NATURE: Inspect for Compliance vithAdministrative OrderMr. T. Harding

BackgrotmdSurveillance of the Lower Passaic River during the summer of 1969 resulted in theissuing of an Administrative Order to Revere Smelting & Refining on August 15, 1969calling for ceasing of discharge by November 10, 1969.

FindingsOn December 2, 1971 I reinspected the plant of Revere Smelting & Refining and metwith Mr. Albert Lospinoso of the cOIllPany. He informed me that his company purchasedthe plant in April 1970 and immediately instituted several changes in the plantpollution control equipment. They installed a new air pollution control appRratus and elimir.ated their waterpo1lutionproblems. The original problem consisted of sulfuric acid being dis-charged into the river from the dismanteling of lead-acid batteries. The plant nowdrains this acid into a stainless steel tank and adds sodium hydroxide flakes toneutralize the acid. This liquor is then discharged to a lagoon along with the0verflow from the air pollution scrubbers where it is allowed to dry. Any solidsremaining are returned to ~ne plant for reprocessing.

The plant. processes lead from batteries and reclaims the lead and antimony whi ellare present 1n the alloy. This process 1s carried out in a furnace where the leadscraps are melted down and purified. Residual solids from the acid waste and scrubberoverflow are also introduced into the fUrnace. When the material in the furnace isprimarily battery_ plates, iron borings are also added to remove residual sulfuricacid 8Dd prevent sulfur dioxide emissions through the conversion of su.lfUl-ic acidto FeS which is disposed of in the slag f"romthe furnace.

GENERAL NOTICE LETTERCERTIFIED MAlL-RETURN RECEIPT REQUESTED

Robert Finn, PresidentRSR Corporation2777 Stemmons Freeway, Suite 1800Dallas, Texas 75207

RE: Diamond Alkali Superfund SiteNotice of Potential Liability forResponse Actions in the Lower Passaic River, New Jersey

Dear Mr. Film:

The Vnited States Environmental Protection Agency ("EPN') is charged with responding to therelease andlor threatened release of hazardous substances, pollutants, and contaminants into theenvironment and with enforcement responsibilities under the Comprehensive EnvironmentalResponse. Compensation, and Liability Act of 1980, as amended ("CERCLA"), 42 V.S.C. §9601et~. Accordingly, EPA is seeking your cooperation in an innovative approach toenvironmental remediation and restoration activities for the Lower Passaic River.

EPA has documented the release or threatened release of hazardous substances, pollutants andcontaminants into the six-mile stretch of the river, known as the Passaic River Study Area, whichis part of the Diamond Alkali Superfund Site ("Site") located in Newark, New Jersey. Based onthe results of previous CERCLA remedial investigation activities and other environmentalstudies, including a reconnaissance study of the Passaic River conducted by the United StatesArmy Corps of Engineers ("VSACE''). EPA has further detennined that contaminated sedimentsand other potential sources of hazardous substances exist along the entire 17-mile tidal reach ofthe Lower Passaic River. Thus, EPA has decided to expand the Study to include the areal extentof contamination to which hazardous substances from the six-mile stretch were transported; andthose sources from which hazardous substances outside the six-mile stretch have come to belocated within the expanded Study Area.

By this letter. EPA is notifying RSR Corporation ("RSR") of its potential liability relating to theSite pursuant to Section 107(a) ofCERCLA, 42 V.S.C. §9607(a). Under CERCLA, potentiallyresponsible parties ("PRPs") include current and past owners of a facility, as well as persons whoarranged for the disposal or treatment of hazardous substances at the Site, or the transport ofhazardous substances to the Site.

In recognition of our complementary roles, EPA has formed a partnership with USACE and theNew Jersey Department of Transportation-Office of Maritime Resources ("OMR") [''thegovernmental partnership"} to identify and to address water quality improvement, remediation, and restoration opportunities in the 17-miJe Lower Passaic River. This governmental partnershipis consistent with a national Memorandwn of Understanding ("MOV") executed on July 2, 2002between EPA and USACE. This MOU calls for the two agencies to cooperate, whereappropriate, on environmental remediation and restoration of degraded urban rivers and relatedresources. In agreeing to implement the MOU, the EPA and USACE will use their existingstatutory and regulatory authorities in a coordinated manner. These authorities for EPA includeCERCLA, the Clean Water Act, and the Resource Conservation and Recovery Act. TheUSACE's authority stems from the Water Resources Development Act ("WRDA''). WRDAallows for the use of some federal funds to pay for a portion of the USACE's approved projectsrelated to ecosystem restoration. .

For the first phase of the Lower Passaic River Project, the governmental partners are proceedingwith an integrated five- to seven-year study to determine an appropriate remediation andrestoration plan for the river. The study will involve investigation of environmental impacts andpollution sources, as well as evaluation of alternative actions, leading to recommendations ofenvironmental remediation and restoration activities. This study is being conducted by EPAunder the authority ofCERCLA and by USACE and QMR, as local sponsor, under WRDA.EPA, USACE, and OMR are coordinating with the New Jersey Department of EnvironmentalProtection and the Federal and State Natural Resource Trustee agencies. EPA, USACE, andOMR estimate that the study will cost approximately $20 million, with the WRDA and CERCLAshares being about $10 million each. EPA will be seeking its share of the costs of the study fromPRPs.

Based on information that EPA evaluated during the course of its investigation of the Site, EPAbelieves that hazardous substances were being released from the former Revere Smelting &Refining facility located at 387 Avenue P in Newark, New Jersey, into the Lower Passaic River.Hazardous substances, pollutants and contaminants released from the facility into the riverpresent a risk to the environment and the humans who may ingest contaminated fish andshellfish. Therefore, RSR may be potentially liable for response costs which the governmentmay incur relating to the study of the Lower Passaic River. In addition, responsible parties maybe required to pay damages for injury to, destruction of. or loss of natural resources, including thecost of assessing such damages.

Enclosed is a list of the other PRPs who have received Notice letters. This list represents EPA'sfindings on the identities ofPRPs to date. We are continuing efforts to locate additional PRPswho have released hazardous substances, directly or indirectly, into the Passaic River. Inclusionon, or exclusion from, the list does not constitute a final determination by EPA concerning theliability of any party for the release or threat of release of hazardous substances at the Site. Beadvised that notice of your potential liability at the Site is being forwarded to aU parties on thislist.

We request that you consider becoming a "cooperating party" for the Lower Passaic River

..Project. As a cooperating party, you, along with many other such parties, will be expected tofund EPA's share of the study costs. Upon completion of the study, it is expected that CERCLA.and WRDA proces~es will be used to identify the required remediation and restoration programs,as weU as the assigmnent of remediation and restoration costs. At this time, the commitments ofthe cooperating parties will apply only to the study. For those who choose not to cooperate, EPAmay apply the CERCLA enforcement process, pursuant to Sections 106 (a) and 107(a) ofCERCLA, 42 U.S.C. §9606(a) and §9607(a) and other laws.

Pursuant to CERCLA Section 113(k), EPA must establish an administrative record that containsdocuments that form the basis ofEPA's decision on the selection ofa response action for a site. The administrative record files, which contain the documents related to the response actionselected for this Site are located at EPA's Region 2 office (290 Broadway, New York) on the 18lb

floor. You may call the Records Center at (212) 637·4308 to make an appointment to view theadministrative record for the Lower Passaic River Project.

EPA will be holding a meeting with all PRPs on October 29, 2003 at 10:00 AM in ConferenceRoom 27A at the Region 2 office. At that meeting, EPA will provide information about theactions taken to date in the Lower Passaic River, as well as plans for future activities. After thepresentation, PRPs will be given the opportunity to caucus, and EPA will return to answer anyquestions that might be generated during the private session. Please be advised that due toincreased security measures, all visitors need to be registered with the security desk in the lobbyin order to gain entry to the office. In order to ensure a smooth arrival, you will need to provideEPA with a list of attendees no later than October 15, 2003.

EPA recommends that the cooperating parties select a steering committee to represent thegroup's interest as soon as possible, since EPA expects a funding commitment for the financingof the CERCLA share of the $20 million study by mid-November 2003. Ifyou wish to discussthis further, please contact Ms. Alice Yeh, Remedial Project Manager, at (212) 637-4427 or Ms.Kedari Reddy, Assistant Regional Counsel, at (212) 637-3106. Please note that allcommunications from attorneys should be directed to Ms. Reddy.

Sincerely yours,

~t .George Pavlou, DirectorEmergency and Remedial Response Division
