SURVEY OF RULES OF PROCEDURE FOR CONFERENCES OF STATES PARTIES GOVERNING INTERNATIONAL TREATIES
ThefirstmeetingoftheConferenceofStatesParties(CSP)fortheArmsTradeTreaty(ATT)issettotakeplacewithinthefirstyearaftertheATTentersintoforce.OneofthecriticaltasksthefirstCSPwillundertakeistheadoptionoftheCSPRulesofProcedure,whichwillgovernitsactivitiesforyearstocome.InadvanceofthefirstCSP,ATTLegal1reviewedtheRulesofProcedurefortheConferencesofStateParties(CSPs)of19differentinternationaltreaties,primarilyintheareasofdisarmamentandarmscontrol,humanrightsandhumanitarianlaw,environmentalprotection,andcrimeandcorruption.
Inselectingthetreatiesforthissurvey,wetookintoaccountthesubjectmatterofthetreatyandtheexistenceofanactiveConferenceofStatesPartiesgoverningthattreaty.Withregardtosubjectmatter,weincludedtreatiesthattouchonissuesormechanismslikelycoveredbytheATT,suchasarmscontrolandinternationalhumanrightsandhumanitarianlaw.WealsoincludedtreatiesthathaveatraderegulationorcrimepreventionelementtoaddresstheATT’sconcernwiththeillicittradeofconventionalarms.Wesoughttoincludethe“core”treatiesineachoftheseareas,andfromthere,weselectedthosethataregovernedbyaConferenceofStatesParties(orinsomecases,aReviewConference)withproceduralrulesthatcoversimilarareascontemplatedbytheproposedCSPfortheATT.
Thissurvey,whichfocusesonCSPparticipation,isthesecondinaseriesproducedbyATTLegalandisdesignedspecificallyasaref-erenceandresearchtoolforgovernmentsandcivilsocietyorganizationstoassistindevelopingtheCSPfortheATT.Whilethissurveyisinnowayexhaustive,itsaimistoprovideabasisfordiscussionandfurtherresearch.
PARTICIPATION
Justaswithdecision-makingprocedures,thelevelofparticipationaffordedtoStatesParties,signatories,regionalorganizations,inter-governmentalorganizations,theUnitedNationsandnon-governmentalorganizations(NGOs)inConferencesofStateParties(ConferencesorCSPs)canalsoaffecttheoverallefficiencyandeffectivenessoftreatygovernance.
Please notethatthissurveyincludesonlythoseprovisionsrelatedtoparticipationintheMeetingsorConferencesofStatesPartiesassetforthintheCSPRulesofProcedureforeachtreaty.Itdoesnottakeintoaccountparticipationmodalitiessetforthinotherdocuments,orthepatternsandpracticesdevelopedovertimethatmayexistinthecontextofeachindividualtreatybody.
Ofthe19setsofCSPRulesofProcedurereviewed,8CSPsprovidespecificparticipationproceduresforsignatorystates,and12CSPsoutlinespecificguidelinesforNGOparticipation.Ofthe8CSPRulesofProcedurethatincludesignatoryprovisions,5CSPsindicatethatsigna-torystatesmayparticipateorberepresentedintheCSPmeetingswithoutvote,1CSPpermitssignatoriestoparticipateasobservers(CRPD)and2CSPsindicatethatsignatoriescanparticipateinthe“deliberativeprocessoftheConference”(CTOLandUNCAC).

Ofthe19setsofCSPRulesofProcedurecovered,13CSPsprovideforNGOparticipation.2WhiletheMineBanTreatyandtheCCMprovidethebroadestlevelofparticipation,mostCSPspermitNGOs,ataminimum,toattendpublicplenarymeetingsandreceiveConferencedocuments.Additionally,5CSPsspecificallypermitNGOstomakeoralstatementsinplenarysessions.
RegionalEconomicIntegrationOrganizations(REIOs)arepermittedtosign,ratifyoraccedeto4ofthetreatiescovered(CRPD,BaselConvention,CTOCandUNCAC).Assuch,theREIOsthatsignorratifythesetreatiesarepermittedtoparticipateandtovote(withcertainlimitations)alongwiththeStatesPartiesintheConferencesofStatesParties.
Disarmament and Arms Control
TheDisarmamentandArmsControlsectionincludestheRulesofProcedurefor5ofthemajortreatiesinthisfield.3Only2CSPs(BWCandCWC)providespecificprovisionsforsignatorystates.BothallowforsignatoryStatestoparticipatewithoutvoteintheCSPs“withpriorwrittennotification”totheSecretaryGeneral/DirectorGeneraloftheConference.Also,theBWCandCWCallowsignatoryStatestosubmittheirviewsinwriting–theBWCas“Conferencedocuments”,andtheCWC,onlytothedelegates.
TheCSPRulesofProcedurefortheMineBanTreatyandtheConventiononClusterMunition(CCM)aredistinctfromalloftheothertreatiescoveredinthissurvey.Insteadofidentifyingtheactionsandactivitiesthatobserversarepermittedtotake,thesetwotreatiesidentifytheactionsandactivitiesthatobserversMAYNOTundertake.
Ofthe5DisarmamentandArmsControltreatiescovered,3CSPsinthissection(NPT,BWCandCWC)allowNGOstoattendpublicmeetingsand1CSP(CWC)permitsNGOstoparticipateinactivitiesofreviewconferences.Assetforthabove,theMineBanTreatyandtheCCMprovidethebroadestparticipationforNGOsinthisgroupbypermittinggeneralparticipationasobserverswithjustafewspecificrestric-tions.
Human Rights and Humanitarian Law
Incontrastwiththeothertopicscoveredinthissurvey,theRulesofProcedureformanyofCSPsintheHumanRightsandHumanitar-ianLawareaprovideverylittleguidancewithregardtoparticipation.WiththeexceptionoftheCRPD,theCSPscoveredONLYprovidefortheparticipationofStatePartiesandtheSecretaryGeneraloftheUnitedNations(UNSG)anddonotsetoutguidelinesfortheparticipationofintergovernmentalorganizationsorNGOs.However,alloftheCSPscoveredinthissectionreferencetheRulesofProcedurefortheUnitedNationsGeneralAssemblyforanyotherproceduralmattersarisingattheMeetingofStatesPartiesnotcoveredbytheRulesofProcedureofthetreaties.

Crime and Corruption
All3setsofCSPRulesofProceduressurveyedintheCrimeandCorruptionsectionprovidespecificguidelinesforsignatorystates.TheAssemblyofStatesPartiesfortheICCpermitssignatorystatestoberepresentedwithoutvoteandtosubmitwrittenstatementstoStatePar-tiesandObserverStates.TheConferencesfortheCTOCandUNCACallowsignatoriestoattendmeetings,deliverstatementstotheConfer-ence,receivedocuments,submitviewsinwritingand“participateinthedeliberativeprocess”. XII.PublicandprivatemeetingsRule40-Generalprinciples-1.TheplenarymeetingsoftheConferenceshallnormallybeheldinpublicunlesstheConferencedecidesotherwise.2.Meetingsofthebureaushallbeheldinprivateunlessthebureaudecidesotherwise.3.DecisionsoftheConferencetakenataprivatemeetingshallbeannouncedatthefollowingpublicmeeting.

Rule49-1.EachPartyshallhaveonevote,exceptasprovidedforinparagraph2.2.Regionaleconomicintegrationorganizations,inmatterswithintheircompetence,shallexercisetheirrighttovotewithanumberofvotesequaltothenumberoftheirMemberStatesthatarePartiestotheConvention.SuchanorganizationshallnotexerciseitsrighttovoteifanyofitsMemberStatesexercisesitsright,andviceversa.
