Rules and Expectations for Use of Temple Facilities

These rules and regulations constitute part of this agreement. Please sign and date below your understanding and ac-ceptance of them.

A security deposit of $500 is due with your signed copy of this agreement. Please sign both copies of this agreement and return both copies with your security deposit. Upon approval, one copy, signed by Temple Shalom’s Execu-tive Director, will be returned to you. The security deposit will be returned to the APPLICANT after the event if there is no damage, loss, or other costs incurred in violation of this agreement. To the extent the security de-posit is insufficient, the Temple will send a bill to the APPLICANT, which the APPLICANT agrees to pay promptly.

2. A family using the Temple facilities for any occasion must be current in ALL its financial obligations to the Temple. These financial obligations include but are not limited to Membership Dues, Religious School fees, Building Fund obliga-tions. All fees related to the event for which the rental is being made must be paid sixty (60) days prior to the event for which Temple facilities are being rented.

3. Payments to the temple are refundable only as follows:

A. For cancellation six (6) months or more before the FUNCTION DATE, the security deposit and all rental fees which have been paid will be refunded after a $100 administrative fee has been deducted.

B. For cancellation less than six (6) months before the FUNCTION DATE: a) Should the facility be rented for an-other event after the cancellation, the security deposit and all paid fees minus a $100 administrative will be re-funded when the contract for the new rental has been executed. b) Should the facility not be rented following the cancellation, no part of the security deposit will be refunded.

4. APPLICANT acknowledges having read the General Guidelines for Use of the Temple Facilities, which constitute part of this agreement, and understands that the TEMPLE may, from time to time in the future, promulgate additional Rules and Regulations. APPLICANT agrees that he/she will abide by all Rules and Regulations as may be in effect during the term of this agreement.

The APPLICANT further agrees to indemnify and save TEMPLE SHALOM, its officers, directors, trustees, agents, em-ployees, or affiliated entities harmless from any and all damage to its building, facilities, and equipment, and from any and all claims for loss, injury or damage to any person or property while anywhere on the Temple’s premises or grounds, including counsel fees and expenses in connection therewith in any instance.

APPLICANT hereby agrees that all merchandise, furniture, and property of any kind of APPLICANT, its agents, con-tractors, employees, or invitees which may be on the premises are at the sole risk and hazard of APPLICANT and that, if whole or any part thereof shall be destroyed or damaged by fire, water, or in any other way or manner, no part of said loss is to be charged to or borne by Temple Shalom of Newton.

I/We apply to use the Temple's facilities as specified above. I/We have read the attached Guidelines for Use of Temple Facilities and agree to abide by all current and future rules established by Temple Shalom of Newton for use of its facili-ties.

Guidelines For Use of Temple Facilities at Temple Shalom

We are pleased that you have chosen to hold your special event at Temple Shalom. The following guidelines have been developed for use of our facilities. Agreement to abide by these guidelines is a condition of rental.

1. The use of Temple facilities is made available to Temple members in good standing.

2. The use of Temple facilities must be reserved in advance and approved by the Temple Executive

Director. Please note that other events may be scheduled during the time of your function.

3. Rental of the Social Hall for a Luncheon following a Bar/Bat Mitzvah ends no later than 4:00 PM; the caterer must complete clean-up and depart by 5:00 PM. Saturday evening events

begin not earlier than 7:00 PM and end by Midnight. The caterer can begin set-up two (2) hours prior to the start of the event and must complete cleanup and depart one hour after the end of the event. A member of the Temple Staff will be in the building during your event should any problems arise.

4. The use of the main kitchen is included in the rental fee for the Social Hall. The main kitchen is

generally not available when renting Room 101 or other facilities.

5. When SHACHARIT is in session, Sunday weddings may not begin prior to 3:00 PM. The Sanctuary

will be available for set-up after SHACHARIT ends at 1:30PM.

6. The Temple has limited storage space. Rental or other deliveries should be scheduled during the

time your Caterer is scheduled for set-up and rental removal should be scheduled during your caterer's cleanup. Any exceptions must be approved in advance by the Temple Executive Director or her designee.

7. Rental of the Social Hall includes the use of the room, the kitchen, banquet chairs and available

tables. 8. A set-up for the room needs to be discussed with the Executive Director or her designee at least

one week prior to the event. The Temple will set up tables and chairs for your function.

9. Because we have limited storage space, rental of chairs to be used in place of the Temple's chairs is not permitted.

10. You are welcome to choose any Caterer who is willing to enter into an agreement with the

Temple to abide by our rules (see enclosed Caterers Agreement). We suggest that you do not engage a caterer until he/she has signed a caterer’s agreement with Temple Shalom.

Pork or shellfish may not be served at the Temple.

Smoking is not permitted in the Temple.

Food or drink may not be served prior to the start of a wedding.

Food or drink is not permitted in the Sanctuary or in Rothman Chapel.

Decorations may not be placed on the walls of the Temple or hung from the ceilings.

Fog machines are not permitted at the Temple.

Glitter and confetti are not permitted at the Temple.

12. There must be full compliance with all state regulations regarding the serving and consumption of

alcoholic beverages. The caterer must carry liquor liability insurance if liquor is to be served. Alcoholic beverages may not be sold at the Temple.

13. Because a loose helium balloon can interrupt our fire prevention system and result in a false fire

alarm and response, along with a high associated cost, helium balloons are not permitted at events in the Social Hall except with the following restrictions:

Prior to the event, the renting family shall leave an additional $1,000 security deposit with the Temple to cover the costs associated with a false alarm. If no false alarm occurs, the deposit will be returned to the family.

All helium balloons must be securely anchored to prevent a loose balloon from setting off the fire alarm system.

Families should take special care to insure that their guests do not remove the balloons from their anchors.

All balloons must be removed from the Temple promptly at the end of the event.

14. Newton Fire Department regulations require that if candles are used for decoration, a permit

must be obtained by the renter in advance from the Newton Fire Department. The renter must take an exact model of the proposed display to Fire Department Headquarters for approval. The Temple’s Executive Director or his/her designee must receive a copy of the permit and a photo of the display at least one week before the event. The Temple reserves the right to confiscate all candles placed without a permit.

15. If you wish the services of a Newton Police Officer, the Temple will arrange it for you. The fee

must be paid at the time the request is made. This must be done a minimum of two weeks in advance of the date of your function.

16. Temple Shalom is not responsible for injuries suffered by any person using the facilities or for loss

or theft of any personal property belonging to persons using the facilities. Should any damage occur to Temple property, the family is responsible for the acts of their guests as well as the acts of those providing services for the event.

17. If you are transporting your guests by bus from the Temple, please ensure that your bus is

stationed on Myrtle Street or in the Peirce School parking lot. The Temple’s parking lot is relatively small and cannot accommodate a bus.

Temple Shalom Caterer’s Agreement – Part A

Please return a signed copy of this agreement to: Temple Shalom of Newton

Once this form has been received, it will be kept on file. Part B will need to be submitted for each event catered.

This agreement is made between _______________________________ hereafter referred to as “the Caterer,” and Temple Shalom of Newton, hereafter referred to as “the Temple.” The Caterer must provide Temple Shalom with

• A Certificate of Insurance naming Temple Shalom of Newton as an additional insured and showing proof of General Liability Insurance, including product coverage, of at least $1,000,000, and Worker's Compensation of at least $500,000.

• Proof of Liquor Liability Insurance if alcohol is to be served at the event. This Certificate must arrive in the Temple Office at least three (3) weeks prior to the caterer’s first event on the Temple premises and must be reissued whenever any insurance coverage is renewed or changed.

• A $200 security deposit at least 2 weeks prior to any event, to apply to any loss or damage to the building or equipment. The deposit will be returned to the Caterer after the event if there is no damage or loss.

• A $100 dumpster fee if the caterer wishes to use Temple Shalom’s dumpster. If the $100 dumpster fee is not paid, the caterer shall remove all rubbish from the Temple premises immediately following the event.

The Caterer shall designate an authorized representative who shall

• Be present at all times to supervise the use of the Temple facilities during each event.

• Inspect the facilities together with an authorized representative of the Temple at the end of each event.

Unless arranged in advance with the Temple

• The Caterer will not have access to the kitchen or Social Hall prior to the date of the event. Access times must be cleared with the Executive Director or his/her designee prior to the event.

• The Caterer must depart the premises one hour after the conclusion of the event. Because of limited storage space at the Temple

• Deliveries prior to the event must be arranged with our custodian.

• All property of the caterer and all rental items should be removed upon the conclusion of the event unless alternate arrangements are made in advance.

• Rental of chairs to be used in place of the Temple's chairs is not permitted. The Caterer shall not use any of the Temple's supplies or movable equipment, with the exception of tables

and chairs, which will be placed in accordance with a submitted floor diagram. It is understood that the Caterer will bring everything else required for the event.

The Temple’s dishwasher, stove, and disposal may be used under the supervision of Temple personnel. No

other fixed equipment may be used without specific authorization from the Executive Director or his/her designee.

Temple Shalom Caterer’s Agreement

The following are strictly forbidden:

• The serving of pork or shellfish

• Nailing, thumb-tacking, or taping anything to Temple property, including walls and tables

• Smoking on Temple grounds

• Food in the Sanctuary or the Rothman Chapel

• The serving of food or drink before any religious ceremony.

The Caterer will be responsible for the quiet and orderly conduct of his/her staff while using Temple facilities.

All driveways and exits must be kept unobstructed. The Caterer may not set up tables in the area outside the Social Hall prior to the start of a Bar/Bat

Mitzvah or wedding. All set-ups must be completed in a manner that does not interfere with any services or programs that may be in session elsewhere in the Temple.

The use of decorative candles requires prior approval by the Newton Fire Department. A plan must be

submitted to the Fire Department and approved by them. We must be advised in writing by the Fire Department at least 1 week in advance of the event that the use of candles has been approved. If the Newton Fire Department deems it necessary to have a Fire Officer onsite in order for candles to be used, that must be arranged and paid for by the family. Any candles used at an event without written approval of the Newton Fire Department will be confiscated by the Temple staff.

Prior to leaving the building the caterer must

• thoroughly clean the premises, washing area around sinks, stove, floor and equipment

• leave the Social Hall as well as any other spaces used broom-clean. If the event is in a space other than the Social Hall, access to the Kitchen facilities may not be available. If it is

not, food and beverages should be served on disposable plates, plasticware, etc. The Temple shall not be liable for any personal injuries or loss of personal property. The Temple reserves the right to refuse admittance to any caterer who fails to comply with these rules. The Temple reserves the right to modify or cancel this agreement upon thirty (30) days written notice to

the Caterer. Such changes shall be deemed accepted by the Caterer unless the Temple receives written notice to the contrary within (10) days thereafter.
