S.O. —Whereas, by the Notification of the Government of India in the Ministry of Coal numberS.O. 3037(E), dated the 28th November, 2014 and Amendment Notification number S.O. 2129(E),dated the 5th August, 2015 published in the Gazette of India, Extraordinary, Part II, Section 3,sub-section (ii), dated the 2nd December, 2014 and the 6th August, 2015, respectively, issued undersub-section (1) of Section 4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20of 1957) (herein referred to as the said Act), the Central Government gave notice of its intention toprospect for coal in 1141.477 hectares (approximately) or 2820.59 acres (approximately) of the landsin the locality specified in the Schedule appended to that notification;
And, whereas, the Central Government is satisfied that coal is obtainable in a part of the saidland specified in the Schedule appended to this notification.

Now, therefore, in exercise of the power conferred by sub-section (1) of Section 7 of the CoalBearing Areas (Acquisition and Development) Act, 1957 (20 of 1957), the Central Government herebygives notice of its intention to acquire the land measuring 1141.477 hectares (approximately) or2820.59 acres (approximately) and all rights in or over the said lands specified in the Scheduleappended hereto.
NOTE 1—The plan bearing number MCL/KA/GOCP/NOTIFICATION/2015/16, dated the 23rd August,2015 of the area covered by this notification may be inspected at the office of the GeneralManager (Land/Rehabilitation and Resettlement), Mahanadi Coalfields Limited, Jagruti Vihar,Burla, Sambalpur-768 020, Odisha or at the office of the Collector and District Magistrate,District Angul, Odisha or at the office of the Coal Controller, 1, Council House Street, Kolkata.
NOTE 2—Attention is hereby invited to the provisions of Section 8 of the said Act which provides asfollows:
Objection to acquisition :
“8 (1) Any person interested in any land in respect of which a notification under Section 7 hasbeen issued, may, within thirty days of the issue of the notification, object to the acquisition of thewhole or any part of the land or of any rights in or over such land.
Explanation—It shall not be an objection within the meaning of this section for any person to saythat he himself desires to undertake mining operations in the land for the production of coal and thatsuch operations should not be undertaken by the Central Government or by any other person.
(2) Every objection under sub-section (1) shall be made to the competent authority in writing,and the competent authority shall give the objector an opportunity of being heard either in person or bya legal practitioner and shall, after hearing all such objections and after making such further inquiry, ifany, as he thinks necessary, either make a report in respect of the land which has been notified undersub-section (1) of Section 7 or of rights in or over such land, or make different reports in respect ofdifferent parcels of such land or of rights in or over such land, to the Central Government, containinghis recommendations on the objections, together with the record of the proceedings held by him, thedecision of that Government.
(3) For the purposes of this section, a person shall be deemed to be interested in land whowould be entitled to claim an interest in compensation, if the land or any rights in or over such landwere acquired under this Act.”
NOTE 3—The Coal Controller, 1, Council House Street, Kolkata- 700 001 has been appointed by theCentral Government as the competent authority under Section 3 of the said Act, vide NotificationNumber S. O. 2015, dated the 10th July, 1995, published in Part II, Section 3, sub- section (ii)of the Gazette of India.

The lineproceed from point C towards south east direction reaches at north east corner of plot number4005 and turns towards south direction along west of plot numbers 3909, 4001 and thenmoves towards north east direction and passing through plot numbers 3996 and 3992 andreaches north east corner plot number 6337 and passes along western boundary plot number3990 and reaches south east corner of plot number 6689 then the line turns the south westdirection along south partly boundary then turns towards south east direction and touchesthe common boundary of village Badagunduri and Saradhapur-RF. And then turns towardseast direction passing along the same village boundary and reaches the tri-junction point ofvillage Badagunduri and Saradhapur and Gundurinali then the line turns towards southdirection passes along the common boundary of village Saradhapur RF and Gundurinali andcontinues to the tri- junction point of village Gundurinali, Saradhapur RF and Saradhapurand proceeds along common boundary village of Saradhapur RF and Saradhapur and reachessouth west corner of plot number 263 at point D.
D-E: The line starts from point D and proceeds towards south east direction and reaches at southeast corner of plot number 263 of village Saradhapur then it turns towards north east directionand reaches at tri-junction point of village Saradhapur, Harichandanpur and Gundurinali.Then it turns towards south east direction and passes through common boundary of villageGoilanda and Harichandanpur and reached at North West corner of plot number 194 at pointE.
E-F: The line starts from point E which is situated common boundary of villages Goilanda andHarichandanpur and moves towards north east direction and passes partly through plotnumbers 194, 221, 222, 180, 179, 183 and 178 and reaches at point F.
F-G: The point F is situated at common boundary of village Gundurinali and Goilanda and north westcorner of plot number 1559 of village Gundurinali. Then the line turns towards west directionpassing along south and west boundary of plot number 47. L-M: Point L is situated at north west corner of plot number 1732. The line starts from L andproceeds towards north along east boundary of plot number 1800 of village Gundurinali andreaches at south west corner of plot number 1798 and then moves towards east directionand proceeds along south boundary of plot number 1798 towards north along the sameplot. After reaching the north east corner of plot number 1798 it turns towards east directionand reaches at south east corner of plot number 1797. Then it moves towards north directionalong eastern boundary of plot number 1797 and 1796 and meet at point M which is situatedat north east corner of plot number 1796 of village Gundurinali.
M-N: ‘M-N’ line starts from point ‘M’ and proceeds west along north boundary of plot number 1796and reached at north west corner of plot number 1796 then it moves towards south eastdirection along village road and continued up to south west corner of plot number 1796.Then the line turns towards west and then north west and passes along west of same roadand reached at north east of plot number 1058 and turns west along north of plot numbers1058, 1800 and 1101 at point ‘N’ which is situated at north corner of plot number 1101 ofvillage Gundurinali.

The line ‘V-W’ starts from point ‘V’ moves towardssouth west direction, passes along same common village boundary and reaches at northcorner of plot number 3. Then the line moves towards North-West direction passes alongsame village boundary and reaches at North-West corner of plot number 4. Then the lineturns towards South-West direction along same village boundary and reaches at South-Westcorner of plot number 410. B 1-C1: The line B 1-C 1 starts from point B 1 and move towards east direction passes along commonboundary of villagers Chhelia and Badatribida and reaches point C1, which is situated atNorth East corner of plot number 370 of village Chhelia.
C1-A1: The line C1-A1 starts point C1 moves towards west direction passes along south boundary ofplot number 1666 then it crosses the Kaniha-Gopalprasad road and passes partly throughplot numbers 404, 403, 397, 396, 392, 381, 380, 379, 378, 376, 363, 362, 342, 343, 344,339, 1824, 319,1665 and 318 and reaches at starting point A 1.

Which is point E1 .

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 4 of the CoalBearing Areas (Acquisition and Development) Act, 1957 (Act 20 of 1957), (hereinafter referred to asthe said Act), the Central Government hereby gives notice of its intention to prospect for Coal in theland described in the aforesaid Schedule ;

1. (A) Amendment to Para.-3.5.5 (V) of Note-II of OPWD Code, Vol.-I by modification
NOTE-(II)-Additional Performance Security shall be obtained from the bidder when the bid amountis less than the estimated cost put to tender. In such an event, the bidders who have quoted less bidprice/rates than the estimated cost put to tender shall have to furnish the exact amount of differentialcost, i.e. estimated cost put to tender minus the quoted amount as Additional Performance Security inshape of Demand Draft /Term Deposit Receipt pledged in favour of the Divisional Officer in the sealedenvelope along with the price bid at the time of submission of bids.

Incase of the bidders quoting less bid price/rate than the estimated cost put to tender and have notfurnished the exact amount of differential cost (i.e. estimated cost put to tender minus the quotedamount) as Additional Performance Security in shape of Demand Draft/Term Deposit Receipt, theirprice bid will not be taken into consideration for evaluation even if they have qualified in the technicalbid evaluation.
(B) Amendment to Para.-3.5.5 (V) of Note-Ill of OPWD Code, Vol.-I by modification
NOTE-(lII)-For availing Incentive Clause in any project which is completed before the stipulateddate of completion, subject to other stipulations it is mandatory on the part of the concerned ExecutiveEngineer to report the actual date of completion of the project as soon as possible through Fax ore-mail so that the report is received within 7 (seven) days of such completion by the concernedSuperintending Engineer, Chief Engineer & the Administrative Department.
The incentive for timely completion should be on a graduated scale of 1 (one) per cent to 5(five) per cent of the contract value. Assessment of incentives may be worked out for earlier completionof work in all respect in the following scale :
Before 30% of contract period =5% of Contract Value
Before 20 to 30% of contract period =4% of Contract Value
Before 10 to 20% of contract period =3% of Contract Value
Before 5 to 10 % of contract period =2% of Contract Value
Before 5% of contract period =1% of Contract Value
