Executive Summary

This Statement of Environmental Effects is in support of a Development Application for construction of an Indoor MotoX Park complex, which will comprise of covered arena utilised for motor cross bike activities, a large open area carpark and front of house facilities. A significant feature of the proposed development is an air supported structure which is formed with prefabricated flexible fabric.

The proposal aims to provide riders, year round access to all weather tracks, in a controlled and safe environment for all ages and riding ability. The location has excellent access to motorways and is situated in one of Sydney’s best known recreation and entertainment areas of the Western Suburbs. The proposal will importantly divert junior and senior riders from illegally accessing vacant council lands and reserves into a first class supervised legal motorcycle riding facility. The activity will complement the current activities of Eastern Creek International Karting and the events held at Sydney Motor Sport Park that adjoins the site. The sites zoning is uniquely suitable to this activity, with the proposed design complying and providing consistency with Blacktown City Council Local Environmental Plan 2015 and Development Control Plan 2015 objectives, in addition to other relevant state planning controls.

The Statement of Environmental Effects (SEE) demonstrates that the proposal will not have significant detrimental impacts on the natural or built environment. It is evidenced in this SEE that the potential environmental impacts can be managed.

The proposal also facilitates the achievement of Councils recreational policies through the provision of an additional sporting facility on land that has been set aside for that purpose. Based on the assessment undertaken in this SEE, Council’s approval of the Development Application is sought.

1 Introduction The development application submitted by Sydney Indoor MotoX Park Pty Ltd to Blacktown City Council is for a proposed indoor motocross facility which consists of a covered arena area utilised for motor cross bike activities, a large open area carpark and front of house facilities. A significant feature of the proposed development is an air supported structure which is formed with prefabricated flexible fabric.

Risk Environment Services Pty Ltd was commissioned by Sydney Indoor MotoX Park Pty Ltd to prepare a Statement of Environmental Effects as part of the Development Application (DA) for the proposed facility at 50 Peter Brock Drive, Eastern Creek. The site is zoned Private Recreation under BLEP 2015 and partly General Industrial under SEPPWSEA (LZN-009 & 014) and provides permissible development.

A formal pre-lodgement meeting was held with Blacktown Council on 29 June 2017. A detailed planning appraisal via this statement of environmental effects and supportive information prepared by expert consultants has reviewed the issues covered at the pre-lodgement meeting. [Refer SIMX21]

2 Site Details and Suitability The subject site is legally identified as Lot 4 DP 1079897 and is known as No. 50 Peter Brock Drive, Eastern Creek. The site is bordered to the north by the M4 Westbound Service Centre and the M4 motorway, east are industrial premises, south and south-west is Sydney Motor Sport Park (Eastern Creek Raceway) and north-west are industrial premises.

50 Peter Brock Drive, Eastern Creek is a ‘brownfield’ site that currently accommodates Eastern Creek International Karting on the central and northern portions of the site. The proposed development would be situated within the south-west corner of the site with car parking provided on the central southern portion of the site.

The nearest residential zoning in proximity to the development is located to the north-east, south and north-west. To the north/north-west adjacent the subject site and Eastern Creek International Karting are industrial premises fronting Peter Brock Drive. Analysis of the closest residential receivers is detailed in the Acoustics report. [Refer SIMX01]

The proposed development is seeking approval to operate from 7:00am to 10:00pm Monday to Saturday, and 8:00am to 10:00pm Sunday and Public Holidays, to align with the existing Eastern Creek International Karting operating conditions. Routine operational hours are however expected to be confined 9.00am to 9.00pm.

The section of site, subject to this approval comprises of a sub-lease that has been consented to by NSW Department of Planning and Sport from Eastern Creek Carts Pty Ltd to Sydney Indoor Motocross Park Pty Ltd of 10,000m2 situated in the south western corner of Lot 4 DP 1079897. [Refer SIMX09]

The current zoning and surrounding development provide a uniquely compatible site for the proposal. The location is currently a recreational precinct with the existing facility bordering the site being Sydney MotorSport Park and the co-located eastern Creek International Karting. The remaining land use surrounding the site is industrial and reserve bushland maintained by Sydney Water. The southern site border is adjacent to Endeavour Energy 132 kV high voltage transmission towers and conductors, with an accompanying easement. Consent has been obtained from Endeavour Energy [Refer SIMX19]

The development will feature an impressive new dome structure, occupying unused flat ground at the rear of the Karting circuit. The building profile will complement the existing recreational precinct and not provide any adverse impacts on neighbouring activities. Further specific site details are addressed throughout Section 6 in this report.

The development will enjoy the same proximity to transport services, shops and community that the existing recreational precinct currently accesses.

3 Previous and Present Land and Building Use The site has been operating as Eastern Creek International Karting Raceway since 1997. Approval was provided for facility operation and construction of the following buildings:

• Kart Hire building

• Equipment store

• Kart Scales store

• Administration and Facilities building

• Caretakers flat

• Race administration and toilets building

• Hire Kart Control Tower and Office

• Competition Control tower Prior to the existing use approved, the site was undeveloped. We are not aware of any present or previous use of the site that is a potentially contaminating activity or that the site is contaminated land. As set out above the site is adjoined by industrial premises on Peter Brock Dr, recreational from Sydney MotorSport Park and reserve bushland managed by Sydney Water.

4 Operational Management

The development proposal consists of an Indoor Motor X Park within an air filled dome structure. The operational aspects of the facility will include: MotoX Track (2 Tracks) • Track one has a length of 350m and an average width of 4.5m covering 2500 m2 and

is designed for junior / beginner riders.

• Track two has a length of 800m and average width of 4.5m covering 4500 m2 and is designed for senior / more experienced riders.

• Hours of operation for both tracks will be 9.00am to 9.00pm, 7 days per week; both tracks are open to the public.

• Maximum of 50 riders on both tracks at any one time and 4 staff members are to be employed that will include safety, marshalling and scrutineering duties.

• The tracks will comply with national standards prescribed by Motorcycling NSW.

• The facility will be inspected by NSW Police, Fire and Rescue NSW and SafeWork NSW to provide baseline compliance with the motor x parks safety management system.

Registration / Administration • The cashier will function throughout operational hours and will process bookings,

allocation of time sessions and verify identification of riders.

• 2 staff members will be employed to manage this function. Café / Merchandise shop • A café style shop will be open throughout operational hours for purchase of light food

and beverages that will be catered and prepared off-site and Sydney Indoor MotoX Park merchandise.

• 2 staff members will be employed to manage this part of the business. Motorcycle Hire / Mechanic • A combined facility to coordinate additional hire motorcycles, purchase of related riding

accessories, and basic mechanical services will be available during operational hours.

• 2 staff members will be employed to manage this service. Ancillary Works • 200 car parking spaces will be provided to cater for the facility, that will include 40 car

and trailer spaces.

• An area for overflow car parking spaces will also be provided for up to an additional 200 cars within the grounds of Eastern Creek International Karting.

• A further overflow for car parking spaces can be negotiated with Sydney MotorSport Park via the western boundary of the proposals site for special events.

5 Permissability and Assessment of Environmental Effects

Planning Instrument / control

Evidence of compliance / comment

State Environmental Planning Policy (Western Sydney Employment Area)

The proposed application meets the objectives of the ‘General – Industrial’ zoning of the land via this policy by providing employment opportunities along the Motorway corridor and additionally providing for small scale local services.

The development is situated within Precinct No 4 Raceway of this policy. The principal development are addressed as follows:

-The structures height will impact the amenity of adjacent residential developments (no adjoining residential land -nearest residential dwelling is approx. 2km) -Ecological sustainability has been addressed by NorthRops report and rainwater harvesting has been detailed in an Integrated Water Cycle Management Strategy. -The development will not require a sub division and is wholly contained within Lot 4 DP 1079897. -The public utility infrastructure including water, electricity, sewerage is presently available to the site. -The site is not affected by proposed roads (transport infrastructure routes) as detailed in the policies ‘Infrastructure Plan Map’. -There are no known factors requiring an exception to the development standard of this planning policy.

State Environmental Planning Policy 33 – Hazardous and Offensive development

A review of SEPP33 criteria confirms that the proposed development does not meet the criteria for a hazardous industry or storage establishment.

A risk screening has been conducted and concludes that a separate SEPP33 assessment will not be required as controls will be applied to exclude fuel cans/storage from the facility. (20m away in car park)

Fuel replenishment may be conducted at any time via the M4 twin service stations, located on the northern side of Peter Brock drive directly opposite the facility.

State Environmental Planning Policy No 55 – Remediation of Land

The application does not include a zoning or rezoning submission. There are no ‘clean up’ notices produced by the Environmental Protection Authority under POE Act for the site nor site remediation orders by any regulator.

Council has not listed the land as a contaminated site and has previously considered site contamination in earlier assessments of the Eastern Creek International Karting.

There are no indicators that further investigation of potential site contamination is warranted.

Sydney Regional Environmental Plan No 20 – Hawkesbury River (No 2-1997)

In consideration of specific strategies to protect the Hawkesbury Nepean River system, the development proposal will not result in any negative impacts. Coring has developed soil profiles and and chemical testing conducted on surface layers to identify existing site characteristics from a GeoTechnical report. [refer Section 6.3]

Section 6.3 demonstrates that appropriate controls are proposed to address soil erosion and sedimentation movement and will address total catchment management.

The site is not identified as an environmentally sensitive area and the proposed activities on site combined with the controls detailed in Section 6 will not impact water quality or water quantity of the Nepean Hawkesbury River system.

Cultural Heritage and Flora and Fauna assessments are provided in Section 6.5 and 6.9 respectively.

The site is not part of the river corridor and will not impact agriculture or fishing activities, nor are rural or urban development controls for the river relevant to this application.

The application does not impact upon the Nepean / Hawkesbury River’s tourism or recreational features. The development will complement the Metropolitan strategy in regard to waste disposal and roadways and carparks on water quality [refer Section 6.3 and 6.6 ]

Waste management, reduction, recycling are further addressed in Sect 6.6. There are no foreseeable impacts from climate change or measurable impacts from conservation of natural resources.

Blacktown Local Environmental Plan 2015 (BLEP 2015)

Consistency with objectives of BLEP 2015 and zoning of Private Recreation LZN_009 is demonstrated via:

-The proposal is permissible and the principal development standards and miscellaneous provisions have been reviewed. -The minimum subdivision requirements are not applicable. -Restriction on height of buildings map HOB_009 are not prescribed.

Blacktown Development Control Plan 2015 (BDCP 2015)

Consistency with objectives of BDCP 2015 and the General Industrial Zoning is demonstrated via the following:

Part A -Areas requiring fill are limited and displayed at Civil Package p6 [Refer SIMX Civil Drawing] -Tree preservation and future planning is addressed in Section 6.9 [Refer SIMX03] -Heritage issues have been assessed in Section 6.5 -Pollution Control have been addressed in Section 6.3 -Noise reduction has been analysed in Section 6.2 -A traffic impact report and parking plan has been prepared in Section 6.1 -The sites services are considered at Section 2 -Solar access has been mapped at Figure 4 Section 6.10 -Proposed retaining walls and ground reshaping is displayed Civil Package p6 [Refer SIMX Civil Drawing] -Crime Prevention through Environmental Design has been considered in Section 6.12 Part E -The general design guidelines for development have been reviewed: -The proposed development will not encroach any minimum setbacks and

6 Key Planning Considerations

6.1 Traffic, Parking and General Accessibilty

A Parking and Impact Assessment Report has been prepared by Greys Australia Pty Ltd, dated 02 September 2017. The report considered the sites traffic generation, impacts upon surrounding roads, by assessing existing and proposed traffic volumes during peak hour periods. Public transport accessibility and facilities within proximity to the site were identified. [Refer SIMX15] On site car parking requirements were assessed against Blacktown Councils Development Control Plan and RTA Guide to Traffic Generating Developments 2002, whilst internal roads and parking layout was assessed against AS 2890.1. The suitability of site access / egress arrangements has been reviewed and advice has been provided to the design team of these requirements. The assessment has fully considered the Eastern Creek International Karting facility and is conditional on proposed upgrading of shared driveway for site access. The report concludes that the proposed parking layout is designed in accordance to AS2890.1 and acknowledges the development allowance for 200 car parking spaces

the position of the structure on rear of site will accommodate and acceptable scale and bulk when viewed from the street. -The landscape plans will provide a high standard of environmental quality, will minimise the loss of existing vegetation, including tree protection during construction and suitable replanting of indigenous species. -There are identified land use conflicts and no adjoining residential land. -The unique design of an air filled dome structure will achieve an aesthetic standard. The schedule of external building finishes is consistent with the existing structures on site. -Vehicular access, circulation and car parking is detailed in Section 6.1 -Specific controls for B7 Business Park and Huntingwood Industrial estate are not applicable. Part J

Attached Integrated Water Cycle Management Strategy [Refer SIMX17]

The proposed development is not within 40m of a watercourse, therefore Section 4.2 (Waterfront Lands) does not apply. The proposed development will have in excess 150m2 impervious area. As such, Sections 4.3 (Water Conservation), Section 4.4 (Stormwater – water quality and waterway stability) and Section 4.5 (Stormwater – detention) apply. The proposed development includes activities that will result in soil disturbance and placement of fill. Therefore, Section 4.6 (Stormwater – Erosion, Sediment and Pollution Control) applies. The proposed development is more than 50m from a watercourse AND is proposed to have cut and fill less than 1.5m. Therefore Section 4.7 (Groundwater) does not apply. The proposed development is located within the North West Growth Centre boundary, therefore an Integrated Water Cycle Management Strategy is required to be produced in accordance with Appendix 1 of Part J. A Drainage Plan showing all stormwater controls is required in accordance with Appendix 1 of Part J. An Erosion and Sediment Control Plan is required to be submitted in accordance with Appendix 2 of Part J. Works as Executed Plans are required after construction.

(including 40 tandem - car trailer) will exceed the future anticipated future car parking demand including parking overflow from the existing Eastern Creek Karting facility on the shared site. [Refer Figure 1 below] The report further indicates that the results of the peak hour analysis and intersection assessment that the development is sustainable in transport terms, with acceptable impacts on the local transport network.

6.2 Air and Noise

An Environmental Noise Assessment report has been completed by Acoustic Consulting Engineers. [Refer SIMX01] The assessment identified likely sources of noise by the development, identified potentially affected noise receivers, established the existing noise environment, established objectives for operating hours, predicted and assessed environmental noise from motorcycles and recommended measures to minimise impacts on adjacent residential receivers. Noise monitoring was conducted at the closest residential receivers at locations across Blacktown and Horsley Park. Dominant noise sources were identified as local and distant road traffic and existing noise measured throughout proposed operating times. Objectives were set at these locations in accordance with EPA Industrial Noise Policy. Operational noise sources were measured and estimated from motorcycles operating simultaneously. Based on the recommendations presented in this report a further acoustic assessment should be prepared as part of the Construction Certificate documentation, once further emission levels are available from the mechanical plant and equipment. In regard to the primary operation of motorcycle activity the following measures are recommended:

• Accommodate motorcycle type and numbers consistent with modelling assumptions

• Contain motorcycle activities within the dome structure

• Dome fabrication to comprise triple skin layer structure as specified by Arizon Structures

• Restrict use of motorcycles to hours of operation proposed

• Additional review on public address system to be proposed Addressing these recommendations will achieve project specific noise levels / noise assessment projections at residential and industrial receivers to 10.00pm. A Wind Assessment to AS1170.2 has been completed by NorthRop. This report has been provided to the dome designers for review. The report outlines the site wind speeds to which the dome structure will need to be designed in order to comply with Australian Standards. Internal air quality and temperature will be regulated by the facilities custom designed mechanical equipment componentry air tempering. The structure will supported by a primary inflation system and backup system to maintain air pressure in the wall layers of the dome. The system will be supported by remote control functions and a wind sensor.

6.3 Drainage, Soil and Water

The On-site Stormwater Detention (OSD) and Water Quality measures are provided to comply with Blacktown Council’s requirements. An Integrated Water Cycle Management Strategy has been prepared by NorthRop Consulting Engineers. The report details controls for water conservation, stormwater (water quality and waterway stability; and detention). [Refer SIMX17] A below ground OSD tank, external to the dome structure will constructed with multiple grated access to the tank at 4m centres. A water quality device, the Stormwater360 Jellyfish 3250 will be installed to provide adequate pollutant removal targets. An additional below ground rainwater re-use tank (RWT) with a volume of 100kL, will be located at the eastern face of the building with external access. The overflow from the RWT will connect to the OSD tank. The dome will also have a grated trench drain to surround the perimeter. A further below ground OSD will be positioned within the carpark. Please refer to site plan for location of on-site stormwater detention. [Refer SIMX Civil Drawings] The maintenance and monitoring of rain tanks, pumps, fixtures, UV disinfection, onsite stormwater detention, jellyfish device, and enviropod inserts are described with frequency in the integrated report. A salinity assessment was completed by Ideal GeoTech in September 2017, that comprised of bore holes to determine subsurface soil profiles to 3m, and soil sampling of surface layers to 2.5m. This analysis has provided advice on potential footing structures, allowable bearing capacity, chemical testing to determine aggressiveness to steel and concrete. The report further confirmed groundwater was not encountered during boring. [Refer SIMX11]

6.4 Erosion and Sediment Control

A comprehensive sediment and erosion plan has been prepared within the Civil Package [ Refer SIMX Civil Drawings]. Maps and detail is provided for stabilised site access, inlet

filter/sediment traps, mesh and gravel inlet filter, sediment fence, earth basins, stockpiles and catch drains. Sedimentation and erosion control measures will be put in place and maintained during construction and operation to ensure that soil material does not enter surrounding properties as explained below:

• All trafficable areas on the site will be maintained in an adequate condition which will minimise the generation or emission of windblown or traffic generated dust from the site at all times.

• Any top soil stripping of the site will be undertaken when there is sufficient moisture content in the soil to minimise dust generation.

• Any plant and equipment will not be used on exceptionally windy or dry days to prevent dust generation.

• Dust suppression techniques, including water karts and spraying, will be used as necessary, particularly where vehicles are using temporary access routes, prior to sealing the car park and main access road.

• Vehicles driving along temporary access routes will be limited to a maximum of 10km/hr to limit generation of dust.

6.5 Local Heritage

The subject land does not contain any known aboriginal archaeological constraints to the development proposal. However should archaeological material be uncovered during construction activities within the proposed development, then all construction are to cease immediately and representatives of the National Parks and Wildlife Service will be consulted with. The subject land does not contain any items of heritage significance in terms of buildings or landscape. The Blacktown Development Control Plan 2015 does not include this site in areas mapped as ‘High Archaeological Significance’.

6.6 Efficiency and Sustainability

Specifications for rainwater reuse on site are detailed in the civil package [Refer SIMX Civil Drawings]. The Integrated Water Cycle Strategy [Refer SIMX17] details the storm water and water quality measures that will be implemented. At a construction certificate stage, additional energy efficiency measures will be in place.

6.7 Waste Management

Waste management for the site will not require any complex arrangements due to the nature of construction and ongoing activities. A waste management plan has been prepared by JF Architects on 17 September 2017 and has been categorised into 3 stages of demolition, construction, and ongoing waste management. The plan [Refer SIMX16] estimates volumes per week for contractor waste collection of general and recyclable. A waste collection truck access has been considered in the Parking & Traffic Impact Assessment Report. A waste truck with an overall length of 8.8m was simulated in AutoTURN for this assessment. Refer to Parking Layout Figure in Section 6.1 of this report.

6.8 Reflectivity & Colour Schedule

A schedule of external building finishes accompanies is attached. The colour scheme is consistent with surrounding structures with Eastern Creek International Karting. [Refer SIMX Architectural Drawings DA002]

6.9 Flora and Fauna

The subject land has been previously cleared of native vegetation, with some remaining regrowth and undergrowth in the south west corner that contains a small stand of native eucalypts trees. As a result the land does not support any physical characteristics to indicate that this proposed development may adversely impact upon threatened species, populations or ecological communities or their habitats. In consideration of the proposed developments impact, an Arboriculturalist Impact report assessment report was prepared by Arborists Network (Mark Hartley) on 30 August 2018. The reports identifies that the proposed two lane access road along the southern and western boundary, will require the removal of 6 trees within the proposed road footpath.[Refer SIMX03] An additional 6 trees will also be required to be removed to allow the construction of the motox park dome. Some further trees in the south west corner have been identified that will be close to construction activities and will require to be protected. A site specific Tree Protection Plan (specification and drawing) have been prepared. [Refer SIMX03] A series of Landscape Plans prepared by Eden Renewed Gardens and Landscapes have been prepared detailing proposed plantings of canopy trees, shrubs and ground covers for the MotoX Park. 6.10 Privacy Views and Overshadowing

The proposed facility does not have any residential neighbours and adjoins industrial sites to the east and west. The northern border and access road Peter Brock Drive, runs parallel to the M4 Motorway. The southern border adjoins the Sydney Water reserve land containing Prospect Reservoir.

The structures site location on Lot 4 DP 1079897 will not ‘overshadow’ the current Eastern Creek Carting operations and its positioning will provide spatial separation from the existing sporting activities. The structures profile will be significant, however will form part of the sporting precinct already established in this zoning and be in keeping with the character of the current land use.

6.11 Disability Access

An Access Assessment report has been prepared BCA Logic dated 21 August 2017 against the Disability (Access to Premises- Buildings) Standard 2010 and Blacktown Councils Development Control Plans. [Refer SIMX 06]

The report concludes that compliance will be readily achievable with design development. Blacktown Councils Development Control Plan, 2015 refers to Parking for Persons with a Disability (6.4.8) and Bay and Aisle dimensions (6.4.4), each of which will be addressed via accessible car parking spaces with adjoin shared zones in accordance with BCA clause D3.5 and AS2890.6-2009.

The report concludes that after reviewing the relevant Environmental Plans and Development Control Plans the proposed development drawings will comply or can readily comply with the relevant access provisions.

6.12 Special Considerations

Community and Government Consultation

A letter of consent for this proposal has been provided by Office of Strategic Lands, NSW Department of Planning and Environment who own the land currently leased by Eastern Creek International Karts. [Refer SIMX09]

The Member for Penrith, Trades & Tourism, Major Events, and Minister for Sports, Stuart Ayers has provided a letter of support dated 25/08/17 and endorses the recreational objectives that this application is aiming to achieve within Blacktown City Council region. [Refer SIMX08]

The industry has been consulted and a further letter of support is attached from the General Manager, Motorcycling NSW dated 26/08/16 and the adjoining Australian Racing Driving Club dated 19/01/2017. [Refer SIMX20 and SIMX14]

The structure’s air filled dome manufacturer, Arizon Companies, has also provided a letter of partnership dated 01/09/2017 demonstrating commitment to this project and accompanying successful construction phase. [Refer SIMX04]

Community Benefits

The proposal aims to provide riders, year round access to all weather tracks, in a controlled and safe environment for all ages and riding ability. The facility will feature a safe in-house hire of motorbikes for beginners with mandatory safety equipment. The proposed location has excellent access to motorways and is situated one of Sydney’s best known entertainment areas of the Western Suburbs. The proposal will importantly divert junior and senior riders from illegally accessing vacant council lands and reserves into a first class supervised legal motorcycle riding facility. Crime Prevention through Environmental Design Relevant issues have been considered to identify, signpost and secure the external perimeter, with appropriate landscaping to prevent concealment and external security lighting. The structures doors, fire exits and windows will comply with the Building Code. Security measures will include CCTV surveillance. Emergency preparedness and planning will be demonstrated at occupancy certificate. A CPED checklist has been completed. [Refer SIMX22] Fire and Building A fire engineering capability statement has been prepared for the facility by Olsen Fire and Risk dated 21/08/17 [Refer SIMX07] and Building Code Fire report prepared by BCA Logic 18/08/2017 [Refer SIMX05] to demonstrate the structures ability to comply with Building Code of Australia.

7 Conclusions

The Statement of Environmental Effects demonstrates that the proposal will not have significant detrimental impacts on the natural or built environment.

The proposal is consistent with the zone objectives and applicable controls and guidelines. It is evidenced in this SEE that the potential environmental impacts can be managed.

The proposal also facilitates the achievement of Councils recreational policies through the provision of an additional sporting facility on land that has been set aside for that purpose.

Significant consultation with government and industry has identified support for the application that has recognised community benefits in providing both ‘registered’ and ‘unregistered riders’ with a legal facility to participate in this sport.

Based on the assessment undertaken in this SEE, Council’s approval of the Development Application is sought.


Recommended
