NIOBRARA COUNTY, WYOMINGApril 3, 2018
The County Commissioners' meeting was called to order on this date at 9:00 a.m. withChairman Richard A. Ladwig, Commissioners Patrick H. Wade, John Midkiff and County ClerkBecky L. Freeman, present.
Road & Bridge- Fred Th omas, Road and Bridge Foreman, met with the Commissionersand discussed road and bridge business.
Danette Welsh, ONEOK's Government Relations representative met with theCommissioners to discuss the Elk Creek Pipeline and its proposed route. She presented a mapshowing the proposed route and an overview of the project. She said it will closely paralleltheexisting Bakken NGL line.
She said that ONEOK is still working through the easement process and their goal is tobe in operation by the third quarter of 2019.
Ms. Welsh said the reason for the new pipeline is because they are at capacity on theBakken line.
She said that ONEOK would be interested in giving back to the community and to sendher the contact information of any interested entities.
She also inquired about using mag chloride for dust control and Mr. Thomas said that itis expensive to use it year after year and he felt that water trucks work best.
The group discussed the use tax on the pipe being used on this project and the taxmoney will be in Wyoming. She said the lay down yard will be in Yoder, and tax monies will bedispersed to the counties in which the pipeline is being laid.
Ms. Welsh thanked the Commissioners and Mr. Thomas for their time.Mr. Thomas discussed road projects and clarified information that was in the previous
minutes. He had stated that Barker Concrete and Construction would be laying the gravel onthe Boner Road project and the actuality is, that the project is still in the bidding process.
He said he had contacted Tom Dunlap regarding auto gates and Mr. Dunlap agreed topurchase the auto gates from the County. Road & bridge will install the auto gates and addthem to the county inventory.
Brian Wakefield, engineer with BenchMark joined the meeting and presented ChangeOrder #2 and Pay Request #4.
Change Order #2- This change order provides for an extension of the contract work toinclude an additional 1.0 mile of K-Field Road Rehabilitation work which was not originallyincluded in the contract because that portion had previously been rehabilitated by the County.However, due to heavy usage as a result of gravel hauling operations for this project, thesurface has been damaged and requires minor repairs and additionalgravel. Mr. Midkiff,moved to approve Changer Order #2for S13,500.00 on the K-Field Road Rehabilitation Project.Mr. Wade seconded, motion carried. The new contract price, including this change order is
s199,106.00.The group discussed the Silver Springs Road right of way with the State and Mr.
Wakefield said they had reviewed their files and could not find a survey for the area inquestion. He said that they can do the required survey at a cost not to exceed 53,500.00.
Mr. Ladwig adjourned the meeting and called a public hearing to order.The purpose of the public hearing was to receive public comment on the change of
zoning application submitted by Skyway Towers, LLC. They are requesting a change of zoning

from agricultural to commercial on land located in the NW1/4NWUa of Section 8, T39N, R61W,for the construction of a cell phone tower out by Mule Creek Junction. Skyway Towers, LLC. willbe leasing a 100' x 100' area to install cellular equipment for a multi-carrier 300' guy tower toserve the Mule Creek and surrounding areas and supply enhanced E-911 services. KenGreenwood, Program Manager for Velocitel, and representing Skyway Towers, LLC. was inattendance to speak in favor of the cell tower being constructed.
Mr. Greenwood said the tower will be a four carrier site and T-Mobile will be the firstcarrier out there. He said it wouldn't take long for other carriers to join.
There was no one in attendance to speak in opposition to the change of zoning.Mr. Ladwig closed the hearing at 10:08 a.m.The regular meeting reconvened at 10:09 a.m.Mr. Wade moved to approve the change of zoning application for Skyway Towers from
agricultural to commercial for the purpose of constructing a cell tower near Mule CreekJunction. Mr. Midkiff seconded, motion carried.
Countv Attornev- Cally Lund- County Attorney, met with the Commissioners viatelephone to discuss county business.
Ms. Lund said she had reviewed the Public Health draft contracts and they appeared tobe in order and have the immunity clause in them.
She discussed criminal activity and standard misdemeanors occurring in the county.Mr. Wade updated her on the survey work to be done on Silver Springs Road.Elected Officials & Department Heads- Rick L. Zerbe, Sherifl James Santistevan,
Emergency Mgmt. Coordinator, KeriThompson, Treasurer, Teri Stephens, Assessor, Denise E.
Smith, UW Extension Coordinator, and Dell Atkinson, Long Term Recovery Manager, met withthe Commissioners to discuss county business and report on office operations.
Mr. Zerbe updated the Commissioners on the progress of the server installation indispatch, said they are full with State prisoners and has ordered signs to place around thecounty warning of high livestock theft areas. He also submitted an estimate from LaramieRange Water Treatment & Plumbing, LLC. for S13,021.60 to replace the water softener in thejail.
Mr. Santistevan said he had visited with someone from the Red Cross regardingemergency shelters in town.
Mr. Atkinson handed out information regarding the Endow bill and Diversify and GrowWY Agriculture.
Mrs. Thompson noted that a new server was ordered for the courthouse.Mrs. Stephens said that Notices of Value were mailed out and they are getting ready for
summer reviews.Mrs. Smith said they were busy as usual. They also discussed the upcoming events
planned by the Northern Cheyenne Tribe Tribal Services acknowledging the 150th Anniversaryof the Signing of the L868 Fort Laramie Treaty. She said that Chrisanna has been in contact withthem and is working on coordinating everything.
The group also discussed the cleaning contracts which will be coming up for bid.Richard also mentioned to the group that there has been an anonymous donor who
wishes to pay for a new elevator system for the library and work has begun.

Denise remained and discussed the cleaning contract. She said that the biggestquestion being asked was about ramifications if the contractor isn't doing the work.
Public Health - Melanie Pea rce, Regional Supervisor, Public Health Nursing, met withthe Commissioners and discussed the Public Health draft memorandums of understanding. Shesaid that some funds will be submitted for travel expense for the Goshen County Public Healthnurse to come up to Lusk. She also stated that there had been some vaccinations requestedand any income from those will go back to Goshen County because it is their vaccine beingused.
They also discussed the Prevention Coalition and that they are trying to do anassessment for the County.
Hospital District- Nathan Hough, CEO and Mark Groh, Hospital Board Chairman, met todiscuss the transfer of 5122,482.00 from the Hospital O & M account to the Hospital District topay for the radiology upgrade at hospital. Also in attendance were Keri Thompson, Treasurer,and Cally Lund, County Attorney, by phone.
The group discussed pay back options to the O & M account which will come from thet%Tax that was just passed.
Ms. Lund will draft a payback contract for the hospitalto reimburse the O & M account.Mr. Wade moved to approve the transfer of 5!22,482.00 from the Hospital O & M
account to the Hospital District to pay for the radiology upgrade. Mr. Midkiff seconded, motioncarried.
Mr. Groh said they are hiring a management company who will take care of the businessend of thingsandwill reportto Mr. Hough, butthe Hospital Board will retain itsauthoritytooversee everything.
Sheriff Zerbe joined the meeting, along with Ms. Lund, to discuss the HVAC assessmentagreement from Baker & Associates. Ms. Lund stated she would contact the engineer to visitabout the agreement.
Consent agenda- Mr. Wade moved to approve the consent agenda. Mr. Midkiffseconded, motion carried. ltems on the consent agenda were the minutes of the March 20,2018 meeting and receipts for the month of March from the County Clerk for 54,038.00 andfrom the Sheriff for 5690.00.
Black Hills Enersv Delesations-The Commissioners laid these back untilthe nextmeeting.
24-Hour Malt Beverage Permit- Mr. Midkiff moved to approve a 24-Hour Malt Beveragepermit for Kathy McConaughey to give away malt beverages at the Bank of the West dinnerparty being held and the Niobrara County Fairgrounds on April 6,2018. Mr. Wade seconded,motion carried.
