We are delighted to submit the 2018-2019 Annual Report for the David Berg Foundation Institute for Law and History at the Tel Aviv University Buchmann Faculty of Law. The past year was another year of intensive and productive activity, with further accomplishments by our faculty, students, and visitors in advancing the field of legal history in Israel and beyond. Thanks to the increased funding from the Foundation, we were able to hire Dr. Rivka Brot to coordinate the research infrastructure activities of the Institute. She has been dedicating her time this year to the difficult task of getting our Israeli legal history archive off the ground. This was a top priority for us as we believe it is a cornerstone of what we are as the Institute for Law and History – and it was long overdue. We hope to make progress on the other planned research projects – an index to case files at the Israel State Archives and digitization of Privy Council papers of appeals from Mandate Palestine – in the months ahead. While the day-to-day work of the Institute is carried out by its Director, Dr. David Schorr, with the assistance of Dr. Brot and of the Administrative Assistant Ms. Idit Pais-Fried, overall direction continues to be guided by the academic committee, whose members are: Dr. Schorr, Prof. Leora Bilsky, Prof. Arye Edrei, Prof. Ron Harris, Prof. Roy Kreitner, Prof. Assaf Likhovski, Dr. Doreen Lustig, and Prof. Susanne Last Stone. The lead gift from the David Berg Foundation has enabled us to build a program that gets stronger every year. Atop that pillar of support, we are also working to identify new partnerships to help further our goals. We have partnered with the Zimin Foundation to fund the digitization of the materials from the growing archive of Israeli legal history, and are working on a joint proposal to the Minerva Foundation with the Max Planck Institute for European Legal History for a joint summer school on legal history. Most considerably, we are eagerly awaiting a response from the Yad Hanadiv Foundation to fund an Israeli arm of Cardozo Law School’s Israeli Supreme Court Project. We know that the David Berg Foundation has been a sustaining contributor to that project and hope to be able to build off of that and bring new success to it at our own law school. In addition, this year we hosted a number of successful annual and specialty conferences, progressed in the establishment of our archive of the history of Israeli law, continued work on our book series on the history of Israeli law, and continued to support high-quality scholarship through research grants and other channels. Scholarship produced with the aid of the Institute continued to garner awards and recognition. We are excited to share that Rivka Brot's book, In the Gray Zone: The Jewish Kapo on Trial, the second in our book series partnership with Ben-Gurion University's Ben-Gurion Institute, was published this spring. The David Berg Foundation Institute continues to lead the Israeli legal history community and set an example internationally of what an institute of legal history can accomplish. We know we will continue to be a renowned institution with the increased support we have received from the David Berg Foundation.

1. 14th ANNUAL CONFERENCE OF THE ISRAELI LAW AND HISTORY ASSOCIATION October 8, 2018 | Appendix A As in past years, the Berg Institute supported the annual meeting of the Israel Law and History Association, held in collaboration with the Yad Ben Zvi Institute in Jerusalem. This year’s theme was "Historical truth, legal truth, and other truths," and the conference was one of the biggest ever in the series. In addition to ten traditional panels in which papers were presented on a wide range of topics, the central event of the day was an award ceremony in which the fourth annual prize for the best article in legal history was presented (see below at #20), and a panel in which three new books on Israeli legal history were discussed. TAU Law's Menachem Mautner is one of Israel's most important and influential public intellectuals, a leading figure in political theory, legal theory, contract law, and legal history. His book "The Decline of Formalism and Rise of Values in Israeli Law" is probably the most influential book in the field of Israeli legal history, having framed the terms of debate for lawyers, judges, and scholars ever since its publication. This conference, held to celebrate his ongoing work in multiple fields, dedicated a session to discussing this seminal work, with lectures delivered by leading legal historians as well as a team of scholars who are studying the values/formalism dichotomy in the decisions of the Israel Supreme Court using quantitative tools. 12. ISRAEL FORUM FOR ENVIRONMENTAL HISTORY

In order to foster synergies between the fields of legal history and environmental history, the Berg Institute continued lending modest support to the Environmental History Forum this year. Speakers on legal history topics included Amost Nadan (Middle East History, TAU), who spoke on a unique form of common property in land found in Middle Eastern villages (mushaa), and David Schorr, who presented a paper on a seminal Israeli nuisance case. 13. THE DAVID BERG FOUNDATION INSTITUTE STUDENT FORUM

The Berg Forum for Law and History focused this year on the many graduate students at TAU Law who are researching legal history topics. The students met five times over the course of the year:

�� In the first meeting, in November, David Schorr, Director of the Institute, spoke briefly, and the students then discussed a recent review essay by Prof. Orit Rozin (TAU) discussing methodological issues in new historiography on Israeli law.

�� The December meeting revolved around the reading of primary sources, and was led by Omri Pellerman, a graduate student in TAU's Faculty of Humanities and member of the Forum.

�� The third meeting, in January, hosted Prof. Yoram Shachar (IDC & TAU), who talked about his project on the history of the Israeli Declaration of Independence, and more broadly about writing history.

�� The fourth meeting, in April, consisted of a trip to the Knesset, where Forum members met with Gali Ben-Or, head of the national legislation database project; Dr. Gilad Natan, deputy director of the Knesset Archive; and Hodaya Cain, director of the Knesset's research department.

�� At the final meeting, in June, Forum member Alon Jasper led a discussion of Duncan Kennedy's classic article, "The Rise and Fall of Classical Legal Thought".

RESEARCH

14. ISRAELI LEGAL HISTORY ARCHIVE

Thanks to the increased funding by the Foundation, the Berg Institute was able to make significant progress in building the archive this year. The Ben-Ami and Feller collections that we acquired last year were fully indexed by a professional archivist. Prominent civil rights and criminal defense attorney Avigdor Feldman donated to us hundreds of case files, including those of many well-known Israeli cases. These files, as well as the others we have amassed, will no doubt allow historians and lawyers to produce important of Israeli law. We have had expressions of interest from other lawyers about depositing their papers with us, and we are confident that the archive will continue to grow. CO-SPONSORS David J. 15. BERG-BGU LEGAL HISTORY BOOK SERIES

The second book in our Israeli legal history book series with Ben-Gurion University's Ben-Gurion Institute, Rivka Brot's In the Gray Zone: The Jewish Kapo on Trial, was published this spring (with the Open University Press). Brot's manuscript was the winner of the prestigious Goldberg Fund Prize in 2016, and has received rave reviews from our referees. We are sure it will continue to garner accolades. A manuscript submitted last year and sent to outside reviewers was returned to the author this year with recommendations for revisions. We hope to receive the revised manuscript soon. Yet another manuscript was recently submitted, and is currently under review by our publications committee. The Institute provided research grants to three graduate students and nine faculty members at the Tel Aviv University Faculty of Law. 20. PRIZE FOR BEST LEGAL HISTORY ARTICLE The Case That Made History: A Historiographical Look at the Decision in Mizrachi Bank This year's Annual Conference of the Israeli Law and History Association (see above at #1) included the award of a prize to the author of the best legal history article published in the preceding year by a member of the Association. The prize committee, composed of Prof. Esther Cohen (Hebrew University, Chair), Prof. Michael Birnhack (TAU), and Dr. Avishalom Westreich (College of Law and Business), chose as the winner this year an article by Yair Sagy (Haifa), The Case That Made History: A Historiographical Look at the Decision in Mizrachi Bank, published (in Hebrew) in volume 19 of Mishpat Umimshal. The annual prize has served to encourage Israeli scholars to invest in high-quality legal history research. The committee for the fifth annual prize, to be awarded this October 24th, is chaired by Prof. Roy Kreitner of Tel Aviv University, and also includes Dr. Orna Alyagon Darr of Sapir College and Ono College and Prof. Amichai Radzyner of Bar-Ilan University.

הקיבוץ הוא ניסוי חברתי חשוב בשוויון ושיתוף שמאתגר את התאוריה הכלכלית המקובלת. בספרו ״תעלומת הקיבוץ: ערכים שוויוניים בחברה קפיטליסטית״ )בהוצאת אוניברסיטת פרינסטון(, רן חוקר את ההיגיון הכלכלי מאחורי עלייתה ודעיכתה של התנועה הקיבוצית. בעולם שבו אי השוויון עולה והאחוזון העליון מחזיק בחלק עצום מהעושר הכלכלי, דרכים למצוא מנסות רבות מדינות להורדת אי השוויון. הספר מסביר מה ניתן ללמוד מהקיבוצים על איך ליצור חברה שוויונית יותר, ומהם התנאים הנדרשים כדי שחברה כזו תשגשג. ההרצאה תשלב סיפורים אישיים עם תיאור ממצאי המחקר שמבוסס על נתונים שרן
