2 . RULES AND REGULATIONS

The Tesoro Alaska Pipeline Company , hereinafter called " Carrier ," wi l l receive petro l eum products for intrastate transportat i on from or i gin points named herein to destinat i ons named herein , under the following regulations and conditions :

2 . 1 FACILITIES AT DESTINATION

Petro l eum products wi l l be accepted for transportation onl y a f te r the consignor or consignee has made necessary arrangements for facilities to rece i ve same at dest i nat i on .

2 . 2 DESCRIPTION AND SPECIFICATIONS REQUIRED

Petro l eum products accepted for transportation are those havi ng an A. P .I. gravity ranging from 30 degrees to 7 5 degrees , a Reid vapo r pressu re of n o t more than 1 4 pounds per square i nch, a v i scosity of not more than 40 seconds Sayb o l t Universa l at 1 00 degrees Fahrenheit and a color not darker than No . 3 N. P . A. Fur ther , petroleum products accepted for transportation s hall meet Carrier ' s mi n i mum specifications f or the product in question.

Carrier , for corrosion protection , may inject inhibitor compound , and petroleum products containing such inhibitor sha l l be accepted by shippers at destinations.

2 . 3 MINIMUM SHIPMENTS

Section A: Petroleum products shall be tendered for transportation in quantities of not less than 10 , 000 barrels (42 United States Ga l lons per Barrel) of similar quality and color from one cons i gnor consigned to one consignee . At dest i nations , consignor or consignee sha l l accept deliveri e s in quantities equal to t hat tendered .

Section B: If total vo l ume for shipment during anyone month exceeds the pipe line delivery capacity f or such month , petroleum products offered by each shipper for transportat i on will b e transported i n such quant i ties and at such times to the limi t of capacity so as to avoid discrimination among shippers .

2.4 IDENTITY OF GASOLINE OR PETROLEUM DISTILLATES

Al l petro l eum products wi l l be accepted for transportation on the condition that Car r ier will use due d il igence to t r anspor t same to destination with a minimum of contamination and to mainta i n the identity of each shipment . However , it being impracticable to ma i ntain absolute identity of each inbound shipment of petroleum products , reasonable substitution of gallonage of the same kind of commodity will be permitted . In the case of products such as unleaded gasolines and aviation gasolines , which requi re extraordinary protection to avoid trace contaminants , s hippers must accept the interface mixtures between such products and l eadi ng or trailing products or reimburse the Carrier for a l l costs involved in degrading such mixtures to l ower valued p r oducts.

2 . 5 GAUGING AND TESTING

Petroleum products wi l l be gauged either i n tanks or through meters , and may be tested by Carrier prior to acceptance .

2 . 6 MEASURING AND VOLUME CORRECTIONS

Pet r o l eum products will be received and delivered on the bas is of volume corrections for temperature from observed temperatures to 60 degrees Fahrenhe i t . Full deductions will be made for all water and other impurities in products received or delivered .

2 . 7 DELIVERY AT DEST I NATIONS

Upon arrival at destinations , the petroleum products will be delivered into facilities provided by the consignor of consignee for account of the consignor or consignee .

2 . 8 LIENS AND UNPAID CHARGES

Petroleum products wil l be accepted for transportat i on only when free from all liens and charges .

2 . 9 PIPAGE CONTRACTS REQUIRED

Separate pipage contracts in accord wi th this tariff and these regulations , covering further details , may be required of the proposed shipper before any duty of transportation shall arise .

2 . 10 SHRINKAGE AND EVAPORATION

Some gain or loss i.s unavoidably incident t o pipeline transportation due to the inherent nature of petroleum products and such gains or losses shall be borne by the shippers and shall be apportioned among them at the end of each calendar month on the proportional basis that the volumes received from each shipper for the calendar month

'bears to the total volumes received for transportation during the calendar month .

2 . 11 TRANSPORTATION CHARGES

Transportation charges will be assessed and collected at the rates named herein on the basis of the number of barrels of petroleum products actually delivered at destination after volume corrections as provide d for in paragraph titled "Measuring and Volume Corrections. "

2 . 12 PAYMENT OF TRANSPORTATION AND OTHER CHARGES

The transportation and all other lawful charges accru ing on petroleum products accepted for shipment , based on the rate applicable from t he origin point to the destinat i on at wh i c h delivery is made , sha ll on demand be paid before the release of petro l eum products in the custody of Carr i e r. If required , charges shal l be paid prior to r ece ipt at or igin point. Petroleum products accepted fo r transportation shal l be subject to a lien for all lawful charges .

2.13 RECONSIGNMENT

If no out - of- line movement is required , and subject to paragraph titled "Min imum Shipments ," reconsignment may be made without charge subject to the ru l es and regulations applicable to fina l destination as provi ded herein .

2 . 14 LIABILITY OF CARRIER

While i n possession of the property here i n described , Carrier shall not be liable for any loss or damage or delay caused by the act of God , public enemy , quarantine , authority of law , strikes, riots , fire , floods , or act of defau l t of shipper or owner , or of any other cause not due to the negligence o f Carr i er whether similar or dissimila r to t h e cause here in enumerated ; in such case , the owner of the product s hall stand the loss .

Carrier wi ll not be li able for disco l o r ation , comming ling, contamination , or deterioration of petroleum products transported unless discoloration , commingling, contami nation , or deter i oration is caused by the negligence of Carrier .

Normal commingling which occurs between batches may be divided as equably as possible among the shippers participating in the batches causing the commingling .

2.15 CLAIMS; TIME FOR FILING

As a condition precedent to suit for damages , claims must be filed in wri ting with Carr i er wi thin nine (9 ) months a ft e r delivery of t he property or in case of fai l ure to make de l i very , then wi thin nine (9) months after a reasonab l e time has e l apsed , and suit shall be instituted against Carrier onl y within two (2) years and one (1) day from the day that notice in writing is given by Carrier to the claimant that Carrier has disallowed the claim or any part or parts t hereof . Where c l aims for loss or damage are not filed or suits are not insti tuted thereon in accordance with the foregoing provisions , such cla i ms will not be p a id and Carrier wi l l not be liable .

2 . 16 DISPOSITION OF COMMINGLED MIXTURES

A 1 , 000 barrel tank for the receipt and distribution of commingled mixtures at the Anchorage terminal has been provided by the Carr i er . The Carrier wil l receive into such tankage all interface mixtures of products containing dissimilar physica l characteristics . Such product will then be prorated among the shippers and delivered to t h e shi ppers direct by (1) blending during de liveries of each shipper ' s products , or (2) loading onto transports provided by each shipper.

In order to provide space in Carrier ' s tankage at Anchorage for the receipt of succeeding shipments o f commingled mixtures , Carrier may give notice to cons i gnor or consignee to remove commingled mi xtures held fo r i ts account in Ca r rier ' s tankage .
