably be inferred

there f rom and if the contractor f inds any discrepancies therein he shal l

immediately and in wr i t ing refer the same to the Employer/Architects whose

decision shal l be f inal and b inding. The contractor shal l provide h imself for ground

and f resh water for carrying out of the works at his own cost . The Employer shal l

on no account be responsib le for the expenses incurred by the contractor for hired

ground or water obtained f rom elsewhere.

The rates quoted against individual i tems wil l be inclus ive of everything necessary

to complete the said i tems of work within the contemplat ion of the contract, and

beyond the unit pr ice no extra payment wi l l be al lowed for incid ental or cont ingent

work, labour and/or mater ials inclusive of al l taxes and dut ies whatsoever except

for specif ic i tems, if any, st ipulated in the tender documents.

The contractor shal l supply, f ix and maintain at his own cost , for the execut ion of

any work, al l tools, tack les, machiner ies and equipments and al l the necessary

centr ing, scaffolding, staging, planking, t imber ing, strut t ing, shor ing, pumping,

fencing, boarding, watching and l ight ing by night as wel l as by day required not

only for the proper execut ion and protect ion of the said work but also for the

protect ion of the publ ic and safety of any adjacent roads, streets, wal ls, houses,

bui ldings, al l other erect ions, matters and things and the contractor shal l take down

and remove any or al l such centr ing, scaffolding, planking, t imber ing, strutt ing,

short ing etc. as occasion shal l be required or when ordered to do so, and shal l ful ly

reinstate and make good al l matters and things disturbed dur ing the execut ion of

works to the sat isfact ion of t he Employer /Architects.

The Contractor shal l at al l t imes g ive access to workers employed by the Employer

or any men employed on the bui ldings and to provide such part ies with proper

suff ic ient and i f required, specia l scaffolding, hoists and ladders and provide them

with water and l ight ing and leave or make any holes, grooves etc. in any work,

where directed by the employer as may be required to enable such workmen to lay

or f ix pipes, electr ical wir ing, special f i t t ings etc. The quoted rates of the tend erer

shal l accordingly inc lude al l these above -ment ioned cont ingent works.

TIME OF COMPLETION, EXTENSION OF TIME & PROGRESS CHART

1. TIME OF COMPLETION: 60 days from the date of receipt work order.

work shal l be deemed to be commenced immediately f rom the date of acceptance

let ter or date of handing over of s i te, whichever is ear l ier. Time is the essence of

the contract and shal l be str ict ly observed by the Contractor.

The work shal l not be considered as complete unt i l the Employer/Architects have

cert i f ied in wr i t ing that this has been completed and the defects Liabi l i ty Per iod

shal l commence f rom the date of such cert i f icate.

2. EXTENSION OF TIME :

I f in the opinion of the Employer/Architects the works be delayed (a) by reason of

any except ional ly inclement weather, or (b) by reason of instruct ion f rom the

Employer in consequence of proceedings taken or threatened by or d isputes, with

adjoining or neighbour ing owners or (c ) by the works, or delay, of other contractors

or tradesmen engaged for nominated by the Employer and not referred to in the

specif icat ion or (d) by reason of author ised extra and addit ions or (e) by reason of

any combinat ion of workmen or str ikes or lock -out affect ing any of the bui lding

t rades or (f ) f rom other causes which the Employer may consider are beyond the

control of the contractor, the Employer at the complet ion of the t ime al lowed for the

contract shal l make fair and reasonable extension of t im e for complet ion in respect

therefore. In the event of the Employer fai l ing to g ive possession of the si te upon

the day specif ied above the t ime of complet ion shal l be extended suitably.

In case of such str ikes or lockouts, as are referred to above, the contractor shal l ,

immediately g ive the Employer, wr i t ten not ice thereof. Never theless, the contractor

shal l use his best endeavours to prevent delay, and shal l do al l that may be

reasonably required, to the sat isfact ion of the Employer to proceed with the works

and on his doing so that i t wi l l be ground of considerat ion by the Employer for an

extension of t ime as above provide. The decision of the Employer as to the per iod

to be al lowed for an extension of t ime for complet ion hereunder (which decision

shal l be f inal and binding on the contractor) shal l be promulgated at the conclusion

of such str ike or lock -out and the Employer shal l then, in the event of an extension

being granted, determine and declare the f inal complet ion date. The provision in

clause 15 with respect to payment of l iquidated damages shal l , in such case, be

read and construed as i f the extended date f ixed by the Employer were subst i tuted

for and the damage shal l be deducted accordingly.

All drawings mainta ined on the s i te are or to be c areful ly mounted on boards of

appropr iate size and covered with a cost of approved varnish. They are to be

protected f rom ravages of termites, ants, and other insects.

The contractor shal l provide at his own cost al l -ar t i f ic ial l ight required for the wor k

and to enable other contractors and sub -contractors to complete the work within

the specif ied t ime.

The Contractor shal l not f ix or place any p lacards or advert isement of any

descr ipt ion or permit the same to be f ixed or placed in or upon any boarding g antry,

bui lding structure other than those approved by the Employer.

3. PROTECTIVE MEASURES:

The Contractor f rom the t ime of being placed in possession of the si te must make

suitable arrangements for watching, l ight ing and protect ing the work, the si te and

surrounding property by day, by n ight , on Sundays and other hol idays. Contractor

shal l indemnify the Employer against any possible damage to the bui ld ing roads, or

member of the publ ic in course of execut ion of the work.

No photograph of s i te or of the wo rk or any part thereof shal l be taken, publ ished

or otherwise c irculated without the pr ior approval of the State Bank of India.

4. TOOLS:

Theodol i te, levels, pr ismat ic compass, chain, steel and metal l ic tapes and a l l other

surveying instruments found necessa ry on the works shal l be provided by the

Contractor for the due performance of this Contractor as instructed by the Site

Engineer.

Al l measur ing tapes shal l be of steel and suitable scaffolding and ladders that may

be required for safely tak ing measuremen ts and shal l be suppl ied by the

Contractor.

The master ies and the supervisors on the works shal l carry with them always an

one metre or two metre steel tape a measur ing tape of 30 metres, a spir i t level, a

plumb and a square and shal l check on the work to see that the work is being done

according to the drawing and specif icat ions. The Site Engineer wi l l use any or al l

measur ing instruments or tools belonging to the Contractors as he chooses for

checking the works executed or being executed on the contract .

The Contractor should cover in h is rates for making provisions for al l reasonable

faci l i t ies for the use of his scaffolding, tools and plant etc. by sub -contractor for

their work.

5. NOTICE AND PATENTS OF APPROPRIATE AUTHORITY AND OWNERS :

The Contractor shal l conform to the provisions of any Acts of the Legislature

relat ing to the work, and to the Regulat ion and Bye -Laws of any author i t ies, and/or

any water, l ight ing and other companies, and/or author i t ies with whose systems and

structures were proposed to have connect ion and shal l before making any

var iat ions f rom the drawings or specif icat ion that may be associated to so conform,

g ive the Employer/Architects wr i t ten not ices specify ing the var iat ions proposed to

be made and the reasons for making them and apply for instruct ion thereon. The

Employer/Architects on receipt of such int imat ion shal l g ive a decis ion with in a

reasonable t ime.

The Contractor/shal l arrange to g ive a l l not ices required for by the said Acts,

Regulat ions or Bye-Laws to be g iven to any author i ty, and to pay to such author i ty

or to any publ ic off icer al l fees that may be proper ly chargeable in respect of the

work and ledge the receipts with the Employer.

The Contractor shal l indemnify the Employer against al l c la ims in respect of paten t

r ights, royalt ies, and damages to bui ldings, roads or member of publ ic in course of

execut ion of work and shal l defend al l act ions ar is ing f rom such claims and shal l

keep the Employer saved harmless and indemnif ied in al l respects f rom such

act ions, costs and expenses.

6. CLEARING SITE AND SETTING OUT WORKS

The Contractor shal l set out the works and shal l be responsible for the t rue and

perfect set t ing out of the work and for the correctness of the posit ions, levels,

dimensions and a l ignment of al l parts thereof. I f at anyt ime, any error shal l appear

dur ing the progress of any part of the work, the contractor shal l at his own

expenses rect i fy such error, if cal led upon to the sat isfact ion of the Employer. The

Contractor shal l further set out the works to t he alternat ive posit ions at the si te

unt i l one is f inal ly approved and the rates quoted in his tender should include for

this and no extra on this account wi l l be entertained.

7. DATUM

The average ground level wi l l be considered as the crown of the nearest r oad,

which should be taken as "Datum" which is however, subject to f inal conf irmation

by the Employer/Architects. Al l levels shown in the drawings are to be str ict ly

adhered to.

8. BENCHES

The Contractor is to construct and maintain proper benches of al l th e main wal ls , in

order that the l ines and levels may be accurately checked at al l t imes.

9. CONTRACTOR IMMEDIATELY TO REMOVE ALL OFFENSIVE MATTERS

Al l so i l , f i l th or other matters of any offensive nature taken out of any t rench,

sewer, drain, cesspool or other p lace shal l not be deposi ted on the surface but

shal l be at once carted away by the cont ractor to place provided by h im.

The contractor shal l keep the foundat ions and works f ree f rom water and shal l

provide and maintain at his own expenses electr ical ly or other power dr iven pumps

and other plant to the sat isfact ion of the Employer for the purpose, unt i l the

bui lding is handed over to the Employer. The contractor shal l arrange for the

disposal of the water so accumulated to the sat isfact ion of the Emplo yer and the

local author i ty and no claims wil l be entertained af ter wards i f he does not include

in his rates for the purpose.

10. ACCESS

Any author ised representat ive of the Employer shal l at al l reasonable t imes have

free access to the works and/or to the w orkshops, factor ies or other places where

mater ials are having prepared or constructed or the work and also to any p lace

where the mater ials are laying or f rom where they are being obtained, and the

Contractor shal l g ive every faci l i ty to the State Bank of India or their

representat ives necessary for inspect ion and examinat ion and test of the materials

and workmanship. Except the representat ives of the Employer no person shal l be

al lowed at any t ime without the wr i t ten permission of the Employer.

11. MATERIALS, WORKMANSHIP, SAMPLES, TESTING OF MATERIALS

Al l the works specif ied and provided for in the specif icat ions or which may be

required to be done in order to perform and complete any part thereof shal l be

executed in the best and most workmanlike manner wit h mater ials of the best and

approved qual i ty of the respect ive k inds in accordance with the part icu lars

contained in and implied by the specif icat ions and as represented by the drawings

or according to such other addit ional part iculars, and instruct ions as may f rom t ime

to t ime be g iven by the Employer/Architects dur ing the execut ion of the work, and

to his ent ire sat isfact ion.

I f required by the Employer/Architects the contractor shal l have to carry out tests

on mater ials and workmanship in approved mater ials test ing laborator ies or as

prescr ibed by the Employer/Architects at his own cost to prove that the mater ia ls

etc. under test conform to the relevant I .S. standards or as specif ied in the

specif icat ions. The necessary charges for preparat ion or mould ( in case of

concrete cube) t ransport ing, test ing etc. shal l have to be borne by the Contractor.

No extra payment on this account should in any case be entertained.

Al l the mater ials (except where otherwise descr ibed) stores and equipment required

for the ful l performance of the work under the contract must be provided through

normal channels and must include charge for import dut ies, sales -tax, Octroi and

other charges and must be the best of their k ind avai lable and the Contractor/s

must be ent irely responsib le for the proper and eff ic ient carrying out of the work.

The work must be done in the best workmanlike manner. Samples of al l mater ials

to be used must be submit ted to the Employer/Architects when so directed by the

Engineer/Architects and wr i t ten approval f rom Employer/Architects must be

obtained pr ior to placement of order.

Dur ing the inclement weather the Contractor shal l suspend concret ing and

plaster ing for such t ime as the Employer/Architects may direct and shal l protect

f rom injury al l work when in course of execut ion.

Any damage (dur ing construct ions) to any part of the work for any reasons due to

rain, storm or neglect of contractor shal l be rect i f ied by the contractor in an

approved manner at no extra cost .

Should the work be suspended b y reason of rain, str ike, lockouts or any other

cause, the contractor shal l take al l precaut ions necessary for the protect ion of work

and at his own expenses shal l make good any damage ar is ing f rom any of these

causes.

The contractor shal l cover up and pr otect f rom damage, f rom any cause, a l l new

work and supply al l temporary/doors, protect ion to windows, and any other

requisi te protect ion for the execut ion of the work whether by himself or specia l

t radesmen or sub-contractor and any damage caused must be made good by the

contractor at his own expenses.

12. REMOVAL OF IMPROPER WORK.

The Employer shal l dur ing the progress of the work have power to order in wr i t ing

f rom t ime to t ime the removal f rom the work within such reasonable t ime or t imes

as may be specif ied in the order of any mater ials which in the opinion of the

Employer/Architects are not in accordance with specif icat ion or instruct ions, the

subst i tut ion of proper re -execut ion of any work executed with Mater ials or

workmanships not in accordance with th e drawings and specif icat ions or

instruct ions. In case the contractor refuses to comply with the order the Employer

shal l have the power to employ and pay other agencies to carry out the work and

al l expenses consequent thereon or incidental there to as c ert i f ied by the

Employer/Architects shal l be borne by the contractor or may be deducted f rom any

money due to or that may become due to the contractor. No cert if icate, which may

be g iven by the Architects, shal l rel ieve the contractor f rom his l iabi l i ty i n respect

of unsound work or bad mater ials.

13. CONTRACTOR'S EMPLOYEES

The contractor shal l employ technical ly qual i f ied and competent supervisors for the

work who shal l be avai lable (by turn) throughout the work ing hours to receive and

comply with instruct ions of the Employer /Architects. The contractor shal l engage at

least one exper ienced Engineer as Site - in-charge for execut ion of the work. The

contractor shal l employ in connect ion with the work persons having the appropr iate

sk i l l or abi l i ty to perform the job eff ic ient ly.

The contractor shal l employ local labourers on the work as far as possible.

No labourer below the age of s ixteen years and who is not an Indian Nat ional shal l

be employed on the work.

Any labourer suppl ied by the contractor to be enga ged on the work on day-work

basis either whol ly or part ly under the direct order or control of the Employer or his

representat ive shal l be deemed to be a person employed by the contractor.

The contractor shal l comply with the provisions of al l labour legis lat ion including

the requirements of

a. The Payment of Wages Act

b. Employer 's l iab i l i ty Act

c. Workmen's Compensat ion Act

d. Contract Labour (Regulat ion & Abol i t ion) Act 1970 and Central Rules 1971

e. Apprent ices Act 1961

f . Any other Act or enactment relat ing thereto and rules f ramed there under f rom

t ime to t ime.

The Contractor shal l keep the Employer saved harmless and indemnif ied against

c laims i f any of the workmen and al l costs and expenses as may be incurred by the

Employer in connect ion with any cla im that may be made by any workmen. The

contractor shal l comply at his own cost with the order of requirement of any Health

Off icer of the State or any local author i ty or of the Employer regarding the

maintenance of proper environmental sanitat ion of the area where the contractor 's

labourers are housed or accommodated, for the prevent ion of small pox. Cholera,

plague, typhoid, malar ia and other contagious diseases. The contractor shal l

provide, maintain and keep in good sanitary condit ion adequate sanitary

accommodat ion and provide faci l i t ies for pure dr ink ing water at al l t imes for the use

of men engaged on the works duly making / provid ing suitable sheds for the use of

labour (separately for Men and Women) for their meals and rest, and shal l remove

and clear away the same on complet ion of the works. Adequate precaut ions shal l

be taken by the contractor to prevent nuisance of any k ind on the works or the

lands adjoin ing the same.

The contractor shal l arrange to provide f i rst -aid t reatment to the labourers engaged

on the works. He shal l within 24 hours of the occurrence of any accident at or

about the si te or in connect ion with execut ion of the works, report such accident to

the Employer and also the competent author i ty where such report is required by

law.

14. DISMISSAL OF WORKMEN.

The contractor shal l on the request of the Employer immediately d ismiss f rom

works any person employed thereon by him, who may in the opinion of the

Employer be unsuitable or in competent or who may misconduct himself . Such

discharges shal l not be the basis of any c laim for compensat ion or damages

against the Employer or any of their off icer or employee.

15. ASSIGNMENT.

The whole of the works included in the contract shal l be executed by the contractor

and the contractor shal l not direct ly or indir ect ly t ransfer, assign or under let the

contract or any part , share or interest therein not , shal l take a new partner, without

wr i t ten consent of the Employer and no sublet t ing shal l rel ive the contractor f rom

the ful l and ent ire responsib i l i ty of the contr act or f rom active super intendence of

the work dur ing their progress.

16. DAMAGE TO PERSONS AND PROPERTY INSURANCE ETC.

The contractor shal l be responsible for al l in jury to the work or workmen to

persons, animals or things and for al l damages to the structur al and/or decorative

part of property which may ar ise f rom the operat ions or neglect of himself or of any

sub-contractor or of any of his or a sub -contractor 's employees, whether such

injury or damage ar ise f rom carelessness, accident or any other cause wh atsoever

in any way connected with the carrying out of this contract. The clause shal l be

held to include inter -al ia, any damage to bui ldings whether immediately adjacent or

otherwise, and any damage to roads, streets, footpaths or ways as wel l as

damages caused to the bui ld ings and the works forming the subject of this contract

by rain, wind or other inclemency of the weather. The contractor shal l indemnify

the Employer and hold harmless in respect of al l and any expenses ar is ing f rom

any such injury or damages to persons or property as aforesaid and a lso in respect

of any claim made in respect of injury or damage under any acts of compensation

or damage consequent upon such claim.

The Contractor shal l reinstate al l damage of every sort mentioned in this c lause, so

as to del iver the whole of the contract works complete and perfect in every respect

and so as to make good or otherwise satisfy al l c laims for damages to the property

or third part ies. Minimum amount of third part insurance should be Rs. 1 Lak h pre

accident and number of accident should be inf ini ty.

The contractor shal l affect the insurance necessary and indemnify the Employer

ent irely f rom al l responsib i l i ty in this respect. The insurance must be placed wi th a

company approved by the Employe r and must be effected joint ly in the name of the

contractor and the Employer and the pol icy lodged with the lat ter. The scope of

insurance is to include damage or loss to the contract i tself t i l l th is is made over in

a complete state. Insurance is compu lsory and must be affected f rom the very

ini t ia l stage. The contractor shal l also be responsible for any thing, which may be

exc luded f rom damage to any property ar is ing out of incidents, negl igence or

defect ive carrying out of this contract .

The Employer shal l be at l iberty and is hereby empowered to deduct the amount the

amount of any damages, compensat ions, costs, charges and expenses ar is ing or

occurr ing f rom or in respect of any such claim or damages from any sums due or to

become to the contractor.

17. INSURANCE

Unless otherwise instructed the contractor shal l insure the works and keep them

insured unt i l the vir tual complet ion of the contract against loss or damage by f i re

and/or earthquake, f lood. The insurance must be placed wi th a company approved

by the Employer, in the joint names of the Employer and the contractor for such

amount and for any fur ther sum if cal led to do so by the Employer, the premium of

such fur ther sum being al lowed to the contractor as an author ised extra.

The contractor shall deposit the pol icy and receipt for premiums paid with the

Employer af ter start ing the work unless otherwise instructed. In default of the

contractor insur ing as provided above, the Employer on h is behalf may so insure

and may deduct the premiums paid f rom any money due, or which may become due

to the contractor. The contractor shal l as soon as the claim under the pol icy is

set t led or the work reinstated by the Insurance Company should they elect to do so,

proceed with due d i l igence with the complet ion of the works in the same manner as

though the f i re has not occurred and in al l respects under the condit ions of the

contract . The contractor in case of rebinding or reinstatement af ter f i re shal l be

ent i t led to extension of t ime for complet ion as the Employe r may deem f i t .

18. ACCOUNTS RECEIPTS & VOUCHERS

The contractor shal l , upon the request of the Employer furnish them with a l l the

invoices, accounts, receipts and other Vouchers that they may require in

connect ion with the works under this contract . I f the c ontractor shal l use mater ials

less than what he is required under the contract , the value of the difference in the

quant i ty of the mater ials he was required to use and that he actual ly used shal l be

deducted f rom his dues. The decision of the Employer sha l l be f inal and binding on

the Contractor as to the amount of mater ials the Contractor is required to use for

any work under this contract .

Before tak ing any measurement of any work, the Site Engineer or a subordinate

deputed by him shal l g ive reasonable not ice to the Contractor. I f the Contractor

fai ls to attend at the measurements after such not ice or fai ls to countersign or to

record the difference with in a week f rom the date of measurement in the manner

required by the Site Engineer then in any such e vent the measurements taken by

the Site Engineer or by the subordinate deputed by h im as the case may be is f ina l

and binding on the Contractor and the Contractor shal l have no r ight to dispute the

same.

19. VARIATION / DEVIATION

The Contractor may when autho r ised and shal l , when directed in wr i t ing by the

Employer add and or omit , or vary the works shown in the drawings or descr ibed in

the specif icat ions or included in the pr iced schedule of quant i t ies. The Contractor

on his own accord shal l make no addit ion , omission or var iat ion without such

author isat ion or direct ion. A verbal author isat ion or direct ion by the Employer shal l

when conf irmed correct ly by the Contractor in wr i t ing wi thin 3 days shal l be

deemed to have been g iven in wr i t ing.

Valuation of var iations

No claim for an extra shal l be al lowed unless i t shal l have been executed under

the author i ty of the Architect /Consultant with the concurrence of the SBI as

herein ment ioned. Any such extra is herein referred to as author ized extra and

shal l be made in accordance with the fol lowing provisions.

a) i ) The net rates or pr ices in the contract shal l determine the valuat ion of

the extra work where such extra work is of s imilar character and executed

under similar condit ions as the work pr iced he rein.

i i ) Rates for al l i tems, wherever possib le should be der ived out of the

rates g iven in the pr iced BOQ.

b) The net pr ices of the or ig inal tender shal l determine the value of the i tems

omit ted, provided i f omissions do not vary the condit ions under which any

remaining i tems of works are carr ied out, otherwise the pr ices for the same

shal l be valued under sub clause (c) hereunder.

c) Where the extra works are not of s imilar character and/or executed under

similar condit ions as aforesaid or where the omissions vary the condit ions

under which any remaining i tems or works are carr ied out, then the contractor

shal l within 7 days of the receipt of the let ter of acceptance inform the

Architect /Consultant of the rate which he intends to charge for such i tems of

work, duly supported by analys is of the rate or rates claimed and the

Architect /Consultant shal l f ix such rate or pr ices as in the c ircumstances in his

opin ion are reasonable and proper, based on the market rate.

d) Where extra work cannot be properly measured or valued the contractor

shal l be a l lowed day work pr ices at the net rates stated in the tender of the

BOQ or, if not , so stated then in accordance with the local day work rates and

wages for the distr ict ; provided that in either case , vouchers specifying the

dai ly t ime (and i f required by the Architect /Consultant) the workman’s name

and mater ials employed be del ivered for ver i f icat ions to the

Architect /Consultant at or before the end of the week fol lowing that in which

the work has been executed.

e) I t is fur ther c lar i f ied that for al l such author ized extra i tems where rates

cannot be der ived f rom the tender, the contractor shal l submit rates duly

supported by rate analys is worked on the “market rate basis” for mater ial ,

labour, hire /running charges of equipment and wastages etc plus 15% towards

establ ishment charges, contractor ’s overheads and prof i t . Such i tems shal l not

be el ig ib le for escalat ion.

20. PREPARATION OF BUILDING WORKS FOR OCCUPATION AND USE ON

COMPLETION

The whole of the work wi l l be thoroughly inspected by the Contractor and

def ic iencies and defects put r ight. On complet ion of such inspect ion the Contractor

shal l inform the Employer the he has completed the work and i t is ready or

inspect ion.

On complet ion the contrac tor shal l c lean al l windows and doors including the

cleaning and oi l ing, if necessary, of al l hardware, inside and outside, al l f loors,

staircases, and every part of the bui lding. He wil l leave the ent ire bui lding neat

and clean and ready for immediate oc cupat ion and to the sat isfact ion of the State

Bank of India.

21. CLEARING SITE ON COMPLETION

On complet ion of the works the Contractor shal l c lear away and remove f rom the

si te al l construct ional plant , surplus mater ials, rubbish and temporary works of

every k ind and leave the whole of the si te and the works clean and in a

workmanlike condit ion to the sat isfact ion of the Employer/Architects.

22. DEFECTS AFTER COMPLETION

The Contractor shal l make good at his own cost and to the sat isfact ion of the

Employer al l defects, set t lements or other faults, which may appear within 12

months af ter complet ion of the work. In default the Employer may employ and pay

other persons to amend and make good such damages, losses and expenses

consequent thereon or incidental thereto shal l be made good and borne by the

Contractor and such damages, loss and expenses shal l be recoverable f rom him by

the Employer or may be deducted by the Employer, in l ieu of such amending and

making good by the Contractor, deduct f rom any money due to t he Contractor a

sum equivalent to the cost of amending such work.

23. CONCEALED WORK

The Contractor shal l g ive due not ice to the Employer/Architects whenever any work

is to be bur ied in the earth, concrete or in the bodies of wal ls or otherwise

becoming inaccessible later on, in order that the work may be inspected and

correct dimensions taken before such bur ial , in default where of the same shal l , at

the opt ion of the Employer/Architects be either opened up for measurement at the

Contractor 's expense or no payment may be made for such mater ials. Should any

dispute or di f ferences ar ise af ter the execut ion of any work as to measurements

etc. or other matters which cannot be convenient ly tested or checked, the notes of

the Employer/Archi tects shal l be accepted as correct and binding on the

Contractor.

24. ESCALATION

The rate quoted shal l be f i rm throughout the tenure of the contract ( including

extension of t ime, if any, granted) and wil l not be subject to any f luctuat ion due to

increase in cost of mater ials, labou r, GST, Income tax, other taxes etc.

25. IDLE LABOUR

Whatever the reasons may be, no claim for idle labour, addit ional establ ishment

cost of hire and labour charges of tools and plants would be entertained under any

circumstances.

26. SUSPENSION

I f the Contractor except on account of any legal restraint upon the Employer

prevent ing the continuance of the work or in the opinion of the Employer shal l

neglect or fai l to proceed with due d i l igence in the performance of his part of the

contract or if he shal l more t han once make default , the Employer shal l have the

power to g ive not ice in wr i t ing to the Contractor requir ing the work be proceeded

within a reasonable manner and with reasonable despatch, such not ices purport to

be a not ice under this c lause.

After such not ice shal l have been g iven the Contractor shal l not be at l iberty to

remove f rom the si te of the works or f rom any ground cont iguous thereto any plant

or mater ials to subsist f rom the date of such not ice being g iven unt i l the not ice

shal l have been complied with. I f the Contractor shal l fai l for 7 (seven) days af ter

such not ice has been g iven to proceed with the works as therein prescr ibed the

Employer may proceed as provided in Clause 44 (Terminat ion of contract by

Employer) .

27. TERMINATION OF CONTRACT BY EMPLOYER

I f the Contractor being a company go into l iquidat ion whether voluntary or

compulsory or being a f i rm shal l be dissolved or being an individual shal l be

adjudicated insolvent or shal l make an assignment or a composit ion for the benef i t

of the greater part, in number of amount of his creditors, or i f the Off ic ial Assignee

in insolvency, shal l repudiate the contract , or i f a Receiver of the Contractor 's f i rm

appointed by the court shal l be unable, with in fourteen days af ter not ice to him

requir ing him to do so, to show to the reasonable sat isfact ion of the Employer that

is able to carry out and fulf i l the contract , and if so required by the Employer to

g ive reasonable secur i ty therefore, or if the Contractor shal l suffer execut ion to be

issued, or shal l suffer any payment under this contract to be at tached by or on

behalf of and of the creditors of the contractor, or shal l assign, charge or encumber

this contract or any payments due or which may become due to the contractor,

there under, or shall neglect or fai l to observe and perform al l or any of the acts

matters of things by this contract , to be observed and performed by the Contractor

within three c lear days af ter the not ice shal l have been g iven to the Contractor

manner hereinaf ter ment ioned requir ing the Contractor to observe or perform the

same or shal l be use improper mater ials or workmanship in carrying on the works,

or shal l in the opin ion of the employer not exercise such due di l igence and make

such due progress as would enable the work t o be completed with in due t ime

agreed upon, and shal l fai l to proceed to the sat isfact ion of the Employer after

three clear days not ice requir ing the Contractor so to do shal l have been g iven to

the Contractor as hereinaf ter ment ioned, or shal l abandon the contract , then and in

any of the said cases, the State Bank of India may notwithstanding previous waiver

determine the contract by a not ice in wr i t ing to the effect as hereinafter ment ioned,

but without thereby affect ing the powers of the Employer of the obl igat ions and

l iab i l i t ies of the Contractor the whole of which shal l cont inue in force as ful ly as if

the contract, had not been so determined and as if the works subsequent ly

executed had been executed by or on behalf of the contractor (without thereby

creat ing any t rust in favour of the contractor) fur ther the Employer or his agent, or

servants, may enter upon and take possession of the work and al l plants, tools,

scaffolding, sheds, machinery, steam and other power, utensi l and mater ials ly ing

upon premises or the adjoining lands or roads and sel l the same as his own

property or may employ the same by means of his own servants and workmen in

carrying on and complet ing the works or by employing any other contractors or

other persons or person to complete the works, and the contractors shal l not in any

way interrupt or do any act , matter of thing to prevent or hinder such other

contractors or other persons or person employed f rom complet ing and f inishing or

using the mater ials and plants for the works when the works shal l be complete, or

as soon thereafter as convenient ly may be, the employer shal l g ive not ice in wr i t ing

to the contractor to remove his surplus mater ials and plants and should the

contractor fai l to do so with in a per iod of 14 days af ter rece ipt by him the employer

may sel l the same by publ ic Auct ion and shal l g ive credit to the contractor for the

amount so real ised, Any expenses or losses incurred by the employer in get t ing

the works carr ied out, by, other contractors shal l be adjusted again st the amount

payable to the contractor by way of sel l ing his tools and plants or due on account

of work carr ied out by the contractor pr ior engaging other contractors or against

the Secur i ty Deposit .

28. ARBITRATION

Except where otherwise prov ided in the co nt ract a l l ques t ions and d isputes

re la t ing to the meaning of the spec i f ica t ions , des ign, drawings and inst ruct ions

here in before ment ioned and as to the qua l i t y of workmansh ip or mater ia ls used

on the work or as to any other ques t ion , c la im , r ight ,mat t er or th ing

whatsoever in any way ar is ing out of or re lat ing to the cont ract , des igns ,

o therwise concern ing the work or the execut ion or fa i lu re to execute the same ,

SAFETY CODE

1. There shal l be maintained in a readi ly accessible place f i rst aid appl iances

including adequate supply of st er i l ised dressings and cot ton wool.

2. An injured person shal l be taken to a publ ic hospital without loss of t ime, in cases

where the injury necessitates hospital isat ion.

3. Suitable and strong scaffolds should be provided for workmen for al l works that

cannot safely be done from ground.

4. No portable s ingle ladder shal l be over 8 meters in length. The width between the

side rai ls shal l not be less than 30 cm. (clear) and the distance between two

adjacent rungs shal l not be more than 30cm. When a ladder is use d an extra

mazdoor shal l be engaged for holding the ladder.

5. The excavat ion mater ial shal l not be placed within 1.5 meters of the edge of the

t rench or half of the depth of t renches whichever is more. Al l t renches and

excavat ions shal l be provided with ne cessary fencing and l ight ing.

6. Providing suitable fencing provides every opening in the f loor of a bui lding or in a

work ing platform with suitable means to prevent the fal l of persons or mater ials or

rai l ing whose minimum height shal l be one metre.

7. No f loor, roof or other part of the structure shal l be so over loaded with debr is or

mater ials as to render i t unsafe.

8. Workers employed on mixing and handl ing mater ial such as asphalt , cement mortar

or concrete and l ime mortar shal l be provided with protect ive f ootwear and rubber

hand-gloves.

9. Those engaged in weld ing works shal l be provided with welder 's protect ive eye -

shields and g loves.

10.

( i ) No paint contain ing lead or lead products shal l be used except in the form of

paste or readymade paint .

( i i ) Suitable facemasks should be suppl ied for use by the workers when the paint is

appl ied in the form of spray or surface having lead paint dry rubbed and

scrapped.

11. The Contractor to the painters shal l supply overal ls and adequate faci l i t ies shal l be

provided to enab le the work ing painters to wash dur ing the per iod of cessat ion of

work.

12. Hoist ing machines and tack le used in the works, including their attachments,

anchorage and supports shal l be in perfect condit ion.

13. The ropes used in hoist ing or lower ing mater ial or as a means of suspension shal l

be of durable qual i ty and adequate strength and free f rom defects.

14. Work ing platforms, gangways and stairways shal l be so constructed that they do

not sag unduly or unequal ly.

15. Dur ing demoli t ion work al l roads and open areas within the bui lding adjacent to the

work spot shal l ei ther be closed (or) suitably protected. Al l the Bank stat ionery,

records and furniture are to be covered suitably to avoid the dust deposit ion dur ing

demoli t ion (or) white washing.

16. No electr ic cable or apparatus, which is l iable to be a source of danger or a cable

or apparatus used by the operator, shal l remain electr ical ly charged.

17. Al l necessary personal safety equipment as considered adequate by the Engineer

should be kept avai lable for the use of p ersons employed in the si te and

maintained in a condit ion suitable for immediate use.

18. Those engaged in white washing and wr it ing (or) stack ing of cement bags (or) any

mater ials, which are injur ious to the eyes, shal l be provided with protect ive

goggies.

SPECIAL INSTRUCITONS TO TENDERERS

1. The var ious works descr ibed in the Bi l ls of Quant i t ies and in the drawi ngs shal l be

executed in str ict accordance with the specif icat ions and drawings to the ent ire

sat isfact ion of the Architects and the State Bank of India. The qual i ty of materials

and workmanship shal l be of high qual i ty and shal l conform to the relevant I .S.

Specif icat ions wherever appl icable. The successful tenderer wi l l be required to

produce for Architects approval samples of al l mater ials and procurement shal l be

arranged only af ter specif ic approval. Samples of f in ished work shal l also be

shown for Architects approval wherever directed and f inished work shal l conform

str ict ly to the approved samples. The decision of the Architects in this matter wi l l

be f inal.

2. The tenderer shal l ensure that the place of work is kept neat and t idy dur ing the

progress of work and also clean at the end of each day's work. The contractor

shal l a lso ensure that the si te is c leared of al l rubbish, and other unwanted

mater ials and handed over in a neat and sat isfactory condit ions as may be directed

by State Bank of India/Architects.

3. The tenderer shal l take maximum precaut ion in protect ing persons, things and

propert ies belonging to the State Bank of India, Publ ic and also their own dur ing

the progress of work. The tenderer wi l l be solely responsib le for any damage

caused dur ing the progress of work and the successful tenderer shal l indemnify the

State Bank of India by suitable guarantee/ insurance cover f rom any claims on any

account due to damages caused dur ing their work.

4. Pre-measurements to be recorded for al l the dism ant l ing i tems before star t ing of

work.

5. Site meet ings wi l l be held regular ly once in a week. The contractor or their

author ised representat ive would be present for the meet ing to take instruct ion and

carry out the same for execut ion.

6. The contractor should maintain measurement books in which he should record

measurements of work done f rom t ime to t ime and checked by the Architect /Site

Engineer. There should be no correct ions or over wr i t ing in the measurements.

7. A Site Order Book and Hindrance Register sh ould be maintained at the si te, which

should contain the instruct ions issued at s i te by the Bank Engineers/Architects and

nature of hindrance with date of occurrence.

8. A tentat ive programme is at tached to this tender. The Contractor on start ing the

work shal l herewith furnish to the Architects a programme for carrying out the work

stage by stage with in the st ipulated t ime. A graph or chart on individual work shal l

be maintained showing the progress week by week. The contractors shal l submit to

the Archi tect a weekly progress report stat ing the number of sk i l led and unski l led

labourers employed on the works, work ing hours done, quant i ty of cement used,

place, type and quant i ty of work done dur ing the per iod.

State Bank of India's representat ive as wel l as the representat ive of the Architects

shal l carry out the supervis ion at s i te. The work progress shal l be reviewed in

per iodic s i te meet ings or any other interval to be decided by the State Bank of India

and the architects. The Architects shal l prepare t he BAR chart and PERT chart

joint ly and the contractors and the State Bank of India approval shal l be obtained,

for the same. Af ter approval the contractor shal l fai thful ly adhere to the schedule

and where deviat ions take place, the contractor shal l take remedial act ion to

compensate for the delays in complet ion of the project .

9.

a. The contractor shall erect and maintain entirely at his own expense properly lighted and

waterproof lockable Offices for the Site Engineer, the Architects and State Bank of India's

representatives and for his own staff together with a conference room respectively on such part of

the site as the Architects shall indicate. These offices shall be provided by the contractor with

furniture, light and attendants as directed.

b. The Contractor shall provide at his own cost all necessary storage on the site in a specified area

for all materials such as timber, cement, lime and other materials, which is likely to deteriorate by

the action of sun, rain or other causes due to exposure, in such a manner that all such materials,

tools etc., shall be duly protected from damage by weather or any other cause. All such stores

shall be cleared away and the ground left in good and proper order on completion of this contract

unless otherwise expressly mentioned therein.

c. The contractor shall provide at his own cost temporary works as per drawings/specifications

approved by the Architects. The contractors should obtain approval of local authorities. The

Contractor shall be responsible for removal and disposal of the temporary works before handing

over the completed works to the State Bank of India.

d. All formalities including permission required to be obtained from competent authorities for making

the provisions in (a), (b) and (c) above would be done by the contractors at his own cost.

e. The Contractors shall erect a display board on site at his cost in accordance with the drawings

issued by the Architects for display of the names of the various agencies involved on the project

including the State Bank of India and the Architects.

f. Contractor should soon after the commencement of work make prototype samples of all the

furniture items for approval. The State Bank of India/Architects have the liberty to modify the

design in such case the contractor should follow the approved samples very strictly as no

extension in contract time will be granted by the State Bank of India/Architects in aspect of the

modification of the design. The contractor should observe the rate difference up to a reasonable

limit. However any major cost difference in modification as an extra item and consideration will be

calculated as per the terms of contract.

GENERAL SPECIFICATIONS

The scope of work covers execution and completion of the work consisting of Internal Partitions,

Furnishing etc. in accordance with the drawings and specifications prepared by:

M/s. ARCHITECTURE INCORPORATED VRA, A-8, “VISWAKARMA”, Women’s College lane,Vazhuthacaud, , Thiruvananthapuram-695014 and under the direction and to the satisfaction of the State Bank of India/Architects.

MATERIALS

a. Materials shall be of the best-approved quality obtainable and they shall comply with the

respective Indian Standard Specification.

b. Samples of all materials shall be got approved before placing order and the approved sample shall

be deposited with the State Bank of India.

c. In case of non-availability of materials in metric sizes, the nearest size in FPS units shall be

provided with the prior approval of the State Bank of India/Architects for which neither extra will be

paid nor shall any rebate be recovered.

d. Materials shall be tested in any approved Testing Laboratory and the Test Certificate in original

shall be submitted to the State Bank of India and the entire charges of testing including charges for

repeated tests if ordered shall be borne by the Contractor.

e. It shall be obligatory for the Contractor to furnish Certificate, if demanded by the State Bank of

India /Architects, from manufacturer of the material.

f. All materials supplied by the State Bank of India/any other specialised firms shall be properly

stored and the Contractor shall be responsible for its safe custody until they are required on the

works and till the completion of work.

g. Unless otherwise shown on the drawings or mentioned in the Schedule of Quantities or Special

Specifications the quality of materials, workmanship, dimensions, etc., shall be as specified here in

under.

h. All Equipment and facilities for carrying out field tests on materials shall be provided without any

extra cost.

PAINTS

Lime for lime wash, dry distemper, oil bound distemper, cement, primer, oil paint, enamel paint, flat oil

paint, plastic emulsion paint, anti-corrosive primer, red lead, water proof cement paint texture paint

shall be from an approved manufacturer and shall conform to the latest Indian Standards for various

paints, Ready mixed paints as received from the manufacturer without any admixture shall be used,

except for addition of thinner, if recommended by the manufacturer.

SUPERIOR QUALITY 'TEAK WOOD'

It shall be of good quality and well seasoned. It shall have uniform colour, reasonably straight grains

and shall be free from large, loose, dead knots, cracks warps, twists, bends, borer holes, shakes,

sapwood or defects or any kind. No individual hard and sound knot shall be more than 1cm. in

diameter and aggregate area of all knots shall not exceed 1/2% of the area of the piece. It shall be

close grained and there shall not be less than six growth rings per 2.5cm width.

GLAZING

Glass used for glazing shall be as specified in the Schedule of Quantities.

MORTICE LOCK

These shall be brass oxidised conforming to IS-2000 with handles conforming to I.S. 0992.

DOOR CLOSER

These shall be of Efficient DL 2000 brown anodised conforming to I.S. applicable or F.32 Everite as

applicable and specified in the schedule of quantities.

ALL OTHER HARDWARE FITTINGS:

These shall be of approved make conforming to the respective I.S. applicable.

WOOD WORK:

Timber used shall confirm to specifications desired under materials, shall be in accordance with the

State Bank of India/Architects drawing in every detail and all joiner's work shall be accurately set out,

framed and finished in a proper workmanlike manner. Frames of partitions and openings, etc., shall

be of accurately planned smooth and rebates, rounding and mouldings shall be made as shown on

the drawings. Patching or Plugging of any kind shall not be allowed. Joints shall be simple, neat and

strong. Framed joints shall be coated with suitable adhesive like glue or synthetic resin before the

frames put together. All mortice and tenon joints shall fit in fully and accurately without wedging or

filling. The joints shall be pinned with hardwood or bamboo pins of 10mm to 12mm dia, or rust

resisting star shaped metal pins of 8mm dia., after the frames are put together and pressed in position

by means of a press. The frames shall be protected during the progress of work by providing suitable

boxing. All portions of timber abutting against or embedded in masonry or concrete shall be treated

against termites by giving a coat of any approved wood preservative. All White Cedar woodwork

should be painted with a coat of approved wood primer after applying anti termite treatment to be

given for both sides of plywood etc.

Frames and Shutters shall not be painted or erected before being approved by the State Bank of India

/Architects.

Sand the surface along the grains with Emery Paper No.180 or with a suitable grade sand paper.

Brush the surface free of loose dust. Fill the wood using Acolyte Wood Filler. Remove excess

filler immediately after applications. Allow 2-3 hours of drying, before sanding with Emery Paper

No. 240 or 280. If desired, apply Acolyte Wood Strains by ragging after filling step or mix it in

Acolyte Natural Wood Finish up to 20% by volume and apply by spraying after Sealer Coat. In

application by ragging allow a drying time of 5-10 minutes in between coats of Acolyte Natural

Wood Finish Clear Sealer. After overnight drying, smooth sand with Emery Paper No.320 and

wipe the surface free of loose dust. Apply Acolyte Natural Wood Finish Clear Glossy as follows.

Ensure that the surface to be coated is free from loose matter. Acolyte Natural Wood Finish Clear

Glossy is a two-component system consisting of base and hardener. These should be mixed in

the recommended ratio. The two components should be mixed in a glass, plastic or enamelled

container. Allow the mixture to stand for 30 minutes and then apply by brushing or spraying using

the recommended thinner for consistency adjustment. The mixture of base and hardener should

be used within 8 hours. To enhance gloss and decorative value Acolyte Natural Wood Finish Clear

Glossy can be buffed using suitable buffing mops but only after 48 hours of application

MATT:

Acolyte Natural Wood finishes clear matt premium quality melaminised coating specially

formulated as a protective and decorative finishing clear coating for wood.

filler immediately after applications. Allow 2-3 hours of drying, before sanding with Emery Paper

No. 240 or 280. If desired, apply Acolyte Wood Stains by ragging after filling step or mix it in

Acolyte Natural Wood Finish up to 20% by volume and apply by spraying after Sealer Coat. In

application by ragging allow a drying time of 5-10 minutes in between coat of Acolyte Natural

Wood Finish Clear Sealer. After overnight drying, smooth sand with Emery Paper No. 320 and

wipe the surface free of loose dust. Apply Acolyte Natural Wood Finish Clear matt as follows.

Ensure that the surface to be coated is free from loose matter. Acolyte Natural Wood Finish Clear

Matt is a two-component system consisting of base and hardener. These should be mixed in the

recommended ratio. The two components should be mixed in a glass, plastic or enamelled

container. Allow the mixture to stand for 30 minutes and then apply by brushing or spraying using

the recommended thinner for consistency adjustment. The mixture of base and hardener should

be used within 8 hours.

WAX POLISHING:

Wax polish shall either be prepared on site or obtained readymade from market. Polish made on the

site shall be prepared from a mixture of pure bees wax, linseed oil, turpentine oil and varnish in the

ratio of 2:1/2:1 1/2 by weight. The bees wax and the boiled linseed oil shall be heated over a slow fire

when the wax is completely dissolved the mixture shall be cooled till it is just warm, and turpentine oil

and varnish added to it in the required proportions and the entire mixture is well stirred.

Surface shall be prepared as described under French Spirit Polish except that the final rubbing shall

be done with sand paper, which has been slightly moistured with linseed oil.

Mixture of polish shall be applied evenly with a clean cloth pad in such a way that no blank patches

are left and rubbed continuously for half an hour. When the surface is quite dry a second coat shall be

applied in the same manner and rubbed continuously for half an hour or until the surface is dry. Final

coat shall then be applied and rubbed for 2 hours or more if necessary, until the surface has assumed

a uniform Gloss and is quite dry showing no sign of stickiness when touched. Gloss of the polish

depends on the amount of rubbing, therefore rubbing must be continuous and with uniform pressure

and frequent change in direction.

MODE OF MEASUREMENTS

Unless otherwise stated in the Schedule of Quantities the method or measurement for various items in the

tender shall be generally in accordance with the I.S.1200 subject to the following:

DEMOLITION WORK:

Pre-measurements to be recorded for all dismantling items before starting of the works.

WOOD WORK:

No extra measurements will be given for the shape, joints of the partition counter, tables work etc.

All work shall be measured net as fixed. No extra measurement will be given for shape, joints, played

meeting styles of doors and windows and shall be measured in unit of square meter.

Areas over one face inclusive of exposed frame thickness (excluding width of cover mould) shall be

measured in case of T.W. Doors, Windows and Ventilators, Louvers. Portions in masonry or flooring

shall not be measured.

PAINTING, WHITE WASHING, COLOUIR WASHING & DISTEMPERING

All painting work shall be measured in Sq. Meters.

Net area of the surface painted shall be measured. No deductions will be made for unpainted

surfaces of ends of joints, beams, posts, etc., and opening not exceeding 0.5 Sq. Meters each and no

addition shall be made for reveals, jambs, soffits, sills, etc., of these openings.

1. The Tenderer is required to inspect the si te of the wor k and ascertain for himself

3. The tenderer should note that the tender drawings and other documents descr ibing

each i tem of the schedule are only indicat ive in nature and cannot be taken as

complete in detai l and f inishes. Being tender f or furniture works which cal ls for

workmanship and f inish inc luding use of good qual i ty mater ials of high standard, i t

is expected that the tenderer should understand the intent of the tender drawings

and specif icat ions and provide for mater ials, workmansh ip, f in ishes and

accessor ies appropr iately so as to del iver the product of high standards in keeping

with the funct ion for which the furniture is being specif ied. No claim f rom the

contractor at a later date wi l l be entertained for his fai lure to understa nd this

condit ion. The decision of State Bank of India / Architect in respect of the qual i ty

of mater ials, type of construct ion, workmanship, f in ish, etc. , shal l be f inal and the

contractor 's c laim for not provid ing in his tender for such mater ials, const ruct ion,

workmanship and f inish cannot be entertained.

4. State Bank of India/Architect reserve the r ight to insist on select ion of mater ials ,

workmanship, detai l ing and f inishes, which they consider, are appropr iate, and

suitable for the intended use. The contractor is not el ig ible for c laims to extra on

this account.

5. State Bank of India / Architect reserve the r ight to insist on proto - type to be made

for each i tem of work for approval before star t ing the ful l f ledged manufacture of

each type of furniture.

6. State Bank of India / Architect reserves the r ight to suggest or make modif icat ion at

the proto- type stage which the contractor shal l comply with.

India's acceptance, cover ing mater ials, workmanshi p and f inish. Any defects or

shr inkage, warping or other forms of deter iorat ion shal l be made good by the

contractor at his own cost with in the guarantee per iod, immediately on being

informed of such defects. Fai lure to comply wi l l entai l State Bank of I ndia to

uni lateral ly decide on gett ing the repair done through other agency at the cost and

r isk of the furniture contractor.

9. The contractor should use only the best mater ials. Teakwood or other t imber

specif ied shal l be of the best qual i ty, f ree of defe cts of any k ind. Al l plywood,

part ic leboard, veneer, laminate etc. , shal l comply with respect ive I .S. standard. I f

required by State Bank of India /Architect , the contractor wi l l be required to arrange

for test ing products and produce test cert i f icate f r om recognised test houses to

establ ish the qual i ty of mater ials at his own cost . Any defect ive mater ials not

meet ing with the standard shal l be replaced at the contractor 's own cost .

10. Samples of al l the fol lowing mater ials and required for the work shal l be got

approved by State Bank of India / Architect .

l ikely to vary sl ight ly according to the size of space avai lable in the respective

rooms where they are to be provided or place d. State Bank of India / Architects has

the r ight to sl ight ly modify the dimensions of furniture i tems to suit the si te.

12. The quoted rates shal l include for al l mater ials, labour, scaffolding, furniture

f i t t ings, accessor ies of matching type with the main furniture, t ransport to si te, a l l

taxes and dut ies (Central, State and Local Taxes) and f ix ing in their respect ive

places of the Bui ldings complete.

13. Non-compliance of any of the above specia l condit ions wi l l entai l summary

reject ion/dispensing with the contract at any stage of progress of work.

14. Wherever decorat ive plywood is specif ied i t must be ensured that the plywood shal l

be of matching veneer and grains and of uniform colour. State Bank of India /

Architects shal l have r ight to reject if the above sp ecif icat ions is not adhered to.

Wherever pol ish ing is specif ied i t shal l be of high qual i ty of melamine f inish,

sprayed or hand appl ied, to high class/matt f in ish as directed. Melamine shal l be

carr ied out in str ict accordance with the manufacturer 's spe cif icat ions. I f , at the

Bank of India /Architects shal l have r ights to insist appl icat ion of another coat

without extra cost . Al l hardware shal l be of high qual i ty brass oxidised f inish

conforming to IS specif icat ions. Samples of hardware f i t t ings shal l be shown to

State Bank of India / Architects in advance and approval obtained before

procurement. Rate should inc lude cost of keeping the works insured as wel l as

other requirements specif ied in the tender.

15. In al l cases measurement wi l l be made on net i tems in complete shape as

manufactured, suppl ied and instal led. Wherever areas are furnished in Sqm for

i tems such as carpet, curtains, etc. payment wi l l be made on actua l area la id to suit

the shape and size of the room. The tenderer should note that al l cut t ing wastage,

st i tching, joint ing and several specia l features such as pleats, over laps, hem, etc.

shal l be absorbed by them with in the quoted similar i tems. The ten derer should

make sure that they should protect their mater ials and hand them over in good

shape sat isfactory to State Bank of India/Architects. At the t ime of handing over

any damages, scratches, dents or such defects shal l be got rect i f ied as directed

without any extra charge by the tenderer to the sat isfact ion of State Bank of India /

Architects.

16. The tenderer should inspect in the off ice of State Bank of India the standard terms

and condit ions of agreement and other contract condit ions normally adopte d by

State Bank of India for other works, which shal l govern th is contract . Fai lure in

part of the tenderer to famil iar ise himsel f with State Bank of India's standard terms

and condit ions of procedure wi l l not entai l them for any claim or representat ion a t a

later date.

17. State Bank of India reserves the r ight to accept or reject any tender without

assigning any reason State Bank of India also reserves the r ight to spl i t the scope

of the work to more than one tenderer at their direct ion at any stage. State Bank of

India also has the r ight to modify thereafter the scope of the work. Tenderer shal l

not have any cla im on account of the above.

18. The t ime of complet ion of the ent ire work is awarded to one agency shal l be 45

days f rom the 7th day of work order. I n case of spl i t t ing of work to more than one

agency, the t ime of complet ion shal l be suitably reduced. For delay in complet ion

of work beyond the st ipulated date of complet ion, State Bank of India shal l levy

l iquidated damages as per their standard condit ions of contract .

cei l ing, carpet, curtains, etc. shal l be taken for actual area laid to suit the shape

and size of the room. The tenderer should note that al l cut t ing wastage, st i tching,

joint ing and several special f eatures such as pleats, over laps, hem, etc. shal l be

absorbed by them within the quoted rates and no separate payment wi l l be made

for the same. The tenderer shal l have to make sure that they protect their

mater ials and hand them over in good shape sat isf actory to State Bank of

India/Architect . At the t ime of handing over any damages, scratches, dents or

other such defects shal l be got rect i f ied as directed without any extra charge by the

tenderer/Contractor to the sat isfact ion of State Bank of India/Arch itect . Plast ic

sheets t i l l handing over shal l protect al l carpets.

16. State Bank of India reserves the r ight to accept or reject any tender without

assigning any reason. State Bank of India also reserves the r ight to spl i t the scope

of the work for award to more than one tenderer at their discret ion. State Bank of

India also has the r ight to modify thereafter the scope of the work.

Tenderer/Contractor shal l not have any claim on account of the above.

17. The t ime of complet ion of the ent ire work shal l be 60 d ays f rom the 7th day of the

date of work order. In case of spl i t t ing of work to more than one agency, the t ime

of complet ion shal l be suitably reduced. State Bank of India shal l levy

penalty/ l iquidated damages as per the condit ions of contract for delayed progress

of work at different stages/f inal complet ion of work as the case may be.

18. Al l rates quoted shal l inc lude high qual i ty hardware f i t t ings and specials such as

hinges, tower bolts, mort ice locks, door closers, door handles, drawer pul ls, dr awer

sl id ing accessor ies, s l iding door gears and specials etc. and no extra cost is

payable for these hardware f i t t ings. Samples of al l hardware f i t t ings shal l be got

approved by State Bank of India /Architect wel l in t ime, before procurement.
