MAJU PULU KITA MASTERPLAN UPDATE: We reported last fortnight on the great new decking under the Home Island Cyclone Shelter and this fortnight we are pleased to announce that the works on this important community hub will continue to be a focus for our efforts as outlined in the Masterplan. The outdoor cinema will be one step further with materials for the shelter over the steps of the Cyclone Shelter arriving on the next ship. We have also heard from the community their concerns about the balustrading and have materials coming to ensure the balustrading is safer and more child-
friendly.
BERITA MAJU PULU KITA MASTERPLAN : Kami melaporkan berita hebat dua minggu yang lalu tentang deking di bawah Rumah Masyarakat Home Island dan dua minggu ini kami dengan sukacitanya mengumumkan bahwa kerja-kerjaan yang penting untuk masyarakat ini akan terus menjadi usaha kami seperti yang dijelaskan di Masterplen. Tempat untuk menonton wayang di luar akan menjadi satu langkah lebih jauh dengan bahan-bahan untuk perlindungan di atas tangah Rumah Masyarakat akan tiba di kapal laut yang akan sampai. Kami juga telah mendengar dari masyarakat tentang kebimbangan pelangkapan dan bahan-bahan yang dating untuk memastikan pelangkapan lebih selamat dan mesra terutama
untuk anak-anak.

BUDGET 2019/2020: Continuing our series on items of interest from our budget, this week we turn our focus to asset renewal. This may not sound as exciting as new buildings and structures but we know how essential it is to maintain the assets we have so that they continue to be of benefit to the community. A couple of the asset renewal projects we are doing this year are the re-sheeting of the Home Island Community Resource Centre building and the two residential bungalows as the existing sheeting is very corroded. We have, with partial funding support from the Department of Infrastructure, Transport, Cities and Regional Development, also re-stumped Government House as the stumps were at risk of failure. So while these projects are not visible to the community, it is important we do give them our attention as responsible asset
managers.

WORKS UPDATE: Work on the raised deck at Trannies Beach has commenced. The first stage was to prepare the ground area to ensure good support for the deck. We are using ground screws to minimise the area required for foundations. The ground screws will support the structure that will be raised 600mm and cover an area of
80 square metres.
The solar lighting is now being installed on Direction Island. Each shelter will have its own lighting system with a remote on/off switch
within easy reach.
The water bubblers have now been installed; two on Home Island and two on West Island. These have been positioned to enable access by people in wheelchairs. We acknowledge the
Commonwealth Government for funding this initiative.
The new igniter switch for the BBQ at the Yacht club will be installed as soon as it arrives. Once it has been fitted we will notify the
community via Facebook.
Keep your eyes out for the sea of colour as the shade sails for the West Island Playground will arrive this week. They will be installed
as soon as possible.
BERITA KERJAAN: Pekerja untuk membuat deking di Trannies Beach telah bermula. Peringkatan pertama adalah untuk menyediakan kawasan tanah yang akan menyokong dek. Skru tanah akan di siapkan dan memberikan struktur sokongan supaya tanah boleh di naikan 600mm dan menutup kawasan sebanyak 80 square
metre.
Lambu solar sedang di pasang di Pulu Tikus. Setiap tempat pelindungan akan mempunyai system lampu sendiri dengan suit
menyalah/bunuh dengan senang.
Tempat minuman air telah di pasang di Pulu Panjang dan Home Island. Ini telah diletak senang untuk kursi sorong karena tempat
minuman ini dibuat senang untuk mereka.

WASTE MANAGEMENT: The removal of historic asbestos contain-ing material (ACM) from Cocos is an issue we have put some effort into resolving. Recent changes to the legislation will now allow us to apply for permits to transfer ACM to the mainland for appropriate disposal. The transport of ACM will incur significant costs so we are working with the Department of Infrastructure, Transport, Cities and Regional Development to find funds to supplement Shire funding to
solve this legacy waste issue.
And a gentle reminder: Residents are kindly asked to place their bins one metre from the edge of the road with the handles facing the road on collection days. This will assist the waste management crew and
improve road safety.
URUSAN SAMPA: Penyingkiran asbestos lama yang mengandung bahan (ACM) dari Cocos adalah satu isu yang kita telah berusaha untuk selesaikan. Perubahan terbaru pada undang-undang sekarang akan memperbolehkan kami untuk memohon permit untuk memin-dahkan ACM ke tanah besar untuk perbuangan yang sesuai. RECREATION PROGRAMS: I have been delighted to receive such positive feedback from the community for the great activities organised by our fabulous Community Development Team (Adim and Isa). The after school programs have generated a great deal of par-ticipation to join in a variety of activities. A few of the activities that have been on offer have included reef walking and snorkelling at Pulu Maria, open sailing day at the Home Island Sailing Club and just recently the surfing for beginners at The Spot. A camping outing at Scout Park is planned for later this week with 40 students registered
for this activity.
October will be just as busy with a busy school holiday program, kids
and adult boot camp and Sepak Takraw.
These program ideas have been come from the CIDHS students and volunteer coordinators with the Shire team behind the scenes making it happen. A special thanks to the organisations such as the Cocos Islands District High School and Parks Australia and all our wonder-ful volunteers that have assisted in making these activities fun and
safe. We couldn’t do it without your support.
PROGRAMS KEMAINAN: Saya dengan senang hati menerima pendapatan yang baik dari masyarakat untuk kegiatan hebat yang di uruskan oleh team Community Development (Adimi dan Isa). Pro-gram-program yang di jalankan selepas hari sekolaan telah menghasilkan banyak orang berpatisipati dalam berberapa aktiviti. Berberapa aktiviti yang kami tawarkan termasuk jumberang dan selulup di Pulu Maria, hari belayaran di Klub Sailing Home Island dan baru saja surfing untuk orang permulaan di Spot. Rangangan penginapan telah di rancangkan untuk minggu ini dengan 40 murid mendaftar untuk aktiviti ini. Bulan Oktober akan sama sibuk dengan program school holiday, anak-anak dan dewasa boot kam dan Sepak
Takraw.
Idea program-program ini datang dari murid sekola CIDHS dan koordinator volunteer dengan team Shire di belakang untuk membu-at semua ini berlaku. Terima kasi kepada orginasi seperti CIDHS dan Parks Australia dan juga semua volunteer yang hebat yang memban-tu dalam pengurusan aktiviti yang seronok dan selamat. Kami tidak
dapat melakukannya tanpa sokongan anda.
BUSTS AT OCEANIA HOUSE: Last fortnight I wrote about the repair works budgeted for the Home Island Museum. Continuing that theme, I am pleased to advise that we are working with Lloyd and Avril to bring the Clunies-Ross busts back to the Museum to ensure they are accessible for the community to view. The agreement Council had with Lloyd regarding the busts included a proviso that the busts would be returned to the Museum if Lloyd was not on-island for any length of time. Sadly, Lloyd has advised that he will be off-island for an indefinite period, and it is his preference that the busts are returned to the Shire for safe-keeping and accessibility. Thank you
Lloyd and Avril, for taking good care of the busts for these many
years and opening your home so graciously so the community and visitors could enjoy these invaluable Cocos heritage assets. We send
you our very best wishes while you are off-island.
KEPALA GRAMPA DI RUMAH BESAR: Dua minggu yang lalu saya menerangkan tenant kerja-kerja untuk memperbaiki Musium di Home Island. WORKS CREW TEAM BULDING ACTIVITES ON DIRECTION IS-
LAND: Later this week our wonderful outdoor works team will be
spending the day on Direction Island to give this beautiful place a little bit of TLC. They will be building another two fire pits, doing lots of grounds maintenance to the paths such as whipper snipping and mowing. They will also do some minor repairs to main shelter. This hard work will be followed by some team building activities and a BBQ lunch. We look forward to reporting the results to you in the
next Atoll.
TEAM BUILING AKTIVITI DI PULU TIKUS KEPADA PEKERJAAN LUAR: Dalam minggu yang akan datang team pekerja luar yang luar biasa akan berada di Pulu Tikus untuk memberikan tempat yang indah itu sekit TLC. Mereka kan membangunkan dua lubang api, dan juga banyak pekerja pemiliharaan terutama kepada tempat pejalanan seperti potong rumput. Ada juga tugas untuk memperbaiki lindugan. Kerja keras ini akan diikuti oleh berberapa aktiviti team building dan BBQ semasa lunch. Kami sangat senang untuk melaporkan hasil
semua ini dalam Atoll minggu depan.
These are a few items that I think may be of particular interest but we
are always willing to meet with members of the community who are
interested in knowing more about Shire activities.

The Indian Ocean Territories Administration (IOTA) is currently seeking motivated, professional and suitably qualified persons to join our team as Health Workers within the Indian Ocean Territories Health Service (IOTHS) based on the Cocos (Keeling) Islands.
The key responsibility of the Health Worker is to deliver quality health care in consultation with Health Service staff and as part of a multi-disciplinary team using a primary health care approach.
Our ideal applicant will have a demonstrated ability to provide quality care for persons with support needs, work unsupervised and as part of a team, work within a code of conduct including ensuring confidentiality and have well developed communication and interper-sonal skills.
Applicants who hold a Certificate in disability studies or other relevant qualification, a First Aid Certificate (or willingness to obtain one) and have language skills in the community language of Cocos Malay are desirable.
To be considered, applicants must be eligible to work in Australia, hold a valid Western Australia Working with Children Check and hold a ‘C’ class manual, or higher, driver’s licence transferable to the Indian Ocean Territories.

Re-using & Recycling Egg Cartons
Egg cartons don’t have to be waste – there are other ways to use both the paper and plastic forms. Here are a few ideas. * Inquire with your local primary/pre-schools if they need cartons fo r c ra f t p ro jec ts . A r t departments also use the cartons for papier Mache projects as paper based cartons are basically just papier Mache themselves. Use for craft projects at home for your own children * Use the cartons as seedling starters. * Plastic egg cartons can also be used in this application. * Handy for organising small items such as nuts, bolts and screws. * Use as packing materials when shipping goods. * As a way of storing delicate Xmas tree bauble decorations. * An avid golfer can use egg cartons for storing golf balls! * Plastic egg cartons can be used as trays for making ice cubes. * Transporting hard boiled eggs to picnics. * If you have neighbours or a local farm with egg-laying chickens; they might greatly appreciate your egg cartons – and perhaps may even give you some free eggs in exchange. * Instead of going into your general rubbish bin, paper based egg cartons should be put into your recycling bin; but given the nature of their construction, they also break down very quickly in compost piles – so you can use them to help benefit your garden. Making further use of egg cartons is just one aspect of making our egg consumption a little more environmentally friendly.
Green Living Tips
Dear Cocos community, This week a handful of small devices (loggers) were deployed on two beaches on Home Island and South Island. The loggers are tiny (the size of a 10-cent coin) and attached to wooden posts, which are buried in the beach sediment (sand) at a depth of 30 cm. In the photo below you can see an orange piece of tape (inside the yellow star) which marks the top of one of the wooden posts. I ask the community to please leave these posts in place (do not remove them). It’s also important that any plastic or other debris items in the surrounding area remain in place and NOT be removed (ie., please temporarily postpone any clean-up events). Your assistance is greatly appreciated! This exciting re-search aims to understand whether accumulated debris alters the temperature or humid-ity of the sand. This is important for green sea turtles which lay their eggs in the sand – whether the turtle hatchlings are male or female depends on sand temperature. I will remove the wooden posts and collect the loggers when I return to Cocos in October, and ensure the results are shared with the community once I’ve had time to analyse the data. Thank you. The criminal offences of damaging property
These are short articles about legal issues that may interest you. They are not legal advice. You
should always get individual legal advice for your situation.
There are 2 separate criminal offences of damaging property. They are often called:
• Damaging property
• Criminal damage
The offence of unlawfully damaging or destroying property (commonly called “damaging property” above) is a less serious offence than wilfully and unlawfully damaging or destroying property
(usually called “criminal damage”).
Property includes animals and vegetation.
Damaging property – the less serious offence
Damage property is a simple offence only, which means it can only be dealt with by the Magistrates
Court.
The maximum penalty is 2 years imprisonment and/or a fine of $24,000.
Criminal damage – the more serious offence
This is a more serious offence because one element of the offence that must be proven is that the damage was wilful (deliberately done). Criminal damage can be dealt with by either the Magistrates
or District Court (commonly called an “either way” offence).

If the amount of damage caused is worth $25,000 or less, and the property is not damaged or de-stroyed by fire, the charge can be dealt with in the Magistrates Court. The maximum penalty is 3
years imprisonment and/or a fine of $36,000.
Where criminal damage must be dealt with by the District or Supreme Court
The offence of criminal damage must be dealt with by the District Court (“on indictment”) in these
circumstances:
• If the damage is by fire and occurred on or after 1 January 2019 (if it occurred prior to this
date, it must be dealt with by the Supreme Court).
• If the amount of the damage caused is more than $25,000.
• If the criminal damage is by fire, the maximum penalty is life imprisonment.
• If the amount of the damage is over $25,000, the maximum penalty is 10 years imprisonment,
or 14 years if committed in circumstances of racial aggravation.
Racial aggravation is where either:
• Immediately before, during or after the offence the offender shows hostility based on the vic-
tim being a member of a racial group or
• The offence is motivated by hostility towards people of a racial group.
Where you might get charged with the more serious offence of criminal damage instead of damaging property
You might be charged with criminal damage and not the less serious charge of damage property
where there is evidence that you intended to cause the damage.
An example might be where as part of the same incident you trespass onto your ex-partner’s proper-ty and assault them, and tell them you are going to smash up their car and then go and smash up their car as you are leaving. It may be easier in a situation like this to show that you intended to wil-
fully cause the damage, because of your other actions and what you said at the same time.
Damaging aircraft, mines, vessels and railways
There are also other serious offences that include damaging, obstructing the working of, or interfer-ing with, particular types of property such as aircraft, mines, vessels and railways. These generally
attract very serious penalties and have to be dealt with by the District Court.
Graffiti damage
There is special graffiti damage legislation that commenced on 12 October 2016. Graffiti is damaging or making a mark on property. Graffiti can include marking, writing on, spraying, etching, scratching
or drawing on something, with a pen or spray can.
It is an offence to damage, destroy or deface any property by graffiti without the owner’s consent. This is a simple offence only with a maximum penalty of 2 years imprisonment and a fine of $24,000.
It can only be dealt with by the Magistrates Court.
The Court can also make an order that the offender take action to remove the graffiti, or pay some-one else to do so, even if it is not visible to the public. This is not part of the sentence, but a separate
order.
Note that vegetation is included in the definition of property.
It is also an offence to possess an item with intent to apply graffiti. You can be presumed to have the intent if you are in possession of the item in circumstances that give rise to a reasonable suspicion
that you intend to apply graffiti.

An example might be where you are found with a friend trespassing on railway property at 2 am in the morning and both of you have a spray can of paint and are next to a wall where there some spray paint grafitti has just been sprayed. You have not been seen spraying the wall but you might be charged with being in possession of an item in circumstances that give rise to a reasona-
ble suspicion that you intend to apply grafitti.

Merusakan harta— Kesalahan yang kurang serious.
Merusakan harta adalah kesalahan yang sederhana saja, ini bermakna ia hanya bole diuruskan di Mahkamah Magistret.
Hukuman maksimum adalah 2 tahun di penjarah dan/atau di bayar dendah sebanyak $24,000.
Kerusakan Kriminal – jenayah yang lebih serius
Ini adalah kesalahan yang lebih serius disebabkan satu elemen kesalahan yang mesti dibuktikan adalah bahwah kerusakan itu disengaja (sengaja dilakukan). Kerusakan kriminalbole diuruskan di Mahkamah Magistret atau District (biasanya disebut kesala-
han “either way”).
Jika nilai harta yang dirusakan lebih dari $25,000 atau kurang, dan harta tidak dirusakan atau dimusnahkan dari kebakaran, kesalahan ini boleh di uruskan di Mahkamah Magistret. Hukuman maksimum adalah 3 tahun dipenjarah dan/atau dibayar dendah

• Jika nilai yang dirusakan lebih $25,000, hukuman maksimum adalah 10 tahun dipenjara, atau 14 tahun jika dilakukan da-
lam keadaan gangguan kebangsaan.
Gangguan kebangsaan adalah dimana:
• Seterusnya sebelum, semasa atau selepas kesalahan pesalah menunjukan permusuhan berdasarkan oleh mangsa be-
rada dalam kumpulan kebangsaan lain
• Kesalahan itu didoroang oleh permusuhan terhadap orang dari kumpulan kebangsaan.

tanda pada harta. Grafiti termasuk menandakan, menulis, menyebar, atau melukis pada sesuatu, dengan pen atau sprey.
Ia adalah satu kesalahan untuk merusakan, merusakkan atau mengotorkan harta hak orang dengan graffiti tanpa persetujuan dari pemiliknya. Ini adalah kesalahan yang sederhana saja dengan hukuman maksimum 2 tahun penjara dan didendah sebanyak

Are your association rules up to date?
All incorporated associations and clubs must have a set of rules (commonly called the constitution) which explains how the organisation oper-
ates and manages its affairs. When the Associations Incorporation Act 2015 (WA) commenced in 2016 all incorporated associations and
clubs were given three years to review and update their rules to meet the requirements of the Act. The transition period to change the rules
ended on 30 June 2019. If the rules have not been updated it is important to understand how this will affect your association or club.
The rules of every incorporated association and club in CKI are required to include all of the 19 matters listed in Schedule 1 of the Act. If any
of these Schedule 1 requirements are missing from an association or club’s rules the relevant clause(s) from the prescribed model rules will
be deemed to apply.
To avoid the uncertainty this may case, if it has not done so already, Consumer Protection encourages associations and clubs to review and
update the rules as soon as possible. There are checklists, publications and videos available on Consumer Protection’s website to assist
associations and clubs complete this process, including the Rules Workbook which provides a step by step guide to review and update the
