PURPOSE:

This “after-the-fact” engineering report is intended for the examination of the content of a traffic

engineering study prepared and submitted the City of Willis “Citizen Advisory Committee” in

October 2009. It is further intended that the examination determine that the traffic engineering

study (1) meets acceptable engineering standards and (2) conforms to the criteria established in

Texas Transportation Code, Chapter 707.003 (c) and (d).

HISTORY:

America Traffic Solutions, Inc.; an Arizona based provider of automated traffic enforcement

systems; conducted a “Site Evaluation Report” in April 2009 for 3 intersections in the City of

Willis, Texas. The report examined the constructability for red light running cameras on all

approached at the 3 intersections; and collected field incidents of red light running violations

using Violation Incident Monitoring System (VIMS). The intersection were:

IH-45 (SB & NB) at FM 1097/W Montgomery Street

FM 1097/W Montgomery Street at TX 75/Danville Street

TX 75/Danville Street at FM 2432/E Powell Street

The report concluded that a total of 3 approaches at 2 intersections meet the warrants for the

installation of red light running cameras due to significant number of red light running

violations. This report was compiled by Mr. Jerry Minor, Program Manager; with American

Traffic Solutions. The report was not signed & sealed by a Texas registered professional

engineer.

Later in January of 2009, City staff conducted a crash analysis for the recent 18 month period

and summarized the results at 4 intersections which included the intersections 3 intersections

examined by field studies by American traffic Solutions with the addition of FM 1097/ W

Montgomery Street at Campbell Street. City staff further summarized the total of number of

citations issued for the recent 18 month period for the intersections. The crash and citation data

are summarized in a Memorandum dated January 12, 2009; from Chief Novak to a Mr.

McAlister. This memorandum does not indicate if a Texas registered professional engineer

compiled the data and it is not signed or sealed by a professional engineer. A copy of the entire

report submitted to the “Citizen Advisory Committee” s is included in the appendix of this

report.

Records indicated that City of Willis authorized American Traffic Solutions to construct 3 red

light running camera which were placed into operation in February 2010 at the following

locations:

EB FM 1097/W Montgomery Street at IH-45 South Service Road (west side)

EB FM 1097/W Montgomery Street at TX 75/Danville Street

NB TX 75/Danville Street at FM 1097/W Montgomery Street

These installations are consistent with the recommendation by the “Site Evaluation Report”

which found substantial number of red light running violations at the 3 approaches.

ENGINEERING CRITERIA:

Texas Transportation Code, Chapter 707.003 (c) requires that before the installation of a red light

running camera, the local authority to conduct a traffic engineering study to determine the

installation is warranted. The Code also requires that the study examines other design changes to

reduce red light running incidents in addition to installation of red light running cameras.

Chapter 707.003 (d) further requires that an intersection approach must be selected based on

traffic volume, crash history of the approach, and the frequency of red light running violations

for the approach.

It is important to note that the codes above do not establish a minimum criteria for the

justification of the installation of the red light cameras. The decision is generally left to the

discretion of a competent professional engineer which will consider all applicable engineering

elements. However, justification for the installation of the red light running cameras are

universally based on the traffic safety implications where incidents of red light running often

result in severe angle type crashes that cause injuries or fatalities.

Hard evidence established through a crash analysis is often used in the decision matrix for the

installation of red light running counter-measures. However, this criteria alone cannot be used to

warrant installation. An intersection approach can often exhibit significant red light running

without a history of correctable crashes. Nevertheless, the conditions create potential for severe

crashes, cause significant driver distress, and consumes considerable public resources for

monitoring and enforcement. Red light running violations are taught to be indicators of the

potential for severe crashes. Therefore, measurement of the actual observed violations is a

critical element of the study.

There are many other red light running counter-measures that can be incrementally deployed to

reduce the rate of red light running violations. They include improving signal visibility, installing

advance warning signs to increase the likelihood of stopping, addressing intentional violations,

consistent enforcement, etc.

Texas Department of Transportation later in 2010 adopted a standard study templet that

considers the safety criteria as well as visibility and field conditions amongst other elements.

ANALYSIS:

Examination of the report submitted to the “Citizen Advisory Board” indicates that all required

elements set forth by the Texas Transportation Codes were generally followed. Below are the

significant findings:

Report provides a field constructability review and recommends “constructible”

approaches for further field data collection.

Field violation data collection includes intersection/approach, time period, signal

operation, and number of violations. All data appear to be correct and complete.

Report provides analysis of the collected data and provides recommendation for

candidate locations for installations based on the significance of the violation rates.

Site Evaluation Report does not contain data for intersection of US 1097 at Campbell that

listed on the crash summary and summary of citations.

Crash data are provided for the recent 18 month period consistent with the Texas

Transportation Code requirements. Crash data are summarized by intersection and by

total number and type of crash. However, crash data is not broken down by approach as

intended to further isolate approaches with correctable crash history.

Citations issued are summarized by intersection and total of red light running per

intersection, for 18 month period consistent with Texas Transportation Code

requirements. However, the summary does not further break down the data by

intersection approach to isolate the intersection approach with significant problem.

Report does not provide information on condition of signals, signs, and markings; and

does not discuss any previous incremental counter-measures deployed at the

intersections. However, this was not an explicit requirement of the Texas Transportation

Codes.

Report does indicate limited enforcement capability and resources to address red light

running issues in Willis, Texas. This is a critical element when addressing red light

running violation without use of automated systems.

Report indicates support by local law enforcement for deployment of red light cameras.

Site Evaluation Report clearly recommends 3 approaches for installation based on field

observations which were later installed and placed in operation in February 2010.

Report appears to have been prepared by competent individuals in general conformance

with the Texas Transportation Code. However, it is not signed & sealed by a Texas

registered professional engineer.

CONCLUSIONS & RECOMMENDATIONS:

The report submitted to the “Citizen Advisory Committee” generally meets the intent of the

Texas Transportation Codes in which (1) a traffic engineering study was prepared prior to the

installation of the red light running, and (2) traffic engineering data including crash history and

the frequency of the red light running events; were examined prior approval and installation.

The report contains those critical elements and data that is used by professional traffic engineers

to determine the warrants for the installation of red light running cameras. Furthermore, the

approval to proceed with the installation of the red light running cameras were based on the data

and the analysis in the report.

The report does address the condition and adequacy of the signals, signs, and markings; and

consideration for other incremental counter-measures. However, those elements generally take a

longer period of time to implement by public agencies and may not necessarily be effective in

curtailing the red light running violations.

In final conclusion, in my opinion as a professional traffic engineer, the content of the study

generally supports the installation of the red light running cameras at the selected locations.

SUBJECT: Red Light Photographic Enforcement Systems

If you may recall, we discussed previously that the police department had noticed an increase in the number of traffic crashes following three years of declines. We know that traffic flow through the city increases annually, that road construction may have had an impact on the decrease of accidents during part of that three year period, and STEP Wave enforcement periods were relatively new to the citizens.

Although most crashes in Willis are caused by failure to yield right-of-way, following too closely, and failure to control speed, running red lights does contribute to a significant number of crashes. Over 31% of the crashes at intersections in Willis that are controlled by traffic signals were caused by a driver running a red light. The results of a review of 18 months of accident data at intersections controlled by a traffic signal are shown in Table A below. The results of an analysis of 18 months of citation data for those intersections where a citation was issued for the charge of running a red light are shown below in Table B.

Photographic enforcement systems have been used for several years to supplement the efforts of police officers enforcing the law against running red lights by providing constant monitoring and surveillance of problem intersections. Clearly, not every intersection possesses the characteristics that make red light running prevalent, or as dangerous, as other intersections. Moreover, the police cannot be on station constantly just to deter or catch violators who may comply when police are present, but run the light if they think they can get away with it, thus endangering other people and eroding the respect for the law that helps sustain voluntary compliance and orderly traffic flow.

Research of some intersections in some cities and countries has revealed that photographic enforcement had a positive effect on reducing red light running, but led to an increase in rear end collisions. Although less likely to be as dangerous as angular collisions, it is still a collision which interferes with smooth traffic flow, and creates an incident to which the police must respond. Many critics of these kinds of systems often use such data to argue against the implementation of such systems. There is data to indicate that these systems have a spillover effect that increases compliance with traffic laws at untreated intersections as well.

Critics will also argue that rights to privacy are compromised by these enforcement systems. This is not an issue, since the vehicles are upon a public roadway and the camera photographs the car and the license plate, not the interior. Furthermore, they will argue that these systems are merely designed to make money for the city. Any money collected, however, comes from violators who would have been cited had an officer been there to catch them. There is no fine, but instead, a civil penalty that does not go against a driving record. There is a hearing examiner that must be appointed to hear any disputes, and the decision of the examiner may be appealed to municipal court, but it is still a civil penalty, not a fine. The city may retain some of the money generated from violators, but some of the money goes to the state, and some goes to the company that provides the system.

This is a very brief overview of the concept of using photographic enforcement systems in Willis at certain intersections to reduce and deter red light running. Before proceeding any further with detailed work and research, I think it is most important to first determine if the council finds this concept acceptable. If the council is philosophically opposed to it at this time, then we need not pursue it any further now. If they believe it is worthwhile and will support it, then we can move on with more research, consultations with TxDOT, and presentations from vendors to help us decide how to proceed further to implement such a project here.

WHEREAS, the City Council finds t hat a motor vehicle t hat proceeds into an intersection when the traffic control signal for the vehicle' s direct ion of t ravel is emitt ing a st eady red signal damages the public by endangering motor vehicle operators and pedestrians alike, by

decreasing the efficiency of t raffic control and t raffic f low efforts, and by increasing the number of accident s to which public safety agencies must respond at the expense of taxpayers; and

W HEREAS, pursuant to V.T.C.A., Transportat ion Code §§707.001, et seq., the City is authorized to establish and implement a phot ographic traffic signal enforcement system; and

WHEREAS, t he Cit y Council f inds that it is necessary and proper for the good of the government, peace and order o f the City to adopt an ordinance implementing a photographic t raffic signal enforcement system that consist s of a camera syst em installed to work in conjunct ion with an elect ronically operat ed t raffic control signal and shall produce at least two recorded images that depict t he license plate attached to the front or rear of a mot or vehicle that is not operated in compliance with the inst ructions of the traffic control signal:

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF W ILLIS,

TEXAS:

Section 1. That all matters and fact s set forth in the recitals hereinabove are found to be t rue and such recitals are hereby approved and made a part of t his Ordinance for all purposes and are adopted as a part of the judgment and f indings by the City Council of the Cit y of Willis, Texas.

Section 2. Purpose.

(a) It is the purpose of th is Ordinance to implement a photographic t raffic signal enforcement system program in order to promote the health, safety and general welfare of the citizens of the city by reducing the hazards of running red lights.

(b) This Ordinance shall apply within the corporate boundaries of t he City of Willi s.

Section 3. Definitions.

(a) The following terms and phrases, when used in this Ordinance, shal l have the meanings ascribed to them in th is section, except where t he context clearly indicates a different meaning:

Contracting entity shall mean the entity with which the City contracts for the installat ion, administration and enforcement of the photographic t raffic signal enforcement system.

Department means the police department of the City of Willis, Texas.

Motor Vehicle or Vehicle shall mean any motor vehicle subject to registration pursuant to the Texas Certificate of Title Act (V.T.C.A. Transportation Code Ch. 501).

Owner shall mean the owner of a motor vehicle as shown on the motor vehicle registration records of the state department of t ransportation or the analogous department or agency of another state or country.

Photographic traffic signal enforcement system or system means a system that:

1. consists of a camera system and vehicle sensor installed to exclusively work in conjunction with an electrically operated t raffic control signal; and

2. is capable of producing at least two recorded images that depict the license plate attached to the f ront or rear of a motor vehicle t hat is not operated in compliance with the instructions of the traffic control signal.

Recorded Image means a photographic or digital image that depicts the front or the rear of a motor vehicle.

Traffic-control signal has the meaning assigned by V.T.C.A., Transportation Code §541.304.

Section 4. Approval of Installation of Photographic Traffic Signal Enforcement System

(a) Before installing a photographic traffic signal enforcement system at an intersect ion approach, the City department and staff with the assistance of its contracting entity shall conduct a traffic engineering study of the approach to determine whether, in addition to or as an alternative to the system, a design change to the approach or a change to the signalization of the intersection is likely to reduce the number of red light violations at the intersection.

{b) An intersection approach must be selected for the installation of a photograph ic traffic signal enforcement system based upon traffic volume, the history of accidents at the approach, engineering, and safety criteria, without regard to the ethnic or socioeconomic characteristics of the area in which the approach is located.

(c) The City department and staff shall report the results of the traffic engineering study required in subsection (b) above to a citizen advisory committee consist ing of one person appointed by each member of the City Council. The committee shall advise the City Council on the installation and operation of a photographic traffic signal enforcement system.

(d) Upon its review of the traffic engineering study and the recommendations of the citizen advisory committee, the City Council may approve the installation of any photographic traffic signal enforcement system within the City of Willis.

Section 5. Imposition of civil penalty for violations.

(a) The owner of a motor vehicle is liable for a civil penalty of $75.00 if, while facing only a steady red signal disp layed by an electrically operated traffic-control signal located in the city, the vehicle is operated in violation of the instructions of that traffic-control signal, as specified by V.T.C.A., Transportation Code §544.007(d).

(b) An owner who fails to pay the civil penalty within the time allowed by this Ordinance shall be subject to a late payment penalty of $25.00.

Section 6. Enforcement; procedures.

(a) The department is responsible for the enforcement and administration of this Ordinance.

(b) In order to impose a civil penalty under this Ordinance, a notice of violation shall be mailed to the owner of the motor vehicle against whom the city seeks to impose a civil penalty not later than the 30th day after the date the violation is alleged to have occurred to:

(1) the owner's address as indicated on the registration records of the state department of transportation; or

(2) if the vehicle is registered in another state or country, the owner's address as shown on the motor vehicle registration records of the department or agency of the other state or country that is analogous to the state department of transportation.

(c) A notice of violation issued under this Ordinance shall contain the following:

(1) a description of the violation alleged;

(2) the location of the intersection where the violation occurred;

(3) the date and time of the violation;

{4) the name and address of the owner of the vehicle involved in the violation;

(5) the registration number displayed on the license plate of the vehicle involved in the violation;

(6) a copy of a recorded image of the violation limited solely to a depiction of the area of the registration number displayed on the license plate of the vehicle involved in the violation;

(7) the amount of the civil penalty for which the owner is liable;

(8) the number of days the person has in which to pay or contest the imposition of the civil penalty and a statement that the person incurs a late payment penalty of $25.00 if the civil penalty is not paid or imposition of the penalty is not contested within that period.

(9) a statement that the owner of the vehicle in the notice of violation may elect to pay the civil penalty by mail sent to a specified address instead of appearing at the time and place of the admin istrative adjudication hearing; and

{10) information that informs the owner of the vehicle named in the notice of violation:

a. of the owner's right to contest the imposition of the civil penalty in an administrative adjudication hearing;

b. that the imposition of the civil penalty may be contested by submitting a written request for an administrative adjudication hearing before the expiration of the period specified under subsection (c)( B) of this section;

c. that failure to pay the civil penalty or contest liabil ity for the penalty in a t imely manner is an admission of liability and a waiver of the owner's right to appeal the imposition of the civil penalty; and

d. that if the owner of the motor vehicle fails to timely pay the amount of the civil penalty imposed against the owner:

(1) an arrest warrant will not be issued for the owner; and

(2) the imposition of the civil penalty will not be recorded on the owner's driving record.

(d) A notice of violation under this Ordinance is presumed to have been received on the fifth day after the date the violation is mailed.

(e) In lieu of issuing a notice of violation, the department may mail a warning notice to the owner.

Section 7. Admission of liability.

A person who fails to pay the civil penalty or to contest liability for the penalty in a timely manner or who requests an administrat ive adjudication hearing to contest the imposition of the civil penalty against the person and fails to appear at that hearing is considered to:

(1) admit liability for the full amount of the civil penalty stated in the notice of violation mailed to the person; and

(2) waive the person's right to appeal the imposition ofthe civi l penalty.

Section 8. Presumption.

(a) It is presumed that the owner of the motor vehicle committed the violation alleged in the notice of violation mailed to the person if the motor vehicle depicted in a photograph or digital image taken by a photographic traffic signal enforcement system belongs to the owner of the motor vehicle.

(b) If, at the time of the violation alleged in the notice of violation, the motor vehicle depicted in a photograph or digital image taken by a photographic traffic signal enforcement system was owned by a person in the business of selling, renting, or leasing motor vehicles or by a person who was not the person named in the notice of violation, the presumption under subsection (a) is rebutted on the presentation of evidence establishing that the vehicle was at that t ime:

(1) being test driven by another person;

(2} being rented or leased by the vehicle's owner to another person; or

(3) owned by a person who was not the person named in the notice of violation.

(c) Notwithstanding Section 7, the presentation of evidence under subsection (b) by a person who is in the business of selling, renting, or leasing motor vehicles or did not own the vehicle at the t ime of the violation must be made by affidavit, through testimony at the administrative adjudication hearing under Section 7, or by a written declaration under penalty of perjury. The affidavit or written declaration may be submitted by mail to the City through the contracting entity.

(d) If the presumption established by subsection (a) is rebutted under Subsection (b), a civil penalty may not be imposed on the owner of the vehicle or the person named in the notice of violation, as applicable.

(e) If, at the time of the violation alleged in the notice of violation, the motor vehicle depicted in the photograph or digital image taken by the photographic traffic signal enforcement system was owned by a person in the business of renting or leasing motor vehicles and the vehicle was being rented or leased to an individual, the owner of the motor vehicle shall provide to the City through the contracting entity the name and address of the

individual who was renting or leasing the motor vehicle depicted in the photograph or digital image and a statement of the period during which that individual was renting or leasing the vehicle. The owner shall provide the information required by this subsect ion not later t han the 30

1h day after the date the notice of violation is received. If the owner provides the required

information, it is presumed that the individual renting or leasing the veh icle committed the violation alleged in the notice of violation and a notice of violation may be sent to that individual at the address provided by the owner of the motor vehicle.

(f) The City reserves the right to nominate the name and address of the operator of a vehicle in violation of this Ordinance when the vehicle is owned by the City. The City must follow the procedures set forth in subsection {e) above.

Section 9. Affirmative Defenses.

The owner of the motor vehicle shall be responsible for a violation of this Ordinance, unless the owner can, by preponderance of the evidence, prove that:

1. the traffic-control signal was not in proper position and sufficiently legible to an ordinarily observant person;

2. the operator of the motor vehicle was acting in compliance with the lawful order or direction of a police officer;

3. the operator of the motor vehicle violated the instructions of the traffic-control signal so as to yield the right-of-way to an immediately approaching authorized emergency vehicle;

4. the motor vehicle was being operated as authorized emergency vehicle under V.T.C.A., Transportation Code Ch. 546 and the operator was acting in compl iance with that Ordinance;

5. the motor vehicle was a stolen vehicle and being operated by a person other than the owner of the veh icle without the effective consent of the owner;

6. the license plate depicted in the recorded image of the violation was a stolen plate being displayed on a motor vehicle other than the motor vehicle for which the plate has been issued;

7. the presence of ice, snow, unusual amounts of rain or other unusually hazardous road conditions existed that made compliance with this Ordinance more dangerous under the circumstances than non-compliance; or

8. the person who received the notice of violation was not the owner of the motor vehicle at the t ime of the violation.

Section 10. Administrative adjudication hearing.

(a) A person who receives a notice of violation under this Ordinance may contest the imposition of the civil penalty specified in the notice of violation by filing a written request for an administrative adjudication hearing. The request for a hearing must be f iled on or before the date specified in the notice of violation, which may not be earlier that the 30th day after the date the notice of violation was mailed.

(b) On receipt of a timely request for an administrative adjudication hearing, the department or contracting entity shall notify the person of the date and time of the hearing.

(c) A hearing officer designated by the City Manager shall conduct the administrative adjudication hearing and shall have the authority to administer oaths and issue orders compelling the attendance of witnesses and the production of documents.

(d) In an administrative adjudication hearing, the issues must be proven by a preponderance of t he evidence.

(e) The reliability of the photographic traffic signal enforcement system used to produce the recorded image of the motor vehicle involved in the violation may be attested to by affidavit of an officer or employee of the City or t he contracting entity and who is responsible for inspecting and maintaining the system.

(f) An affidavit of an officer or employee of the City or the contracting entity that alleges a violation based on an inspection of the applicable recorded image is:

(1) admissible in the administrative adjudication hearing and in an appeal under Section 9; and

(2) evidence of the facts contained in the affidavit.

(g) At the conclusion of the administrative adjudication hearing, the hearing officer shall enter a finding of liability for the civil penalty or a finding of no liability for the civil

penalty. A finding under this subsection must be in writing and be signed and dated by the hearing officer.

(h) A finding of liability for a civil penalty must specify the amount of the civil penalty for which the person is liable. If the hearing officer enters a finding of no liability, a civil penalty for the violation may not be imposed against the person.

{i) A finding of liability or a finding of no liability entered under this section may:

(1) be filed with the municipal clerk; and

(2) be recorded on microfilm or microfiche or using data processing techniques.

(j) A person who is found liable for a civil penalty after an administrative adjudication hearing shall pay the civil penalty within (10) days of the hearing.

Section 11. Untimely Request for Administrative Adjudication Hearing.

Notwithstanding any other provision of this Ordinance, a person who receives a notice of violation under t his Ordinance and who fails to t imely pay the amount of the civil penalt y or fails to t imely request an administrative adjudication hearing is entitled to an administrative adjudication hearing if:

(1) the person submits a writt en request for the hearing to the designated hearing officer, accompanied by an affidavit that attest s to the date on which the person received the notice of violation; and

(2) the written request and affidavit are submitted to the hearing officer w ithin the same number of days after the date the person received the notice of violation as specified under Section 5 (c){8).

Section 12. Appeal.

(a) The owner of a motor vehicle determined by a hearing officer to be liable for a civil penalty may appeal that determinat ion to the municipal court judge of the City by filing an appeal petition with the clerk of the City's municipal court.

(b) The petition must be:

(1) filed before the 31st day after the date on which the administrative adjudication hearing officer entered the f inding of liability for the civil penalty; and

(2) accompanied by payment of t he cost s required by law for the court.

(c) The municipal court clerk shall schedule a hearing and notify the owner of the motor vehicle and the department of the date, time and place of the hearing.

(d) An appeal stays enforcement and collection of the civil penalty imposed against the owner of the mot or vehicle. The owner shall file a notarized statement of personal financial obligat ion to perfect the owner's appeal.

(e) An appeal under this section shall be determined by the municipal court by trial de novo.

(f) A person who is found liable for a civil penalty after an appeal hearing shall pay the civil penalty within ten (10) days of the hearing.

Section 13. Effect of liability; exclusion of civil remedy; enforcement.

(a) The imposit ion of a civil penalty under this Ordinance is not a conviction and may not be considered a conviction fo r any purpose, nor may information concerning a civil penalty be provided to a credit bureau or similar entity.

(b) The implementation of a photographic traffic signal enforcement system by the city under this Ordinance does not prohibit a peace officer from arresting a violator of V.T.C.A., Transportation Code §544.007(d) as provided by V.T.C.A., Transportation Code Ch. 543 if the peace officer personally w itnesses the violation or from issuing the violator a citation and not ice to appear as provided by V.T.C.A., Transportation Code Ch. 543.

(c) No civil penalty may be imposed under this Ordinance on the owner of a motor vehicle if the operator of the vehicle was arrested, was issued a criminal citation and notice to appear or was issued a warn ing by a duly authorized peace officer for a violation of V.T.C.A., Transportation Code §544.007(d) recorded by the photographic traffic signal enforcement system.

(d) If the owner of the motor vehicle f ails to t imely pay the amount of the civil penalty imposed against the owner:

(1) an arrest warrant will not be issued for the owner; and

(2) the imposition of the civil penalty will not be recorded on the owner's driving record.

(e) The city attorney is authorized to file suit t o enforce collection of a civil penalty assessed under this Ordinance.

Section 14: All ord inances or parts of ordinances inconsistent with the terms of this Ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this Ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this Ordinance.

Section 15: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of the Ordinance or the application of same to any person or the set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this Ordinance or their application to other persons or

sets of ci rcumstances and to this end all provisions of t his Ord inance are declared to be severable.

Section 16: The City Secretary is hereby directed to give notice hereof by causing the caption of th is Ordinance to be published in the officia l newspaper of the City of Willis after passage of this Ordinance. This Ordinance shall take effect from and after ten (10) days from its publication.

Methodology

Using data provided to A TS by the City of Willis, A TS has performed a comprehensive analysis on three intersections with five potential approaches. The results of this analysis will assist the city in identifying the most dangerous approaches that may subsequently qualify for the installation of an Automated Safety System to be used as a tool to help reduce the number of incidences occurring at the perspective intersections. In each evaluation A TS looked at the following items in the order listed

ATS Implementation and Construction: Constructability evaluations were conducted by ATS implementation staff to identify any impediments to installation based on standard construction practices. Considerations include; - Impediments to installation of video Detection I Image capture equipment - Possible ADA requirements - Possible Utility Issues

A TS Engineering: Preliminary engineering evaluations were conducted by engineering staff to provide design parameters and to identify any impediments to image quality. Consideration includes; - Exact placement of image capture equipment - Identification of any need for specialized equipment - Evaluation of - Communications drop locations - Power I service location - Condition of existing infrastructure - Street conditions - Traffic flows -Ambient conditions

Once evaluated for construction and engineering feasibility, those approaches that qualified were subjected to a VIMS (Violation Incident Monitoring System) to help measure the number of incidents occurring during an 8 hour period.
