1.0 SCOPE OF THIS CORRIGENDUM 1.1 This Corrigendum 1 (containing 21 pages), is issued to clarify queries raised by bidders during pre-bid meeting held at BPCL Mumbai Refinery on 19.08.2015 and incorporate revisions made for the abovementioned tender. 1.2 Except for details mentioned herein, all other details contained in the abovementioned tender enquiry, shall remain applicable and unchanged. 2.0 EXTENSION OF BID SUBMISSION DATE 2.1 The extended due date for submission of bids is 11:00 Hrs of 18-09-2015.

PCMS Technical Form Should be able to detect, differentiate and classify

at least 20 simultaneous multiple events.

The system should be able to detect, differentiate and classify

simultaneously multiple events along the section of pipeline. There

should be no limitation to no. of events/alarms, the system can

generate for any section of pipeline. The system should generate

different alarms for different location with separation of 30 meters for

Manual digging and 50 meters for Mechanical Digging along the

pipeline.

Power Supply ( Presently not existing , new clause is included) “4.3.3: Continuous AC and DC power supply is available. Uninterrupted

DC is available at SV Stations like SV-47, SV-46, SV-45, SV-43 and SV-42.

DC supply is fed thru Battery Charger of rating 48V - 30 amps, Out of

this 15 Amps is presently being used. Also UPS is available at IP

Locations like Piyala (30KVA), Bijwasan (25 KVA), Mathura (20 KVA),

Bharatpur (40KVA), IP-4 (15 KVA) for Uninterrupted power supply.

Details of present load on power supply and the power available to

PCMS vendor will be based on the POWER CONSUMPTION & UPS

REQUIREMENTS (PCUR) form. Vendor is required to design its system

for power efficiency. Vendor is required to submit the PCUR form given

in Section 10.2 (System Drawings and Forms).”

Post Warranty Maintenance

Contract

POST WARRANTY MAINTENANCE CONTRACT :

PCMS bidder shall quote separately for Post

warranty maintenance contract of 4 years for

complete services and spares for the offered

system. COMPANY reserves the right to award or

not to award the post warranty maintenance

contract. The Post warranty maintenance.contract

is applicable after successful completion of

warranty phase. Personnel deployed shall have

thorough knowledge of the system. The lump sum

price of the post warranty maintenance services

shall be furnished separately for 4 years on yearly

basis. The post warranty AMC shall include the

following minimum.......

POST WARRANTY NON-COMPREHENSIVE MAINTENANCE CONTRACT :

PCMS bidder shall quote separately for Post warranty non-

comprehensive maintenance contract of 4 years for complete services

and spares for the offered system. COMPANY reserves the right to

award or not to award the post warranty maintenance contract. The

Post warranty non-comprehensive maintenance contract is applicable

after successful completion of warranty phase. Personnel deployed shall

have thorough knowledge of the system. The lump sum price of the

post warranty maintenance services shall be furnished separately for 4

Graphic User Interface (GUI) 1. Graphical User Interface (GUI) for Bijwasan and

Bharatpur will be in server-server configuration for

288 km stretch.All the data logging will be at both

the servers and both the servers should be in sync,

the client PC at Piyala will be an extension of server

of Bijwasan and Mathura from Bharatpur.In event

of non working of one server due to any reasons,

all the alerts/alarms should get recorded in other

server. Once the connection is restored between

the servers, the alerts/alarms should get duplicated

and again in sync.

Clients and Servers should not be older than the

Purchase order date. The resolution of satellite

imagery should not be more than 2.0 m.

Drawing doesn’t show IUs. It is not system

architecture. This is not final design. Design

submitted by supplier will be studied. SV-41 is

not part of present phase.

1.2

The bidder should have executed and completed

(excluding taxes, duties etc.) in any of the last

seven years reckoned from the tender due date as

per the below

requirement.

a) One similar completed work costing not less

than Rs. 10.35 Crores Or

b) Two similar completed works each costing not

less than Rs. 6.5 Crores Or

c) Three similar completed works each costing not

less than Rs. 5.2 Crores .

As requested earlier, due to Company confidential

information, shared PO copies would be without

prices.

In order to share order value information, we would

request quoting of Lump sum pricing information over

Letter head of " The Omega Company".

We would be submitting completion certificate,

unpriced PO's and other relevant information from the

end customer's.

Kindly suggest.

BPCL tender condition prevails.

Demonstration of similar project: Bidder to carry

out demo of the system in India;

a) at bidder’s factory. OR

b) at any end users’ location where the similar

system is installed and is successfully running on

a sustainable basis. OR

c) at BPCL site (dark (dark fiber will be provided

by BPCL in any of the section from SV-42 to

Bijwasan).

Regarding Demonstration of similar project, our

Technology provider , The Omega Company, is based

in Russia and has executed thousands of KM's project

there.

- As part of requirement (a) we would request that the

demo of our system be allowed at Omega Factory in

Russia. OR

- As part of requirement (b) we would request that

demo of the system in an end user location be allowed

in Russia

Scope of Work

1.5.7 In order to adhere to strict project schedule and to

shorten the major drawing/ document schedule

review phase, the PCMS MMI (covering graphic

displays, sample reports, alarm & events etc.) will

be finalized on the system itself. To achieve this,

after configuring the PCMS MMI, the PCMS bidder

shall present the same on one MMI workstation

(same or similar make/ model no. as offered for

PCMS project) with the corresponding software for

all these software modules loaded on it to

COMPANY. COMPANY will review these activities

on the workstation and shall give the comments/

observations on the same. The bidder shall

incorporate the COMPANY comments in the

system itself.

We would like to have a confirmation from BPCL that

the scope of incorporation of these comments into

system would be based on the offered solution by the

technology vendor. We would be sharing the detailed

solution overview along with all features and

functionalities being offered as part of that.

As per this clause, General software

functionalities/layout on the GUI will be checked

by BPCL, so that if some minor modifications are

required, same could be incorporated before the

finalization.

is placed at 3 O clock position.

3. Yes, OFC is in duct at some of the locations.

From Piyala to Bijwasan, OFC is totally in HDPE

duct, except at some location. From SV-42 to

Piyala, OFC is buried without any HDPE duct.

3.1.10 PCMS bidder has to specify the bandwidth

required for shared LAN required for networking

between stations where PCMS equipment/GUI will

be placed. Based on the requirement call will be

taken by BPCL to provide shared LAN Ethernet

connectivity at the locations from its existing

telecom network. If PCMS equipment require

more bandwidth more than 2Mbps for successful

functioning of the PCMS system then additional

fibers will be provided other than the sensor fiber

for use to the PCMS bidder to be used along with

Optical Gigabit Ethernet

switches (with Optical SFP and VLAN support) for

the additional required bandwidth for the project.

Maximum 3 no. (INCLUDING SENSING FIBER) of

fibers shall be provided for the project. The price

bid of the bidder should include the cost of

providing and installing of these Ethernet switches

based networking backbone at the locations.

Regarding availability of 3 Fibre strands (Maximum)

which includes both Sensing as well as

Communication part, we would request BPCL to

consider the following request.

For communication purposes, we would recommend

providing 4 Mbps bandwidth which can be provided

either by

- Giving an extra strand of Fiber which makes total

number of Fiber strands to 4

OR

- BPCL should provide 4 Mbps Bandwidth on their

shared LAN infrastructure for usage of our system.

For SV/IP stations where Air conditioning is not

present, the operational temperature rating of 55

degrees, looks to be very high. Considering this

temperature would be of inside of Room, we would

request BPCL to change it to around 40 Degrees.

In order to have proper estimation of site conditions,

we would request BPCL to consider site visit to few

such SV stations with support from onsite BPCL

personnel.

Tender Clause 4.1 (page 69 of 171) will prevail.

Vendor has to design system with that opeartional

constraint. Or Temperature of equipment can be

maintained by vendor by using panel mounted air

conditioning. No extra payment will be done for

such Air conditioining equipment. The electrical

and ventilation detail should be included in PCUR

and VACR form (Section 10)

ORDER AWARD / EVALUATION CRITERIA :

Unless otherwise specified, Order award criteria will be on lowest

quote landed price basis. Landed price will be summation of Basic

Price, Packing & Forwarding Charges, Excise Duty, Sales Tax,

Freight, Inspection, Octroi, Supervision of Installation &

Commissioning and other taxes & levies, loading etc, if any, reduced

by cenvat/vat credit

as applicable

With reference to clause 3.1.14 and 10 of Annexure 15 Bidder understand that we

have to consider only supervision of Installation & Commissioning in our price offer

while installation of the PCMS System will be carried out by BPCL. Please confirm if

our understanding is correct.

The entire scope is in bidder's scope

including Installation of the PCMS

System.

6.2. SALES TAX /

VAT/GST :

Sales Tax as applicable at the time of delivery within scheduled

delivery period will be payable by BPCL. Vendor shall give details of

local sales tax and/oror central sales tax

currently applicable in their offer. The rates applicable for “CST

without form C”, “CST

with form C" and “VAT” shall be clearly indicated.

Please advice if BPCL shall issue the C Form BPCL shall not issue 'C' form.

6.1 EXCISE DUTY Excise duty extra as applicable at the time of delivery within

scheduled delivery period will be payable by BPCL against

documentary evidence. Vendor shall mention in their

offer, the percentage of excise duty applicable at present. Any

upward variation in excise

duty rates, beyond the contractual delivery period, shall be to

vendor’s account.

Request BPCL to advice if Excise duty is refundable or not. Cenvat credit on Excise duty is not

available to BPCL.

7 General Duty Benefit Request BPCL to advice if we get zero duty benefit on Import content. Customs Duty benefit is not available to

BPCL.

Acceptance to price reduction for delay in delivery beyond

contractually agreed schedule @ ½% of undelivered order value per

week of delay or part thereof, subject to a ceiling of 5% of total

order value as per Clause No. 20 of BPCL’s GPC.

Bidder requests BPCL to consider as "…………liquidated

damages of 0.5% of the value of undelivered portion per week and or part thereof of

the delay subject to a maximum of 5% of the undelivered portion of the total supply

contract value.

pro-rata basis.

2. 20% of the Service PO value against the commissioning of the equipment on Pro-

rata basis.

3. 10% of the Service PO value against the final Site acceptance Test on Pro-rata

basis.

Warranty 4.17 WARRANTY PCMS bidder shall be responsible for the manufacture in respect of

proper design, quality, workmanship & maintenance of all

equipment, accessories etc. supplied by the PCMS bidder including

all services, spares and consumables for a period of 24 months after

taking over the system at site, for meeting the functionality and

performance requirements of this contract.

The mentioned clause is inconsistent. It only refers to warranty period for 24 months

from the completion. However, the instance of site fronts are not avalilable due to

reasons not attributable to the bidder is not covered. Hence, we propose to accept

the warranty clause as 18 months from the material dispatch or 12 months from the

commissioning of the system.

Bidder requests BPCL to review the payment terms proposed as per tender, since the

cash flow for the execution of the project will be poor. BPCL would appreciate that

majority of the equipments are imported and LC payments will be made by bidder to

OEM. The revised payment terms are as follows:

1. 20% of the supply PO value against the basic engineering drawing approval (GA

Drawing, Scheme, System Architecture, Cabiner Wiring)

2. 70% of the supply PO value against the material dispatch documents & original

Invoice.

3. 10% of the value against successful installation of the PCMS system. In case

commissioing is delayed for more than 60 days from the material receipt for reasons

not attributable to the bidder, BPCL shall release the balance 10% payment against

the Bank Guarantee of equivalent value.

EXCISE DUTY 6.1 EXCISE DUTY Excise duty extra as applicable at the time of delivery within

BPCL to confirm that being Refinery/ Manufacturing unit, does BPCL get any Excise

Duty Benefit. If yes, BPCL to advice so that Excise Duty will be quoted accordingly in

the offer. Other wise, current rate of Excise Duty at 12.5% will be applicable.

Cenvat credit on Excise duty is not

available to BPCL.

9 Custom Duty Custom Duty BPCL to confirm if 'Custom Duty' Benefit is available to BPCL. If yes, BPCL to confirm

that BPCL will extend the same to Bidder and Sub-Vendor of Bidder.

BPCL to also confirm what documents will be provided to take the custom duty

benefit.

Customs Duty benefit is not available to

BPCL.

2.1 PRE-BID

QUALIFICATION

CRITERIA

2.1.1

The bidder should have Proven Track Record (PTR) of Project

Management, design,

engineering, supply, configuration & testing of PCMS EQUIPMENT

with Graphics User Interface and necessary software for diagnostic

& maintenance functions, for job for minimum 100 KM of Cross

country underground pipelines used for transportation of

crude/petroleum products, successfully running for, not less than 6

months or 4000 hours. (Certificate to be submitted as per Proven

Track Record (PTR) format in Annexure-A or a format covering same

aspects). The bidder to provide completion & performance

certificate, Purchase Order(PO) copies and reference/contact

details of the client where the job has been performed. The PO date

shall be within 7 years prior to the tender due date.

Since this proposed system/technology is relatively new & being implemented in

phased manner in the Pipeline segment by end clients. We request BPCL to revise the

minimum length criteria as 40KM-100KM instead of 100KM. This will help BPCL to

evaluate more relevant technologies & benefit.

2.1 The average annual turnover of the bidder during the preceding

three financial years up-to 2014-2015 shall not be less than Rs. 3.9

Crores.

We understand that the subject package is very critical & prestigious for BPCL and

considerably significant investment for BPCL. For BQC, BPCL requires one work order

of minimum 10.35 Crores. Against this requirement, we observe that the mentioned

annual turnover of 3.9 Crores is very less and would attract financially weak bidders.

With such low annual turnover, bidder may not be able to execute such a financially

demanding project. We request BPCL to review the criteria so that the financially

capable bidders can participate & there will be level playing field.

2.2 The financial net worth of the bidder as per the last financial

year (2014-15) should be positive.

We have observed that the annual turn over for preceding three financial years is

required. Similarly, financial neet worth of the bider for the last three financial

years should be positive. BPCL to clarify the understanding.

Solvency Certificate shall be provided with atleast 90% of the

tender value (Budget)

POST WARRANTY MAINTENANCE CONTRACT

Clause 4.18 PCMS bidder shall quote separately for Post warranty

maintenance contract of 4 years for complete services and

spares for the offered system. COMPANY reserves the right to

award or not to award the post warranty maintenance contract.

This clause is modified as below; "The

pricing of AMC Service for all 4 year shall

consider for price bid evaluation."

Further, "Also bidder has to ensure that

AMC Service costing shall be in the range

of 5% to 10% of PCMS equipment (i.e.,

line item 1) costing." stands cancelled.

Since award of PWAMC is optional, we request you to exclude it from the price

evaluation. It is required that AMC is done to ensure proper functioning system

for 6 years.

Please refer Corrigendum 1.

The pricing of AMC Service for all 4 year shall consider for price

bid evaluation. Also bidder has to ensure that AMC Service

costing shall be in the range of 5% to 10% of PCMS equipment

(i.e., line item 1) costing.

We understand that the AMC charges are based on the total cost of the project.

Please clarify that the AMC charges shall be in the range of 5% to 10% for every

year.
