This document is North Sydney Council’s response to actions arising from Precinct Committee Minutes. On receipt of the minutes, actions are numbered and
allocated to relevant Council Officers for response. To effectively manage and provide clarity, all actions are allocated a status when reporting to Precinct Committees
in response to their minutes. There are three categories:
Awaiting Response - action allotted to Council Officer - response awaited.
Open/Ongoing - action allocated to Council Officer, initial response provided. Matter ongoing and further response/update to be provided at later date.
Closed for Council - Council either completed related works/tasks or has taken all reasonable steps within its power to resolve issue (for example when matter
is beyond its jurisdiction). If the Precinct Committee feels Council can take further steps, they can request Council reopen action.

December 1 Special Rate Variation (SRV)
MOTION:
1. Precinct is not convinced that Council's funding cannot
meet its declared requirements in the medium term
without the withdrawal of existing services.
2. Precinct does not support the Special Rate Variation
(SRV) Scenarios 2 or 3 which will lock in the proposed
rate increases in perpetuity.
3. Precinct would support a special infrastructure levy to
fund a specified list of backlog capital works.
4. Precinct would propose the special infrastructure levy be
set at 2% above the annual rate peg over a maximum
period of 4 years.

November Box Trailer Parking (Tunks Park)
A trial of 'No Parking, Motor Vehicles Excepted' signs will
take place at Tunks Park, with a report back to the Traffic
Committee early 2019. MOTION: Precinct recommends

Special Rate Variations (SRV)
MOTION: Precinct requests financial information from
Council on the basis of calculations behind Scenarios 2 and
3, with details of continuing expenditure items, details of
capital expenditure items and projections of revenue on
which these scenarios are based. Motion Carried: 11 in

Council’s Manager Financial Services has advised that the
Amended Resourcing Strategy 2018/19-2027/28, currently
on exhibition until 16 January 2019, includes a suite of
appendices per financial scenario/option - inclusive of an
Income Statement, Balance Sheet, Cash Flow Statement and

October A Precinct member stated that there is a wide disparity in
the size and amenity of home units in Willoughby Bay and
neighbouring Brightmore Precincts, but all of them attract
the same Annual Rate of $970.00, which is more than the
minimum.
Council’s Manager Financial Services has advised that a
typical property with a land value of approximately
$605,000 would receive a rate notice of $967.71, which
includes the minimum rate of $526.00 as well as the
Environmental and Infrastructure Levies, the Stormwater
Management Charge (SWMC) and the Domestic Waste
Management Charge (DWMC).

The Mayor to investigate the signage in Brothers Park
The Mayor to look into a resident's complaint that there is
unnecessary signage in Brothers Park. However, a Precinct
member has stressed that the signs are there for the
protection of school children who frequent the Park where
hazardous materials are often found.
Council’s Manager Parks and Reserves has advised that, on
inspection at Brothers Park, there is no signage that suggests
anything of hazardous materials. Clarification on issue
needed from Precinct in order for further action to be taken.

September 2 CPC Report 21 August 2018
General Manager outlined the reasons for Council's
projected rate increase of 7% per year over 7 years starting
in 2019.
Will Council please advise if the 7% would be additional
to rate increments based on progressive increases in land
values?
Will Council please advise how Strata Title Unit rates
are calculated?
Council’s Manager Financial Services advised that The
Minister for Local Government issues an annual maximum
allowable percentage increase in the general rates. If a
Special Rate Variation (SRV) application for North Sydney
Council was approved for 7% over a period of 7 years, the
annual permissible increase is applied to the pool of rating
revenue, not individual properties.
Valuations on individual properties are then used to
determine the spread of that increase across LGA. Council
plays no part in the independent valuation of land in the
LGA, this is performed by the Valuer General (VG). A
general revaluation, released approximately every three
years, may result in the value of some land in a council area
increasing or decreasing by more than other land.
North Sydney Council has a residential and a business rate,
which are subject to a minimum rate. The minimum rate for
2018/19 is $526.00. Those properties with a land value of

approximately $605,000.00 or less, the minimum rate
amount is applicable. Those properties above this land
value, the rates are calculated on the applicable VG land
value and a cents in the dollar allocation, as per Council’s
rating annual determined distribution.
The majority of Strata Title units are subject to the
minimum rate calculation.
2 General Business
Association for the Committee of North Sydney (similar to
Friends of the Art Gallery)

Memberships $250. Precincts are disqualified from joining
because of their statutes.
CORRECTION: Precinct Committees are not disqualified
from joining the Committee for North Sydney. However, as
stated in the Memo sent to all Precinct Committees on 29
June 2018, operational funds as issued by Council cannot be
used for membership of the Committee for North Sydney.

3 MOTION: Precinct thanks Council for its response to a
Precinct resident's request (August Minutes) for a pedestrian
crossing over Montague Road at Macpherson Street but,
after much discussion, Precinct wishes to advise Council
that Precinct does not support any change to the status quo.

4 New Footpath and Grass Verge between Montague Road
and Richmond Avenue
Precinct thanks Council for an excellent job in building a
new footpath and laying a grass verge in Macpherson Street
between Montague Road and Richmond Avenue.

August 2 Bridge Over Creek at Primrose Park

3 Action on Excessive Noise from Barking Dogs

6 Request for Resurfacing Prospect Avenue
A Precinct resident notes that this avenue has not been
resurfaced in the last ten years. Holes have simply been
patched, with the edges eventually wearing away and then
being repatched. Would Council please consider the
resurfacing of Prospect Avenue?
Council’s Assets Manager advised that the road resurfacing
of Prospect Avenue will be listed for consideration in next
year's capital works program subject to funding availability.

7 Re-instatement of Lodge Road Pavement
A Precinct member requested Council to advise its stance on
the quality of the re-instatement of Lodge Road’s northern
pavement from the electrical unit in Ellalong Road outside
the children's playground down to 16-20 Lodge Road. The
Precinct member asked whether this work was carried out
for Council or for private interests and at whose expense.
The member also enquired whether the bitumen patching
there at present is judged to be an adequate reinstatement of
the damaged concrete pavement.
Council’s Contracts Manager advised that the work was not
carried out by Council. It was carried out by Scott Electrical
(Contractor) on behalf of Ausgrid. The bitumen present is a
temporary restoration. A permanent restoration of the
concrete footpath and sections of the asphalt road will
commence on 17 September and is expected to be
completed by 30 September. These works are all paid for by
Scott Electrical on behalf of Ausgrid.

8 Request for removal of kerbside parking in Macpherson
Street at corner of Prospect Ave - A Precinct member has
noted on several occasions in the past week that cars waiting
to turn right into Prospect Avenue from Macpherson Street
were creating blockages sometimes all the way back to
Ourimbah Road even in the middle of the day. This could be
solved by removing sufficient parking on the eastern kerb at
Council’s Manager Traffic and Transport Operations has
advised that MacPherson Street forms the boundary between
Mosman Council and North Sydney Council. The
southbound traffic and parking lanes fall under Mosman
Council's jurisdiction, therefore the request to remove
parking will be forwarded to Mosman Council for their
consideration on behalf of the Precinct.

to bypass the blockage. Would Council please investigate

9 Request for pedestrian crossing over Montague Road at
Macpherson Street - A Precinct resident said that creating
such a crossing is essential to the safety of the many small
children who cross Montague Road on their way to and
from Middle Harbour School.
Council’s Manager Traffic and Transport Operations has
advised that the traffic and pedestrian volumes on Montague
Road are unlikely to meet the minimum warrants set by the
RMS for installation of a pedestrian crossing. Kerb
extensions may be a suitable alternative which would
narrow the crossing distance and help to reduce the speed at
which vehicles approach the intersection. This will be added
to the LATM Action Plan (Zone 5).

Precinct has discussed Council’s proposed rate increases at
this meeting but still seeks a more detailed explanation as to
the necessity for such increases.

Council’s Manager Integrated Planning and Special Projects
has advised that in accordance with statutory requirements
Council has prepared a long term Resourcing Strategy as
part of its Integrated Planning and Reporting suite of plans,
and that this Strategy includes three financial scenarios. In
adopting the Resourcing Strategy, on 25 June 2018, the
Council adopted Scenario 3 as the preferred financial
scenario which includes a proposed special rate variation
(SRV) of 7% per annum for seven years. Note: this
percentage amount is indicative at present subject the
following required stages in Council determining whether or
not to apply for a SRV - step 1 is to resolve “intent to apply”
which is the trigger for extensive consultation to commence;
and step 2 is for the Council to consider the feedback
received at the conclusion of the consultation period and in
turn determine whether to proceed to submit a SRV
application.
The opportunity to provide feedback on the draft Resourcing
Strategy was promoted to all Precinct Committees via
memorandum dated 10 May 2018 and the potential
proposed SRV under Scenarios 2 and 3 was flagged at the
Combined Precincts Committee meeting held on 22 May
2018.
SRV applications are made to the Independent Pricing and
Regulatory Tribunal (IPART), who has been appointed by
the State Government to assess all SRV applications.

UPDATE (7 August 2018)
The General Manager is confirmed to attend the Combined
Precincts Committee meeting on 21 August 2018 to talk to
Council’s adopted Resourcing Strategy 2018-2028 and
preferred financial scenario. The CPC agenda for this
meeting will soon be distributed to all Precinct Committees.
2 Development Application No. 333/2017 - 40 Brightmore
Street, Cremorne
A Precinct member who attended the conciliation
conference on 4 May 2018 where no resolution was reached
has been advised that the applicants has since amended their
plans and that the matter has now been set down for a two-
day hearing at the Land and Environment Court
commencing Monday 23 July 2018.

3 Abandoned Vehicle in Wonga Road
A Precinct member reported that a car full of rubbish has
been parked just west of 2 Wonga Road for many months.
Council’s Manager Ranger and Parking Services has
advised that Council officers have previously processed this
vehicle at another location. The owner responded stating it
is not abandoned. Also, it has only recently been registered
in June 2018 so it is not possible to assume abandonment.
As it is legally parked in an unrestricted place we cannot
take action.

4 United Resources Management
Precinct members reported that on Friday 29th June and

June Memorandum of 1 June 2018 - Development Application
(DA) Plan Borrowing and Viewing at Council by
Precinct Committees
Motion: Precinct Committee has discussed the
Memorandum and finds that its changes would place an
unnecessary burden on Precinct officers. Precinct is
therefore requesting Council maintain the current seventy-
two (72) hours borrowing and viewing period and not
introduce a twenty-four (24) hour turnaround.

3 Concern Expressed on the Bulk and Scale of Properties
Currently Being Built
Motion: Precinct has concern at the bulk and scale of
certain local developments, such as 19 Samora Avenue
Cremorne. While Precinct understands that neighbours must
remain vigilant when DAs are notified, Precinct urges
Council to monitor construction to ensure that what is being
built conforms to the plans approved.

6 Mar 2017 - DA316/17 for the demolition of the

4 Oct 2017 - Construction Certificate for the
approved development was issued by the PCA
(Residential Certifying Specialist).
4 June 2018 - DA119/18 for strata subdivision of the
approved attached dual occupancy was approved
under delegated authority.

May 1a Changes in Young Street Neutral Bay It has been six months since the roundabout at the
intersection of Young Street and Grasmere Road was
removed and replaced with Stop Signs. The result of the
changes is currently under review.
Those present at the Precinct Meeting agreed that what
is really needed at this intersection is a low roundabout.
UPDATE (1 June 2018)
Council’s Manager Traffic and Transport Operations has
advised that at the Council meeting on 28 May 2018 it was
resolved: 1. THAT Council review the safety issues relating to Young Street and
Grasmere Road and Sutherland Street as a matter of urgency.
2. THAT Council staff, in consultation with the Tunks Ward Councillors
and community representatives including the local Precincts
Committees, determine appropriate action to reduce these safety issues.
3. THAT all Councillors be kept informed.
UPDATE (6 September 2018)
Council’s Manager Traffic and Transport Operations has
advised that Council’s Sustainable Transport Projects
Officer attended Willoughby Bay Precinct meeting on 14
June as guest speaker regarding this matter. Council officers
are currently considering options and will undertake further
community consultation once these are developed.

1b Proposed further Changes to Young Street in new
Council Proposal
The Councillor will investigate the following changes
proposed for Young Street by the Traffic Committee, and
endeavour to place them on Council's agenda.
i) Bicycle lane up Young Street to be extended from
Sutherland Street to Grosvenor Street on the Western
side.
Council’s Sustainable Transport Project Coordinator will
attend June 2018 Precinct Committee meeting to discuss
cycleways questions.
UPDATE (18 September 2018)
Council’s Sustainable Transport Project Coordinator has
advised that Council have engaged a consultant traffic
engineer to undertake a third party review and Road Safety
Audit (RSA) of the intersection between Young Street and
Grasmere Road. The matters raised made by the Precinct

ii) Dedicated right hand turn lanes to be set at Belgrave
Street intersection both North and South on Young
Street.
iii) Removal of the roundabout at Young Street and
Grosvenor Street intersection with Stop Signs on
Grosvenor Street.
One Precinct member who had examined the plans said
it was unclear how bicycles are expected to exit the lane
on Young Street near Grosvenor Lane before reaching
Military Road. That Precinct member also asked what
became of the suggestion to introduce a contra flow
bicycle lane at Grosvenor Lane from Young Street to
Ben Boyd Road (as in Middlemiss Street North Sydney).

3 Prompt action from Council commended
Precinct commends Council on their prompt removal of a
very large tree which had been brought down on a very
windy weekend and had blocked the pathway leading down
from Grafton Street to the tennis courts.

4 Traffic visibility hindrance at Ryries Parade
A Precinct member has reported visibility issues when
exiting Ryries Parade from the north and attempting to turn
right into Lodge Road. Cars parked close to the corner to the
left in Lodge Road obscure oncoming traffic from the east
because of the acute angle at the intersection.
Motion: Precinct requests that Council place a "No
Stopping" sign on the eastern corner of Lodge Road at
Ryries Parade North.

Council’s Manager Traffic and Transport Operations has
advised that No Stopping restrictions to be installed at 10
metres on the corner of Lodge/Ryries, subject to approval by

5 Tenders for New Flood Study Plan
A Precinct member asked for an update on the Flood Study.
As advertised in the Mosman Daily of 3 May 2018, North
Sydney Council is calling for tenders for the next stage of the
Flood Study Plan.
Council’s Engineering Project Manager has advised that
tenders for the Floodplain Risk Management Study closed
on 24 May 2018. It is anticipated that the successful
consultant will start on the study in July/August 2018.
Further community consultation will take place as part of
this study.
UPDATE (4 December 2018)
Council’s Engineering Project Manager has advised that the
consultant undertaking the Floodplain Risk Management
Study and Plan has begun work. The first stage is a review
of the flood model. Once the review has been completed all
required changes will be made to the model. A review of the
problem areas will begin once the model has been updated,
this review will include floor level surveys and ground
truthing. Community consultation will take place prior to
the finalization of the Floodplain Risk Management Study
and Plan. The Floodplain Risk Management Study and Plan
is expected to be completed in May 2020.

April A Precinct resident advised that the graffiti on the rock face
in Primrose Park has been removed as requested in Precinct’s
March meeting. The Precinct Committee thanks Council for
its prompt action.

2 Parraween Street
A Precinct resident expressed the opinion that Parraween
Street requires a Grosvenor Street style make-over.
Precinct requests that Council appoint a representative
from their Planning Dept to attend its June Meeting and
present a renovation and beautification program for
Parraween Street.
Council’s Executive Coordinator Engineering and Property
Services has advised that the Development Application for
this project was approved by Council in April 2015. The
project was then put on hold during the proposed Council
merger period in 2016/17 and now is being reconsidered
along with a number of major projects that Council has
deferred decisions on during the proposed merger period.

A Precinct resident asked what is still delaying the
development of the Parraween Street Carpark Project.
Council is currently preparing its Budget and Delivery
Program for 2018/19 and the Parraween Street Carpark
Redevelopment will be reviewed as part of this process.
Project update: works are currently on hold due to changes
proposed by Transport for New South Wales and the already
extensive works they are undertaking in the area for the B-
Line construction. An updated construction program will be
provided when available.
3 Brothers Park Update
Council is installing in this park a rubbish bin which it will
empty on a regular basis. A resident commended Council
staff member E. S. for delivering smaller bags of mulch to
be spread at an upcoming residents’ working bee.

Council’s Streets Alive Coordinator noted compliment and
advised that a bin in the park has been installed.

March B-line Issues
Precinct Committee's comments have been forwarded to the
relevant officer.
Motion: Prevention of removal of the bus stop at Prince
Street - Precinct notes the removal of the Prince St bus
shelter and asks Council to use its good offices to seek
reinstatement of the shelter and to prevent closure of that
bus stop. Motion carried unanimously
Please note: Precinct has since learned that a new bus shelter
has recently been erected 3 metres further along Military
Road.
Council’s Manager Traffic and Transport Operations has
advised that the bus shelter and stop on Military Road at
Prince Street is within the Mosman Council area. It is
understood from the Precinct Committee's notes that a new
shelter has been reinstated and the matter is therefore
considered closed for Council.

3 Combined Precincts Committee Meeting - 27 February 2018
Western Harbour Tunnel & Beaches Link / WHTBL
The CPC heard that the major concern for residents is air
pollution from the proposed exhaust stacks. There will be a
Special Meeting on WHTBL at Council’s Hutley Hall on 22
March 2018 from 6.30pm to consult with local residents on
this issue. Individual precincts were asked to gauge their
members’ opinion on this matter prior to the meeting.
Members expressed support. Some advocated for a rail link
and some wanted both rail and road.
Motion: Precinct supports the notion of the WHTBL and
places the accent on environmental impact to ensure it is
properly managed and mitigates any adverse effect on the

Brightmore Precinct re Existing Use Developments
Ambitious developers are acquiring dilapidated multi-
residential blocks and applying for outsized developments
that contravene existing zoning knowing Council will reject
them but the L & E Court will consent on the basis of
existing use. CPC invites Council to address its next
meeting on this and take legal advice on strategies to
counteract such development initiatives.
Proposed Shipyard for Lavender Bay
Concerns were voiced about an application with Council to
construct a floating dry dock facility to service commercial
vessels up to 1000T in weight at 6 John Street, McMahons
Point.
Feedback regarding the Combined Precincts Committee
meeting is noted. Request for Council staff to address a
future Willoughby Bay Precinct meeting regarding Existing
Use Developments is noted - Council’s Manager
Development Services has accepted the Precinct
Committee’s invitation to address its April 2018 meeting.

6 Household Waste Service - United Resource
Management
A resident has reported that on 23 February 2018, URM was
observed placing both household waste and recycling waste
in the same truck. This occurred in all properties in
Fernhurst Street and some properties in Macpherson Street.
Would Council please investigate and advise?
Council’s Waste Management Officer advised that the
complaint raised in the minutes was forwarded to URM:
An investigation from URM’s CEO with Operations Manager and
Contract Supervisor included the following:
• All crews being interviewed that serviced the area
• GPS data and services being reviewed
• DVR recording cameras being reviewed
The URM company truck is fitted with GPS and DVR’s therefore we
were able to review the footage from last Friday 16 March 2018
whereby the crew can be seen to service the street in question.
Unfortunately the footage only goes as far back as the 26 February
2018 so we could not view the 23 February 2018. The footage from 16
March 2018 shows the crew in Fernhurst street at approx. 6.12am-
6.30am collecting only the Garbage bins. The crew will then return at
11.00am to collect the recycling. I have attached a small video of the
crew emptying the garbage and leaving the recycling behind for later
collection. The driver did state that he recalls the crew removing a large
quantity of polystyrene from 2 of the bins here but could not recall
which date this was and they did not leave a sticker nor did they report
it as they simply serviced the bins. The crew have since been reminded
of the correct process when dealing with contamination in recycle bins.
The crew today and from 16 March 2018 states that they have not mixed
recycling in with the waste stream. I can advise that one of the loaders
working on the truck on the 23 February 2018 is no longer with URM
and was not contactable. We will attempt contact again tomorrow to
question him also. We will again make this issue a topic at our next tool
box meeting to reiterate the requirements here and have all drivers and
loaders sign memos and tool box sign off documents.

URM’s CEO confirmed that drivers and loaders are constantly
reminded and again supervised in a fashion to deter this behaviour
preventing it from occurring. URM also have the onboard systems that
are also recording and assisting URM confirming that all locations that
require multiple services are receiving multiple visits on a daily basis.
February Cycleway concerns at the Grasmere Road and Young
Street Intersection
Council collected speed count data along Grasmere Road to
both the east and west of Young Street. This data indicates
that vehicle speeds along Grasmere Road have reduced
following the intersection works. Council is currently
awaiting camera footage of the intersection and will use this
to conduct further analysis of vehicle movements.
Precinct asks Council: When was the traffic monitoring
camera installed?
Council’s Sustainable Transport Project Coordinator has
advised that camera observations of the intersection were
collected for 28 November and 29 November 2017. Staff
have reviewed the footage and noted that the range of
behaviours observed at the site are generally consistent with
those seen at priority intersections.

3 Motion: Precinct supports clear signage regarding the rules
of dog control in Primrose Park similar to the signage in
other parks in the area such as St. Thomas' Rest Park and
Tunks Park.

Council’s Manager Parks and Reserves advised that Council
will look into improving the signage here at Primrose Park.
UPDATE (6 September 2018)
Council’s Manager Parks and Reserves has advised that
Council is currently looking into upgrading the naming
signage at all sports fields. This upgrade will include
wording around Dogs at each Park. It should be noted that
there is signage already installed at several locations
regarding dogs in parks.

4 Motion: Precinct requests Council erect a Community
Notice Board at Primrose Park in line with those at St.
Thomas’ Rest Park and Tunks Park. It should show clear
designated areas where dogs can be allowed off the leash
and the areas where they must be kept on the leash.
Council’s Community Information Officer has advised that
this request from the Precinct Committee will need to be
referred to the Councillors for the Forward Estimates for
2018/19.

UPDATE (9 April 2018)
Council’s Community Information Officer has advised that
the request for a noticeboard at Primrose Park is being
considered and options/quotes for an AO size board are
being investigated, although there is a bus shelter
noticeboard already on Earle St, just above Primrose Park so
there may be greater need for a board elsewhere. Generally,
if Precinct Committee require space, it is to advertise when
the next meeting is and this only requires one A5 or A4
space and therefore, one AO size board would more than
adequate for both Council notices and a Precinct Notice
every 6 weeks.
UPDATE (10 October 2018) Council’s Director Community & Library Services has
advised that there are no funds in the 2018/19 estimates for a
community noticeboard. Council’s Director Community &
Library Services also notes that on review of this request a

park sign regarding the dogs issue can be done cheaply and
practicably, and will be reviewed by Council.
6 Environmental Planning and Assessment Act Changes
The EP&A Act was amended on 23 November 2017 to the
Environmental Planning and Assessment Amendment Act.
The following changes have been made:
Development Applications
14 days public exhibition for local DAs
28 days for designated & State significant DAs
The days between 20th December and 10th January in any
year will be excluded from the count.
Local Strategic Planning Instruments
There is a new requirement for Councils to prepare Local
Strategic Planning Instruments (LSPs). Once published it is
mandatory for LEPs to give effect to the Strategic Plan.
Land and Environment Court
The Land & Environment Court has discretionary power to
declare a construction certificate invalid on the grounds of
inconsistency with the underlying development consent.

UPDATE (16 March 2018)
Council have put in a funding request to the RMS to design
upgrades to the intersection of Gerard Street and
MacPherson Street. We expect to hear from the RMS
regarding the outcome of this application around the middle
of 2018. The LATM Action Plans (formerly TAPAS) were

signals at Gerard Street and MacPherson Street intersection
have been included in the LATM Action Plan (Zone 5). For
further information about the LATM Action Plans please

Other actions in the LATM Action Plans include increasing
vegetation/ landscaping along the verges of MacPherson
Street to enhance the pedestrian amenity and provide a
buffer to passing traffic. There are no specific actions for
additional pedestrian facilities between Gerard Street and
Montague Street proposed in the LATM Action Plans.
MacPherson Street has AM and PM clearways on either side
of the street during peak periods. A pedestrian refuge would
reduce travel lanes in either direction from 2 lanes to 1 lane
in peak periods which would create a pinch point.
Therefore, a pedestrian refuge is unlikely to be supported by
the RMS. The proposed signalised crossing at Gerard Street
and MacPherson Street intersection would include
signalised pedestrian crossings across both Gerard Street
and MacPherson Street which would be a significant
improvement for pedestrian access across this busy road.
9 B-Line Issues:
Motion: Precinct notes with regret the removal of the bus
stop at Hale Road on Military Road and hopes Council will
use its best endeavours to prevent further removal of bus
stops including that at Prince Street.
