5. IMPACT OF THE RATIONALISATION PROCES OF THE AREAS OF JURISDICTION OF MAGISTERIAL DISTRICTS
Proposed Magisterial District Areas affected
Chief Albert Luthuli (Carolina and Eerstehoek)
A portion of Eerstehoek Magisterial District consisting of the farms, Schoonoord; Loenen; Granville
grove; Schoongezicht will be excised and included into the area of jurisdiction of the new Umjindi
Magisterial District (Barberton).
A portion of Ermelo magisterial district (Msukalingwa) consisting of the farms Op Goeden Hoop;
Welgemwent; Kroghshoop; Daspoort; Clarence; Lionsrock; The Brook and Ardentinn will be excised
and included into the new Chief Albert Lithuli Magisterial District (Carolina).
Umjindi (Barberton) The areas from Low’s Creek including Kaapmuiden up to Malelane SAPS precinct (western boundary
of Malelane’s SAPS policing areas) are excised from Malelane under Nkomazi and have are included
into the area of jurisdiction of the new Umjindi Magisterial District.
The periodical courts of Komatipoort and Malelane are excised from Barberton (Umjindi Magisterial
District) and included into the area of jurisdiction of Nkomazi Magisterial District. The following areas to

Bushbuckridge Magisterial District A portion of Mhala Sub-District consisting of the areas of Dwarsloop; Saselane; Xanthia and Ornoek are
excised and included in to Bushbuckridge and the following area Timbavati; Okkernootboom; Orpen
gate and Chavela gaza should be serviced by Archornhoek Periodical Court under Bushbuckridge,
namely The Dingleydale settlement be annexed to Mhala Sub-district and the following areas namely
Marite; Alexandria and Oakley should be serviced by Mkhuhlu Periodical Court.
Govan Mbeki A portion of Bethal magisterial district c onmsisting of the famrs; Banklaagte 254; Vaalbank 233;
Kuilfontein 234; Rietkuil 224; Vlaklaagte 223; Bankpan 225; Kalabasfontein 2323; Koppi 228 and
Uitgedacht 229 are excvised and included into the new Msukaligwa Magisterial District (Ermelo).
Dr JS Moroka Magisterial District
A portion of Moretele Magisterial District in the North West province is excised from Moretele into
Mbibana
(NB) These areas require a full-fledged court infrastructure as they are currently serviced from a Tribal
Authority building which was built by the community of Marapyane with no holding cells and ablution
facilities for awaiting trial prisoners.
A portion of Marble Hall consisting of the area of Toitskraal and Kgobokwane is excised and included
into the new Dr. JS Moroka Magisterial District (Mdutjana).
A portion of Mbibana Magisterial District consisting of the areas of Kameelpoort and Rietvallei is
excised and included into the area of jurisdiction of the new Thembisile Hani (KwaMhlanga).
Ramaphosa and Oorlog to be excised from Elias Motswaledi to Dr JS Moroka.
Thembisile Hani Thembisile Hani (Mkobola) court infrastructure to be upgraded to accommodate the new status of the
main seat.

Emalahleni Magisterial District A portion of Victor Khanye Magisterial District (Koningkrantz 536) is excised from the Victor Khanye
Magisterial District and included into the area of jurisdiction of the new Emalahleni Magisterial District
(Witbank).
Mbombela Magisterial District The Kanyamazane and Masoyi Periodical Courts to be elevated to the status of a local seat under
Nsikazi Sub-district. Kanyamazane Court is housed in the SAPS facility and it will require its own court
infrastructure.
Msukaligwa The Morgenzon Periodical Court is excised from Ermelo magisterial district and included into the area
of jurisdiction of the new Lekwa Magisterial District. (Standerton).
Mkhondo Amsterdam Place of Seating will be excised from Ermelo and included into the new Mkhondo
Magisterial District and be designated into a Full Services Detached Court (Sub-District).
Pixley Ka Seme Dirkiesdorp Periodical Court is excised from Wakkerstroom in Pixley Ka Seme and included into the
area of jurisdiction of the new Mkhondo Magisterial District (Piet Retief) and remain a periodical court
within the district.
Steve Tshwete Laersdrift farms to be excised from Middelburg (Steve Tshwete) and be included at Emakhazeni
municipality (Belfast) namely: Messchunfontein, Meddelkraal, Honingkloof, Swartkoppies, Witpoort,
Potjam, Welgevonden, De lagersdrift, Schieftpad, Hooggenoeg, Doornkloof, Enkeldoorn, Grootrietvley,
Lang-maar-small en Sterkloop.
Laersdrift Periodical court to remain in Mpumalanga transferred from Mpumalanga to Limpopoed
within a park home on the premises of the police station. This Periodical court requires an infrastructure
upgrade as it is currently dilapidated and not habitable.
Laersdrift SAPS is divided between the two provinces. SAPS needs additional infrastructure to service
Mpumalanga areas.
The following farms will have to be served by SAPS Middelburg while they remain under Emakhazeni

namely; Kleinfontein; Avontuur; Kluiitjiesfontein; Klipnek; Doornkloof; Nooitgedacht (2); Onverwacht;
Naaupoort; Welverdeiend; Klipspruit; Driefontein; Buffelskloof; Klipplaadrift; Fontein; Hoedspruit;
Rooikop; De roodekop; Ongezien; Uitkyk and Leeuwklip. Laersdrift Peridical Court and SAPS, together
with the adjourning farms are excised from Limpopo to Mpumalanga and will be serviced by Steve
Tshwete
R555 National Road to be used as a boundary for the jurisdiction of the Court up to Witpoort river
Nkomazi The two Periodical courts of Komatipoort and Malelane which were excised from Barberton (Umjindi)
and included into Nkomazi Magisterial District.

Laersdrift 29 August 2015 The community agrees that the area l remain under Middelburg
(Steve tshwete municipality) as it is easy for the community to
access transport to Middelburg than to Belfast.
Belfast, , Waterval Boven, Machadodorp,
and Stoffberg
24 August 2012 Incorporation of Watervaalboven Magisterial district into the
Municipal area of Emakhazeni. The incorporation of nine farms
which are situated in the extreme North of the Belfast Magisterial
district.
Marapyane 2 January 2015 Although this area is located within the Mpumalanga province, it
is served by the Moretele magisterial district in the North West
province. The community agreed that the entire portion that is in
the Mpumalanga province be served by the Mbibana sub-district
(DR JS Moroka) located within the Mpumalanga province..
Marapyane Village 23 February 2015 Pankop and Marapyane are within the boundaries of Dr JS
Moroka Municipality. The community attend court and access
other services provided by Moretele court which is
Hammanskraal.the community recommended that both areas of
Marapyane and Pankop with the population of 85 000 is to be
incorporated in the district of Mbibane in Mpumalanga Province.

Pankop village 25 February 2015 Pankop and Marapyane are within the boundaries of Dr JS
Moroka Municipality. The community attend court and access
other services provided by Moretele court which is
Hammanskraal.the community recommended that both areas of
Marapyane and Pankop with the population of 85 000 is to be
incorporated in the district of Mbibane in Mpumalanga Province
Oorlog 10 April 2015 Oorlog will fall under DR. JS Moroka. The community of Oorlog
chosed to be serviced by Mdutjana court. Mdutjana court is the
closest in proximity which is 10 km, Moutse is 30 km, Marble Hall
is 25 km.
Ramaphosa 2 May 2015 Ramaphosa will fall under DR. JS Moroka. The community of
Ramaphosa chosed to be serviced by Mdutjana court. Mdutjana
court is the closest in proximity.
Barberton Magistrate Court (community
meeting)
10 April 2015 The periodical courts of Komatipoort and Malelane are exercised
from Barberton and they will now be administered from Nkomazi
(Tonga). These changes will take place on 1st of October 2015.
