Scott McCrea, resident of the borough and Director of Tourism for Explore Fairbanks, detailed how Explore Fairbanks is adapting due to the current COVID-19 related tourism reductions, noted statistics gathered since January 2020 and reported on cancelled events.

MESSAGES FROM THE BOROUGH MAYOR Track 1, 39:40 Mayor Ward commented on:
• Fairbanks North Star Borough (FNSB) employee COVID-19 cases are being monitored and office closures are noted on fnsb.us.
• The Central Recycling Facility will remain closed for at least another two weeks due to a contractor’s employee testing positive for COVID -19.
• A proclamation in support of wearing masks for public health was signed by City of Fairbanks Mayor Matherly, City of North Pole Mayor Welch and FNSB Mayor Ward.
• Policies are being regularly updated to adhere to Center for Disease Control and Prevention (CDC) guidelines, regulations and standards.
• The Cares Act funding third-party contractor Request for Proposal (RFP) closed on Monday. The notice of intent to award should be issued tomorrow, with the goal of having a contractor in place early August to begin accepting applications mid-August. Go to fnsb.us/cares for more information on available grants.
• Pioneer Park staff are replacing railroad tracks around the park and completing other maintenance projects this summer.
REPORTS OF STANDING AND SPECIAL COMMITTEES Track 1, 37:15 Assemblymember O’Neall reported the July 28 Economic Development Commission meeting has been cancelled. Assemblymember Sanford reported the Regional Emergency Services Advisory Committee (RESAC) is exploring several different emergency services models available to the borough. Ms. Sanford reported the next meeting will be in August.

REPORTS FROM REPRESENTATIVES Track 2, 00:49 a. Report from the City of Fairbanks Representative. City Of Fairbanks Mayor Matherly, reported on:
• The City of Fairbanks continues to allow some employees to work remotely, due to social distancing practices.
• Fairbanks City Hall is open by appointment only. • Cares Act money grant distributions have begun. • An aggressive masking campaign is underway in the City. Mayor Matherly
reported on the three Mayor proclamation strongly urging the wearing of masks to help limit the spread of the COVID-19 virus.
• A city gas excise tax is up for public hearing on Monday. City revenues are down due to the COVID-19 pandemic, mostly due to losses in bed tax dollars.
• Use of the Fairbanks City Hall for in-person absentee voting for local municipal elections is being discussed.
• School start times are a matter of local concern and are being discussed. • Spoke against FNSB Ordinance No. 2020-24, specifically he believes both
union and non-union businesses should qualify to benefit from publicly funded construction projects.

Council Member Aino Welch reported on:
• North Pole City Hall is open by appointment only, please wear a mask when inside the building.
• Several residential building permits are in the process of being issued. • The Interior Gas Utility (IGU) tank has been moved from Fairbanks to its
North Pole site. • The North Pole City water expansion project is progressing, and numerous
hook-ups have been made. • The Moose Creek water expansion project is underway and has received a
lot of public input. The high ground water in Moose Creek is finally dropping, which will enable the water expansion project to continue.
• Mayor Welch will sign a memorandum of understanding (MOU) with the FNSB regarding distribution of Cares Act funding.
• The North Pole Police Department is seeking a new police officer.

The Presiding Officer called for public testimony.
Lance Roberts, resident of the borough, spoke against Ordinance No. 2020-24. Mr. Roberts believes competition is important in the bidding process to keep costs in check. Charles Wiegers, resident of the borough, spoke against Ordinance No. 2020-24. Mr. Wiegers believes that utilizing apprentices will not save the borough money, as they are inexperienced workers and require more supervision. Jeff Alling, resident of the borough, spoke against Ordinance No. 2020-24. Mr. Alling believes competition is the best way to lower costs and believes this ordinance will hinder that competition. Michael Samson, resident of the borough, spoke against Ordinance No. 2020-24. Mr. Samson doesn’t believe this ordinance will help lower costs. Joshua Palmer, resident of the borough, spoke against Ordinance No. 2020-24. Mr. Palmer believes the ordinance will limit competition and drive costs higher. Shane Malone, resident of the borough, spoke against Ordinance No. 2020-24. Mr. Malone doesn’t believe the ordinance will increase the labor pool or lower costs to the borough. Ben Callahan, resident of the borough, spoke against Ordinance No. 2020-24. Mr. Callahan operates a small general contracting business in Fairbanks and stated he has not had a problem finding workers to train. Julie Duquette, resident of the borough, spoke against Ordinance No. 2020-24. Ms. Duquette reported that most construction training in Alaska is done in-house and suggested support to technical schools would serve the purpose of getting more young people into the construction industry.

PUBLIC HEARING - continued Sarah Lefebvre, resident of the borough, spoke against Ordinance No. 2020-24. Ms. Lefebvre doesn’t believe this ordinance will solve workforce development issues. Ms. Lefebvre suggested promoting trade curriculums to engage students in the construction industry. Adam Ferguson, resident of Palmer, AK, spoke in support of Ordinance No. 2020-24. Mr. Ferguson sees the ordinance as a workforce pipeline while providing opportunity in the trades for young people. Matt Brockman, resident of the borough, spoke against Ordinance No. 2020-24. Mr. Brockman reported there are agencies regulating trades already; this ordinance is not needed. Joseph Kurber, resident of the borough, spoke against Ordinance No. 2020-24. Mr. Kurber is a contractor and stated this ordinance would hurt his business. Arthur Sutton, resident of the borough, spoke in support of Ordinance No. 2020-24. Mr. Sutton reported apprenticeship programs are a great way for young people to get into the construction industry and can help lower construction costs. John Brown, resident of the borough, spoke in support of Ordinance No. 2020-24. Mr. Brown reported on the amount of money spent on infrastructure and suggested apprenticeships can help lower costs and help retain long-term construction workers. Elizabeth Slane, resident of the borough, spoke against Ordinance No. 2020-24. Ms. Slane opposes the ordinance as it may affect her husband’s ability to work. Ms. Slane reported limiting jobs to union contractors is discrimination and she believes freedom and opportunity are the basis for our society. Jeremy Silva, resident of the borough, spoke against Ordinance No. 2020-24. Mr. Silva learned everything he knows about roofing in the field. Mr. Silva stated this ordinance could affect his ability to work. Joe Thomas, resident of the borough, spoke in support of Ordinance No. 2020-24. Mr. Thomas believes increasing apprenticeship opportunities is an essential first step in the effort to increase the local workforce, currently 20% of the workforce is non-resident. Glenn Prax, resident of the borough, spoke against Ordinance No. 2020-24. Mr. Prax does not think this ordinance will save the borough any money and does not believe the borough should be imposing restrictions on the contracting industry.

PUBLIC HEARING - continued Douglas Tansy, resident of the borough and President of the Interior Labor Council, spoke in support of Ordinance No. 2020-24. Mr. Tansy reported on his own apprenticeship and the skills he has developed since. Mr. Tansy believes the borough would see a cost savings if the ordinance is adopted. Luke Hopkins, resident of the borough, spoke in general support of Ordinance No. 2020-24. Mr. Hopkins believes the ordinance should be passed with a few amendments resolving bid submittals and scoring. Mr. Hopkins reported he believes this ordinance will save the borough money and benefit the community. Crystal Tidwell, resident of the borough, spoke in support of Ordinance No. 2020-24 and thanked the sponsors for bringing the ordinance forward. Ms. Tidwell believes the proposed apprenticeship program is a sound plan to help educate and employ young people on local building projects. Matthew Sampson, resident of the borough spoke in support of Ordinance No. 2020-24. Mr. Sampson believes the training requirements outlined in the ordinance are a good standard for crafts and trades. Mr. Sampson believes apprenticeship programs are an effective way to educate and retain local workers. Steven Bayer, resident of the borough, spoke in support of Ordinance No. 2020-24. Mr. Bayer believes investing in the local workforce is a good idea for the borough.
Ryan Tipton, resident of the borough, spoke against Ordinance No. 2020-24. Mr. Tipton believes this ordinance is discriminatory.

RECOMMENDATION TO APPROVE CHANGE ORDER FOR CONTRACT ISSUED AS A RESULT OF IFB NO. 19068 Lathrop HS Gym/Locker Room Roof Replacement
The Department of Public Works recommends assembly approval of a Change Order to this contract for an amount of $112,915.95. The resulting total contract amount, after approval of th is change order, will be $592,370.60.
In the performance of this contract seven roof drains were identified that do not currently have heat trace on them. This change order will allow the contractor to modify the drains to accept the heat trace and extend electrical power from inside the building to power the new heat trace lines.
In accordance with FNSBC 16.12. 090 Authority to Contract, "Every borough contract, contract modification, or change order is subject to the prior approval of the borough assembly or finance committee of the borough assembly, when the amount exceeds $100,000."
Funding for this Change Order is available through Ordinance Numbers 2018-20-1 B and 2018-20-2H.

Recommendation to Approve Change Order for the Finance Committee Meeting of August 6, 2020.
Action Requested: The Department of Public Works recommends Finance Committee approval of a change order to Interior Alaska Roofing, Inc., in the amount of $112,915.95, for a total contract amount of $592,370.60.
Project Description: This project replaces the existing IRMA roof system on the Gym and boys and girls locker rooms with a new EPDM roof with increased insulation.
Project History: The School District has identified seven roof drains that do not currently have heat trace on these roofs and has requested that the contractor modify the drains to accept heat trace and extend electrical power from inside the building to power the new heat trace lines.

WHEREAS, The Fairbanks North Star Borough (Borough), in keeping with
its zoning and land use planning powers, implemented Borough code zoning regulations
but has not historically enforced these regulations; and
WHEREAS, The Borough's lack of enforcement paired with other market
conditions did not require or incentivize Borough property owners to strictly comply with
the Borough's zoning code; and
22 WHEREAS, Current property owners are being held accountable for the
23 actions of previous property owners; and

25 WHEREAS, Current property owners are usually unaware of the land use
26 violation until it is identified during the mortgage financing process; and

The ordinance was referred by the FNSB Assembly to the Planning Commission for recommendation . The proposed ordinance is sponsored by the FNSB Administration. The intention of this ordinance is to amend FNSBC 18.116 for the amnesty relief criteria to allow more flexibility in granting amnesty for existing code violations of setbacks in certain zones.
The Planning Commission concurred with staff recommendation and voted seven (7) in favor, two (2) opposed, to recommend approval with three (3) amendments proposed to the ordinance, to the Borough Assembly.

1. The tower is limited to 155’ in height, including all antennas and other
appurtenances. 2. The subject tower shall remain unlit. 3. All conditions previously imposed in CU1976-016 will continue to be valid:

4. All required and waived setbacks shall be measured from the edge of the communications tower, rather than the center of the pole or the accessory equipment.
5. The property shall be developed in accordance with the site plan dated April 06, 2020, submitted on April 23, 2020 and attached as Attachment 6.

If any modifications are made to the site plan or other FNSB required documents or operational characteristics, the applicant or holder of this conditional use permit shall submit revised documents to the FNSB Community Planning Department. If modifications are made to the conditional use, an amendment to the Conditional Use Permit may be required pursuant to FNSBC 18.104.050(D).
7. Only the vegetation within the proposed 30’ x 30’ tower site (on the site plan labeled C1.0, dated April 5, 2020) for the communications tower, and access to the site, may be cleared. The remainder of the property shall not be cleared, and the existing vegetation shall remain in perpetuity.
F. LEGISLATIVE HEARING
1. ORD2020-10: An Ordinance Amending FNSBC Title 18 To Alter And Clarify The Eligibility Criteria For Amnesty Relief For Properties With Certain Existing Code Violations.
The Sponsor did not provide a report. Christine Nelson presented the staff report. Based on the staff analysis, the Department of Community Planning recommended that the Planning Commission recommend to the FNSB Assembly adoption of Ordinance No. 2020-10 with two proposed amendments. The Commission and staff discussed language of ordinance, existing situations vs. new situations, occasional violations, burden of proof, mailing distance for DPO’s, buyer beware and zoning regulations, property violations, eligibility standard date, and expansion of amnesty.

Chair Muehling opened public testimony. The following individuals testified via Zoom: Lance Roberts Questions to Director Nelson from commissioners were about un-platted parcels and lot sizes and subdivision code. Public Hearing Closed MAIN MOTION: I move the Planning Commission recommend that the FNSB Assembly adopt Ordinance No. 2020-10 with the two proposed amendments from Community Planning made by Commissioner Perreault and seconded by Commissioner Sims. Commissioner Perreault spoke in favor of the forward thinking, problem solving amendments and changes to code, he intended to vote in favor. Commissioner Sims spoke in favor of fine tuning the code to address unforeseen problems of the original ordinance. AMENDED MOTION: I move to add a third amendment to strike lines 80 and 81 from the draft ordinance 2020-10 made by Commissioner Sims and seconded by Commissioner Koester. Commissioner Sims stated in reference to striking the platting provision, recalled the difficulty of an appeal dealing with tax lots and commented that Title 17 should have its platting amnesty clause on its own. Commissioner Koester recalled the appeal and discussion of removing the line in the ordinance, in favor of improving the amnesty process. Commissioner Guinn stated he was in favor of amendment 3 of the amended motion. Most of the problems of the plats were created years ago and have been surfacing, keep in mind this is amnesty prior to 2010. Commissioner Abbey stated her support of the third amendment of the motion and comments from Commissioner Guinn, thanked Commissioner Sims for making the motion. Borough Attorney Billingsley advised the commission on the amended motion and the prescriptive nature of Title 29 in regard to platting, and amnesty code previsions. Commissioner McComas-Roe called the attention of the commission to Rule 20 of the Planning Commission, no non-member of the commission should be permitted to speak when the commission is in a discussion with a motion on the table, except by a consent of the majority of the commissioners. This is the third or fourth time he has brought it up.

Commissioner Sims asked for clarification if a dually recorded subdivision plat is what is referenced in Title 29 vs. aliquot tax lots. He did not believe it was a dually recorded subdivision plat. Commissioner Kenna referred to an ordinance before the commission the week prior. The intention of the ordinance was not to allow people who intentionally acted against the rules to get off scot-free. Because the line, it was not intentional or willful, was not clear at the start it was interpreted over broadly. The fix is not to delete it, but simply add language to it, to show that the intention of the original ordinance was to, according to Mr. Roberts, address the intentions of the person making the application. He was not in favor of the amended motion and will not recommend it. Commissioner Muehling stated he does not want to see amnesty relief for a violation that was self-created, especially within the last 10 years. Does not want to see the authority of the Platting Board diminished, which he thinks would happen with the amendment. ROLL CALL (AMENDED MOTION)

Purpose and Intent
The attached ordinance was referred by the FNSB Assembly to the Planning Commission for recommendation (see Attachment 1). The proposed ordinance is sponsored by the FNSB Administration. The intention of this ordinance is to amend FNSBC 18.116 for the amnesty relief criteria to allow more flexibility in granting amnesty for existing code violations of setbacks and lot size.
Background
In July of 2010 the Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank Act) was signed into law bringing about changes to financial regulations in the United States. Locally the impact has been more strict requirements by the finance lending industry, including an unwillingness to lend on a structure or lot that is not in compliance with borough zoning regulations. Many of these violations have existed for years, or even decades, passed through multiple owners and now the current property owners are having difficulty obtaining financing on said property.
Over the last 5 years, FNSB Community Planning Department saw a significant increase in both grandfather rights affirmation requests and variance applications for lots and structures that have already been constructed. Due to strict criteria for variances, it is very difficult for the Planning Commission to approve most of these variance requests. Property owners with violations to the numerical standards in FNSBC 18 had little recourse if they were not eligible for "grandfather rights" or could obtain a variance to bring their lot or structure into compliance.
In 2016, Ordinance No. 2016-09 was adopted that amended Title 18 by adding an amnesty relief chapter (see Attachment 2) which provided "relief to property owners from certain zoning violations in

existence prior to July 21, 2010 and that do not impact health safety and welfare ... " Amnesty relief applies only to specific numerical standards, primarily yard setbacks and lot area. Currently, a property/structure is eligible for amnesty relief if it meets the provisions listed below:
1. It existed as of July 21, 2010; 2. It was not intentional or willful; 3. It does not pose a danger to the health, safety and welfare of borough residents; 4. If a yard setback violation, it is not greater than 50% of the required setback or a minimum
depth of 5 feet, whichever is greater; 5. If a lot area violation it is not greater than 50% of the required area; and 6. The building of lot complies with all other FNSB platting and zoning requirements, including use.
The criterion of "intentional or willful" is further elaborated upon in FNSBC 18. l 16.030(B) which states that if the violation is less than 50%" it is presumed to be "in good faith", or in other words, not intentional or willful. If a violation is between 50% and 75% of the required area or setback as stated in 18.116.030(A)(5) and (6), a finding on "intentional or willful" must be made as the result of an administrative hearing.
Consistency with the FNSB Regional Comprehensive Plan
Land Use Goal 1 of the FNSB Regional Comprehensive Plan is to "recognize that the foremost aspect of land use involving private property is the retention and maintenance of private property rights", and Strategy 2 is to "work for community end goals with a minimum impact and disruption of individual private property rights." The proposed criteria as revised in eligibility section still differentiates between a violation that could impact the health, safety, and welfare of borough residents; and excludes such a violation from being eligible for amnesty relief.
Analysis
FNSB Community Planning supports the purpose and intent of Ordinance No. 2020-10. This ordinance proposes two changes to the amnesty relief eligibility criteria. The first change is the elimination of the " intentional or willful" criterion (Line 73). The original reasoning for the current language is that a property owner who knowingly and intentionally violated the code should not be granted amnesty for the self-created violation. However, interpretation of this criterion once adopted was not only that the violation could not be "intentional or willful" on the part of the current property owner, but also of any past property owner who originated or expanded the violation as well. Since many of these properties have changed hands many times, it is impossible to determine the intent and willfulness of (often deceased) property owner(s) decades prior. Rather than make the distinction between current and past property owners, it was advised to remove the criterion entirely. Removal of this criterion could allow a property owner to obtain amnesty relief for a violation that was self-created.

Community Planning recommends an amendment to address an overlooked remainder in code if this criterion is eliminated. FNSBC 18.116.030(6) should be deleted in its entirety because it only refers to the "intentional or willful" criterion, and therefore is no longer needed.
The second change that this ordinance proposes is the reduction of minimum side yard setback (for amnesty relief purposes only) to not less than 3 feet, rather than the existing language of not less than 5 feet. This change will give some additional flexibility for existing structures in the single-family (SF) and two-family (TF) zones. Structures in these two zones already have a 5 foot minimum side yard setback; therefore these properties are effectively prohibited from amnesty relief for side yard setbacks. These residential zones are generally more urban in nature and are perhaps most suited for smaller yard setbacks. Historically side yard setbacks in several residential zones have ranged from 0 to 15+ feet, and have frequently fluctuated multiple times over the last 70 years, so the existing development pattern shows a variety of different side yard setbacks in these neighborhoods. This change to the minimum side yard setback for amnesty relief is generally consistent with existing development patterns in the SF and TF zones.
Community Planning is proposing another amendment to clarify the amnesty relief application process, namely which applications go to hearing and the public notice distance for amnesty relief requests. With the removal of the "willful and intentional" criterion, the method by which applications are determined to go to hearing or not, is no longer functional. The proposed amendment merely spells out the previous distinction of which applications go to hearing as stated in FNSBC 18.116.040(6) and in 18.116.030(6), which is proposed to be deleted. Currently, amnesty relief requests that are presumed to be in good faith (violation less than 50% of the required size, area or distance) do not go to hearing. Therefore, with the proposed amendment, the process will remain the same; the distinction is merely stated in a slightly different manner.
In addition, this proposed amendment reduces the mailing distance for public notice of an amnesty relief hearing. Currently the mailing distances are 1,000 feet inside city limits and 2,000 feet in the borough. While these distances work admirably for conditional uses and other Planning Commission applications, they are excessive for administrative hearing items. Frequently property owners call the office confused as to why they are receiving these notices and requesting to be removed from the "mailing list". In the last several years, only a few adjacent or very close neighbors have testified in amnesty relief hearings.
The two amendments proposed by Community Planning are:

18.116.010 Purpose I Fairbanks North Star Borough Code
18.116.010 Purpose.
The purpose of this chapter is to provide relief to property owners from certain zoning violations that
were in existence prior to July 21 , 2010, and that do not impact the publ ic health, safety and welfare
of borough residents. The intent is to ensure properties are marketable and saleable, thereby
ensuring local neighborhood preservation, continu ity, and stability. (Ord. 2016-09 § 2, 2016. 2004 Code
§ 18.60.010.)
18.116.020 Authority to continue.
A. Subject to the restrictions of this chapter, any building or lot that is in violation of this title with
respect to the numerical regulations pertaining to the size of yards and open space areas, building
height and size, or lot area, and which has received affirmative recognition of amnesty relief under
this chapter, may continue and not be subject to any enforcement action under this title. A change in
ownership of the building or lot does not void amnesty relief provided by this chapter.
B. A building or lot that is in violation of the numerical regulations of this title and eligible for
amnesty relief may be enlarged or altered as long as the enlargement or alteration does not create a
new code violation .
C. The portion of a structure granted amnesty relief may be repaired if only partially destroyed (less
than 50 percent of the square footage) by fire or similar occurrence provided there is no expansion
of the violation. (Ord. 2016-09 § 2, 2016. 2004 Code§ 18.60.020.)
18.116.030 Eligibility.
A. A violation will be eligible for amnesty relief if it meets the following criteria :
1. The violation for which amnesty relief is sought does not qualify for legal nonconforming
status as set forth by Chapter 18.108 FNSBC;
2. It existed as of July 21, 201 0;
3. It was not intentional or willful ;
4. It does not pose a danger to the public health, safety and welfare of borough residents;
5. If a yard setback violation, it is not greater than 75 percent of the required setback and will
not result in a setback of less than five feet;
6. If a lot area violation, it is not greater than 75 percent of the required area; and

7. The building or lot complies with all other FNSBC platting and zoning requ irements ,
including use.
B. For purposes of amnesty relief, a violation is not intentional or willful if it is based on a good faith
error of law or fact. Violations that are less than 50 percent of the required size, area or distance are
presumed to be in good faith. (Ord. 2016-09 § 2, 2016. 2004 Code§ 18.60.030.)
18.116.040 Affirmative recognition of amnesty relief.
A. An applicant may seek an affirmative recognition of the amnesty relief provided by this chapter
by submitting an application and affidavit to the department of community planning director or
designee describing the building or lot for which affirmative recognition of amnesty relief is sought.
The application may be submitted concurrently with an application for affirmative recognition of
grandfather rights. The applicant shall be the owner of the property described in the application , the
contract purchaser of said property, the holder of an option to purchase said property, or such
persons that possess a substantial proprietary interest in the property being considered . The written
consent of the owner, or an authorized representative having power of attorney, shall accompany all
applications. The application must contain a written positive assertion that said building or lot and the
violation for which the applicant seeks affirmative recognition of amnesty relief meets the
requirements of this chapter. This application may be made at any time. The application may be
accompanied by pictures, statements of support, public or recorded documents and other evidence.
The application must be accompanied by a site plan showing size of the lot, the subject building, and
current yard dimensions, if applicable.
B. Within 15 days after the filing of the owner affidavit, the department shall schedule an
administrative hearing. Notice of the application and the hearing shall be provided using the
procedures set forth in FNSBC 18.104.01 0(C)(1) and (2). Applications requesting amnesty relief for
violations presumed to be in good faith under this chapter shall be exempt from the requirements of
this subsection.
C. Within 15 days of the hearing, the department shall issue an administrative determination
regarding the affirmative recognition of amnesty relief. If no hearing is required, the administrative
determination shall be issued within 10 working days of the application. The applicant or any
aggrieved person, as defined by FNSBC 18.104.090(A)(4) . may appeal to the planning commission
by filing a notice of appeal with the community planning department within 15 days after the
department's determination was mailed. The appeal shall be heard de nova by the planning
commission. The planning commission shall uphold or reverse the determination and adopt specific
findings of fact after considering the oral and written statements of the applicant, interested persons,
and the department of community planning . This decision is appealable to the board of adjustment. (Ord. 2016-09 § 2, 2016. 2004 Code§ 18.60.040.)

AN ORDINANCE AMENDING THE FY 2020-21 BUDGET BY REALLOCATING $1,000,000 OF THE CARES ACT FUNDS WITHIN THE SPECIAL REVENUE FUND FROM THE BOROUGH RESPONSE FUNDING TO THE UNIVERSITY OF ALASKA FAIRBANKS
RESPONSE FUNDING
WHEREAS, The Coronavirus Aid, Relief, and Economic Security (CARES) Act
(P.L. 116-136) was signed into law by the President on March 27, 2020; and
WHEREAS, Section 601(a) of the Social Security Act, as added by section
5001 of the CARES Act, appropriated $150 billion to the Coronavirus Relief Fund (CRF)
for payments to States, Tribal governments and units of local governments; and
WHEREAS, The Alaska Legislature accepted the State of Alaska's $1.25
billion allotment of CARES Act CRF dollars; and
WHEREAS, $24,684,398 of the State's CRF dollars have been allocated to
the Fairbanks North Star Borough (Borough) and will be passed through the Alaska
Department of Commerce, Community, and Economic Development (DCCED); and
WHEREAS, Ordinance No. 2019-20-lZ formally accepted the estimated
$24,684,398 in federal funding from the CARES Act, passed through DCCED, and
allocated $6,184,398 to Borough Response Funding; and
WHEREAS, The University of Alaska Fairbanks (UAF) has requested support
from the Borough for UAF's response to the COVID-19 pandemic using CARES Act Fairbanks North Star Borough. Alaska ORDINANCE NO. 2020-20-

36 funding; eligible requests include those for public safety measures, such as plexiglass and
37 disinfection of public areas and other facilities, modifying areas to promote social
38 distancing, and expenses to facilitate distance learning; and
39
40 WHEREAS, The presence of UAF is recognized in the Comprehensive
41 Economic Development Strategy as a major educational asset in the region, a major
42 employer, and is critical to residents' economic and social well-being; and
43
44 WHEREAS, Supporting UAF in its actions to respond to the public health
45 emergency and allow it to maintain its continued programs and services in a manner that
46 mitigates COVID-19 related threats to public health and safety is deemed a necessary
47 expenditure pursuant to the CARES Act.

49 NOW, THEREFORE, BE IT ORDAINED by the Assembly of the Fairbanks
50 North Star Borough:

52 Section 1. Classification. This ordinance is not of a general and
53 permanent nature and shall not be codified.

55 Section 2. Special Revenue Fund Reallocation. The FY 2020-21 budget
56 is hereby amended by reallocating $1,000,000 within the CRF appropriation from the
57 allocation entitled "Borough Response Funding" to the allocation entitled "University of
58 Alaska Fairbanks (UAF) Response Funding."
59 60 Section 3. Parameters for University of Alaska Fairbanks Response
61 Funding. The parameters for the UAF Response Funding are as follows:
62 1. Eligible uses include necessary expenditures incurred due to the public
63 health emergency with respect to COVID-19 within FNSB boundaries.
64 2. UAF must execute a grant agreement with the Borough.

3. The amount of the grant may be reduced if UAF is approved to receive
assistance from other sources including state or federal disaster relief.

Appropriate Funds for the First Year of the Capital Improvement Program
Attached for your approval is a proposed budget ordinance. This ordinance amends the FY
2020-21 budget by appropriating $11,325,000 from the Facility Maintenance Reserve Fund
and $1,010,000 of estimated donations or gifts for various facilities projects across the
Borough. The projects included in this ordinance are the FY 2021 Capital Improvement
Program projects adopted in Resolution No. 2020-12.

DONATIONS OR GIFTS TO THE MULTI-YEAR GENERAL SUBFUND, CAPITAL PROJECTS FUNDS, AND/OR CARLSON CENTER ENTERPRISE PROJECTS FUND FOR VARIOUS
FACILmES PROJECTS ACROSS THE BOROUGH FOR THE FIRST YEAR OF THE CAPITAL IMPROVEMENT PROGRAM
WHEREAS, On August 8, 2019, the Fairbanks North Star Borough (Borough)
Assembly adopted Ordinance No. 2019-35 establishing a new description of and the
process for the Borough's Capital Improvement Program (CIP) in FNSBC 7.12.120; and
WHEREAS, FNSBC 7.12.120(D) requires that the first year of the CIP
constitute the capital improvement budget for that fiscal year and be a part of the annual
budget appropriation; and
WHEREAS, Due to the constraints of the COVID-19 situation, the
FY 2020-21 CIP process was delayed and then extended to allow for ample public input;
and
WHEREAS, On June 25, 2020, The Borough Assembly adopted the FY 2021
CIP in Resolution No. 2020-12; and
WHEREAS, Each of the projects funded by this ordinance is listed in the
FY 2020-21 column of the CIP, with the Facilities Maintenance Reserve and donations or
gifts designated as the funding sources; and

34 WHEREAS, The Borough Assembly established the Facilities Maintenance
35 Reserve by Ordinance No. 99-016 to accumulate funds for major facilities maintenance,
36 repairs, and upgrade costs; and

38 Wl-:IEREAS, The FY 2020-21 column of the CIP also includes a contribution
39 from the Transit Enterprise Fund for the Transit Garage Phase II project which
40 appropriation is before the Assembly in Ordinance No. 2019-20-2D; and

42 WHEREAS, The FY 2020-21 column of the CIP also includes federal grant
43 funds and other grant funds which, if obtained, will be brought forward to the Borough
44 Assembly in (a) separate appropriating ordinance(s).

46 NOW, THEREFORE, BE IT ORDAINED by the Assembly of the Fairbanks

Appropriating Grant Funds from the Alaska Department of Natural Resources and a Match from the General Fund, for the Tanana Lakes Recreation Area Trailheads and Trail Access Improvement Phase V Project
Attached for your approval is an ordinance amending the FY 2020-21 budget by appropriating funds totaling $76,610 for trail access improvements at Tanana Lakes Recreation Area. The project funds include $68,949 from the State of Alaska, Department of Natural Resources Recreational Trails Program and a local match of $7,661 from the General Fund.
This grant will fund the purchase and installation of trailhead kiosks and wayfinding signage at key trail access points in the Tanana Lakes Recreation Area. These kiosks will promote access to the trails and provide an increased level of comfort to new visitors who don't know the area and its trail systems. The project facilitates implementation of the Tanana Lakes Master Plan approved by the Assembly in 2007.

FROM THE GENERAL FUND FUND BALANCE TO THE CAPITAL PROJECTS FUND FOR THE TANANA LAKES RECREATION AREA PHASE V PROJECT FOR TRAILHEADS AND
TRAIL ACCESS IMPROVEMENTS
WHEREAS, The Fairbanks North Star Borough (Borough) Assembly
adopted Resolution No. 2007-16, approving the Tanana Lakes Recreation Area (Tanana
Lakes) Master Plan; and
WHEREAS, The continued development of Tanana Lakes has received
strong community support and the Borough has received several state and federal
grants to aid this development which have been supported by the Borough Assembly;
and
WHEREAS, Motorized and non-motorized trail use is a popular year-round
activity at Tanana Lakes; and
WHEREAS, Tanana Lakes is a primary access point for the Bonnefield Trail
and the Tanana Flats Training Area; and
WHEREAS, Informational and directional signage has not been installed at
the area's popular trail access points; and
WHEREAS, The U.S. Department of Transportation, Federal Highway
Administration (FHWA), has made funding available to the State of Alaska, Department
of Natural Resources (ADNR), Division of Parks and Outdoor Recreation under the
Fairbanks North Star Borough, Alaska ORDINANCE NO. 2020-20-

35 Recreational Trails Program (RTP) to support recreational trails and trail-related
36 facilities; and

38 WHEREAS, The Borough Assembly adopted Resolution No. 2019-41,
39 authorizing the Mayor to submit to the State of Alaska an application for an RTP
40 matching grant for access improvements in Tanana Lakes; and
41
42 WHEREAS, The Borough Parks and Recreation Department submitted an
43 RTP grant application to improve trail access within and from Tanana Lakes Recreation
44 Area, and the application was successful; and
45
46 WHEREAS, The scope of this grant funded project will include multiple
47 trailhead kiosks for providing trail access information and improved trail access
48 locations; and
49
50 WHEREAS, The ADNR has awarded $68,949 in RTP grant funding to the
51 Borough for trailhead improvements and wayfinding kiosks; and
52
53 WHEREAS, The grant agreement with ADNR requires a 10 percent cash
54 match equaling $7,661; and
55
56 WHEREAS, The Tanana Lakes Access Improvements Project is supported
57 by the Borough's Trails Advisory Commission and the 2007 Master Plan; and
58
59 WHEREAS, These improvements are included in the Borough's Capital
60 Improvement Program as part of the Tanana Lakes Master Plan Implementation Phase
61 III project (Phase V project for trailheads and trail access improvements); and
62
63 WHEREAS, The proposed project will improve the community's ability to
64 access these public lands and recreation resources.

72 Section 2. Acceptance of Federal Pass-Through Grant Funding. The
73 Borough accepts the award of $68,949 in FHWA RTP funding, passed through ADNR,
74 for trailhead improvements at Tanana Lakes Recreation Area.

76 Section 3. General Fund Appropriation. The FY 2020-21 budget is hereby
77 amended by appropriating $7,661 to the General Fund budgetary guideline entitled
78 "Contribution to Capital Projects Fund" and by increasing Contribution from Fund
79 Balance by a like amount.

81 Section 4. Capital Projects Fund Appropriation. The FY 2020-21 budget is
82 hereby amended by appropriating $76,610 to the Capital Projects Fund budgetary
83 guideline entitled "Tanana Lakes Trails Phase V Trailheads" and by increasing estimated
84 revenue from federal pass-through grants by $68,949 and by increasing Contribution
85 from General Fund by $7,661.

87 Section 5. Eligible Expenditure Period. RTP grant expenditures incurred
88 within the effective dates of the signed federal pass-through grant agreement between
89 ADNR and the Borough are eligible for reimbursement.

91 Section 6. Provisions for Appropriation Estimates. This appropriation is
92 for estimated amounts and may be adjusted to reflect the actual requirements of the
93 RTP grant and its matching provisions. The actual amounts will be appropriated
94 contingent, and based, upon the signed grant agreement between ADNR and the
Fairbanks North Star Borough, Alaska ORDINANCE NO. 2020-20-Page 3 of 4

95 Borough. Any material difference, as determined by the Chief Financial Officer, will be
96 communicated to the Assembly.

98 Section 7. Contingency. The appropriation of federal pass-through grant
99 funding is contingent upon the signed RTP grant agreement between ADNR and the

102 Section 8. Lapse of Funds. Upon completion or abandonment of this
103 project, any unencumbered, unexpended portion of local matching funds will lapse to
104 the General Fund fund balance.

SUBJECT: Ordinance 2020- 20 - 1DAppropriating DOJ CARES Act Funding for Personal Protective Equipment
This ordinance appropriates $58,008 in 2020 Department of Justice funding to the Special Revenue fund for the purchase of personal protective equipment (PPE) for first responders.
Specifically, Emergency Operations Department plans to purchase the following PPE:
• Surgical facemasks (250 boxes of 50 each)
• Face shields (2,500)
• Personal isolation kits (550)
• Disposable gowns (3,000)
• Nitrile disposable gloves (525 boxes of 50 each)
• N-95 protective masks (275 boxes of 20 each)
These items will be purchased and then will be warm/climate-control stored within the Fairbanks North Star Borough (FNSB) to be utilized by first responders for response to any coronavirus outbreak that may occur within the FNSB.
Due to many suppliers being out of stock and unknown pricing adjustments, these figures and quantities may need to be adjusted after formal procurement of items. Shipping costs to Alaska vary greatly, depending on the physical location of the responsive company.

17 Response and Agency Operations, authorized the Bureau of Justice Assistance FY 2020
18 Coronavirus Emergency Supplemental Funding Program (BJA CESF Program) to provide
19 funding to assist eligible states, local units of government, and tribes in preventing,
20 preparing for, and responding to the coronavirus; this includes purchases of personal
21 protective equipment and other necessary medical items; and

23 WHEREAS, The Fairbanks North Star Borough (Borough) is awarded

AN ORDINANCE AUTHORIZING THE MAYOR TO ACQUIRE LAND DESCRIBED AS TRACT A-2, GRACE PARK SUBDIVISION AND AMENDING THE 2019-20 BUDGET BY APPROPRIATING $1,300,000 FROM THE GENERAL FUND FUND BALANCE TO THE TRANSIT ENTERPRISE PROJECTS FUND
The attached Ordinance requests authorization for the Mayor to purchase in the amount of $1,300,000 a parcel of land identified as Tract A-2 Grace Park Subdivision, Plat No. 2007-122 F.R.D., from its owner the International Union of Operating Engineers Local 302 Building Association. The purchase would support construction of a new transit vehicle maintenance garage; a project which has received Federal Transit Administration (FTA) grant funding in the amount of $12,800,000.00.
The Borough's existing transit facility is nearly 45 years old, presenting significant maintenance issues, substantial thermal deficiencies and lacking adequate space as needed for its mission. Construction of a new facility had initially been planned on the existing borough owned site at 3175 Peger Rd., but soil conditions were found to be inadequate for construction during the design stage. The FTA has approved moving the project site.
Borough owned land in the immediate area of the current transit site on Peger Rd., and beyond, was analyzed for potential use as an alternate construction location. While most Borough land is located outside of the urban center of Fairbanks, a number of retained parcels were considered. Specifically, portions of South Davis Park were evaluated and found to lack suitable construction soils or economical access to natural gas distribution mains. A number of parcels marketed for sale in Fairbanks were also analyzed and found to be inadequate in size, road access, or with regard to the nearby availability of natural gas distribution mains.
The parcel proposed for purchase is roughly 8.4 acres in size, located in an area zoned as GU-1, within an area that is predominantly used for industrial purposes. It was selected partially on the basis of availability of natural gas for heating and transit

vehicles. This project is the initial phase of a comprehensive development that includes the future transition from diesel fueled vehicles to compressed natural gas (CNG) fueled vehicles. The current scope of the construction project is to provide for natural gas heat with a heating fuel backup system.
The parcel is bounded by Lathrop Street to the east and Tesoro Avenue to the south. Lathrop street is classified as a minor arterial, while the Tesoro Avenue is classified as local roadway. Adjacent properties to the north and east have dedicated driveways to Lathrop Street and 3oth Avenue. Properties to the south have direct access to Lathrop Street. Properties to the west are accessed via International Street which will not be impacted by the site development. Access to the proposed parcel is currently restricted to Tesoro Avenue. This existing roadway has minimal traffic volume as some adjacent properties are undeveloped. Typically each of ten operating buses will access and depart the site once a day, however, the roadway is expected to have sufficient capacity.
The United States Army Corps of Engineers (USACE) issued a jurisdictional determination on July 31, 2019, which determined the property does not contain waters of the United States under the Corps of Engineers jurisdiction (wetlands).
An independent appraisal was procured which estimated fair market value of the property to be $1 ,182,000.00. The agreed upon sale price takes into consideration the unique characteristics of the property as related to the project's specifications for siting, and a thorough vetting of other available properties on and off the market which distinguished Tract A-2 Grace Park Subdivision as the most economical choice.
We support this ordinance and urge its adoption.

WHEREAS, The Fairbanks North Star Borough (Borough) Assembly adopted

transit facility located at 3175 Peger Road; and
WHEREAS, During the design process, soils were identified and determined
to be unsuitable to support new construction at the existing transit location; and
WHEREAS, The Borough has identified an alternate site for the project,
offering suitable conditions for construction, appropriate road access for a transit
operation, and economical access to critical utilities; and
WHEREAS, Existing Borough-owned land in Fairbanks did not meet the

WHEREAS, FNSBC 20.12.0l0(A)(l) identifies negotiated purchase as a
primary method by which the Borough may acquire land; and

33 WHEREAS, Contingent on Assembly approval, the Borough has negotiated
34 purchase of Tract A-2, Grace Park Subdivision, Plat No. 2007-122 F.R.D., from its owner,
35 the International Union of Operating Engineers Local 302 Building Association, a
36 Washington Corporation, for $1,300,000; and

38 WHEREAS, The Borough has conducted extensive inspections of the site, to
39 include geotechnical investigations funded by the Assembly through Ordinance No.
40 2019-20-ll, and found the site meets all requirements for construction of a new transit
41 vehicle maintenance garage facility; and

43 WHEREAS, An independent appraisal of the property was procured that
44 estimated fair market value of the property to be $1,182,000;
45
46 WHEREAS, The Transit Enterprise Operating Fund had an audited
47 unrestricted net position of $2,649,377 at June 30, 2019; and contributions from
48 unrestricted net position of $1,145,000 in Ordinance No. 2019-20; $107,592 in Ordinance
49 No. 2017-20-lE; and $75,000 in Ordinance No. 2019-20-lL; resulting in an estimated
50 unrestricted net position of $1,321,785 at the end of FY 2019-20; and

52 WHEREAS, The Transit Enterprise Operating Fund projected results of
53 operations for FY 2019-20, excluding the appropriations in the preceding whereas, are a
54 positive $599,298; for a projected unrestricted net position at June 30, 2020 of
55 $1,921,183; and

57 WHEREAS, Furthermore, the Borough is expecting to receive at least
58 $2 million of transit-specific CARES Act funding; although the timing is uncertain, the

71 delegate is hereby authorized to acquire Tract A-2, Grace Park Subdivision, on behalf of
72 the Borough, and to take any and all actions necessary to complete said transaction.

75 20.12.040, the Mayor is authorized to acquire the property for more than fair market
76 value. The Assembly finds there is a compelling public purpose for doing so based on the

The acquisition of Tract A-2, Grace Park Subdivision was negotiated in good
faith with the International Union of Operating Engineers Local 302 Building
Association, a Washington Corporation, who held the property as a long
term investment.
The cost of running natural gas distribution mains, even to those available
properties not ideally suited in size or access, was analyzed and deemed to
be cost prohibitive.
Delaying acquisition of this property in hope that another property might
become available in the market at a lower price would put at risk a
$12,800,000 federal grant.

Attached for your approval is a Resolution authorizing the Mayor to enter into a Memorandum of Agreement with the City of Fairbanks for maintenance of Gordon Wear Park. The Borough exercises area-wide powers for parks and recreation, including maintenance and improvement of parks within the city. The Borough's Department of Parks and Recreation is staffed, equipped, and authorized to manage and maintain parks in our community. The City of Fairbanks, Borough, and Alaska Department of Transportation and Public Facilities have multiple agreements parceling out responsibility based on each organization mission for several sections of the Chena River corridor pedestrian facilities stretching from the Steese Highway Bridge to Peger Road. The City of Fairbanks owns Gordon Wear Park and the adjoining parking lot. The City of Fairbanks maintains the parking lot and lights. The Borough maintains the park, path, and path lights.
This Memorandum of Agreement would renew a prior agreement signed between the Borough and the City of Fairbanks regarding the maintenance and management of the park signed in May of 2000 that recently expired.

WHEREAS, The Fairbanks North Star Borough (Borough) and the City of
Fairbanks entered into a 20-year agreement for the maintenance and management of
Gordon Wear Park, formerly known as Shoreway Drive Park, which expired in May of
2020; and
WHEREAS, The City of Fairbanks and the Borough wish to renew the original
Memorandum of Agreement; and
WHEREAS, The Borough exercises area-wide powers of parks and
recreation including maintenance and improvements of parks within the city; and
WHEREAS, The Borough, through its Department of Parks and Recreation,
is staffed, equipped, and authorized to manage and maintain park properties; and
WHEREAS, The Borough, City of Fairbanks, and Alaska Department of
Transportation and Public Facilities jointly manage and maintain pedestrian and park
facilities along the Chena River Corridor from the Steese Highway Bridge to the Peger
Road Bridge, including Gordon Wear Park; and
WHEREAS, Area residents and visitors to the community benefit in the use

WHEREAS, the City and the Borough wish to continue the original MOA under substantially the same terms; and
WHEREAS, the Borough, through its Department of Parks and Recreation, is staffed, equipped, and authorized to manage and maintain park properties; and
WHEREAS, area residents and visitors to the community benefit in the use and from the enjoyment of a properly maintained park at this location.

This Memorandum of Agreement is entered into this __ day of ___ _ 2020, between the City of Fairbanks, a municipal corporation of the State of Alaska, 800 Cushman Street, Fairbanks, Alaska 99701 (the "City"), and the Fairbanks North Star Borough, 907 Terminal Street, Fairbanks, Alaska 99701 .

Section 1. Park Property:
Gordon Wear Park formerly known as Shoreway Drive Park, an irregular tract of land described as follows:
A tract of land located within Section Ten (10) , Township One (1) South, Range One (1) West, Fairbanks Meridian, Fairbanks Recording District, Fourth Judicial District, State of Alaska, more particularly described as follows:

A tract of land created by accretion, comprising that area shown on the attached map designated "Exhibit A", with bounded limits at follows:
Bounded on the North by Tract H-%-B and the Church Tract as depicted on the replat of the portion of Blocks 5 and 6, and Tracts F-1, F-2, H-4, H-5, and Church Property, North Addition to the Fairbanks Townsite, filed on July 17, 1985 as Instrument No. 85-131, Records of the Fairbanks Recording District, Fourth Judicial District, State of Alaska:
Bounded on the East by the North Bank of the Chena River;
Bounded on the South by the north bank of the Chen a River;
Bounded on the West by the easterly right-of-way limit of North Cushman Street.
EXCEPTING the asphalt parking lot and island/meridian located therein, over which the City reserves control as set forth by the terms below.
Section 2. Transfer:
The City hereby transfers management and maintenance of the park property to the Borough as set forth by the terms of this Agreement.
Section 3. Maintenance:
The Borough will maintain the Park Area, including care of flowers, lawns, trees, shrubbery, seating areas, and sidewalks, bearing all cost for such maintenance. The City will be responsible for repairing any damage to curbs that result from use or maintenance of the parking lot.
Section 4. Utilities:
The Borough provides electrical and water utilities at its expense for use as needed for maintenance of the Park Area.
Section 5. Parking:
The City reserves control of the parking lot, including responsibility for maintenance expenses of snow removal, sweeping, lighting, storm water drainage, and usual lot expenses.

Section 6. Law Enforcement:
The Borough may require law enforcement assistance at the Park Area. The City will provide prompt response to calls for assistance, within the limitations of higher police priorities and staffing levels. Borough representatives will coordinate with the Police Department at the beginning of each maintenance season.
Section 7. Occupancy:
The Park Area is made available at no charge to the Borough in the manner of a licensed use for the term of this Agreement. Nothing in this Agreement will be construed to convey a real property interest to the Borough such that the City will be permanently secured in its ownership of the Property.
Section 8. Term:
This MOA will be for a period of __ years from the initial date herein, unless otherwise agreed to by the parties in a written amendment.
Section 9. Exculpation and Indemnity:
Neither party to this Agreement will be liable to the other for loss, injury, or damage to its employees, contractors, agents, or members of the public from any cause arising from their respective use as provided herein.
Section 10. Termination:
Either party may terminate this Agreement without cause upon 90-days written notice to the other party.
Section 11. Entire Agreement:
There are no other agreements, written or oral, which affect this MOA.

Section 8. Term: This Memorandum of Agreement shall endure for a period of twenty (20) years from the initial date herein, unless otherwise agreed by the parties hereto in written amendment.

AN ORDINANCE AMENDING THE FY 2020-21 BUDGET BY APPROPRIATING $140,000 FROM THE GENERAL FUND FUND BALANCE TO THE MULTI-YEAR GENERAL SUBFUND
FOR THE FY21 COMPREHENSIVE ECONOMIC DEVELOPMENT STRATEGY (CEDS) UPDATE PROJECT
WHEREAS, The Comprehensive Economic Development Strategy (CEDS)
contributes to effective economic development in America's communities and regions
through a locally-based, regionally-driven economic development planning process; and
WHEREAS, The CEDS process serves as a means to engage community
leaders, leverage the involvement of the private sector, and establish a strategic blueprint
for regional collaboration as it provides a vehicle for individuals, organizations, local
governments, institutes of learning, and private industry to engage in a meaningful
conversation and debate about what capacity building efforts would best serve economic
development in the region; and
WHEREAS, A regional CEDS is a prerequisite for designation by the
U.S. Economic Development Administration (EDA) as an Economic Development District
(EDD); and
WHEREAS, A CEDS must be updated every five years to qualify for EDA
assistance under its Public Works and Economic Adjustment Assistance funding assistance
programs; and
WHEREAS, The State of Alaska formed the Alaska Regional Development
Organization (ARDOR) program in AS 44.33.896 to prepare and implement regional
economic development strategies; and

36 WHEREAS, The Fairbanks North Star Borough (Borough) Economic
37 Development Commission (EDC) is the designated ARDOR for Interior Alaska and has
38 been charged with developing, implementing, and updating the Borough CEDS, including
39 conducting annual reviews and five-year updates to ensure that it represents the
40 community's economic development vision; and
41
42 WHEREAS, The EDC developed the CEDS in 1999, which was adopted into
43 the Borough's Regional Comprehensive Plan in 2001; and
44
45 WHEREAS, The CEDS has been appropriately updated since its original
46 adoption as economic priorities have changed and to meet the five-year update
47 requirement; and
48
49 WHEREAS, The current CEDS was adopted in 2016 and is set to expire on
50 June 30, 2021; and
51
52 WHEREAS, Ordinance No. 2019-20 (FY 2019-20 budget) appropriated
53 $115,000 to the Mayor's department, Economic Development (Areawide) division to
54 support economic development in the Borough, but the funds did not get spent; and
55
56 WHEREAS, The estimated cost of a CEDS update for a region the size of
57 the Borough is $140,000; and
58
59 WHEREAS, The Administration intends to secure a contractor for the plan
60 development and public engagement; and
61
62 WHEREAS, CEDSs are important planning documents as they provide the
63 capacity-building foundation that creates the environment for economic prosperity and
64 resiliency.
