INTRODUCTION

Grey areas abound in the interpretation of planning legislation and policy. The government’s ongoing programme of planning reform and delays in develop-

ment plan adoption are among factors creating a climate of uncertainty in which parties on all sides see opportunities to press their own interests.

The threat of litigation hovers over almost any major development or infrastructure proposal or local authority planning policy. In this climate, lawyers have a key role to play in ensuring that schemes and policies are fire-proofed against legal challenge.

The government has taken steps to curtail the scope for chal-lenge, but these may make little difference to the volume of liti-gation. Most lawyers predict that the new rules capping costs or-ders against unsuccessful claimants will encourage judi-cial review challenges on planning and environmental grounds.

Some feel that ministers’ general reluctance to use call-in powers on controversial proposals supported by local authorities leaves disappointed objectors little option but to test their arguments through the courts. This ap-plies perhaps most prominently in the hous-ing field, where lawyers see clear signs of market confidence returning.

The Planning Act 2008’s development consent order (DCO) procedure for nationally significant infrastructure projects is now in full swing. Sev-eral schemes approved so far face judicial reviews. Lawyers in this arena have built up valuable expe-rience in managing the DCO application process and making sure the documentation is sound.

The government’s new tax on development pro-posals, the Community Infrastructure Levy (CIL), is another growth area for the legal trade. Many lawyers are advising clients on how local authority CIL charging schedules will affect their schemes. Others are helping councils ensure their charge rates pass the soundness tests set by ministers.

These are just some areas where legal expertise is proving essential for parties seeking to realise their aspirations through the planning system, whether they are developers, local authorities or

third parties. A clear steer on the best sources of legal advice is vital for anyone trying to nego-

tiate this minefield. The Guide to Planning

Lawyers aims to help in two ways. First, it offers an element of peer re-

view via our annual Planning Law Survey. In April, we asked lawyers and planning consultants to nominate so-licitors whose planning work they hold

in high regard and individual so-licitors and barristers whose

work exemplifies best plan-ning law practice. We re-

ceived responses from 284 experts in the field, including 83 solicitors in private practice, 125 barristers, 42 consult-

ants and 34 local author-ity lawyers – the fullest

response ever. The findings are set out in our features sec-

tion (see pages 5-12).Second, the Guide provides a summary on the

services offered by nearly 200 law firms and cham-bers on planning, environmental and commercial matters (see pages 13-16). Finally, the directory sec-tion contains contact details for each organisation (see pages 17-31). Opinion about the best sources of advice on planning can shift rapidly over time. As ever, our annual peer review of the sector shows a few firms of solicitors climbing

the lower rungs of the ratings ladder, and others fall-ing back (see table, page 6). Yet there is consistency in the top tier, with only one new entry in this year’s top ten and three new entries in the top 20.

This year, Berwin Leighton Paisner retains pole position. Its involvement in projects including Lon-don’s Thames Tideway Tunnels and Yorkshire’s White Rose carbon capture and storage project has cemented its position as a key infrastructure player. But partner Tim Pugh points to “trophy develop-ments” such as the University of Cambridge’s ex-pansion project and a track record in resisting legal challenges as key elements of the firm’s offer: “Our work reflects a shift towards a smaller number of nationally significant infrastructure projects (NSIPs) and other high-value schemes.”

Infrastructure, energy, commercial and residen-tial development are the main strands of activity for Eversheds, national head of planning Stuart Andrews reports. The firm is promoting the High Speed Two (HS2) rail link, currently facing a Court of Appeal challenge, while it is exploring the legal

implications of new forms of energy supply in its work on energy firm Cuadrilla’s shale gas explora-tion programme in Lancashire.

Major mixed-use projects feature heavily in SJ Ber-win’s current workload. Judicial review is another staple: the firm is acting for HS2 Action Alliance on its challenge to the HS2 route. Head of planning and environment Simon Ricketts identifies environmen-tal assessment, the Community Infrastructure Levy (CIL) and compulsory purchase as growth areas.

Pinsent Masons partner Richard Ford says the firm’s London team has expanded fast on the Olym-pic Park legacy scheme, the Earls Court mixed-use development and Croydon’s Whitgift Centre redevel-opment. The firm is also advising on 20 development consent orders (DCOs) under the NSIP regime.

At Bircham Dyson Bell, up three places in this year’s top ten, 70 per cent of the work revolves around major infrastructure schemes, including HS2 and Transport for London’s Northern Line extension and London river crossings programmes. “Policy, practice and procedure are constantly evolving in this area,” says head of major projects Robbie Owen.

Herbert Smith Freehills partner Matthew White says knowledge gained during his team’s involve-ment in EDF Energy’s Hinkley Point nuclear plant DCO, approved in March, is feeding through into work in the offshore wind, shale gas and aviation sectors. This spring the firm successfully defended a court challenge to ministerial consent for the re-generation of Crystal Palace Park in south London.

ning Michael Gallimore says his team is also advising widely on CIL charging schedules.

DLA Piper partner Howard Bassford reports that his team is very active in the infrastructure field, cit-ing work to improve grid connections in Cumbria and a tidal energy lagoon planned for Swansea Bay. “The market is sorting itself into firms that can do infrastructure projects and those that can’t,” says Bassford. He also sees a revival in market demand for residential development advice.

Dentons’ planning work ranges from wind farms to waste facilities, residential and retail schemes, local plan and High Court tasks and a broad range of economic development advice. Partner Stephen Ashworth says the firm has reviewed more than 50 CIL charging schedules for retailer Sainsbury’s.

Housing, retail and infrastructure are the most active areas for Ashurst’s team, says partner Trevor Goode. The firm’s work covers high-value housing-led schemes in London, town centre projects in Guildford, Hereford and Portsmouth, the mayor of London’s aviation strategy and ongoing advice to re-tail firms Westfield and Tesco.

At Bristol law firm Burges Salmon, up five places in this year’s table, partner Gary Soloman highlights wind farms, nuclear and road schemes as key areas. Current assignments include the Galloper wind farm off Suffolk and advising Isle of Anglesey Council on Horizon’s plans for a new nuclear plant at Wylfa. “Housebuilding is coming back and we are seeing more compulsory purchase activity,” says Soloman.

Marrons’ infrastructure portfolio includes a pro-posed extension to the Daventry International Rail Freight Terminal, a rail freight interchange at East Midlands Airport and pipeline and harbour facili-ties for a proposed potash mine in North Yorkshire. Senior principal Morag Thomson also cites judicial review work and renegotiation of section 106 agree-ments to ensure scheme viability as mainstays.

Nabarro partner Martin Evans agrees that viability is now a huge factor in lawyers’ workload. “There is simply no fat on most current projects. We’ve been inundated with instructions to advise on CIL and mitigation strategies,” he says.

Highlights of the past year for Clyde and Co include securing permission for CALA Homes’ Barton Farm urban extension in Winchester. Partner Ian Ginbey says planning litigation is a large part of his team’s work, “in part due to the uncertainty over the direc-tion of planning policy under this government”.

Wragge and Co’s planning team’s workload covers expansion plans for London Luton and London City airports, a rail freight exchange in west London, the Crown Estate’s St James’s Market scheme in central London and St Modwen’s regeneration package for the Longbridge car plant in the West Midlands.

May’s merger of Bond Pearce and Dickinson Dees as Bond Dickinson has created a 25-strong planning team which practice head Claire Brook says “will combine strengths in housing, regeneration, devel-opment consent orders, compulsory purchase, re-newables, energy from waste and transport”.

This year’s Planning Law Survey produced no change in the top four positions for the most highly rated planning Queen’s Counsel (QC). However, Rupert Warren

QC climbs into fifth place just two years after tak-ing silk, and Peter Village QC appears in the top ten for the first time.

Martin Kingston QC, who again tops the rank-ings (see profiles, page 12), cannot remember a busier time on large-scale projects and sees no sign of demand slackening. “Clients want advice on the prospects of success but more particularly on how projects should be shaped, their fit with the Nati-onal Planning Policy Framework (NPPF) and the timing of applications and development plan rep-resentations,” he finds.

Major retail and leisure schemes feature strongly in Christopher Katkowski QC’s workload. Katkowski notes a marked increase in legal challenges to per-missions granted by local authorities. “Ministerial call-ins are so few and far between that disgruntled objectors are taking to the courts more and more, however weak their cases might be,” he says.

Ian Dove QC is also seeing plenty of court ac-tion, including successful outcomes on housing-led schemes in Gloucestershire, North Somerset and Cheshire. Dove reckons his court workload has doubled over the past three years. “Government has identified a need for growth and development and

this is matched by increasing controversy at local level,” he finds.

Morag Ellis QC suggests that a “perceived window of opportunity” opened up by the NPPF and better prospects for residential development are boosting the market for legal services. Nationally significant infrastructure project (NSIP) applications and ex-aminations also call for planning silks’ services, she adds: “Promoters recognise that barristers can add value at the early stages of all kinds of projects.”

Warren, who is involved in challenges to the High Speed Two (HS2) rail project and the Hinkley Point nuclear plant in Somerset, also cites a continuing rise in litigation. “A major increase in infrastruc-ture work, including compulsory purchase, is being driven by long procedural timescales,” he says. “Ad-vice on interpretation of the NPPF, often around prematurity and five-year housing land supply is-sues, is another fruitful area.”

David Elvin QC’s current workload includes liti-gation involving HS2, Northern Ireland’s Western Transport Corridor, an energy-from-waste plant in Buckinghamshire and London’s Crystal Palace Park regeneration scheme. “Strategic environmental as-sessment (SEA) and habitats issues arise with great regularity, partly because they raise substantial legal issues on which opponents can focus in making challenges,” he says.

Village’s recent track record includes securing permission for CALA Homes’ Barton Farm urban extension in Winchester, a 1,100-home scheme north of Harlow and expansion of London Ashford Airport in Kent. “There is undoubtedly a rise in compulsory purchase activity as councils and gov-ernment agencies seek to kick-start regenerative projects,” Village says.

Jeremy Cahill QC says he has won permission for more than 1,000 new homes at appeal in the past year, including schemes in Gloucestershire, Rugby and Bromsgrove, and an energy-from-waste plant in Liverpool. “The housing market is starting to move, especially on sites for around 100 homes where up-front infrastructure costs are not too high,” he says.

Simon Bird agrees that housing work is on the rise, given delays in development plan preparation and a renewed emphasis on a five-year land supply. “Councils are seeking to accelerate their local plan processes to avoid planning by appeal, so examina-tion work has picked up,” says Bird, who is advising a string of authorities on emerging local plans.

Russell Harris QC’s work list is dominated by major London schemes at Fulham Football Club’s Craven Cottage stadium, Elizabeth House in Wa-terloo and Elephant and Castle in Southwark. “The planning bar is well placed to provide bespoke guid-ance on NSIPs,” says Harris, who is also working on electricity grid upgrades in Wales and Cumbria.

Robin Purchas QC, who advised on the West Shinfield urban extension in Berkshire approved last year, says commercial and residential work has picked up. “The NPPF and the demise of regional strategies have opened up interesting opportunities for major schemes,” he says. Major infrastructure is another key area: “The NSIP examination process is reinforcing the need for a robust evidence base and well reasoned presentation.”

Five newly appointed silks – Richard Harwood QC, James Maurici QC, James Strachan QC, Sasha White QC and Christopher Boyle QC – appear in this year’s rankings. Harwood, the highest rated, says housing work is recovering, while waste, re-newable energy and High Court work remain strong. “There is an increase in compulsory pur-chase work to bring di�cult sites forward,” he adds.

Top of the ranking of junior barristers is James Pereira, whose current casework includes two off-shore wind farms and compensation claims involv-ing the Olympics development in east London. Pereira thinks the bar could play a bigger part in development plan preparation. “A barrister’s advice on legal compliance with SEA and habitats regula-tions can substantially derisk the process,” he says.

Second-placed Mary Cook lists renewable energy, enforcement, housing need, the Community Infra-structure and renegotiation of planning agreements among a raft of other issues where barristers’ serv-ices are in demand. “Right now, clients want access to lawyers familiar with all the recent legislative changes,” Cook concludes.
