There’s little escapingthe recent publicityaround the newConsumer RightsAct 2015 whichbrought better rightsfor consumers onfaulty goods.

But whilst this is great newsfor shoppers how doesthis affect businesses?

right to reject

If a product or service is faultythen the consumer now hasan initial right to reject thegoods and claim a full refundwithin 30 days of delivery. Thebuyer can also chose whetherto have the item repaired orreplaced instead however, ifthis is not possible then thetrader can refuse and thenthe consumer has a right to arefund or to keep the productat a reduced price. A refundor reduction also applies if arepair or replacement doesn’twork as overall, the trader onlyhas one chance to rectify thesituation and this has to bedone within a reasonable time.

If the consumer has had theproduct for more than sixmonths since delivery (onemonth, if it is a car), then thetrader can deduct part of theprice based on the amountof use of the product.

With services, the consumercan require the service tobe performed again, withina reasonable time, withoutsignificant inconvenienceand at the trader’s expenseor can ask for a reduction inthe price. There is no formulafor calculating the reduction,but it can be up to 100%.

This is the first time paid-for digital content has beenproperly addressed inconsumer legislation and mustbe of satisfactory quality, fitfor purpose and as described.If not, a consumer has theright for it to be replaced orrepaired (although there is nolimit of the amount of timesit can be repaired) or seek areduction in the price (of up to100% in appropriate cases).The consumer can also obtaina repair or compensationfor any damage done to

any digital device that thecontent was uploaded on.

A new expanded “grey list”of potentially unfair termsin contracts has also beenproduced. Terms included onnotices to consumers (ratherthan within written terms)and any price information,including extra charges, haveto be prominent. So ensurethat any written terms ornotices are reviewed andupdated, customer servicepolicies or practices arecompliant and that all staffare trained on the new rules.

StollenThis spiced and fruity Continental sweet breadis perfect for serving over the festive seasonwith a glass of warmmulled wine.

Ingredients:

• 50g butter• 175ml milk• 3 tbsp caster sugar• 375g strong plain whiteflour, plus extra forkneading

• � tsp salt• 1 tsp ground mixed spice• 2 tsp fast-action driedyeast

• Zest of 1 lemon• 1 large egg, beaten• 125g raisins• 25g chopped mixed peel• 50g glace cherries, rinsed,dried and quartered

• 175g marzipan• Melted butter, for brushing• Icing sugar, for dusting

Makes 10-12 slices

Ready in about 3 hours

1. Put the butter, milk and caster sugar in a small pan andheat gently until the sugar has dissolved and the butterhas melted. Leave to cool for 10 minutes.

2. Sift the flour, salt and mixed spice into a large bowl andstir in the dried yeast. Make a well in the centre and stir inthe milk mixture, lemon zest and egg. Mix together with around-bladed knife to form a soft and sticky dough.

3. Turn the dough onto a well floured surface and knead for5-8 minutes until smooth and elastic. At first the doughwill be quite sticky so add more flour as necessary.

4. Flatten out the dough and knead in the raisins, cherriesand peel until just combined. Place the dough in a lightlyoiled bowl, cover with cling film and leave in a warmplace for about 1� hours, or until doubled in size.

5. Turn the dough onto a floured surface and knead for1-2 minutes, then roll out to a 25cm square. Shape themarzipan into a sausage shape and place down thecentre of the dough. Fold one side over to cover themarzipan then repeat with the other side, overlappingin the centre. Seal the ends. Place seam-side down ona greased baking sheet. Cover with oiled cling film andleave in a warm place until doubled in size. Preheat theoven to 190°C, fan 170°C, gas 5.

6. Bake the stollen for 35-45 minutes until golden andsounds hollow when tapped underneath. Brush the hotstollen all over with melted butter and roll in the icingsugar to coat. Leave to cool.

Accident? YouMean CollisionIain Betson learns there are noaccidents on Britain’s roads.

Speaking to a Highways Agency officerthe other day, I was intrigued to learn thatthe emergency services now do not class“incidents” on the road as “accidents”, butas “collisions”. Previously, they would haveattended a “Road Traffic Accident” (RTA). Nowthey attend a “Road Traffic Collision” or RTC.Why the subtle change in wording? Well, theuse of the word “accident” implies somethingthat was unexpected, unforeseen or that “justhappened”. And calling these incidents assuch has been used as a defence in a courtof law.

“Yes your honour. I know I was clocked by thespeed camera doing 60mph in a 30mph zone.It is true I was pulled by the fire crew from mywrecked car that was part of the multiple pile-up outside the primary school at going hometime. And I know my car was subsequentlyfound to have four bald tyres, no insuranceand dodgy brakes. But the whole event wasclassed as a traffic accident, so you can seeI couldn’t have foreseen any of it happening.So, therefore, I am innocent of all charges.”

Accident or incident. Collision or comingtogether. You say tomaytoe and I say tomato.

It may be interpretation but, ultimately, theresults are the same. If we all took a littlemore consideration and, dare I say, care inour driving, then I think it’s likely the number of“collisions” our already stretched emergencyservices have to attend would be reduced.With, of course, a corresponding drop in thenumber of people killed or seriously injured.**Department of Transport figures for 2014: 1,775killed; 22,807 seriously injured.

Who doesn’t enjoy sinkingtheir teeth into a delicious,flavour-packed, superblyjuicy apple or pear? Mmm!But if you want the ultimatein gorgeous apples, pears,plums or more, then the fruitneeds to be freshly pickedand sun-warmed - so growyour own and you can alsosave yourself a few bob, havefun and make some goodlooking additions to yourgarden, even when space islimited. There’s no need tohave a massive plot or anorchard to grow fruit trees…

You can grow fruit trees insurprisingly small spaces,especially if you don’t growthem in a classic tree shape,but train them. Training theminto espaliers (so that theyhave several sets of horizontal‘arms’), cordons (as singlemain stems grown at anangle) or fans (with branchestrained into a fan shape)means that you can growmany varieties of apples andpears up against a suitablevertical surface such as awall, fence or set of sturdywires.

You could also train fruits likeapples as ‘step-overs’ - thisjust means trained so theymake a neat edging for a bedor border, about 45cm or soabove ground level. A step-over apple basically goes upto a height of about 30cm andis then trained so that it formstwo horizontal ‘arms’. Theylook great when in flower andwill even bear a smallish cropof fruit along the arms. Trystep-overs around the edge ofyour vegetable plot or flowerbed.

Alternatively, why not makea real feature of fruit and usea tree to create a decorativeand, later on, a productivearch? Buy an inexpensivebare-root cordon (straightstem) or a ‘whip’ fruit tree ofyour favourite variety, pair itwith another variety that is asuitable pollinator (check withthe nursery) and plant one oneach side of the arch, trainingthem in as they grow. It willlook great, phenomenallypretty when covered inblossom in spring, and after afew years will bear tasty fruittoo.

But what if you don’t haveany open ground, beds orborders in your backyard stylegarden? Provided you get theright rootstock (see below) itis quite possible to grow fruittrees in large containers. Thecontainer needs to be as bigas possible - a half-barrelat least - and must havedrainage holes kept clearusing a few inches of brokenchina or ‘crocks’ at its bottom.Good quality loam-basedcompost such as John InnesNo.3 will work well, but helpto keep it well aerated andfree-draining by adding 25-50% multi-purpose loam-freecompost.

Whatever the size of yourgarden, but especially ifspace is short, when youare choosing fruit trees itis essential to get them onthe right ‘rootstock’, as thisdetermines the ultimatesize and vigour of the tree.The rootstock is the type ofroots onto which the chosenvariety of apple has beengrafted. Apples are particularlycomplicated and a goodnursery will advise you, but

as a rule, for step-overs,cordons, dwarf bushesand trees in containers trythe extremely dwarfing butsomewhat tricky M27 - but dobeware weak varieties or anytree grown on this rootstock inpoor soil or not well pamperedmay well fail. For bush,cordon, espaliers and half-standard try the easier to lookafter dwarfing rootstock M26,while for a cordon, an espalieron poor soil, arches and bushtrees try the semi-dwarfingMM106.

You can either buy one yearold ‘maidens’ or ‘whips’ whichare small, fairly straight stemsand train them yourself, orif you want to save time youcan often buy trained or part-trained fruit trees. Obviouslyyou’ll pay more for a trained

tree, but it can save youseveral years work!

Make sure you choose thevarieties you grow so that theyare in flower at the same timeand thus can pollinate eachother - if there is no suitablepollinator in the vicinity youwill not get fruit. Check withyour supplier who will be ableto tell you which ‘pollinationgroup’ each variety is in.

At this time of year you canbuy fruit trees which are reallygood value because theyare sold ‘bare root’, this justmeans lifted from a field andnot container grown. Theseare not only inexpensive, butalso establish particularlywell. Bare root fruit trees aregenerally available from aboutNovember until early March,depending on the weather - so

don’t delay, get ordering orplanting today!

Cold Ash Brass wasfounded in 2003by a group of localmusicians whoenjoyed playingmusic together.

We have gone from strengthto strength and are nowalongside performing inlocal concerts we take partin the Southern CountiesAmateur Bands Associationannual contests as wellas entering the regionalheats for the NationalBrass Band competition.In September this year wewere fortunate enough tocompete in the National BrassBand competition finals atCheltenham Racecourse.

In 2009 we formed aYouth Band to encourageyoungsters to play togetherand last year we expandedand renamed this as Cold AshBrass Community Band. It isour aim that the communityband should encourageplayers of all ages and

abilities to join together and

have fun playing music whilst

learning from each other.
