Subject; Fire Dept. 2017

To; Reeve and Members of Council,

2017 the McKellar Fire Dept. responded to 87 calls for service, they were broken as follows,

Medical 54

Fire 2 (both outdoor, no loss fires)

Carbon Monoxide 3

Hydro lines down/arcing 7

Automated alarm 2

Mutual Aid 5

Motor vehicle crash (MVC) 5

Other 9

62% of responses were medical which was down slightly from an average of 69% of calls per year. MVC responses of 5 or 6% of calls is an increase from an average of one MVC per year. This follows an upward trend over the past 5 years of increaseing MVC responses.

The remainder of call volume is consistant with year to year averages.

In 2017 there no structure fires within the Twp. of Mckellar.

The area Chiefs have been continuing to work on the West Parry Sound Emergency Response Plan (WPSERP), the final draft will presented to area councils in the coming weeks.

AMO Makes Submission on Policing - Bill 175, SaferOntario ActThe Association of Municipalities of Ontario has made a written submission to theStanding Committee on Justice Policy concerning Bill 175, Safer Ontario Act,2017.

The full submission is available here. AMO also supports the call of the OntarioAssociation of Police Service Boards (OAPSB) that Boards be assured access toprofessional advice when at the bargaining table negotiating collective agreements.AMO also supports the measures included in Schedules 2-4 which focus onoversight agencies and processes.

Ontarians pay the highest policing costs in the country. Democratically elected localofficials must provide for the full range of municipal services that keep Ontarianssafe and healthy. That includes, but is not limited to, the financial needs of policeservices across the province and the OPP’s municipal mandate.

AMO encourages municipal governments to make written submissions to theCommittee to reinforce the above themes and/or share other municipal concerns. Arequest to make an oral presentation is due February 16 by 10:00am; writtensubmissions are due March 1 by 6:00pm. Hearing details are available here.

Areas of the bill of keen interest to municipal leaders include the following:

1. Mandating municipalities to develop Community Safety and Well-BeingPlans (Part VIII, Section 187)

Proposed Municipal Changes:

1. Limit the scope of this mandate based on the size of a municipality or wherean acute local public safety need exists.

2. Require participation of the Police Chief (or police service representatives).

3. Instead of legislation that punishes municipalities for non-compliance,encourage the development of such plans through outreach and financialsupport.

2. Civilianization (Use of Personnel, Part III, Section 13)

Proposed Municipal Changes:

1. Permit the civilianization of court security and prisoner transportationfunctions.

2. Permit the civilianization of all specific functions listed in the Bill to includecorporate entities.

3. Permit the civilianization of minor property offences, directing traffic, andcrime scene security.

3. Consolidation of OPP Police Service Boards and Role (Schedule 1, Part V)

Proposed Municipal Changes:

1. Provide assurance in law that all municipalities will be represented on OPPBoards.

2. Provide some greater assurance in law that powers of an OPP Board are assimilar as possible to those of an own-force board.

3. The OPP Police Governance Advisory Council should establish a mechanismto receive and provide advice to the Minister of Community Safety andCorrectional Services and the President of the Treasury Board with respect tothe fiscal position of municipal governments to inform the government’sbargaining position with the Ontario Provincial Police Association.

4. Police Service Boards (Part IV, own force)

Proposed Municipal Changes:

1. Either mandate diversity plans for both police service boards and policeservices or strike diversity plan requirement for boards.

2. Require in law that the provincial government expedite the appointment of itsrepresentatives to boards and in so doing, increase the diversity on a PoliceService Board. This is consistent with the findings of shortcomings and delaysnoted by the Auditor General of Ontario’s report on Public Appointments.

3. Diminish restrictions on former police officers servicing on a board to withinone year of employment by a service.

5. Establishment of a Provincial Inspector General (Part VI)

1. Supporting boards in fulfilling their function should be a mandate of thisoffice.

2. The Inspector General should be an independent office of the LegislativeAssembly.

6. Suspension without Pay (Part IX, Section 150)

Proposed Municipal Changes:

1. AMO support further amendments which ensure the ability of a Chief tomaintain discipline within the police service.

7. Waterways Policing (Part III, Section 6)

Proposed Municipal Changes:

1. Provide greater legislative clarity to avoid overlap with waterways currentlypoliced by the OPP.

FONOM and NOMA Expecting Increase in Number of Long-Term Care Beds for the North

The Federation of Northern Ontario Municipalities (FONOM) and the Northwestern Ontario Municipal Association (NOMA) are pleased to learn that the government will soon be announcing calls for proposals for new bed developments in long-term care. The government had committed to creating 5,000 new long-term care beds by 2022 and over 30,000 new beds over the next decade which was outlined in their recent paper, Aging with Confidence: Ontario’s Action Plan for Seniors, and reiterated in the Fall Economic Statement. This commitment was welcomed news by stakeholders advocating for greater system capacity to address the growing number of seniors. “We are pleased that the government is moving forward and taking concrete action to increase the number of long-term care beds in the province,” said Mayor Al Spacek of Kapuskasing and FONOM President. “Northern Ontario feels the effects of an aging population disproportionately than the rest of the province. We hope the North will see their fair share of new beds.” “Ontario seniors deserve the best care and support as possible. As northerners, we have long been advocating for a commitment to provide more long-term care beds in our communities,” said Mayor Wendy Landry, President of NOMA. “The ability for people to age in their home community, surrounded by family and friends enhances patient outcome and provides for a vibrant and inclusive community,” added Landry. FONOM and NOMA are encouraging their membership to begin preparing to submit proposals to the Ministry of Health and Long-Term Care.

Re: Offering School Property to Municipalities

Dear Sir/Madam,

At its regular council meeting of January 15, 2018, Essex Town Council discussed the ongoing issue of school closures throughout Ontario. These school closures in many cases result in properties that are left as vacant and unused for substantial periods of time and this often results in properties that not only become eyesores for the affected communities but as well often have further negative impacts on the social and economic development of that community and its municipality.

Many municipalities might be interested in purchasing these properties for development and sustainment as a hub in their community. However the feasibility of this certainly becomes more daunting and for some municipalities even impossible when municipalities that are interested in purchasing must first (pursuant to current regulations) purchase these properties at fair market value with taxpayer dollars and then may need to spend further taxpayer monies in order to retrofit and/or remediate the building (s) on these properties.

Given the fact that these properties were already originally purchased and developed into schools using taxpayer dollars we ask that consideration be given to the fact that the taxpayers should not again have to purchase these properties at fair market value if the intent

is for the particular Municipality to develop and/or sustain these properties for the betterment of its community.

As a result of the discussion the following resolution was passed by Essex Town Council at its January 15, 2018 regular meeting:

Moved by Councillor Bondy Seconded by Councillor Voakes

(R18-01-013) That the Town of Essex send a request to the Association of Municipalities of Ontario (AMO), ROMA and all other municipalities in Ontario requesting that when schools boards make decisions to close schools, that they have to offer the building to the local municipality for a dollar.

Carried

Council believes that providing the opportunity to purchase the buildings for a dollar would give municipalities a meaningful opportunity to ensure that these properties remain a key hub for social and economic development in their respective communities.

Issues discussed at the West Parry Sound Health Centre

Board of Directors meeting held February 12, 2018

▪ The Board received a demonstration of the new eCTAS (Electronic Canadian Triage and Acuity Scale) that the

Emergency Department started utilizing on January 23, 2018.

▪ The Board of Directors continued their Accreditation Governance Standards self-assessment survey. This self-

assessment will continue at the meeting in March 2018.

▪ The consent agenda was received. This included reports and recommendations from the Quality and Safety

Committee, Governance Committee, Property/Finance Committee, Medical Advisory Committee, Board

Executive, Lakeland Long-Term Care and the WPSHC Foundation.

▪ The Foundation report included EHR project costs incurred to date. The annual run is scheduled on May 27th.

Registration will commence February 14, 2018.

▪ The Auxiliary will be hosting a bake sale on March 29 in the front lobby.

▪ An EHR project status report was provided.

▪ A financial update as at December 31, 2017 was provided.

▪ The CEO report made reference to:

- the EHR system at West Parry Sound Health Centre. The system will provide physicians and all care

providers with powerful tools that will improve our delivery of patient and family centred care. The

WPSHC team is participating in the leadership of this project in partnership with Sault Area Hospital,

North Bay Regional Health Centre, and the North East Local Health Integration Network.

I am completely opposed to funding a pool/fitness centre. I can't see how a pool in ParrySound is going to benefit people living in McKellar, particularly when I have three other poolsalready in existence, in which to swim in if I felt so inclined.

In fact, not only am I opposed to funding this pool but I don't see the point of sending anyonefrom McKellar Council to attend these meetings. Attending the meetings cost the McKellartaxpayer $200 for every meeting attended plus their mileage. Being that I can't supportfunding the pool I see no reason for any council member to waste our tax money attending.

policies consistent with the Provincial Policy Statement, 2014 (“PPS, 2014”). The

Official Plan Amendment (“OPA”) was adopted on December 7, 2015 and forwarded to

the Ministry of Municipal Affairs (“MMA”), the approval authority, on January 25, 2016.

[2] The MMA modified and approved OPA 8, and Notice of Decision was given on

September 21, 2016.

[3] Two appeals were filed, one from the Township, and the other from Mr. Zulak.

[4] Prior to the first pre-hearing on this matter in April of 2017, the Township and the

MMA were able to resolve their differences, and despite this new common ground, and

Board directed consultation with Mr. Zulak, the approval authorities were unable to

resolve the appeals by Mr. Zulak. Mr. Zulak’s appeal of five sections of the OPA

overlapped three of the sections resolved in the MMA/Township discussions and

settlement.

[5] The Board heard evidence from two witnesses qualified to give opinion evidence

in matters of land use planning: John Jackson on behalf of the Township; and Chris

Brown on behalf of MMA.

[6] Through Mr. Zulak’s questioning of Mr. Jackson, it became apparent to the Board

that the parties would benefit from further discussions to clarify the intent of the policies

under appeal. The Board stood down for 2 hours.

THE ISSUES [7] Following the recess, the Board heard from Mr. Zulak, that he had been satisfied

with the explanation of the technical merit of the modifications and matters he had

appealed, including receiving an answer to the date of the mapping forming the basis of

specific policies. He however expressed his concerns with respect to the lack of

consultative process comparable to that which the Township undertook to deal with the

3 PL161019 issues resolved through the Official Plan Amendment 7 (“OPA 7”) approval process.

Mr. Zulak’s principal concern was that in his view, the seasonal residents affected by

the policies which dealt with Waterfront lands had benefited from greater attention of

Council and associated opportunities for input, citing a questionnaire which had served

as the foundation of the data collection for the policy formulation for OPA 7. No such

survey was undertaken in connection with OPA 8 which addresses the rural areas,

which the Appellant characterized as being populated by full time residents.

[8] Following Mr. Zulak’s submissions, the Board heard from the MMA’s witness who

gave un-contradicted, and uncontested evidence with respect to the background and

purpose of the policy amendments necessary to bring the Official Plan (“OP”) current to

be consistent with, and conform to both the PPS, 2014, and the Growth Plan for

Northern Ontario. In many instances, the language of OPA 8 is extracted directly from

the PPS 2014.

[9] Mr. Brown led detailed evidence as to how each of the following sections of OPA

8 had been drafted and or modified by the Minister to specifically bring the Township

OP into compliance with provincial policy:

i. Sec. 5.2.6 (Aggregates)

ii. Sec.7.21.6 (Wildland Fire Risks)

iii. Sec.9.1.2 (Environmentally Sensitive Lands)

iv. Sec. 9.2.5 (Flood Plain Management)

v. Sec. 5.13.3 (Record of Site Condition) and

vi. Sec. 9.2.4 (Flood Plain Management)

[10] The Board is persuaded by the evidence of the MMA, as supported by the

Township, and allows the appeal in part to further modify OPA 8.

ORDER [11] The Board allows the appeal in part and orders that OPA 8, as approved by the

Background and Property Description

Reg Moore is the owner of a parcel of land on Part of Lot 19, Concession 13 in the Township of McKellar.

The parcel has frontage on Balsam Road and Squaw Lake Road. The owner has applied to the Parry Sound

Area Planning Board to create two new rural lots, both of which will front on Squaw Lake Road.

The subject land is bordered in all directions by residential development and is currently vacant. The

western half of the subject land is predominantly open grassland while the eastern half is heavily forested.

The subject land is approximately 10.6 hectares (26 acres in size) with ±350 metres of frontage on Balsam

Road and ±350 metres of frontage on Squaw Lake Road.

Proposed Consent

The applicant is proposing to create two new rural lots, each with frontage on Squaw Lake Road. The lots

will be ±0.8 hectares in size and will both include at least 60 metres of frontage.

Official Plan

The subject land is designated Rural in the Township’s Official Plan. The Rural designation permits, among

others, residential uses.

The subject land is not located in one of the Township’s historic settlement areas. However, there are

several similar sized rural lots located around the subject land. The proposed consent will not alter the

existing rural character of the area or the Township in general.

The Official Plan permits consents in the Rural designation subject to there being a maximum of two new

lots plus a retained lot. The application satisfies these conditions. All new lots must front upon a year-

round, publicly maintained road. Both new lots are to front on Squaw Lake Road which is a year-round,

publicly maintained road.

The subject land is entirely free of significant natural heritage features. There are no natural heritage

concerns.

Each of the proposed lots are to be serviced by private individual wells and septic systems. These forms

of services are permitted throughout the rural areas of the Township.

Official Plan Amendment No. 8

The Township established a new set of rural standards as part of Official Plan Amendment No. 8. To avoid

any cross contamination between private well systems, the Ministry of Environment and Climate Change

created a set of guidelines for land use planning that recommend new rural lots be a minimum of 0.8

hectares in size. The Township has implemented these guidelines and now requires new rural lots to meet

this standard.

Zoning By-law

The subject land is zoned Rural (RU) in the Township’s Zoning By-law. New lots in the RU Zone are required

to have a minimum lot area of 0.4 hectares (±1 acre), 60 metres (± 200 feet) of frontage, and a depth of

45 metres (150 feet).

Note: the Official Plan requires a higher standard as it relates to lot area (0.8 hectares).

The proposed lots as well as the retained lot will have the following characteristics:

Each of the proposed lots will satisfy the minimum lot standards established in the Zoning By-law. There

are no zoning concerns.

Provincial Policv Statement (PPSI

Section 1..L.4 al of the PPS calls for "supporting rurol areos by building upon rurol chorocter, ond leverogingruralomenities qnd ossets." The application is proposing the creation of two new rural lots. Both lots are

large in size and will not alter the existing rural character of the area.

Section 2.Lof the PPS deals with the protection of natural heritage and natural heritage features. As per

Schedule 'A' of the Official Plan, there have been no natural heritage features identified on the subjectland. The creation of two rural lots will not negatively impact any natural heritage features.

The proposed application is consistent with the PPS.

Recommendation

It is recommended that Consent Application 801/2018(McK) by Reg Moore on Part of Lot L9, Concession13 in the Township of McKellar be approved, subject to the following conditions:

L. The applicant deeding to the Township that portion of land 10 metres from the centreline of thetravelled road as it abuts the retained and severed parcels, should a survey reveal an

encroachment;2. Payment of a parkland dedication fee satisfactory to the Township;3. Receiving adequate 91"1" addressing for the new lots; and

4. Payment of any applicable planning fees.

CORPORATION OF THE TOWNSHIP OF MCKELLAR

BY-LAW NO. 2018-08

Being a By-law to Confirm the Proceeding of Council of theTownship of McKellar

WHEREAS Section 5 of the Municipal Act, 2001, S.O. 2001, c.25 as amended, provides that thepowers of a municipality shall be exercised by its Council; and

WHEREAS, Section 9 of the Municipal Act, 2001, S.O. 2001, c.25 as amended, provides that amunicipality has the capacity, rights, powers and privileges of a natural person for the purposes ofexercising its authority under the Municipal Act or any other Act; and

WHEREAS Section 5(3) of the Municipal Act, 2001, S.O. 2001, c.25 as amended, provides that amunicipal power, including a municipality’s capacity rights, powers and privileges under Section 9of the Municipal Act, 2001, S.O. 2001, c 25 as amended, shall be exercised by by-law unless themunicipality is specifically authorized to do otherwise; and

WHEREAS it is deemed expedient that the proceedings of the Council of the Corporation of theTownship of McKellar at this Session be confirmed and adopted by By-law.

NOW THEREFORE the Council of the Corporation of the Township of McKellar hereby enacts asfollows:

1. THAT the actions of the Council of the Corporation of the Township of McKellar at itsmeetings held on February 8, 2018 and February 20, 2018 in respect to each resolution andeach action passed and taken by Council at the meeting, are, except where the prior approvalof the Ontario Municipal Board is required, hereby adopted, ratified and confirmed as if thesame were expressly embodied in this By-law.

2. THAT the Reeve, or in his/her absence the Acting Reeve, and the proper officials of theCorporation of the Township of McKellar are hereby authorized and directed to do all thingsnecessary to give effect to the said action of the Council of the Corporation of the Townshipof McKellar during the said meeting referred to in Section 1 of this By-law.

3. THAT the Reeve, or in his/her absence the Acting Reeve, and the proper officials of theCorporation of the Township of McKellar are hereby authorized and directed to execute alldocuments necessary to the action taken by this Council as described in Section 1 of this By-law and to affix the Corporate Seal of the Corporation of the Township of McKellar to alldocuments referred to in said Section 1.
