4. 19 OPEN BURNING

1) General. A person shall not kindle

or maintain or authorize to be kindled or

maintained any open burning unlessconducted and approved in accordance with

this section.

a) Any open burning other thanrecreational fires, requires a permit from the

Fire Chief or his Designee.

2) Definitions: The followingdefinitions shall apply to this section:

a) Open fire. The burning of materialswherein products of combustion are emitted

directly into the ambient air without passingthrough a stack or chimney from anenclosed chamber. Open burning does notinclude road flares, smudge pots and similar

devices associated with safety oroccupational uses typically considered openflames or recreational flames.

b) Accelerant. A flammable or

combustible liquid that will increase the rate

of burning of a material. Under nocircumstances may any flammable orcombustible liquid be used to start or

promote an open fire to burn.

c) Chamber. For the purpose of this

definition, a chamber shall be regarded as

enclosed when, during the time combustionoccurs, only apertures, ducts, stacks, flues orchimneys necessary to provide combustionair and permit the escape of exhaust gases

are open.

d) Fuel. Fuel for any fires identifiedunder this code section shall only consist of

dry natural wood materials, leaves orcharcoal. Materials for fires shall NOT

include rubbish, garbage, trash, grass, anymaterial made of or coated with rubber,

plastic, leather, paint or petroleum-based

materials and shall not contain anyflammable or combustible liquids.

e) Recreational Fire/Fire Pit. A

below ground pit with a minimum depth of

ten inches ( 10") not to exceed three feet ( 3')

in diameter. The fire pit shall be surrounded

on the outside, above ground, by a non- combustible material such as concrete block

or rock.

9 Size. Unless specified in thedefinitions above, the maximum size of anyopen fire, bonfire, recreational fire or

fire/barbecue pit may not exceed three feet3') in diameter and the fuel height may not

exceed two feet (2') in height. Special

permission (binning permits) may begranted by the Chief or his designee forlarger piles.

3) Burning permits shall be obtainedfrom the Fire Department. The permit shall

be good for ten ( 10) days unless otherwise

amended by this code. a) Fees for burning permits shall be as

set from time to time by resolution of theBoard.

4) Safety Considerations: Thefollowing shall be adhered to for openburning:

a) Atmospheric Conditions. Fires will

be limited to the following atmosphericconditions: No fire shall be started unless

there are favorable conditions for burningwith regard to wind direction and speed. No

fire shall be started at a time when the wind

speed exceeds eight miles per hour ( 8 mph)

as measured at the Green Bay NOAANational Weather Service station or local

circumstances make fires potentiallyhazardous. Open burning shall beprohibited when such atmospheric

conditions exist that would cause the smoke

from open burning to stagnate such as aninversion or extremely high humidity.

b) Burning times. Open fires otherthan bonfires or recreational fire/barbecue

pits may only be conducted during daylighthours and must be extinguished at dusk.

c) Prohibited open burning. Openburning that will be offensive orobjectionable to occupants of the

surrounding -properties ( creating a PublicNuisance as defined in Chapter 11 of the

Village Code) due to smoke or odor

emissions when atmospheric conditions or

local circumstances make such fires

hazardous shall be prohibited. A fire

department officer is authorized to order the

extinguishment by either the party in controlof the fire or the Fire Department when open

burning creates or adds to a hazardous orobjectionable situation.

5) Location. The location of open

fires shall be as follows:

a) Recreational Fires/Fire Pit. The

location of open fires shall not be less than

thirty feet (30') from any structure, and

provisions shall be made to prevent the fire

from spreading to within thirty feet (30') of

any structure. 6) Attendance.

a) All open fires shall be constantlyattended until the fire is completelyextinguished. A minimum of one ( 1)

portable fire extinguisher complying with aminimum 4-A rating or other approvedonsite fire extinguishing equipment, such asshovel, dirt, sand, water barrel, garden hose

or water truck, shall be available for

immediate utilization.

b) Responsible Person. At least one

1) responsible person of age sixteen ( 16)

years or older must be in attendance of all

fires.

7) Portable Open -Flame CoolingDevices. Portable open -flame cookingdevices, regardless of cooking fuel, shall notbe operated within ten feet ( 10') of

combustible construction.

a) Exceptions: Where buildings and

decks are protected by an automaticsprinkler system.

b) Prohibited locations. Portable open -

flame cooking devices are prohibited on the

balcony of any multi -family residentialdwelling.

8) Liability. In addition to any otherpenalty as set forth at Section 4.99 herein, orwithin any other statute, code, or regulation,

any person violating this article shallreimburse the Village for reasonable cost of

fire protection services made necessary bythe violation including, but not limited to, the costs of investigation of the violation

and any response by the Village' s FireDepartment as a result of the violation. The

prosecution for violations of this article or

payment of the penalties provided shall not

prohibit any person from seeking any otherremedy against the person causing orpermitting the burning.

9) Exempt Fires. The followingdescribed fires shall be exempt from the

open fire requirements described in this

section.

a) Approved training for fire protectionpurposes. The Village Fire Department

shall be the authority to determine approvalof all such fires.

10) Emergency Powers of the Chief. When the Chief determines there are

environmental conditions likely to produce aserious threat of fire to life and property, itshall be the duty of the Chief of the FireDepartment to impose a burning ban andburning restrictions and require that noperson may:

TENTS AND TEMPORARY MEMBRANE STRUCTURES

Compliance Guidelines

This list of guidelines does not include all requirements for the safe use of tents. This list of guidelines

applies to all tents not just those requiring a license or notification. It is the license/ permit holder' sresponsibility to comply with the applicable sections of the Village of Suamico Ordinance, theInternational Fire Code and the Wisconsin Department of Safety and Professional Services.

1. Flame -resistant treatment required for all tents and membrane structures.

2. Use period. Temporary tents, air -supported, air -inflated or tensioned membrane structures shallnot be erected for a period of more than 180 days within a 12 -month period on a single

premise.

3. Smoking shall not be permitted in tents or membrane structures. Approved " No Smoking" signs

shall be conspicuously posted. 4. Fireworks shall not be used within 100 feet of tents or membrane structures.

5. No open flame or other devices emitting flame, fire or heat or any flammable or combustibleliquids, gas, charcoal or other cooking device or any other unapproved devices shall bepermitted inside or located within 20 feet of the tent or membrane structures while open to the

public unless approved by the fire code official. 6. 6. Heating or cooking equipment, tanks, piping, hoses, fittings, valves, tubing and other related

components shall be installed as specified in the International Mechanical Code and the

International Fuel Gas Code, and shall be approved by the fire code official. Outdoor cookingthat produces sparks or grease -laden vapors shall not be performed within 20 feet from a tent.

Operations such as warming of foods, cooking demonstrations and similar operations that usesolid flammables, butane or other similar devices which do not pose an ignition hazard, shall be

approved.

7. Housekeeping. All weeds and combustible vegetation shall be removed from the premises

adjacent of or within 30 feet of any tent. Hay, straw, shavings, trash and other combustiblematerial may not be stored less than 30 feet from any tent, except upon special permission fromthe fire chief. The grounds both inside and outside of tents shall be kept free and clear of

combustible waste. The waste shall be stored in approved containers or removed from the

premises.

8. Flammable and combustible liquids shall be stored outside in an approved manner not less than

50 feet from tents or membrane structures. The storage and dispensing of flammable orcombustible liquids shall be in accordance with SPS 101. 09. Flammable and combustible liquids

shall not be used in tents or membrane structures.

9. LP -gas containers shall be located outside. Containers 500 gallons or less, shall have a minimum

separation of 10 feet between container and tents or membrane structures.

10. Gas cylinders - Adequately secure all compressed gas cylinders. 11. Electrical Installations. Electrical systems in all tents that accommodate more than 50 persons

shall be installed in accordance with the requirements of Wisconsin Administrative Code

Chapter Comm 16 Electrical. All such systems shall be maintained and operated in a safe and

workmanlike manner. The electrical system and equipment shall be isolated from the public byproper elevation and guarding. All electrical fuses and switches shall be installed in approved

enclosures. Cables laid on the ground or in areas traversed by the public shall be placed intrenches or protected by approved covers.

12. Exits.

a. Distribution of exits. Exits shall be spaced at approximately equal intervals around theperimeter of the tent and shall be located such that all points are 100 feet (30 480 mm)

or less from an exit.

b. Number of exits. Tents or usable portion thereof shall have at least one exit and not less

than the number of exits required by Table 2403. 12. 2 The widths of means of egressrequired by Table 2403. 12. 2 shall be divided approximately equally among the separatemeans of egress. The total width of means of egress in inches (mm) shall not be less

than the total occupant load served by a means of egress multiplied by 0. 2 inches perperson. Every tent occupied by the public shall have at least 2 standard exits located ator near opposite ends of the structure. Exits shall be uniformly distributed but in nocase shall the line of travel to an exit be greater than 100 feet.

13. Exit lights and signs. All exits, aisles and passageways leading to exits in tents used as places of

outdoor assembly shall be kept adequately lighted at all times when the structure is occupied bythe public. Artificial illumination having an intensity of not less than 1 -foot candles at the floorline shall be provided when natural light is inadequate. Exit lights and signs complying with therequirements of IFC 2403. 12. 6 shall be provided in all tents used as places of outdoor assemblywhere more than 50 persons can be accommodated.

14. Portable Fire extinguishers with a minimum rating of 2A-10B: C shall be provided. The traveldistance to extinguisher(s) shall not exceed 75 feet. Extinguishers shall be readily accessible andshall not be obstructed or obscured from view.

15. An Unobstructed Fire Break passageway or fire road not less than 12 feet wide and free from

guy ropes or other obstructions shall be maintained on all sides of all tents unless otherwiseapproved by the code official.

16. Fire Access Roads shall extend to within 150 feet of all portions of the event site and shall have

an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not

less than 13 feet 6 inches.

17. Generators and other internal combustion power sources shall be separated from tents or

membrane structures by a minimum of 20 feet and shall be isolated from contact with thepublic by fencing, enclosure or other approved means.

18. Tents or membrane structures shall not be located within 20 feet of lot lines, buildings, other

tents or membrane structures, parked vehicles or internal combustion engines. For the purpose

of determining required distances, support ropes and guy wires shall be considered as part ofthe temporary membrane structure or tent.

a. Exceptions:

i. Separation distance between membrane structures and tents not used for

cooking, is not required when the aggregate floor area does not exceed 15, 000sq. ft.

ii. Membrane structures and tents need not be separated from buildings when all

of the following conditions are met: 1. The aggregate floor area of the membrane structure and tent shall not

exceed 10,000 square feet.

2. The aggregate floor area of the building and membrane structure andtent shall not exceed the allowable floor area including increases asindicated in the International Building Code.

3. Required means of egress provisions are provided for both the building

and the membrane structure, and tent, including travel distances. 4. Fire apparatus access roads are provided in accordance with the IFC.

Membrane structures having an area of 15,000 sq. ft. or more shall be located not less than 50 feet fromany other tent or structure as measured from the sidewall of the tent or membrane structure unlessjoined together by a corridor.

5. 08 ( 10) Catering: A caterer holding a retail license may sell alcohol beverages, Catereras defined in WI Stats 125. 02( 3x) to customers only if the sale is consummated on thelicensed premises, with the buyer and seller both physically present at the time of sale.
