Report of the committee constituted by Director General Town & Country Planning, Haryana vide order dated 16‐
08‐2016 in compliance of orders dated 23‐07‐2016 passed by Hon’ble Arbitrator Mr. Justice Sh. Vikramajit Sen,
Former Judge of Supreme Court in the matter of Okhla Enclave Plot Holders Welfare Association and others Vs.
Union of India and others.
The Hon’ble Supreme Court of India in the above referred cases has appointed Hon’ble Mr. Justice Sh. Vikramajit Sen,
Former Judge of Supreme Court as Arbitrator to resolve the disputes between the parties vide order dated 27‐01‐
2016. The Hon’ble Arbitrator vide procedural order no. 7 dated 23‐07‐2016 passed interalia orders and the
operative part of the said procedural order in para no. 2 is reproduced as under:‐
“After much deliberation, it has been further decided that to undertake allotment, it is imperative that a list of
eligible allottees is first drawn up as it appears that in a lot of cases, multiple sale deeds or agreements have been
wrongfully and illegally executed on the basis of a single allotment. In such circumstances, it has been agreed that the
Director General Town Country Planning (DGTCP) along with a representative from the Builder and a representative

from the concerned Associations will invite representations/applications alongwith the allotment documents from
all the claimants/ allottees and will examine and scrutinize these applications, as per all the existing rules and
guidelines, to identify genuine allottees and prune out the cases of wrongful/ multiple allotments.....”
In compliance of the orders of Hon’ble Arbitrator a committee was constituted by Director General, Town & country
Planning, Haryana vide order dated 18‐06‐2016 consisting :‐

during the scrutiny process.
The Hon’ble Arbitrator in the order no. 5 dated 7‐05‐2016 has set the following conditions to determine
entitlement of each plot holder.
Plot holders should have made bookings along with entire payment towards cost of land prior to 07.04.1997.
Further, such plot holders should have paid/deposited the entire development charges with the Haryana
Government upto 31.12.1999, in terms of Hon’ble Supreme Court order dated 02.12.1999.
The plot holder who have made bookings along with the entire payment towards cost of land prior to
07.04.1997, but had not made payments towards the Development charges in terms of Supreme Court order
dated 02.12.1999, can be considered provided they are willing to pay the Development charges as would be
required on the date of carrying out the actual development…

The multiplicity and duplicity of claims i.e. more than one claim from one family, will not be considered as
eligible. Further, if any person is already in occupation of a plot illegally or by encroachment, he will similarly not
be considered for any further allotment.
In the procedural order dated 23‐07‐2016 it was directed that the said exercise for deciding eligible allottee will
be started with the NPNL category. Director General, Town & Country Planning, Haryana in compliance of the
orders issued public notice on 18‐08‐2016 in news paper dated 18‐08‐2016 inviting applications to file the
claims accompanying with supporting documents regarding allotment/ booking of plot in “No Profit No
Loss” category ( hereafter referred as NPNL) in the office of Senior Town Planner, Sector ‐12, Faridabad upto 16‐
09‐2016. After receiving applications first meeting of the committee was held on 27‐10‐2016 alongwith Dr.
Monika Gusain, Standing Council on behalf of Government of Haryana, District Town Planner, Faridabad,
advocate of the concerned associations, representative of plot holders associations. In the meeting it was
decided that all association will prepare draft format covering maximum information related to booking

/allotment of plots. The committee decided that the format should be simple with more details so that record
of claimants can be maintained regarding payments made for booking of plot, development charge, date/ year
wise payments made to the developer/department, details of plot size / changes in the plot no./size if any, land
cost per sqyd., bifurcation of land cost/ development charge paid time to time or in one go, details of allotment
of plot, detail of Builder Buyer Agreement, details of sale deed, approval of building plans and any specific
details produced by claimants. The scrutiny of documents was initiated on 21‐10‐2016, but the representative on
behalf of the builder objected that until and unless copy of record received from claimants is provided to
them, the verification should not be commenced. It was pointed out to them that except details of claimants
received from associations, the documents of individuals were collected by their staff only in the office of
STP/DTP and they were also asked to submit the original record in STP office within two days after making
necessary copies as per their requirement and at least these cases can be put up for verification by next date
of hearing.
The format was finalized by the committee on 6‐11‐2016 and the scrutiny of documents was initiated on 7‐11‐2016.
During the first day of scrutiny representative of developer had pointed out that as per the direction of Hon’ble

Arbitrator, copies of documents received from claimant be provided first so that it can be examined by them. Since
it was going to take lot of time, therefore the representative of the builder was advised the same in the office STP so
that process of scrutiny of applications received by his staff in the office of Senior Town Planner / District Town
Planner Faridabad can be initiated to avoid delay and subsequently the representative of coloniser can take
photocopy of the applications/ documents received from claimants. For the above said reason scrutiny process
actualy commenced on 21‐11‐2016. Initially average 30 cases were taken up for scrutiny per sitting which was
increased to average 40 per day keeping in view the no. of claims to be heard and also the meeting days were
increased from thrice a week to five days a week keeping in view the volume of work.
Although the claimant appearing before the committee were advised that what sort of documents they
should produce and what should not be produced before the committee for the verification/scrutiny of documents.
But it was observed that most of the claimants came with all the correspondences made with the coloniser and it
took more time to scrutinize the claims inspite of all necessary help by the member of the committee to individual
claimant. During the scrutiny it was observed that in most of the cases plots were transferred from one allottee to
another after taking transfer charges by the developer and there was possibility / chance that receipts in two names

for one plot can be reproduced by the other claimants therefore, after third day of scrutiny it was decided that the
original payment receipts should be stamped so that it cannot be reproduced by any other claimants.
The committee also observed that in many cases GPA or SPA holder have applied directly for allotment of plot
under their name without executing sale‐deed in their favour by the original allottee therefore the name of the
original allottee was taken up only while referring name of GPA or SPA holder to know that how many application
have been received through GPA/SPA. It is also observed in some cases that the owner of plot have executed will or
agreement to sale in their favour. The application submitted by GPA/ SPA holder in their own name have been
considered by the committee since they had authority to represent their case.
Before starting the process of verification of original documents, the committee observed that as per
department policy on No Profit No Loss ( hereafter referred as NPNL) 25% of total no. of residential plots of
sizes 125 sqmts. to 225 sqmts, or otherwise approved specifically in the layout plan by Director Town and
Country Planning are kept under NPNL category plots. But in this particular case on the direction of Hon’ble
Punjab and Haryana High court in CWP no. 3311 of 2001 the DGTCP, Haryana decided that the plots upto the

size of 263 sqyd. allotted to petitioners falls under NPNL category. Therefore the committee considered all the
plots below this size as NPNL category plot. The Hon’ble Tribunal in procedural order no. 5 dated 7‐05‐2016 has
directed that plot holder who had made booking alongwith the entire payment towards cost of land prior to 7‐
04‐1997 and further have paid/deposited the entire development charges with the Haryana Government upto
31‐12‐1999 in terms of Hon’ble Supreme Court order dated 2‐12‐1999 be considered for entitlement as
genuine plot holders.
As far as payment of land cost prior to 7‐04‐1997 is concerned, in most of the cases the developer had
sold out plot @ 50, 65 (in SPL cases) 80, 90, 100, 110, 120, 130, 150, 180, 200 225, 250 etc. and in such cases the
calculation for payment of land cost was very clear but there were cases where the plot holders made entire
payment on same date of booking without mentioning rate of land cost per sqyd., in such cases the land cost
has been calculated after deducting the payment made against development charge @550 per sqyd. In some
cases claimants also produced consolidated receipts of payment made earlier and had not mentioned rate of
land in it, the same approach has been adopted in those cases also.

Regarding development charges as mentioned @ 550 in above para, it was discussed in detailed by the
committee before scrutiny of the claims and referred the rulings of the Hon’ble Apex Court in matter Writ
Petition (C) nos. 477, 792 & 876 of 1996 and Punjab and Haryana High Court in CWP no. 3311 of 2001. The
Hon’ble Apex Court observed that who has paid a sum of 550 (over that above the originally agreed cost of land)
would be considered as proper payment if paid on or before 15‐09‐1995.
The Hon’ble Arbitrator in procedural order dated 7‐05‐2016 had categorically defined that such plot holder who
had paid/ deposited the entire development charge with Haryana Government upto 31‐12‐1999 in terms of
Hon’ble Supreme Court order dated 2‐12‐1999 be considered as genuine plot holder. In the order dated 2‐12‐
1999 it was directed that each allottee to pay a sum of 50 per sqyd within 4 weeks i.e. over and above 550. It is
submitted here that the rate considered as 550 was on the basis of rate considered with the association by
developer through memorandum of under standing. The Hon’ble Supreme Court had also considered 550 +50
as tentative rate of development charge on 10‐03‐2003 in contempt petition no. 477 in WP no. 477 / 1996
wherein 600 was fixed by the Hon’ble Apex Court. It is pertinent to mention here that some of claimants
produced photo copy of draft payable to DTCP, Haryana and the same were returned back by the department

since they were not party in the Writ Petition. The representative of association also pointed out during the
scrutiny that copy of such demand drafts produced by their members before the committee may not be
considered in respect of amount paid towards development charges. The representative of association produced
a copy of public notice dated 11‐01‐2000 published in times of India wherein it was clearly stated that the order
dated 25‐05‐1999 and 21‐07‐1999 of DGTCP Haryana are only applicable to such person who have filed writ
petition 113, 477, 876 and 792 of 1996 in the Hon’ble Supreme Court of India. In view above the committee
decided that amount of @ 550 be taken as development charge for scrutiny of claims.
Regarding multiplicity and duplicity of claims, the matter was discussed by the committee and it is was
observed that some claimants have purchased more than one plot from the developer in one’s own
name or in name of his or her spouse after making necessary land cost / development charge to
developer in prescribed time, in such cases single claim may be considered. It is also decided by the
committee that one who has purchased plots in resale from genuine/original allottee (who booked the
plot with the developer and paid part or full land cost/development charge) is also not considered
under multiplicity.

Regarding the cut off date to deposit land cost/ development charge, it was strictly considered except in cases
where land cost and development charges are deposited before cut off date with the coloniser/ department as
per booking/allotment of plot size but at the time of executing sale deed due to minor variation in the size of
plot at the time of registration (particularly 492 petitioner before Supreme Court), the developer had taken
the balance land cost / development charge for additional area.
During the scrutiny it was observed that at the initial stage of booking of plot and thereafter the developer
transferred the plot to some other person and the claimant produced old and new receipts for the same plots
under different name therefore on the third day of scrutiny it was decided that all original receipts be stamped
on it so that it cannot be reproduced before the committee.
In number of cases claimants have booked plot by making payment on the same day and such receipts
neither have any details regarding rate of land cost per sqyd nor development charges. In such cases the
committee considered 550 per sqyd. as development charge and the rest amount is taken as cost of land. The
committee further observed that except where relaxation are given to employee of the company by the

builder, plots are sold at the rate of 80, 90 , 100 , 120 , 150 180 , 200 and 250, therefore in cases where BBA is
executed, cost of land is considered at any of the rate mentioned above.
The committee also observed that there is difference in total amount paid by the claimant, the amount
mentioned in BBA and sale deed. It is tendency in general that people execute sale deed at the collector rate
where as in reality the rate of purchase is on higher side therefore in such cases where land cost / development
charge is found less than the actual amount paid, in those case the highest value either mentioned in payment
receipt, sale deed or BBA (builder buyer agreement) has been considered for calculating land cost /
development charge. In cases where the land value and development charge is met out with any of the
minimum amount mentioned above then it has been considered.
It is also observed that in no. of cases the claimant booked a plot of specific size and paid land cost/
development charge as per booking but in no. of cases the developer after receipt of land cost/ development
charge increased the size of plot and in such cases the amount paid towards original size of booking has been
considered if not paid for increased size of plot except where BBA/sale deed is executed. This issue had been

raised before the Hon’ble Arbitrator on the hearing dated 4‐08‐2017 and it was verbally directed to consider
the plot size at the time of original booking if not paid for increased size.
Some claimants informed that they were party (492 petitioners) in the writ petition before the Hon’ble
Supreme Court but could not produced any document/receipt to prove whether they paid the land
cost/development charge before the cut off date. They also informed that they got executed sale deed of plot in
compliance of the orders of Hon’ble Apex Court and are genuine plot holder. The committee observed that most
of the sale deed executed by developer directly after cut off date and have wrongly mentioned that the sale
deed has been executed in compliance of Hon’ble Supreme Court orders, irrespective of fact that a number of
registry have been executed directly who were not petitioner. Further the representative of associations were
requested to provide the copy of certified caust title/list of petitioners but complete list could not be provided.
The committee has verified document produced by claimants on the basis of original document and in case
if claimants produced photocopy of one or more document misplaced it was considered. Some claimants lodged
FIR recently during 2016‐2017 or quite before the scrutiny date, but could not produced copy of said misplaced

document or produced any relevant document with regard to such receipts/ documents, the same was not
considered by committee. The developer in such case was asked to verify the amount paid to him or not but the
same was denied by representative of developer. It is also observed that the developer only after charging the
due amount against land cost has taken development charges in such cases the deficit land cost has been
adjusted from the total amount paid. However, the representative member of associations requested that any
deficiency of report/documents may be allowed for rectification in the report within stipulated time if permitted
by the Hon’ble Arbitrator.
In number of cases claimant paid statuary charges @10 per sqyd., to the developer over and above the land
cost/ development charges. This amount was not considered in land cost/ development charge except
mentioning the same in total amount made by claimant against statutory charge. In some cases claimants have
paid registration charge to builder which was not considered except mentioning the same. Also the payment
made against plot transfer charges is also not considered.

Committee observed in number of case a residential plot along with commercial space was booked by
claimant and in such cases where the claimant informed that after few instalments against shop and residential
he has paid residential only and no more interested in commercial then the total amount paid as land cost is
adjusted towards residential plot only. In some case it was observed that claimant through same receipts paid
cost of residential plot as well as commercial space in such cases after considering the amount for residential,
the excess amount is considered as payment made for commercial space booked by the claimant.
In some cases it has been observed that claimant does not have some payment receipts with him but in BBA or
registry the total amount has been shown more than payment made by the claimants in such cases the amount
mentioned either in registry or BBA has been considered for calculating payment made towards land cost /
development charge. In some case the claimant requested to refund the booking amount/ development
charges and against those requests developer issued a separate receipt mentioning that all the original payment
receipts mentioning their total nos./amount have been taken back, in those cases whether the developer
refunded back money or not was not clear but the claimant produced some correspondence for not considering
there cancellation request and produced original single receipts. It was pointed out by the representative of

associations that where claimants have taken back amount paid, in those cases the original receipt was taken
back by the coloniser. The committee considered such cases with single original receipt for purpose of scrutiny.
It most cases after payment of land cost / development charge, possession letter have been issued by
developer. In this regard, it is submitted that except in cases of 492 plots decided by the Hon’ble Apex Court, no
demarcation/ zoning plan has approved by the competent authority, therefore the possession letter issued by
the developer without approval of demarcation plan is not considerable. There were some other minor issues
came before the committee during scrutiny and the same were sorted out amicably. The Survey report being
prepared by D.T.P Faridabad and developer will be placed before the Hon’ble Arbitrator shortly.
Multiplicity/duplicity of ownership has been highlighted in the enclosed list at Annexure I to IV.
As per the approved layout plan of the Okhla Enclave Sec‐91. There are 2926 Plots of General category,
NPNL & EWS. The details of plot as per approved layout plan/partially approved zoning plan are as under:‐

The committee received 2690 applications for the purpose of scrutiny before the cut off date. However, 523
applicants do not appear before the committee for the purpose of scrutiny. After scrutiny of the applications, the
committee found total 1932 nos. of NPNL category claimants, 73 nos. of general category applicants, 165 nos. of
commercial category applicants & 2 nos. of EWS category applicants.
In compliance of the orders of Hon’ble Arbitrator the NPNL category applicants are further categorized in
following categories on the basis of payment made by them against land cost charges and development charges
or the documents produced by them which are categorized as under :‐
i) The claimants who have paid full land cost/ development charges before cut off date have been kept
in First List which is enclosed as Annexure‐ I (Page. No. 1‐301)
ii) The claimants who have paid full land cost and part development charges before cut off date have
been kept in Second List which is enclosed as Annexure‐ II (Page. No. 301 A to 415)

iii) The claimants who have paid full land cost only and no development charges have been paid are kept
