Our members – and the industry in general – also benefited from the busi-ness, networking and educational opportunities that COMPTEL presented. Our COMPTEL PLUS Convention & EXPOs brought together more than 4,300 industry leaders and decisionmakers, and exhibitors representing 210 companies, in the Spring and Fall of 2011. In addition to the timely keynote addresses, panel discussions and workshops at our conventions, we provided members with access to Webinars and white papers on the topics of importance to their business.

Over the years, COMPTEL has established a strong reputation for both our policy advocacy and business development opportunities, and we will con-tinue this momentum going forward. We hope, in these pages, you enjoy the look back at COMPTEL’s first 30 years, and get a glimpse of how we are setting the stage for continued growth and success of your business – and the communications industry as a whole – for the years to come.

On March 21, the association incorporated as Association of Long Distance Telephone Companies (ALTEL), a group of very small resellers interested in promoting competition with AT&T.

IBM introduces the desktop personal computer.

On January 8, AT&T agrees to divest its local exchange service operating companies, settling an antitrust lawsuit, United States v. AT&T, initiated by the U.S. Department of Justice in 1974. Judge Harold H. Greene, of the Federal District Court for the District of Columbia, presided over the case.

2011 was a year of celebrating the significant

achievements of COMPTEL. We began the year by

marking the association’s 30th anniversary. Since 1981,

COMPTEL has been the champion of competition in

the communications industry.

Throughout this annual report, you will see a timeline marking the milestones of COMPTEL and the industry during the past three decades. COMPTEL was founded by upstarts in the long-distance market that were chal-lenging the entrenched monopoly. We have grown and evolved as competition expanded into other sectors – from local telephony and data to VoIP, video, broad-band, managed services, cloud computing and data centers – as a result of the innovation, entrepreneurial spirit and leadership of our member companies, who rely on copper, fiber and wireless technologies to reach their customers.

During the year, we also achieved a number of critical policy advocacy wins before the Supreme Court, at the FCC and on Capitol Hill – all which will result in a bet-ter business and regulatory climate for our members by ensuring an open, vibrant communications marketplace – whether it is in retail or wholesale, wireline or wireless, or business or residential.

A few weeks later, COMPTEL was joined by more than 100 mem-bers, supporters, policy-makers and lawmakers to continue the celebra-tion at Union Station in Washington, D.C.

30 YEARS

For any organiza-tion to remain in business for 30 years is a great ac-complishment. But for an association in a dynamic and ever-changing industry to reach this milestone is a testament to the enduring spirit of its members and the continuing need for a unified voice to advocate for the industry it serves.

COMPTEL marked its 30th anniversary in style. More than 50 former and current COMPTEL chairmen, board members and staff joined COMPTEL at the COMPTEL PLUS Spring 2011 Convention & EXPO in Las Vegas, where an anniversary party kicked off the opening night festivities. During the convention, we also debuted a video retrospective of the as-sociation’s history, featuring a number of individuals whose leadership was instrumental in building and growing the association over the years.

January 30 to February 1, ALTEL hosts first annual meeting in New Orleans. William P. O’Reilly elected first Chairman of the Board; Jerry McAndrews becomes first President.

TexAlTel, the association’s first state affiliate, is created.

ALTEL hosts first educational conference in Woodcliff Lakes, N.J., in September.

First Commercial Cellular Service, provided by Chicago-based Ameritech, is launched using the Motorola DynaTAC mobile phone.

TCP/IP is selected as the official protocol for the ARPANET.

ALTEL gains prominence after working with Reps. Dingell, Markey and Bryant to pass H.R. 4102, which rolled back access charge regime FCC was proposing to benefit AT&T.

MEMBERSHIP

Since COMPTEL’s in-ception, our primary mission has been to support our members – whether it is by ad-vocating for laws and policies designed to foster competition in the communications industry, providing

timely information, or enabling them to net-work and seal valu-able business deals.

Throughout 2011, we have expanded our outreach in order to attract new members in a number of sub-sectors of the communications industry, including cloud services providers, cable companies, cyber-security firms, developers of managed service plat-forms, wireless backhaul and 4G companies, and the vendors that serve these markets. Additionally, we offered new educational opportunities exclusively to our members, including an Executive Webinar Se-ries, complete with white papers, on topics such as IP interconnection for managed VoIP, IP multimedia sub-system for over-the-top services, and facilities-based first-mile strategies.

Our efforts are paying off, as we added 37 new members in 2011 and increased overall membership by approximately 8 percent.

But we are never satisfied with the status quo. New programs are being implemented that will set the foundation for future growth and provide even greater value for our members.

In November, ALTEL merges with the American Council of Competitive Telecommunications (ACCT) and expands its membership to include facilities-based carriers and other providers.

ALTEL changes its name to the Competitive Telecommunications Association (CompTel).

Federal Judge Harold Greene upholds core restriction on RBOC long-distance entry, allowing competitive long distance industry to continue to grow. The first transatlantic fiber

optic cable is completed.

On Mother’s Day, Illinois Bell in Hinsdale County, outside of Chicago experiences a severe fire, leaving 35,000 people without phone service for extended periods. The event underscored the risks on a one-carrier system and its inherent bottlenecks.

Teleport Communications Group, the first competitive access provider (CAP), is established in New York City.

Chicago Fiber Optics (later known as Metropolitan Fiber Systems, or MFS) installs fiber optic cable in Chicago’s system of unused coal tunnels.

ing, the future of IP networks, intercarrier compensation, management strategies, meeting network demands, M&A, OSS, smart grid, universal service reform, video and voice technologies, wireline and wireless, and an insider’s view of Congress

The COMPTEL PLUS Spring 2011 Convention & EXPO, which took place at the Venetian in Las Vegas, featured a sold out exhibit hall that included 115 exhibitors, including 25 that were at COMPTEL PLUS for the first time. The Convention also was the site of our 30th anniversary celebra-tion, featuring a party with entertainment by Pete Dale and the Dealmak-ers – a band made up of employees at BTI Systems Inc.

During the Spring Convention, we also had a half-day workshop hosted by Kelley Drye & Warren LLP on “The State of Carrier-to-Carrier Whole-sale Relationships,” as well as offering additional educational opportuni-

ties in the EXPO hall, where there was a Speaker’s Corner for exhibitor demonstrations and presentations, and a theater hosted by the Metro Ethernet Forum (MEF).

In the Fall, we had more than 2,000 attendees gather at the Gaylord Palms Hotel and Convention Center in Orlando. The COMPTEL PLUS Fall Convention & EXPO featured almost 100 companies in the EXPO hall, including 10 first-time exhibitors. During the opening session, COMPTEL also recognized its outgoing Chairman Joe Ambersley for his decade of service to the association and the Board of Directors.

Our Fall educational agenda featured specialty programming, including a summit on “Backhaul Strategies for Competitive Carriers,” hosted by Light Reading and a half-day workshop by Technologies Management Inc. (TMI) on “Strategies to Maximize Your Profits in an Evolving Regula-tory Environment: USF Allocation Issues.”

petitive communica-tions marketplace.

Our conventions in 2011 attracted more than 4,300 attendees, 210 exhibitors and dozens of influential media and industry ana-lysts, and featured prominent speakers, such as:

•Vint Cerf, Google’s vice president and chief Internet evangelist;

•Erik Qualman, an internationally recognized social media guru and author of “Socialnomics;”

•Richard Jalkut, president and CEO of TelePacific Communications; and

•Jim Patterson, executive vice president of Infotel Broadband Services, former CEO and co-founder of Mobile Symmetry and former president of Sprint’s wholesale division.

Proving once again that COMPTEL PLUS Conventions are the events where “deals are done,” in 2011 more than 2,100 at-tendees utilized the COMPTEL PLUS Business PLANner – our online networking tool – to schedule more than 800 meetings with current and prospective customers in the EXPO hall and the COMPTEL PLUS Deal Center.

We also continued to produce a high quality educational agenda that focused on hot topics such as the AT&T/T-Mobile merger, cloud computing, cybersecurity, BTOP/BIP awards, data security and pri-vacy, data centers, deregulation, emerging technologies, enterprise IP architectures, Ethernet over copper, fiber access, federal contract-

• SuccessfulOppositiontotheAT&T/T-MobileMerger In March 2011, AT&T announced its intention to acquire T-Mobile. COMPTEL, working on its own and in conjunction with other like-minded organizations, actively opposed the transaction through filings at the FCC, lobbying on Capitol Hill, press outreach and grassroots efforts via our FreeToCompete.org website. COMPTEL was instrumental in underscoring how the merger would impact wireless backhaul, innovation and special access services and result in AT&T’s dominance in both the wireless and wireline markets. Ultimately the Department of Justice sued to enjoin the merger on antitrust grounds and the FCC circulated a draft Order recommending a hearing to explore whether the merger would result in less competition, job loss and harm to key markets,

among other issues. On December 19, AT&T and Deutsche Telekom officially terminated the planned merger. • IntercarrierCompensationandUniversalServiceReform Engaging with our

members, we succeeded in getting consensus on a Competitive Amendment to a proposal offered by six incumbent telcos. During this process, COMPTEL was able to build stronger relations with other industry stakeholders – such as cable companies, National Association of Regulatory Utility Commissioners (NARUC), the Rural Cellular Association (RCA) and American Cable Association ACA – that also took issue with the incumbents’ proposal. The FCC adopted its ICC/USF reform order in October.

• IP-to-IPInterconnection Our advocacy was responsible for getting this issue included in the ICC/USF reform order, with the FCC stating that it expects all carriers to negotiate in good faith on IP-to-IP interconnection for voice traffic.

The late Terrence Barnich, then Chairman of the Illinois Commerce Commission, issues a monograph entitled “Telecommunications Free Trade Zones,” which outlines the foundational tenets of local telecom competition.

The Court of Appeals orders Judge Green to lift the ban on RBOC entry into information services.

ADVOCACY

Whether it’s in Washington, D.C.,

one of the 50 states, or in another country around the

world, the laws passed by legisla-

tors and the policies formulated by the Federal Communi-

cations Commission (FCC), state utility commissions, inter-national regulators and other agencies can have a great

bearing on the day-to-day operations – and ultimate success

– of our member companies.

COMPTEL’s tireless advocacy efforts continue to pay off for our members. In 2011, our policy team scored a number of prominent wins in the courts and continued to effectively represent the competi-tive communications sector’s interests before federal and state regu-lators and on Capitol Hill. Among COMPTEL’s accomplishments this year included:

• SupremeCourtWins COMPTEL scored two wins before the Supreme Court, both by unanimous decision. The first case – FCC v. AT&T – stemmed from a Freedom of Information Act (FOIA) request filed by COMPTEL in 2005 seeking records from the FCC relating to an investigation into AT&T’s participation in the E-Rate program. The core issue of the case, which overturned a federal appeals court decision, centered on whether corporations could assert personal privacy interests to prevent the government from releasing documents about them. The Supreme Court refused to extend personal privacy rights to corporations under FOIA. In the second case – Talk America Inc. v. Michigan Bell Telephone Company dba AT&T Michigan – the Supreme Court reversed a decision by the 6th Circuit, and ruled that AT&T must lease entrance facilities used for interconnection purposes to other carriers at cost-based rates.

These entrance facilities – typically wires or cables used for transmission –connect competitive providers’ networks with the incumbent LEC network for the mutual exchange of telecommunications traffic and are critical to our members.

In an effort to standardize Internet practices, Tim Berners-Lee founded the World Wide Web Consortium (W3C) at MIT.

CompTel launches its state policy program.After President Clinton pledges

to veto pro-RBOC legislation, CompTel and its members play pivotal role in gaining key pro-competitive provisions in Congressional bill revamping federal telecommunications law.

Competitive Long Distance Coalition (CLDC) is founded by CompTel, AT&T, MCI, Sprint and LDDS Communications.

Former Sen. Howard Baker becomes Chairman of CLDC.

On Capitol Hill COMPTEL continues to be a go-to source for Congressional committees and staff seeking comment and input on key telecommunications issues. In 2011, we continued our efforts to educate new members of Congress and staff via meet and greets, and briefings on the competitive industry, featuring representatives from our member companies.

With our advocacy on FCC process reform, we succeeded in getting many of our suggestions on rulemaking changes included in the bill as in-troduced. COMPTEL also was active in educating members of Congress about its Competitive Amendment, the need for IP-to-IP interconnection and other issues related to ICC and USF reform, which resulted in letters and calls to the Commission in support of our issues.

COMPTEL staff was active on a number of other legislative initiatives that impact our members, as well, including bill cramming, cybersecurity, data security, privacy, interoperability and eligibility language with re-gard to spectrum policy, next-generation 911 and online piracy.

We also debuted the Capitol Hill Review, a new e-newsletter that is designed to provide members with additional news and information on relevant topics being addressed by Congress. The publication is avail-able to COMPTEL members only.

CompTel forges informal coalition with AT&T, MCI and Sprint to resist RBOC legislative efforts to gain long distance entry while keeping their local monopolies.

Internet service providers (ISPs) begin selling Internet via phone modem to growing computer networks throughout the globe.

Advances, such as Digital Subscriber Line (DSL), appear to support faster delivery of data via phone lines. Asymmetric DSL (ADSL) is standardized.

Internet Protocol version 4 (IPv4) is established for reliable transmission over the Internet in conjunction with the Transport Control Protocol (TCP).

• Lifeline/LinkUpReform We succeeded in getting the FCC to adopt industry-proposed changes to an interim plan for dealing with duplicate Lifeline claims. The FCC was expected to vote an order on long-term Lifeline/Link Up reform in the first quarter 2012.

• CenturyLink/QwestMerger We worked with the FCC and the merging companies to obtain conditions on behalf of our members. These efforts resulted in several members entering individual agreements with Qwest on the issues we raised.

• PoleAttachmentFees We succeeded in getting the FCC to reduce pole attachment fees for members and to reduce the time intervals for the “make ready” process. Additionally, we joined with the National Cable & Telecommunications Association (NCTA) and tw telecom in seeking reconsideration or clarification of the telecom rate formula adopted by the FCC in its April pole attachment order.

• Forbearance In January, we intervened in the U.S. Court of Appeals for the 10th Circuit, and filed a brief in support of the FCC’s decision denying Qwest forbearance from Section 251 (c)(3) and dominant carrier regulation in Phoenix. The case was argued in September.

• SpecialAccess In July, together with other parties, we filed a Petition for Mandamus with the U.S. Court of Appeals for the D.C. Circuit to compel action by the FCC in the special access rulemaking proceeding.

CompTel launches its international policy program.

Worldcom and MFS Communications merge to provide combined local and long distance services.

Bell Company Mergers: SBC acquires Pacific Telesis, and Bell Atlantic acquires Nynex

Ameritech and BellSouth file, under the Telecom Act of 1996, to provide long distance services within their service areas. Both companies are denied permission to do so based on the lack of competition in their local markets.

The RBOCs contest (and win) the FCCs authority on overseeing the opening of local telephone markets under the Telecommunications Act of 1996.

The first interconnection agreement between a CLEC and an BOC is approved by Illinois Commerce Commission.

In Orange County, Calif., Cox Communications becomes the first cable company to install a Class 5 switch.

SBC wins a temporary victory when a Texas court rules that the Telecom Act of 1996 is anti-competitive by requiring the RBOCs to complete a series of steps to open their local markets while placing no such requirements on competitors (IXCs) wishing to enter the local markets.

First CLEC Class 5 switch is purchased by Teleport Communications Group Inc.
