    KANSAS CONSTITUTIONAL PROVISIONS CONCERNINGLEGISLATIVE POWERS

    Article 2.—LEGISLATIVE

    § 1. Legislative power.—The legislative power of this state shall bevested in a house of representatives and senate.

    § 2. Senators and representatives.—The number of representa-tives and senators shall be regulated by law, but shall not exceed onehundred twenty-five representatives and forty senators. Representativesand senators shall be elected from single-member districts prescribed bylaw. Representatives shall be elected for two year terms. Senators shallbe elected for four year terms. The terms of representatives and senatorsshall commence on the second Monday of January of the year followingelection.

    § 3. Compensation of members of legislature.—The members ofthe legislature shall receive such compensation as may be provided bylaw or such compensation as is determined according to law.

    § 4. Qualifications of members.—During the time that any personis a candidate for nomination or election to the legislature and during theterm of each legislator, such candidate or legislator shall be and remaina qualified elector who resides in his or her district.

    § 5. Eligibility and disqualification of members.—No member ofcongress and no civil officer or employee of the United States or of anydepartment, agency, or instrumentality thereof shall be eligible to be amember of the legislature. Any member of the legislature who acceptsany appointment or election contrary to the foregoing shall be disqualifiedas a member of the legislature..

    § 8. Organization and sessions.—The legislature shall meet in reg-ular session annually commencing on the second Monday in January, andall sessions shall be held at the state capital. The duration of regularsessions held in even-numbered years shall not exceed ninety calendardays. such sessions may be extended beyond ninety calendar days by anaffirmative vote of two-thirds of the members elected to each house. Billsand concurrent resolutions under consideration by the legislature uponadjournment of a regular session held in an odd-numbered year may beconsidered at the next succeeding regular session held in an even-num-bered year, as if there had been no such adjournment.

    The legislature shall be organized concurrently with the terms of rep-resentatives except that the senate shall remain organized during theterms of senators. The president of the senate shall preside over thesenate, and the speaker of the house of representatives shall preside overthe house of representatives. A majority of the members than elected (orappointed) and qualified of the house of representatives or the senateshall constitute a quorum of that house. Neither house, without the con-sent of the other, shall adjourn for more than two days, Sundays excepted.Each house shall elect its presiding officer and determine the rules of itsproceedings, except that the two houses may adopt joint rules on certainmatters and provide for the manner of change thereof. Each house shallprovide for the expulsion or censure of members in appropriate cases.each house shall be the judge of elections, returns and qualifications ofits own members.

    § 9. Vacancies in legislature.—All vacancies occurring in eitherhouse shall be filled as provided by law.

    § 10. Journals.—Each house shall publish a journal of its proceed-ings. The affirmative and negative votes upon the final passage of everybill and every concurrent resolution for amendment of this constitutionor ratification of an amendment to the Constitution of the United Statesshall be entered in the journal. Any member of either house may makewritten protest against any act or resolution, and the same shall be enteredin the journal without delay or alteration.

    § 11. This section was eliminated by the 1974 revision of this article.

    § 12. Origination by either house.—Bills and concurrent resolu-tions may originate in either house, but may be amended or rejected bythe other.

    § 13. Majority for passage of bills.—A majority of the membersthen elected (or appointed) and qualified of each house, voting in theaffirmative, shall be necessary to pass any bill. Two-thirds (2⁄3) of themembers then elected (or appointed) and qualified in each house, votingin the affirmative, shall be necessary to ratify any amendment to theConstitution of the United States or to make any application for congressto call a convention for proposing amendments to the Constitution of theUnited States.

    § 14. Approval of bills; vetoes.—(a) Within ten days after passage,every bill shall be signed by the presiding officers and presented to thegovernor. If the governor approves a bill, he shall sign it. If the governordoes not approve a bill, the governor shall veto it by returning the bill,with a veto message of the objections, to the house of origin of the bill.Whenever a veto message is so received, the message shall be entered inthe journal and in not more than thirty calendar days (excluding the dayreceived), the house of origin shall reconsider the bill. If two-thirds of

    the members then elected (or appointed) and qualified shall vote to passthe bill, it shall be sent, with the veto message, to the other house, whichshall in not more than thirty calendar days (excluding the day received)also reconsider the bill, and if approved by two-thirds of the membersthen elected (or appointed) and qualified, it shall become a law, notwith-standing the governor’s veto.

    If any bill shall not be returned within ten calendar days (excluding theday presented) after it shall have been presented to the governor, it shallbecome a law in like manner as if it had been signed by the governor.

    (b) If any bill presented to the governor contains several items of ap-propriation of money, one or more of such items may be disapproved bythe governor while the other portion of the bill is approved by the gov-ernor. In case the governor does so disapprove, a veto message of thegovernor stating the item or items disapproved, and the reasons therefor,shall be appended to the bill at the time it is signed, and the bill shall bereturned with the veto message to the house of origin of the bill. When-ever a veto message is so received, the message shall be entered in thejournal and, in not more than thirty calendar days, the house of originshall reconsider the items of the bill which have been disapproved. If two-thirds of the members then elected (or appointed) and qualified shallvote to approve any item disapproved by the governor, the bill, with theveto message, shall be sent to the other house, which shall in not morethan thirty calendar days also reconsider each such item so approved bythe house of origin, and if approved by two-thirds of all the membersthen elected (or appointed) and qualified, any such item shall take effectand become a part of the bill.

    § 15. Requirements before bill passed.—No bill shall be passed onthe day that it is introduced, unless in case of emergency declared bytwo-thirds of the members present in the house where a bill is pending.

    § 16. Subject and title of bills; amendment or revival of stat-utes.—No bill shall contain more than one subject, except appropriationbills and bills for revision or codification of statutes. The subject of eachbill shall be expressed in its title. No law shall be revived or amended,unless the new act contain the entire act revived or the section or sectionsamended, and the section or sections so amended shall be repealed. Theprovisions of this section shall be liberally construed to effectuate the actsof the legislature.

    § 17. Uniform operation of laws of a general nature.—All laws ofa general nature shall have a uniform operation throughout the state:Provided, The legislature may designate areas in counties that have be-come urban in character as ‘‘urban areas’’ and enact special laws givingto any one or more of such counties or urban areas such powers of localgovernment and consolidation of local government as the legislature maydeem proper.

    § 18. Election or appointment of officers; filling vacancies.—The legislature may provide for the election or appointment of all officersand the filling of all vacancies not otherwise provided for in thisconstitution.

    § 19. Publication of acts.—No act shall take effect until the enactingbill is published as provided by law.

    § 20. Enacting clause of bills; laws enacted only by bill.—Theenacting clause of all bills shall be ‘‘Be it enacted by the Legislature ofthe State of Kansas:’’. No law shall be enacted except by bill.

    § 21. Delegation of powers’ of local legislation and administra-tion.—The legislature may confer powers of local legislation and admin-istration upon political subdivisions.

    § 22. Legislative immunity.—For any speech, written document ordebate in either house, the members shall not be questioned elsewhere.No member of the legislature shall be subject to arrest—except for trea-son, felony or breach of the peace—in going to, or returning from, theplace of meeting, or during the continuance of the session; neither shallhe be subject to the service of any civil process during the session, norfor fifteen days previous to its commencement.

    § 23. This section was eliminated by the 1974 revision of this article.

    § 24. Appropriations.—No money shall be drawn from the treasuryexcept in pursuance of a specific appropriation made by law.

    § 25. This section was eliminated by the 1974 revision of this article.

    § 26. This section was repealed by the adoption of 1972 HCR 1097,on Aug. 1, 1972.

    § 27. Impeachment.—The house of representatives shall have thesole power to impeach. All impeachments shall be tried by the senate;and when sitting for that purpose, the senators shall take an oath to dojustice according to the law and the evidence. No person shall be con-victed without the concurrence of two-thirds of the senators then elected(or appointed) and qualified.

    § 28. Officers impeachable; grounds; punishment.—The gover-nor and all other officers under this constitution, shall be removed fromoffice on impeachment for, and conviction of treason, bribery, or otherhigh crimes and misdemeanors.

    § 29. This section was eliminated by the 1974 revision of this article.

    § 30. Delegations to interstate bodies.—The legislature may con-fer legislative powers upon interstate bodies, comprised of officers of thisstate or its political subdivisions acting in conjunction with officers ofother jurisdictions, relating to the functions thereof. Any such delegation,and any agreement made thereunder shall be subject to limitation, changeor termination by the legislature, unless contained in a compact approvedby the congress.

    JOINT RULES OF THE SENATE ANDHOUSE OF REPRESENTATIVES

    2009-2010

    Joint rule 1. Joint rules; application and date of expiration; adop-tion, amendment, suspension and revocation. (a) Joint rules; expi-ration, adoption, amendment, suspension and revocation; vote required.Joint rules are adopted under the authority of section 8 of article 2 of theConstitution of the State of Kansas and shall govern matters made subjectthereto except when otherwise specifically provided by joint rule. Jointrules shall expire at the conclusion of the terms of representatives. Jointrules shall be adopted, amended, suspended and revoked by concurrentresolution of the two houses of the legislature. Concurrent resolutionsadopting joint rules shall receive the affirmative vote of not less than amajority of the members then elected (or appointed) and qualified ineach house.

    (b) Amendment, suspension or revocation of joint rules; previous notice;vote required. After one day’s previous notice, joint rules may beamended, suspended or revoked by the affirmative vote of not less thana majority of the members then elected (or appointed) and qualified ineach house. Upon the filing of such notice in either house, a messageshall be sent to the other house advising of the filing of such notice andthe reading of the message shall constitute notice to the members of suchhouse. If such previous notice is not given, the affirmative vote of 2⁄3 ofthe members then elected (or appointed) and qualified in each houseshall be required for the amendment, suspension or revocation of a jointrule.

    (c) Amendment, suspension or revocation of joint rules at commence-ment of legislative session; vote required; conditions. Notwithstanding anyprovision of this rule to the contrary, no notice shall be required for theadoption of a concurrent resolution amending, suspending or revokingany one or more joint rules at the commencement of a legislative session,and adoption of any such concurrent resolution shall require only theaffirmative vote of not less than a majority of the members then elected(or appointed) and qualified in each house, subject to the following con-ditions: (1) The concurrent resolution is sponsored by the speaker or thepresident, and (2) either (a) a copy thereof is mailed to each member ofthe legislature by deposit in the United States mails not later than 11:00p.m. on the Thursday preceding the Monday on which the legislativesession is to commence or (b) in lieu of mailing, copies of the concurrentresolution are made available to members on the first day of the legislativesession and final action is taken on a subsequent legislative day.

    Joint rule 2. Joint sessions. (a) Joint session called by concurrentresolution; vote required; time, place and subject matter. A joint sessionof the senate and house of representatives may be called by concurrent

    resolution adopted by the affirmative vote of not less than a majority ofthe members elected (or appointed) and qualified in each house of thelegislature or as may otherwise be prescribed by law. Any such resolutionshall fix the time and place of the joint session, and the subject matter tobe considered at the joint session. Joint sessions shall consider only suchmatters as are prescribed by law or by the concurrent resolution callingsuch joint session.

    (b) Presiding officer at joint sessions; record of joint session; rules ap-plicable. The speaker of the house of representatives shall preside at alljoint sessions of the senate and house of representatives, and the clerk ofthe house of representatives shall keep a record of the proceedingsthereof and shall enter the record of each such session in the journal ofthe house of representatives. The rules of the house of representativesand the joint rules of the two houses, insofar as the same may be appli-cable shall be the rules for joint sessions of the two houses.

    (c) Votes in joint session; taking; requirements. All votes in a joint ses-sion shall be taken by yeas and nays, and in taking the same it shall bethe duty of the secretary of the senate first to call the names of themembers of the senate, and after which the clerk of the house of repre-sentatives shall in like manner call the names of the members of thehouse. Each member of the senate and the house of representatives pres-ent shall be required to vote on all matters considered in joint session,unless excused by a vote of a majority of the members of both housespresent.

    Joint rule 3. Conference committee procedure. (a) Action byhouse of origin of bill or concurrent resolution amended by other house.When a bill or concurrent resolution is returned to the house of originwith amendments by the other house, the house of origin may: (1) Concurin such amendments; (2) refuse to concur in such amendments; or (3)refuse to concur in such amendments and request a conference on thebill or concurrent resolution.

    (b) Concurrence by house of origin; concurrence prior to taking actionon conference committee report by other house; final action; effect of fail-ure of motion to concur. The house of origin of any bill or concurrentresolution may concur in any amendments made by the other house,except that if the bill or concurrent resolution has been referred to aconference committee such action may only be taken prior to the takingof final action upon the conference committee report upon such bill orconcurrent resolution by the other house. A vote in the house of originof any bill or concurrent resolution on a motion to concur in amendmentsto such bill or concurrent resolution by the other house shall be consid-ered action on the final passage of the bill or concurrent resolution andthe affirmative and negative votes thereon shall be entered in the journal.If the motion to concur is upon amendments to a bill or concurrent res-olution for which a conference committee has been appointed and action

    has not been taken upon the report of such committee by the other houseand such motion fails, the bill or concurrent resolution shall not bedeemed to have been killed thereby, but if the motion to concur is uponamendments to a bill or concurrent resolution for which a conferencecommittee has not been appointed and such motion fails, the bill or con-current resolution shall be deemed to be killed.

    (c) Motion to nonconcur; when considered final action; effect of adop-tion of motion. A vote in the house of origin of any bill or concurrentresolution on a motion to nonconcur or to refuse to concur in amend-ments to such bill or concurrent resolution by the other house which isnot coupled with a request for the appointment of a conference com-mittee shall be considered action on final passage of the bill or concurrentresolution and the affirmative and negative votes thereon shall be enteredin the journal, and the bill or concurrent resolution shall be deemed killedon the adoption thereof.

    (d) House of origin refusal to concur or nonconcur; request for confer-ence; procedure. When a bill or concurrent resolution is returned by ei-ther house to the house of origin with amendments, and the house oforigin refuses to concur or to nonconcur therein, a conference may berequested by a majority vote of the members present and voting. Suchrequest shall be transmitted to the other house by message which shallinclude the names of the conferees on the part of the requesting house.Upon receipt of any such message, the receiving house may, in like man-ner, approve such conference, and shall thereupon notify the requestinghouse by message stating the names of its conferees.

    (e) Membership; appointment; chairperson; house of origin of substi-tute or materially changed bill or concurrent resolution; meetings of con-ference committee. Each conference committee shall consist of threemembers of the senate and three members of the house of representa-tives, unless otherwise fixed by agreement of the president of the senateand speaker of the house. Senate members shall be appointed by thepresident of the senate and house members shall be appointed by thespeaker of the house of representatives. The president or the speakermay replace any conferee previously appointed by such person. Not lessthan one member appointed from each house shall be a member of theminority political party of such house except when such representationfor such house is waived by the minority leader of such house. In all cases,the first-named member of the house of origin of the bill or concurrentresolution assigned to the committee shall be chairperson of the confer-ence committee. The house of origin of a substitute bill or substituteconcurrent resolution shall be the house in which the bill or concurrentresolution in its original form was introduced. The chairperson of a con-ference committee on a bill or concurrent resolution the subject matterof which has been ruled to be materially changed shall be a member ofthe house which amended the bill or concurrent resolution to materiallychange the subject matter. Each conference committee shall meet on the

    call of its chairperson. All meetings of conference committees shall beopen to the public and no meeting shall be adjourned to another time orplace in order to subvert such policy.

    (f) Conference committee reports; subject matters which may be in-cluded; report not subject to amendment; house which acts first on report;copies of reports; reports considered under any order of business. Onlysubject matters which are or have been included in the bill or concurrentresolution in conference or in bills or concurrent resolutions which havebeen passed or adopted in either one or both houses during the currentbiennium of the legislature may be included in the report of the confer-ence committee on any bill or concurrent resolution except in any appro-priations bill there may be included a proviso relating to any such itemof appropriation. A conference committee report shall not be subject toamendment. The original signed conference committee report shall besubmitted to and acted upon first by the house other than the house oforigin of the bill or concurrent resolution. Except when a conferencecommittee report is an agree to disagree coupled with a request that anew conference committee be appointed or is a recommendation to ac-cede to or recede from all amendments of the second house electronicand paper copies of the report shall be made available to all members ofthe house considering the report not later than 30 minutes before thetime of its consideration, except that if the report is more than six pagesin length no paper copies will be required to be distributed to individualmembers provided that at least 10 paper copies of the report are madeavailable to members at the clerk’s or secretary’s desk at the front of therespective house. By written notice, the majority leader may direct theclerk or secretary to increase from six pages to some greater number ofpages the size of conference committee reports that need not be distrib-uted by paper copies to individual members pursuant to this rule. Theaffirmative vote of 2⁄3 of the members present in the house at the time ofconsideration of the report shall be sufficient to dispense with distributionof copies of the conference committee report to all members of thathouse. Reports of conference committees may be received and consid-ered under any order of business.

    (g) Signatures required on conference committee reports. All initial con-ference committee reports other than an agreement to disagree coupledwith a request that a new conference committee be appointed shall besigned by all of the conferees. All initial conference committee reportswhich are an agreement to disagree coupled with a request that a newconference committee be appointed shall be signed by a majority of theconferees appointed in each house. If a conference committee reportwhich is an agreement to disagree coupled with a request that a newconference committee be appointed is not adopted, a subsequent con-ference committee report shall be signed by all conferees unless a sub-sequent conference committee report which is an agreement to disagreecoupled with a request that a new conference committee be appointed is

    adopted, in which case a conference committee report subsequent to theadoption of such report shall be signed by a majority of the confereesappointed in each house. All other conference committee reports shallbe signed by a majority of the conferees appointed in each house.

    (h) Vote to adopt conference committee report final action; effect offailure of motion to adopt conference committee report. The vote to adoptthe report of a conference committee, other than a report of failure toagree coupled with a recommendation for appointment of a new confer-ence committee, shall be considered final action on the bill or concurrentresolution and the affirmative and negative votes thereon shall be enteredin the journal. If the motion fails, the bill or concurrent resolution shallbe deemed to be killed. If the motion on a conference committee reportwhich is an agreement to disagree coupled with a request that a newconference committee be appointed fails, the bill or concurrent resolutionshall not be deemed to have been killed thereby and remains inconference.

    (i) Report of conference committee unable to agree; effect of failure torequest new conference committee; effect of failure of motion to adoptreport requesting new conference committee. If a conference committeeupon any bill or concurrent resolution is unable to agree, it shall reportthat fact to both houses. Such report may request that a new conferencecommittee be appointed thereon. If the committee so reports but fails torequest the appointment of a new conference committee thereon the billor concurrent resolution shall be deemed to have been killed upon theadoption by either house of such report. If the motion to adopt a reportrequesting the appointment of a new conference committee fails, the billor concurrent resolution shall be deemed to be killed.

    (j) Bills or concurrent resolutions under consideration by conferencecommittees and reports thereof; carryover from odd-numbered to even-numbered year. Bills or concurrent resolutions under consideration by aconference committee, or a report of which has been filed but no actiontaken thereon in either house, at the time of adjournment of a regularsession of the legislature held in an odd-numbered year shall remain aliveduring the interim and may be considered by the committee and legis-lature as the case may be at the regular session held in the following even-numbered year.

    Joint rule 4. Deadlines for introduction and consideration ofbills. The senate and house of representatives shall observe the followingschedule of deadlines in making requests for drafting and in the intro-duction and consideration of bills.

    (a) Bill request deadline for individual members. Except for bills intro-duced pursuant to (i) of this rule, no request to draft bills, except thosemade by committees, through their respective chairpersons, shall bemade to, or accepted by, the office of the revisor of statutes after the

    hour of 5:00 p.m. on January 26, 2009, during the 2009 regular sessionand on January 25, 2010, during the 2010 regular session.

    (b) Bill introduction deadline for individual members. Except as pro-vided in (i) of this rule, no bill sponsored by a member or members shallbe introduced in either house of the legislature after the hour of adjourn-ment on February 4, 2009, during the 2009 regular session and on Feb-ruary 3, 2010, during the 2010 regular session. Such deadline for theintroduction of bills by individual members may be changed to an earlierdate in either house at any time by resolution duly adopted by the affir-mative vote of not less than a majority of the members then elected (orappointed) and qualified in such house.

    (c) Bill request deadline for certain committees. Except for bills to beintroduced pursuant to (i) of this rule, no committee except the commit-tee on ways and means of the senate, select committees of either housewhen so authorized, the committee on federal and state affairs of eitherhouse or the house committees on calendar and printing, appropriationsand taxation shall make a request to the office of the revisor of statutesfor any bill to be drafted for sponsorship by such committee after thehour of 5:00 p.m. on January 30, 2009, during the 2009 regular sessionand on February 1, 2010, during the 2010 regular session.

    (d) Bill introduction deadline for certain committees. Except as pro-vided in (i) of this rule, no bill sponsored by any committee of eitherhouse of the legislature, except the committee on ways and means of thesenate, select committees of either house when so authorized, the com-mittee on federal and state affairs of either house or the house committeeson calendar a
