The City Council of said City with approval from the Missouri Department of Transportation reserves the right to reject any and/or all bids, and to waive any irregularities therein.

Employment of Unauthor-ized Aliens Prohibited

(a) Contractor agrees to com-ply with Missouri Revised Stat-ute Section 285.530.1 in that it shall not knowingly employ, hire for employment, or continue to employ an unauthorized alien to perform work within the State of Missouri.

(b) As a condition for the award of this contract, the Con-tractor shall, by sworn affidavit and provision of documentation, affirm its enrollment and partici-pation in a federal work autho-rization program with respect to the employees working in connec-tion with the contracted services. The Contractor shall also sign an affidavit affirming that it does not knowingly employ any per-son who is an unauthorized alien in connection with the contracted services.

(c) Contractor shall require each subcontractor to affirma-tively state in its contract with Contractor that the subcontrac-tor shall not knowingly employ, hire for employment or continue

to employ an unauthorized alien to perform work within the State of Missouri and shall not hence-forth do so. Alternatively, Con-tractor shall require each sub-contractor to provide Contractor with a sworn affidavit under the penalty of perjury attesting to the fact that the subcontractor’s employees are lawfully present in the United States.

Construction Safety Pro-gram Requirements

(a) Contractor shall provide a ten-hour Occupational Safety and Health Administration (OSHA) construction safety program for its employees working onsite on the project. The program shall include a course in construction safety and health approved by OSHA or a similar program ap-proved by the Missouri Depart-ment of Labor and Industrial Relations which is at least as stringent as an approved OSHA program. All employees work-ing on the project are required to complete the program within sixty (60) days of beginning work on the construction project.

(b) Any employee found on the worksite subject to this sec-tion without documentation of the successful completion of the course required under subsec-tion (a) shall be afforded 20 days to produce such documentation before being subject to removal from the project.

(c) Contractor shall require all onsite employees of any subcon-tractors to complete the ten-hour training program required under subsection (a).

(d) Pursuant to Sec. 272.675 RSMo., Contractor shall forfeit as a penalty to the City $2,500.00 plus $100.00 for each employee employed by Contractor or sub-contractor, for each calendar day, or portion thereof, such employee is employed without the required training. The penalty shall not begin to accrue until the time periods in subsections (a) and (b) have elapsed. City shall with-hold and retain from the amount due Contractor under this con-tract, all sums and amounts due and owing City as a result of any violation of this section.

H. Facility Access: The exist-

O. Before submitting their bid, bidders shall carefully examine the drawings and specifications and fully inform themselves as to existing conditions and shall make their bids to carry out and complete the work under such conditions and in strict ac-cordance with the drawings and specifications.

P. Contractors shall comply with all requirements of the State of Missouri’s Department of Labor Standards Excessive Un-employment Law RSMo 290.55 - 290.58.

Q. Contractors shall verify that no employer or business entity employ any unauthorized alien in the State of Missouri to perform work. R. Since the building and site are owned by the City of Wash-ington, the Contractors will be required to obtain a building permit and all other permits, but will not be required to pay for a building permit, or any other permits and fees required by the City of Washington for the con-struction of the building.

S. Addendums may be issued by the Architect during the time of bidding which shall be cov-ered in the bid and will become a part of the Contract. No oral, telephonic, or telegraphic bids or modifications of bids will be en-tertained.

T. Completion Schedule: The entire project shall be completed in 300 consecutive calendar days from Notice to Proceed.

U. Liquidated Damages per Section 8.2.4 of the Supplemen-tary General Conditions: liqui-dated damages apply to the Proj-ect in the amount of $500.00 per day.

V. The results of the bidding will be read publicly immedi-ately following the receipt of all bids on the date bids are due, or as otherwise determined by the Owner. The successful bidder will be announced after the bids can be analyzed and after a con-tract is written and signed with the successful low bidder.
