1. Background
The Queensland Government’s $518 million Advance Queensland economic plan is oriented to
creating an environment that fosters emerging and priority sectors with global growth potential.
As one of these priority sectors, Queensland’s superyacht industry plays an important role in
diversifying Queensland’s economy and creating jobs. The Superyacht Industry Development
Fund (SIDF) 2019-2020 has been created to enhance the contribution of eligible small to
medium enterprises (SMEs), not-for-profit organisations (NFPs), and industry peak bodies
operating in Queensland’s superyacht industry to the local economy. The SIDF is administered
by the Department of State Development, Manufacturing, Infrastructure and Planning (the
department), and is a priority action under the Queensland Government’s Superyacht Strategy
2018-2023.
Applications for financial assistance from the SIDF 2019-2020: International Certification and
Accreditation Funding may be submitted online from Tuesday, 17 December 2019 (AEST) to
5:00pm on Friday, 14 February 2020.
2. Program objective
The SIDF supports fulfilment of a key objective of Advancing Queensland’s Priorities, which is
to create jobs in a strong economy, and aligns with the department’s Strategic Direction by
supporting Queensland superyacht supply chain businesses to:
• increase their participation in targeted international trade events through making available
matched funding to offset expenses associated with their participation, and
• enhance their prospects of winning superyacht contracts through acquiring internationally-
recognised industry certification and accreditation that support the adoption of ‘lean’
manufacturing and associated operating practices.
Support for Queensland SMEs, NFPs, and industry peak bodies operating in Queensland’s
superyacht industry is therefore available through two separate streams of financial assistance
under the SIDF:
1. the International Certification and Accreditation Funding (ICAF) stream, which aims to
facilitate SY industry compliance with relevant international standards and marina
accreditation1 requirements, and
2. the International Market Engagement Funding (IMEF) stream, which aims to accelerate
SME and NFP engagement with overseas markets and exposure to international supply
chain opportunities and is accessible only through Queensland-based SY industry peak
bodies.
These Guidelines provide essential information to eligible organisations seeking financial
assistance under the ICAF stream to acquire the necessary certifications for business operating
in superyacht manufacturing, maintenance, services, refit and fit-out industry-related supply
chains.

3. Financial assistance
To be considered for ICAF assistance, an applicant must satisfy the eligibility criteria and
assessment criteria.
Financial assistance of up to $10,000 (excluding GST) in matched funding towards eligible
costs will be awarded to approved applicants. All approved applicants are:
• required to provide a cash contribution equal to at least 50% of total eligible costs, and
• permitted to apply for financial assistance from the ICAF for up to three certification
categories. However, the maximum amount an approved applicant can receive will not
exceed $10,000 (excluding GST) in total funding.
Section 5 of these Guidelines provides information on the eligible certifications and
accreditations, and eligible costs which can be reimbursed under the ICAF stream. Payment
of ICAF assistance will occur in arrears of eligible costs being incurred and satisfactory
evidence of payment provided to the department. Approved applicants will be required to enter
a funding agreement with the department with all funded activities to be completed within the
agreed funding period.
4. Eligibility criteria
To be eligible to receive ICAF assistance, applicants are required to:
• be either
− a SME that employs less than 200 people and operates in Queensland as a company
incorporated in Australia or an incorporated trustee on behalf of a trust, or
− a NFP incorporated in Queensland (restricted to yacht clubs, marinas, or similar
facilities with superyacht berths)
• be GST registered with a valid Australian Business Number (ABN)
• be engaged in the SY industry supply-chain, or demonstrate the capability and intention
to do so
• be able to and commit to funding at least 50% of eligible costs and 100% of ineligible
costs
• demonstrate compliance with Queensland’s industrial relations, and workplace health
and safety (WH&S) regulatory framework, and
• demonstrate a close and direct relationship exists between the application for ICAF
assistance and the premises in Queensland from where products, services, or systems
are produced or delivered.
Applications from the following entities will not be considered for funding:
• organisations acting as a representative for one or more SMEs
• SMEs with an associated entity that is certified or pursuing certification to one or more of
the eligible certification standards listed in section 5 of these Guidelines
• SMEs or NFPs operating for less than 1 year, and
• Federal, State and Local Government agencies or entities.

5. Eligible and ineligible costs
5.1 Eligible costs
Applicants will only be able to claim ICAF assistance for eligible costs that are incurred directly
in relation to the eligible certification or accreditation categories listed below.

5.2 Ineligible costs
Applicants will not be entitled to claim ICAF assistance for ineligible costs. Ineligible costs mean
costs and expenses associated with:
• eligible costs incurred, invoiced or paid for prior to the opening date for applications for the
ICAF specified in section 5.1 of these Guidelines
• certification of individuals to perform specific duties
• protection of intellectual property (if any) generated from undertaking systems reviews and
upgrades arising from the certification and accreditation activities
• legal advice relating to or arising from undertaking eligible activities or complying with
regulatory requirements
• acquisition, installation, and deployment of capital equipment (including software operating
systems and hardware) required for upgrading existing or implementing new systems to
meet certification or accreditation standards
• staff training as a requirement for organisational certification/accreditation, or for the use of
upgraded or new software operating systems and hardware installed to meet certification or
accreditation standards
• preparation of the application for ICAF assistance or related reports required as part of a
funding agreement between the approved applicant and the department, and
• works undertaken by auditors/consultants not accredited to perform certification activities.
6. Assessment criteria

building and has the financial capacity to meet the
mandatory matched cash contribution, and non-eligible
cost items related to the activity
• The activity can be undertaken and completed over an
18-month period (maximum timeframe)

Each application for financial assistance from ICAF will be assessed according to:
• whether the applicant meets the eligibility criteria
• the applicant’s response to the assessment criteria, and
• the outcomes of due diligence. This will involve bona fide checks, background and probity
searches, and financial capability assessment.
Applications submitted by applicants that do not meet all eligibility criteria will not progress to
assessment against the assessment criteria.
6.1 Assessment
All applications will be subject to assessment by the department and there is no assurance an eligible
applicant will be approved to receive financial assistance from the ICAF.
The State through the department may contact applicants during the assessment process to clarify
information in the application, and/or provide further information to enable comprehensive due diligence
and probity checks to be undertaken.
Adverse findings or unsatisfactory results from the due diligence appraisal may result in an application for
funding being rejected.
Each applicant will be informed in writing of the outcome of their application for financial assistance from
the ICAF. Applicants that are not approved to receive assistance from the ICAF are encouraged to seek
feedback from the Department.
The State’s decision regarding an application is final and cannot be appealed. If, however, an applicant
believes the assessment process outlined herein has not been adhered to, a formal complaint may be
submitted to the department via the department’s website.

7. Submitting an application
Applicants are to apply for funding by completing the electronic application form available from
the department’s website: https://www.statedevelopment.qld.gov.au/industry-
development/queensland-superyacht-strategy.html.
Applications that are submitted via email or in hard copy through Australia Post, a courier, or
hand delivery will not be considered for funding.
In submitting an application, all applicants must:
• demonstrate their eligibility for ICAF assistance
• include a project budget that identifies the source of the applicant’s matched cash
contributions
• include one or more official quotes from an
• include one or more official quotes from an Accredited Certifying Body, Classification
Society and/or independent expert assessor for marine accreditation
• include one or more official quotes from an appropriately qualified consultant for
undertaking pre-certification phases/tasks
• include evidence of appropriate insurance cover
• include financial statements from the previous financial year, which demonstrate the
current financial position of the applicant and bears evidence of having been prepared or
checked by a qualified accountant (i.e. CPA, CA, or PA qualified), and
• nominate those certification(s) or accreditation(s) from the list of eligible certifications and
accreditations (section 5.1) for which they seek ICAF assistance. A maximum of three
can be selected.
7.1 Important dates
Excluding the Opening and Closing dates for the submission of applications, all other dates
provided below are indicative only.

8. Media communications
All media enquiries or public announcements relating to the ICAF will be coordinated and
managed by the department’s media team. Where possible, relevant media and communication
activities in connection with funding will be undertaken jointly with approved applicants. All
approved applicants will be required to:
• obtain the department’s approval before making public statements, or contacting or
responding to the media regarding the outcome of applications to the ICAF
• provide at least 25 business days’ notice to the department of any proposed media event,
and
• provide any proposed media or public statement to the department for approval prior to its
release as well as making any changes or amendments to the form, content or manner
reasonably requested by the department.
9. Confidentiality
The department is responsible for managing all confidential information provided by applicants,
and internal documentation produced in relation to the administration of the ICAF.
Applicants must keep confidential any dealings with the department about their application,
including any offer of financial assistance from the ICAF, but may make disclosures to advisors
who are under an obligation of confidentiality, or if required by law. An applicant must also keep
confidential any information designated by the department as confidential.
The department reserves the right to publicly disclose the names of applicants, information
about the amount and timing of funding granted to applicants, a brief description of the activities
funded and details about the anticipated economic outcomes and benefits to the State that are
expected to result from funding the activities.
The department may also disclose confidential information of, or provided by, the applicant:
• if required to be disclosed by law
• to its advisors and assessors, in connection with the ICAF, including assessment of the
application and verification of information
• to comply with or meet applicable standards for accountability of public money or in
accordance with established governmental policies, procedures or protocols, or
• to a government agency.
For audit purposes, the department is required to retain applications and other supplied
supporting material. Successful applications will be retained for seven years and unsuccessful
applications retained for two years.

10. Advice and assistance
A list of frequently asked questions (FAQs) is available on the department’s website
https://www.statedevelopment.qld.gov.au/industry-development/queensland-superyacht-
strategy.html . Responses to questions asked after the opening of the ICAF will be added to the
FAQs. The department may, at its discretion, determine not to publish questions and responses
that do not have general application. Applicants should check the FAQs for updates prior to
submitting their application.

11. Tax
Grants allocated from the ICAF may constitute assessable business income for taxation
purposes. As the department does not provide advice to applicants on taxation matters, it is
recommended applicants seek independent tax advice regarding business tax obligations.
12. Glossary
Accredited certifying body: means a certification or inspection body that holds appropriate
accreditation issued by an Accrediting Body that is recognised by the International Accreditation
Forum
Assessment criteria: means the criteria listed in section 6 of these Guidelines
Associated entity: has the same meaning as under s50AAA of the Corporations Act 2001
Classification society: means any one of the twelve organisations that are members of the
International Association of Classification Societies
Eligible certifications and accreditations: means those listed in section 5 of these Guidelines.
Eligible costs: means the costs listed in section 5.1 of these Guidelines
Eligibility criteria: means the criteria listed in section 4 of these Guidelines
Ineligible costs: means the costs listed in section 5.2 of these Guidelines
SME: means an organisation that employs less than 200 people and is a company incorporated
in Australia or an incorporated trustee on behalf of a trust
SY: means superyacht

13. Terms and conditions
13.1 Reservation of rights
The department reserves the right to administer the ICAF and conduct the process for the
assessment and approval of applications in connection with the ICAF in such a manner as it
considers fit and to:
• change the structure, procedures, nature, scope or timing of, or alter the terms of participation
in, the process or overall ICAF (including timeframes and submission and compliance of
applications)
• take into account any information from its own and other sources (including other Government
agencies or advisors)
• consider or accept, or refuse to consider or accept any application which:
i. is lodged other than in accordance with these Guidelines
ii. is submitted after the relevant closing date for lodgement
iii. does not contain the information required by these Guidelines
iv. is otherwise non-conforming in any respect
• seek clarifications or additional information from, or provide clarifications or additional
information to, negotiate or deal with, or seek presentations or interviews from, any one or
more applicants
• conduct due diligence investigations in respect of any applicant and subject applications to
due diligence, technical, financial and economic appraisals
• require an applicant to clarify or substantiate any claims, assumptions or commitment
contained in an application or provide any additional information
• terminate further participation of any applicant in the application process relating to the ICAF
for any reason, which includes termination due to a material change to information presented
in an application
• terminate or reinstate the ICAF or any process in the ICAF
• allow the withdrawal of, or addition of, any applicant after the closing date, and
• conduct negotiations with any one or more applicants after applications have been lodged.
Under these Guidelines, where it is stated the department may exercise a right or discretion or
perform any act or omit to perform any act, then unless stated otherwise the department may do
so at its sole and absolute discretion and will not be required to act, or be restrained from acting,
in any way or for any reason nor to take into account the interests of any third party (including the
applicants). If the department does exercise any of its rights under these Guidelines, then the
department may inform any or all applicants although will not be under any obligation to do so.

13.2 No relationship
The department’s obligations regarding the application process are limited to these expressly
stated in these Guidelines.
Subject to section 13.7, no contractual or legal relationship exists between the department and
an applicant in connection with the ICAF, these Guidelines or the application process or any stage
of the ICAF.
An applicant, or its representatives:
• has no authority or power, and must not purport to have the authority or power to bind the
department, or make representations on behalf of the department
• must not hold itself out or engage in any conduct or make any representation which may
suggest to any person that the applicant is for any purpose an employee, agent, partner or
joint-venturer with the department, and
• must not represent to any person that the department is a party to the proposed activity other
than as a potential funder, subject to the application process and confidentiality obligations
detailed in these Guidelines.
13.3 Participation at applicant’s cost
Each applicant that applies for assistance from the ICAF does so at its own cost and risk.
To the extent permitted by law, no applicant will have any claim of any kind whatsoever against
the department whether in contract, tort (including negligence), equity, under statute or otherwise
arising from or in connection with:
• any costs, expenses, losses or liabilities suffered or incurred by the applicant in preparing and
submitting its application (including any amendments, requests for further information by the
department, attendance at meetings or involvement in discussions) or otherwise in connection
with the ICAF
• the department at any time exercising or failing to exercise, in its absolute discretion, any rights
it has under or in connection with the ICAF, and
• any of the matters or things relevant to its application or the ICAF in respect of which the
applicant must satisfy itself under these Guidelines. Without limiting the foregoing, if the
department cancels or varies the ICAF at any time, does not select any applicant following its
assessment of the applications, or does (or fails to do) any other thing referred to under these
Guidelines, no applicant will have any claim against the department arising from or in
connection with any costs, expenses, losses, or liabilities incurred by the applicant in preparing
and submitting its application or otherwise in connection with or in relation to (whether directly
or indirectly) the ICAF.

13.4 Applicants are to make their own enquiries
These Guidelines have been prepared to give potential applicants background information in
relation to the ICAF. These Guidelines do not, and do not purport to contain all the information
that applicants may require in reaching decisions in relation to whether to apply for financial
assistance from the ICAF. Applicants must form their own views as to what information is relevant
to such decisions and obtain their own independent legal, financial, tax and other advice in relation
to information in these Guidelines or otherwise made available to them during the application
process.
The department accepts no responsibility whether arising from negligence or otherwise (except a
liability that cannot lawfully be excluded) for any reliance placed upon the information supplied by
it in connection with the ICAF or interpretations placed on the information by applicants.
13.5 Intellectual property
Any intellectual property rights that may exist in an application will remain the property of the
applicant or the rightful owner of those intellectual property rights. Any part of an application
considered to contain any intellectual property rights should be clearly identified by the applicant.
The applicant grants to the department (and will ensure that relevant third parties grant) a non-
exclusive, irrevocable licence to use and reproduce the intellectual property in an application for
administering the application in relation to the ICAF.
13.6 Privacy
In this section, Personal Information has the meaning given to that term in the Information Privacy
Act 2009 (Qld).
Personal information collected as part of the application and assessment process will be used by
the department and disclosed to third parties for purposes in connection with the assessment of
applications (and if an application is successful, in connection with administration of any
subsequent agreement). The department will otherwise deal with personal information provided
to it in accordance with the Information Privacy Act 2009.
13.7 Acceptance
By applying for financial assistance from the ICAF, each applicant:
• warrants to the department that the information contained in its application, including its
attachments and any information provided in connection with the application, is true,
accurate and complete as at the date on which it is submitted and not by omission
misleading, and may be relied on by the department in determining whether to provide
financial assistance to the applicant under the ICAF
• undertakes to promptly notify the department if it becomes aware of any change in
circumstances which causes the information contained in its application to become
inaccurate or incomplete in a material respect

• acknowledges that the department will rely on the above warranty and undertaking when
evaluating the application
• acknowledges that the department may elect to remove an applicant or elect not to further
consider an application at any stage because of material changes to the information
presented in its application, and
• is taken to have accepted these Guidelines, including the terms and conditions, and warrants
for the benefit of the department it will not breach these Guidelines or seek to bring any claim,
of any kind whatsoever, against the department which is precluded by these Guidelines.
