The project proponents shall strictly adhere to the provisions of the CRZ notification of 1991 and its amendments issued by the Ministry of Environment and Forest, GOI, from time to time.

The project proponents shall obtain all necessary permissions from different Government Departments / agencies shall be obtained by the KPT before commencing the expansion activities.
Point Noted. NOC already granted by GPCB, GOG vide letter No. PC/NOC/CCA-Kutch – 78(2)/ GPCB ID 17832/14401 Dated : 13th, July, 2009. Further, GPCB vide letter no GPCB/CCA-Kutch- 1285/GPCB ID 46364/ dated 28/8/2016 had extended the validity period of NOC up to 5/08/2020.

The project proponent shall not handle any hazardous cargo or any classified chemicals at the site in question and this permission is valid only for the petroleum products and edible oils having no hazardous characteristics and as permissible in the CRZ notification, 1991, and its amendments issued from time to time.

4 No ground water shall be tapped to meet the water requirements during the construction and /or operation phases.

5 The Kandla Port Trust shall undertaken roof –top water harvesting in areas wherever it is feasible.

The project proponents shall contribute towards the cost of any common study that may be carried out for the KPT region for environmental protection and management issues.

The Kandla Port Trust shall duly incorporate the above-mentioned activities and update its Diaster Management Plan at the earliest and submit a copy to this Department.

8 The project proponents shall implement all the suggestion/ recommendations given by the NIOT in their Rapid EIA report.

The project proponents shall strictly comply with all the conditions stipulated by the Gujarat Pollution Control Board in its Consent to Establish (NOC) and the CCA.

The project proponents shall bear the cost of the external agency that may be appointed by this Department for supervision / monitoring of proposed activities and the environmental impacts of the proposed activities.

The project proponents shall take up mangrove plantation in an area of 50 ha. As well as green belt development activities in consultation with the Gujarat Institute of Desert Ecology/Forest Department.

General Conditions

The construction camps shall be located outside the CRZ area and the construction labour shall be provided with the necessary amenities, including sanitation, water supply and fuel and it shall be ensured that the environmental conditions are not deteriorated by the construction labours.

The KPT shall have to contribute financially for talking up the socio-economic upliftment activities in this region in construction with the Forest and Environment Department and the District Collector / District Development Officer.
CSR Work is already attending by KPT. Copy of CSR activities for the year 2014 – 2015 placed at Annexure I. However, Adequate Measures shall be taken by successful plot allottee.

A separate budget shall be earmarked for environmental management and socioeconomic activities and details there of shall be furnished to this Department as well as the MoEF, GOI. The details with respect to the expenditure from this budget head shall also be furnished.
A separate account for environmental protection has been maintained by Kandla Port Trust. Kandla Port has kept Rs.50.00 Lakhs in B.E. 2015 – 2016 and RBE Rs. 1.90 Crore for the year 2016 – 2017 under the scheme of “General Environment Management Programme” and approximate expenditure incurred till date is Rs.30.5 Lakhs. However, Adequate Measures shall be taken by successful plot allottee.

A separate environmental management cell with qualified personnel shall be created for environmental monitoring and management during construction and operational phases of the project.
KPT already having EMC constituted vide office order EG/WK/4660(EMC)/2010/270 dated 12/01/2011. Further, Kandla Port has also strengthening the Environmental cell by appointing two Environmental Experts and one Legal Person from M/s Precitech Laboratories Pvt. Ltd. They
are permanently stationed at Kandla Port. However, Adequate Measures shall be taken by successful plot allottee.

An Environmental reports indicating the changes, if any, with respect to the baseline environmental quality in the coastal and marine environment shall be submitted every year by the KPT to this Department as well as to the MoEF, GOI.

A six monthly reports on compliance of the conditions mentioned in this letter shall have to be furnished by the KPT on regular basis to this department/MoEF, GOI.

Following projects for up-grading/creating certain facilities under CSR activities have been identified with the total expenditure of Rs 236.22 lakhs for the year 2014 – 2015.
