INTRODUCTION
Welcome to the 2013-2014 edition of TE Connectivity (TE) Corporate Warranty/Software Handbook. Product warranty information is provided for TE’s Telecom and Wireless business units as of the issue date of this publication.
All previous editions of any TE, Tyco Electronics, or ADC Warranty/Software Handbooks or any other document defining warranties or warranty periods published by TE or its business units expire on the publication date of this Handbook. TE and its business groups retain the right to make any corrections to this handbook by the addition, removal, or change to any data without any official published or oral notification of any nature. Warranty periods stated in a formal agreement between TE and a customer shall replace the specific warranty periods stated in this Handbook for the products covered under such agreement.
Customers with product(s) and software shipped prior to the publication date of this handbook will retain the product(s) warranty in effect as of the original shipment date. Product(s) and software shipped on or after the issue date of this handbook are covered by the warranty classification as stated within the terms of this handbook.

TELECOM AND WIRELESS WARRANTY PROCESS INFORMATION
Product Warranty
Refer to TE Product and Service Warranty statement for terms of warranty. Product warranty periods are stated within each individual product line information sheet(s). Refer to the Table of Contents for the page numbers of product line information.
Software Warranty
Refer to your specific Software License Agreement and TE Software Warranty statement for terms of warranty. Software warranty periods are stated within each individual product line information sheet(s). Refer to the Table of Contents for the page numbers of product line information.
Ownership
Transfer of product ownership or software license rights from the original TE purchaser or from the original TE Licensee (as the case may be) (excluding VARS, Distributors, Resellers) will void all existing TE warranties of any kind. Refer to the applicable agreement or license to determine any specific exceptions to such.
Return for Replacement
The following policy applies to products returned to TE for replacement. This policy applies to all customers excluding TE's distribution return policy. Replacement products may contain reconditioned parts, but those are subject to the same specification and quality control standards applied to new materials and warranted as stated herein.
In-Warranty Product/Software
Products or Software still under warranty are replaced at no charge to customer excluding any and all third party repair houses, which are subject to replacement charges as determined by TE.
TE assumes no warranty liability with respect to abnormal use, abnormal conditions, improper storage, exposure to moisture or dampness, unauthorized modifications, repairs, tampering, or the negligent or improper use of product or other events which are not the fault of TE. TE warranty is not transferable to third party repair facilities. OEM equipment purchased by TE and resold will be limited to that manufactures’ warranty.
Products replaced while under warranty are warranted for the remainder of the original product warranty or for a period of ninety [90] calendar days from the date of return shipment to customer, whichever is longer.
Software media replaced while under warranty is warranted for the remainder of the original software media warranty or for a period of thirty [30] calendar days from the date of return shipment to customer, whichever is longer.
Advance Replacement: Upon request, and for an additional fee, TE can provide Advance Replacement of the faulty equipment, subject to product availability. The original faulty equipment must be returned to TE within 30 days, or TE will invoice for the price of the advance-replaced equipment. Return freight will be pre-paid and added to your invoice for the repair charges.

NTF (No Trouble Found)
Products returned and found during TE’s evaluation to meet all TE specifications can, at the discretion of TE and its business units, be assessed a processing fee for handling and evaluating the product based either on a flat fee or at a defined percentage of the product list price. Customer will be advised of any such charge with a customer purchase order required to cover any charges prior to the return of any product.
Post Warranty/Out of Warranty Policy
Products that have failed after the original product warranty period has expired are not eligible for replacement as described in "Service Affecting Advance Replacement Program" stated herein.The customer should consider the purchase of a new or refurbished product as a replacement.
Service Affecting Advance Replacement Program
If any TE or an applicable business unit product fails due to a defect covered by warranty a TE Advance Replacement Product (ARP), when available from designated inventory can be forwarded to customer to replace a defective product in an emergency situation.
The customer must contact TE or appropriate business unit product return department listed under the heading “Product Return Department Telephone Directory” to verify warranty status and request a replacement product. A purchase order number from customer will authorize shipment of the ARP. Customer will be invoiced at the product list price upon shipment of the ARP.
Customer is issued a Return Material Authorization (RMA) number for return of the defective product. To be eligible for credit, the defective product must be returned within thirty [30] calendar days from date of shipment of the ARP by TE or applicable business unit.
TE reserves the right to grant partial or no credit if the returned product is damaged from negligent, improper use, improper installation, modification, repair, operation or maintenance except as described in TE's user documentation.
Customer fully understands and agrees that ARP's are normally refurbished products; however, a new product may be used when required at the discretion of TE. Customer further agrees to acceptance of all terms of the Service Affecting Advance Replacement Program, as advised by TE, for the furnishing of any ARP by TE.
Freight Responsibilities Under Warranty
Unless otherwise provided for on a contractual relationship between the parties the customer is responsible for all freight charges on products returned to TE or any business unit. TE and the business units will be responsible for freight charges (most economical means) for replacement products being returned to customer.

Return Material Authorization
A Return Material Authorization (RMA) number is required prior to the return of any product to TE or any business unit. Failure to obtain an RMA number can result in rejection of shipment by TE and return to the customer at customer's expense.
Contact the appropriate Product Return Department listed under the heading “Product Return Department Telephone Directory” to obtain an RMA number.
Once an RMA number is issued all products must be returned to TE or the applicable business unit within thirty [30] calendar days (Domestic US) and sixty [60] calendar days (Internationally) from its issue date. If products are not received within the stated calendar day period, the RMA number is invalid and is officially cancelled. Customer must obtain a new RMA number for any cancelled RMA number.

RETURN FOR CREDIT PROCESS INFORMATION
Credit Return
Products are allowed to be returned for credit under specific conditions identified below. Before TE or any business unit will accept a return for credit, customer is required to contact TE or applicable business unit Product Return Administrator to discuss the circumstances covering the need for product return. The minimum factors used in the evaluation of product eligibility for credit are as follows:
Custom/Nonstandard Products
Represents products, which are either: (A) designed and built to a customer specification or customer defined requirements and/or (B) the use of a TE or business unit standard product and modified to meet customer specified parameters. These products are not eligible for return or for credit.
Obsolete/Discontinued Products
Represents any TE or business unit product defined as obsolete or which has been discontinued from any further sale. These products are not eligible for return or for credit.
Standard Products
Represents products which are defined within a TE or business unit published catalog of the latest edition. Standard products are eligible for return and must be unused and meet current TE or applicable business unit specifications (form, fit and function), and not missing hardware packs, manuals, etc. These products are eligible for return or for credit.
Products must be returned within a six [6] calendar month period or less from TE's original ship date and be accepted by TE or the applicable business unit for further use. Customer's account will be credited for accepted products based on the following criteria: one hundred percent [100%] of purchase price if return is found to be the result of a TE or business unit error; or eighty percent [80%] of purchase price if return is the result of a customer error.
Products returned in an unused but "incomplete" status (missing hardware, manuals, prints, etc.), will be assessed a restock charge. This "incomplete" return charge is in addition to any other applicable restock charge.

Freight Responsibilities Return for Credit
Customer is responsible for all freight charges on all products being returned for credit. All shipments made to TE or any business unit by customer shall be made DDP (Delivered Duty Paid). Customer is responsible for all transportation, custom, duty and process costs if products are not returned in accordance with instructions stated herein. TE and any business unit may also impose a handling and process fee as a result of products not shipped DDP.

PRODUCTS AND SERVICE LIMITED WARRANTY
a) Except as otherwise stated herein or in an order acknowledgment delivered to Customer, TE warrants to Customer that the Products (1) shall be free of defects in materials and workmanship for the periods set forth in this Warranty Handbook (each a “Warranty Period”) from date of shipment to Customer; and (2) shall be free of liens and encumbrances when shipped to Customer. If TE agrees in writing to provide and does provide system design, drawings, technical advice, or any other services to Customer in connection with Products, then TE further warrants to Customer during the applicable Warranty Period that such services shall be undertaken in accordance with TE’s reasonable technical judgment based on TE’s understanding of pertinent technical data as of the date of performance of such services. TE’s warranties will not apply to any Product with respect to which there has been (i) improper installation or testing, (ii) failure to provide a suitable operating environment, (iii) use of the Product for purposes other than that for which it was designed, (iv) failure to monitor or operate the Product in accordance with applicable TE specifications and good industry practice, (v) unauthorized attachment or removal or alteration of any part of the Product, (vi) unusual mechanical, physical or electrical stress, including but not limited to lightning strikes (such Products as fuses, breakers, gas tubes, etc. shall not be considered defective if they function as per their specification (vii) modifications or repairs done by other than TE, (viii) mishandling during shipment of the Product; or (ix)any other abuse, misuse, neglect or accident. In no circumstance shall TE have any liability or obligation with respect to expenses, liabilities or losses associated with the installation or removal of any Product or the installation or removal of any components for inspection, testing or redesign occasioned by any defect or by repair or replacement of a Product. Application Equipment, spare parts and hand tools ordered or supplied hereunder may contain used parts and/or be reconditioned.
(b) Customer shall notify TE in writing promptly (and in no case later than thirty (30) calendar days after discovery) of the failure of any Product to conform to the warranty set forth above, shall describe in commercially reasonable detail in such notice the symptoms associated with such failure, and shall provide to TE the opportunity to inspect such Products as installed, if possible. The notice must be received by TE during the Warranty Period for such Product. Unless otherwise directed in writing by TE, within thirty (30) calendar days after submitting such notice, Customer shall package the allegedly defective Product in its original shipping carton(s) or a functional equivalent and shall ship it to TE.
(c) Within a reasonable time after receipt of the allegedly defective Products and verification by TE that the Products fail to meet the warranty set forth above, TE shall correct such failure by, at TE’s option, either (i) modifying the Products or (ii) replacing the Products. Such modification, replacement, and the return shipment of the Products with minimum insurance to Customer shall be at TE’s expense. Customer shall bear the risk of loss or damage in transit, and may insure the Products. Customer shall reimburse TE for transportation costs incurred for Products returned but found by TE not to be defective. Modification or repair of Products may, at TE’s option, take place either at TE’s facilities or at Customer’s premises. If TE is unable to modify Products to conform to the warranty set forth above, then TE shall, at TE’s option, either refund to Customer or credit to Customer’s account the purchase price of the Products less depreciation calculated on a straight-line basis over TE’s stated Warranty Period. THESE REMEDIES SHALL BE CUSTOMER’S EXCLUSIVE REMEDIES FOR BREACH OF WARRANTY.
(d) EXCEPT FOR THE EXPRESS WARRANTY SET FORTH ABOVE, TE MAKES NO OTHER REPRESENTATIONS, OR WARRANTIES, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, REGARDING THE PRODUCTS, THEIR FITNESS FOR ANY PURPOSE, THEIR QUALITY, THEIR MERCHANTABILITY, THEIR NONINFRINGEMENT, OR OTHERWISE. NO EMPLOYEE OF TE OR ANY OTHER PARTY IS AUTHORIZED TO MAKE ANY OTHER REPRESENTATIONS, WARRANTIES, OR CONDITIONS FOR THE GOODS OTHER THAN THE WARRANTY SET FORTH HEREIN. TE’S LIABILITY UNDER THE WARRANTY SHALL BE LIMITED TO A REFUND OF THE PURCHASE PRICE OF THE PRODUCT. IN NO EVENT SHALL TE BE LIABLE FOR THE COST OF PROCUREMENT OR

INSTALLATION OF SUBSTITUTE GOODS BY CUSTOMER OR FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT OR INCIDENTAL DAMAGES OF ANY KIND WHATSOEVER, OR CLAIMS OF ANY THIRD PARTIES.
(e) Customer assumes the risk and agrees to indemnify TE against and hold TE harmless from all liability relating to (i) assessing the suitability for Customer’s intended use of the Products and of any system design or drawing and (ii) determining the compliance of Customer’s use of the Products with applicable laws, regulations, codes and standards. Customer retains and accepts full responsibility for all warranty and other claims relating to, or arising from, Customer’s products which include or incorporate Products or components manufactured or supplied by TE. Customer is solely responsible for any and all representations and warranties regarding the products made or authorized by Customer. Customer will indemnify TE and hold TE harmless from any liability, claims, loss, cost or expenses (including reasonable legal fees) attributable to Customer’s products or representations or warranties concerning same.
TE SOFTWARE LICENSE GENERAL TERMS
IMPORTANT, READ CAREFULLY
The software license which accompanies the software or product is a legal agreement between TE (including its affiliates) (“TE”) and Customer for, TE software (“TE Software”) and/or third-party software (“Third-Party Software”) (hereinafter referred to collectively as “Software Product”). The complete details of such software license including the limitation of warranty shall be defined in the software license.
