SENATE RESOLUTION NO. 41 Offered by Senator Clayborne and all Senators: Mourns the death of Richard Lee Clayborne, Sr., of Springfield.

SENATE RESOLUTION NO. 42 Offered by Senator J. Jones and all Senators: Mourns the death of U.S. Army Sergeant Michael Bartley of Barnhill. By unanimous consent, the foregoing resolutions were referred to the Resolutions Consent Calendar.

Senator Haine offered the following Senate Resolution, which was referred to the Committee on Assignments:

SENATE RESOLUTION NO. 43

WHEREAS, The month of April has been designated "National Child Abuse Prevention Month" as anannual tradition that was initiated in 1979 by former President Jimmy Carter; and WHEREAS, The most recent National Child Abuse and Neglect Data System (NCANDS) figures show that almost 900,000 children were victims of abuse and neglect in the United States in 2004,causing unspeakable pain and suffering to our most vulnerable citizens; among the children who arevictims of abuse and neglect, nearly four children die each day in this country; and WHEREAS, Children age one and younger accounted for 45 percent of child abuse and neglectfatalities in 2004, and children age three and younger accounted for 81 percent of all child abuse andneglect fatalities in 2004; and WHEREAS, Abusive head trauma, including the trauma known as Shaken Baby Syndrome, isrecognized as the leading cause of death of physically abused children; Shaken Baby Syndrome is atotally preventable form of child abuse, caused by a caregiver losing control and shaking a baby that isusually less than one year in age; it can result in loss of vision, brain damage, paralysis, seizures, ordeath; and WHEREAS, A 2003 report in the Journal of the American Medical Association estimates that, in the United States, an average of 300 children will die each year, and 600 to 1,200 more will be injured, ofwhom two-thirds will be babies or infants under one year in age, as a result of Shaken Baby Syndrome,with many cases resulting in severe and permanent disabilities; and WHEREAS, Medical professionals believe that thousands of additional cases of Shaken BabySyndrome are being misdiagnosed or not detected; and WHEREAS, Shaken Baby Syndrome often results in permanent, irreparable brain damage or death toan infant and may result in more than $1,000,000 in medical costs to care for a single, disabled child injust the first few years of life; and WHEREAS, The most effective solution for ending Shaken Baby Syndrome is to prevent such abuse, and it is clear that the minimal costs of education and prevention programs may prevent enormousmedical and disability costs and untold grief for many families; and WHEREAS, Prevention programs have demonstrated that educating new parents about the danger ofshaking young children and how they can help protect their child from injury can bring about asignificant reduction in the number of cases of Shaken Baby Syndrome; and WHEREAS, Education programs have been shown to raise awareness and provide critically importantinformation about Shaken Baby Syndrome to parents, caregivers, daycare workers, child protectionemployees, law enforcement personnel, health care professionals, and legal representatives; and

WHEREAS, Efforts to prevent Shaken Baby Syndrome are supported by advocacy groups across theUnited States that were formed by parents and relatives of children who have been killed or injured byshaking, such as the National Shaken Baby Coalition, the Shaken Baby Association, the SKIPPER(Shaking Kills: Instead Parents Please Educate and Remember) Initiative, the Shaken Baby Alliance,Shaken Baby Prevention, Inc., A Voice for Gabbi, Don't Shake Jake, the Kierra Harrison Foundation, theCynthia Gibbs Foundation, Reagan's Rescue, the Hannah Rose Foundation, and the Sarah Jane BrainFoundation, whose mission is to educate the general public and professionals about Shaken BabySyndrome and to increase support for victims and victims' families in the health care and criminal justice systems; and WHEREAS, Child abuse prevention programs and "National Shaken Baby Syndrome AwarenessWeek" are supported by the National Shaken Baby Coalition, the National Center on Shaken BabySyndrome, the Children's Defense Fund, the American Academy of Pediatrics, the Child Welfare Leagueof America, Prevent Child Abuse America, the National Child Abuse Coalition, the National ExchangeClub Foundation, the American Humane Association, the American Professional Society on the Abuse of Children, the Arc of the United States, the Association of University Centers on Disabilities,Children's Healthcare is a Legal Duty, Family Partnership, Family Voices, National Alliance ofChildren's Trust and Prevention Funds, United Cerebral Palsy, the National Association of Children'sHospitals and related institutions, Never Shake a Baby Arizona/Prevent Child Abuse Arizona, the Centerfor Child Protection and Family Support, and many other organizations; therefore, be it RESOLVED, BY THE SENATE OF THE NINETY-SEVENTH GENERAL ASSEMBLY OF THESTATE OF ILLINOIS, that in honor of survivors of Shaken Baby Syndrome like Kristina Simmons ofDecatur, non-survivors like Taylor Nicole (Pinkas) Rogers of Edwardsville, Reagan Williams ofDanville, Gabriella Manzardo of Naperville, Brynden Tyler Gibson of Herrin, Xavier Delgado ofSterling, and Ben Fitton of Paxton, and in honor of all the other precious children that did or did notsurvive, we hereby designate April 18-24, 2011, as "Shaken Baby Syndrome Awareness Week" in the State of Illinois; and be it further RESOLVED, That we commend those hospitals, child care councils, schools, and other organizationsthat are working to increase awareness of the danger of shaking young children and educate parents and caregivers as to how they can help protect children from such injuries; and be it further RESOLVED, That we encourage the people of Illinois to remember the victims of Shaken BabySyndrome and to participate in educational programs to help prevent Shaken Baby Syndrome; and be itfurther RESOLVED, That a suitable copy of this resolution be presented to the National Shaken BabyCoalition. Senator Pankau offered the following Senate Resolution, which was referred to the Committee on Assignments:

SENATE RESOLUTION NO. 44

WHEREAS, Many people throughout the State put themselves and others at risk by trespassing alongthe right-of-way of railroads or ignoring railroad crossing warning devices at public crossings; and WHEREAS, Parents and children alike may be unfamiliar with proper behavior near railroad tracks; therefore, be it RESOLVED, BY THE SENATE OF THE NINETY-SEVENTH GENERAL ASSEMBLY OF THESTATE OF ILLINOIS, that we encourage K through 12 schools in this State to include the followinglanguage in their student handbooks: "As a parent, you teach your children to strive for excellence, pursue their interests, and to be safe and responsible citizens. Operation Lifesaver is an international, nonprofit education

and awareness program dedicated to ending tragic collisions, fatalities, and injuries at highway-rail grade crossings and on railroad rights of way. Operation Lifesaver strives to increase public awareness about the dangers around the rails. The program seeks to educate both pedestrians and drivers, young and old, to make safe decisions at crossings and around railroad tracks.

Your children will take critical information they learn from you into their future. Operation Lifesaver wants to help you make sure their future is a safe one. Here are some tips about walking across railroad tracks and trespassing: (1) Cross tracks ONLY at designated pedestrian or roadway crossings. Observe and obey all warning signs and signals. (2) Never walk down a train track; it's illegal and it's dangerous. By the time a

locomotive engineer can see a trespasser or a vehicle on the tracks, it is too late. The train cannotstop quickly enough to avoid a collision.

(3) The only safe place to cross is at a designated public crossing with a cross

buck, flashing red lights, or a gate. If you cross at any other place, you are trespassing and can beticketed or fined.

(4) Do not cross the tracks immediately after a train passes. A second train might

be blocked by the first. Trains can come from either direction. Wait until you can see clearly aroundthe first train in both directions.

(5) Flashing red lights signal that a train is approaching from either direction.

You can be fined for failure to obey these signals. Never walk around or behind lowered gates at acrossing. Stay Alive! DO NOT cross the tracks until the lights have stopped flashing and it is safeto do so.

(6) Remember, rails and recreation do not mix!"; and be it further RESOLVED, That suitable copies of this resolution be delivered to the State Superintendent ofEducation.

Senator Murphy offered the following Senate Joint Resolution, which was ordered printed and referred to the Committee on Assignments:

SENATE JOINT RESOLUTION NO. 9 CONSTITUTIONAL AMENDMENT

SC0009 RESOLVED, BY THE SENATE OF THE NINETY-SEVENTH GENERAL ASSEMBLY OF THESTATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES CONCURRING HEREIN, that thereshall be submitted to the electors of the State for adoption or rejection at the general election nextoccurring at least 6 months after the adoption of this resolution a proposition to change Sections 8, 9, and 10 of Article IV, Section 6 of Article VII, and Section 9 of Article IX as follows:

ARTICLE IV THE LEGISLATURE

SECTION 8. PASSAGE OF BILLS (a) The enacting clause of the laws of this State shall be: "Be it enacted by the People of the State of Illinois, represented in the General Assembly." (b) The General Assembly shall enact laws only by bill. Bills may originate in either house, but maybe amended or rejected by the other. (c) No bill shall become a law without the concurrence of a majority of the members elected to eachhouse; except that on the date of a general election through the term of the then-current General Assembly, no bill shall become law without the concurrence of at least two-thirds of the members elected to each house. Final passage of a bill shall be by record vote. In the Senate at the request of twomembers, and in the House at the request of five members, a record vote may be taken on any otheroccasion. A record vote is a vote by yeas and nays entered on the journal. (d) A bill shall be read by title on three different days in each house. A bill and each amendmentthereto shall be reproduced and placed on the desk of each member before final passage. Bills, except bills for appropriations and for the codification, revision or rearrangement of laws, shallbe confined to one subject. Appropriation bills shall be limited to the subject of appropriations. A bill expressly amending a law shall set forth completely the sections amended.

The Speaker of the House of Representatives and the President of the Senate shall sign each bill thatpasses both houses to certify that the procedural requirements for passage have been met. (Source: Illinois Constitution.) SECTION 9. VETO PROCEDURE (a) Every bill passed by the General Assembly shall be presented to the Governor within 30 calendardays after its passage. The foregoing requirement shall be judicially enforceable. If the Governorapproves the bill, he shall sign it and it shall become law. (b) If the Governor does not approve the bill, he shall veto it by returning it with his objections to thehouse in which it originated. Any bill not so returned by the Governor within 60 calendar days after it ispresented to him shall become law. If recess or adjournment of the General Assembly prevents the returnof a bill, the bill and the Governor's objections shall be filed with the Secretary of State within such 60calendar days. The Secretary of State shall return the bill and objections to the originating house promptly upon the next meeting of the same General Assembly at which the bill can be considered. (c) The house to which a bill is returned shall immediately enter the Governor's objections upon itsjournal. If within 15 calendar days after such entry that house by a record vote of three-fifths (at least two-thirds on the date of a general election through the term of the then-current General Assembly) of the members elected passes the bill, it shall be delivered immediately to the second house. If within 15 calendar days after such delivery the second house by a record vote of three-fifths (at least two-thirds on the date of a general election through the term of the then-current General Assembly) of the members elected passes the bill, it shall become law. (d) The Governor may reduce or veto any item of appropriations in a bill presented to him. Portions ofa bill not reduced or vetoed shall become law. An item vetoed shall be returned to the house in which itoriginated and may become law in the same manner as a vetoed bill. An item reduced in amount shall bereturned to the house in which it originated and may be restored to its original amount in the samemanner as a vetoed bill except that the required record vote shall be a majority (at least two-thirds on the date of a general election through the term of the then-current General Assembly) of the members elected to each house. If a reduced item is not so restored, it shall become law in the reduced amount. (e) The Governor may return a bill together with specific recommendations for change to the house inwhich it originated. The bill shall be considered in the same manner as a vetoed bill but the specificrecommendations may be accepted by a record vote of a majority (at least two-thirds on the date of a general election through the term of the then-current General Assembly) of the members elected to each house. Such bill shall be presented again to the Governor and if he certifies that such acceptanceconforms to his specific recommendations, the bill shall become law. If he does not so certify, he shallreturn it as a vetoed bill to the house in which it originated. (Source: Illinois Constitution.) SECTION 10. EFFECTIVE DATE OF LAWS The General Assembly shall provide by law for a uniform effective date for laws passed prior to June1 of a calendar year. The General Assembly may provide for a different effective date in any law passedprior to June 1. A bill passed after May 31 shall not become effective prior to June 1 of the next calendar year unless the General Assembly by the vote of three-fifths (at least two-thirds on the date of a general election through the term of the then-current General Assembly) of the members elected to each house provides for an earlier effective date. ARTICLE VII LOCAL GOVERNMENT

SECTION 6. POWERS OF HOME RULE UNITS (a) A County which has a chief executive officer elected by the electors of the county and any municipality which has a population of more than 25,000 are home rule units. Other municipalities mayelect by referendum to become home rule units. Except as limited by this Section, a home rule unit mayexercise any power and perform any function pertaining to its government and affairs including, but notlimited to, the power to regulate for the protection of the public health, safety, morals and welfare; tolicense; to tax; and to incur debt. (b) A home rule unit by referendum may elect not to be a home rule unit. (c) If a home rule county ordinance conflicts with an ordinance of a municipality, the municipalordinance shall prevail within its jurisdiction. (d) A home rule unit does not have the power (1) to incur debt payable from ad valorem property tax receipts maturing more than 40 years from the time it is incurred or (2) to define and provide for thepunishment of a felony.

(e) A home rule unit shall have only the power that the General Assembly may provide by law (1) to punish by imprisonment for more than six months or (2) to license for revenue or impose taxes upon ormeasured by income or earnings or upon occupations. (f) A home rule unit shall have the power subject to approval by referendum to adopt, alter or repeal a form of government provided by law, except that the form of government of Cook County shall besubject to the provisions of Section 3 of this Article. A home rule municipality shall have the power toprovide for its officers, their manner of selection and terms of office only as approved by referendum oras otherwise authorized by law. A home rule county shall have the power to provide for its officers, theirmanner of selection and terms of office in the manner set forth in Section 4 of this Article. (g) The General Assembly by a law approved by the vote of three-fifths (at least two-thirds on the date of a general election through the term of the then-current General Assembly) of the members elected to each house may deny or limit the power to tax and any other power or function of a home rule unit notexercised or performed by the State other than a power or function specified in subsection (l) of thissection. (h) The General Assembly may provide specifically by law for the exclusive exercise by the State of any power or function of a home rule unit other than a taxing power or a power or function specified insubsection (l) of this Section. (i) Home rule units may exercise and perform concurrently with the State any power or function of a home rule unit to the extent that the General Assembly by law does not specifically limit the concurrentexercise or specifically declare the State's exercise to be exclusive. (j) The General Assembly may limit by law the amount of debt which home rule counties may incur and may limit by law approved by three-fifths (at least two-thirds on the date of a general election through the term of the then-current General Assembly) of the members elected to each house theamount of debt, other than debt payable from ad valorem property tax receipts, which home rulemunicipalities may incur. (k) The General Assembly may limit by law the amount and require referendum approval of debt to beincurred by home rule municipalities, payable from ad valorem property tax receipts, only in excess ofthe following percentages of the assessed value of its taxable property: (1) if its population is 500,000 ormore, an aggregate of three percent; (2) if its population is more than 25,000 and less than 500,000, an aggregate of one percent; and (3) if its population is 25,000 or less, an aggregate of one-half percent. Indebtedness which is outstanding on the effective date of this Constitution or which is thereafterapproved by referendum or assumed from another unit of local government shall not be included in theforegoing percentage amounts. (l) The General Assembly may not deny or limit the power of home rule units (1) to make localimprovements by special assessment and to exercise this power jointly with other counties and municipalities, and other classes of units of local government having that power on the effective date ofthis Constitution unless that power is subsequently denied by law to any such other units of localgovernment or (2) to levy or impose additional taxes upon areas within their boundaries in the mannerprovided by law for the provision of special services to those areas and for the payment of debt incurredin order to provide those special services. (m) Powers and functions of home rule units shall be construed liberally. (Source: Illinois Constitution.)

ARTICLE IX REVENUE

SECTION 9. STATE DEBT (a) No State debt shall be incurred except as provided in this Section. For the purpose of this Section,"State debt" means bonds or other evidences of indebtedness which are secured by the full faith andcredit of the State or are required to be repaid, directly or indirectly, from tax revenue and which areincurred by the State, any department, authority, public corporation or quasi-public corporation of the State, any State college or university, or any other public agency created by the State, but not by units oflocal government, or school districts. (b) State debt for specific purposes may be incurred or the payment of State or other debt guaranteed in such amounts as may be provided either in a law passed by the vote of three-fifths (at least two-thirds on the date of a general election through the term of the then-current General Assembly) of the members elected to each house of the General Assembly or in a law approved by a majority of the electors votingon the question at the next general election following passage. Any law providing for the incurring orguaranteeing of debt shall set forth the specific purposes and the manner of repayment. (c) State debt in anticipation of revenues to be collected in a fiscal year may be incurred by law in an

amount not exceeding 5% of the State's appropriations for that fiscal year. Such debt shall be retiredfrom the revenues realized in that fiscal year. (d) State debt may be incurred by law in an amount not exceeding 15% of the State's appropriationsfor that fiscal year to meet deficits caused by emergencies or failures of revenue. Such law shall providethat the debt be repaid within one year of the date it is incurred. (e) State debt may be incurred by law to refund outstanding State debt if the refunding debt matureswithin the term of the outstanding State debt. (f) The State, departments, authorities, public corporations and quasi-public corporations of the State, the State colleges and universities and other public agencies created by the State, may issue bonds orother evidences of indebtedness which are not secured by the full faith and credit or tax revenue of the State nor required to be repaid, directly or indirectly, from tax revenue, for such purposes and in suchamounts as may be authorized by law. SCHEDULE This Constitutional Amendment takes effect upon being declared adopted in accordance with Section7 of the Illinois Constitutional Amendment Act.

CONSTITUTIONAL AMENDMENT SC0010 RESOLVED, BY THE SENATE OF THE NINETY-SEVENTH GENERAL ASSEMBLY OF THESTATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES CONCURRING HEREIN, That there shall be submitted to the electors of the State for adoption or rejection at the general election nextoccurring at least 6 months after the adoption of this resolution a proposition to add Section 13 to ArticleVII of the Illinois Constitution as follows:

ARTICLE VII LOCAL GOVERNMENT

SECTION 13. UNFUNDED MANDATES (a) If the General Assembly or any State executive action requires a unit of local government toestablish, expand, or modify its activities in such a way as to necessitate additional expenditures of revenue by the unit of local government, then the State must provide funds to reimburse the unit of localgovernment for the costs necessary to carry out the mandated requirement, except that the GeneralAssembly may, but need not, provide funds for the following mandates: (1) legislatively mandated requirements requested by the unit of local government affected; and (2) legislatively mandated requirements that became effective before the effective date of thisSection or State executive actions initially implementing legislation that became effective before theeffective date of this Section. (b) A mandated requirement that is not funded is not enforceable while not funded unless the billimplementing the mandated requirement passed with the concurrence of at least three-fifths of the members elected to each house of the General Assembly and specifically states that it is anon-reimbursable mandate under this subsection.

AMENDMENT NO. 1 . Amend Senate Bill 1 as follows: on page 3, immediately below line 21, by inserting the following: "For the purposes of this subsection (b), a meeting of the Senate does not include a perfunctorysession day as designated by the Senate under its rules."; and on page 3, line 22, by replacing "appointed" with "designated"; and on page 4, line 6, immediately after the period, by inserting the following: "No person who has been designated by the Governor to serve as an acting appointee to any office towhich appointment requires the advice and consent of the Senate shall, except at the Senate's request, bedesignated again as an acting appointee for that office at the same session of that Senate, subject to theprovisions of this Section."; and on page 4, lines 7, 19, and 22, by replacing "appointed" each time it appears with "designated"; and on page 4, line 17, immediately after the period, by inserting the following: "No person who has been designated by the Governor to serve as an acting appointee to any office to which appointment requires the advice and consent of the Senate shall, except at the Senate's request, bedesignated again as an acting appointee for that office at the same session of that Senate, subject to theprovisions of this Section. During the term of a General Assembly, the Governor may not designate a person to serve as anacting appointee to any office to which appointment requires the advice and consent of the Senate if thatperson's nomination to serve as the appointee for the same office was rejected by the Senate of the sameGeneral Assembly."; and on page 5, immediately below line 2, by inserting the following: "Section 10. The Civil Administrative Code of Illinois is amended by changing Section 5-605 as follows: (20 ILCS 5/5-605) (was 20 ILCS 5/12) Sec. 5-605. Appointment of officers. Each officer whose office is created by the Civil AdministrativeCode of Illinois or by any amendment to the Code shall be appointed by the Governor, by and with theadvice and consent of the Senate. In case of vacancies in those offices during the recess of the Senate,the Governor shall make a temporary appointment until the next meeting of the Senate, when theGovernor shall nominate some person to fill the office, and any person so nominated who is confirmed by the Senate shall hold office during the remainder of the term and until his or her successor isappointed and qualified. If the Senate is not in session at the time the Code or any amendments to theCode take effect, the Governor shall make a temporary appointment as in the case of a vacancy. During the absence or inability to act of the director of any department, or of the Secretary of HumanServices or the Secretary of Transportation, or in case of a vacancy in any such office until a successor is appointed and qualified, the Governor may designate some person as acting director or acting secretaryto execute the powers and discharge the duties vested by law in that director or secretary. During the term of a General Assembly, the Governor may not designate a person to serve as anacting director or secretary under this Section if that person's nomination to serve as the director orsecretary of that same Department was rejected by the Senate of the same General Assembly. This Section is subject to the provisions of subsection (c) of Section 3A-40 of the Illinois Governmental Ethics Act. (Source: P.A. 91-239, eff. 1-1-00.)". There being no further amendments, the foregoing Amendment No. 1 was ordered engrossed, and the bill, as amended, was ordered to a third reading.

AMENDMENT NO. 1 TO SENATE RESOLUTION 25 AMENDMENT NO. 1 . Amend Senate Resolution 25 on page 1, by replacing lines 2 through 4with the following: "BE IT RESOLVED, BY THE SENATE OF THE NINETY-SEVENTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that the Rules of the Senate of the 97th General Assembly are amended by changing Rule 10-2 as follows: (Senate Rule 10-2) 10-2. Appointment Messages. (a) Every nomination subject to the advice and consent of the Senate shall be submitted to the Senateby an Appointment Message from the appointing officer or appointing authority in accordance with thisRule, using the Appointment Message form provided in this Rule, containing all of the requiredinformation, and accompanied by a cover letter signed by the appointing officer or on behalf of theappointing authority. (b) All Appointment Messages shall be drafted by the Legislative Reference Bureau, according to theform provided in this Rule. (c) Appointment Messages submitted shall be assigned a sequential number by the Secretary of theSenate, indicating the order in which they were received and read into the Senate record by the Secretaryof the Senate at the direction of the Senate President. An Appointment Message is received by the Senatewhen it is read into the Senate record and assigned a sequential number. (d) An Appointment Message that does not conform to the requirements of this Rule shall, at thedirection of the Senate President, (i) be ruled non-compliant and of no legal effect and (ii) returned bythe Secretary of the Senate to the appointing officer or authority that filed it. (e) The appointing officer or authority may file in accordance with this Rule an Appointment Messagethat supersedes a previously filed Appointment Message. A superseding Appointment Message shall identify by sequential number the Appointment Message that it supersedes. The filing of a supersedingAppointment Message shall automatically table the Appointment Message that it supersedes, and thatsuperseded Appointment Message shall have no further legal effect. (f) Nothing in this Rule shall be construed to prohibit an appointing officer or authority fromwithdrawing in writing an Appointment Message that was previously submitted to or received by theSenate. An Appointment Message that has been withdrawn shall have no further legal effect. (g) An Appointment Message (i) shall be a committee-sponsored legislative measure that is unamendable and (ii) shall be controlled by the Chairperson of the Executive Appointments Committee,who for purposes of these Senate Rules shall be deemed the principal sponsor. In the absence of theChairperson, the Vice-Chairperson of the Executive Appointments Committee shall be deemed theprincipal sponsor. Messages may not have individual cosponsors. (h) Any Appointment Message pending when the Senate adjourns sine die (i) shall carry over into the next General Assembly and (ii) shall be considered to have been received by the Senate when originallyread into the Senate record as provided for in subsection (c) of this Rule. An Appointment Messagecarrying over into the next General Assembly shall retain the sequential number assigned whenoriginally read into the Senate record as provided for in subsection (c) of this Rule. (i) Notwithstanding the requirements contained in this Rule, any Appointment Message submitted tothe 96th General Assembly and not acted upon by the 96th General Assembly is deemed to be carriedover to the 97th General Assembly. The Senate may take action on any Appointment Message carried over from the Senate of the 96th General Assembly. Nothing in this Rule shall be construed to prohibitan appointing officer or authority from withdrawing in writing an Appointment Message that was
