    CANBERRA VISIT: Meeting with Assistant Minister Nola Marino. The Shire President, the Administrator and I visited Canberra for a meeting with Assistant Minister Nola Marino. We had a very long and productive meeting and would like to thank the Minister for being so generous with her time especially during parliamentary sittings. We had a lengthy discussion on the DI proposal as the Minister had a number of questions to which we were pleased to provide detailed responses. At this meeting we also discussed the Commonwealth’s plan for (and i n v e s t m e n t o n ) C o c o s . W e congratulated the Assistant Minister for her foresight and proactive approach to economic development on Christmas Island and told her we welcomed any investment in the IOTs. We noted the need on Cocos and that we, as the Shire, are willing a n d a b l e p a r t n e r s o f t h e Commonwealth in implementing initiatives on Cocos. CHRISTMAS ISLAND RESEARCH ROUNDTABLE: We were also pleased to participate in a research roundtable while we were in Canberra. The Shire President was an important contributor to the discussions. It was clear that the focus is the IOTs and that the Business Case will also present and explore research opportunities for Cocos. PELAWATAN CANBERRA: Pertemuan dengan Assistant Minister Nola Marino. Presiden Konsel, Administrator dan saya melawat Canberra untuk mengadakan pertemuan dengan Assistant Minister Nola Marino. Kami ada miting yang panjang dan produktif dan ingin mengucapkan terima kasih kepada Minister kerana begitu murah hati dengan waktunya terutama semasa persidangan parlimen. Kami mempunyai perbincangan panjang mengenai cadangan Pulu Tikus kerana Minister mempunyai beberapa soalan yang kami dapat memberikan respons yang sepenohnya. Pada mitingan ini kami juga membincangkan rancangan Commonwealth untuk (dan invesmen pada) Cocos. Kami mengucapkan tahniah kepada Assistant Minister untuk pandangan ke masa depan dan pendekatan proaktifnya terhadap pembangunan ekonomi di Christmas Island dan memberitahu dia kami terima sebarang invesmen dalam IOT. Kami mencatat keperluan mengenai Cocos dan bahawa kami, sebagai Shire, adalah rakan yang bersedia dan mampu bekerjasama dengan Commonwealth dalam melaksanakan inisiatif di Cocos.     RUNWAY PROJECT UPGRADE: The Shire President and I were pleased to meet with Greg Flanagan from the Department of Defence and Fulton Hogan’s Project Manager, Mr Jeff Byrnes in Perth on Monday. Mr Byrnes spoke highly of the skills set on Island as presented in the Cocos CV. Fulton Hogan is very keen to work with the Shire to ensure any and all opportunities to leverage community outcomes and benefits from this project are realized. To do so, we are very aware that ongoing communication is vitally important. We very pleased to note that one project Fulton Hogan’s specialist consultants will be undertaking is a review of the South End Road. They will be looking at current situation, projections, options for securing the road and costs for each option. They will include a recommendation to inform our future discussions with the Commonwealth about the road. It is also likely they will have a storm water management specialist on Cocos and are very open to the Shire engaging with that specialist to discuss storm water management on Home Island. In all it was a very productive first meeting.

    POLICY MANUAL: Amongst other things, Council adopted the Shire’s updated Policy Manual at their Ordinary Meeting on 26 February. There a many policies that have an impact on decisions relating to community life so it is useful to know the policy position of Council on these topics. In that way, residents can be well-prepared and work within policy parameters in any applications to

So to assist in making the process as easy and transparent as possible, we have put together a guide to the Development Process and put it on our website. In summary, Development Approval (also known as Planning approval) is required for most types of development and land use in the Shire of Cocos (Keeling) Islands. Development includes: The erection, construction or demolition (some) of any building or structure (above or below ground) Building alterations or additions Excavation / fill works. Most development/land use proposal require development approval from the Shire before they can proceed. To obtain a development approval you need to lodge a development application with the Shire of Cocos (Keeling) Islands. WORKS UPDATE: Work has been completed on the seawall restoration. After a false start on the 11th February we were able to complete the radius seawall on the 24th February which enabled us to have the machinery on the beach. This section runs from the concrete seawall, and is tied into the existing sand bags.

    Women really know how to hold a grudge. My wife asked me to pass her a lip balm. And by mistake, I gave her a tube of Super Glue. It’s been a month now and she’s still not speaking to me! Husband brings the child home from kindergarten and asks his wife, "He’s been crying the whole way home. Isn’t he sick or something?" "No," replies the wife, "he was just trying to tell you he isn’t our Frankie." A police officer stops a minivan full of elderly ladies being driven by an old gentleman because they’re only going 25 mph, stopping the mid-day traffic. The policeman asks the driver why is he going so slow. “Well that’s the speed limit, isn’t it! There was a sign saying 25 and everything!” the driver defends himself. The policeman sighs, “No, sir, that’s the number of the highway you’re on. It has nothing to do with the speed limit.” “Oh, so that’s what it means…” says the driver, looking shocked. The officer looks at the rest of the van and notices the grannies are looking somewhat frozen and stiff. “What’s up with the ladies?” he asks the driver. “Um…” the driver scratches his head, “you see, we just got off highway 150…”

    Construction of the new eco toilet at the West Island Yacht Club has been completed. Once the wiring of the solar system is connected in the next few days then the toilet will be operational.

    The new lights at the West Island tennis court have been installed and can be used at any time. Please remember to turn them off once you have finished It is disappointing to see the general rubbish is still being deposited at the green waste area on Home Island. Please deposit these item in the correct areas at the transfer station. Cardboard boxes can be placed in the slot at the Recycle Centre.

    Any Metal waste can be placed on the metal (inert) pile at the transfer station.

    BERITA KERJAAN: Kerjaan telah selesai pada pembetolan seawall. Selepas permulaan yang tidak jadi pada 11hb Februari, kami dapat menghabiskanya pada 24 Februari yang membolehkan mesin-mesin di pinggir laot. Bahagian ini berjalan dari seawall konkrit, dan tesambung ke dalam beg pasir yang disitu. Pembangunan jamban eco di Jung Puji telah selesai. Bila kawat untuk sistem solar disambung dalam beberapa hari akan datang jamban baru beroperasi. Lampu baru di tenis court Pulu Panjang sudah dipasang dan boleh digunakan pada bila-bila masa. Sila ingat untuk mematikannya apabila sudah selesai. Sangat mengecewakan untuk melihat sampah biasa masih dibuang di kawasan sampah pokok di Kampong. Sila buang sampah di kawansan yang betol. Sampah bok boleh diletakkan di dalam Recycle Centre. Sampah-sampah besi boleh diletakkan di atas susunan besi di transfer stesen.

    Paper Wasp management within the Shire of Cocos (Keeling) Islands The Macao Paper Wasp (Polistes olivaceus) is a large social wasp that is exotic to the Cocos (Keeling) Islands and mainland Australia. It was found on the Cocos (Keeling) Islands in 2015 and has been subject to an eradication program led by the Department of Agriculture and Water Resources, with assistance from the Western Australian Department of Primary Industries and Regional Development (DPIRD). In 2018, the National Biosecurity Management Group (NBMG), comprising representatives from all Australian governments, determined that the Macao Paper Wasp was not

    technically feasible to eradicate from the Cocos (Keeling) Islands under the National Environmental Biosecurity Response Agreement (NEBRA). Many islands in Cocos (Keeling) Islands are densely forested and challenging to access, which has made it difficult to effectively locate, treat and contain the wasp. What residents and visitors can do to manage Macao Paper Wasp? It is important that people living on or visiting the Cocos (Keeling) Islands are vigilant to the presence of Macao Paper Wasp. If you see any wasps or nests, do not approach them in case you disturb them—the wasp can be aggressive and has a painful sting. Instead, call the Shire Ranger on 9162 6649 or the local pest controller, Jack Clunies-Ross on 9162 7793. If you are moving goods off any of these islands, it is important that you make sure that there are no wasps or nests on the goods or vessels. This will help prevent the wasp from infesting other places. About the Macao Paper Wasp Macao Paper Wasps are up to 24 millimetres long, deep yellow in colour with yellow antennae and legs. They build large papery honeycomb nests in trees and on houses. Macao Paper Wasps look like native paper wasps, which also live in the Cocos (Keeling) Islands but are bigger and form larger nests than native wasps. Sometimes these nests contain several hundred wasps and can be up to 50 centimetres across. These wasps have a painful sting, and are more aggressive than native wasps, particularly when defending their nests.

    Macao Paper Wasp Fogging Program

    The Shire of Cocos (Keeling) Islands, under the guidance of the Department

    of Agriculture and Water Resources, is commencing a fogging program to try and reduce the presence of the Macao Paper Wasp around

    Home Island and West Island.

    Fogging will target, the wasps when they are least active. This is usually between the hours of 6am-8am. Fogging is one strategy being used

    by the Shire to reduce and manage the Macao Paper Wasp population on Cocos (Keeling) Islands.

    What product does the Shire use for a fogging program?

    Fogging is conducted using ULV (ultra-low volume) formulation, commonly used in mosquito control.

    Please see attached for the Health Hazard Information (MSDS) for further information on possible risks and treatments.

    The fogging machine emits a white thick smoke which could be a mild irritant to eyes. The Shire will notify residents when fogging in their

    neighbourhood is scheduled via Facebook posts and letter box drops. Residents will also know when fogger is in the vicinity from the noise of

    the machine. Residents are advised to move indoors when the fogger comes past.

    Changing a child’s name II

    These are short articles about legal issues that may interest you. They are not legal advice. You should always get individual legal advice for your situation.

    This article and the last article are about changing a child’s name. A child is someone under 18 years of age.

    This article is about where a parent applies to the Family Court for orders either because:

    • the other parent will not agree to a name change or

    • to stop (called an “injunction”) the other parent informally using another name for the child that is not on the birth certificate.

    The parents have usually separated.

    Changing child’s name is a “major long-term issue”

    Family law legislation defines certain things, such as a child’s education, their religious and cultural upbringing, their health, changing their living

    arrangements so that it makes it much more difficult for the child to spend time with one parent and changing a child’s name as “major long-term issues.”

    Where there are no Family Court orders, parents have equal shared parental responsibility for a child.

    Family Court orders can:

    • state that parents have equal shared parental responsibility

    • give sole parental responsibility to one parent or a third party

    • divide up parental responsibility, or

    • say nothing about parental responsibility, which means that each parent still has equal shared parental responsibility.

    Where there are Family Court orders that state that the parents have equal shared parental responsibility, when a decision must be made about a major long-

    term issue, the legislation provides that the parents must make the decision jointly (together).

    The parents must:

    • consult each other and

    • make a genuine effort to agree

    on major long-term issues.

    So, in these circumstances, the parents must try to make a decision jointly about changing a child’s name.

    Where they cannot agree, and one parent wants to ask the Court to either:

    • make a declaration that it is in the child’s best interest to change their name or

    • issue an injunction stopping the other parent from using a name

    they have to attempt family dispute resolution with the other parent first. Family dispute resolution is undertaken by a Family Dispute Resolution (FDR)

    practitioner. An application for these orders cannot be filed unless a certificate from an FDR practitioner is filed with the application, except in certain

    circumstances. Those circumstances are where a person is exempt due to factors such as urgency or family violence, among other things.

    Where there are no Family Court orders, and one parent wants a declaration or an injunction above, they have to go through the same family dispute

    resolution process, unless they are in one of the exempt categories.

    In deciding whether to make a declaration saying it is in the best interests of the child to change their name, the Court’s paramount principle is the best

    interests of the child.

    The legislation sets out that the primary (main) considerations for the Court in determining what are the child’s best interests are the benefit to the child of

    having a meaningful relationship with both parents, and the need to protect the child from harm due to family violence, abuse or neglect. Other considerations

    include the child’s wishes, the child’s relationship with each parent, how much each parent has participated in the upbringing of the child and the extent to

    which each parent has maintained the child financially. There are other considerations.

    The Court must take into account the views of the child, and it will most often do so by way of a “wishes report”. The importance that the Court will give to the

    child’s wishes depends on the child’s emotional and intellectual maturity and the Court will consider any reasons why a child might be expressing a particular

    view. The older a child becomes, the more weight the Court is likely to give to the child’s wishes.

    Some of the factors that are specific to applications about changing a child’s name are:

    • The short and long-term advantages.

    • Any confusion of identity the child might have.

    • Embarrassment for the child.

    • How much the child identifies with each parent.

    • The effect on the parent whose name the child had originally.

    • How much contact the other parent has with the child.

    If a declaration is made that it is in the best interests of the child that their name be changed

    If the Court makes this declaration, then an application can successfully be made to the Registrar of Births, Deaths and Marriages to change the child’s name

    without the other parent’s consent. The Court order, a completed application form and the fee will be required.

    Where the Court issues an order (called an injunction) preventing one parent from using another name for the child

    If the Court does this, the parent who sought the injunction should take a copy of it to all organisations or agencies, such as the school, where the wrong

    name is being used for the child and ask that those places correct their records.

    Ini adalah berita ringkas mengenai isu undang-undang yang mungkin menarik minat anda. Ini bukan nasihat undang-undang. Anda harus selalu

    mendapatkan nasihat undang-undang sendiri mengikut keadaan anda.

    Surat berita ini dan surat berita sebelomnya adalah tentang menukar nama anak. Anak-anak adalah seseorang yang berumur di bawa 18 tahun.

    Artikel ini adalah mengenai di mana seorang ibu bapak memohon kepada Mahkamah Keluarga untuk pesanan sama ada kerana:

    • ibu bapak yang tidak akan bersetuju dengan pertukaran nama atau

    • untuk berhentikan (dipanggil "injunction") orangtua yang lain secara tidak rasmi untuk anaknya menggunakan nama lain yang tidak ada pada cerificate

    kelahiran.

    Ibu bapak biasanya sudah berpisah.

    Menukar nama anak adalah "isu masa panjang"

    Undang-undang keluarga menetapkan hal-hal tertentu, seperti pendidikan anak, pendidikan agama dan kebudayaan mereka, kesihatan mereka, mengubah pengaturan hidup mereka sehingga menjadikannya lebih susah bagi anak-anak untuk menghabiskan waktu dengan salah satu orangtuanya dan mengubah

    nama anak sebagai " isu masa panjang. "

    Jika tidak ada perintah Mahkamah Keluarga, ibu bapak mempunyai tanggungjawab yang sama untuk anaknya.

    Pesanan Mahkamah Keluarga boleh:

    • nyatakan bahawa ibu bapak mempunyai tanggungjawab yang sama

    • tanggungjawab kepada salah satu ibu bapak atau pihak ketiga

    • membagikan tanggungjawab ibu bapak, atau

    • tidak mengatakan apa-apa mengenai tanggungjawab ibu bapak, yang bermaksud bahawa setiap ibu bapak masih mempunyai tanggungjawab yang

    sama.

    Di mana terdapat perintah Mahkamah Keluarga menyatakan bahawa ibu bapak mempunyai tanggungjawab yang sama, apabila keputusan mesti dibuat

    mengenai isu masa panjang, undang-undang tersebut menyatakan bahawa ibu bapak harus membuat keputusan bersama (bersama).

    Ibu bapak mesti:

    • berunding antara satu sama lain dan

    • buat usaha untuk bersetuju

    mengenai isu masa panjang.

    Oleh itu, dalam keadaan ini, ibu bapak mesti cuba membuat keputusan secara bersama tentang menukar nama anaknya.

    Di mana mereka tidak boleh bersetuju, dan salah satu ibu bapak ingin meminta Mahkamah untuk:

    • membuat penyataan bahawa ia adalah kepentingan anak-anak untuk menukar nama mereka atau

    • mengeluarkan perintah untuk menghentikan orangtua yang lain daripada menggunakan nama

    mereka perlu membuat jalan penyelesaian petengkaran rumah tangga dengan orangtua yang lain terlebih dahulu. Jalan penyesaian petengkaran rumah tangga dilakukan oleh pengamal Family Dispute Resolution (FDR). Permohonan untuk pesanan ini tidak boleh di filekan kecuali certificate dari FDR di filekan dengan permohonan itu, kecuali dalam keadaan tertentu. Keadaan ini adalah di mana seseorang dikecualikan kerana faktor-faktor seperti keadaan yang

    mendesak atau keganasan keluarga, antara yang lain2.

    Di mana tiada perintah Mahkamah Keluarga, dan seorang ibu bapak mahukan penyataan atau perintah yang di atas, mereka perlu melalui proses

    penyelesaian petengkaran rumah tangga yang sama, kecuali jika mereka berada dalam salah satu kategori yang di kecualikan.

    Dalam memutuskan sama ada untuk membuat penyataan mengatakan bahawa demi kepentingan anak itu untuk menukar nama mereka, prinsip utama

    Mahkamah adalah kepentingan terbaik untuk anak itu.

    Undang-undang menetapkan bahawa pertimbangan utama untuk Mahkamah dalam menentukan apakah kepentingan terbaik anak itu adalah manfaat kepada anak yang mempunyai hubungan yang bermakna dengan kedua orangtuanya, dan keperluan untuk melindungi anak-anak dari bahaya akibat kekerasan keluarga, siksaan atau pengabaian. Pertimbangan lain termasuk keinginan anak-anak, hubungan anak-anak dengan setiap orangtuanya, berapa banyak orangtuanya masing-masing telah mengambil bahagian dalam membesarkan anak itu dan sejauh mana setiap orangtua telah mengekalkan anak itu

    secara kewangan. Ada jugak pertimbangan lain.

    Mahkamah mesti mengambil pandangan anak itu, dan ia selalunya akan melakukannya dengan cara "laporan permintaan". Kepentingan yang Mahkamah akan memberi untuk keinginan anak itu bergantung kepada kematangan emosi dan kecerdekan anak itu dan Mahkamah akan mempertimbangkan apa-apa sebab mengapa seorang anak mungkin menyatakan pandangan tertentu. Lebih tua seorang anak menjadi, semakin berat Mahkamah berkemungkinan

    memberi keinginan anak itu.

    Beberapa faktor yang tertentu untuk permintaan tentang menukar nama anak ialah:

    • Keuntungan masa pendek dan masa panjang.

    • Sebarang kekeliruan identiti anak-anak mungkin ada.

    • Malu untuk anak-anak.

    • Berapa banyak anak-anak mengenal pasti dengan setiap orangtuanya.

    • Kesan pada orangtua yang namanya ada pada anak itu.

    • Berapa banyak hubungan orangtua yang lain dengan anak itu.

    Sekiranya laporan dibuat bahawa ia adalah demi kepentingan anak-anak supaya nama mereka ditukar

    Sekiranya Mahkamah membuat laporan ini, maka suatu permohonan boleh dibuat kepada Registrar of Births, Deaths and Marriages untuk mengubah nama

    anak itu tanpa persetujuan orang tua yang lain. Perintah Mahkamah, form permohonan yang lengkap dan bayaran diperlukan.

    Jika Mahkamah mengeluarkan perintah (dipanggil injunction) menghalang seseorang orang tua daripada menggunakan nama lain untuk anak itu

    Sekiranya Mahkamah melakukan ini, orangtua yang meminta perintah itu perlu mengambil salinannya kepada semua organisasi atau agensi, seperti sekolah,

    di mana nama yang salah sedang digunakan untuk anak itu dan meminta supaya tempat tersebut membetulkan rekod mereka.

    CI blue tail skink recovery project

    Community Update Pulu Keeling National Park

    A count from reptile experts last week has revealed close to 100 blue tail skinks (+14

    baby skinks), well spread across Pulu Blan. After 6 months post release, this is a very

    pleasing outcome and is well within the levels of acceptance for a conservation

    introduction.

    We hope to release another 300 skinks on Pulu Blan Madar in the coming weeks. Thanks to Nek Fasha (pictured above) and

    the Cocos Shire Council for supporting this second stage of the project.

    Along with captive breeding populations at both Christmas Island and Taronga Zoo in Sydney, these populations on the Cocos

    Islands are helping to save this colourful species from extinction.

    If visiting Pulu Blan or Blan Madar, please remember to check your boat for unwanted pests like rats, centipedes and paper

    wasps. It is critical for the survival of the skinks that the islands remain pest free.

    PKNP seabird survey

    A brave team of researchers have just completed the second round of seabird surveys at PKNP, after the initial 9 day survey in

    December 2019. With the help of Monash University, it was the first time we used drone technology to count seabirds and we are

    confident that this will give us reliable population estimates for the main seabird species. On the 2 field trips, we also set up

    monitoring cameras on the invasive yellow crazy ant to better understand their impacts on PKNP and potential control options; we

    continue to monitor nesting green sea turtles and with Australian National University and volunteers Rik Soderlund and Megan

    Weir, we also conducted a coral health and fish survey in the marine waters of the Park.

    Pulu Keeling National Park supports many seabirds no longer found on the southern atoll. It is recognised internationally as a

    significant seabird rookery. All seabirds are protected under the EPBC Act.
