TENDER SCHEDULE FOR HIRING OF PRIVATE BUSES UNDER 'HIRE SCHEME'

APSRTCinvites applications from private entrepreneurs for supply of buses (BharatStage-III 2015 Model Express, Pallevelugu, Metro Express, City ordinary type &Bharat Stage - IV 2015 Model City Ordinary/Sub-Urban in Hyderabad City) under'Hire Scheme' for operation on the identified routes.

1. Buses to be offered by the entrepreneurs shall be 2015 model or later modelof following types. The vehicle/chassis should be purchased after receipt ofallotment letter.

The minimum seating capacity, Seating pattern and Minimum Wheel base of thebus shall be as indicated below:

2. The buses to be supplied by the entrepreneurs are proposed to be operatedon the identified routes during the agreement period. The details of routes,table of hire rate per KM., Specifications for fabrication of bus body and thenumber of buses to be allotted, are available in the www.apsrtc.gov.in.

3. The entrepreneur has to satisfy himself regarding route length, type of road,scheduled KMs etc. and other terms and conditions before submittingTender Form. No representation in this regard will be entertained at a laterdate.

4. The criteria of selection of the entrepreneur for allotment of identified routes:

1. The rate quoted by/the applicant for the route applied shall be as per theI

floor rate fixed fori a particular V.U. No allotment will be given in caseapplicant quotes more/less hire rate per KM than the fixed hire rate perKM, all such applications will be rejected and Caution Deposit amountpaid will be refunded.

: 2 :ii. The selection of the entrepreneur for allotment of identified routes will be

purely on the basis of single quotation on the particular route or onlottery basis, if there are more than one applicant for a particular route. Aprospective entrepreneur can file any number of applications for onebus.

5. The entrepreneur has to register the bus in the respective State within whichthe jurisdiction of the depot lies. However it is desirable to register the bus inthe respective District within which the jurisdiction of the depot lies.

6. No preference will be given to the applicant who is either an existing operatoror with ready chassis or bus. The decision of the Entrepreneurs' SelectionCommittee of the Corporation is final. In case the route allotted to thesuccessful applicant happens to be inter-State route, induction of the busproduced by the applicant on the allotted inter-State route shall be subject toobtaining necessary permit from the STA of A.P statey S'TA of T. State andgrant of counter signature from STA of reciprocating State. Corporation isnot responsible for the time delay in obtaining approval from the saidauthorities.

7. The agreed hire rate allotted to the applicant will remain unchanged till thetotal tenure of agreement period except: (a) adjusting the rate along with themovement (increase/decrease) of price of HSD Oil from time to time. (b)Revision of hire rates (increase/decrease) in line with revision in price(increase/ decrease) of tyres and wages of Drivers and Cleaners. However theperiodicity of review of tyres cost and wages is once in a year.

8. M.V.Tax will be borne by the Corporation from the date of commencement ofoperation of bus on the assigned route. The Corporation will reimburse theactual cost of comprehensive Insurance Premium amount paid on the vehicleon the pro-rata basis from the date of commencement of operation.

9. The entrepreneur who gets the allotment of the route will be allowed 90 daystime from the date of Route Allotment Letter for production of the bus (dulyregistered with respective RTAin A.P State/T.State) and together with originalR.C. Book and comprehensive Vehicle Insurance Policy (Corporation will notreimburse any expenditure incurred by the owner in registering the vehiclewith concerned RTAas per the standards and specifications and color schemeprescribed) before the Vehicle Inspection Committee of concerned District(Region) for certification of fitness and for operation on the allotted route. Incase the applicant fails to produce the bus within the allowed 90 days time,the Caution Deposit amount paid will be forfeited.

10. The new bus proposed to be given on hire shall be as per the specifications,standards, color scheme, wheel base, seating capacity and seating patternprescribed by the Corporation (As furnished in Website). And the bus has tobe fabricated at authorized bus body fabricators only.

-3-11. It is the responsibility of the entrepreneur to maintain the bus in good

condition. The expenditure relating to maintenance of the bus andoperational cost such as diesel, tyres, spares, lubricants, wages of Driver,Cleaner etc., shall be borne by the entrepreneur himself.

12. The entrepreneur has to enter into an agreement with Regional Manager ofrespective state.

13. The allotted route and allotted Daily KMs will not be changed except underexceptional circumstances such as Geographical changes on the routes dueto Natural Calamities, Construction of Bridges /Flyovera, Implementation ofOne Way Traffic, Modification/Extension of route to improve performance.

14. The period of agreement for buses will be as detailed below:

TYPE OF HIRE BUS AGREEMENT PERIOD

EXPRESSI 6 years (4+2) i.e. initially for 4 years from the date of introduction

METRO EXPRESSand extendable to 5th and 6th year subject to fitness of the vehicleand satisfactory performance of the service.9 years (4+2+3)i.e. initially for 4 years from the date of introductionand extendable to 5th+6th year subject to fitness of the vehicle. To

PALLEVELUGU be eligible for extension of 7th+Sth+9th year of agreement period,(DIST. ORDINARY) there shall be complete over haul of the bus body of the vehicle at

the end of 6th year, failing which no extension of agreement willbe given.

. 10 years (4+2+2+2) i.e. initially for 4 years from the date ofintroduction and extendable to 5th, 6th, 7th, Sth, 9th and 10th year

CITY ORDINARYsubject to fitness of the vehicle. To be eligible for extension of 7th,Sth, 9th and 10th year of agreement period, there shall be completeover haul of the bus body of the vehicle at the end of 6th year,failing which no extension of agreement will be given.

Note: Separate hire charges will be communicated at the end of 6th year of agreementand eligible for renewal of 7th, 8th, 9th, or 10th year of agreement as perapplicability and suitability. It is also to clarify that the hire rate charges for7th, 8th, 9th and 10th year may be generally less than the hire charges payable atthe end of 6th year.

15. The entrepreneur shall make the bus available on all days. A maximum oftwo days in a calendar month will be permitted for maintenance of the bus.

16.The entrepreneur shall give at least 24 hours notice to the Corporation, whenthe bus is not likely to be made available on any particular day dulyfurnishing the reasons.

!17. In case the entrepreneur fails to make the bus available without giving 24

hours notice or any other irregularity that attracts penalty as stipulated inthe agreement, the Corporation shall be at liberty to levy penalty of Rs. 500/-per day and to deduct the same from the hire charges payable to theentrepreneur. ~

18. The entrepreneur shall make the bus available for the period requisitioned ina day and operate the scheduled KMSgiven for the day.

19. The entrepreneur shall obtain individual Provident Fund Code No. from theProvident Fund authorities and recover PF / EDLIF contribution from thewages of the Driver engaged by him and to remit to the concerned PFauthorities together with Employer's contribution as prescribed in the PF actfrom time to time, every month. PF paid by Entrepreneur will be refunded onproduction of proof of remittance to concerned PF Authority.

20. The entrepreneur shall ensure recovery of the contribution towards ESI fromthe wages of the Driver engaged by him and remit to the concerned ESIauthorities along with the Employer's contribution by 21 st of every month andto see that all the benefits under ESI Scheme are extended to the Driversunder the ESI Act, 1948. The Corporation will reimburse the ESI amountpaid by the owner on production of proof of remittance.

21. The entrepreneur shall ensure payment of wages to the Drivers engaged byhim as per the rates prescribed by the Government from time to time, underMinimum Wages Act 1948.

22. The entrepreneur is required to register his undertaking before the respectiveAuthority of Labour Department under Section 3 of Motor Transport WorkersAct 1961, if 5 or more Transport Workers are employed and submit a copy ofthe same to the concerned Unit Officer.

23. The entrepreneur shall provide a Driver / Drivers with a minimum height of160 CMs not exceeding 58 years of age with a valid driving license i.e.,having a validity of not less than 18 months experience to drive HPMV/HGVor "TRANSPORT VEHICLE" and Passenger Service Badge for the bussupplied. The Driver shall be in prescribed Uniform while on duty. TheDriver shall follow the instructions of the authorized Officials of theCorporation.

24. The Driver employed by the entrepreneur shall undergo medical fitnessexamination by a Medical Officer of the Corporation at APSRTCHospital atTarnaka, Hyderabad and then only he will be permitted to ply the vehiclewhen the Medical Officer certifies that he is fit for the job of a Driver.

25. The entrepreneur shall not employ the following category of persons asdrivers operating the busesa) A person who has been retired on medical grounds, removed or dismissed from

the corporation. r

b) Aperson who is aged more than 58 years.

•c) A person who was working on any other hire bus and was replaced by theowner on a complaint made against him by the corporation for his replacementtowards any irregularity, misbehavioror involvementin a fatal accident.

26. The Corporation will provide Conductor for operation of the service withnecessary equipment / Ticket Issuing Machines for issuing tickets to thepassengers as well as luggage.

27. The Corporation shall have right to collect fare or luggage or freight chargesin case of bus parcel service, postal mail bags etc. and the entrepreneur shallnot have any right or claim over them.

28. The entrepreneur shall permit to display advertisement boards or panels onthe bus or in interior of the bus by the Corporation and its authorized agentand the owner has no right to claim the revenue.

29. When the bus is operated without a Conductor (one man service), the Drivershall have the responsibility to ensure issue of tickets to all the passengers.

30. While operating one man service, if a Driver is found to have committed anycash or ticket irregularity or any other offense, the entrepreneur shallreplace him immediately and be vicariously responsible for the omission andcommission of the Driver.

31. The entrepreneur shall depute the driver engaged on the hire bus forimparting requisite training programs as would be conducted on safe drivinghabits and courteous behavior with passengers and other passenger friendlymeasures / schemes duly paying the prescribed fee.

32. The entrepreneur shall not use the bus covered by the agreement to ply forothers or for any other purpose during the period of stoppage formaintenance / carrying out repairs. Agreement is liable to be terminatedwithout notice in case of any violation.

33. The entrepreneur shall ensure prescribed monogram on sides of bus. Theentrepreneur shall not paint any other matter on the bus, except theadvertisements painted or displayed by the Advt. contractors appointed bythe corporation.

34. The entrepreneur shall be liable for penalties / fines levied by the OfficialsofCorporation at the rates specified for the delinquencies / irregularities asindicated in the list.

35. The entrepreneur has to operate the bus on the route allotted and completethe given schedule. /.

36. The entrepreneur shall not allow operation of any other passenger vehicleowned by him / her or belonging to his / her family members illegallyon thenotified routes infringing the monopoly of Corporation and in case ofviolation, he / she is liable for action which includes termination ofagreement.

37. The entrepreneur or his j her family shall not indulge in operation of theirother vehicles as con tract carriages or All India Tourist vehicles nor own oroperate travel agencies either in their name or in the name of his j herfamily members. Any violation of the condition entitles the Corporation toterminate the contract by issuing one month notice.

38. The entrepreneur has to produce the bus for inspection in fit condition withinthe time prescribed, and the bus has to be constructed at an authorized busbody fabricator.

39. Following registration fee (Non-refundable) shall be paid through a demandDraft drawn in favor of CURRENT AIC, Dy.CAOI AO of the respectiveregion.

Above Registration fee will not be refunded in case the application becomesinvalid due to any reason i.e. either due to placing on wrong Tender Box orApplication by minors or failure to enclose Caution Deposit Demand Draft etc.In case, no registration fees D.D is enclosed to the Application form, the samewill become invalid and an amount of Rs.l ,250/ - will be deducted from theCaution Deposit amount paid by the applicant and balance amount will berefunded.

40. Following Caution Deposit (refundable on production of the bus) shall be paidthrough a Demand Draft drawn in favor of CURRENT AIC, Dy.CAO/AO ofthe respective region and be submitted along with the application. Refusalto accept allotment of route on offering, basing on the eligibility and failure toproduce the bus on allotment of route entails in forfeiture of Caution Deposit.

41. Transfer of application in favor of other persons is not permitted.

42. Employees of APSRTC and their family members as defined In APSRTCEmployees (Conduct) Regulations, 1963 are not eligible to supply busesunder "HIRE SCHEME". Minors under age of 18 years are not eligible toapply.

43. The deployment of buses taken in this Scheme shall be made on vanousroutes as decided by the Committee constituted for the purpose and thedecision of the Committee is final.

44. Application Forms, list of Routes, Tender Schedule containing the Terms,Conditions and other details of the Notification and Specifications, Standard,Seating Pattern, Wheel Base, Color Scheme of buses and the list ofAuthorized Bus Body Fabricators, will be available with the APSRTCWebsite.They can be obtained at free of cost from 03.01.2015 onwards up to oneworking day before the date of tendering of applications of concerned District.

45. The filled in application Forms together with two Bank Demand Drafts (asdetailed above) duly sealed in a thick cover of 10 Cms. X 23 Cms. shall beaddressed to the Regional Manager, concerned Region, with superscription ofthe type of bus applied, route applied and applicant's address on the coverand should be put in the concerned Dist. Tender Box only placed in the AllRegional Manager's Offices (Except Kadapa, Kurnool, Anantapur &Prakasam) of corporation during 10.30 Hrs to 14.00 Hrs on the datementioned below. The Tender Box will be sealed at 14.00 Hrs. The TenderBox will be opened at 15.00 Hrs. in the presence of Tenderers for short-listing of eligible applicants. The place and time of conducting EntrepreneursSelection by Regional Committees will be as detailed below. Allotment lettersto successful entrepreneurs will be issued on 22.01.2015 after obtainingapproval of the concerned ED/ Zone.

46. The entrepreneur who applied shall have to attend the concerned Office asnotified above at 15.00 Hrs. at which time the tenders will be opened intheir presence on the concerned date mentioned above. The representativesattending on behalf of applicant shall have valid authorization. Theentrepreneur shall come prepared to stay till the completion of the entireproceedings which may extend beyond one day.

47. Applications received after the time fixed and incomplete applications andwithout Registration fees and Caution Deposit, are liable for rejection.

48. The entrepreneur shall keep the bus road-worthy in terms of the provisionsof M.V. Act 1988, CMV Rules 1989 and APMV Rules 1989 made thereunder from time to time by carrying out necessary maintenance and repairs.

49. The entrepreneur shall get the vehicle insured comprehensively so as tocover all risks. Insurance Policy of the vehicle shall have "IMT 44"(Indemnity to hirer-package policy-negligence of the owner or hirer)endorsement from the concerned Vehicle Insurance Company. Noncoverage of Vehicle Insurance entails in termination of agreement withoutnotice.

50. The Corporation shall not be responsible for any damage or loss caused tothe bus hired during the period of agitations, accidents, etc.

51. The entrepreneur shall be responsible for proper prosecution of proceedingsunder statute and also responsible for all claims that may arise due tostatutory violations out of the operations, like claims due to accidentspayable under the provisions of M.V. Act / Rules and accident claims.Corporation shall under no circumstance be made liable or responsible topay compensation that may be awarded by Motor Accidents Claims Tribunalor Tribunals, in respect of accidents. In the event of payment ofcompensation by the corporation to the injured persons / dependents ofdeceased persons or to the owners of the property damaged, by any Awardof the Motor Vehicle Accidents Tribunal/Order of the Court in casesinvolving accident to hire buses, corporation shall have right to recover thesaid compensation from the entrepreneur. The entrepreneur hereby agreesthat he shall not dispute the said recovery.

52. The entrepreneur (owner of the hire bus) shall arrange immediate financialassistance to cover Medicare to injured persons / dependents of thedeceased incase of accpidents involving the hire bus. If due to reasonswhatsoever, the entrepreneur is unable to arrange immediate financial reliefand if the Corporation arranges the same, such amount will be recoveredfrom the hire charges payable to the concerned Hire Bus Owner.

53. It is the responsibility of the entrepreneur to implement statutory Laws. It isalso the responsibility of the entrepreneur to implement statutory labourlaws in respect of drivers and other employees employed by him and producerelevant license. In case of any claim / award / order of any competentauthority, it shall be the responsibility of the entrepreneur to makearrangements for proper prosecution of proceedings before the competentauthority. It is mutually agreed that Corporation shall not be maderesponsible for any claims / awards / order of any competent authoritypassed in pursuance of the statutory labour laws in relation to drivers /other employees employed by entrepreneur. In case of any claim, award ororder of any competent authority making RTC responsible, the entrepreneurshall make good of such liability.

54. It shall be the responsibility of the entrepreneur to make arrangements forproper prosecution of proceedings either before Motor Accidents ClaimsTribunal or Tribunals, Commissioner for Workmen Compensation, RegionalTransport Authority (RTA)and State Transport Authority (STA).

55. (a) It is the responsibility of the entrepreneurs to get themselves registered asper the provisions of Sec.17 (7) of AP VATAct 2005 and obtain necessaryTOT / GRNnumber.

(b) As per the provisions of Sec.4(8) of AP VATAct 2005, the entrepreneur isliable to pay Value Added Tax (VAT)over the hire bills received by themfor operating their hire buses with corporation under transfer of right touse goods.

(c)The Corporation will reimburse the VATamount paid by the entrepreneursto the extent of 1% only on the total hire charges received fromcorporation. No representation for enhancement beyond 1% will beentertained.

56. Corporation reserves right to utilize the vehicle engaged under hire on anyroute and at any time.

57. Corporation reserves the right to cancel this Tender Notification or reject anyor all the applications without assigning any reason.
