    How I learned that gun control didnt work

    Sam Smith, 2008 - In 1960, just eight years before the riots in DC (and three years after I had

    covered my first DC crime story) , the capital had fewer than 100 murdersless than it had lastyear despite its much smaller population and far fewer men of the age responsible for many

    killings. The citys population has dropped 21% since 1960.

    As the 1968 riots approached, annual murders soared to nearly 300, without any new access to

    fire arms. In the mid 1970s, after the murder rate had already dropped back under 200, a strict

    gun law was imposed and for the next few years nothing much happened one way or the other.

    Then Reagan escalated the drug war and in about five yearsdespite the new gun restrictions

    murders climbed to nearly 500. As the drug market became less anarchistic (many killings had

    involved a conflict over turf), as the population of young men declined and with better policing,

    over the next twenty years the murder rate declined until it was close to the 1960s level.

    Over this half century the imposition of strict gun laws had hardly any impact, but some other

    things did, primarily the war on drugsa policy far more deadly than the availability of guns

    and which, to this days, most liberals refuse to confront.

    This was especially true in a town without a strong mob organization where local dealers easily

    fought over turf. Once the market had matured, murders started to decline aided by a massive

    drop in the number of crime-age youths.

    In the late 1980s I did an analysis of who was getting killed in DC as a result. Heres a chart that

    tells the story:

    In short, it was virtually impossible to be killed in Washington if you were a young white girl

    living in upscale Georgetown on an early Thursday morning in July. If, on the other hand, you

    were a young black 20-year-old male living in low-income Anacostia, dealing drugs on a

    Saturday night in June, your chances of being killed were far greater than the overall city

    average. Yet all these people lived in the same city with the same number of guns.

    Other differences showed up most strikingly in motive. The murder rate resulting from

    altercations or robberies actually dropped substantially and those that stemmed from domesticviolence stayed about the same. But those involving drugs leaped over 300%. Were it not for the

    drug trade, DC would have had a murder rate roughly that of Copenhagen. Death in DC in those

    days was clearly about drugs, not guns.

    In the late 1990s I wrote:

    -- Since 1995, 88% of DC homicides have been gun-related.

    -- In 1985, only 65% of the homicides involved guns.

    -- There was been no significant change in the number of guns reported in the city between 1985

    and 1995.

    -- During this time, however, the number of homicides went from 148 in 1985 to a high of 454

    in 1993, then down to 260 in 1998. Clearly the number of guns in the city was not the controlling

    factor

    Liberals obsess over guns, but this tends to obscure more important factors. Here are just a few

    of the things that would make more sense than more gun control:

    - End the war on drugs, the major cause of violence in America today. A new form of futile

    prohibitioni.e. more gun controlwont work any better.

    - Institute alternative justice programs such drug courts, neighborhood justice commissions,

    mandated treatment, community services such as roving leaders, and other diversion programs.

    Texas, using some of these diversion programs, has reduced the size of its prisons by 20%.

    Meanwhile, crime has declined by 13% to its lowest level since 1973.

    - Reduce poverty and slum housing while making public schools a source of social and civic

    education ters - and not just test factories.

    - Provide jobs for young people. At the time DC had some of its highest crime rates, about 50%

    of the young were unemployed one year after graduating from high school.

    - Get cops out of theircars and into the hood. Largely unnoted has been that crime in DC

    increased after police took refuge in their vehicles instead of working the streets.

    All of these are changes that progressives could be supporting that would be far more useful

    than a futile war on guns, which will not reduce crime but will certainly increase the opposition

    of many Americans to many good progressive ideas.

    Soon will be able to enforce Obama gun laws without sheriffs' help; the push is from the White

    Houses Constitutional Lawyer.

    A bill is heading to Colorado Gov. John Hickenloopers desk that Republican lawmakers saywould give members of the Secret Service broad arrest powers in the state and could provide aframework for federal agents eventually to enforce gun restrictions.

    This is absolutely insane, Rep. Lori Saine, R-Dacono, said. In theory if a Secret Service agentis in a county where the sheriff has refused to enforce some of the recent unenforceable gunlaws, the agent could arrest an individual if he believes the law has been broken.

    The idea actually aligns with an Obama agendato create vast new restrictions and regulations onguns. WND has reported that hundreds of sheriffs nationwide, including many in Colorado, havesaid they cannot enforce federal restrictions that would violate the Second Amendment.In Colorado,Weld County Sheriff John Cooke saidhe and many other county sheriffswontbotherwith several laws poised to go into effect in Colorado because they would be impossibleto enforce.

    One of the laws would require private sellers to do a background check on purchasers in privategun transaction, but the sheriffs wonder how to keep track of whether gun owners are meetingthe new requirements.

    Cooke said many new gun laws are feel-good, knee-jerk reactions that are unenforceable andwould give a false sense of security.

    Cooke said he and other sheriffs are considering filing a lawsuit to block the laws. And sheriffsin other parts of the nation agree, with more than 340 already banding together to promise touphold the U.S. Constitution.

    The Colorado Legislature also passed a bill putting a 15-round limit on ammunition magazines.

    The new bill regarding the Secret Service, SB-13-013, passed on a nearly party line vote in theDemocrat-controlled House and is now awaiting the governors signature. The bill grantsmembers of the Secret Service arrest powers by considering them to be a peace officer, puttingthem on a par with state law-enforcement officials with respect to arrest authority.

    The legislation does not only apply to agents guarding the president or other governmentofficials but also to special agents, uniformed division officers, physical security technicians,physical security specialists and special officers of the United States Secret Service.

    Republican lawmakers say that when they asked why the bill was needed they were given aseries of conflicting answers.

    Sen. Kevin Lundberg, R-Berthoud, said he was told the purpose of the bill was to make it easierto hold a person for mental health reasons.

    When I asked in committee why they need this I was told it was so we can exercise 72-hourmental holds on our own citizens, Lundberg said.

    I found it curious that this was the big reason they thought they needed it. Currently a policeofficer, doctor, psychiatrists, registered nurses and other professionals just on the strength oftheir word can say they want a person taken against their will and put in a mental institution forup to three business days, meaning it could be even longer if it was over the weekend, for anevaluation as to whether they are mentally sane or a danger to themselves or others.

    Sen. Vicki Marble, R-Fort Collins, said despite the bill being sponsored by a fellow Republican,the 72-hour mental hold caught the attention of several Republicans in the Senate.

    This was one of the big flags for us in the bill, Marble said. Its very suspicious because wehave the separation of federal, state and even the local police services. Everyone has their ownjurisdiction, and there is a special reason for keeping federal agents away.

    Nofederal authority should have the ability to detain somebody for 72 hours, she said. Ifthere is a legitimate reason for doing so for someone who is mentally ill, that should come at thelocal level where people in the community know one another.

    Marble said the mental hold was the reason the bill slipped under the radar.

    The mental health hold was what they testified to in committee, and that was the big thing they

    didnt want to get out, but it does give them the authority to put that hold on people.

    Lundberg said the big concern is that the bill essentially places members of the Secret Service onan equal footing with law-enforcement, without being constrained by jurisdictional issues.

    If you look at the bill, it says they can operate alongside oflocal police authorities and functionas equals you might say, he said. However, when you read it carefully it basically gives them

    state police power so whatever power a regular policeman such as the state patrol, sheriffs officeor local police has they will have also.

    However, in debate on the House side, Saine said she was given a different reason for whylegislators needed to pass the bill.

    Rep. Jared Wright was talking about how when he was in committee he asked several times

    why they needed it, and the reason given was if there was a motorcade and something happenedduring the procession the Secret Service needed the authority to arrest the perpetrators, Saine

    said.

    Then we were told by the sponsor thats not it, its because they were going to help our locallaw enforcement and sheriffs with check and wire fraud. However, check and wire fraud are notmentioned anywhere in the bill, she said.

    The bill states that the agents are automatically granted peace officer status when severalconditions apply. For instance, if the agent is responding to a non-federal felony or misdemeanorbeing committed in their presence, he has the full authority to arrest any Colorado citizen.

    The bill also gives the Secret Service agents wide discretion to arrest citizens based merely onprobable cause that a non-federal felony or misdemeanor involving injury or threat of injury to aperson or property has been or is being committed.

    Lundberg said one of the problems with bills like this is they start out by giving broad authorityto a government agency or entity, then they place language later in the bill that appears to restrictthat authority in an attempt to provide cover for those expressing alarm about the language.

    Often in laws like this they will give broad authority in one section, then later in another sectionthey will have wording which appears to restrict the authority, he explained. Unlike the states

    law enforcement, the Secret Service would not have any jurisdictional concerns. Under this billthey can go anywhere in the state of Colorado regardless of jurisdiction.

    But Wright, a former law-enforcement official, told Marble the Secret Service told him theircurrent policies would prohibit them from arresting Colorado citizens under the bills provisions.

    They told Jared that making an arrest of a Colorado citizen for a misdemeanor crime unrelatedto their own duties would actually violate their own guidelines, Marble said. So his question

    was why are we passing a law that violates their own internal policies.

    In Texas, a Democrat in the state legislature has proposed a bill that would allow the state toremove an elected sheriff for refusing to enforce the law. The bill defines law as including anyrule, regulation, executive order, court order, statute or constitutional provision.

    After the passage of a several gun control laws, which would among other things restrictmagazine size and prohibit private sales between individuals without a background check,

    several sheriffs have said the laws are unenforceable and they will not enforce what they callunconstitutional laws.

    Under Colorado law, the only individual with the authority to arrest a sheriff is the coroner.

    Saine said she believes the bill is intended to be used as a foundation for later legislation that will

    surrender still greater control to federal officials.

    Thereve been so many explanations for the reasons they really need this bill passed. So what is

    it really? Saine asked. I believe it is intended to be used for setting up a framework so that atsome other time they could expand it to possibly include being able to arrest a sheriff who isrefusing to enforce unconstitutional laws. They would justify it by saying that since weve

    already given the Secret Service this ability, why not give them just one more?

    Lundberg said he agrees with Saines assessment that the bill could be used to expand federal

    power beyond what is stated in its language.

    It does give Secret Service powers in a broad sense, but Im not sure the changes as stated willautomatically change things significantly. Its not a broad overreach, but it is an overreach. Itsone more step in the wrong direction.

    Lundberg said rather than expanding the ability of federal officials, state and local officialsshould be looking for opportunities to stand up against federal intervention in local affairs.

    I believe sheriffs can enforce their authority, Lundberg said. I also think we need to draw theline as clearly as we can and at every opportunity to say the states are in charge, not the federalgovernment.

    WND has reported that sheriffsacross the country are expressing concern that they cannot

    enforce a Washington mandate that clearly violates the Second Amendment.A growing list of now more than 340 sheriffs who have reportedly vowed to uphold theConstitution against efforts to undermine Americans gun rights isbeing accumulated by theConstitutional Sheriffs and Peace Officers Association.As WND also reported, Cooke said he is getting political pressure to support the laws. He said hereceived an email chain pointing out that Senate Majority Leader John Morse, a Democrat, saidif a salary bill were introduced, it would not be until late in the session, after the gun-control billshad been voted on.

    Cooke said while hes not willing to conclude the emails meet the legal definition of extortion, itwas apparent that was the intent.

    When you look at the email, I dont see how you could look at it any other way, Cooke said.

    It definitely implied the reason a pay raise bill was being held up was to punish us for our

    stance against these gun bills. Then they had another email suggesting if we were to support thisbill, it would look better for us and maybe we can get a bill introduced for a raise.

    To me, that didnt sit well at all. Im not willing to say its extortion yet, but it just looked bad.We were not willing to compromise on our principles. We felt the bill was bad, and we were notgoing to support it.

    The sheriffs pushback against the gun measures is significant because Democratic lawmakersare crafting similar bills in other states.

    The bills are a model for what theyll try to push in Congress,said Independence Instituteresearch director and Denver University law professor Dave Kopel.

    Colorado is a pawn for the Obama-Biden plan, he added.

    In fact, Vice-President Joe Biden called undecided Democrats and pushed for passage of thebills. Obama is scheduled to visit the state in just a few days.

    While some see the measures as models for other states, laws that preserve gun rights are gainingmomentum.

    The first of these was theFirearms Freedom Act passed in Montana, which says any firearmsmade and retained in-state are beyond the authority of Congress under its constitutional power toregulate commerce among the states.Lawmakers in other statesare now following suit.

    Two senators in Ohio have introduced a bill which would prohibit firearms seizures, registrationand bans in their state.

    A bill in Kentucky would prohibit the state from enforcing new federal gun-control laws, ifenacted.

    Idahos House passed a bill that would criminalize enforcing any new federal laws that ban,restrict, confiscate or require registration of firearms or ammunition in violation of the statesconstitution.

    A bill in Louisiana would prohibit the enforcement of federal restrictions regarding theownership or possession of semi-automatic firearms.

    A bill that would prohibit the enforcement of federal gun laws passed in the House Public SafetyCommittee in Oklahoma.

    The Texas House is considering a measure to prevent state and local police from enforcing newfederal gun-control measures.

    A bill in Arizona would make it a felony for the federal government to enforce new laws orregulations on guns, accessories and ammunition owned or manufactured in the state.

    And a bill in Michigan would exempt firearms and firearms accessories made and soldexclusively in Michigan from federal gun restrictions.

    Some of the strongest language to that effect has come from Utah, where 28 of the states 29

    elected sheriffs signeda letter to President Obamawarning him not to send federal agents to startconfiscating guns.

    Similarly, in New Mexico in January, 30 of the states 33 county sheriffs paid a visit to the statehouse, reminding the governor and state congressmen that a sheriffs job is to defend the

    Constitution, including the Second Amendment.

    Gun Laws,Colorado, and apparently Texas (next) are being targeted with an attempt to set up a federalauthority framework that will enable Secret Service agents (not just those guarding thepresident), and others of the U.S. Secret Service including uniformed division officers, physicalsecurity technicians and specialists, and other special officers, to arrest and remove an electedsheriff for refusing to enforce the law (or anyone breaking the law).

    The bills being introduced defines law as including any rule, regulation, executive order, courtorder, statute or constitutional provision.

    Why are they doing this? Heres why

    It would establish federal authority police powers in a State, enabling an enforcement armreporting directly to the president (the Secret Service).

    It would potentially lead to enabling the president / executive branch to theoretically override theactions and preventative measures that are now being taken by many States throughout thecountry who are trying to preserve 2nd Amendment gun rights and who are prohibiting the

    enforcement of unconstitutional law passed by Congress or pushed by executive order.

    As some of you may know, a growing list of sheriffs (more than 340 so far) across the countryhave expressed that they will not enforce a Washington mandate that clearly violates the SecondAmendment.

    The president and vice-president Biden have been actively pursuing state legislatures andpushing for passage of the bills. Obama is scheduled to visit Colorado in just a few days.Colorado is a pawn for the Obama-Biden plan, and then on to the next at least those thatwont fall into line.

    It is a full court press by the federal government to empower themselves even further byinserting themselves as police authority within the state, to eliminate opposition.

    dire danger. Theyd have to spend time and money campaigning in the state, taking their focusoff states that are already hotly contested.

    With its diversity and size, Texas should always be a battleground state where local elections

    are vigorously contested and anyone who wants to be our commander in chief has to compete

    and show they reflect Texas values. Yet for far too long, the states political leaders, both inAustin and in Washington, D.C., have failed to stand for Texans, Bird said. Over the next

    several years, Battleground Texas will focus on expanding the electorate by registering morevotersand as importantly, by mobilizing Texans who are already registered voters but whohave not been engaged in the democratic process.

    Perry wont have any of that in his state. Frazier said Democrats can try to organize in Texas allthey want to, but that their principles dont work. Voters just wont go for liberal policies, she

    said, as long as conservatives like Perry continue to articulate why those liberal policies areeconomically detrimental.

    Gov. Perry has remained vigilant in working with Republican state leadership to ensure wedon't back down, Frazier said. He understands we cannot rest on our laurels and hope to

    continue succeeding. We need to remain nimble, innovative and aggressive in the effort to holdthe line on spending, keep taxes low, and maintain a climate where job creators know they cancome, take a risk and have a good chance of reaping a reward.     The long arm of the law doesn't reach very far for sheriffs in Delaware.

    That's what Jeff Christopher, Sussex County's sheriff, learned after trying to exert greaterpolicing powers, like making arrests and traffic stops.

    By trying to widen his authority, Christopher got tangled in a dispute with politicians and policefrom other departments after taking office last year. County officials, state legislators and

    Delaware's attorney general say Christopher is overstepping his bounds and jeopardizing publicsafety by carrying out tasks his force hasn't been trained to perform.

    "I want to recreate the office in the way it was intended," Christopher, a Republican, told TheHuffington Post. "A sheriff is supposed to be out there responding to the wishes of the people,

    just as the police do. Most people want to see more of a presence of law enforcement."

    It comes as a surprise to some residents that typical police duties are not part of the jobdescription for Delaware's three county sheriffs. Unlike in many other states where the sheriff'sdepartment is the local police force, the duties of the elected lawmen in Delaware are primarilylimited to serving court papers and running foreclosure sales.

    Christopher has justified his grasp at power by citing a phrase in the state Constitution thatdefines sheriffs as "conservators of the peace." Opponents argue that he has misinterpreted thephrase, but some of Christopher's critics acknowledge an ambiguity in various state documentsthat delimit a sheriff's function.

    With legal wiggle room and a belief that he has a public mandate to act, Christopher hasreportedly unleashed his deputies and allowed them to chase down apparent felons andscofflaws.

    Their stepped-up presence in Delaware's southernmost county has fueled a smolderingcontroversy, after a string of incidents in which Christopher's unit allegedly interfered with ormishandled police work.

    "He continues to say he's law enforcement, and he's not," said state House Majority Leader PeteSchwartzkopf, a Democrat, who introduced a bill that specifically denies sheriffs the ability to

    arrest suspects and investigate crimes. "It's not a good position to be in, to have no authority overa person who carries a gun. It's scary."

    In one case, a Sussex County deputy pulled over off-duty corrections officer William Breasurefor speeding last fall and let him off with a warning, according to Breasure, who spokeat acounty council hearing in April.

    Other alleged breaches of authority by Christopher are documented in a report sent by SussexCounty's administrator to members of the Delaware General Assembly in April. In one case,state police were investigating reports of a residential burglary in January when one ofChristopher's deputies showed up after hearing the call on police radio. The deputy's unexpected

    appearance in the house "caus[ed] confusion and alarm among the state troopers," according toCounty Administrator Todd Lawson's report.

    Christopher's detractors cite another mishandled incident in which a judge threw out drugcharges against a defendant arrested by a Sussex County deputy in February. The judgedismissed the case because "the deputy is not a police officer and the individual was not affordedhis Constitutional rights during the incident," Lawson's report said.

    The extracurricular activities have come at the expense of Christopher's other duties, Lawson'sreport claimed, which said there's a "multiple month backlog on sheriff's sales."

    Christopher said his department should be recognized as a regular police force, because evenserving subpoenas can escalate into dangerous encounters.

    "There's a concern about how passionate a person is going to get in these situations," said

    The debate over sheriff's powers has flared before. Sheriff Robert Reed, a predecessor ofChristopher in Sussex County, sued the state in 2002 for expanded powers and previously hadbeenrebuked for installing flashing lightson deputies' cars to make them resemble policevehicles.

    Christopher's team must back down, his critics have contended, because they haven't gonethrough the mandatory training that the state's police officers have received. The lack ofnecessary instruction exposes the county to lawsuits and increases the chance of mishap when

    deputies insert themselves into policing roles.

    "There is some serious concern about liability," University of Delaware public policy professorDouglas Tuttle told HuffPost. "If you've got somebody out exercising law enforcementresponsibility who doesn't meet your training standards and something goes wrong, whathappens?"

    Officials working for Attorney General Beau Biden -- Vice President Joe Biden's son -- said"conservator of the peace" is an undefined term that doesn't carry much weight. A February non-binding opinion from State Solicitor Lawrence Lewis in Biden's office noted that coroners andsome court clerks have the same designation. Lewis also wrote that "sheriffs do not have the

    statutory or common law authority to make arrests."

    To settle the clash once and for all,Christopher has filed a lawsuit asking for his responsibilitiesto be spelled out.

    But a decision could emerge from the Dover statehouse, whereSchwartzkopf's bill to definesheriffs' roles more precisely passed the House. The state Senate will pick up the bill for a votewhen it returns in June.

    Clarification: Language has been changed to indicate that Schwartzkopf's bill would outline thesheriffs' role in more detail, not that the bill had narrowly passed in the House.

    Yet they've turned around and mocked us with declining tax payments. They've cut workers.

    They've refused to invest their massive profits in job-producing research and development. And

    they've insulted existing employees with low wages and dwindling retirement support.

    As a final disdainful act, many of them have tried to convince us that they LOSE money in the

    U.S. while only making profits overseas.

    Here are the facts.

    Business Built on Our Backs

    (a) Research

    The most essential aspect of business growth is the long-term basic research that is

    largely conducted with government money. Starting in the 1950s, taxpayer-funded research at

    the Defense Advanced Research Projects Agency (the Internet), the National Institute of Health

    (pharmaceuticals), and the National Science Foundation (the Digital Library Initiative) has laid a

    half-century foundation for corporate product development. Even today 60% of university

    research is government-supported.

    The tech industry is a special case, with many computer and communications companies coming

    of age in the 1990s, when industry funding for computer research declined dramatically and

    government research funding continued to climb. As of 2009 universities were still receiving ten

    times more science & engineering funding from government than from industry.

    (b) Infrastructure

    Thanks to the taxpayer-funded National Highway System, corporations have acquired access to

    markets across the country for over 60 years. Along with road construction came the water,

    electric, and telephone facilities needed to sustain their businesses.

    Today, the publicly supported communications infrastructure allows the richest 10% of

    Americans to readily manipulate their80% share of the stock market. CEOs rely onroads and

    seaports and airports to ship their products, the FAA and TSA and Coast Guard and Department

    of Transportation to safeguard them, a nationwide energy grid to power their factories, and

    communications towers and satellites to conduct online business. Private jets use 16 percent of

    air traffic control resources while paying only 3% of the bill.

    (c) Law

    A litany of advantages accrues to the business world through the legal system. The wealthiest

    Americans are the main beneficiaries of tax laws, property rights, zoning rules, patent and

    copyright provisions, trade pacts, antitrust legislation, and contract regulations. Their

    companies benefit, despite their publicly voiced objections to regulatory agencies, from SBA and

    SEC guidelines that generally favor business, and from FDA and USDA quality control

    measures that minimize consumer complaints and product recalls.

    The growing numbers offinancial industry executives have profited from 30 years of

    deregulation, most notably the repeal of the Glass-Steagall Act. Lobbying by the financial

    industry has stifled reasonable proposals like a sales tax on financial transactions.

    More big advantages are enjoyed by multinational corporations through trade agreements like

    NAFTA, with international disputes resolved by the business-friendly World Bank, International

    Monetary Fund, and World Trade Organization. Federal judicial lawprotects our biggest

    companies from foreign infringement. The proposed Trans-Pacific Partnership would put

    governments around the world at the mercy of corporate decision-makers.

    (d) Education

    Public colleges have helped to train the chemists, physicists, chip designers, programmers,

    engineers, production line workers, market analysts, and testers who create modern technological

    devices. At the primary and secondary levels, the "equal opportunity" principle mandated by the

    Supreme Court in Brown vs. the Board of Education has contributed to business growth, building

    the math and language skills that until recently led the world.

    (e) Defense

    The U.S. government will be spending $55 billion on Homeland Security this year, in addition to

    services and the National Guard, are focused on crimes against wealth.

    Belittling Us Instead Of Paying Us Back

    Instead of paying for their decades of government-supported growth, corporations have nearly

    stopped paying taxes, leaving payroll deductions and individual income taxes as the main

    sources of federal revenue.

    From 2003 to 2011 total corporate profits more than doubled from $900 billion to almost $2

    trillion, but the corporate income tax rate dropped by more than half, from 22.5% to 10%.

    On top of this, the most profitable corporations get the biggest subsidies. The Federal

    Reserveprovided more than $16 trillion in welfare assistance to financial institutions and

    corporations. According to U.S. PIRG and Citizens for Tax Justice, 280 top-earning Fortune 500

    companies, which together paid only half of the maximum 35 percent corporate tax rate, received

    $223 billion in tax subsidies.

    What have they been doing with their windfall profits? Anywhere from $2.2 trillion to$3.4

    trillion in cash is being held by non-financial corporations, who have chosen to fatten

    stockholders rather than invest in new production facilities and the employees needed to make

    them functional. Worse yet, as reported by The Nation, Market Watch, and Business Insider,

    they've been steadily cutting jobs in order to 'streamline' their operations.

    For the employees who remain, average real wages were $17.42 in 2007, down from $19.34 in

    1972 (based on 2007 dollars). Wages as a percentage of the economy are at an all-time low.

    An Added Insult -- Profits Declared Overseas, But Not in the U.S.

    Multinational corporations use the vacuous argument of an excessive U.S. tax rate to defend theirtax avoidance, although in reality the U.S. has the third-lowest rate oftax revenue per

    GDP among all OECD countries.

    The biggest tax avoiders are not content to just shirk their tax responsibilities. To sustain the

    image of profitmaking for their investors, many of them claim hefty worldwide incomes while

    reporting little or no income in the United States. Pfizer, for example, just declared their fifth

    straight annual loss in the U.S., despite a five-year income total of over $50 billion.

    A review ofSEC data reveals more chicanery. In the last two years Citigroup reported $27.8

    billion in foreign income, but a $5 billion loss in the United States. Exxon credits the U.S. for 1/3

    of its revenue and 40% of its assets, but only 15% of its income. Apple has 2/3 of its employees

    in the U.S. but claims only 1/3 of its profits as U.S. income.

    Summing Up the Absurdity: You Made Us the Best, But We Don't Have To Pay

    Forbes responded to suggestions of American decline with this stirring defense: "We lead the

    world in Internet innovation, music, movies, biotech and many other technological fields that

    require out-of-the-box thinking. From Apple to DreamWorks Studios, from Amazon to Zynga,

    we are the world's innovators."

    They might have added, "And we don't have to give anything back to the people who made it all

    possible."

    Obama Budget Proposal Cuts Are 'Unconscionable,' Says AFL-CIO

    WASHINGTON -- President Obama hasn't formally proposed his "compromise" budget planyet, but the White House can already see cracks forming among its trusted progressive coalitionover cutbacks to cherished safety net programs.

    On Saturday, organized labor quickly made good on its promise to oppose a White House budgetthat includes cuts to Social Security and Medicare, with the AFL-CIO labor federation rippingthe president'sexpected proposalwith unusually tough language in an email blast to activists.

    The email (below) came with the subject heading, "Obama's really bad idea."

    "From all reports Ive seen, President Obama is going to propose a budget plan next week that isunprecedented for a Democratic president," said the email from Damon Silvers, the AFL-CIO'spolicy director. "It will propose a cut to Social Security benefits for seniors, veterans and peoplewith disabilities."

    "It is unconscionable to ask seniors, people with disabilities and veterans who are barely makingit to be squeezed even tighter at a time when corporations and the wealthiest 2% are not payingtheir fair share of taxes, despite soaring profits."

    That the AFL-CIO would oppose such a budgetcomes as no big surprise-- the federation hasbeen saying as much since the day after Obama's election victory over Mitt Romney. But the factthat one of the president's strongest allies is preemptively calling his proposal "unconscionable"hints at some of the withering criticism Obama can expect to come from his left flank.

    The president will propose his budget on Wednesday. As HuffPost has reported, it is likely toinclude a proposal to readjust the way the cost of living is calculated for Social Securitybeneficiaries. Known as "chained CPI," the switch will effectively reduce payments over time.The budget is also expected to include additional means testing for Medicare.

    The budget would trim the deficit by an estimated $1.8 trillion over a decade, with $600 billionin savings coming from revenue and $1.2 trillion coming from domestic program and entitlementcuts,according to the New York Times.

    While the inclusion of chained CPI and other cuts strengthen the possibility of a "grand bargain"over the budget, many to Obama's left seem to be questioning the prudence of starting

    negotiations so close to the middle. Count the AFL-CIO among them.

    In his email, Silvers steered activists to apetitionand urged them to "tell President Obama: No'chained CPI and no cuts to Medicare, Medicaid or other cuts to Social Security benefits. Period.'

    Why US Jobs Are Going to Get a Lot Worse

    Weak U.S. jobs data on Friday confirmed the worst trading week this year for European and U.S.

    stocks and now analysts are warning there will be little upturn in the data and investors shouldbrace themselves for further trouble ahead as fiscal tightening begins to take its toll.

    Friday's jobs report came in well below expectations, raising concerns that the recovery in theworld's largest economy is weakening. March's participation rate was at its lowest since 1979,according to the Bureau of Labor Statistics. Just 88,000 jobs were added to the economy lastmonth although theunemployment rate fell to 7.6 percent from 7.7 percent in February.

    "In the labor market, at least, we see a real risk of even worse news down the line," IanShepherdson, chief economist at Pantheon Macroeconomic Advisors said in a research note onMonday.

    Weakening labor demand is the key problem with the U.S. economy, according to Shepherdson,not rising layoffs. And this weakening demand is mostly from small firms, that are below theradar of the Institute for Supply Management (ISM) survey which shows national factoryactivity.

    NFIB's (The National Federation of Small Business) job survey has done a decent job inforeshadowing movements in payrolls in recent years, according to Shepherdson, and it's thisreport - due to be released on Tuesday - that's warning of troubled waters ahead.

    "While actual job creation appears to be rising, plans to create jobs [in March] took a dive,

    falling 4 points to a net zero percent of small employers who plan to increase total employment.It seems that the stamina for growth is waning," William C. Dunkelberg, chief economist for theNFIB said in a press release last week.

    Looking at the figures, Shepherdson said there could be a degree of respite in the officialemployment numbers for the next couple of months, before a distinct change.

    "The outlook then turns bleaker again. The survey does not signal an outright decline in payrollsover the next few months, but we cannot be sure it has bottomed out yet," Shepherdson said.

    He cited fiscal tightening as the major reason behind the reverse. At the start of the year, thepayroll tax that funds Social Security was raised two percentage points to its 2010 level of 6.2percent. This was the largest component of tax increases approved by Congress in the resolutionof the "fiscal cliff" that many believe will cause a significant hit to U.S. growth.

    "You can't take more than 1.5 ofGDP (gross domestic product) out of the economy more or lessovernight and expect nothing bad to happen," Shepherdson said.

    "Markets - especially the Treasury market - are having a rethink of the fiscal-tightening-doesn'tmatter-much hypothesis. Good. It never made any sense."

    U.S. equities responded negatively on Friday to the soft jobs data, government bond yields fellwith the benchmark 10-year Treasury falling to its lowest yield so far this year. The dollar also

    depreciated against European currencies in response.

    "The data supports our view that the strong U.S. data flow in January and February is likely togive way to weaker data in (the second quarter), as fiscal headwinds are reflected in slowergrowth in demand, activity, and employment," Barclays said in a research note on Monday.

    "Although we have recently raised our forecast of (first quarter) GDP growth to 3.5 percent,which matches our latest tracking estimate for the quarter, we have kept our (second quarter)forecast at 1.5 percent."
