From a tourism perspective the CCPP (Cycling Community Partnership Program) can increase cycling tourism ~ to your community.

Economic Impact variable (EIV) One of the key issues with drawing tourism to an area is TIME and Transportation

costs. We can't shorten the distance to a community but there is a way to reduce costs. The EIV does just that.

HOW does the EIV work?

From working with our marketing partners we reduced tour rates, below operating costs to see where the price

point would make a significant difference in drawing new visitors. We discovered a dramatic increase in cyclist's

signups for tours, which satisfied the visitors, but didn't support our business model. Then we looked at the

economic impact of the drawing tourism to the community, realizing there was great benefits to the community we

cycled within. Hence The Economic Impact Variable and the Cycling Community Partnership Program is founded on

the principle of the Partnership organization would compensate (EIV) Born To Ride Bicycle for the difference in price

of each cyclist sign up and in turn we would draw more cyclists to your community.

With this technique we find our cyclists spend anywhere from 2 to 4 times the value of our tours.

o The Economic impact can grow to an estimated $48,OOO/season into your community. And through a multi-day

tour, where the community is incorporated in the tour, the economic benefit can be an additional estimated

$23,142 through Born To Ride Bicycles purchases of accommodations and meals combined with our cycling tourists

What does it cost?

1. You're required to purchase an annual CCP membership: $5000.00/yr. This amount is a small

contribution towards ongoing operating costs to maintain this service to your communities.

2. For $1000/yr website presence allows up to three cycling tours on our website.

3. A minimum $2000 retainer is required if the community supports reducing tour rates to increase tourism

traffic (EIV). We've experience with large organizations a slow process in making payments. This helps to

insure payments are kept up to date and guarantees the prices stated on our website for tours are

honoured on a long term basis.

4. Tour development fees are $450/day. Developing each tour takes several days. Typically a two hour tour

takes three days to complete. This is also influenced by the type of tour and the level of commitment or

cooperation to support each project. Having maps, GIS, data and other resources at our finger tips is

pinnacle.

~our policy is to receive payments for: 1,2 and 3 ( 3 is optional) in full before commencing services. Other

payments are due within seven days from been billed, after 14 days interest charges apply, talk to us if special

requirements are needed and we can help with setting up a reserve fund for you to save money for

participation or for your next cycling event, that you would like to use our services for.

Featured services:

• On Location services has a base rate of$600 a day + $180 setup/take down fee paid in full a min. 7days prior to the event (credit card, cash or PayPal).

• Optional times are: A. 7am-12pm B. 10am-4pm, C. 2pm-8pm (up to 4 hours)

• On location services available are Bicycle Rentals, repairs, guided tours, training and a Sound system for announcements and musical entertainment. (Additional charges may apply: i.e. DJ services)

What's involved to establish a tour? 1. Research & Development of routes available. Hours of Internet research, and onsite visits with transportation of

equipment to proposed sites. 2. After the tour route is finalized, time trialed, graded by terrain, assigned to bicycle type, endurance level, we go

the next stage. 3. Naming the tour takes research and discussion. 4. Different times of the year the route is ridden 5. A script is written about the tour 6. The Webmaster then goes to work editing documentation taken into consideration many technical issues. 7. Finally Tour goes live for the world to see.

What happens when a tour is booked?

When a tour is booked, a series of correspondence goes back and forth between the customer. This can take a

month, a week or a day. We first establish the correct tour-type for the cyclists skill set. Ensuring the customer

has an enjoyable experience. Then the tour is confirmed by payments with additional data and the staging area

date and time is set, with additional preferences of packaged meals, accommodations, exhibits and

transportation. Then the agreement is written up for the tour guide and mechanic to prepare for the tour. a. The tour guide may ride the tour route once before the customers arrives, reviewing the route and historical data

on the tour as well as determining if any detours have to be made do to down trees, road construction. b. The mechanic has the responsibility to assess the bicycle required for the tour based on the customer's height,

weight, level of experience skill set and expectations. c. And finally the tour guide and bicycles arrive at the staging area to meet the visitors going out that day, come rain

or shine.

And the good thing about our cycling tours is that we always come back with many happy faces that enjoyed the

cycling experience, and look forward to another cycling experience.

SUBJECT: 2014 Building Fee Amendment

RECOMMENDATION

That Staff Report PD007 -14 be received for deliberation; and

That consideration be provided to increase building fees in accordance with the provision of the Building Code Act 7.(1)(c) , 7.1(2) and that notice be given at a public meeting in regards to these changes.

BACKGROUND

The Ontario Building Code requires Building Departments to be independent of the financial tax base of the Municipality, and establish fees that would allow a department to stand alone, responsible for the delivery of services related to the administration and enforcement of the Act. This entails "direct costs for administration and enforcement of the Act, including the review of applications for permits and inspections of buildings, and indirect costs of admin istration and enforcement of the Act, including support and overhead costs" (Section 1.9.1.1.(1 )(C) Division C Part 1 of the Building Code), and the establishment of a reserve fund.

The Building Department reports that present permit fees do not cover the costs involved in conducting regulated duties. This has resulted in reserve funds being used to offset the department expenses when this is not the intent of the reserve fund. There has not been an increase in fees in a number of years. The averages have been calculated in other municipalities of neighbouring communities to ensure that Council can have comfort that what is being asked is reasonable. The intent of the legislation is that building permit fees cover the cost of the Building Department and that it does not affect the tax base.

COMMENTS AND CONSIDERATIONS

The tax base should not be supplementing construction within the Municipality. The Ministry has provided the Municipality the means to collect fees which will make the Building Department independent of the tax base. With our present fees, this is not being achieved.

The legal ramifications of construction and the inspection process are increasing daily. Insurance companies require that the Municipality hire qualified individuals who are up­to-date on the current changes to the legislation and the duty of care to follow the Building Code to the letter of the law. This implies that all members of the building staff must be up-to-date with courses, keep up their credentials and knowledge , all coming at a cost to the Municipality in the form of educational seminars , memberships, training and upgrading of all skills. These are just a few of the costs that are rising yearly with the cost of living: specialization involved and the in-depth knowledge that a building official is expected to have. All change comes with a price and in order to address these changes, the Building Department looks towards Council to address the costs involved.

A survey that was undertaken indicates that Essa is below the average fee allocated by its neighbouring municipalities, and should Council choose to accept the increases presented, it will still be below the average fees within the study group as noted in the charts provided.

An increase of the following would be required to meet the average fee for Simcoe County:

It is suggested that to meet the deficit, an increase of 20% be undertaken over the next year and one half - with a 5% increase April 1,2014, 10% increase January 1, 2015 and an additional increase of 5% implemented June 1, 2015.

FINANCIAL IMPACT

Should an increase in fees be implemented, there will be a positive financial impact to the Municipality. If the present fees are to continue to be in effect, the Building Department may continue to lose money.

SUMMARY/OPTIONS

Council may:

1.. Take no further action. 2. Request Staff revisit the fees noted. 3. Accept the proposed fee by-law (with amendments) and proceed to a public

meeting. 4. Engage a consultant to review present fees and provide a report (not in budget).

CONCLUSION

Council may consider the increase in fees in order to meet the intent of the Ministry requirement for Building Departments to be revenue-neutral. The cost of the increase would be user-related not tax base-related. The staging of the suggested increase allows for builders to prepare for their projects that are forthcoming . Should an increase not be implemented, the reserves will continue to be depleted and the tax base may be impacted. Other savings will have to be considered as well, as already noted by Council during budget deliberations.

Results from Survey of Neighbouring Municipalities

A survey of neighbouring municipalities was undertaken to compare permit fees.

There were 18 municipalities involved (originally 19, but due to the calculations involved with Tiny Township, it was difficult to get a number for comparison. Instead, Blue Mountain was

used as they are similar to the municipalities in Simcoe County).

RECOMMENDA nON

That Staff Report PD009-14 be received; and

That Council consider authorizing the Mayor and Clerk to execute an agreement with the County of Simcoe to allow the Township to construct a new trail through the middle of the Rippon County Forest in Angus to connect the Pine River Trail with the traffic lights at the intersection of Mill Street and Brentwood Road leading into Peacekeepers Park, away from the rear yard of homes on Summerset Place, with a second off-shoot trail possibly leadillg northwards.

BACKGROUND

Further to a public meeting of October 16, 2013, Staff sought out permission to meet with the County on the matter of a new placement for a trail through the Rippon County Forest, to link the Pine River Trail with Peacekeepers Park. Both the Mayor and Deputy-Mayor met with the County Forester and Director of Corporate Services, and this Staff member, to further the trail talks.

The results yielded an agreement to allow the Township to push the proposed trail north and away from those living on Summerset Place - in accordance with what the public voiced at the public meeting. That is, Council would like to push the trail further north than what was originally proposed, in an effort to create an accessible linkage. Note that a well-worn path exists in the Rippon County Forest along the southern boundary. The Township has opted not to expand/improve on this path; instead the accessible or barrier-free trail will meander through the thick of the forest.

COMMENTS AND CONSIDERATIONS

The County reports that this Forest is quite healthy but could use some thinning, which is a normal part of forest maintenance. The Forester has noticed some invasive species likely brought in or spread from the south (residents of Summerset). The , ,

County will commence its regular forest maintenance any day as this is the best time of year to do this type of work. While carrying out maintenance, they propose to also cut a path for the trail through the middle of the Forest and to thin the Township's forest on an adjacent property to the east, for forest health reasons.

FINANCIAL IMPACT

None at this point but if the Township wishes to continue with trail construction this year, then further costs would be involved . The Township may not have budgeted any amount for 2014. It costs approximately $30,000 for 1 km of trail.

a) Staff could investigate County Trails Funding prior to the application deadline of March 21 (50/50 funding/reimbursement).

b) Staff is investigating a youth trail crew funded by HRDC to assist and will know more on this initiative in April.

SUMMARY/OPTIONS

Council may:

1. Enter into an agreement with the County acknowledging Township trail works/usage on County owned lands.

2. Cost of $30,000: ask County for $15,000 and Townsh ip to pay $15,000 to be funded by DC's - insert into 2014 budget.

3. Seek out youth trail crew support of HRDC helping to reduce labour costs for clearing.

4. Concerning the cost of $30,000 split this between years depending on Council direction.

5. Take no further action.

CONCLUSION

Staff recommends Options #1, #2 and #3.

PROPERTY USE AGREEMENT

WHEREAS:

A. The Municipal Act, 2001, S.O. 2001, c.25, ("Act) authorizes The Corporation of the County of Simcoe ("County") to enter into Agreements for the use of its property; ;

B. The County is the owner of certain tracts of land known as "County Forests" throughout the County of Simcoe;

C. County Council passed By-law No. 5568, dated November 27, 2007 authorizing the entering into of Property Use Agreements in respect of County Forests; and

D. The User wishes to obtain permission to use one of the County Forests as described in Schedule "A" attached to this Agreement ("Property"); and

NOW THEREFORE in consideration of the covenants and Agreements herein contained the parties agree as follows:

USE OF PROPERTY

1. The County grants to the User, its agents, contractors and employees ("Agents") the non-exclusive right to use the Property for the purpose of constructing and maintaining a multi-use trail ("Works"), upon the terms and pursuant to the conditions contained in this Agreement.

2. This Agreement shall be effective and commence upon execution by all parties and remain effective until terminated pursuant to the terms herein.

3. The User may terminate this Agreement upon 30 days written notice, provided the User agrees to complete any and all Works, such that the Property is left in as good or better condition than prior to the date upon which this Agreement became effective.

4. The County may terminate this Agreement upon six months prior written notice to the User.

FEE

5. The administrative fee has been waived for this Agreement in accordance with the County's Property Use Agreement Policy.

TRAIL LOCATION

6. The location of the trail will be determined and mutually agreed upon by the County and the User prior to the commencement of Works.

CONSTRUCTION AND MAINTENANCE

7. The User is responsible for all costs relating to trail construction and trail maintenance during the term of this Agreement.

8. The User also acknowledges that, as a result of County directed timber harvesting or other required maintenance or forestry operations, damage to trails may occur. While the County covenants to use its reasonable best efforts to minimize these impacts, the County has no obligation to maintain or repair the trails and/or bridges on the Property for the benefit of the User or the public.

TRAIL CLOSURES

9. The User also acknowledges that County directed timber harvesting or other required maintenance or forestry operations may require the temporary closure of trails. The County will endeavour to communicate planned works with the User in advance to mitigate adverse impacts.

TREE REMOVAL

10. The User and its Agents are prohibited from cutting any trees, branches or brush without the prior written approval of the County Forester or his designate. If the County Forester consents to any cutting, such cutting must be completed so as to create as little damage to the natural vegetation as possible.

11 . The User agrees that any cutting or other damage, which in the opinion of the County Forester has been caused by the User or it's Agents without the approval of the County Forester, shall be rectified at the User's expense upon written notice by the County Forester. If the User does not rectify the damage, this Agreement may be terminated at the County's option, immediately upon written notice to the User.

SIGNS

12. The User shall be permitted to post signage on all trails and/or bridges, provided that:

a. all signage shall be at the User's expense; b. signs must not be installed on trees; and c. prior approval shall be obtained from the County Forester as to the form and

location of such sign( s).

PUBLIC ACCESS

13. Notwithstanding the terms of this Agreement, all trails and/or bridges on the Property must remain open to the public for uses permitted by the County Forest Recreation Policy, as amended from time to time, and the public shall be allowed to use them without any fees being charged by the User. The County may, in its discretion, grant permission to close a certain portion of the Property temporari ly to public access for the purpose of construction of the Works, provided prior written notice is made and mutually satisfactory safety measures are undertaken.

INSURANCE

14. The User shall obtain liability insurance in the amount of $5,000,000.00 showing the Corporation of the County of Simcoe as an additional insured and including a provision for cross liability for insurance against all damages or claims for damages or liability. The User shall provide the County with proof of the insurance required under this Agreement by providing a certificate of insurance prior to this Agreement being executed by the County. It is understood and agreed that the coverage provided by the aforementioned policies will not be changed or amended in any way nor cancelled by the User until thirty (30) days after written notice of such change or cancellations have been delivered to the County.

INDEMNITY

15. The User shall indemnify and hold harmless the County from and against all claims, demands, losses, costs, damages, actions, suits or proceedings whether in respect to losses suffered by the County or in respect to claims by third parties that arise out of any act, error, or omission of the User, or its Agents, in connection with or arising out of the use of the Property and/or the Works, including without limiting or restricting the generality of the foregoing, all injuries to persons, including fatal injuries, and all other damages to property and claims and demands with respect

WAIVER

16. The User expressly waives and releases the County, and its officers, servants, agents, and employees from all claims against them including without limitation those that might arise from the negligence or breach of contract by the County, and its officers, servants, agents, and employees.

COSTS

17. The User is responsible for the costs of preparing, enforcing or releasing this Agreement or any other documentation relating to the carrying out of this Agreement.

ENTIRE AGREEMENT

18. This Agreement shall constitute the entire Agreement between the parties and the parties further acknowledge that there is no representation, warranty, collateral Agreement or adverse condition affecting this Agreement other than as expressed herein in writing.

SEVERABILITY

19. The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision hereof and any such invalid or unenforceable provision shall be deemed to be severable.

SCHEDULE

20. Schedule A attached hereto forms part of this Agreement.

NOTICE

21. Where this Agreement requires notice to be delivered by one party to the other, such notice shall be in writing and delivered either personally or by facsimile transmission, by one party to the other party at their addresses noted below. Such notice shall be deemed to have been given, if by personal delivery, on the date of delivery, and if by facsimile transmission, on the date of delivery with electronic confirmation of receipt obtained:

BACKGROUND

Nottawasaga Futures is seeking funding from OMAFRA (Rural Economic Development (RED) Program funding) to carry out a BR&E survey on manufacturers in south Simcoe [Essa Township has one manufacturer (Munro Ltd.)]. More specifically, on-site interviews will be carried out by two coordinators. A data administrator will also be hired to assist with this project.

The purpose of the project is to identify "red flag" issues to each municipality and to pass along concerns of the industry to municipal officials.

COMMENTS AND CONSIDERATIONS

Since Essa has just one manufacturer, the Municipality may not wish to contribute funds to this project. Alternatively, support in principle could be offered to this organization which develops and coordinates projects and initiatives to the economic development needs of the area.

BACKGROUND

January 2014 introduced changes to the new 2012 Building Code. There have been many significant changes to the Code, in particular, to Part 7 which is plumbing related. Courses have been available to get a handle on the new requirements, and Staff has attended when available. Attached to this Report is a recent report of Corey Eppinghaus, Deputy Chief Building Official.

COMMENTS AND CONSIDERATIONS

Significant changes may affect both the builder and the Municipality. Previously, % inch water services were standard to feed a single family dwelling. A % inch feed still may be acceptable in most homes but lines must be sized according to demand.

Presently, many builders are unaware of these changes and Building Officials are finding that they are educating the trades during plans review. In order to have a comfort level, Staff requires training .

Courses on plumbing are filling up quickly and the Department was fortunate to attend a course. Water size piping is just one of the areas that have been touched by the Code changes and Staff will continue to upgrade knowledge as it is available to better serve builders and the public in general.

FINANCIAL IMPACT

Education spending already a part of the 2014 budget. More specifically, Council has already approved a budget line item of $3,000.

On February 5th 2014 I attended a course for the changes & refresher on Part 7 Plumbing of the Ontario Building Code put on by the Ontario Plumbing Inspectors Association in conjunction with George Brown College and the Independent Plumbing & Heating Contractors Association.

The course was well attended by Inspectors, Plumbers & Engineers from both central and southern Ontario.

The course was instructed & designed by Rainer Blundel, Professor of Plumbing at George Brown College.

The course covered the many changes to the 2012 Ontario building code Pat 7 along with refresher material and was broken into 5 modules such as follow:

• General updates & Changes to Part 7 Plumbing

• Venting • Circuit Venting • Commerical Venting • New Water Pipe Sizing Methods for water services and distrabution systems

The 2012 Ontario Building Code Part 7 has been changed to harmonize some requirments with the National Plumbing Code of Canada. Some changes include; Clarifiying the requirments for wet venting, changes to the maximum length of the trap arm & the maxamum length of a vertical leg of a drainage pipe serving a water closet to 1 meter.

The most noteworthy change is the requirement to size water service pipes & water distribution systems. With this change most homes with 3 washrooms, 1 kitchen sink, 1 clothes washer, 1 laundry tray, 1 dishwasher and hose bibs will require a 1" water service pipe & larger distribution pipes within the house to serve the fixtures in the house.

Each module came with illustrated layouts and scenarios of plumbing systems.

Included in the price ofthis course was an illustrated code book on plumbing written by Rainer Blundel. The book contains Part 7 (plumbing) and highlights the changes & revisions for 2012. The back of the book has an appendix with many illustrated examples & interpratations for Part 7.

I found that this course was helpful and provided a better understanding of the changes to Part 7, especially, the new water pipe sizing methods for water services and distribution piping.

This has been provided in a chart form that establishes the number of members within Building Departments and the number of vehicles which are in each Depaliment.

COMMENTS AND CONSIDERATIONS

The Bui lding Code provides that vehicles used by the Building Department can be financed using Build ing Permit Fees. Generally, all but three municipalities surveyed provided vehicles to Building Staff. Since most trucks are funded through the Building Department, they are exclusively used for Building. Some Departments did lend out trucks on occasion to other Departments but generally they are for their use only. In Essa's case, others may wish to use a Building truck on occasion when it is not in use by an inspector, and this should be allowed, just as other Departments share when warranted. The number of trucks generally collates with the number of inspectors, and 9 out of 15 provide a vehicle for the Chief Building Official.

Staffing varied from 2 to 18 including administrative staff. It should be noted that some of the municipalities with lower staffing are presently preparing to hire due to staff leaving and not being replaced over the winter. This survey took place in December, generally when staffing is down in municipalities.

That Staff Report PR005-14 be received; and

That Council agrees to release The Kinder Garden - Centre for Early Education Preschool from their Lease Agreement for use of the Angus Community Park Bui/ding.

BACKGROUND

The Kinder Garden - Centre for Early Education Preschool had entered into a lease agreement /

with the Township to start running daycare at the Angus CoOmmunity Park Building in the Angus Community Park starting on January 1" 2014. Then the Township agreed to extend the start of the lease agreement until May 1" 2014 to give the Tenant time to comply with the Ministry of Education, Health Unit, and building department requirements .

COMMENTS AND CONSIDERATIONS

The Township would not allow the Preschool to open under the unlicensed parameters allowed by the Ministry and the Tenant is concerned with the 6 month escape clause in the agreement.

FINANCIAL IMPACT

The financial impact is the loss of revenue of $9,600 for 8 months which is in the 2014 budget.

SUMMARY/OPTIONS

Council may: 1. Take no further action. 2. Withdraw the lease agreement and utilize the building for municipal purposes only. 3. Lease the Angus Community Park Building to some other group or organization.

CONCLUSION

Staff recommends that option 2 be approved.

1 would like to take this opportunity to thank you for your consideration and effort in creating an agreement for my purpose in leasing the Angus Community Park building,

Since council has decided that 1 will not be permitted to open under the unlicensed parameters allowable by The Ministly ofEducation/COImnunity Social Services as stated in their letter to you and the risk involved with the six-month escape clause 1 am opting out of our agreement.

Upon inquiring about the six-month escape clause I was infonned by Greg Murphy that it wonld be used if the township decided that they needed the space for another municipal use. This is not an acceptable reason to me as I am looking for a higher cOlmnitment with respect to the needs of the community, my venture and my employees,

Although I am familiar with how escape clauses work 1 am concerued about the time and money that I will be spending on drawings, permits, inspections and upgrades to then be given 6 months notice at any given time. If it were to happen that council decides that they want the building for municipal use or they ask me to vacate for any other reason, 6 months notice would not be a substantial amount of time for me to ftnd another location and start over with drawings, permits, inspections and upgrades without an interruption of service being provided to my clients, It would also be a signiftcant loss to me financially, As you are aware Angus is a small cOlmnunity and there is not a lot avai lable in the way of commercial space for me to choose from should I be given notice by council. I fear that even though I agree with each party having an escape clause, that I have much more to lose than the township as this would cause unemployment amongst my staff and for myself not to mention that my clients risk losing the quality care that they trusted they would have for the duration of their children's preschool years.

I apprec iate your effOli in trying to assist me in my venture and want to thank you for the time you have put aside to consider my requests, I appreciate the support you have shown and hope that the township will remain supportive as I work towards opening in an altemate location.

That the NVCA and Rotary Club of Barrie's request to allow for the overflow parking of vehicles along the shoulders of the 8th Line, each way of the entrance of the Tiffin Conservation Centre, during the 2014 Spring Tonic Maple Syrup Festival be approved provided the Organizers provide traffic control and they ensure that neighbouring driveways are not obstructed.

BACKGROUND

The Rotary Club of Barrie is the service club in charge of organizing the Spring Tonic Maple Sugar Festival at the Tiffin Conservation Centre on April 5 and 6, 2014. As in the past, they are requesting permission to allow for the overflow parking of vehicles on the shoulders of the 8th

Line, each way of the entrance to the Tiffin Conservation Centre during this two day Festival. They have indicated they will provide traffic control and pay special attention on keeping neighbouring driveways unobstructed.

COMMENTS AND CONSIDERATIONS

I can confirm that the Organizers have done an acceptable job in the past with respect to traffic control and ensuring that neighbouring driveways are not obstructed during the annual Spring Tonic Maple Syrup Festivals.

FINANCIAL IMPACT

There are no financial impacts to the municipality.

Council may:

1. Take no further action; 2. Approve the request as presented; or 3. Approve the request subject to further conditions as specified by Council.

The Council of the Township of Essa wishes to express in the strongest terms its concerns with respect to the approval of recent development in the floodplain of the Nottawasaga River , within the watershed and in particular, futl,Jre development in the Township of Essa.

Recent events in centres such as Bancroft, Gravenhurst, Minden, Toronto and Calgary have , . highlighted the dangers to personal safety and to the protection of property that are being caused by flooding . Recent engineering studies and Ontario Municipal Board hearings have also emphasized these very same potential dangers as they relate to the Nottawasaga River and Essa Township.

The Township will shortly be undertaking its own review as part of our Official Plan update to determine the limits of safe and suitable development for flood prone or potentially flood prone areas within our boundaries. While that review is underway, we would respectfully, but strongly urge the Authority to closely monitor any development activity in the floodplain or flood fringe areas around the Nottawasaga River. For the safety of our residents, the protection of our residents' property, and to protect the financial wellbeing of the Township, we ask that such development only take place when full and detailed stud ies are completed by any potential developer verifying that it can be constructed in a safe, suitable and orderly fashion.
