7(B) A body corporate providing architectural consultancy services, professional engineering services and/or quantity surveying services,:
- minimum combined shares of 70% to be held by an architect, practicing engineer with practising certificate and/or Consultant quantity surveyor,
- each architect, engineer and/ or quantity surveyor shall have a minimum share of 10%
- the remaining shares can be held by any other persons to a maximum 30%

‘Subject to this Act, any person may qualify for registration as a Graduate Architect or Architect and no person shall be entitled to be registered as an Architect unless he is at the time of application for registration and has been for a period of not less than 6 months prior to the date of application, residing in Malaysia’
Note : In line with liberalisation, any nationality will have the right to register as an architect subject to the domestic regulation. (14)&&An&Architect&shall¬&permit&the&inserBon&of&any&clause&in&tenders,&bills&of&quanBBes&or&other&contract&documents&which&provides&for&payments&to&be&made&to&him&by&the&contractor&whatever&may&be&the&consideraBon,&unless&it&is&in&accordance&with&the&guidelines&or&circulars&issued&by&the&Board&and&with&the&full&knowledge&of&his&client.&
(15)&An&Architect&if&appointed&as&a&member&of&a&governmental&or&statutory&body&with&the&power&to&approve&development&applicaBons,&shall,&if&he&has&any&interest&in&such&applicaBons&declare&his&interest&and&shall¬&take&part&in&the&decision&making&process&of&such&development&applicaBons&in&which&he&or&his&architectural&consultancy&pracBce&is&directly&or&indirectly&involved.&&

(16)&An&Architect&shall¬&fail&to&disclose&to&his&clients,&owners&or&contractors&significant&circumstances&known&to&him&that&could&be&construed&as&creaBng&a&conflict&of&interest&and&shall&ensure&that&such&conflict&does¬&compromise&legiBmate&interests&of&such&persons&or&interfere&with&the&Professional&Architect’s&duty&to&render&imparBal&judgement&of&contract&performance&by&others.&
(17)&The&professional&services&of&an&Architect&who&carries&on&business&as&an&architectural&consultancy&pracBce&shall&be&remunerated&solely&by&fees&payable&by&his&client.&The&services&of&an&Architect&in&employment&shall&be&paid&by&salary&and&other&benefits&agreed&with&his&employer&and&he&shall&be&debarred&from&any&other&source&of&remuneraBon&in&connecBon&with&such&services&rendered.&&

5)$Respect$for$the$legiEmate$rights$and$interests$of$others.$
(1) An&Architect&shall¬&adempt&to&supplant&another&person®istered&under&this&Act&who&has& already& been& engaged& by& a& client& nor& shall& he& compete& with& another& person®istered&under&this&Act&to&secure&a&commission&by&a&reducBon&of&fees&or&otherwise.&
(1A)&An&Architect&on&being&approached&or& instructed& to&proceed&with&professional&work& for&which&he&knows&or&can&ascertain&by&making&reasonable&enquiries&that&another&Architect&has&been&engaged&shall,&before&proceeding&with&such&work,&communicate&in&wriBng&with&the&other&Architect&and&obtain&a&leder&of&release&from&him&or&obtain&such&leder&through&his&prospecBve&client,&provided&that&this&requirement&may&be&waived&at&the&discreBon&of&the&Board.&
(2)& &An&Architect&may&be&paid&professional&fees&for&providing&an&independent&opinion&on&the&works&of&another&Architect,&provided&that& the&client&engages&him&for& that&purpose&and&that&he&assumes&responsibility&for&such&opinion.&
(3)& Nothing& in& this& Code& shall& prohibit& an& Architect& who& is& a& director& of& a& registered&corporaBon&from&receiving&remuneraBon&for&services&as&a&director.&

CONDITIONS$OF$ENGAGEMENT$OF$AN$ARCHITECT$
An$Architect$who$carries$on$business$as$an$architectural$consultancy$pracEce.$
1.& (1)& An& Architect& who& carries& on& business& as& an& architectural& consultancy&pracBce&shall&provide&architectural&consultancy&services&as&described&in&the&scope&of&services&incorporated&in&the&Memorandum&of&Agreement&between&the&&Architect&and&the&client.&
(2)&The&architectural&consultancy&services&provided&by&the&Architect&shall&be&in&accordance&with&the&Architects&(Scale&of&Minimum&Fees)&Rules&2010.&&
(3)&The&&Architect&shall&be&remunerated&solely&by&fees&payable&by&the&client&for&architectural&consultancy&services&provided&by&him.&

any&part&of&the&project&and&unless&otherwise&agreed&upon,&the&consultants&shall&be&engaged&and&paid&by&the&client.&
Engagement$of$consultants$by$the$Architect.$2.&&An&Architect&may&be&required&to&engage&his&own&consultants&and&if&the&engagement&is&
approved&by&the&client,&the&fees&which&would&have&been&payable&to&such&consultants&if&they&were&separately&engaged&shall&be&paid&through&the&Professional&Architect.&
CoordinaEon$of$consultants’$works.$3.&&An&Architect&shall&instruct&the&consultants&and&coordinate&the&consultants’&works&where&
required,&whether&the&consultants&are&engaged&by&him&or&client.$

Suspension$of$architectural$consultancy$pracEces.$16.&(1)&The& &Architect&shall,&in&the&event&the&client&fails&to&pay&the&fees&claimed&within&
the& period& sBpulated& in& the& MOA,& be& enBtled& to& suspend& his& services& not&amounBng& to& a& terminaBon,& where& the& suspension& commences& upon& the&Professional& Architect& having& duly& served& a& wriden& noBce& of& suspension& on& the&client.&
& & & & &(2)&The&suspension&under&subparagraph&(1)&shall&remain&in&force&unBl&the&fees&are&paid& or& sedled,& or& in& the& event& of& a& dispute,& unBl& the& mader& is& referred& for&resoluBon&as&provided&for&in¶graph&23&and&24.&
TerminaEon$of$engagement.$17.&The&MOA&between&the&Architect&and&the&client&may&be&terminated&at&any&Bme&by&

20.&&Pursuant&to&secBon&14&of&the&Copyrights&Act&1987,©right&in&all&documents&and&drawings&prepared&by&the&Architect,&including&any&works&executed&from&such&documents&and&drawings,&shall&remain&the&property&of&the&Architect,&unless&otherwise&transferred&to&the&client&upon&such&terms&and&consideraBon&as&may&be&agreed$
EnEtlement$to$documents.$
21.&(1)&Where&the&Architect&has&rendered&architectural&consultancy&services&up&to&and&including&the&Contract&DocumentaBon&Phase&and&has&received&his&due&fees,&the&client&shall&be&enBtled&to&reproduce&the&design&for&the&purpose&of&implemenBng&the&project&provided&that&the&project&is&on&the&site&on&which&the&design&was&originally&prepared.&

22.&Upon& the& terminaBon&of& the&MOA&between& the&Architect&and& the&client&and& the& full& sedlement& of& all& dues& or& upon& the& receipt& of& an& acceptable&guarantee&of&payment,&the&Professional&Architect&shall&deliver&to&the&client&copies& of& drawings,& specificaBons& and& other& documents& relaBng& to& the&project&
MediaEon.$
23.(1)& In& the& event& of& any& dispute& between& the& Architect& and& the& client,&whether&arising&during&or&aker&the&rendering&of&architectural&consultancy&services&under&the&MOA,&the&parBes&may&refer&their&dispute&for&mediaBon&in&accordance&with&the&guidelines&or&circulars&issued&by&the&Board&

Phases$for$Basic$Services$
7.& The&Basic&Services&that&may&be&provided&by&the&architectural&consultancy&pracBce&shall&be&for&any&or&all&of&the&following&phases&:&

• (b)& Design&Development&Phase;&
• (c)& Contract&DocumentaBon&Phase;&
• (d)& Contract&ImplementaBon&and&Management&Phase;&
• (e)& Final&CompleBon&Phase.&
Supplementary$Services$$
13. The&Supplementary&Services&which&are¬&included&in&the&Basic&Services&but&which&may&be&provided&by&the&architectural&consultancy&pracBce&to&supplement&the&Basic&Services&shall&be&any&or&all&of&the&following&:&&
14. client’s&objecBves,&brief&and&constraints&for&the&project&&(a) ascertaining&the&and&advising&the&client&on&how&to&achieve&the&objecBves;&
(c) inspecBng&and&advising&the&client&on&the&selecBon&and&suitability&of&proposed&sites,&and&conducBng&or&taking&part&in&negoBaBons&connected&therewith;&
(e) preparing&and&refining&the&brief&in&consultaBon&with&the&client&and&interpreBng&the&client’s&objecBves&to&arrive&at&an&agreed&brief&for&the&project;&
(d)&preparing&an&outline&project&plan&which&may&include&a&preliminary&esBmate&of&construcBon&costs,&a&preliminary&project&planning&and&implementaBon&schedule,&a&preliminary&cash&flow&projecBon&and&a&resource&plan;&

(e)&preparing&a&master&plan&for&housing&development&or&other&schemes,&including&preliminary&layout&plans,&for&discussion&with&the&relevant&approving&authoriBes&that&leads&to&the&preparaBon&of&detailed&development&plans&based&on&the&layout&plans&as&approved&by&the&relevant&approving&authority&to&enable&the&project&to&be&implemented;&
(f)&preparing&the&drawings&for&sale&and&purchase&agreements,&where&relevant;&
(g)&cerBfying&and&issuing&cerBficates&of&stage&compleBon&under&the&sale&and&purchase&agreement&between&the&client&and&the&purchasers;&
(h)&providing&interior&design&services,&including&preparing&sketch&layouts,&working&and&construcBon&drawings,&details&and&tender&documents,&managing&the&contract,&supervising&the&works&during&the&stages&of&implementaBon,&issuing&cerBficates&of&payment&and&accepBng&on&behalf&of&the&client&such&works&upon&its&compleBon;&
(i)& designing&graphics&and&signage&in&connecBon&with&the&project&and&providing&all&the&necessary&services&for&their&execuBon.&
Supplementary$Services$$ AddiEonal$Services$
14.&The&AddiBonal&Services&that&may&be&provided&by&the&architectural&consultancy&pracBce&under&a&separate&appointment&shall&be&any&or&all&of&the&following&:&

(a)&advisory&services;&
(b)&survey&and&invesBgaBon&services;&(c)&planning&and&development&services;&
(d)&financial&advisory&services;&
(e)&excepBonal&negoBaBons&and&protracted&involvement&services;&
(f)& project&management&consultancy&services;&&
(g)&miscellaneous&services.&
Advisory$services$
15.&The&advisory&services&that&may&be&provided&by&the&architectural&consultancy&pracBce&shall&be&any&or&all&of&the&following&:&&
(a)&carrying&out&such&studies&as&may&be&necessary&for&the&project&and&reviewing&with&the&client&alternaBve&designs&and&construcBon&soluBons,&evaluaBng&their&respecBve&advantages&and&disadvantages,&and&advising&on&all&relevant&aspects&of&obtaining&statutory&approvals&necessary&for&the&implementaBon&of&the&project;&
(b)&advising&the&client&on&the&need&for&geotechnical,&civil,&structural,&mechanical&or&electrical&engineering,&quanBty&surveying&or&other&specialist&consultants’&services,&inviBng,&obtaining&and&evaluaBng&submissions,&and&making&recommendaBons&to&the&client&for&the&appointment&of&persons&providing&such&services,&if&necessary.&

Survey$and$invesEgaEon$services$
16.& The&survey&and&invesBgaBon&services&that&may&be&provided&by&the&architectural&consultancy&pracBce&shall&be&any&or&all&of&the&following&:&&
(a)& preparing&measured&surveys,&taking&levels&and&preparing&plans&of&sites&and&exisBng&buildings;&
(b)& inspecBng,&reporBng&and&giving&advice&on&the&condiBon&of&exisBng&buildings;&
(c)& preparing&schedules&of&dilapidaBon&of&exisBng&buildings&for&either&the&landlord&or&tenant&of&such&buildings,&taking&parBculars&of&sites,&preparing&specificaBons&for&repairs&and&supervising&their&execuBon;&
(d)& undertaking&surveys&on&the&structure&of&a&building&and&ascertaining&the&extent&of&defects&which&may&affect&its&value;&
(e)& invesBgaBng&building&failures&and&arranging&and&supervising&work&to&recBfy&the&building&failures&by&contractors&or&specialists;&
(f)& surveying&and&measuring&exisBng&buildings,&preparing&specificaBons&and&other&documents&for&repairs,&restoraBon&or&conservaBon&works,&administering&the&contract&and&inspecBng&the&works&during&their&execuBon;&
(g)& preparing&documents&and&providing&all&other&services&necessary&in&connecBon&with&demoliBon&works&for&the&purpose&of&the&erecBon&of&a&new&building&when&undertaken&separately&from&the&building&contract;&
(h)& inspecBng&buildings&and&properBes&and&preparing&valuaBons&for&mortgage&or&other&purposes;&
(i)& conducBng&any&survey,&preparing&reports&including&environmental&impact&assessment&reports,&or&carrying&out&invesBgaBons&relaBng&to&the&built&environment.&

17.&The&planning&and&development&services&that&may&be&provided&by&the&architectural&consultancy&pracBce&shall&be&any&or&all&of&the&following&:&
(a)&preparing&a&structural&plan&and&local&plan;&(b)& preparing&a&master&plan&in&accordance&with&the&approved&
structural&plan&and&local&plan;&(c)&preparing&subadivisional&layout&plans&and&submieng&
applicaBons&for&planning&approval&to&the&relevant&authoriBes&for&the&purpose&of&development;&
(d)& preparing&a&preliminary&technical&evaluaBon,&planning&reports&and&feasibility&studies&relaBng&to&land&use&of&a&project&to&enable&the&client&to&reach&a&decision&on&whether&to&proceed&with&the&project&and&the&possible&form&and&content&of&the&project.&
Financial$advisory$services$
18.& The&financial&advisory&services&that&may&be&provided&by&the&architectural&consultancy&pracBce&shall&be&any&or&all&of&the&following&:&
&&(a) preparing&cost&esBmates&for&a&project&comprising&the&cost&of&site&
acquisiBon&and&development,&building&construcBon&and&infrastructure&services,&landscaping,&furniture&and&equipment&and&esBmated&cash&flow&requirements&for&the&related&items;&
(b)&preparing&the&Schedule&of&Rates&and&other&related&documents&for&tendering&purposes,&inviBng&tenders&on&behalf&of&the&client,&examining&tenders&received&or&negoBaBng&tenders&and&prices&with&shortlisted&or&selected&contractors&under&any&contract&system,&valuing&variaBons&and&other&applicaBons&&
ExcepEonal$negoEaEons$or$protracted$involvement$services$
19.&The&excepBonal&negoBaBons&or&protracted&involvement&services&that&may&be&provided&by&the&architectural&consultancy&pracBce&shall&be&any&or&all&of&the&following&:&&
(a)& parBcipaBng& in& protracted& negoBaBons& in& connecBon& with& applicaBons& for& town&planning&or&other&statutory&approvals,&including&applicaBons&for&conversion&of&Btle&to&land& for& development& purposes,& changes& in& land&use,& zoning,& densiBes,&waivers& and&appeals;&
(b)& amending& the&content,& scope,&design&or&details&of&a&project&or,&building&or&any&of& its&parts,&upon&the&client’s&instrucBons&aker&approvals&at&various&stages&have&been&given&by&the&client,&and&requiring&the&architectural&consultancy&pracBce&to&either&amend&or&prepare&new&drawings&or&produce&informaBon&aker&they&have&been&finalised;&
(c)& conBnuing& services& on& a& protracted& basis& due& to& causes& beyond& the& architectural&consultancy&pracBce’s& control&and¬&directly&or& indirectly& caused&by&acBons&of& the&architectural& consultancy& pracBce,& but& may& be& caused& by& certain& decisions& of& the&client,& breach& of& contract& by& any& of& the& parBes& to& the& building& contract& or& other&causes,&and&which&will&involve&the&architectural&consultancy&pracBce&in&addiBonal&Bme&or&work;&
(d)& conferring& with& solicitors,& adending& court,& mediaBon,& arbitraBon& and& enquiries& in&connecBon&with&statutory&approvals.&
Project$management$consultancy$services$
20.&The&project&management&consultancy&services&that&may&be&provided&by&the&architectural&consultancy&pracBce&shall&be&any&or&all&of&the&following&:&

Architects$are$to$observe$the$following$before$commencement$of$construcEon$work:$1. Check&the&details&specified&in&the&Sales&Brochure&approved&by&the&Ministry&of&Housing&&&&&&&&&&Local&Government&to&ensure&they&correspond&to&the&specificaBons&in&the&building&contract.&&&&&&&&The&check&list&should&include&the&approved&layout&plans,&the&building&plans&and&the&&&&&&&&specificaBons&of&the&houses.&&3.
