Growth Requirements The selection of agar media and growth requirement methods is critical in achieving the desired results from the lyophilized microorganism preparation. Please review the document titled MicroBioLogics Recommended Growth Requirements found in the Appendix of the catalog.

HELPFUL TIP: Consider ordering the recommended agar media and other necessary biological supplies at the same time you place a MicroBioLogics order.

BioSafety Levels All microorganism products distributed by MicroBioLogics® have a biosafety level (BSL) of 1 or 2. MicroBioLogics adheres to the BSL level designation as determined by ATCC® for products where ATCC supplies the source culture and the American Biological Safety Association for all other strains. Responsibility for safe handling of biological agents ultimately rests with the user and all infectious materials should be handled under the supervision of a competent and knowledgeable microbiologist. For more information see the CDC Office of Health & Safety site at www.cdc.gov/od/ohs/biosfty/biosfty.htm. BSL 1 organisms have no, or low, risk to individuals and communities. BSL 1 organisms may cause disease in individuals with immune systems that are suppressed or compromised. BSL 2 organisms pose a moderate risk of individual infection, but low risk of community infection. Guidelines for safely using BSL 2 microorganisms can be found at http://www.cdc.gov/od/ohs/biosfty/bmbl4/bmbl4s3t.htm.

Mean Assay Value The mean assay value provided with assayed control microorganism preparations is an average of all measurements obtained during the assay phase of the quality control process. The quality control specification requires all values to fall within the target log range stated for a specific product.

MicroBioLogics® determines the Mean Assay Value by implementing a statistically valid sampling plan for the number of samples to be assayed and the number of replicate assays. Both automated plating and colony counting devices are used to reduce the influence of analyst and manual deviations. A non-selective medium is used when performing colony counts as a natural base for these determinations.

Product Warranty MicroBioLogics® guarantees results when the product is stored, handled and used as directed (as per the Expiration Date, MicroBioLogics Recommended Growth Requirements, Illustrated Instructions and Product Inserts). Shipping and Delivery Orders are assumed to have a shipping date of within 48 hours except when a shipping date is requested. Call MicroBioLogics Customer Service department for your areas delivery schedule. All shipments are F.O.B. Saint Cloud, Minnesota unless prior arrangements are made.

Lyophilized microorganisms are identified as Biological Substance Category B or Infectious Substance. As such, the lyophilized microorganisms are subject to regulated packaging materials, special labeling and special shipping requirements. Fees, additional labor and material costs are incurred to meet these requirements. The costs associated with Biological Substance Category B or Infectious Substance shipments and freight charges are listed as separate line items on the invoice. Slides are subject to surcharge/handling fees. All invoices include a Certificate of Quality for quality control documentation.

MicroBioLogics® Shipping Policy A shipping stress study was conducted for reference stock cultures such as LYFO DISK®, KWIK-STIK™ and assayed control microorganism preparations such as EZ-CFU™ and EZ-FPC™. These studies were conducted by MicroBioLogics to ensure product quality upon delivery and to select the safest and most economical shipping method.

Based on the results of these studies MicroBioLogics has established and adheres to the following policy:

MicroBioLogics lyophilized microorganism products do not require special cooling devices or controlled temperatures, but must avoid extreme conditions. The duration of these conditions is a minimum of seven days and MicroBioLogics strives to deliver the product to the destination within 5 days. The outside of the shipping container is identified with the notation refrigerate upon receipt to assure proper handling and storage upon arrival.

Damaged Materials Should any products arrive in a damaged condition, the carrier must note the condition on the delivery receipt. All claims for product damaged during shipment must be made within seven (7) business days of receipt. MicroBioLogics warranties are void when required shipping and/or storage conditions are not met.

Return Policy The nature of these products is such that they cannot be returned. As a result, the product catalog numbers, product description and quantities are verified verbally or in writing at the time the order is placed.

LYFO DISK®: A vial containing 10 lyophilized pellets of EACH individual strain. This is the most economical reference stock culture option.

Each lyophilized microorganism preparation is no more than 4 passages from the reference culture, requires no pre-incubation, and comes with a shelf-life of 10-24 months in refrigerated storage.

Microorganism preparations delivering less than 100 CFU per 0.1 mL volume. EZ-CFU™ One Step earns its name because once the hydrated suspension is prepared (30 minutes) it can immediately be added to the challenge material. Up to 19 tests per aliquot (2.0 mL) or 190 tests per kit can be completed. Each kit is packaged with 2 vials of pellets (10 in each) and 10 vials of hydrating fluid (2.0 mL in each) and a Certificate of Assay.

RECOMMENDED GROWTH REQUIREMENTS

LYFO DISK® AND KWIK-STIK™ Microorganisms

SELECTION OF GROWTH REQUIREMENTS

1. Primary growth on a non-selective, agar medium is preferred. Primary growth in a fluid medium should only occur in special instances or when recommended. Because of the manipulations required during hydration, it is difficult to obtain purity of a lyophilized strain in a fluid medium. A contaminant may completely overgrow and obscure the presence of the lyophilized strain.

2. The availability of nonselective agar media will differ between laboratories. The following lists alternative agar media selection, if applicable, AND growth requirement selections:

Method 1 • Tryptic Soy Agar, Nonselective Sheep

Blood Agar, Standard Plate Count Agar or Nutrient Agar - 35°C in ambient atmosphere – 24 to 48 hours.

Method 2 • Nonselective Sheep Blood Agar - 35°C in

ambient atmosphere – 24 to 48 hours. Method 3

• Chocolate Agar with Hemoglobin/NAD - 35°C in 5% to 10% CO2 – 24 to 48 hours.

Method 4 • Anaerobic Blood Agar 35°C in Anaerobic

Environment – 48 to 72 hours. • Some obligate anaerobes may require 5 to

7 days to demonstrate sufficient growth. • Fresh prepared Nutrient Agar, Tryptic Soy

Agar, Standard Plate Count Agar (Standard Methods Agar) are appropriate alternatives for the Clostridium species together with an additional period (24 hours) of incubation.

Method 5 • Saboraud Dextrose Emmons Agar - 25°C in

ambient atmosphere – 3 to 7 days. • Nonselective Sheep Blood Agar is an

appropriate alternative. • Nutrient Agar, Tryptic Soy Agar, Potato

Dextrose Agar and Standard Plate Count Agar are appropriate alternatives together with an additional period (24 hours) of incubation

Method 6 • Chocolate Agar w/ Hemoglobin/NAD - 35°C

in Microaerophilic Environment – 48 to 72 hours.

Method 7 • Lowenstein Jensen Agar or Middlebrook

Agar - 35°C in 5-10% CO2 or ambient atmosphere – up to one week.

Method 8 • Buffered Charcoal Yeast Extract Agar - 35°C

in ambient atmosphere – 3 to 5 days. Method 9 • V Agar or Chocolate Agar - 35°C in 5% to

10% CO2 – 48 hours. Method 10 • Rehydrate in sterile Brain Heart Infusion

Broth, Tryptic Soy Broth or 0.85% Saline. Rehydration with water may result in decreased or no recovery. Rehydration with fluid provided in the KWIK-STIK™ unit provides satisfactory recovery.

• Grow on non-selective Sheep Blood Agar or Tryptic Soy Agar - 35°C in ambient atmosphere – 24 to 48 hrs.

Method 11 • The primary growth medium is MRS (Man,

Rogosa, Sharpe) Broth. Incubate at 35°C in ambient atmosphere for 48 hours. Transfer to Columbia CNA with Sheep Blood. Incubate at 35°C in 5-10% CO2 for 48 hrs.

Method 12 • Potato Dextrose Agar - 45°C in ambient

atmosphere - 48 to 72 hours. Method 13 • Rehydrate in 10 B Arginine Broth. Make

Serial Dilutions. Incubate at 35°C, in ambient atmosphere. As soon as the Arginine vial turns pink, sub broth to A-8 Agar. DO NOT use cotton swab or wooden shaft. Incubate Mycoplasma at 35°C in 5-10% CO2. Incubate Ureaplasma at 35°C anaerobically.

Method 14 • Rehydrate in SP4 Glucose Broth. Make

serial dilutions. Incubate at 35°C, in ambient atmosphere. As soon as the broth turns from red to yellow, sub broth to SP4 Glucose Agar. Do not use cotton swab or wooden shaft. Incubate at 35°C in CO2 atmosphere, preferably in a candle jar.

QUALITY POLICY AND QUALITY ASSURANCE

MicroBioLogics’ executive management has established its policy and objectives for, and commitment to, quality and bears the ultimate responsibility for ensuring the quality of all products and services. This responsibility is extended to, and shared by, every employee contributing to quality products and service. QUALITY POLICY STATEMENT

“To ensure total customer satisfaction, MicroBioLogics provides services and products

of defined, known, and defensible quality.” FOOD AND DRUG ADMINISTRATION ESTABLISHMENT

MicroBioLogics is registered with the Food and Drug Administration (FDA) as a Device Establishment. (FDA Establishment # 2150138). This registration dictates regulatory mandates to meet and comply with the elements set forth in the FDA; Quality System Regulation (QSR) 21CFR Part 820 Medical Devices; Current Good Manufacturing Practice (CGMP). The compliance applies to the methods used in, and the facilities and controls used for, the design, purchase, manufacture, packaging, labeling, storage, and distribution of in-vitro, medical diagnostic products. These provisions are intended to ensure that finished product will be safe and effective and otherwise in compliance with the Federal Food, Drug, and Cosmetic Act. Several of MicroBioLogics’ product lines are not intended as in-vitro, medical diagnostic products and may not be subject to the FDA QSR. However, regardless of intended applications or use, all of MicroBioLogics’ products are placed under, and meet, the provisions of FDA QSR.

ISO 9001:2000 MicroBioLogics is an ISO 9001:2000 Certified Company and is subject to external audits on a regular schedule. Conformity to ISO 9001:2000 ensures that the design, production and distribution of products are performed under, and conform to, the provision of a documented quality management system.

CE Mark

The CE Mark is a regulatory directive to which MicroBioLogics’ CE Marked products conform. The CE Mark provides testimony that the products meet the requirements of the “In Vitro Diagnostic Directive” and conforms to criteria for placing in vitro diagnostic medical devices on the European Market. Any company or organization that markets, sells and distributes similar products into the European Market must also conform. MicroBioLogics has conformed to the CE Mark requirements for its reference stock culture products of LYFO-DISK®, KWIK-STIK™, KWIK-STIK™ PLUS Microorganisms, and their slide product line of Microbiology QC Slides and KWIK-QCTM Slides. The Assayed Product Lines of MicroBioLogics that include EPOWER™, EZ-CFU™, EZ-CFU™ ONE STEP, EZ-FPC™ and EZ-PEC™ Microorganisms are intended for industrial applications only. Based on the fact that the above stated products are not intended for clinical applications and are not actually used for establishing or verifying performances of medical devices, they do not fall under the definition of “in vitro diagnostic medical devices” as defined in the Directive 98/79/EC of the European Parliament and of the Council of 27 October 1998 on in vitro diagnostics medical devices. Therefore, the requirements of this directive, including the CE Mark, do not apply to the above stated products.

EXTERNAL AUDITS

MicroBioLogics allows customers the opportunity to visit and audit its facilities during normal business hours to determine adherence to quality assurance programs, regulatory compliance, and conformity to international standards according to their Quality System Audit Policy, LIT.128. Said audit will not include access to proprietary information or plant area that would breach the security and integrity of MicroBioLogics proprietary information and intellectual property.

PRODUCT WARRANTY AND PRODUCT REPLACEMENT

PRODUCT WARRANTY

MicroBioLogics warrants that products, exclusive of disclaimer statement, will perform satisfactorily and be free of defect if used as intended, stored as directed, processed in accord with instructions, and used before the expiration date. MICROBIOLOGICS MAKES NO FURTHER WARRANTY OF ANY KIND WITH RESPECT TO THE PRODUCT AND EXPRESSLY DISCLAIMS ANY WARRANTIES IMPLIED BY LAW, INCLUDING BUT NOT LIMITED TO, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

PRODUCT REPLACEMENT

MicroBioLogics agrees to replace or give credit for any product that fails to meet stated specifications and performance, provided the correct procedures have been followed. Should any product fail to meet specifications and performance, contact MicroBioLogics’ Technical Support Service Department at 320-253-1640. Be prepared to provide:

the nature of the problem; the product description; catalog number; lot number; date of receipt; and, the number of units involved.

All claims for unsatisfactory product performance must be made prior to the expiration date.

Should any product arrive in a damaged condition, the carrier must note the condition on the delivery receipt. All claims for products damaged during shipment must be made to MicroBioLogics within seven (7) business days of receipt. MICROBIOLOGICS’ SOLE OBLIGATION AND PURCHASER’S EXCLUSIVE REMEDY FOR BREACH OF THIS WARRANTY SHALL BE, AT THE OPTION OF MICROBIOLOGICS, TO REPLACE THE PRODUCTS. IN NO EVENT SHALL MICROBIOLOGICS BE LIABLE FOR ANY PROXIMATE, INCIDENTAL OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH THE PRODUCTS.
