What has been done… Conducted Information and Education Campaign on

R.A. No. 10586, nationwide.

Conducted the First LTO Deputized Agents Orientation Seminar ForThe Enforcement of R.A. No. 10586 on June 18, 2014 with 100participants from LTO, PNP, MMDA and Tollways (NLEX, SCTEX,TPLEX, Cavitex and Skyway).

Conducted the Second LTO Deputized Agents Orientation SeminarWorkshop For the Enforcement of Anti Drunk Driving Campaign underR.A. No. 10586 from March 10, 11 and 12, 2015 with 130 participantsfrom LTO (Central Office and Regional Offices), PNP, MMDA and theTollways (NLEX, SCTEX, TPLEX, Cavitex and Skyway) .

Conducted two (2) LTO Deputation series of Seminars for MMDAConstables for the Enforcement of R.A. 10586.

What has been done… Conducted a series of Deputies’ Training Seminar on R.A.

No. 10586 in the LTO Regional Offices.

Distributed a total of 150 Alcohol Breath Analyzer (ABA)equipment to LTO Central Office and LTO Regional Officesnationwide.

Bidding of additional 300 units of Alcohol Breath Analyzersfor the year 2017.

Conducted roadside Anti-Drunk Driving Campaign andOperation.

Inclusion of the topic relative to R.A. No. 10586 on seminarsand written examinations for driver’s license applicants.

Coordinated with Regional Police Offices for the deputationof their Traffic Police Officers as well as to discuss eachagency ’ s role in observing the proper procedure forapprehension.

Conducted the LTO Deputized Agents Re-OrientationSeminar Workshop For the Enforcement of Anti DrunkDriving Campaign under R.A. No. 10586 from February 10,11 and 12, 2016 with 100 participants from LTO (CentralOffice and Regional Offices), PNP, MMDA and the Tollways(NLEX, SCTEX, TPLEX, Cavitex and Skyway) .

Inclusion of topic relative to R.A. No. 10586 on the TrafficSafety Management Seminars for Drivers being conductedby LTO nationwide.

What is being done… Continuing Information and Education Campaign on R.A.

No. 10586 nationwide.

Continuing driver’s education and awareness on R.A.10586.

Cascade region wide the LTO Regional Deputized AgentsOrientation Seminar Workshop For the Enforcement of AntiDrunk Driving Campaign under R.A. No. 10586 to LTO,PNP and LGU’s.

Continuing conduct of roadside Anti-Drunk DrivingCampaign and Operation for the enforcement of the lawnationwide and distribution of flyers on R.A. 10586.

Ongoing coordination with Regional Police Offices for thedeputation of their Traffic Police Officers as well as todiscuss each agency ’ s role in observing the properprocedure for apprehension.

Continuing study on the implementation andenforcement of R.A. No. 10586 through possibleamendments of some provisions of it’s IRR.

Roadblocks to Implementation Lack of legal assistance to LEOs in case of prosecution

due to harassment from apprehended motorists.

Absence of hazard pay and night differential for LEOs.

Vulnerability of LEOs to risk and life threateningsituations because of night to dawn operations.

Behavioral factors on the part of the LEOs who arevulnerable to harassment due to difficulty inprosecuting violators due to perceived loopholes in theImplementing Rules and Regulations (IRR).

Behavioral factors on the part of the motorists thatbecomes the principal cause of road crashesattributed to drunk driving.

Attitude problem of the motorists. They do notfollow the law, rules and regulations or eventaking for granted their own safety.

High percentage of failures ranging from 50% to70% relative to the written exams given to MMDAConstables.

Dismissal of cases filed against arrested drivers incourt due to failure of LEOs to follow the DUIAProtocol.

Enforcers end up being blamed for failureto strictly follow the DUIA Protocol.

Personnel turn-over on the part of thePNP. Personnel who were trained on theprovisions of R.A. No. 10586 are transferredto other unit as matter of policy. Newpersonnel usually do not understand therequirement of the law.

• Difficulty in enforcing the drug-driving aspect of R.A. 10586 due to lack of qualified Drug Recognition Experts/Evaluators (DRE) as well as the absence of a comprehensive Drug Recognition Protocol (DRP).

• There is an urgent need to conduct a Trainor’s Training for Drug Recognition Experts/Evaluators.

What needs to be done? The Philippine National Police (PNP) and

Department of Interior and Local Government(DILG) should provide a program for thecontinuous deputation of their personnel and theprocurement of equipments (ABA) to support theimplementation of R.A. No. 10586.

The Department of Justice should assign andidentify the prosecutors who shall handle cases ofR.A. No. 10586 nationwide.

Sustain monitoring, implementation andenforcement of the law and conduct acomprehensive review of the IRR for provisions thatmay need amendments.

What needs to be done?…(cont.)

Coordinate closely with the Dangerous Drug Board forinformation dissemination to drivers of motor vehiclesthrough posters and stickers.

Conclude and sign MOA with the Department of Health(DOH) for assistance in the conduct of random drug tests inthe bus terminals specially the protocol to be followed forthe drug test and the conduct of the Confirmatory Tests forthose who tested positive in the initial drug test. Follow up the Road Board’s commitment to provide fundsfor training of PNP personnel nationwide. Conduct regular Re-Orientation seminars to LEOsnationwide.

The Public Attorney’s Office (PAO) and the Office ofthe Solicitor General (OSG) to provide legalassistance to LEOs in case of prosecution arising fromthe enforcement of the R.A. No. 10586.

Continuing drivers education and road user ’ sawareness on the provisions, importance and benefitsof R.A. No. 10586 and its impact of road safety inwhich enforcement will be supported.

Conduct training of Drug RecognitionExperts/Evaluators with the assistance of the DOH.

Prepare a comprehensive and implementable DrugRecognition Protocol (DRP) for the conduct of thedrug test.
