To qualify for the discount on your 2015 health plan contribution, you must complete the online health assessment by Nov. 14. You will still need to earn 500 or more wellness points as in the past, but you are not even eligible to qualify if the health assessment is not complete by Nov. 14. Members who completed the health assessment using the Zensey tool will receive credit for the assessment and do not have to retake the assessment this year. Members who attempted to take it under Zensey, but did not complete it, must take the new assessment at mycigna.com. The City of Houston Human Resources Division heard the loud voices of many of you at our September meeting and made changes as a result.

Effective Sept. 22, HR and Cigna discontinued the use of Zensey for the health assessment and have reverted back to last year’s procedure. Employees may access the health assessment on mycigna.com.

To qualify for the discount on your 2015 health plan contribution, you must complete the online health assessment by Nov. 14. You will still need to earn 500 or more wellness points as in the past, but you are not even eligible to qualify if the health assessment is not complete by Nov. 14.

Members who completed the health assessment using the Zensey tool will receive credit for the assessment and do not have to retake the assessment this year. Members who attempted to take it under Zensey, but did not complete it, must take the new assessment at mycigna.com.

This new policy will get our message out beyond our members. There will initially be no cost, but a small fee may be imposed if the demand exceeds the 5,000 number. Each member will continue to receive the Badge & Gun at no cost.

Anyone with a computer can already read our paper online at hpou.org, but many still prefer to read an actual paper. We will announce an email address soon where those interested can register to receive the paper.

Promotional Testing CompleteThe last of the three promotional exams was completed last month when the lieutenant assessment was held on Sept. 20. As with every promotional test, there were issues and everyone was not satisfied. The city has certified all lists but the HPOU is still researching all complaints to ensure fairness to everyone.

This was the first promotional exam where a member of the Majority Bargaining Agent (HPOU) and a member of the Command Staff monitored the assessors grading the candidates.

There will be no more promotional exams under the current contract and I would anticipate both sides taking a close look at the promotional system in the next contract to improve on the current system. No system is perfect, but we must strive to make the system as fair as possible for the many who put their lives on hold to study for these exams and assessments.

Thanks to the families of the candidates as well for altering your lives during this process.

PAC EndorsementsEarly voting starts soon for the general election on Nov. 4. All HPOU PAC endorsements are listed at HPOU.org and this issue of the Badge & Gun. Please remember to go all the way down the ballot to vote as many of our judicial friends are near the bottom.

If you are a regular voter, you will receive many voter guides in the mail from various “groups” or individuals. Please know that our PAC has carefully screened the candidates we have endorsed to ensure that they are pro-police and will protect those benefits we have been promised.

HPOU ElectionsSign-up for the two vice president positions and all the even numbered Board Positions closed on Oct. 2. Voting for the contested races begins at noon on Oct. 6 and ends at noon on Oct. 17. All voting will be done electronically at hpou.org. Sgt David Balderaz is the election chairman for this election.

We hope to see many of you and your families at the annual picnic at Tin Hall on Saturday, Oct. 18. You must have tickets to enter. All tickets are free at the HPOU, but issuing them to members and their families allows us to get an idea of the number planning to attend.

Editor’s Note: The City’s online health assessment campaign has drawn the ire and concern of HPD officers because of the perceived threat to their privacy. The Badge & Gun offered the City’s Human Resources officials the opportunity to address this issue and other frequently asked questions about health assessment. Here with the response is Elise Rambaud Marrion, Senior Communications Specialist for HR.By ELISE RAMBAUD MARRION In today’s digital landscape, Internet users have a responsibility to safeguard their personal privacy. Savvy consumers should always read and fully understand online agreements and privacy disclaimers before “checking the box.” So, asking questions is the right thing to do.

When Houston police officers and the Houston Police Officers' Union had questions about the recent employee online health assessment, the city of Houston Human Resources department and Cigna listened.

As part of Human Resource’s annual online health assessment campaign, Cigna introduced a new health assessment tool to city of Houston employees called Zensey in early August. Effective Monday, Sept. 22, Cigna ceased use of Zensey and reverted to the University of Michigan Health Assessment, the familiar health assessment tool used in previous years.

Although safeguards were in place to prevent the release of personal information, Zensey’s format raised some privacy concerns among employees, including representatives from HPOU. To address those concerns and move forward with employee health assessment participation, Human Resources and Cigna elected to discontinue the use of Zensey.

“Zensey was entirely HIPAA compliant, and employee personal health information was never at risk,” Human Resources Director Omar Reid said in a message to HPD officers.

“We heard your concerns, and we didn’t want anything to distract employees from participating in the health assessment and qualifying for a discount on your health plan contribution.”

Paula McHam, Cigna account executive, reiterated that online health assessments are a common practice among large employ-ers, and emphasized Cigna’s commitment to protect employee privacy.

“Cigna has a legal agreement with Audax, the creator of Zensey, to protect the personal health information of our clients,” McHam said. “Cigna regards privacy with the highest priority, and we want city employees to be confident that their information is treated with the utmost care and confidentiality. We don’t sell, publish or share your data.”

The health assessment is a valuable tool that gives Cigna and the city a holistic view of employee health. It enables the city to tailor specific educational programs and even offer zero-copay programs based on the

concentration of specific health conditions. For example, when the biometric screenings and health assessment revealed a prevalence of high cholesterol among employees, the city began providing free generic cholesterol medications to employees.

“The city’s focus on wellness is not so we can have personal information about employees. This is about empowering employees and helping them help themselves. Over the last four years we have seen how people’s lives have been transformed because they took control of their health,” Reid said. “The health assessment not only alerts employees to potential health problems, but it has a financial impact,” Reid said. “We have been able to prevent premiums from increasing and actually rolled back copays. Those things are not so we can be more intrusive upon employee privacy, it is so we can help them be healthier and enjoy more fuller and richer lives.”

Effective Sept. 22:All employees can access the health assess-ment on mycigna.com. Be sure to have your Cigna ID card, your username and password.

By TOM KENNEDYHPOU is learning that Facebook and Twitter is “a good way to interact not only with our membership but also with the community.”

The Union’s 2nd Vice President Joe Gamaldi said the social networking services prove every day that they are “an essential tool in communications” and underscored the message: Like us on Facebook and follow us on Twitter.

“As a whole, these are a great way to communicate basic announcements to our membership but get across our side of the story of the day to our friends and followers as well as the mainstream media,” Gamaldi told the Badge & Gun.

“Our posts can reach over a quarter million people,” he said. “We want to urge members to encourage their family members and friends to like us and follow us on these social networking services.”

Gamaldi said HPOU has had more than 10,000 “likes” on Facebook and expects to see the number grow by great numbers. He said “media types, council members and state representatives are finding out that Twitter “is a good, fast way to learn the word that we want to get out.”

Hundreds and hundreds of Houstonians follow HPOU on Twitter and – like Facebook – the numbers continue to rise on a daily basis, Gamaldi explained.

Gamaldi especially pointed out that HPOU on Facebook provides monthly video recaps of monthly general membership meetings for officers unable to attend those programs held the first Thursday of the month in the Breck Porter Building on State Street.

“Now if you can’t make it to the meeting,” he said, “you can see a video of HPOU President Ray Hunt providing a brief recap of major business, policies and related news. You still get all the information and you don’t have to be there.”

Facebook and Twitter have revolutionized the world of social networking. Facebook, launched in February 2004, now has 1.3 billion users.

Twitter, created in March 2006, enables users to send and read short 140-character messages called “tweets.” More than 100 million users post more than 1.6 billion tweets per day.

By TOM KENNEDYHPOU 2nd Vice President Joe Gamaldi said the number of officers signed up for the Union’s Courtesy Ride Program has doubled over the last year.

“The program has been an overwhelming success,” said Gamaldi, who led the establishment of the program, which now celebrates its second full year of operation.

“It has received frequent usage over the last two years, and has provided rides to officers that have had too many on a night out.”

“It’s a very active program that accepts people who realize that they have had too many on a night out. We hope members will continue to utilize this service when it’s needed.”

The number of program participants has almost doubled in the last year.

Last year at the one-year anniversary mark there were 300 officers who had signed up to use the program, sponsored in cooperation with Yellow Cab and Mothers Against Drunk Driving (MADD).

“We have had over 550 sign up for the program since its inception,” Gamaldi said.

“We believe the cab program has raised awareness about drunk driving and reaffirmed the message with the membership that they don’t make a bad decision when out on a night on the town.”

He praised Yellow Cab as being “a great partner,” saying, “Any time we’ve requested it, they have come through. They have also provided giveaways for the HPOU picnic and always seem happy to oblige whenever we need their help.”

All an HPOU member has to do is get a prepaid Yellow Cab Taxicard is stop by the Union, sign off on the program’s rules and “get your card” at no cost. Everything is done discretely without any names being made public.

The card is used for the cost of the fare and tip, its value is reloaded after any cab ride home.

The program was developed with Yellow Cab and patterned after one designed by the Dallas Police Association.

Gamaldi reminded officers that the card can only be used for a ride home; it cannot be used for bar hopping. Only officers may use the card but they may have a guest(s) going to the same destination.

“I want to extend a reminder to the folks that we do audit the program every week to check usage and reload the cards accordingly,” he explained.

Gamaldi chaired the committee that put together the program and regularly reminds his fellow officers that “we are very sensitive to the fact that we (Harris County) lead the nation in drunken driving deaths. We don’t want to lose our officers to that.”

The Adaptive Athletics at the University of Houston and the 2014 Wheelchair Rugby Smash Tournament Fundraiser will be held Nov. 15 at the university’s Campus Recreation and Wellness Center.

The Wheelchair Rugby Smash Tournament Fundraiser is a 509 (a)(1) charitable event established by Adaptive Athletics at UH.

The HPOU is sponsoring two teams as well as the luncheon.

“Our mission this fall,” founder and president Serjio Brereda said, “is to raise funds in order to foster the development of an athletics program at UH for students with disabilities, beginning with Wheelchair Rugby.”

Brereda said the tournament will consist of 12 teams; each team will have a minimum of four players to a maximum of eight. Each team will be assigned a local wheelchair rugby athlete for guidance and competitive play. The entry fee is $500 for-profit and $375 nonprofit teams, which includes a t-shirt and lunch for all participants.

Adaptive Athletics at UH is offering a safe and fun experience for those interested in trying this unique sport.

By Sgt. J. S. CRUSERCrime Scene UnitThe Field Interview Card is an invaluable tool that is beginning to be utilized by our department in a larger and larger capacity. One of my responsibilities when RMS went live was to monitor the status of the cards as they were completed.

I noticed that we got very few in June when the system was turned on. Of course this was expected because the entire system was new. Now, three months later, almost 100 cards have been entered into the system.

Data that you enter into a Field Interview Card can be searched within RMS and provide tips, clues, person or vehicle identities, and much more. If you have never entered a card, I want to encourage you to try and enter one the next time you have a suspicious encounter with someone.

To those that have already taken the extra step of entering a card, thanks and keep them coming!

I would like to touch on some issues that I have seen while reviewing the process and the cards.

The first is that very few officers are correctly following the procedures necessary to make an Interview Card searchable in RMS. This is a critical procedure that must be completed by you when you complete the card. If it is not done, then the card will not become available until an RMS team member searches for non-transferred cards. This creates a delay that can cause data not to be entered into the system until much later.

The three step process to enter the Card into RMS is:• Enter your card and Owner Approve the card. Most officers

complete this step.• Right next to the Owner Approve tab is a tab labeled, “Freeze”.

Select it and click “Approve”.• Right above the Freeze tab is a tab called, “RMS Transfer”. Select it

and click the button that says “RMS Transfer”. You will then receive a “Transfer Complete” message.

The second issue is the proper use of the Field Interview Card.

The FI Card is good for intelligence, trespass warnings, suspicious people or vehicles, suspicious circumstances, minor mental health contacts, etc. It is not used to enter CYA information, tow information, gang member documentation or other situations that require a proper report or a different procedure (e.g. a person in crisis) to be followed.

With regards to Mental Health issues, and if necessary, fill out the CIT/CIRT referral form on the HPD Portal.

Here are some actual entries in RMS (Info changed):

Possible Agg Assault suspect possibly armed with several rifles. Suspected of driving white Impala with false license plate xxxxxx returns to a maroon Toyota. Depending on other info, this should probably be a report.

Caller says she has been keeping records of when she’s eaten a meal and gotten sick. She thinks her husband may have something to do with it. She says he is a CIT consumer. Ok to enter an FI Card; also consider completing CIT/CIRT form on Portal.

6300 Bellaire: Traffic Stop with person and vehicle entry, NOI. Traffic stops do not need to be documented on a FI Card unless there is relevant information for entry, not just as a matter of course.

Person is CIT and believes celebrities and movie stars want to visit him. Ok to enter an FI Card; consider completing CIT/CIRT form on Portal.

On 05-22-2014, Mrs. Roberts contacted me, Narcotics Officer xxxxxx, from xxx-xxx-xxxx, to relay information regarding some suspicious young black males in or around her complex located in the 5800 block of Cullen Rd. She told me that she had observed around 3-4 young black males with a purse, and she was pretty sure there were no females with them. Rumor is that the young males living in her area, are committing robberies. She could not identify them or give a good description, but gave this license plate #xxx-xxxx. I did not find a registration of the plate but she described it as a silver or gray 4 door car. NOI. Excellent use of the FI Card.

Reportee who is manager had group (1 W/M, 2 B/M, 1 B/F) come in to eat. Only B/F paid for meal, others did not pay and began to eat. When manager saw this theft of service she confronted them. W/M in group began cursing manager, calling her a bitch for not letting them eat pizza. When she told them to leave or she was calling cops they left. W/M out the door was cussing at manager. She followed them out getting plate xxxxxxx from truck they got in. W/M said watch out when he comes back. Others were yelling at W/M to get in truck he was being a dumbass. This is a criminal offense and a report should be written.

Vehicle towed to 9401 Ronda for driver not having correct license for vehicle type. No motorcycle license. No license plate on vehicle. Towed by Stor N Texas Area 5 Storage Facility. Phone number 281-879-5173. Wrecker John Wiggins, City license number xxxx. Tow slips should be entered in the report system, not the FI card.

Was called to the location in regards to an assault in progress. As we arrived, the suspect had left with the complainant in the complainant’s car. 3rd party caller stated he heard suspect beating on complainant. The vehicle was last seen heading north on Irvington. This is a criminal offense and a report should be written.

Listed person is a gang member with SW Texas/Tango Blast. Gang members must be documented in Gang Tracker, not in FI Card.

Listed person is a prostitute who uses meth and heroin. She was given a trespass warning (Baymont Inn), 9902 Gulf Fwy, employee Ashley Smith 04/12/91, TDL 33948432. Excellent use of the FI Card.

La Paint and Body Shop - 281-xxx-xxxx is selling salvaged vehicles in violation of Transportation Code 501.098 and using fake dealer tags. Sold to an illegal immigrant, ford minivan, VIN JM3KW83J630363774. This is a criminal offense and a report should probably be written.

HPOU honored Officer Adrian Jones as Investigator of the Month at the September general membership meeting.

Sgt. C. E. Ponder of South Gessner Division detailed how Jones’ investigation resulted in the arrest of a robbery suspect.

On July 7, Officer Bobby Conley responded to a call on a robbery at the Metro PCS store in the 5700 block of Chimney Rock. A Hispanic or Asian male with his face covered robbed the store at gunpoint.

“The complainants mentioned that a Hispanic female had come into the store and filled out an application for employment,” Ponder said. “Officer Conley wisely included this information into the report.”

Jones’ investigation had information that the suspect left the scene in a black mini-van and that this individual “had a sleeve of tattoos on his right arm which started just below the elbow.” She also discovered that five other Metro PCS robberies had happened on the Southwest side.

The female’s application for employment revealed that this applicant had a boyfriend fitting the physical description of the robber. The boyfriend also owned a black mini-van.

Jones obtained a pocket warrant for the suspect and secured a consent to search his home. “During the search we recovered the clothing that was used in each robbery (the same hat, shirt and shoes),” Sgt. Ponder said.

Before interviewing the suspect, Officer Jones placed the clothing used in each robbery along with a still photo of the suspect committing the robberies on the conference table,” Ponder said.

“The suspect was brought into the office and was allowed to pass by the conference table heading to the interview room.

“He looked at the clothing and the still photos and then looked up at the ceiling. He was then taken into the interview room where he confessed to six robberies.”

By VERDI R. LETHERMONHow do you say goodbye to the Department and the people who have accepted, embraced, respected, supported and trusted you for 20 years?

I don’t know the answer to that question, but I do know it’s NOT easy!

I literally stumbled into HPD 20 years ago,not having half a clue that my life would be forever changed. Prior to my interview, I never imagined that I would work in law enforcement — especially not for a bureaucracy the size of HPD.

I was my own boss in private practice, and I was not interested in giving up my autonomy to join an organization with a chain of command. My colleagues thought I was crazy to even consider it. In hindsight, it was one of the best decisions I ever made.

I will always remember my interview/ tour of the Department with Greg Riede. I knew NOTHING about law enforcement! I was amazed to learn about the complexity, depth and career opportunities with HPD—under one payroll number. My mouth dropped then, and I have not closed it in 20 years.

I will also never forget Greg’s words to me during my interview. He said to me, “We’ve worked very hard to gain the trust and respect of the officers in the Department. Don’t screw it up.”

Those words were permanently etched in my heart and brain, and I have worked very hard to live up to that challenge. I have likewise challenged each and every member of my staff to do the same.

And now, I’m moving on to a new and exciting season in my life.

As I’ve shared so often, the mission of the Psychological Services Division is to provide support without stigma to the classified and civilian employees to insure that they retire successfully, after a long and satisfying career, on their own terms, and when they are ready.

My career has been satisfying and successful. I’m retiring on my own terms. And, I’m ready. Mission accomplished!

I could never thank each and everyone in the Department who has personally touched my life. Let it suffice to say, that whether it was Robert Cordova at the Academy garage or Chief Charles McClelland Jr. during my exit interview, I have always felt supported and respected by the employees of the Department — no matter the circumstance.

But, I can and will say a very personal “Thank you” to ALL the men and women of the Department who allowed me to touch and be touched by the very intimate and often painful details of their lives. The painful stories that you shared, rarely made the five o’clock news. We know the details! But those stories proved to me – time and again – that the men and women who raise their hands and ask for the opportunity to protect and serve, are cut from a very different cloth.

I know it wasn’t easy to get psychologically naked in our offices and let us see your unseen fears, hurts and scars. But you did and I respect you for your emotional courage to dig deep and work hard. I pray that you are more healed and whole because of the work we did together; and I know the Department and the community are better served and protected because of your dedication to taking care of the whole you.

So as I pass the baton, know that I have absolute confidence that the staff of the Psychological Services Division will continue the 35-year tradition of compassion and professionalism as they serve the psychological needs of the employees and their dependents.

I expect you, the men and women of HPD, to raise your hand, say “Help,” and receive “support without stigma” before it’s too late.

And always remember HPD, you are one of the best “stumbles” I ever made. I am forever grateful and honored that you gave me the privilege to serve with you, to be loved by you and to love you for 20 years.

By MICHAEL YBANEZTexas Narcotic Officers Association Regional Vice President and HPD Narcotics Senior Police Officer John “JG” Garza will be the first to tell you what it is like to experience many a risky encounter with the seedy lowlifes who deal in the illicit narcotics trade. And he should know.

As a 33-year veteran officer, he has served the majority of his career fighting Houston’s drug trade as a patrol officer, Tactical Team member and Narcotics investigator, where he worked all levels of investigations from street level, mid-level and HIDTA squad member, where he helped put away some of the most heinous and violent drug dealers and Mexican cartel members this city has ever encountered.

Garza will tell us that the Mexican cartels are not in the process of taking over the drug distribution networks countrywide; he will say that they have already taken over both in the Houston area and nationwide and they have tapped into the Mexican gang network to facilitate their distribution and enforcement actions. Police agencies alone, including those at the federal level, cannot stand up to these violent cartels without close cooperation and training. To facilitate this, the Texas Narcotics Officers Association (TNOA), a 45-year old non-profit professional trade organization, serves to facilitate the exchange of information among members of the association on the movements of drug violators and to provide updates on new techniques used by either criminals or investigators.

Also, TNOA recommends legislation favorable to effective drug enforcement and opposes detrimental legislation, keeps the membership advised of new drug abuse trends, current changes in the law and judicial decisions, provides the public with appropriate information on narcotic and drug abuse, promotes the professionalization of drug enforcement, and serves as a benevolent organization for its members.

With over 1,000 members statewide, TNOA stands alongside other professional organizations such as Texas Gang Investigators Association (TGIA), Texas Tactical Police Officers Association (TTPOA) and numerous other statewide and nationwide public and private organizations to provide the most current training available. While some of this training is available year-round at various locales, much of the training takes place at the annual TNOA Training Conference which is held at different cities throughout the state in the late summer or early fall months.

This year’s 2014 TNOA Annual training Conference took place August 18-21 at the wonderful seaside resort city of South Padre Island at the South Padre Island Convention Center. The conference began with a presentation of “The Bulletproof Mind-Mental Preparation for Combat” by Lt. Col. Dave Grossman (hosted by CLEAT), who is one of the world’s leading experts on the causes of violent crime. This eight hour presentation explored the dangers confronting modern policing, violent crime in America, Post-traumatic stress disorder, “The Warrior Spirit” and the Warrior and Maslow’s Hierarchy of Needs.

The conference continued through the week under the direction of then TNOA President and Houston Senior Police Officer Abraham Vanderberry, Executive Director Gilbert Gonzalez and Victor Alba.

During the conference, Vanderberry turned over the reins of President to Executive Vice President and Senior Houston Police Officer Sid Veliz. Other key facilitators included State Training Coordinator and HPD Senior Police Officer Jerry McClain, assigned to the Narcotics Division, as well as other executive board members amongst the five regions in Texas and East regional board members to include Vice President John “JG” Garza and Director Rosalinda Ybanez, also assigned to the Houston Police Narcotics Division along with Director Robert McClain assigned to Brazoria County Sheriff’s Office.

Senior Police Officer Jacques Bland was recognized as the Patrol Officer of the Month for July for his courageous handling of a mentally disturbed woman who was walking erratically in traffic on the North Loop.

This happened about 1 p.m. on May 15 when Bland observed the woman running in and out of traffic in the eastbound lanes of the Loop, realizing that she was suffering from a mental health crisis. Many vehicles traveling at high rates of speed were swerving to avoid striking the woman, while 18-wheelers slammed on their brakes to avoid hitting her.

Bland decided to get out of his patrol car and handle the dangerous situation on foot.

“Officer Bland attempted to stop traffic while simultaneously chasing after the woman,” HPOU’s Luis Menedez-Sierra said. “The woman jumped over the freeway dividers and began running in the westbound lanes of the North Loop.”

Bland rushed onto the freeway, dodging the onrushing vehicles, endangering his own life. He also noticed that the woman had a knife in her hand.

“Officer Bland moved in and tackled the woman out of the main lanes onto the inside shoulder of the freeway. In the process he was able to disarm the woman.”

With great difficulty the officer finally restrained the woman so that she was not able to run back onto the freeway until backup arrived to direct traffic. Bland got her into his patrol car.

“Bland’s heroism, fast thinking and commitment to the preservation of life prevented the woman from being struck by a vehicle traveling on the freeway,” Menedez-Sierra said in presenting the award to the North Division officer.

HPOU presented Patrol Officer Eric Tewes with the August Patrol Officer of the Month honor at the September general membership meeting.

HPOU’s Luis Menedez-Sierra described Tewes’ attention to duty under pressure after a chase involving three men suspected of trying to pass counterfeit money at a convenience store. One was armed with a handgun.

Tewes chased the vehicle containing the three individuals, using his emergency equipment, when this vehicle pulled into a residential driveway. When the officer ordered these individuals to stay in the car, the man with a gun fled the scene.

“The suspect initially struggled to open a side gate leading to the back,” Menedez-Sierra explained. “At this point, the officer observed the suspect holding a shiny object in his right hand.

“The suspect was able to open the gate and ran to the back of the residence. He refused to stop, per Tewes’ commands.”

Tewes followed him and ordered him to drop his weapon. “But the suspect turned toward the officer, pointing the gun directly at the officer,” Menedez-Sierra said. “The officer discharged his weapon two times at the suspect. The suspect immediately fell to the ground, dropping the gun.” He was dead on arrival at a hospital.

Officer David Huerta Senselessly Murdered in Violent Domestic Disturbance in the Heights

Lest We Forget

David Huerta was born in Houston on April 11, 1946. He was raised on the near North side of Houston and attended Looscan Elementary School. Graduating from Jeff Davis High School in 1964, he then attended South Texas Junior College in Houston for a year before his two-year service in the United States Army. After returning safely from his tour of duty in Vietnam, Huerta entered Houston Police Cadet Class No. 40 on January 13, 1969, graduating the following May 3. His initial assignment was to the Traffic Enforcement Division. In 1970, he transferred to the Narcotics Division, where he was assigned until May 1973, when he returned to Traffic Enforcement. Our story of murder begins that year.

Terry Brandt (White Female, 20) and Ronald Brandt (White Male, 21) had been married for several years. This marriage had produced a daughter who was two years old. Their relationship was stormy to say the least and had included physical violence as well as a number of separations. The situation continued to deteriorate and eventually Terry filed for a divorce and also requested a restraining order against Ronald.

On Wednesday morning, September 19, 1973, a hearing was held in a family district court (then called “domestic relations court”) in Houston. The divorce would not be final for another five weeks, but the judge granted the restraining order. Terry had recently moved her and her daughter to an apartment at 918 Heights to get away from Ronald. Ronald, however, would not honor the court order and continued to bother Terry, somehow managing to move into Terry’s Heights address while she was at work.

On this same Wednesday in the afternoon, Officer David Huerta was working the evening shift out of the Traffic Division. He was in the Stop-N-Go convenience store at Heights and 10th Street when Terry Brandt and several of her co-workers approached him. These friends from work said they were concerned about Terry’s safety and had gone with her to see her safely to her apartment. Earlier, she had seen Ronald’s car at the apartment

and was afraid to go inside by herself. These same friends had recently harbored Terry from Ronald at their residence, obviously placing themselves in a precarious situation in the middle of this volatile, failing marriage of Terry and Ronald.

At the Stop-N-Go, Terry and her friends expressed their fears to Officer Huerta. Being the helpful and ready-to-serve police officer that he was, the officer agreed to go with them to the apartment in an effort to resolve the situation. Ronald met the group when they knocked on the door. Huerta explained to Ronald the seriousness of the restraining order and Ronald reluctantly agreed to move out. As he began gathering his clothes, he told Officer Huerta he would put his clothes in his car and return some of Terry’s clothes he had placed there without her consent. After the clothes were returned to their proper place, Officer Huerta led Ronald, Terry and the two friends back to Terry’s apartment. Witnesses later said that Officer Huerta used the telephone to call in a report on this matter to Headquarters. (This was prior to the days of hand-held radios). While

Huerta was on the phone, Ronald went into a bedroom and suddenly returned with a shotgun. Terry saw him first and screamed, but it was too late.

Officer Huerta, phone still in his hand, was struck with a shotgun blast to the head and died instantly, never having had the opportunity to draw his duty weapon. While Ronald was turning on Terry with the gun, the two witnesses fled out the door. As they ran for their lives, one of them leaping over a balcony, the two heard another shot, which apparently struck and killed Terry.

Another shot was heard and — several minutes later – still another sounded. The fourth shot was Ronald Brandt taking his own life. Between the third and fourth shots, Ronald called Terry’s father to advise him of what he had done, saying that he was about to kill himself.

More police officers arrived just after these shots were heard. Inspector Wallace L. Williams, who lived just several blocks away, arrived on the scene, as did Radio Patrol Sergeants W.T. “Truitt” Bolin and Wayne Hankins. They tried unsuccessfully to communicate with Brandt — or anyone inside Apartment No. 7 — by using a bullhorn. Soon, Inspector Williams, commander of the HPD Patrol Bureau, decided to fire tear gas into the apartment. When there was still no response, Inspector Williams, Sergeants Hankins and Bolin, Officer Jerry Bench and Homicide Detective L.W. Henning entered the apartment. There they found Officer Huerta and the Brandt couple dead from shotgun wounds.

This was the tragic result of a terrible, continuing case of domestic violence. Officer Huerta was dead at the age of twenty-sev-en. Terry and Ronald were dead at twenty and twenty-one, respectively. One child was left without a father. Another young child was orphaned.

Continues from Page 4Band Mrs. Genaro Huerta, and a brother, Daniel Huerta, survived Officer David Huerta. A Rosary Service was held at the Crespo Funeral Home, 2516 Navigation, at 8 p.m. Thursday, September 20, 1973. Religious services were held at 2 p.m. Friday, September 21, 1973, at the St. Patrick’s Catholic Church. Interment followed at the Forest Park Lawndale Cemetery.

Pallbearers were Police Officers G. Gonzales, S. R. Benavides, A.A. Jasso, J.M. O’Brien, J.J. Davis, L. S. Ballesteros, and Sergeants W. S. Weaver and R.E. Hosford. The slain officer’s friends — Officers H.V. Hernandez, W.T. Gower and M. Perales — performed honor guard duty.

Prior to tear-gassing the apartment, the Homicide Division was alerted to the information that there was very likely an injured police officer inside. Based on the oral statements of the two friends of Terry Brandt, Homicide Lieutenant Frank Crittenden initiated a homicide scene response by assigning Detectives L.W. “Ludwig” Henning, J.M. “John” Roescher and J.W. “John” Haines to go to the scene to begin an investigation. As a result of this tragic event, there was no prosecution.

In 2002, Officer Huerta’s widow Connie had remarried and lived in Houston. Marcie Cleveland, his daughter, is married and is the mother of a son, Coby Cleveland. Mr. and Mrs. Genaro Huerta still live on the near north side where they raised their two sons. The Officer’s brother, Daniel Huerta, lived in Houston in 2002 and was a police officer with the Spring Branch Independent School District. He is the father of one daughter, Nicole.

NOTE: As of 2012, Mr. and Mrs. Genero Huerta have both passed away. It was their practice to visit their son’s Forest Park Lawndale grave regularly, Mr. Huerta making that trek several times a week. This writer and several Homicide Detectives were having breakfast at a Gulf Freeway restaurant one Sunday morning in the early 2000’s when Mr. Huerta walked in after his Sunday morning graveside visit. He joined us for a short time and it was obvious that after nearly thirty years, he still deeply grieved the loss of his oldest son.

As for the officers involved in the incident on Heights Boulevard, Inspector Williams retired from HPD and died in 1991. Sergeant

Hankins retired as a lieutenant in 1995 and died in 2000. Sergeant Bolin retired in 1981 and then worked a number of years as the building and maintenance director for 61 Riesner. He passed away in 2004. Officer Jerry Bench retired in 1984 and went to work in the private sector, having passed away in 2006.

Of the investigators, Detective Henning retired from Homicide in 1982 and, after working with several other law enforcement agencies, died in 1999. Detective Roescher, with forty-four years of service with HPD, died suddenly in 2000 while still assigned to the Homicide Division. Detective Haines retired in 1988 and lived near Lake Conroe in 2002. Lieutenant Crittenden retired in 1978 and died in 1992.

Slain HPD Officers David Huerta, George Rojas and Victor Ray Wells were all graduates of Jeff Davis High School in the mid 1960’s. Officer Matt Perales, HPD Family Assistance Officer, grew up on the north side and went to either elementary, junior high, senior high, and/or church with these fine men, as well as a number of other HPD officers. These include retired Officer Steve Benavides, Accident Sergeant Andy Jasso, Eastside Patrol Officer Luis Ballesterors, Auto Dealer Sergeant Henry Hernandez, Homicide Sergeant Eugene Yanchak, Officer I. Iranda, and K-9 Sergeant Andy Porras.

A review of the Jeff Davis yearbook of those approximate years revealed other HPD officers such as Ray Cantwell, Richard Nieto and Robert Contreras. Another Davis student of that same era, David Clement, became a Houston police officer and died in an accidental shooting in 1971. Officer Luis Ballesteros grew up across the street from David Huerta, but later went to a different high school. Ironically, their paths crossed in Vietnam and, fortunately, both survived that war. Retired Officer Steve Benavides and Sergeant Henry Hernandez grew up in the neighborhood with David Huerta. Steve said he joined HPD after he returned from Vietnam and later encouraged David to become a Houston police officer.

Many HPD officers came out of Davis High School, which even at the time David Huerta attended there in the 1960s was in a rough neighborhood. These young men were nurtured by hard-working, law-abiding parents who raised their children to grow up obeying the law and were obviously proud that they later successfully entered law enforcement to serve and protect their fellow citizens. Officer Huerta died during his dutiful effort to protect one of those citizens.

Houston was once again honored to host the 4th Annual 9/11 Heroes Run, which honors the victims of 9/11 and the wars since.

This prestigious event was held at Ellington Airport on Sept. 6 and thousands of Houstonians laced up their shoes to participate in this national 5K venue, which has become the signature event for Houston for 9/11 ceremonies.

Law enforcement officers, our men and women in our military, and our community all came out to give remembrance and honor to our fallen warriors.

“This just keeps on getting bigger and bigger as the years go by,” race director Capt. Greg Fremin said. “We had close to 2,000 registered runners this year and 3,000 total participants, which was our largest race to date.”

It was again one of the largest 9/11 Heroes Runs in the nation. Capt. Fremin extended special thanks to the City of Houston and the Houston Airport System, Chief McClelland, HPOU, Carolyn Cross with Joe Myers Ford, COX Media Group, Silver Eagle Distributors and Kroger for their unwavering support.

“And a very special thanks for our HPD Capt. Bryan Bennett and Kristy Dowdell of the Houston Airport System, and hundreds of other volunteers that made this event a great success,” Fremin said.

“It’s all about remembering the sacrifices and recognizing the true heroes of our generation.”

EasleyWinnifred Easley passed away Aug. 14. She is the mother of Wendell Easley, a Data Entry Operator assigned to Staff Services/ Fleet Unit. Services were held Aug. 23 in Wharton.

Gonzales, P.Pauline Gonzales passed away Sept. 15. She is the mother of retired Sgt. Chuck Gonzales, who retired from the Department April 30, 2011 while he was assigned to the Burglary and Theft Division. Services were held Sept. 19 with burial in Brookside Cemetery.

Gonzales, R.Retired Police Officer Rafael L. “Speedy” Gonzales passed away on Sept. 13. He served in the United States Navy. Officer Gonzales joined Police Academy Class No. 31 on Oct. 5, 1964. During his career he served at the North Division, Vice Division, and Northeast Division and retired on Jan. 26, 1985 while last assigned to the Criminal Intelligence Division. He is survived by his wife, Edilia Gonzales and daughters, Yvette Connevey and Yvonne Gonzales. Services were held Sept. 17.

GriffinCynthia D. Griffin passed away Aug. 22. She is the mother of Police Officer Kyndall B. Griffin, assigned to Westside. Services were held Aug. 29 with burial in Paradise South Cemetery in Pearland.
