As may be noted from the Annex, the number of Members involved is 21. As in the past, the Board may wish to request the Director-General to continue his contacts with these Members, and to submit his findings to the Committee of the Executive Board to Consider Certain Financial Matters, which will meet prior to the Forty-first World Health Assembly. This report should be read in conjunction with the report by the Director-General on the same subject, entitled "Past experience and possible future action" (document EB81/9). Introduction 1. In May 1955 the Eighth World Health Assembly, in resolution WHA8.13, resolved that, "if a Member is in arrears in the payment of its financial contributions to the Organization in an amount which equals or exceeds the amount of the contributions due from it for the preceding two full years at the time of the opening of the World Health Assembly in any future year, the Assembly shall consider, in accordance with Article 7 of the Constitution, whether or not the right of vote of such a Member shall be suspended". 2. Pursuant to resolution WHA16.20 of the Sixteenth World Health Assembly (May 1963), the Executive Board, at its sessions when the agenda of the Health Assembly is prepared, is required "to make specific recommendations, with the reasons therefor, to the Health Assembly with regard to any Members in arrears in the payment of contributions to the Organization to an extent which would invoke the provisions of Article 7 of the Constitution". 3. In the same resolution, the Health Assembly invited those Members concerned to submit to the Executive Board a statement of their intentions as to payment in order to enable the Health Assembly, when it considered the matter in accordance with the provisions of resolution WHA8.13, to make its decision on the basis of the statements of such Members and the recommendations of the Executive Board. A. Finally, under the terms of that resolution, the Director-General was requested to study their difficulties with the Members concerned and to report to the appropriate sessions of the Executive Board and the Health Assembly. MEMBERS IN ARREARS IN THE PAYMENT OF THEIR CONTRIBUTIONS TO AN EXTENT WHICH WOULD JUSTIFY INVOKING ARTICLE 7 OF THE CONSTITUTION:

Report by the Director-General

In accordance with resolutions of the Health Assembly, the Director-General submits the following report on Members in arrears in the payment of their contributions in an amount which equals or exceeds the amounts due for the preceding two full years. As may be noted from the Annex, the number of Members involved is 21. As in the past, the Board may wish to request the Director-General to continue his contacts with these Members, and to submit his findings to the Committee of the Executive Board to Consider Certain Financial Matters, which will meet prior to the Forty-first World Health Assembly. This report should be read in conjunction with the report by the Director-General on the same subject, entitled "Past experience and possible future action" (document EB81/9).

Introduction

1. In May 1955 the Eighth World Health Assembly, in resolution WHA8.13, resolved that, "if a Member is in arrears in the payment of its financial contributions to the Organization in an amount which equals or exceeds the amount of the contributions due from it for the preceding two full years at the time of the opening of the World Health Assembly in any future year, the Assembly shall consider, in accordance with Article 7 of the Constitution, whether or not the right of vote of such a Member shall be suspended".

2. Pursuant to resolution WHA16.20 of the Sixteenth World Health Assembly (May 1963), the Executive Board, at its sessions when the agenda of the Health Assembly is prepared, is required "to make specific recommendations, with the reasons therefor, to the Health Assembly with regard to any Members in arrears in the payment of contributions to the Organization to an extent which would invoke the provisions of Article 7 of the Constitution".

3. In the same resolution, the Health Assembly invited those Members concerned to submit to the Executive Board a statement of their intentions as to payment in order to enable the Health Assembly, when it considered the matter in accordance with the provisions of resolution WHA8.13, to make its decision on the basis of the statements of such Members and the recommendations of the Executive Board.

A. Finally, under the terms of that resolution, the Director-General was requested to study their difficulties with the Members concerned and to report to the appropriate sessions of the Executive Board and the Health Assembly.

5. As at 1 January 1988, when this document was prepared, the following 21 Members were in arrears for amount s which equalled or exceeded their contributions for two full years prior to 1988; Benin, Burkina Faso, Cape Verde, Chad, Comoros, Democratic Kampuchea,

Dominican Republic^ ^Equatorial Guinea, Grenada, Guatemala, Guinea-Bissau, Liberia, Libyan Arab Jamahiriya, Nicaragua, Paraguay, Peru, Qatar, Saint Lucia, Sierra Leone, Suriname and the United Arab timirate日,^Tw6 <if these Members - Chad and the Dominican Republic 一 had not fulfilled the tonditions previously accepted by the Thirty-seventh and Thirty-third World Health Assemblies respectively qâù^erning the payment in instalments of consolidated arrears of contributions. The -voting rigfíts of the Dominican Republic have been suspended cm three previous occasions, by resolution WHA27.10, in 1975 by resolution WHA28.18, and in 1977 by resolution WHA30.12.

6. The number of Members in arrears as at 1 January 1988, as compared with previous years,

7. The status of the arrears of contributions of the 21 Members concerned is as shown in

the Annex to this document.

Action taken by the Director-General

8. Following the adoption by the Fortieth World Health Assembly in May 1987 of resolution WHA40.5 relating to Members in arrears to an extent which would justify invoking Article 7 of the Constitution and resolution WHA40.2 relating to other Members,1 the Director-General communicated the text of resolution WHA40.5 to Burkina Faso, Comoros, Dominican Republic, Equatorial Guinea, Guatemala, Guinea-Bissau, Liberia, Peru, Saint Lucia and Sierra Leone and the text of resolution V7HA40.2 to the other 11 Members, urging them to pay their arrears during 1987. Further communications were sent by the Director-General in September, October, November and December 1987 to the Members concerned.

10. Since the closure of the Fortieth World Health Assembly the only communication received

from the Members concerned is a letter dated 10 December 1987 from the Government of Burkina

Faso informing the Director-General that the Finance Ministry had authorized payment of the

amount of CFA 18 325 000, being the equivalent of USÍ 67 870.37 at the January 1988 exchange

rate of CFA 270 = US$ 1 , and that urgent procedures were under way to settle the remaining

balance of contributions•

Proposed future action

1 1 . The Director-General will continue efforts to collect the unpaid arrears of contributions from the Members concerned. As in previous years, he proposes to report further on this matter to the Committee of the Executive Board to Consider Certain Financial Matters which will meet prior to the Forty-first World Health Assembly, to enable the Committee to formulate recommendations to the Health Assembly based on the status of these arrears at that time and the deliberations of the Executive Board on the report by the Director-General on the same subject, entitled "Past experience and possible future action" (document EB81/9).
