Community meeting regarding BAAQMD "air quality permit application" and Draft Environmental Impact Report (DEIR) (under CEQA) held Feb. 13, 2008. Once the Final EIR is issued, a 30-day statute of limitations runs on court challenges. While it appears that the construction permit application has been filed with the BAAQMD, it does not appear that a draft permit has yet issued.

This project entails a hydrogen plant replacement, a new power plant replacement, a reformer replacement, and hydrogen purity improvements. This expansion would “allow the refinery to use a wider range of crude oils." See http://www.ci.richmond.ca.us/index.asp?NID=832. It is unclear whether this "wider range" includes tar sand crude.

Expansions: Coker and Refinery Expansion ("CORE") Project (Tar Sand) AND Ultra Low Sulfur Diesel ("ULSD") Project.

The "CORE" Project is the major expansion, and that PSD permit was issued to ConocoPhillips on July 19, 2007 - Comment period expired. The "ULSD" Project is a smaller project, and that construction permit (not triggering NSR) was issued to WRB Refining, LLC on June 11, 2007 - Comment period expired. Environmental groups (the Environmental Integrity Project, on behalf of the Sierra Club; and the Natural Resources Defense Council, on behalf of the American Bottom Conservancy) filed a petition for review of the CORE permit with the U.S. EPA's Environmental Appeals Board (EAB) on Aug. 21, 2007. That case is currently pending before the EAB.

$4 billion expansion to increase total production capacity and to devote almost all new and existing capacity to tar sand crude. Together with ConocoPhillips' refinery in Borger, Texas, the company plans to increase total capacity from 450,000 bpd to 600,000 bpd, and increase processing of tar sand oil from 60,000 bpd to 555,000 bpd (that is, almost all of the two refineries' capacity will be devoted to tar sand oil). Thus, this expansion seeks to increase total production capacity of the two refineries by one third, and increase tar sands oil processing capacity by 817%. Final construction permit issued Feb. 26, 2008 - Comment period expired. 30-day deadline to appeal to the EAB, pursuant to 40 C.F.R. 124.19, was March 27, 2008. Construction must begin by Aug. 26, 2009, or else ExxonMobile must re-apply.

The "Crude / Coker Utilization Project" (CCUP) will increase throughput (although not capacity), resulting in "significant" increases of NOx, CO, PM, and PM10 (serving as a surrogate for PM2.5), for purposes of PSD review. However, IEPA found that no the project units contributing to the increases did not undergo a "physical or operational change," and so were not subject BACT or LAER. Although the purpose of the expansion remains unclear, the geographic location suggests that this is a tar sands expansion.

$3.8 billion expansion to increase processing of Canadian tar sands from 30% of feedstock to 80-90%. The draft permits are for "significant source modification" (the "construction permit," netting out of NSR) and "significant permit modification" (Title V "operating permit").

Further, In Montana, in addition to the 60 days following the EPA's 45-day review period to petition for veto, people can appeal the final permit to the Montana Board of Environmental Review within 30 days of the State's "decision on the permit" (which decision generally coincides with the end of the EPA's 45-day review period. So, assuming the proposed permit was issued April 9, 2008, then the end of EPA's 45-day review would be May 24, 2008; deadline for state administrative appeal would be on or about June 23, 2008; and deadline to file "veto petition" with U.S. EPA would be on or about July 23, 2008.

The Title V pemit for the "refinery" (# OP1564-02) includes all changes since the issueance of Permit # OP1564-01 on July 20, 2004. The Title V permit for the "terminal" (# OP2967-00) is a NEW Title V permit. Although both the "refinery" and "terminal" permits (and their TRDs) state that the "refinery" and "terminal" are a "single source" for NSR purposes, the "refinery's" Tilte V permit says that "[a]t the request of the company, the bulk terminal will be permitted separately under the Tilte V operating permit program ." (See OP1564-02, page 1 (emphasis added)). Although the "terminal" was issued a “synthetic minor” permit on May 3, 1998, “[f]ollowing further evaluation … the Department determined ... [that] [a]s a support facility to a major source, ExxonMobil is required to obtain a Title V Operating Permit [for the terminal].” OP2967-00, TRD page 3. Thus, it remains unclear why the "terminal" is being permitted "separately" from the "refinery" under CAA Title V . The geographic location of this refinery suggests that it may deal with tar sand

However, a search of the website, along with numerous telephone conversations with ODEQ personell, suggests the following deadlines (anyone submitting comments should independently verify): PSD Permit (# 2007-005-C (M-1)): Comment period ended Mar. 2, 2008. (But it may still be possible to submit comments at http://www.deq.state.ok.us/permitspublic/comment.aspx?key=1146). As of Mar. 26, 2008, the PSD permit was still "pending ODEQ internal review," so had not yet issued. So, the construction-commencement deadline will be 18 months from whenever the final permit is issued. Title V Permit (# 2007-005-TVR) : Issued (approx.) Feb. 21, 2008. EPA 45-day review ended approx. Feb. 11, 2008, so 60-day "Veto Petition" window ends approx. April 11, 2008.

This is an enormous tar sands expansion, known as the "Heavy Crude Processing Expansion (HCPE) project." The project entails a $1 billion expenditure to increase capacity from the refinery's current 70,300 bpd to 115,000 bpd (a 64% expansion) to handle tar sand crude.
