UKAS ASBESTOS INSPECTION BODIES The Great British Asbestos in Buildings Survey 2011

IntroductionIn 2011 Asbestos Inspection Bodies (AIB) embarked on the Great British Asbestos Survey. The Asbestos Inspection Bodies initiative is a collaboration project which highlights UKAS Accredited organisations as the first choice for companies who have to commission surveys for asbestos.

The initiative is sponsored by UKAS Accredited Organisations in the UK who have the necessary training and experience in all aspects of survey work including survey planning, resources, technical specification, quality control and ACM assessment criteria.

The purpose of the survey was to collate information of the level of knowledge and awareness of those not working within the asbestos industry but those that are impacted by asbestos and have a duty to manage buildings that contain asbestos or employees who may encounter asbestos as part of their works.

The survey was uploaded onto the AIB website (www.asbestosinspectionbodies.co.uk) and advertised so that anybody that asbestos has an impact on as part of theirs works was invited to complete the survey.

The survey had 6 different response types as follows:-

Response Type 1 - I undertake the building repair and maintenance within our organisations building(s)

Response Type 2 - I am responsible for hiring and/or controlling building maintenance and repair activities within the building(s) I manage/control

Response Type 3 - I am responsible for arranging for my organisations building maintenance and repair staff to visit our clients premises to undertake repair/maintenance works on their building(s)

Response Type 4 - I visit other peoples commercial buildings to undertake building maintenance and repair activities

Response Type 5 - I visit other peoples residential buildings to undertake building maintenance and repair activities

Response Type 6 - I am a non-domestic property Occupier

The survey was kept open for approximately 6 months to give an ample opportunity for people to complete the survey. Over this period 620 people completed the survey.

Executive SummaryIn 2011 Asbestos Inspection Bodies (AIB) embarked on the Great British Asbestos Survey to collate information of the level of knowledge and awareness of those not working within the asbestos industry but those that are impacted by asbestos and have a duty to manage buildings that contain asbestos or employees who may encounter asbestos as part of their works.

The response targeted 6 different groups of people that asbestos impacts on their duties and responsibilities. The survey demonstrates that there are varying degrees of understanding, knowledge and training of the requirements of the Control of Asbestos Regulations 2006, superseded by the Control of Asbestos Regulations (CAR) 2012 on 6th April 2012.

Regulation 4Under Regulation 4 of CAR 2012 the dutyholder must ensure a suitable and sufficient assessment is carried out as to whether asbestos is or is liable to be present in the premises and if asbestos is present a written plan detailing how the risk is to be managed.

On average 68.32% were aware of the duty to manage asbestos but 31.68% were not. The duty to manage has been in place since May 2004 and we would expect a much higher proportion to be aware of this.

Only 62.8% of those responding termed as Duty Holders have an Asbestos Management Plan in place for their buildings with 73.6% reviewing the Management Plan outside of the 6 months guidelines detailed within the ACoP.

Regulation 5Under Regulation 5 it is the duty of the employer to undertake a suitable and sufficient assessment for asbestos prior to any works which will or is liable to expose his employees to asbestos. Also there is an obligation to inform any person liable to disturb ACM’s about the presence and condition of such materials.

100% of dutyholders stated they provide asbestos information to visiting contractors and 82.8% of contracting companies stated that they request asbestos information from their clients, howeveronly 60% those attending commercial buildings stated that asbestos information is received. Within residential buildings this is substantially lower at less than 40%. 34.7% of contractors visiting sitesstated that they have disturbed asbestos during their works with 25.76% not knowing if they have disturbed asbestos. These are concerning figures considering Regulation 5 is in placeto prevent personnel disturbing asbestos on site.

Regulation 10Under Regulation 10 all personnel that could disturb asbestos during their routine activities must undergo asbestos awareness training that is refreshed annually.

Of the respondents approximately 75% had received awareness training with 25% not receiving any awareness training at all.

Asbestos Survey QualificationsWithin HSG 264 it states that the use of a UKAS Accredited organisation is strongly recommended and details the qualifications and competence for surveyors and survey companiesAcross the people questioned 76.14% are aware of the requirements for surveys to be carried out by qualified personnel and of those commissioning surveys only 76.3% had surveys conducted by UKAS Accredited organisations.

Overall it would appear that many commercial businesses have asbestos management procedures in place but there are some significant gaps in terms of knowledge of responsibilities, provision of information and training and this is demonstrated by the number of people that have confirmed that they have disturbed asbestos during their activities. For Residential buildings the management of asbestos doesn’t seem to be as strong and although Regulation 4 is not applicable to residential buildings the other regulations are.

For surveys there is still approximately 25% not being completed in line with guidance and this can lead to poor surveys, a lack of comeback in terms of complaints procedures and insurances and ultimately could increase the risk of personnel being exposed to asbestos where not identified properly.

It is clear from the survey that although some progress has been made in raising awareness of asbestos management procedures and getting personnel trained there is still a large amount of work that needs to be done to ensure people are not exposed to asbestos.

Main Findings

Throughout the 620 people who completed the questionnaire the level of awareness and knowledge regarding asbestos is high although there are still some areas of concern with regards knowledge and awareness gaps.

Response Type 1 - I undertake the building maintenance within our organisations buildings79 people responded to this response type answering 10 questions. This response constitutes maintenance and estates staff working within their employers’ buildings.

• 57.3 % felt they have a good understanding of asbestos with 29.4% stating they knew enough to get them by and 13.2% said they were not asbestos aware at all. • Over the last 4 years 38 people said they had received awareness training and 37 said they had not

received any awareness training at all. • Although 67.3% had been provided with asbestos information about their building 23.1% had received

no information • 40.4% of the people completing the questionnaire had disturbed asbestos during their works, 38.5%

had not disturbed asbestos with 21.2% not knowing. • 59.6% of personnel stated that asbestos was clearly marked within their buildings or they are

provided with drawings. • 53.8% knew that to undertake an asbestos survey an individual or company needed asbestos

qualifications. 23.1% stated that it was not required and a further 23.1% did not know.

Response Type 2 - I am responsible for hiring and/or controlling building maintenance and repair activities within the building(s) I manage and control185 people responded to this response type answering 18 questions. This response constitutes Estates and Facilities Managers within buildings that they manage and control.

• 89.1% are aware of their duty to manage asbestos with 10.9% not aware of their duty • 52.9% of those responding are defined as being the duty holder or nominated deputy • 76.4% of personnel have an asbestos management plan in place for their building(s) with 18.4% who do not and 5.2% who do not know • Only 9.8% of people review their management plan in line with HSE guidance every 6 months with

57.5% reviewing annually and 16.1% who never review it • Although 79.3% of those responding have an asbestos survey for their building, 15.9% do not and 4.9%

• 76.3% of surveys completed were conducted by UKAS accredited organisations and 71.3% of all surveys are re-inspected within 12 months in line with HSE guidance

• 100% of people provide asbestos information to contactors visiting site • 144 of those people responding have received asbestos training and 41 have had no asbestos training.

Response Type 3 - I am responsible for arranging for my organisations building maintenance and repair staff to visit our clients premises to undertake repair/maintenance works on their building(s)91 people responded to this response type answering 15 questions. This response constitutes FM companies who send staff out to clients’ sites.

• 75.9% are aware of their duty to manage asbestos with 24.1% not aware of their duty • 82.8% ask clients to provide copies of asbestos information with 8% not asking • 66.7% ensure asbestos surveys are in place for the buildings their staff are visiting with 20.2% not

ensuring surveys are in place • 64 of those people responding provide training on how to interpret an asbestos survey to their staff

and 26 have not provided training. In terms of the responder’s 80 have received asbestos training and 11 have not

• 34.1% of those responding stated their staff encounter asbestos once a month with 29.5% once every six month and 18.2% on an annual basis

• 81.8% are aware that asbestos qualifications are required to undertake an asbestos survey with 11.4% not aware.

Response Type 4 - I visit other people’s commercial buildings to undertake building maintenance and repair activities 110 people answered this response type covering 12 questions. This response constitutes people visiting clients sites to undertake works.

• At 59.6% only just over half of the people responding are aware of the requirements of the duty to manage asbestos and 40.4% are not

• 25% of the people visiting clients’ sites to undertake building repair and maintenance activities have not had asbestos awareness training

• 51.5% are provided with information about asbestos in the buildings which they visit and 35.1% are not • 43.3% believe they have never damaged or disturbed asbestos during their routine activities with 33% who don’t know and 23.7% who have • 55.7% are aware that asbestos qualifications are required to undertake an asbestos survey with 22.7% not aware.

• At 55.9% only just over half of the people responding are aware of the requirements of the duty to manage asbestos and 44.1% are not • 19.1% of the people visiting residential buildings to undertake building repair and maintenance activities have not had asbestos awareness training • 38.5% are provided with information about asbestos in the buildings which they visit and 49.2% are not • Only 40% of those visiting residential buildings to work are required by their employer to ask if the residents are aware of asbestos within the building • 36.9% believe they have never damaged or disturbed asbestos during their routine activities with

23.1% who don’t know and 40% who have • 46.2% are aware that asbestos qualifications are required to undertake an asbestos survey with 24.6%

not aware.

Response Type 6 - I am a Non-Domestic Property Occupier83 people answered this response type covering 8 questions. This response constitutes those that occupy non-domestic premises.

• 19.4% stated they are not asbestos aware at all. 80.6% stated that they have knowledge ranging from enough to get them by to formal asbestos qualifications • 61.1% are aware of the requirements of the Duty to Manage Asbestos and 38.9% are not aware • 49.2% have an asbestos management plan for their property. 22% do not and 28.8% do not know if a management plan is in place • 61% are aware that asbestos qualifications are required to undertake an asbestos survey with 20.3% not aware.
