California farmers hope for best from Farm Bill

As stone fruit farmers begin harvesting their crops and dairy ranchers and farmers tend to their herds, the thoughts of many of them are drifting to what’s going on across the country in the nation’s capitol.

That’s because last week the Senate Agricul-tural Committee overwhelmingly approved a new, five-year farm bill. While the senators

have spent this week debating and, in some cases, amending that bill, expectations are that a final draft will be approved this week, largely intact.

After that, members of the Senate will be appointed to “go to conference” and work with members from the House to essentially merge elements of the Senate Farm Bill with the House Farm Bill.

While largely parallel in some provisions,

the two bills have some significant differ-ences, and the House passed its bill with only a narrow vote margin. Some pundits predict the differences in the bills may lead to some hard fights over issues relating to farm pro-grams and policies, incuding the Supplemen-tal Nutrition Assistance Program (SNAP) that provides food to people in need, which also is covered in the Farm Bill.

Controversial dialysis bill goes to Assembly floor

Mike Adames was informed last De-cember that he would have to go on di-alysis, the result of increased creatinine levels.

A physically taxing process, the Madera mechanic and volunteer firefighter must go in to have his blood taken out, cleaned and cycled back into his body every Mon-day, Wednesday and Friday morning. The treatment makes a 40-hour work-week virtually impossible.

“It does take a big chunk of my day—for three-and-a-half hours—three days a week,” Adames said. “And usually after the treatment, I’m pretty much spent. I’m very tired and it’s very rough on the body.”

In order to help with finances, Adames has a GoFundMe page. He is also being helped by the American Kidney Fund, a nonprofit that provides dialysis patients with charitable payments on their pre-miums. Adames said that this funding has been vital, but concerns were raised by groups like the fund that due to a new piece of legislature being voted on in Sac-ramento, he and others might lose their health plans.

Proposed by Sen. Connie Leyva (D-Chino), SB 1156 is an effort to deal with payments on premiums by third-party organizations in kidney centers and sub-stance addiction rehabilitation facilities. In a May 30 press release, Leyva stated that the bill “simply requires that pro-vider-funded groups follow disclosure requirements and certify that consum-ers do not have better options available to them.”

Dr. Michael Spigler, vice president of patient services and kidney disease edu-cation from the American Kidney Fund, said the bill does the opposite of protect the patient. Instead, Spigler argued that the measure would have allowed insur-ance companies to deny insurance to patients by refusing premium payments from charitable organizations.

During an Assembly Health Committee

meeting on Tuesday, the bill was amend-ed to allow for payments from groups like the American Kidney Fund.

“Sick patients of any kind—dialysis pa-tients or otherwise—are expensive and Blue Cross and Blue Shield and other in-surers obviously don’t want these patients on the books,” Spigler said last week be-fore the amendments. “So this is the new way of getting these sick patients off the rolls.”

Blue Cross and Blue Shield of Califor-nia both support the legislation. Another group to throw its endorsement behind SB-1156 has been the Service Employees International Union-United Healthcare Workers West (SEIU-UHW). Sean Wher-ley, spokesman for the union in Los An-geles, said the measure was necessary, as patients on dialysis automatically qualify for Medicare, for which dialysis providers then receive $30,000/year. Private plans, however, bring them up to $156,000/year. Stuck in the middle, Wherley said, are the patients, who often lose this coverage af-ter receiving a transplant.

“It is simply to insure that these pa-tients continue on the health insur-ance that they have,” Wherley said. “And should they get a transplant, they would continue to get their insurance through whatever providers.”

Despite these claims, however, crit-ics remain worried by SB 1156, even with amendments made to the bill. This in-cluded the possible consequences for pa-tients’ access to dialysis treatment.

“At the same time, we have serious con-cerns about this bill because of unintend-ed consequences it may have for patients’ access to dialysis care,” the fund said in an official statement. “And it is imperative that the Assembly carefully analyze the potential ramification of this bill before it comes to the Assembly floor.”

The bill is expected to go to a vote in August.

Farmers at odds with grocery giant

A decision by the nation’s largest gro-cery chain to extend to 90 days its pur-chase payments to all its suppliers has raised the ire of farmers across much of California.

The dispute stems from The Kroger Company’s recent letters to its suppli-ers stating that starting Aug. 1, it would end its policy of paying those suppliers within 30 days and instead make the payments in 90 days.

In one letter, the company states the change is intended to smooth the com-pany’s cash conversion cycle, allow it to more effectively manage its working capital to re-invest in the business and to “harmonize our terms with industry peers.”

But two groups representing large numbers of California farmers are ob-jecting to the actions of Kroger, which in California operates FoodsCo gro-cery stores, including those in Hanford, Fresno and Tulare.

“Farmers are in business as well, and farmers have their own banks to deal with on different loans, and they have their own payment plans, and to change this business model – especial-ly for our commodities in the middle or early portion of the season -- that doesn’t work for us,” as waiting up to a couple of months extra to receive pay-ments for their goods could be difficult or impossible for some farmers to man-age, said Ian LeMay, director of mem-ber relations and communications for the Fresno-based California Fresh Fruit Association.

is going to be opposed to any increase in sales tax -- big, medium, small, what-ever.”

Brand announced on Monday his plan to present his proposal during Thursday’s Fresno City Council meet-ing as a ballot initiative in which voters would decide whether to impose the half-cent increase on each dollar of all retail sales in the city.

Brand told reporters on Monday that his tax initiative proposal is intended to raise additional money for public safety and parks.

That meeting occurred after press time, so it wasn’t known at the time of this newspaper’s publication wheth-er the council voted on the proposal, which needed yes votes from five of the members to make it onto the ballot.

“If this measure is supported by at least two-thirds of the voters, it will raise between $44 and $50 million a year to support public safety and parks,” Brand told reporters on Monday, adding that the tax would sunset after 15 years.

“Half the money would go to pro-viding our residents with outstanding police and fire services,” which would include hiring 150-200 new police of-ficers, firefighters and civilian support staff.

Police Chief Jerry Dyer said the city needs extra dispatchers, because they often are backed up with calls – par-ticularly during the summer -- leaving some 911 callers waiting longer than the goal of getting their calls answered in at least 15 seconds.

“It will improve our 911 response times for police, fires and emergency aid,” Brand said of the extra funds.

Part of the money also would be used to upgrade “an aging communications system that has failed at times,” he said.

“Most importantly, it will allow us to go after 20,000 gang members that plague our cities … and finally imple-ment community-based policing.”

The other half of the money would be used to implement most of the recom-mendations of the city’s Parks Master Plan, which would include replanting and “re-outfitting” Fresno’s existing parks and making “relevant, modern facilities.”

In addition, he said the sales tax money would allow Fresno close its $5 million annual gap in paying for main-tenance of its current parks, fund pro-grams for youths and seniors and allow the city to develop new parkland, Brand said.

Mark Schultz, general manager for Harris Mazda-Volvo of Fresno, ex-pressed admiration for Brand’s goals to

improve public safety and parks in the city, but he said he was surprised that Brand – a Republican and fiscal conser-vative – would suggest a tax increase.

For his part, Brand said that per cap-ita Fresno residents are relatively poor compared to other urban areas of Cali-fornia, so current tax rates have fallen short of funding public safety and parks to the levels where they should operate.

And while growth is occurring and new, higher-paying jobs are coming to Fresno with Amazon and other busi-nesses establishing or expanding op-erations, the tax is intended to fill the shortfall until those new jobs and busi-ness activity can generate comparable added income for the city.

He added that his office has done some polling that showed voters would support a sales tax increase to support public safety and parks, and he hoped to get the Fresno Chamber of Com-merce on board to support the ballot initiative.

“The Chamber has yet to take a posi-tion on any proposed local tax initiative that could appear in November’s bal-lot. We will hear more information on the proposals in the coming weeks, so-licit input from our members and then make a decision on a position if and when appropriate,” Nathan Ahle, presi-dent and CEO of the chamber, said in an email to the Business Journal.

For his part, Schultz, who also is vice president of the Fresno Clovis New Car Dealers Association, said he wor-ried about the potential negative ef-fects even a small tax hike could have on businesses here – particularly those selling cars and other big-ticket items.

In the case of the car industry, raising Fresno’s current 7.95 percent sales tax to 8 percent would add $125 to price of a $25,000 car.

While that isn’t a lot, Schultz said a new tax combined with the added cost to operate cars due to California’s in-creased gas tax – which may be chal-lenged in a separate, state-wide ballot initiative – and added California De-partment of Motor Vehicle fees could have a cumulative effect in prompting people to back off from buying cars, a particularly likely scenario in the Val-ley, where salaries generally have been stagnant.

“Even though it’s a relatively small amount, on large-dollar purchases, it could add up to hundreds of dollars,” he said of the various added costs.

“And California already has some of the highest sales taxes in the country,” said Malkasian, adding that even a small bump in sales tax could be enough to tip the balance of whether people buy

some items.“It’s pretty easy to avoid that by going

down the road,” and shopping in a city with a lower sales tax rate, he added.

But Jacob Cisneros, owner of the newly-reopened Herb Bauer Cycling at Blackstone Commercial Plaza in Fres-

no – which he bought and relaunched June 1 with its old name after the larger parent company, Herb Bauer Sporting Goods, went out of business – disagreed that a half-cent sales tax would drive business to other communities.

He noted that several nearby cit-ies have higher sales tax rates, and the California Department of Tax and Fee Administration confirmed several Val-

ley cities have rates higher than 8 per-cent, including Reedley, Selma, Madera, Corcoran, Sanger, Huron and all seven cities in Tulare County.

In addition, Cisneros said, “I don’t think people use that to save money – going out of town” to shop, as the cost of the gas alone might eliminate any sav-ings.

As such, “I don’t think it’s going to

affect my bottom line” if the tax hike makes it to the ballot and voters ap-prove it, he said.

And having that added money to im-prove parks likely would help his busi-ness, as bike riders like having access to good, outdoor space, Cisneros noted.

Sanger, Culter-Orosi, Dinuba, Men-dota, Kings Canyon, and Firebaugh-Las Deltas unified school districts.

State Center Community College District Chancellor Paul Parnell, Ph.D, said that $3 million has been raised so far. This money has been raised both through state grants and philanthropic efforts. Parnell and others hope to add Clovis Community College and the Clovis Unified School District to the program as part of Phase 2 next year as

they expand—and in time—go beyond one semester.

“So our promise program is to raise money and having endowments, so that this isn’t just a one-year deal—that we have enough money in endow funds ev-ery year,” Parnell said. “And we’d like it to be Valley-wide.”

The first students on the Promise program are expected to begin next semester. Fresno City College presi-dent Carole Goldsmith, Ph.D, said that it amounts to approximately 800 stu-dents.

“It’s been a lot of work—kind of like

agriculture—you have to till the land, you have to treat the land, then you have to plant,” Goldsmith said. “So now we’re just starting to see some buds grow.”

Students are first informed of the Promise program in the sixth grade. In order to qualify, students must meet several requirements. This includes ap-plying for community college in their senior year and graduating from high school with a 2.7 GPA or higher. They are also required to fill out their Free Application for Federal Student Aid (FAFSA) forms and perform community service.

There are further expectations to have either their general education re-quirements for college met or to have made progress toward a vocational ca-reer. Applicants must also have mapped out a Student Educational Plan.

Fresno State University President Jo-seph Castro is the current chair of the program’s executive committee. The university is also a partner in the Prom-ise program.

But before that fight begins, some in-volved in California’s ag industry have suggestions on what lawmakers should include or alter in their final bill, among them, Josh Rolph, manager of federal policy for the California Farm Bureau Federation.

“Overall, I think both [bill versions] are net positives for California. We knew that this is a more stringent budgetary time, and there was a lot of fear that pro-grams that benefit California would be on the chopping block, but we are pleas-antly surprised that California interests have been mostly preserved,” he said.

“We did like the Senate version. There were priorities that we had that the Sen-ate bill lined up with California Farm Bu-reau interests,” which included funding to cover grants to pay for research to de-velop mechanized farming equipment, which Rolph said is vital, as farmers need machinery to replace human farm laborers who are in short supply.

Rolph noted that Valley farmers should be happy that the House bill would pre-serve the Environmental Quality Incen-tives Program, which incentivizes and encourages efforts to preserve water and air quality.

Among the trade programs preserved in both bills is the Market Access Pro-

gram, which provides support for brand-ing and promoting U.S. farm products in overseas markets, despite the program’s opposition by some conservative mem-bers of Congress, he said.

“We continue to be happy to see the funding that was included for invasive pests and disease, “ said Ian LeMay, di-rector of member relations and commu-nications for the Fresno-based Califor-nia Fresh Fruit Association.

He said his organization also is happy that there were no dramatic cuts to the overall Farm Bill. “The farm bills are ba-sically working with the same amounts of money we saw in the 2014 Farm Bill. The continuance of the funding was im-portant.”

“If we focused on regulatory reform, the House Farm Bill wins, above and beyond. The problem is getting that through the Senate, because it’s a long shot in the Senate,” as reaching the 60-vote threshold there to pass a final bill is impossible without support from Dem-ocrats, Rolph explained.

“One of the biggest problems – and we’ve been raising it for years – is the definition of ‘rural’” used by the U.S. De-partment of Agriculture that keeps a lot of rural development funds for housing, broadband, water and other program out of some communities in the Valley and other parts of California, he said.

The reason, Rolph said, is because “we

are in the unique position of having ex-ceptionally large counties.”

In fact some counties in the Valley are larger than some of the smaller states.

“If a city in a county is over a certain population, then you immediately dis-qualify your county” for federal aid ear-marked for rural aid, with the city of Fresno being an example of a disquali-fier for Fresno County, Rolph said.

He said that problem wasn’t addressed in the two farm bills because California is the only state raising objections, “and politically, it’s been a challenge.”

The California dairy industry has its own concerns with both bills, most no-tably that a federal insurance program favors smaller dairies that largely don’t exist in this state.

On average, California dairies need to be large to operate effectively here, with an average of about 1,200 cows, said Lynn McBride, executive director of the California Dairy Campaign and the Cali-fornia Farmers Union.

She said the 2014 Farm Bill, currently in effect, established the Dairy Margin Protection Program, a insurance dairy operators could pay premiums into to be reimbursed if the prices they pay for feed exceed the amounts paid for their milk.

The problem is that dairies produc-ing 5 million pounds of milk or less a year – equivalent to the production of a

230-cow operation – pay low premiums while dairies producing more pay about 10 times more, McBride explained.

“So it’s not affordable. So it just doesn’t fit for California,” she said, adding that those farmers who have used the insur-ance here ended up paying out more than they got back after filing claims.

McBride said the insurance could be vital here, because since late 2014 the dairy industry has contended with milk prices most often being lower than the cost of milk production.

The state-set price paid to Califor-nia dairies for their milk was $13.60 per hundredweight – 100 pounds – in April, well below the $18 per hundredweight average cost to produce it, she said.

“Neither the Senate nor the House bill is going to improve the situation for California,” though the Senate version at least would reimburse California dairies the premiums they’ve paid into the pro-gram, McBride noted.

The bills also lack provisions for a na-tionwide plan to manage milk produc-tion, which would help milk pricing, she said.

Whatever provisions end up being contention points for the Senate and House members in conference, the farm industry hopes they can work them out quickly because they’re up against a Sept. 30 deadline to have a final. Farm Bill for members of both branches to vote on and, if both pass, send to the president.

If they miss the deadline, the legisla-tors would have to approve a one-year extension of the 2014 Farm Bill, and if they couldn’t agree to do that, the 1949 Agricultural Act would take effect, which Rolph said would likely raise prices for consumers and wreak havoc on the agri-cultural market.

“We would hope that the bill that does pass is bipartisan. The Senate followed that approach. Unfortunately, the House did not,” resulting in the largely Repub-lican House approving a largely conser-vative bill that may get pushback from Democrats in the Senate, he said.

“But maybe at the end of the day, the Republicans and the conservatives in the House have the upper hand with the president,” who has pushed the conser-vative agenda and may support a more conservative Farm Bill, Rolph noted.

Adventist Health expected to run Tulare hospital

The Tulare Local Healthcare District Board of Directors is expected to vote on Thursday on proposals by area hospitals to open and operate the shuttered Tulare hospital.

Sources say only Adventist Health has offered financing as part of their re-sponse. The Tulare District board has asked the potential partner hospital to open the 112-bed medical center by late October, before their state permit expires.

The hospital closed its doors last November.Adventist Health has locations in Selma, Reedley and Hanford.To sweeten the deal, Tulare would follow up by offering Adventist a long-term

lease of the complex once negotiations were complete. Local voters would have their say before any final deal. The three other hospitals – Kaweah Delta, Commu-nity Regional Medical Center and Dignity Health-Bakersfield decide not to invest the requested $22 million. No word yet how much Adventist might offer.

A special Board meeting will be held tonight at 6:30 in the City Hall chambers in the Tulare to hear Adventist Health’s proposal. Community Medical Centers has also been invited.

The Visalia Planning Commission has approved a revised conditional use permit to allow construction of a four-story hotel off Plaza Drive and Highway 198.

Under the amended application, the 86-room Hilton Home 2 Hotel would be part of the 25-acre Square at Plaza Drive just north of the freeway, an area that already has a hotel and an ARCO AM/PM convenience store and gas station under construction and already includes two car dealerships and a Fresno Pacific University satellite campus.

The new hotel’s architect, Steven L. Keike, had requested the Planning Commission al-low a change in the location of the building to the northwest corner of North Plaza Drive and West Crowley Avenue, and the commission on Monday approved it.

In a separate matter, the members also voted to approve a conditional use permit allowing Brandman University to build a new, 7,071-square-foot building for classrooms and administrative space near the Square at Plaza Drive, within the Plaza Business Park.

Brandman officials intend to vacate the 18,240-square-foot building they now occupy in the Visalia Marketplace Shopping Center, next to the city’s Kmart department store, and move into the smaller site, according to a Planning Commission report.

G O V E R N M E N TAnti-gas tax measure to appear on ballot, activists say

An effort by California conservatives to repeal a recent increase in gas taxes and vehi-cle registration fees ramped up Monday as the supporters turned in more than 940,000 signatures to put the question before voters in November.

The signatures were submitted days after California transportation officials pre-emp-tively fought back, announcing billions of dollars in mass transit improvements funded in part by the tax hikes. It sets up an election showdown over the condition of California’s roads and its high gas prices.

The initiative is a key part of the 2018 election strategy for Republicans, who face the prospect of having no candidates for U.S. Senate at the top of the ticket and Democrats being highly motivated by opposition to President Donald Trump. Much of the funding for the initiative has come from the California Republican Party and members of the con-gressional delegation.

The initiative would repeal SB1 and require voter approval for any future gas taxes or vehicle registration fees.

A Public Policy Institute of California poll in January found that voters were deeply di-vided, with 47 percent supporting repeal and 48 percent opposed.

L E G A LVacancies looming in federal judgeships

Federal judges from the Eastern District of California penned a letter to the United States Senate and House of Representatives regarding what they call an upcoming crisis in the number of judges on the bench and their caseloads.

The federal court, made up six district judges, three senior judges, 12 magistrate judg-es and six bankruptcy judges are not enough to handle the growing population of the Eastern California district, according to the letter’s author, Chief District Judge Lawrence O’Neill.

Eastern California has in its boundaries 8 million people and has grown 220 percent in population since the last new judgeship was created in 1978. It oversees 55 percent of the land in the state and 34 of the 58 counties in California.

Judges handle a typical caseload of 900 cases at any given time, according to the let-ter, which is already twice what the national average.

The problem will be compounded when two of those six judges retire in the next 19 months, as they have announced.

Additionally, one of the three senior district judges has announced that he will step down.

This could potentially mean 2000 more cases would need to be distributed among the remaining four judges, meaning 500 more for each of them.

With this in mind, when the two retiring judges write their letters of coming resigna-tion, they will be asking President Donald Trump for an expedited nomination and con-firmation process for a seamless transition.

The district judges are also requesting that congress introduce an emergency bill to create a minimum of five new judgeships.

Couples who don’t have children tend to have more financial flexibility to pursue their own goals throughout life and in retirement. But this flexibility doesn’t mean they don’t need to manage their future financial health and legacy needs.

If you’re child-free and preparing for retirement, here are five steps to get you started:

1. Prioritize saving for retirement

Since you’re not facing the costs for childcare and educational institutions, consider doubling-down on saving for retirement. You have the potential to spend decades in retirement pursuing your hobbies and goals, so calculate what it will take for you to live the lifestyle you want and compare it to your current savings. Create a plan to save the difference.

Consider contributing as much as you can to your workplace savings plan, if you have one, and consider building up Roth IRA savings to help create a source of income that’s potentially tax-free in retirement.

2. Recognize your long-term care challenges

Long-term care can be a challenge for anyone as they age, and there’s added complexity in situations where you may not be able to rely on family members to step in to help. Regardless of your situation, make it a priority to decide how you will manage healthcare costs in retirement.

Medical expenses continue to rise, so it’s important to have adequate savings and insurance coverage. Explore your options through Medicare and your current or former employer and consider if long-term care insurance would benefit you. Additionally, consider researching caregiving options and long-term care facilities in your area so that you are familiar with the choices, if you need them down the road.

3. Prepare for medical careBefore you experience a significant

medical event -- which can happen at any time -- make sure to have in place an

advanced directive, also known as a “living will.” This document lets your spouse, extended family and friends know your preferences for treatment and gives you the opportunity to designate a healthcare power of attorney. This person will be empowered to make decisions on your behalf, if necessary.

4. Have financial decision-makers in place

It’s also important to designate a spouse, friend, extended family member or professional to look out for your financial interests, if you become incapacitated. Draw up documents to name a durable power of attorney to oversee your financial matters, including legal and tax concerns if you’re unable to do so. Keep in mind that choosing someone to help watch out for you doesn’t mean you have to share your full financial situation and account numbers. Rather, a common approach is to share enough information so that the contact can step in, should

a situation arise where you need help making financial decisions.

5. Plan your legacyWith no direct heirs in line to inherit your

estate, you will want to consider what you’d like your legacy to be -- including how your assets should be distributed upon your death. You may choose to leave your estate to any combination of family members, friends, charities, education institutions or other causes that are important to you. Creating or updating your will is one of the best ways to articulate your wishes.

Also consider using trusts, which sometimes allow more flexibility than a will, to help you meet specific legacy goals. Consult with a financial advisor, attorney and tax legal professional to develop a comprehensive legacy strategy that suits your ultimate goals.

The nature of business is changing, and, not surprisingly, so are workspaces in old and new businesses.

Instead of the familiar bullpen office setup where several desks and cubicles are centered in a room and private offices line the perimeter, companies are opting for more open-office concepts that encourage employee collaboration and provide working space that employees can enjoy.

Employers are trying to create workspaces that facilitate workflow, communication and efficiency, while also providing environments that reflect the values and cultures of their companies.

The shared office space is a growing trend and, according to a study conducted by the online statistics portal Statista, in 2017, 7,800 co-working spaces were built in U.S. companies, and that number is expected to increase to 37,000 in 2018, the website states.

One company involved in constructing these new types of office spaces is SIM-PBK Architects, a Fresno-based architectural firm.

John Smith, a founding partner in the firm, said that these days there’s more team collaboration across all industries, and companies are trying to promote that.

The office has large windows to allow in natural light with single desks and long tables in the middle for collaboration,

and a modern architectural design. “These days, there’s just a lot more

collaboration than five to 10 years ago. There’s more team project based learning,” Smith said. “To promote that, we’ve got a big, open space.” Creating an organic feeling

Another important facet in new office design is the utilization of technology, as Smith said most new or renovated offices are going wireless, while also having more large monitors and interactive computer projections on the walls.

These new spaces also are intended to effect workers emotionally, creating organic feelings among employees to want to be there.

“To try and create something that feels a little more residential is also a very relaxing feeling to give your employees, and that helps productivity and makes it a more fun place to be,” Smith said. Touchdown space

Clay Davis, a senior partner at TETER Architects & Engineers in Fresno, said businesses are putting more conference rooms in their office spaces, as well as “touchdown space,” usually a presentation room or a collaborative area used as a temporary work space for employees working from their homes and other sites who occasionally come into the office.

Employee retention is important for any company, Davis said, and companies want to invest in a work environment that will make employees want to come to work, while also fostering creativity and productivity,

cultures they agree with, and they’re attracted to businesses with offices using the newest technologies. Attracting talent

“To attract the young talent, you’ve got to show that you’ve got that flexible technology and that you’re up to speed on all the current technology,” Davis said. “If you’re interviewing candidates to come work for you, and as they walk around and see what you have to offer, if you’re using old-school technology, they’re probably more apt to go work for the firm that is more current.”

At Facility Designs, a full-service interior design firm, account executive Cassie Weibert said office features her clients want include sit-stand desks that allow employees to stand or sit while they work, as well as large windows to provide natural lighting and give all employees views of the outside. All businesses have a story to tell, said Carrie De Young, director of operations at Facility Designs, and business owners can tell their stories with the workplaces they create.

“That story is different for every client, and that’s up to the client to share with us, and we are just walking them through. That story may be for their customer, their team, but an important part of that is that the team wants to come back every day,” she said.Some workers push back

But open-office concept isn’t for everyone, as there has been some pushback from office workers 30 years old and older, Davis said, explaining that many people still see the corner office or the individual office as a status symbol and yearn for more privacy.

A study by the Finnish Institute of Occupational Health concluded t h e r e a r e n e g a t i v e e f f e c t s f r o m working in open spaces that include increased distraction, reduced privacy, increased concentration difficulties, and increased use of coping strategies including taking more breaks.

The open-office concept gained more popularity as an economic move than for employee comfort said Tom Zimmerman, president of CORE Business Interiors, an interior solutions firm in Fresno.

“It’s not a working environment where most people want to work; it’s an answer to escalating real estate prices and cramming as many people into a space as you possibly can,” he explained.

As such, some companies have concluded that employees being in a state of constant interaction might not make them the most productive, and they’re trying to make workspaces that find balance for employees that might need to do collaborative work and those who might need more privacy, Zimmerman explained.

Zimmerman said that with the current business expansion going on in Fresno and the rest of the Central Valley, more companies will continue to work on their office spaces.

“Anyone who is in the building industry is already seeing a lot of work. It’s going to continue to mature, and as long as people are moving into the Valley, then there is growth.”

Tell us about the histories of your hotels: Both hotels were built and are owned by the Patel family from Alamo, Calif. Mr. Patel opened the Lemoore hotel in November 1995 as a 60-room Holiday Inn Express. In 2003, he added 40 rooms before converting the hotel to a Best Western in 2006. The Patel family continued to invest in Kings County by developing and opening the new 87-room Home2 Suites by Hilton six months ago in Hanford. What is your history with the organization and how did you reach your current position? I came to work for Mr. Patel in 2003 and assisted with the 40-room addition and complete hotel renovation. I also contributed to the successful conversion of the property to a Best Western.  My passion for hospitality started a few years earlier, when I worked at the Sheraton Crescent hotel in Phoenix. In my current job, Mr. Patel gave me a great opportunity to be involved in the development and opening of the Home2 Suites by Hilton. Today, I oversee both of his hotels in my hometown, and I’m still grateful. What is your role at the hotels? Day to day, I oversee the hotels’ operations, which includes training, scheduling and supervising 47 employees and 187 rooms. Both hotels are open 24/7 and also provide ample, free breakfasts. So I’m not just behind a desk all day. There’s always an issue with a guest, an employee, a broken pool pump, or a shortage of bananas. It keeps me on my toes, as no two days are ever the same. It’s never dull and never boring. What was the best business advice you ever received and where did it come from?I work in hospitality, and it’s the most service-oriented industry. We must please and appease our guests daily. I often reflect upon the words of British entrepreneur Sir Richard Branson: “Clients do not come first. Employees come first. If you take care of your employees, they will take care of the customers.”He’s right. Who or what has been the biggest influence on your career? My biggest professional influence is my current boss and owner of the two hotels I manage, Mr. Jay Patel. I have had the pleasure of working for him since 2003, and I have learned such a great deal over the years, from how to read architectural plans and be cost-conscious, to creating and managing a budget and being fiscally responsible.  More than that, I really admire the way he treats people, especially his employees. He has not only invested in our communities, but he has invested in me. It is an honor and privilege to work for him and the Patel family. What are your roots in the Central Valley?  I moved to the Central Valley from Hawaii when I was in the sixth grade and have lived here ever since. My family is here, and my kids are growing up here. I am proud and lucky to be able to make my professional home here, as well.

 Kings County is experiencing an economic boom. What’s driving that, and how is the upturn affecting the hotel and service industries there? Thankfully, a number of businesses and industries have come to Kings County recently, including the Kelly Slater Surf Ranch near Lemoore, along with electric car startup Faraday Future, German-based supermarket chain ALDI and a commercial center developing around the new Costco, all in the Hanford area. There has also been growth in the number of personnel the Naval Air Station. Candidly, this has been great for my hotels. We have been busy, which is always good, but we also have the pleasure of serving a wide demographic and variety of guests from all across the state, the country and the world. What tips do you have for travelers staying at hotels? DO: Book with the hotel directly or use the hotel’s branded website, as third-party, online travel sites charge hotels a commission on each room night they book, so their rates often can be inflated.DON’T: Wait until the last minute to reserve your room. The hotel industry mirrors other aspects of the travel industry in that the earlier you book, the cheaper the rate -- with the exception of special events and promotions.DO: Mention any special requests or needs at the time you make your reservation. Melanie Marlow joined M.D. Manouel in Fresno in May as a senior commercial lines account manager. While working her way up in the insurance industry she graduated with her Bachelor of Science in business management from Phoenix Uni-versity and received her Associate of Arts in Criminal Justice from San Joaquin Valley College. She heads the SBU department with 10-plus years of insurance experience. The United States Small Business Ad-ministration has named George Flores the new deputy director for its Fresno District. With extensive community service experience in the San Joaquin Valley and a strong leadership background, Flores will assist in the delivery of SBA services throughout the Central California and Central Coast’s 15-county region. “George will provide leadership to the SBA Fresno team that supports Central California’s continued growth through entrepreneur-ship development, small business expan-sion, and job creation,” said Fresno District Director Dawn Golik. As Deputy District Director, Flores will also advocate for the region’s entrepreneurs, expand access to SBA programs in rural and underserved communities, increase the utilization of SBA services across 15 central California counties, and supervise staff in the Fresno District Office. A graduate of California State University, Fresno, a first lieutenant (retired) veteran in the Army National Guard, and recipient of a Bronze Star for combat service in Iraq, Flores has had a distinguished 26-year federal government career. Flores previously served as the Chief of Police with the Veterans Affairs Central California Healthcare System and was recognized as a Veteran Honoree for Memorial Day 2016. The city of Clovis is trying to fill a vacancy in its planning commission, which acts as an advisor to the city regarding land use goals and plans. Any residents of Clovis are invited to apply where they will interview with the mayor and serve for a four-year term. As a commission member, appoin-tees are responsible for reviewing General Plan amendments, evaluating rezoning applications approving conditional use permits, tentative maps and variances. modities Act (PACA)” the association’s president, George Radanovich, stat-ed in a press release.

PACA is a law from the 1930s in-tended to prohibit unfair trade prac-tices in the sales of fruits and vegeta-bles, as well as to assure that sellers are paid promptly.

Radanovich’s statement goes on to describe PACA as “an act created specifically to protect the perishable fresh fruit industry. We are very dis-appointed with Kroger’s decision.” 

On its website, Western Growers states that if growers agree to allow payments after 30 days, they forfeit all their PACA protections.

“The produce industry supply chain has benefitted from the trust provision since 1984,” Irvine-based Western Growers’ statement con-tinues. “Any shipper’s best busi-ness practices mandate that you not waive trust rights, regardless of who may be requesting the waiver. Also, if you have outside growers, you will remain liable to them for any non-payment. Based on those aforemen-tioned reasons, it is recommended that you contact Kroger about your concern with the new 90-day pay-ment policy.”

“We’re pushing back and saying this is a bad policy. It’s a law for a rea-son,” LeMay commented.

He added that Kroger has back-pedaled slightly, announcing that

individual agreements with quicker payment schedules could be worked out with some suppliers and then announced a deal through CitiBank “that basically, you’ll pay .72 percent on whatever your sale was to get paid immediately. So out of a million dol-lars, you would pay $7,200 to get your payment immediately.

“You see the ridiculousness in that,” LeMay said, adding, “That’s bad business, and it doesn’t make sense.

“It’s a law for a reason, and we don’t want to see people peel off and try to do side deals with Kroger.”

The Cincinnati-based grocery chain didn’t respond to an interview request.

“It is our understanding the Kroger [Co.] has expressed a willingness to be flexible with this new policy, but ‘flexibility’ in this matter won’t help,” Radanovich’s statement continued. 

“By this action, they have opened the door for other retailers to vio-late supplier rights protected by law. Our industry should not and will not stand for attacks like this.” 

LeMay added that “Kroger just needs to go back to the 30-day policy, and that’s where we’re at today.”

The proposed project would be developed in multiple phases with full build‐out anticipated in 2020. The 5.33‐acre project site is located in the City of Clovis, Fresno County, on the north side of Third Street, between Clovis Avenue and Osmun Avenue. The proposed project is a mixed‐use development consisting of community and public uses including a library. The county library would be moved from its current location in the Clovis Civic Center. The two primary objectives for the proposed project are to accommodate the community’s expanding needs for civic facilities located in central Clovis and optimize public transit, pedestrian, and bicycle access to the site.Environmental Determination: The City of Clovis (City) has completed a Draft and Final Environmental Impact Report for the Landmark Commons Civic Center North Project. New Zealand is four times more dependent on agriculture than the United States and it once maintained

extensive farm subsidies. In 1984, it ended them. What happened? Farm productiv-ity and earnings rose. The Federat-ed Farmers of New Zealand fought just as vigorously as their Ameri-can counterparts to preserve their subsidies. Yet in hindsight, the

same group now says that its experi-ence “thoroughly debunked the myth that the farming sector cannot pros-per without government subsidies.” In fact, it thrives.

It’s time to debunk that myth in our own country, but don’t hold your breath. Recently, my amendment to slowly phase out American farm subsi-dies over the next 12 years got just 34 votes in the 435-member House.

American agriculture is a tangled mess of price supports, insurance subsidies, commodity rules, quotas, bailouts, loan guarantees and other bureaucratic interventions that dis-

tort the price signals that are essen-tial to maximize productivity in any market. The result? Higher prices for consumers, higher costs for taxpayers and ironically, lower productivity for farmers.

Prices, if left alone, convey a wealth of information that consumers de-pend upon to make rational decisions. Those choices, in turn, direct all pro-duction to the greatest need and all in-vestment to its highest use.

The price of the cup of coffee that you bought this morning includes in-formation on political conditions in Columbia, weather forecasts in Costa Rica, currency rates of exchange, in-sect infestations in Brazil, bribery rates in Mexico, inflationary pressures and what the guy down the street is selling it for.

Your response to that price – to drink more coffee, less coffee, or shift to tea – sends signals back to producers of what consumers want them to pro-duce more of or less of.

When government interferes with the pricing structure, it corrupts the data that is necessary to ensure that every dollar in the economy is spent wisely. The cost isn’t just the agricul-tural subsidies paid by taxpayers, but the misallocation of resources that the subsidies are causing. The sugar sup-

port program alone is estimated to cost an average household about $30 in in-flated grocery bills annually.

When government plays this game, risks are masked, inefficiencies go un-detected and uncorrected, capital flows from productive to non-productive use and perhaps the most dangerous for a free society, producers pay less atten-tion to what consumers want and more attention to what government wants.

When that happens, the productive sector becomes increasingly depen-dent on, and beholden to, the govern-ment. Our political and economic sys-tems become riddled with cronyism, corruption and inefficiency.

In recent years, direct payments have given way to subsidized insur-ance. What is insurance? It is a way to put a price on the risk of any activity. If insurance is subsidized, the risk is dis-guised. We encourage behavior that our own common sense, as informed by high insurance rates, would other-wise protect us from.

In the agricultural sector, that risk may be choosing crops that the mar-ket is signaling it doesn’t want. In that case, the result of subsidized insurance is a glut of commodities consumers don’t want and shortages of those they do. High insurance premiums may be warning farmers not to plant crops in

regions ill-suited to them. Mask that cost and more crop failures result.

Because price signals are no longer being sent by the market’s consumers, but instead by government, it shouldn’t surprise us that those with oversized political influence make out very well. Small farmers who can’t afford lobby-ists don’t.

Some argue that because agricul-ture is at the mercy of the weather or foreign trade barriers, it is inherently more risky than other pursuits and thus requires “a safety net.” Yet 60 percent of American farms receive no subsidies and appear to do just fine. So do New Zealand farms. After all, every human enterprise faces unique risks and challenges which accurate pricing regulates and compensates.

American agriculture is too impor-tant to be consigned to the misman-agement of incompetent federal bu-reaucracies. By ending the subsidies and restoring the accurate pricing signals that a free market provides, the needs and wants of consumers can be better served. Taxpayers can be relieved of $20 billion of counter-productive costs. And producers can be freed from the gross inefficiencies that government command and con-trol systems invariably impose.

Just ask New Zealanders.

Farm Subsidies Make No Sense

Health Insurance: What to expect in the second half of 2018

Following the Facebook comments from former Tulare Mayor Carlton Jones criticiz-ing the agricultural industry, Tulare City Council voted him out to return as coun-cilman and named David Macedo the new mayor. Respondents to The Business Jour-nal’s weekly poll are split on whether Jones should have been recalled with 48 percent of respondents voting yes, and 45 percent vot-ing no. A total of 159 votes were cast.

Should Tulare Councilman Carlton Jones face a recall over his comments about agriculture?

The National Federation of Independent Busi-nesses has long supported affordable, flexible, and predictable health insurance for small business owners. We opposed the Affordable Care Act, and we continue to push for reform that brings small businesses cost relief.

The Tax Cuts and Jobs Act, which was signed into law in December 2017, gave meaningful tax cuts to small business owners. This law also included the eventual repeal of the individual mandate penalties, a provision in the Afford-able Care Act that required individuals to pur-chase health insurance or pay a penalty. There are additional changes coming down the pike in 2018 that small business owners must be aware of.

”NFIB continues to advocate for affordable, flexible, and pre-dictable health insurance op-tions for small business owners and employees,” says Kevin Kuhlman, NFIB’s director of legislative affairs. “While compre-hensive health care reform efforts stalled leg-islatively, NFIB achieved considerable legisla-tive victories regarding health care tax relief. These victories will lessen premium increases and provide relief from compliance burdens. At the same time, NFIB continues to work with the administration to increase access to affordable health insurance options.”

Here’s what you need to know about changes in health insurance rules for 2018 and beyond. 

Legislative ChangesAlthough the individual mandate penalties

were repealed with the passage of the Tax Cuts and Jobs Act in December, they will continue to be enforced through 2018.

Three Affordable Care Act taxes have been suspended or delayed. The annual fee on cer-tain health insurance providers, which is in ef-fect for calendar year 2018, has been suspend-ed for 2019. It is scheduled to return Jan. 1, 2020.

The Cadillac tax is a 40 percent excise tax

levied on high-cost employer health insurance plans that has never been implemented due to a previous delay. It is currently delayed until Jan. 1, 2022.

The medical device tax is a 2.3 percent excise tax that is levied on the sale of medical devices. It will be delayed until Jan. 1, 2020.

Regulatory UpdatesPresident Trump signed an executive order on

Oct. 12, 2017, requiring agencies to issue regu-lations to expand access to association health plans, short-term limited duration plans and

Health Reimbursement Arrange-ments.

The final regulations expand-ing AHPs and short-term limited duration health insurance are expected this summer. The pro-posed regulation expanding HRAs is also expected this year.

The AHP regulation proposes to permit small business owners, their employees, sole-propri-etors and other self-employed individuals to band together as a single large group to pur-chase insurance. As proposed, the regulation would allow broad-based business associa-tions to offer metro- or state-based plans and industry-specific groups to offer national plans.

The employer mandate—an ACA requirement for employers with 50 or more full-time or full-time equivalent employees to offer affordable and adequate health insurance to their full-time workers or face fines—will continue to be enforced. Enforcement for 2015 is ongoing, and enforcement for 2016 could begin later this year. The fines for 2018 increase to $2,320 per em-ployee for non-offering employers and $3,480 per employee for offering employers whose em-ployees are not offered affordable coverage.
