A BILL To regulate assault weapons, to ensure that the right to

keep and bear arms is not unlimited, and for other purposes.

Be it enacted by the Senate and House of Representa-1

tives of the United States of America in Congress assembled, 2

SECTION 1. SHORT TITLE. 3

This Act may be cited as the ‘‘Assault Weapons Ban 4

of 2021’’. 5

SEC. 2. DEFINITIONS. 6

(a) IN GENERAL.—Section 921(a) of title 18, United 7

States Code, is amended— 8

(1) by inserting after paragraph (29) the fol-9

lowing: 10

‘‘(30) The term ‘semiautomatic pistol’ means any re-1

peating pistol that— 2

‘‘(A) utilizes a portion of the energy of a firing 3

cartridge to extract the fired cartridge case and 4

chamber the next round; and 5

‘‘(B) requires a separate pull of the trigger to 6

fire each cartridge. 7

‘‘(31) The term ‘semiautomatic shotgun’ means any 8

repeating shotgun that— 9

‘‘(36) The term ‘semiautomatic assault weapon’ 16

means any of the following, regardless of country of manu-17

facture or caliber of ammunition accepted: 18

‘‘(A) A semiautomatic rifle that— 19

‘‘(i) has a magazine that is not a fixed 20

magazine; and 21

‘‘(ii) does have any 1 of the following: 22

‘‘(I) A pistol grip. 23

‘‘(II) A forward grip. 24

‘‘(III) A folding, telescoping, or de-1

tachable stock, or is otherwise foldable or 2

adjustable in a manner that operates to re-3

duce the length, size, or any other dimen-4

sion, or otherwise enhances the 5

concealability, of the weapon. 6

‘‘(IV) A grenade launcher. 7

‘‘(V) A barrel shroud. 8

‘‘(VI) A threaded barrel. 9

‘‘(B) A semiautomatic rifle that has a fixed 10

magazine with the capacity to accept more than 10 11

rounds, except for an attached tubular device de-12

signed to accept, and capable of operating only with, 13

.22 caliber rimfire ammunition. 14

‘‘(C) Any part, combination of parts, compo-15

nent, device, attachment, or accessory that is de-16

signed or functions to accelerate the rate of fire of 17

a semiautomatic firearm but not convert the semi-18

automatic firearm into a machinegun. 19

‘‘(D) A semiautomatic pistol that— 20

‘‘(i) has a magazine that is not a fixed 21

magazine; and 22


‘‘(I) A threaded barrel. 24

‘‘(II) A second pistol grip. 25

‘‘(I) A folding, telescoping, or detach-18

‘‘(II) A pistol grip or bird’s head grip. 20

‘‘(III) A fixed magazine with the ca-21

pacity to accept more than 5 rounds. 22

‘‘(IV) The ability to accept a detach-23

able magazine. 24

‘‘(B) does not include an attached tubular de-1

vice designed to accept, and capable of operating 2

only with, .22 caliber rimfire ammunition.’’. 3

(b) RELATED DEFINITIONS.—Section 921(a) of title 4

18, United States Code, as amended by this Act, is 5

amended by adding at the end the following: 6

‘‘(38) The term ‘barrel shroud’— 7

‘‘(A) means a shroud that is attached to, or 8

partially or completely encircles, the barrel of a fire-9

arm so that the shroud protects the user of the fire-10

arm from heat generated by the barrel; and 11

‘‘(B) does not include— 12

‘‘(i) a slide that partially or completely en-13

closes the barrel; or 14

‘‘(ii) an extension of the stock along the 15

bottom of the barrel which does not encircle or 16

substantially encircle the barrel. 17

‘‘(39) The term ‘detachable magazine’ means an am-18

munition feeding device that can be removed from a fire-19

arm without disassembly of the firearm action. 20

‘‘(40) The term ‘fixed magazine’ means an ammuni-21

tion feeding device that is contained in and not removable 22

from or permanently fixed to the firearm. 23

‘‘(41) The term ‘folding, telescoping, or detachable 24

stock’ means a stock that folds, telescopes, detaches or 25

otherwise operates to reduce the length, size, or any other 1

dimension, or otherwise enhances the concealability, of a 2

firearm. 3

‘‘(42) The term ‘forward grip’ means a grip located 4

forward of the trigger that functions as a pistol grip. 5

‘‘(43) The term ‘grenade launcher’ means an attach-6

ment for use on a firearm that is designed to propel a 7

grenade or other similar destructive device. 8

‘‘(44) The term ‘permanently inoperable’ means a 9

firearm which is incapable of discharging a shot by means 10

of an explosive and incapable of being readily restored to 11

a firing condition. 12

‘‘(45) The term ‘pistol grip’ means a grip, a thumb-13

hole stock or Thordsen-type grip or stock, or any other 14

characteristic that can function as a grip. 15

‘‘(46) The term ‘threaded barrel’ means a feature or 16

characteristic that is designed in such a manner to allow 17

for the attachment of a device such as a firearm silencer 18

or a flash suppressor. 19

‘‘(47) The term ‘qualified law enforcement officer’ 20

has the meaning given the term in section 926B. 21

‘‘(48) The term ‘grandfathered semiautomatic as-22

sault weapon’ means any semiautomatic assault weapon 23

the importation, possession, sale, or transfer of which 24

SEC. 3. RESTRICTIONS ON ASSAULT WEAPONS AND LARGE 12

CAPACITY AMMUNITION FEEDING DEVICES. 13

(a) IN GENERAL.—Section 922 of title 18, United 14

States Code, is amended— 15

(1) by inserting after subsection (u) the fol-16

lowing: 17

‘‘(v)(1) It shall be unlawful for a person to import, 18

sell, manufacture, transfer, or possess, in or affecting 19

interstate or foreign commerce, a semiautomatic assault 20

weapon. 21

‘‘(2) Paragraph (1) shall not apply to the possession, 22

sale, or transfer of any semiautomatic assault weapon oth-23

erwise lawfully possessed under Federal law on the date 24

of enactment of the Assault Weapons Ban of 2021. 25

a licensee under title I of the Atomic Energy Act of 24

tired in good standing from service with a law en-8

forcement agency and is not otherwise prohibited 9

from receiving a firearm, of a semiautomatic assault 10

weapon— 11

‘‘(i) sold or transferred to the individual by 12

the agency upon such retirement; or 13

‘‘(ii) that the individual purchased, or oth-14

erwise obtained, for official use before such re-15

tirement; 16

‘‘(D) the importation, sale, manufacture, trans-17

fer, or possession of a semiautomatic assault weapon 18

by a licensed manufacturer or licensed importer for 19

the purposes of testing or experimentation author-20

ized by the Attorney General; or 21

‘‘(E) the importation, sale, manufacture, trans-22

fer, or possession of a firearm specified in Appendix 23

A to this section, as such firearm was manufactured 24

to carry a firearm, execute search warrants, and 15

make arrests; and 16

‘‘(D) recognized, commissioned, or certified by 17

a government entity as a law enforcement officer. 18

‘‘(6) The Attorney General shall establish and main-19

tain, in a timely manner, a record of the make, model, 20

and, if available, date of manufacture of any semiauto-21

matic assault weapon which the Attorney General is made 22

aware has been used in relation to a crime under Federal 23

or State law, and the nature and circumstances of the 24

crime involved, including the outcome of relevant criminal 25

investigations and proceedings. The Attorney General 1

shall annually submit a copy of the record established 2

under this paragraph to the Congress and make the record 3

‘‘(w)(1) It shall be unlawful for a person to import, 5

licensed dealer, to store or keep under the dominion or 25

control of that person any grandfathered semiautomatic 1

assault weapon that the person knows, or has reasonable 2

cause to believe, will be accessible to an individual prohib-3

ited from receiving or possessing a firearm under sub-4

section (g), (n), or (x), or any provision of State law, un-5

less the grandfathered semiautomatic assault weapon is— 6

‘‘(1) carried on the person, or within such close 7

proximity that the person can readily retrieve and 8

use the grandfathered semiautomatic assault weapon 9

as if the grandfathered semiautomatic assault weap-10

on were carried on the person; or 11

‘‘(2) locked by a secure gun storage or safety 12

device that the prohibited individual has no ability to 13

access.’’. 14

(b) IDENTIFICATION MARKINGS FOR SEMIAUTO-15

MATIC ASSAULT WEAPONS.—Section 923(i) of title 18, 16

United States Code, is amended by adding at the end the 17

following: ‘‘The serial number of any semiautomatic as-18

sault weapon manufactured after the date of enactment 19

of the Assault Weapons Ban of 2021 shall clearly show 20

the date on which the weapon was manufactured or made, 21

legibly and conspicuously engraved or cast on the weapon, 22

and such other identification as the Attorney General shall 23

by regulations prescribe.’’. 24

(c) IDENTIFICATION MARKINGS FOR LARGE CAPAC-1

ITY AMMUNITION FEEDING DEVICES.—Section 923(i) of 2

title 18, United States Code, as amended by this Act, is 3

amended by adding at the end the following: ‘‘A large ca-4

pacity ammunition feeding device manufactured after the 5

date of enactment of the Assault Weapons Ban of 2021 6

shall be identified by a serial number and the date on 7

which the device was manufactured or made, legibly and 8

conspicuously engraved or cast on the device, and such 9

other identification as the Attorney General shall by regu-10

lations prescribe.’’. 11

(d) SEIZURE AND FORFEITURE OF LARGE CAPACITY 12

AMMUNITION FEEDING DEVICES.—Subsection (d) of sec-13

tion 924 of title 18, United States Code, is amended— 14

(1) in paragraph (1)— 15

(A) by inserting ‘‘or large capacity ammu-16

nition feeding device’’ after ‘‘firearm or ammu-17

nition’’ each time it appears; 18

(B) by inserting ‘‘or large capacity ammu-19

nition feeding device’’ after ‘‘firearms or ammu-20

nition’’ each time it appears; and 21

(C) by striking ‘‘or (k)’’ and inserting 22

‘‘(k), (r), (v), or (w)’’; 23

Section 924(a)(1)(B) of title 18, United States Code, 14

is amended by striking ‘‘or (q) of section 922’’ and insert-15

ing ‘‘(q), (r), (v), (w), or (aa) of section 922’’. 16

SEC. 5. BACKGROUND CHECKS FOR TRANSFERS OF GRAND-17

FATHERED SEMIAUTOMATIC ASSAULT WEAP-18

ONS. 19

(a) IN GENERAL.—Section 922 of title 18, United 20

States Code, as amended by this Act, is amended— 21

(1) by repealing subsection (s); 22

(2) by redesignating subsection (t) as sub-23

section (s); 24

(3) in subsection (s), as redesignated— 25

(A) in paragraph (3)(C)(ii), by striking 1

‘‘(as defined in subsection (s)(8))’’; and 2

(B) by adding at the end the following: 3

‘‘(7) In this subsection, the term ‘chief law en-4

forcement officer’ means the chief of police, the 5

sheriff, or an equivalent officer or the designee of 6

any such individual.’’; and 7

(4) by inserting after subsection (s), as redesig-8

nated, the following: 9

‘‘(t)(1) Beginning on the date that is 90 days after 10

the date of enactment of the Assault Weapons Ban of 11

2021, it shall be unlawful for any person who is not li-12

censed under this chapter to transfer a grandfathered 13

semiautomatic assault weapon to any other person who is 14

not licensed under this chapter, unless a licensed importer, 15

licensed manufacturer, or licensed dealer has first taken 16

custody of the grandfathered semiautomatic assault weap-17

on for the purpose of complying with subsection (s). Upon 18

taking custody of the grandfathered semiautomatic assault 19

weapon, the licensee shall comply with all requirements of 20

this chapter as if the licensee were transferring the grand-21

fathered semiautomatic assault weapon from the licensee’s 22

inventory to the unlicensed transferee. 23

‘‘(2) Paragraph (1) shall not apply to a temporary 24

transfer of possession for the purpose of participating in 25

target shooting in a licensed target facility or established 1

range if— 2

‘‘(A) the grandfathered semiautomatic assault 3

weapon is, at all times, kept within the premises of 4

the target facility or range; and 5

‘‘(B) the transferee is not known to be prohib-6

ited from possessing or receiving a grandfathered 7

semiautomatic assault weapon. 8

‘‘(3) For purposes of this subsection, the term ‘trans-9

fer’— 10

‘‘(A) shall include a sale, gift, or loan; and 11

‘‘(B) does not include temporary custody of the 12

grandfathered semiautomatic assault weapon for 13

purposes of examination or evaluation by a prospec-14

tive transferee. 15

‘‘(4)(A) Notwithstanding any other provision of this 16

chapter, the Attorney General may implement this sub-17

section with regulations. 18

‘‘(B) Regulations promulgated under this para-19

graph— 20

‘‘(i) shall include a provision setting a max-21

imum fee that may be charged by licensees for serv-22

ices provided in accordance with paragraph (1); and 23

‘‘(ii) shall not include any provision imposing 24

recordkeeping requirements on any unlicensed trans-25

feror or requiring licensees to facilitate transfers in 1

accordance with paragraph (1).’’. 2

(b) TECHNICAL AND CONFORMING AMENDMENTS.— 3

(1) SECTION 922.—Section 922(y)(2) of title 4

18, United States Code, is amended, in the matter 5

preceding subparagraph (A), by striking ‘‘, 6

(g)(5)(B), and (s)(3)(B)(v)(II)’’ and inserting ‘‘and 7

(g)(5)(B)’’. 8

(2) SECTION 925A.—Section 925A of title 18, 9

United States Code, is amended, in the matter pre-10

ceding paragraph (1), by striking ‘‘subsection (s) or 11

(t) of section 922’’ and inserting ‘‘section 922(s)’’. 12

(c) EFFECTIVE DATE.—The amendments made by 13

this section shall take effect 90 days after the date of en-14

actment of this Act. 15

SEC. 6. USE OF BYRNE GRANTS FOR BUY-BACK PROGRAMS 16

FOR SEMIAUTOMATIC ASSAULT WEAPONS 17

AND LARGE CAPACITY AMMUNITION FEED-18

ING DEVICES. 19

Section 501(a)(1) of title I of the Omnibus Crime 20

Control and Safe Streets Act of 1968 (34 U.S.C. 21

10121(a)(1)) is amended by adding at the end the fol-22

lowing: 23

‘‘(I) Compensation for surrendered semi-24

automatic assault weapons and large capacity 25

ammunition feeding devices, as those terms are 1

defined in section 921 of title 18, United States 2

Code, under buy-back programs for semiauto-3

matic assault weapons and large capacity am-4

munition feeding devices.’’. 5

SEC. 7. SEVERABILITY. 6

If any provision of this Act, an amendment made by 7

this Act, or the application of such provision or amend-8

ment to any person or circumstance is held to be unconsti-9

tutional, the remainder of this Act, the amendments made 10

by this Act, and the application of such provision or 11

amendment to any person or circumstance shall not be af-12

fected thereby. 13
