Due to recent enactments of the IT Security Act, the EU Directive on Network and Information Security (NIS Directive) and the EU Data Pro-tection Regulation (GDPR), Chinese companies operating in Germany are facing great challenges when providing internet-based services, collecting or processing data, using social media tools or exchanging data with their headquarters in China. One year after GDPR entered into force, the first court decisions and administrative fines for violations have been made respectively imposed in Germany and other European countries. What could Chinese companies learn from these cases and how to act in line with the legal requirements?

The current debates on Huawei‘s participation in the planned 5G expansion also show how sensitive the market development can be for Chinese companies in certain sectors in Germany. In this event, we will address the problem areas of digitalization typical for Chinese compa-nies and discuss the rules of a public tender against the background of the ongoing 5G spectrum auction and the security concerns over Hua-wei. Together with experienced industry experts, we also share practi-cal and technical compliant solutions. Last but not least, all participants have the opportunity to visit the innovation space of TÜV Rheinland.

Adrian Hoppe

Lawyer and Certified Specialist in IT Law at Lu-ther Cologne. Adrian Hoppe advises national and international clients on all matters pertain-ing to information technology (IT), copyright and data protection law. His specialist areas include, IT outsourcing, IT projects, e-com-merce, IT contracts and data protection, includ-ing implementing data protection compliance at companies. He lectures and publishes on IT and data protection law issues.

Dr. SHEN Yuan

Attorney-at-Law at Luther Cologne. Dr. Shen is a Chinese lawyer and has been working at the Cologne Office / China Desk of the firm since 2010. She mainly advises German and European clients on the incorporation of com-panies, joint ventures and employment law is-sues in China. Another focus of her work is advising Chinese companies on their invest-ments in Europe. She is also an assistant lec-turer at the University of Cologne.

Stefan Eigler

Officer of German Affairs of TÜV Rheinland Greater China. Mr. Bo is responsible for Chi-nese companies in Germany and aligns all of the resources of TÜV Rheinland in Germany and Greater China. Mr. Bo works as the bridge to support Chinese companies to develop the German market and provides necessary as-sistance for buyer engagement and market presence.

Steffen Häberer

Lawyer and Certified Specialist in Public Pro-curement Law at Luther Leipzig. Steffen Hä-berer focusses on providing public procurement law advice to the public sector and corporate law and transaction advice to private compa-nies.
