That Bhadarwah Development Authority has not engaged any people without proper

advertisement of the post since joining as C.E.O B.D.A, however 42 labourors are working with

this Authority on need basis out of 42 labourors 21 labourors are working for watch and ward/

maintenance of the assets created by this Authority and 21 labourors are engaged as and when

required by this Authority who are working as labourors on different works for maintenance of

assets.

No person has been engaged against substantive post which requires codal procedure as the

same is done by recruitment organization as provided in the rules.

Kindly refer above quoted subject under reference, in this regard it is stated that Snow

Carnival 2012 was being organized by the department of Tourism through Assistant Director

Tourism Batote and Bhadarwah Dev. Authority. To make the festival successful winter adventure

sports activities were coordinated by engaging a specialized winter adventure team from

Utrakhand arranged by Travel Trade Association Bhadarwah. Sh. Sanjiv Dhir S/o Col R.K Dhir

was engaged for adventure activities vide No: BDA/2011-12/4989-95 dated: 08/3/2012. It is fact

that the bill for an amount of Rs.596000.00 was received and after negotiation with the agency

30% rebate was agreed which has been worked out Rs. 417000/- out of which an amount of Rs.

50000.00 (Rupees fifty thousands) were sponsored by the Travel Trade Association Bhadarwah

and an amount of Rs. 100000.00 (Rupees one lac only) paid by this Authority as on a/c payment

out of revenue receipt recoupable. The bills of the agency were submitted to the Assistant Director

N.H Batote for pass and payment vide this office letter No: BDA/2012-13/ 5118-20: dated: 22-3-

2012. Assistant Director Tourism Batote returned the a/c with the intimation that only Rs. 3.00 lacs

were sanctioned and released for the said festival and have been incurred. Now the a/c stands

submitted to the Director Tourism Jammu for drawal and payment in favour of the above said

agency vide this office letter No: BDA/2012-13/ __________, dated:________.

In reference to the complaint received vide No: TSM/G-Cell/Genl-18/2012, dated: 22-5-2012, it is intimated that the complainant was called by the Assistant Director Tourism Batote videNo: Gen/14560 TOB, dated: 08-3-2012 for conduct of winter adventure for three days atBhadarwah from 11th to 13th of March 2012. The event was coordinated by Travel TradeAssociation Bhadarwah, who generated sponsorship for an amount of Rs. 50000/- from thesponsors which was paid to the complainant. In addition Rs. 1.00 lacs was paid from BhadarwahDevelopment Authority against the bill raised to Rs. 596000-00 which on negotiation was curtailedby 30% in anticipation of the receipt of the funds for the festival, later the funds were not providedto Bhadarwah Dev. Authority but were released to the Assistant Director Tourism Batote.Accordingly the bills were furnished to the Assistant Director Batote for releasing the balancenegotiated payment as also the agency was engaged by the Assistant Director Tourism Batote,since Bhadarwah Dev. Authority was not released the funds for conduct of snow festival, sobalance payment was to be released by the Assistant Director Batote thereby settling the issue, butAssistant Director Batote returned the bills again to this office with the intimation that the fundsreleased have been exhausted on other items of expenditure. Now upon the receipt of thecomplaints the bills have again been furnished to the Director Tourism Jammu for settling the issuewith the agency at his level and complainant has accordingly been informed to approach DirectorTourism Jammu for settlement of his claim.

Regarding fixing of Rs. 23.00 lacs for light and sound system at Bhadarwah Fort is not fact,however, an amount of Rs. 22.80 lacs have been paid to the contractor against BankGuarantee No: 15/2012 dated: 10-07-2012 against the allotted amount of Rs. 45.60 lacsallotted after completion of the all codal procedure i.e. by inviting NIP and competitivebids.
